		<section display-inline="no-display-inline" id="HF240E1231DA447E29BF73200DAFACB50" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Disabled American Financial Security
			 Act of 2006</short-title></quote>.</text>
		</section><section id="H2AA5C1E3AB8644078957FBC54C2524E8"><enum>2.</enum><header>Disabled American
			 financial security accounts</header>
			<subsection id="HEE6764E87EB9422DB850A052BE4763F6"><enum>(a)</enum><header>In
			 general</header><text>Subchapter F of chapter 1 of the Internal Revenue Code of
			 1986 (relating to exempt organizations) is amended by inserting after part VIII
			 the following new part:</text>

					<part id="H8C6C9E3974C64037AC27A8931DA938FF"><enum>IX</enum><header>Savings for
				individuals with disabilities</header>
						<toc container-level="part-container" idref="H8C6C9E3974C64037AC27A8931DA938FF" lowest-bolded-level="division-lowest-bolded" lowest-level="section" quoted-block="no-quoted-block" regeneration="yes-regeneration">
							<toc-entry idref="HD3DD775346FC41A9A16FA5723EEA645C" level="section">Sec. 530A. Disabled American Financial Security
				  Accounts.</toc-entry>
						</toc>
						<section id="HD3DD775346FC41A9A16FA5723EEA645C"><enum>530A.</enum><header>Disabled
				American Financial Security Accounts</header>
							<subsection id="HE0E18EDED973407FB6407D3858C5D061"><enum>(a)</enum><header>General
				rule</header><text display-inline="yes-display-inline">A Disabled American
				Financial Security Account shall be exempt from taxation under this subtitle.
				Notwithstanding the preceding sentence, such account shall be subject to the
				taxes imposed by section 511 (relating to imposition of tax on unrelated
				business income of charitable organizations).</text>
							</subsection><subsection id="H79E590770A58404AAB31ABBC394BA427"><enum>(b)</enum><header>Definitions and
				special rules</header><text display-inline="yes-display-inline">For purposes of
				this section—</text>
								<paragraph id="HA24FD3A341474CE49251222E1E2452FA"><enum>(1)</enum><header>Disabled
				American Financial Security Account</header><text>The term <term>Disabled
				American Financial Security Account</term> means a trust created or organized
				in the United States (and designated as a Disabled American Financial Security
				Account at the time created or organized) exclusively for the purpose of paying
				qualified disability expenses of an individual who is disabled and who is the
				designated beneficiary of the trust, but only if the written governing
				instrument creating the trust meets the following requirements:</text>
									<subparagraph id="HCEAE12DABD21450E8015FC8882B71191"><enum>(A)</enum><text>No contribution
				will be accepted—</text>
										<clause id="H14E662E4F36242BB893B8BF3D6DDA398"><enum>(i)</enum><text>unless it is in
				cash, and</text>
										</clause><clause id="H22D384F41A914D1097808530526129D3"><enum>(ii)</enum><text display-inline="yes-display-inline">except in the case of rollover
				contributions described in subsection (c)(4), if such contribution would result
				in aggregate contributions for the taxable year and all preceding taxable years
				exceeding $500,000.</text>
										</clause></subparagraph><subparagraph id="H635870E075ED4739BAC8A8E609CB67D9"><enum>(B)</enum><text display-inline="yes-display-inline">The trustee is a bank (as defined in
				section 408(n)) or another person who demonstrates to the satisfaction of the
				Secretary that the manner in which that person will administer the trust will
				be consistent with the requirements of this section.</text>
									</subparagraph><subparagraph id="H2D886ACF85E54367A47958189C6F13E"><enum>(C)</enum><text>No part of the
				trust assets will be invested in life insurance contracts.</text>
									</subparagraph><subparagraph id="H48977390A6D74015BDB68CAB10F743B5"><enum>(D)</enum><text>The assets of the
				trust shall not be commingled with other property except in a common trust fund
				or common investment fund.</text>
									</subparagraph></paragraph><paragraph id="H8A887555C2454BDBA4A88E1C18240968"><enum>(2)</enum><header>Qualified
				disability expenses</header><text display-inline="yes-display-inline">The term
				<quote>qualified disability expenses</quote> means, with respect to an
				individual with a disability, amounts paid or incurred for—</text>
									<subparagraph id="HBF28776C324246A6B00607D63CD6609B"><enum>(A)</enum><text>education, medical
				care, employment training, moving, daily subsistence, and assistive technology,
				and</text>
									</subparagraph><subparagraph id="H27B22F829EA145FDB3DB513D3957500"><enum>(B)</enum><text>after the
				designated beneficiary has attained the age of 18, housing and
				transportation.</text>
									</subparagraph></paragraph><paragraph commented="no" id="H07289AEF92DE49449CD2A84F3B023727"><enum>(3)</enum><header>Individual with
				a disability</header>
									<subparagraph commented="no" id="H863065F241554EDD91C1E2632FCC4E03"><enum>(A)</enum><header>In
				general</header><text>An individual is an individual with a disability if such
				individual has been certified by a physician as having a disability.</text>
									</subparagraph><subparagraph commented="no" id="H453961DF1660430FA06E5B3765904420"><enum>(B)</enum><header>Disability</header><text>The
				term <quote>disability</quote> means disabled (within the meaning of section
				1614(a)(3) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1382c">42 U.S.C. 1382c(a)(3)</external-xref>).</text>
									</subparagraph><subparagraph commented="no" id="H46BC134D2BA54E37825C4297E2FB5C1"><enum>(C)</enum><header>Physician</header><text>The
				term <quote>physician</quote> has the meaning given to such term by section
				1861(r)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(r)(1)</external-xref>).</text>
									</subparagraph></paragraph></subsection><subsection id="H58901B65230342A5BAD8B772E258B100"><enum>(c)</enum><header>Tax treatment of
				distributions</header>
								<paragraph id="H793E6BDE1435402995EDB4D7D46CFB8"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Except as otherwise
				provided in this subsection, any amount paid or distributed out of a Disabled
				American Financial Security Account shall be included in gross income by the
				payee or distributee, as the case may be, for the taxable year in which
				received in the manner as provided in section 72.</text>
								</paragraph><paragraph id="HB003044121644DF8819504F7FACF2B"><enum>(2)</enum><header>Distributions for
				benefit of designated beneficiary</header>
									<subparagraph id="HB51C5E685A7B404DBBA5ECB3B51057E1"><enum>(A)</enum><header>In
				general</header><text>No amount shall be includible in gross income under
				paragraph (1) if the qualified disability expenses of the designated
				beneficiary during the taxable year are not less than the aggregate
				distributions during the taxable year.</text>
									</subparagraph><subparagraph id="H7448490ED81D48508DA71B7FBC22DA"><enum>(B)</enum><header>Distributions in
				excess of expenses</header><text display-inline="yes-display-inline">If such
				aggregate distributions exceed such expenses during the taxable year, the
				amount otherwise includible in gross income under paragraph (1) shall be
				reduced by the amount which bears the same ratio to the amount which would be
				includible in gross income under paragraph (1) (without regard to this
				subparagraph) as the qualified disability expenses bear to such aggregate
				distributions.</text>
									</subparagraph><subparagraph id="H9950C02176A040A395E800A5CB5EFD05"><enum>(C)</enum><header>Disallowance of
				excluded amounts as deduction, credit, or exclusion</header><text>No
				deduction, credit, or exclusion shall be allowed to the taxpayer under any
				other section of this chapter for any qualified disability expenses to the
				extent taken into account in determining the amount of the exclusion under this
				paragraph.</text>
									</subparagraph></paragraph><paragraph id="HA4816D79BC06414FBB936EC400004B6D"><enum>(3)</enum><header>Additional tax
				for distributions not used for benefit of designated beneficiary</header>
									<subparagraph id="H0367FA743A6A45118B1BD247B849D937"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">The tax imposed by
				this chapter for any taxable year on any taxpayer who receives a payment or
				distribution from a Disabled American Financial Security Account shall be
				increased by 10 percent of the amount thereof which is includible in gross
				income under paragraph (1).</text>
									</subparagraph><subparagraph id="HB80B084E94D84B6988B722E93E40FC23"><enum>(B)</enum><header>Exception</header><text>Subparagraph
				(A) shall not apply if the payment or distribution is made to a beneficiary (or
				to the estate of the designated beneficiary) on or after the death of the
				designated beneficiary.</text>
									</subparagraph><subparagraph id="H862573BA0260438D961CFA507C357B3F"><enum>(C)</enum><header>Contributions
				returned before certain date</header><text>Subparagraph (A) shall not apply to
				the distribution of any contribution made during a taxable year if—</text>
										<clause id="H5E01D80827934D4D9F6D95C300AE7D79"><enum>(i)</enum><text>such distribution
				is made before the first day of the sixth month of the taxable year following
				the taxable year, and</text>
										</clause><clause id="H96B06158644F4ACFB14BC4343FE5B450"><enum>(ii)</enum><text display-inline="yes-display-inline">such distribution is accompanied by the
				amount of net income attributable to such excess contribution.</text>
										</clause><continuation-text continuation-text-level="subparagraph">Any net
				income described in clause (ii) shall be included in gross income for the
				taxable year in which such excess contribution was made.</continuation-text></subparagraph></paragraph><paragraph id="HFC4AED8672F948D88E0757ED8C3B2BB"><enum>(4)</enum><header>Rollovers</header><text>Paragraph
				(1) shall not apply to any amount paid or distributed from a Disabled American
				Financial Security Account to the extent that the amount received is paid, not
				later than the 60th day after the date of such payment or distribution, into
				another Disabled American Financial Security Account for the benefit of the
				same beneficiary. The preceding sentence shall not apply to any payment or
				distribution if it applied to any prior payment or distribution during the
				12-month period ending on the date of the payment or distribution.</text>
								</paragraph><paragraph commented="no" id="H1A23105FC7034CA696058B146177FC00"><enum>(5)</enum><header>Change in
				beneficiary</header><text display-inline="yes-display-inline">Any change in the
				beneficiary of a Disabled American Financial Security Account shall not be
				treated as a distribution for purposes of paragraph (1) if the new beneficiary
				is disabled and is a member of the family (as defined in section 529(e)(2)) of
				the old beneficiary.</text>
								</paragraph></subsection><subsection id="H5348BB8ED213469D8DE700FC54632F00"><enum>(d)</enum><header>Tax treatment of
				accounts</header><text display-inline="yes-display-inline">Rules similar to the
				rules of paragraphs (2) and (4) of section 408(e) shall apply to any Disabled
				American Financial Security Account.</text>
							</subsection><subsection id="HF2CB7766193B482DAA5D9400BE26A5"><enum>(e)</enum><header>Community property
				laws</header><text>This section shall be applied without regard to any
				community property laws.</text>
							</subsection><subsection id="H9A1A46E749174F19B5296CAE86FE466"><enum>(f)</enum><header>Custodial
				accounts</header><text>For purposes of this section, a custodial account shall
				be treated as a trust if—</text>
								<paragraph id="H54A1C991AB9046E1A3105F7DA600167"><enum>(1)</enum><text>the assets of such
				account are held by a bank (as defined in section 408(n) or another person who
				demonstrates, to the satisfaction of the Secretary, that the manner in which he
				will administer the account will be consistent with the requirements of this
				section, and</text>
								</paragraph><paragraph id="H853E8A1B5C5645458B9BBF8BBC156914"><enum>(2)</enum><text>the custodial
				account would, except for the fact that it is not a trust, constitute an
				account described in subsection (c)(1).</text>
								</paragraph><continuation-text continuation-text-level="subsection">For
				purposes of this title, in the case of a custodial account treated as a trust
				by reason of the preceding sentence, the custodian of such account shall be
				treated as the trustee thereof.</continuation-text></subsection><subsection id="H462C706888314581B942CCF06DA72231"><enum>(g)</enum><header>Reports</header><text display-inline="yes-display-inline">The trustee of a Disabled American
				Financial Security Account shall make such reports regarding such account to
				the Secretary and to the beneficiary of the account with respect to
				contributions, distributions, and such other matters as the Secretary may
				require. The reports required by this subsection shall be filed at such time
				and in such manner and furnished to such individuals at such time and in such
				manner as may be required.</text>
							</subsection><subsection id="HB6FE849076684879BC4286D8978C07E6"><enum>(h)</enum><header>Coordination
				with means-tested programs</header><text>Amounts held by, or paid or
				distributed from, a Disabled American Financial Security Account shall not be
				taken into account in determining eligibility for, or the amount or extent of,
				benefits provided by any program funded in whole or in part with Federal
				funds.</text>
							</subsection></section></part><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HC2E6E3DE3C4A4DBBBE00AAF0DD4C642E"><enum>(b)</enum><header>Conforming
			 amendments</header>
				<paragraph id="H14B980970A5649FA80260278A1008B75"><enum>(1)</enum><header>Penalty for
			 failure to meet minimum distribution requirement</header><text>Subsection (c)
			 of section 4974 of such Code is amended by striking <quote>or</quote> at the
			 end of paragraph (4), by striking the period at the end of paragraph (5) and
			 inserting <quote>, or</quote>, and by inserting after paragraph (5) the
			 following new paragraph:</text>
					<quoted-block id="H1211B20F69DC4D60A5362365D816C303">
						<paragraph id="HAE8984F5AC924BCFAB75EF079EB070B9"><enum>(6)</enum><text>any Disabled
				American Financial Security Account (as defined in section
				530A(b)).</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H2BEC77488A694556BDD38E001DCD773"><enum>(2)</enum><header>Tax on prohibited
			 transactions</header><text>Subsection (c) of section 4975 of such Code
			 (relating to tax on prohibited transactions) is amended by adding at the end
			 the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="HFF1F1D86FCD047FB8260996549CE52F5" style="OLC">
						<paragraph id="H77A9FAD9ABDC41D491007D3F5349E266"><enum>(7)</enum><header>Special rule for
				Disabled American Financial Security Accounts</header><text display-inline="yes-display-inline">An individual for whose benefit a Disabled
				American Financial Security Account is established and any contributor to such
				account shall be exempt from the tax imposed by this section with respect to
				any transaction concerning such account (which would otherwise be taxable under
				this section) if section 530A(d) applies with respect to such
				transaction.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H76CD4BC1F32F4CE6BCD22E17A32D7F86"><enum>(3)</enum><header>Reports</header><text>Paragraph
			 (2) of section 6693(a) of such Code is amended by redesignating subparagraphs
			 (D) and (E) as subparagraphs (E) and (F), respectively, and by inserting after
			 subparagraph (C) the following new subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="H53503214ACF444CAB5ABDE8123AE22" style="OLC">
						<subparagraph id="H034A3A9C623244F5ABDA88F3B29E6100"><enum>(D)</enum><text display-inline="yes-display-inline">section 530A(g) (relating to Disabled
				American Financial
				SecurityAccounts).</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H322EF28663F8419EA48F4535D9EB40CA"><enum>(c)</enum><header>Clerical
			 amendment</header><text display-inline="yes-display-inline">The table of parts
			 for subchapter F of chapter 1 of such Code is amended by inserting after the
			 item relating to part VIII the following new item:</text>

					</toc>
					<after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HA0BD6294D58B46EDBAF5BDE8FCF5C24"><enum>(d)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to taxable
			 years beginning after December 31, 2006.</text>
