			 provisions as fall within the jurisdiction of the committee

		<official-title>To restore the intent of the Americans with Disabilities
		  Act of 1990 to more fully remove the barriers that confront disabled
		  Americans.</official-title>

		<section id="HF12B8354780A450EAAB51DDBD33BE0B3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Americans with Disabilities Act
			 Restoration Act of 2006</short-title></quote>.</text>
		</section><section id="H09D98E5D99C848669DB5116F596639E2"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
			<paragraph id="H8295CFE6ABC342408C0082099763C17E"><enum>(1)</enum><text display-inline="yes-display-inline">Physical and mental impairments are natural
			 parts of the human condition as are race, gender, national origin, and sex.</text>
			</paragraph><paragraph id="HBCDDB6FC67034F7300D749844500CEC6"><enum>(2)</enum><text>Discrimination
			 results when individuals with actual or perceived physical or mental
			 impairments are met with attitudinal, societal, and physical barriers in
			 society.</text>
			</paragraph><paragraph id="H42BEB8B01D834A0AB767E72600D81184"><enum>(3)</enum><text>The use of
			 mitigating measures by an individual does not change the fact that the
			 individual has a physical or mental impairment, nor should the use of a
			 mitigating measure by an individual insulate covered entities from liability
			 for discriminatory practices and policies.</text>
			</paragraph><paragraph id="H79002B608FB1402800F9FCF7C65F295F"><enum>(4)</enum><text>The Americans with
			 Disabilities Act of 1990 has not been interpreted by the courts, including the
			 Supreme Court, as intended by Congress. The courts have significantly limited
			 the intended reach of the Americans with Disabilities Act, allowing many
			 individuals with actual or perceived impairments to be subject to
			 discrimination.</text>
			</paragraph><paragraph id="H51BB09FB2818483093838281EB0063F0"><enum>(5)</enum><text>It is necessary to
			 restore the intent of the Americans with Disabilities Act to fully remove the
			 barriers that confront disabled Americans and to permit all people to fully
			 participate in society.</text>
			</paragraph></section><section id="HC2A678BBEC4E41898E406869EEA6B4FB"><enum>3.</enum><header>Disability
			 defined</header><text display-inline="no-display-inline">Section 3 of the
			 Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12102">42 U.S.C. 12102</external-xref>) is amended—</text>
			<paragraph id="H5495CDE994FD40969881B1734FF0B079"><enum>(1)</enum><text>by amending
			 paragraph (2) to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="HF691E345FF184A64AEE0BD9771E7A01C" style="OLC">
					<paragraph id="H724B3527F469406091D3CA3FCF094019"><enum>(2)</enum><header>Disability</header>
						<subparagraph id="HE0DC020E14ED44D499AA39DAD2A1FF46"><enum>(A)</enum><header> In
				General</header><text display-inline="yes-display-inline">The term
				<quote>disability</quote> means, with respect to an individual—</text>
							<clause id="H1A0CAC8C04CE42CB979E1D03BBBA915C"><enum>(i)</enum><text>a
				physical or mental impairment;</text>
							</clause><clause id="H5D7D6C5E624C4C4182FE136D86D112AC"><enum>(ii)</enum><text>a
				record of a physical or mental impairment; or</text>
							</clause><clause id="H1A7F0973283D44A29673CF001231C5D3"><enum>(iii)</enum><text>a perceived
				physical or mental impairment.</text>
							</clause></subparagraph><subparagraph id="H75CFDD1D76B442D99008D2F32FC9739"><enum>(B)</enum><header>Rule of
				construction</header><text>The existence of a physical or mental impairment or
				record or perception of a physical or mental impairment shall be determined
				without taking into account an individual’s use of mitigating measures or
				whether the impairment is episodic, short term, or long term.</text>
						</subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="HD4506DC5E427449AB63547DAE04CF8E0"><enum>(2)</enum><text>by redesignating
			 paragraph (3) as paragraph (7) and inserting after paragraph (2) the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="HDD36FF59426A4BB4AAB9D7788F2E2DB3" style="OLC">
					<paragraph id="H69AF0ED2B63044F48C9396E1BFA0FA66"><enum>(3)</enum><header>Physical
				impairment</header><text display-inline="yes-display-inline">The term
				<quote>physical impairment</quote> means any physiological disorder or
				condition, cosmetic disfigurement, or anatomical loss affecting one or more of
				the following body systems: neurological; musculoskeletal; special sense
				organs; respiratory, including speech organs; cardiovascular; reproductive;
				digestive; genito-urinary; hemic and lymphatic; skin and endocrine.</text>
					</paragraph><paragraph id="H2811E0649B67427BB423F85E0097944E"><enum>(4)</enum><header>Mental
				impairment</header><text>The term <quote>mental impairment</quote> means any
				mental or psychological disorder such as mental retardation, organic brain
				syndrome, emotional or mental illness, and specific learning
				disabilities.</text>
					</paragraph><paragraph id="H8D8F2F889E514D638EF08F4E752F003C"><enum>(5)</enum><header>Record of
				physical or mental impairment</header><text>The term <quote>record of physical
				or mental impairment</quote> means having a history of, or having been
				misclassified as having, a physical or mental impairment.</text>
					</paragraph><paragraph id="HA73C3151CE8E4BE8A888A5FE520400C3"><enum>(6)</enum><header>Perceived
				physical or mental impairment</header><text>The term <quote>perceived physical
				or mental impairment</quote> means not having an impairment as set forth in
				paragraph (2)(A)(i) or (ii), but being regarded as having, or treated as
				having, a physical or mental
				impairment.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H2E86C545D2794521A380476DAB816A3"><enum>4.</enum><header>Discrimination on
			 the basis of disability</header><text display-inline="no-display-inline">The
			 Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12101">42 U.S.C. 12101 et seq.</external-xref>) is further
			 amended—</text>
			<paragraph id="H5D6F8BF3CE044BCE8D5B4111A2B01126"><enum>(1)</enum><text>in section 2(b),
			 by striking <quote>against individuals with disabilities</quote> each place it
			 appears and inserting <quote>on the basis of disability</quote>; and</text>
			</paragraph><paragraph id="HB1A7DABE27884A1A872D2C850762B2EE"><enum>(2)</enum><text>in section 102(a),
			 by striking <quote>against a qualified individual with a disability because of
			 the disability of such individual</quote> and inserting <quote>against an
			 individual on the basis of disability</quote>.</text>
			</paragraph></section><section id="H2BE08632180E4E4E0058655B66C0ABD5"><enum>5.</enum><header>Qualified
			 individual</header>
			<subsection id="H0C4A277FC7AD468F89D35DFA468F957"><enum>(a)</enum><header>Defense</header><text display-inline="yes-display-inline">Section 103, by redesignating subsections
			 (a) through (d) as subsections (b) through (e), respectively, and inserting
			 before such subsection (b) (as so redesignated) the following:</text>
				<quoted-block display-inline="no-display-inline" id="H0666A6E8A4FD4405B74FD17393788912" style="OLC">
					<subsection id="H5877E362249E4E91A9FDCC1CE2AA57A7"><enum>(a)</enum><header>In
				general</header><text>It may be a defense to a charge of discrimination under
				this title that the individual with a disability alleging discrimination is not
				a qualified individual, as such term is defined in section
				101(8).</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H98EC3010B42D40C0914D062D888C1E52"><enum>(b)</enum><header>Qualified
			 individual</header><text>Title I of the Americans with Disabilities Act of 1990
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/12111">42 U.S.C. 12111 et seq.</external-xref>) is further amended—</text>
				<paragraph id="H9F44259D4A26403B8F60674717301783"><enum>(1)</enum><text>in section
			 101(8)—</text>
					<subparagraph id="HD54EF4443A6D48369806287CAC159F00"><enum>(A)</enum><text>in the paragraph
			 heading, by striking <quote><header-in-text level="paragraph" style="OLC">with
			 a disability</header-in-text></quote>; and</text>
					</subparagraph><subparagraph id="H884513B3E0C74A27B8B642717CF4AEB6"><enum>(B)</enum><text>by striking
			 <quote>with a disability</quote> after <quote>individual</quote> both places it
			 appears;</text>
					</subparagraph></paragraph><paragraph id="H1874A558FEF74665AC18B4CEAA3CF9D5"><enum>(2)</enum><text>in section
			 102(b)(5), by striking <quote>with a disability</quote> after
			 <quote>individual</quote> both places it appears; and</text>
				</paragraph><paragraph id="H53214850C5EA4FE2A381F9C9FC9A9DB"><enum>(3)</enum><text>in
			 section 104—</text>
					<subparagraph id="H253AC1DBC88B4B4981C711C6BA6DA9C0"><enum>(A)</enum><text>in subsection
			 (a)—</text>
						<clause id="HF06083FF74B648F2BA2383889809C716"><enum>(i)</enum><text>in
			 the subsection heading, by striking <quote><header-in-text level="subsection" style="OLC">with a disability</header-in-text></quote>; and</text>
						</clause><clause id="H525CF83ADD27480C933F543D81696CB6"><enum>(ii)</enum><text display-inline="yes-display-inline">by striking <quote>with a
			 disability</quote> after <quote>individual</quote>; and</text>
						</clause></subparagraph><subparagraph id="HA39E178ABFE3490300504DCD0399537F"><enum>(B)</enum><text>in subsection (b),
			 in the matter preceding paragraph (1), by striking <quote>with a
			 disability</quote>.</text>
					</subparagraph></paragraph></subsection></section><section id="H9A514ECD93A8450E9F70D53C7BAF877"><enum>6.</enum><header>Rule of
			 construction</header><text display-inline="no-display-inline">Section 501 of
			 the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12201">42 U.S.C. 12201</external-xref>) is amended by
			 adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="H00E724E44DAD48A7A0C1FBAE2FFBC91" style="OLC">
				<subsection commented="no" id="HF675A59E859C48D0BC7C7D153732818E"><enum>(e)</enum><header>Broad
				construction</header><text display-inline="yes-display-inline">In order to
				ensure that this Act achieves its purpose under section 2(b) of providing a
				comprehensive prohibition of discrimination on the basis of disability, the
				provisions of this Act shall be broadly construed to advance their remedial
				purpose.</text>
