<official-title>To authorize the Secretary of Energy to make price floor loans to certain low-carbon coal-to-liquid fuel projects.</official-title>

<section id="H0D61B173B6F54D14921030C09D7663E2" section-type="section-one"><enum>1.</enum><header>Low-carbon coal-to-liquids projects</header><text display-inline="no-display-inline"> Section 1702 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16512">42 U.S.C. 16512</external-xref>) is amended by adding at the end thereof the following new subsection:</text>

<subsection id="H881E591817F14DB6A31F6D878277D74F"><enum>(k)</enum><header>Low-carbon CTL projects</header> 
<paragraph id="H355BF13791944CABBD768979D3D915F4" display-inline="yes-display-inline"><enum>(1)</enum> 
<subparagraph id="HE31DAEEBE52144429740B433E69511DF" display-inline="yes-display-inline"><enum>(A)</enum><text>The Secretary may enter into an agreement (in the form of a price floor loan) with no more than 6 low-carbon CTL projects to guarantee each project a minimum price for its output of liquid or gaseous transportation fuels in return for—</text>
<clause id="HEC7F95C5FBCC4541B68568C17E26DAB6" indent="up1"><enum>(i)</enum><text>payment to the United States of the cost of such loan (determined under 502(5)(B) of the Federal Credit Reform Act of 1990); or</text></clause>
<clause id="H4FDC50D5581C47AC8049410419341D5E" indent="up1"><enum>(ii)</enum><text>at the election of the borrower, a call option for the United States equivalent in value to such payment.</text></clause></subparagraph> 
<subparagraph id="H7E8714E52E5043FE9945EB7D00007E05" indent="up2"><enum>(B)</enum><text>No agreement for a price floor loan may be entered into under this subsection unless the Office of Management and Budget determines that the cost of such loan is fully offset by a payment under subparagraph (A)(i) or by the value of a call option under subparagraph (A)(ii).</text></subparagraph></paragraph> 
<paragraph id="HEE08C5A78FF24F8D91ECACE600EBF499" indent="up1"><enum>(2)</enum><text>For purposes of this subsection:</text> 
<subparagraph id="H4A2C262FD9BD4C2AB41F91E9196EF11B"><enum>(A)</enum><text>The term <quote>call option</quote> means a call option for the United States under which a price floor loan borrower has a contractual obligation to make payments to the United States in addition to any repayments of the price floor loan. Such call option payments in any period shall be equal to the excess of the petroleum market price over the payback price, less any loan payments made in that period.</text></subparagraph>
<subparagraph id="HB61CCE33E0AA4FAAA0C056BD84674E38"><enum>(B)</enum><text>The term <quote>low-carbon CTL project</quote> means a commercial-scale project that converts coal to one or more liquid or gaseous transportation fuels, is designed to demonstrate and, if determined to be appropriate, demonstrates the capture and sequestration or disposal or use of an agreed upon portion of the carbon dioxide produced in the conversion process.</text></subparagraph> 
<subparagraph id="H6E4F270253A44ABC005E6C00005000CD"><enum>(C)</enum><text>The term <quote>output</quote> means some or all of the liquid or gaseous transportation fuels produced from the project.</text></subparagraph>
<subparagraph id="HDC473E69C9764CFF006DF00597D0B5EC"><enum>(D)</enum><text>The term <quote>price floor loan</quote> means an obligation to make a nonrecourse direct loan to a low-carbon CTL project under which—</text>
<clause id="HE0AC6950D69C4751822DDBAF7CED57DE"><enum>(i)</enum><text>disbursement is made during any period if, and to the extent, a specified petroleum market price index falls below a floor price specified in the loan agreement; and</text></clause>
<clause id="H30B0570580224782AFB1F6B751D8341D"><enum>(ii)</enum><text>repayment (with interest) is made during any period if, and to the extent, such market price index is above a payback price specified in the loan agreement.</text></clause></subparagraph></paragraph> 
<paragraph id="HA3C92CCCD993452EA16D9DAAAA75CC00" indent="up1"><enum>(3)</enum><text>Subsections (f), (h), and (j) of this section shall apply to price floor loans to the same extent they apply to loan guarantees. The value to the Government of any call option determined under paragraph (1)(B) shall be taken into account for purposes of section 502(5)(B)(iii) of the Federal Credit Reform Act of 1990 in determining the cost to the Federal Government of a price floor loan. If a price floor loan has no cost to the Federal Government, the requirements of section 504(b) of such Act shall be deemed to be satisfied.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>
