<enum>I</enum><header>Educational
assistance to officers disabled in the line of duty</header>
<section id="H03514AB0F932440CBE86D79BDB05B31E"><enum>101.</enum><header>Basic
eligibility</header><text display-inline="no-display-inline">Section 1212(a)(1)
of the <act-name parsable-cite="OCCSS">Omnibus Crime Control and Safe Streets
Act of 1968</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/3796d-1">42 U.S.C. 3796d–1(a)(1)</external-xref>) is amended—</text>
<paragraph id="HBCC63E2EA2C14D9D899225CFC44EC0A8"><enum>(1)</enum><text>by striking
<quote>a dependent</quote> and inserting <quote>an eligible dependent</quote>;
and</text>
</paragraph><paragraph id="H5E6E894FE20B45E4B89B5F27DC87DF2B"><enum>(2)</enum><text>by striking
<quote>education</quote> and all that follows through the period at the end and
inserting <quote>education.</quote>.</text>
</paragraph></section><section id="HE92D6718CCB341C2949C36AEEAE72200"><enum>102.</enum><header>Applications;
Approval</header><text display-inline="no-display-inline">Section 1213 of the
<act-name parsable-cite="OCCSS">Omnibus Crime Control and Safe Streets Act of
1968</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/3796d-2">42 U.S.C. 3796d–2</external-xref>) is amended—</text>
<paragraph id="HC2A4D1FFB12E4E68932F853B292E4E28"><enum>(1)</enum><text>in subsection
(b)—</text>
<subparagraph id="HA1A8B644E65C41E183F72FF15DB98B50"><enum>(A)</enum><text>by striking
<quote>the dependent</quote> each place it appears and inserting <quote>the
applicant</quote>; and</text>
</subparagraph><subparagraph id="HA69D5A0562484BC9B3FE8DECF515E476"><enum>(B)</enum><text>by striking
<quote>the dependent’s</quote> each place it appears and inserting <quote>the
applicant’s</quote>; and</text>
</subparagraph></paragraph><paragraph id="HB61B8FD061784C9C932C5C48C514C697"><enum>(2)</enum><text>in subsection (c),
by striking <quote>a dependent</quote> and inserting <quote>an

</paragraph></section><section id="H7A908D57C8154C3CA822516CBCF7F489"><enum>103.</enum><header>Retroactive
benefits</header><text display-inline="no-display-inline">Section 1216(a) of
the <act-name parsable-cite="OCCSS">Omnibus Crime Control and Safe Streets Act
of 1968</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/3796d-5">42 U.S.C. 3796d–5(a)</external-xref>) is amended to read as follows:</text>
<quoted-block act-name="Omnibus Crime Control and Safe Streets Act of 1968" id="HAED952026B3F410BB9BA004BD1BFF012">
<subsection id="HF4ED744C7EF54A1C9B58021FCEDDC25F"><enum>(a)</enum><header>Retroactive
eligibility</header><text>Notwithstanding any other provision of law, but
subject to the limitations of this subpart, an eligible dependent of a public
safety officer shall be eligible for assistance under this subpart if such an
officer—</text>
<paragraph id="HE233CED4482E4E098977AD288F88E547"><enum>(1)</enum><text>dies in the line
of duty on or after January 1, 1978; or</text>
</paragraph><paragraph id="H9A5FC006FD5348A5B6403BB7BC2CD0B1"><enum>(2)</enum><text display-inline="yes-display-inline">becomes permanently and totally disabled as
the direct result of a catastrophic injury sustained in the line of duty on or
after January 1,
1978.</text>
</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
</section><section id="H8E148F331333413B8FC108D8F3F38B43"><enum>104.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 1217 of the
<act-name parsable-cite="OCCSS">Omnibus Crime Control and Safe Streets Act of
1968</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/3796d-6">42 U.S.C. 3796d–6</external-xref>) is amended by adding at the end the
following new paragraphs:</text>
<quoted-block act-name="Omnibus Crime Control and Safe Streets Act of 1968" id="HD1667EF909F44568B8AA96C1DB2854FD">
<paragraph commented="no" id="H5299ECE5904C478687A8A80054D638D8"><enum>(4)</enum><text>The term
<term>eligible dependent</term> means—</text>
<subparagraph commented="no" id="HE004AC38354C48BCAFF75149D7216CA"><enum>(A)</enum><text>any public safety
officer who is eligible to receive benefits under section 1201(b);</text>
</subparagraph><subparagraph commented="no" id="H36797EE4E7164776B2133B7BE001227B"><enum>(B)</enum><text display-inline="yes-display-inline">the child of any public safety officer who
is described in section 1201(a), or who is eligible to receive benefits under
section 1201(b); and</text>
</subparagraph><subparagraph commented="no" id="H3BCF7E62C54F49149966EF6072482610"><enum>(C)</enum><text>the spouse of any
public safety officer described in subparagraph (B) at the time of such
officer’s death or on the date of such officer’s totally and permanently
disabling injury.</text>
</subparagraph></paragraph><paragraph id="H985220F92CF44F3EA8DBF5E2D0DB9900"><enum>(5)</enum><text>The term
<term>public safety officer</term> includes—</text>
<subparagraph id="H7199BEBB31574062A319A2BAE12727B"><enum>(A)</enum><text>any public safety
officer described in paragraph (9) of section 1204; and</text>
</subparagraph><subparagraph id="HF2E02CC4ECB744F2A63FC07251004B82"><enum>(B)</enum><text>any other
individual who is employed by any Federal, State, county, or local agency and,
as a result of such employment, is—</text>
<clause id="H800DCB40CFD64AAE9497C479892DC6F3"><enum>(i)</enum><text>empowered by law
to conduct an investigation of or to make an arrest for a felony offense;
or</text>
</clause><clause id="H07EF2239377D480DB7BF9392FAE78800"><enum>(ii)</enum><text>authorized by law
to prosecute or participate in the prosecution of a felony
offense.</text>
</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
</section><enum>II</enum><header>Survivor
Pensions</header>
<section id="H0882964FC3524349893EDBC2BBCCDC"><enum>201.</enum><header>Survivor
pensions</header><text display-inline="no-display-inline">Part L of the Omnibus
Crime Control and Safe Streets Act of 1968 is further amended by adding after
section 1218 (<external-xref legal-doc="usc" parsable-cite="usc/42/3796d-7">42 U.S.C. 3796d-7</external-xref>) the following new subpart:</text>
<quoted-block display-inline="no-display-inline" id="H15368E06CF51498E93AF972878BA5F8" style="OLC">
<subpart id="H2024FCA41A5645B79CE4BAE1F610B311"><enum>3</enum><header>Survivor
Pensions</header>
<section id="H9A0025B0138249B289D5F0805143A894"><enum>1221.</enum><header>Survivor
pensions established</header><text display-inline="no-display-inline">In any
case in which the Bureau is required to pay a benefit under section 1201(a),
the Bureau shall also pay an annual pension to one or more survivors of the
deceased public safety officer in accordance with this subpart.</text>
</section><section id="H09FCCBB24FA643E5ACD17EF6B26110FE"><enum>1222.</enum><header>Payments to
beneficiaries</header>
<subsection id="H41BE87D704A84AD7A66291CF60D20400"><enum>(a)</enum><header>Beneficiaries
determined</header><text display-inline="yes-display-inline">An annual pension
under this subpart shall be paid to one or more survivors of the deceased
public safety officer as follows:</text>
<paragraph id="H144EF7B1CE8048FC94B0A9B4A2B4E6D8"><enum>(1)</enum><text>If there is a
surviving spouse of such officer, a pension equal to 80 percent of the
applicable amount under
<internal-xref idref="H3F2EF8EA40E94765AC8BAEAB25B2DBE2" legis-path="1223.">section 1223(a)</internal-xref>, paid to the surviving
spouse.</text>
</paragraph><paragraph id="H8E4EEA47C12046059127096DDAC7584"><enum>(2)</enum><text>If there is no
surviving spouse, but—</text>
<subparagraph id="HBB560BE63C224542B1787624D1CD70CC"><enum>(A)</enum><text display-inline="yes-display-inline">there is one surviving child of such
officer, a pension equal to 20 percent of the applicable amount under
<internal-xref idref="H9A0025B0138249B289D5F0805143A894" legis-path="1221.(b)">section 1223(a)</internal-xref>, paid to that surviving
child;</text>
</subparagraph><subparagraph id="H2E064947A0AA44918DA75EDBDDDDD67B"><enum>(B)</enum><text display-inline="yes-display-inline">there are two surviving children of such
officer, a pension equal to 35 percent of the applicable amount under
<internal-xref idref="H9A0025B0138249B289D5F0805143A894" legis-path="1221.(b)">section 1223(a)</internal-xref>, paid to the children in
equal shares;</text>
</subparagraph><subparagraph id="H02CF0FC50CA84B51A91554C06FA8F5AF"><enum>(C)</enum><text display-inline="yes-display-inline">there are three surviving children of such
officer, a pension equal to 50 percent of the applicable amount under
<internal-xref idref="H3F2EF8EA40E94765AC8BAEAB25B2DBE2" legis-path="1223.">section 1223(a)</internal-xref>, paid to the children in
equal shares; or</text>
</subparagraph><subparagraph id="H05E712D3952545AE9000C7792665D417"><enum>(D)</enum><text display-inline="yes-display-inline">there are four or more surviving children
of such officer, a pension equal to 60 percent of the applicable amount under
<internal-xref idref="H3F2EF8EA40E94765AC8BAEAB25B2DBE2" legis-path="1223.">section 1223(a)</internal-xref>, paid to the children in
equal shares.</text>
</subparagraph></paragraph><paragraph id="H86E9DCCCD9614340BAC5B97EA9176978"><enum>(3)</enum><text>If there is no
surviving spouse or surviving child, but—</text>
<subparagraph id="H9F373EE5CF64461F00158F49A718DEA0"><enum>(A)</enum><text display-inline="yes-display-inline">there is one surviving parent of such
officer, a pension equal to 20 percent of the applicable amount under
<internal-xref idref="H3F2EF8EA40E94765AC8BAEAB25B2DBE2" legis-path="1223.">section 1223(a)</internal-xref>, paid to that parent;
or</text>
</subparagraph><subparagraph id="H274F6EFF2E474380BFEBE6D6F0E8A32"><enum>(B)</enum><text display-inline="yes-display-inline">there are two surviving parents of such
officer, a pension equal to 40 percent of the applicable amount under
<internal-xref idref="H3F2EF8EA40E94765AC8BAEAB25B2DBE2" legis-path="1223.">section 1223(a)</internal-xref>, paid to the parents in
equal shares.</text>
</subparagraph></paragraph><paragraph id="H718F1613022949D6BA9048A7F72274CD"><enum>(4)</enum><text display-inline="yes-display-inline">If none of the above, a pension equal to 20
percent of the applicable amount under
<internal-xref idref="H3F2EF8EA40E94765AC8BAEAB25B2DBE2" legis-path="1223.">section 1223(a)</internal-xref>, paid—</text>
<subparagraph id="H7F42AB94EE65463392B5EE1F4657CFBD"><enum>(A)</enum><text>in the case of a
claim made on or after the date that is 90 days after the date of the enactment
of this subparagraph, to the individual designated by such officer as
beneficiary under this subpart in the officer’s most recently executed
designation of beneficiary on file at the time of death with such officer’s
public safety agency, organization, or unit, provided that such individual
survived such officer; or</text>
</subparagraph><subparagraph id="H09A04650D6D0477096E9802E5D2F53CD"><enum>(B)</enum><text display-inline="yes-display-inline">if there is no individual qualifying under
<internal-xref idref="H7F42AB94EE65463392B5EE1F4657CFBD" legis-path="1222.(a)(4)(A)">subparagraph (A)</internal-xref>, to the individual
designated by such officer as beneficiary under such officer’s most recently
executed life insurance policy on file at the time of death with such officer’s
public safety agency, organization, or unit, provided that such individual
survived such officer.</text>
</subparagraph></paragraph></subsection><subsection id="H22C1CDC4DCA44906B20035E7F6DC5156"><enum>(b)</enum><header>Payable for
Lifetime</header><text>An annual pension or share of a pension under this
section shall be paid for the lifetime of the beneficiary, without regard to
the marital status or any other status of the beneficiary.</text>
</subsection></section><section id="H3F2EF8EA40E94765AC8BAEAB25B2DBE2"><enum>1223.</enum><header>Pension
amount</header>
<subsection id="HB4EB6E0802584483A1502B528FC358BD"><enum>(a)</enum><header>Amount used to
determine annual pension</header><text>The amount used to determine the amount
of an annual pension under this subpart shall be the greater of the
following:</text>
<paragraph id="H30B00F4933F2475DB303CAD75335C87"><enum>(1)</enum><text display-inline="yes-display-inline">The annual base salary of the officer at
the time of the officer’s death, adjusted in accordance with
<internal-xref idref="H238849FECE204E0BA5D678F685E26F72" legis-path="1223.(b)">subsection (b)</internal-xref>.</text>
</paragraph><paragraph id="HF0BFE60BA9624BA2866CC891B78BFF02"><enum>(2)</enum><text display-inline="yes-display-inline">$60,000, adjusted in accordance with
<internal-xref idref="H238849FECE204E0BA5D678F685E26F72" legis-path="1223.(b)">subsection (b)</internal-xref>.</text>
</paragraph></subsection><subsection id="H238849FECE204E0BA5D678F685E26F72"><enum>(b)</enum><header>Cost of living
adjustments</header><text>On October 1 of each fiscal year beginning after the
effective date of this subpart, the Bureau shall adjust the amounts used to
determine the amount of an annual pension under this subpart immediately before
such October 1 under
<internal-xref idref="HB4EB6E0802584483A1502B528FC358BD" legis-path="1223.(a)">subsection (a)</internal-xref>, to reflect the annual
percentage change in the Consumer Price Index for All Urban Consumers,
published by the Bureau of Labor Statistics, occurring in the 1-year period
ending on June 1 immediately preceding such October 1.</text>
</subsection></section><section id="H30C25A56AEB94FFDB56709BD77D58C31"><enum>1224.</enum><header>Definition</header><text display-inline="no-display-inline">Notwithstanding paragraph (3) of section
1204, for the purposes of this subpart the term <term>child</term> means any
natural, illegitimate, adopted, or posthumous child or stepchild of a deceased
public safety officer.</text>
</section></subpart><after-quoted-block>.</after-quoted-block></quoted-block>
</section><enum>III</enum><header>Public safety
officer scholarships</header>
<section id="HE02158AB4B7B4941A29417CD1171BAF"><enum>301.</enum><header>Public Safety
Officer Scholarships</header>
<subsection id="H710EF432A0BB44EE8D3B2241C15628F"><enum>(a)</enum><header>In
general</header>
<paragraph id="HF27A556708494E47BF2E3FF22BA13096"><enum>(1)</enum><header>Scholarship
awards</header><text>The Secretary of Education is authorized to award a Public
Safety Officer scholarship, in accordance with this title, to—</text>
<subparagraph id="H42AF7E37F0E54790BB4866A0878720B3"><enum>(A)</enum><text>any eligible
applicant who is attending, or who has been accepted for attendance at, any
eligible institution providing instruction for one or more grades of
kindergarten, elementary school, or secondary school; and</text>
</subparagraph><subparagraph id="HFD13A0E79D2D417DAD22A342B5A7B134"><enum>(B)</enum><text display-inline="yes-display-inline">any eligible applicant who is enrolled, or
has been accepted for enrollment, as a full-time or part-time postsecondary
student in any eligible institution providing a degree-granting program for one
or more postsecondary degrees.</text>
</subparagraph></paragraph><paragraph id="H6B22690562E540F0A6707BBC34F5D589"><enum>(2)</enum><header>Application</header><text display-inline="yes-display-inline">To receive a scholarship award under this
title, an eligible applicant shall submit an application to the Secretary at
such time, in such manner, and containing such information as the Secretary may
require. Such an application shall be accompanied by a certification from the
head of the public safety agency, organization, or unit that employed the
public safety officer by reason of whom the applicant is claiming eligibility,
certifying that such officer is a deceased or disabled officer, as defined in
<internal-xref idref="H35BFD1D2151F4326814B01106D886143" legis-path="305.(1)">paragraph (1) of section 305</internal-xref>.</text>
</paragraph></subsection><subsection id="H888622F9383B4826AB19A339C652EDC7"><enum>(b)</enum><header>Maximum
award</header>
<paragraph id="HD375483E0CC54BCBA3C8000002F1A4ED"><enum>(1)</enum><header>Elementary and
secondary awards</header><text>For any academic year, the maximum amount of a
scholarship award under this section for a kindergarten, elementary school, or
secondary school student shall not exceed the lesser of the following:</text>
<subparagraph id="HA8BC1889C2A74FDDB2FAFB393949FB52"><enum>(A)</enum><text>The average per
pupil expenditure for elementary and secondary education of the local
educational agency for the geographic area in which the eligible applicant
resides.</text>
</subparagraph><subparagraph id="H3FF30E255AE147DBAE41881DDF96ED61"><enum>(B)</enum><text>The actual cost to
the student for attendance at the school, including expenses such as tuition,
fees, books, transportation costs, and other related expenses, as determined by
the Secretary.</text>
</subparagraph></paragraph><paragraph id="HC08B78CC33454EED84BAF6CFAA558C25"><enum>(2)</enum><header>Postsecondary
awards</header><text>For any academic year, the maximum amount of a scholarship
award under this section for a postsecondary student shall not exceed the
lesser of the following:</text>
<subparagraph id="HEDE6FB76A6BB4DE392C4CFBDF7B002D"><enum>(A)</enum><text>The average cost of
attendance (as defined in section 472 of the <act-name parsable-cite="HEA65">Higher Education Act of 1965 </act-name> (20 U.S.C.
1087kk)), at a State university in the State in which the student resides, for
a State resident carrying the same academic workload as the student, with the
same number of dependents as the student, and residing in the same type of
housing as the student.</text>
</subparagraph><subparagraph id="HD0DB7ADA3CED464DB7ACA444781ED103"><enum>(B)</enum><text display-inline="yes-display-inline">The actual cost of attendance (as defined
in section 472 of the <act-name parsable-cite="HEA65">Higher Education Act of
1965 </act-name>(<external-xref legal-doc="usc" parsable-cite="usc/20/1087kk">20 U.S.C. 1087kk</external-xref>)) of such student.</text>
</subparagraph></paragraph></subsection><subsection id="H4EAF86B4B2BE4F9F8918B4101819D39C"><enum>(c)</enum><header>Award
period</header><text>The maximum duration of each scholarship award under this
title—</text>
<paragraph id="H552C592EFC9C4FA095F72467E2C1A4FB"><enum>(1)</enum><text>for a
kindergarten, elementary school, or secondary school student, shall be the
period of time normally required for the completion of a high school diploma by
a student in the grade that the recipient is in at the time the award
commences, as determined by the Secretary; and</text>
</paragraph><paragraph id="H099194D93B824EB6A600D3DB985B633D"><enum>(2)</enum><text>for a
postsecondary student, shall be the lesser of—</text>
<subparagraph id="HF19FCDA1D9AF491C9BD26F53026202AE"><enum>(A)</enum><text>the time actually
required by the student to complete the course of study for which the student
is receiving the scholarship award under this title;</text>
</subparagraph><subparagraph id="H35E698FFD6AE449CB342F463E58CF144"><enum>(B)</enum><text>6 years, in the
case of a student enrolled in undergraduate studies; or</text>
</subparagraph><subparagraph id="H026EC34AC9D94695B7E0A979A7F3F987"><enum>(C)</enum><text>3 years, in the
case of a student enrolled in postgraduate studies.</text>
</subparagraph></paragraph></subsection><subsection id="HC91F77D0B05744C987F4491D0096FC80"><enum>(d)</enum><header>Notification</header><text>The
Secretary shall notify the applicant and the eligible institution of the
applicant’s selection for receipt of a scholarship award under this title, and
the conditions pertaining to scholarship award eligibility and
continuance.</text>
</subsection><subsection id="HE299AAB52A574B3190EB32E78C905777"><enum>(e)</enum><header>Fiscal
agent</header><text>The Secretary shall, if practicable, use eligible
institutions as fiscal agents for the payment of scholarship awards.</text>
</subsection></section><section id="H22B11EFC959A4894A574F1C9E055BDC"><enum>302.</enum><header>Additional award
requirements</header><text display-inline="no-display-inline">A student awarded
a scholarship under this title shall demonstrate to the satisfaction of the
Secretary, as a condition for initial receipt of such award and periodically
thereafter as a condition for its continuation, that the student is—</text>
<paragraph id="H6D7EFD8AE8C34AA7A2F8BEA1A373F0F5"><enum>(1)</enum><text>maintaining
satisfactory progress in the course of study the student is pursuing—</text>
<subparagraph id="HDE4D3D5A5DBA4FC6A49E05EC3F134895"><enum>(A)</enum><text>in the case of a
kindergarten, elementary school, or secondary school student, as such
satisfactory progress is determined by the Secretary; and</text>
</subparagraph><subparagraph id="H13FABFB549214C4587CEAD9750B94311"><enum>(B)</enum><text>in the case of a
postsecondary student, consistent with section 484(c) of the
<act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name>;</text>
</subparagraph></paragraph><paragraph id="H4425131EAB1A42A9A8585BC6156B8671"><enum>(2)</enum><text>committed to
remaining drug-free; and</text>
</paragraph><paragraph id="H73721C57CD3F4CCA949579222249C794"><enum>(3)</enum><text>attending classes
on a regular basis so as not to interfere with the normal course of studies,
except for excused absence for vacation, illness, military service, or such
other reason deemed good cause by the eligible institution or the
Secretary.</text>
</paragraph></section><section id="H6D30CDF20A064B6A90C097C07A3FB2E"><enum>303.</enum><header>Agreements with
eligible institutions</header><text display-inline="no-display-inline">For the
purposes of this title, the Secretary is authorized to enter into agreements
with eligible institutions in which any student receiving a scholarship award
under this title has enrolled or has been accepted for enrollment. Each such
agreement shall provide—</text>
<paragraph id="H9339688827564D1A93D9C29197E380E2"><enum>(1)</enum><text>that the
institution shall cooperate with the Secretary in carrying out this title,
including the provision of information necessary for a student to satisfy the
requirements in
<internal-xref idref="H22B11EFC959A4894A574F1C9E055BDC" legis-path="302.">section 302</internal-xref>;</text>
</paragraph><paragraph id="H456CAABE9C79464D00DEADD92EA7714B"><enum>(2)</enum><text>that the
institution shall conduct a periodic review to determine whether students
enrolled at the institution and receiving a scholarship award under this title
continue to be eligible to receive such scholarship award, and shall notify the
Secretary of the results of such reviews; and</text>
</paragraph><paragraph id="H506305115E8147C590B23E41F3EBFCA9"><enum>(3)</enum><text>for control and
accounting procedures as may be necessary to assure proper disbursement and
accounting of funds paid to the institution under
<internal-xref idref="HE299AAB52A574B3190EB32E78C905777" legis-path="301.(e)">section 301(e)</internal-xref>.</text>
</paragraph></section><section commented="no" id="HA9207305178141788E671D4BAEE2128"><enum>304.</enum><header>Treatment of
scholarships for purposes of financial aid</header><text display-inline="no-display-inline">Notwithstanding any other provision of law,
a scholarship award received under this title shall not be taken into account
in determining the need or eligibility of a person for student financial
assistance, or the amount of such assistance, under title IV of the
<act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (20
U.S.C. 1001 et seq.).</text>
</section><section id="H4A9BDB29CBA642269DA3C21715C07F5F"><enum>305.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>
<paragraph id="H35BFD1D2151F4326814B01106D886143"><enum>(1)</enum><header>Deceased or
disabled officer</header><text>The term <term>deceased or disabled
officer</term> means a public safety officer with respect to whom the Bureau of
Justice Assistance has determined, in accordance with section 1201 of the
<act-name parsable-cite="OCCSS">Omnibus Crime Control and Safe Streets Act of
1968</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/3796">42 U.S.C. 3796</external-xref>) and under regulations issued pursuant to part
L of such Act, that such public safety officer—</text>
<subparagraph id="H352C088B1873492880912E975ED1A77D"><enum>(A)</enum><text>has died as the
direct and proximate result of a personal injury sustained in the line of duty;
or</text>
</subparagraph><subparagraph id="H2882FF46B09C42479E82CE2CD4DF1225"><enum>(B)</enum><text display-inline="yes-display-inline">has become permanently and totally disabled
as the direct result of a catastrophic injury sustained in the line of
duty.</text>
</subparagraph></paragraph><paragraph id="H1D95CC4FDFC9479EBAA250FC9552DE86"><enum>(2)</enum><header>Dependent
child</header><text>The term <term>dependent child</term> means a child of a
deceased or disabled officer, including a stepchild or an adopted child,
who—</text>
<subparagraph id="H4818C4E8B9C448A8BE5390B5ACB41C9E"><enum>(A)</enum><text display-inline="yes-display-inline">is living with or receiving regular support
contributions from such deceased or disabled officer—</text>
<clause id="H4FA5D5B2FF6F42F78E00C579990522B7"><enum>(i)</enum><text>at
the time of the officer’s death; or</text>
</clause><clause id="HEE76289265714F7FAE432C86A83C10DA"><enum>(ii)</enum><text display-inline="yes-display-inline">at the time of the officer’s totally and
permanently disabling injury; and</text>
</clause></subparagraph><subparagraph id="H45A01FB0B31E40569E3B007399099639"><enum>(B)</enum><text>at the start of
the academic year for which a scholarship award is received, is 25 years of age
or under.</text>
</subparagraph></paragraph><paragraph id="H3681CA61E1F74FF5BF42E4611664F668"><enum>(3)</enum><header>Eligible
applicant</header><text>The term <term>eligible applicant</term> means a person
residing in a State who is any of the following:</text>
<subparagraph id="H6913C3EDCC454650B324E550D606E900"><enum>(A)</enum><text display-inline="yes-display-inline">A public safety officer described in
<internal-xref idref="H2882FF46B09C42479E82CE2CD4DF1225" legis-path="305.(1)(B)">paragraph (1)(B)</internal-xref>.</text>
</subparagraph><subparagraph id="H3D59D9AA179040AAA56023BA106FF34"><enum>(B)</enum><text display-inline="yes-display-inline">An eligible spouse of a deceased or
disabled officer.</text>
</subparagraph><subparagraph id="HD3FB8BED71C4443BA94CD1CCF00F0B8"><enum>(C)</enum><text display-inline="yes-display-inline">A dependent child of a deceased or disabled
officer.</text>
</subparagraph></paragraph><paragraph id="H0434C025A3DC478AA9920098E1AFBBE0"><enum>(4)</enum><header>Eligible
institution</header><text>The term <term>eligible institution</term> means any
public or private kindergarten, elementary school, or secondary school as
defined in section 7801 of the Elementary and Secondary Education Act of 1965,
or any institution of higher education, as defined in section 102 of the
<act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name>,
that—</text>
<subparagraph id="H997F293B661943CF99B9CC425B69B348"><enum>(A)</enum><text>is located in a
State; and</text>
</subparagraph><subparagraph id="H45647206D0BB42DC869EA9247BACBCF"><enum>(B)</enum><text>complies with the
antidiscrimination provisions of section 601 of the
<act-name parsable-cite="CRA64">Civil Rights Act of 1964</act-name> and does
not discriminate on the basis of race.</text>
</subparagraph></paragraph><paragraph id="H2F1CFB3C03F64FF0937CEC321D822110"><enum>(5)</enum><header>Eligible
spouse</header><text display-inline="yes-display-inline">The term
<term>eligible spouse</term> means an individual who is the legally married
husband or wife of a deceased or disabled officer—</text>
<subparagraph display-inline="no-display-inline" id="HFA89C3987678436C976DC5005F2D2481"><enum>(A)</enum><text>in the case of a
deceased officer, at the time of the officer’s death; or</text>
</subparagraph><subparagraph id="HE1CFC70140344B3C98CF92446CACC900"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of a disabled officer, at the
time of the officer’s totally and permanently disabling injury, and at the time
of the determination of eligibility for a scholarship award under this
title.</text>
</subparagraph></paragraph><paragraph id="HFC692AAA3E8C467AB26DB468FBCF775"><enum>(6)</enum><header>Public safety
officer</header><text>The term <term>public safety officer</term> has the
meaning given such term in section 1217 of the <act-name parsable-cite="OCCSS">Omnibus Crime Control and Safe Streets Act of
1968</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/3796d-6">42 U.S.C. 3796d–6</external-xref>), as added by section 104 of this
Act.</text>
</paragraph><paragraph id="H3808F5E032364F6EB3B9ABBCF6912857"><enum>(7)</enum><header>Secretary</header><text>The
term <term>Secretary</term> means the Secretary of Education.</text>
</paragraph><paragraph id="HE9999D1A83D241D0969F60C8E7B698C"><enum>(8)</enum><header>State</header><text>The
term <term>State</term> means any State of the United States, the District of
Columbia, the Commonwealth of Puerto Rico, and any territory or possession of
the United States.</text>
</paragraph></section><enum>IV</enum><header>Miscellaneous
provisions</header>
<section id="HA0426E05EBC844C2885DC2E6DBEE027B"><enum>401.</enum><header>Compensation in
case of death</header><text display-inline="no-display-inline">Section
8133(b)(1) of title 5, United States Code, is amended by striking <quote>or
remarries before reaching age 55</quote>.</text>
