		<legis-type>A BILL</legis-type>
		<official-title>To amend title 10, United States Code, to provide that,
		  in the case of any member or former member of a reserve component of the Armed
		  Forces who is deployed to a combat theater due to an administrative error by
		  the Department of Defense, the member shall be given nonregular service
		  retirement credit equal to six times the length of the mistaken
		  deployment.</official-title>

		<section id="HD463E299525E44BC9426A7EDF1EFBAF3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Erroneous Deployment Compensation
			 Act</short-title></quote>.</text>
		</section><section id="H54D291B1D9E540BAA9D984835D83E5A1" section-type="subsequent-section"><enum>2.</enum><header>Additional nonregular
			 service retirement credit for member or former member of a reserve component
			 deployed to a combat theater due to an administrative error by the Department
			 of Defense</header>
			<subsection id="H9EC61315D085434091AD858E80003212"><enum>(a)</enum><header>Retired pay
			 eligibility</header><text><external-xref legal-doc="usc" parsable-cite="usc/10/12732">Section 12732</external-xref> of title 10, United States Code, is
			 amended by adding at the end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="HDBF2C89E850A4F78ABDE26E7BC8F4ED8" style="USC">
					<subsection id="HE6D41CF33A204583907300DEB9843474"><enum>(c)</enum><text>In the case of a
				person who, as determined by the Secretary of Defense, was ordered to active
				duty after September 11, 2001, and deployed to a combat theater of operations
				only by reason of administrative error by Department of Defense personnel, the
				person’s years of service computed under subsection (a) are increased by five
				additional years for each year of service credited under subsection (a)(2)
				during which the person had 50 days or more of active service in the combat
				theater of
				operations.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HD013B8415E664190ADFCEB6D800D57F"><enum>(b)</enum><header>Retired pay
			 computation</header><text display-inline="yes-display-inline">Section 12733 of
			 title 10, United States Code, is amended by adding at the end the following new
			 paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="HCA9CBF6406EE423AB93EA380E0A48925" style="USC">
					<paragraph id="H624A911C77B742C4B4CA8EB6BA00AF40"><enum>(5)</enum><text display-inline="yes-display-inline">In the case of a person who, as determined
				by the Secretary of Defense, was ordered to active duty after September 11,
				2001, and was deployed to a combat theater of operations only by reason of
				administrative error by Department of Defense personnel, five days (in addition
				to the days credited under paragraph (1)) for each day during which the person
				was so deployed in a combat theater of operations by reason of administrative
				error.</text>
