		  assistance and to strengthen accountability of the governmentwide debarment and
		  suspension system.</official-title>

		<section display-inline="no-display-inline" id="HDE6742BD711A44FC80E2A69CABE1195" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Contractors Accountability Act of
			 2006</short-title></quote>.</text>
		</section><section id="HAD8B7EC881B546EABE82599F68E4E739"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds the following:</text>
			<paragraph id="HA75E4F369C644E78893B8C65FE591F71"><enum>(1)</enum><header>Need for
			 database</header><subparagraph commented="no" display-inline="yes-display-inline" id="HC968E753569F4E08A50069D774EFD734"><enum>(A)</enum><text>By spending over
			 $215,000,000,000 a year on procurement and nonprocurement awards for goods and
			 services, the Federal Government is the largest consumer in the world.</text>
				</subparagraph><subparagraph id="H4E7A35E724A246B9AB94CC0566FD04E1" indent="up1"><enum>(B)</enum><text>It is in the best interest of the
			 Federal Government and its taxpayers to award contract and assistance to
			 entities that are responsible and have a suitable record of integrity and
			 business ethics.</text>
				</subparagraph><subparagraph id="H4CC94DF721A64DF997AA9DED1200AE1E" indent="up1"><enum>(C)</enum><text>There is no centralized, comprehensive
			 database on judicial actions, consent decrees, administrative agreements,
			 terminations, or settlements with respect to potential Federal contractors or
			 assistance participants.</text>
				</subparagraph><subparagraph id="H8064E4EC6A684CC7969B00F9C081C159" indent="up1"><enum>(D)</enum><text>Federal officials do not have the
			 resources necessary to assemble such information for each Federal procurement
			 award.</text>
				</subparagraph><subparagraph id="HDD8CE1880426406B80DBA14401201887" indent="up1"><enum>(E)</enum><text>The lack of this information
			 compromises the Federal Government’s ability to safeguard the integrity of the
			 Federal procurement and assistance activities.</text>
				</subparagraph><subparagraph id="HB6C2E0B8D5E6456D9D344E58DCE0005D" indent="up1"><enum>(F)</enum><text>It is in the best business interests
			 of the Federal Government to have all information possible regarding potential
			 contractors’ and assistance participants’ performance and integrity records to
			 assure that persons with which the Government does business are presently
			 responsible.</text>
				</subparagraph></paragraph><paragraph id="HA2208E20BA3548ECBD73A020C3D292B"><enum>(2)</enum><header>Reality of
			 debarments and suspensions of top 43 Federal contractors</header><text>Since
			 1990—</text>
				<subparagraph id="H3D5D7BF6B6474EE3A2AF3D8247217CE0"><enum>(A)</enum><text>of the top 43
			 Federal contractors based on total contract dollars received—</text>
					<clause id="H6DFA6290841243AA006E151DEF98E625"><enum>(i)</enum><text>16
			 have a total of 28 criminal convictions; and</text>
					</clause><clause id="H7904E709C61643C8ADF615EC82AB200"><enum>(ii)</enum><text>4 of
			 the top ten have at least 2 criminal convictions;</text>
					</clause></subparagraph><subparagraph id="HCABB19157F2141AE92EC7C2E958621AF"><enum>(B)</enum><text>such 43
			 contractors have paid a total of $3,400,000,000 in fines, penalties,
			 restitution, settlements, and clean-up costs under the Superfund program;
			 and</text>
				</subparagraph><subparagraph id="HFF4110926EA94E43BA30AD22EAEFD99"><enum>(C)</enum><text>despite such fines
			 and criminal convictions, only one of the 43 contractors has been debarred or
			 suspended from contracting with the Federal Government, for only 5 days.</text>
				</subparagraph></paragraph><paragraph id="H040536E8465B494E912CA580A9E3B5A8"><enum>(3)</enum><header>Need for
			 database not fulfilled</header>
				<subparagraph id="H09328CC36F88475E972C2F34809BD42E"><enum>(A)</enum><text>There is no
			 centralized listing of criminal or civil indictments, convictions, fines,
			 penalties, restitution, and settlement assessments relating to contractors or
			 assistance participants.</text>
				</subparagraph><subparagraph id="H1E2F1A54CF32443DA368766CBCFD22A"><enum>(B)</enum><text>Potential Federal
			 contractors or assistance participants are not required to disclose all
			 relevant criminal, civil, or administrative rulings or resolutions during the
			 Federal procurement award process.</text>
				</subparagraph><subparagraph id="H9096651A3C8844AC9B00A691AABD6DE"><enum>(C)</enum><text>Without such a
			 database or disclosure, Federal award officials and debarment officials lack
			 important information relevant to present responsibility.</text>
				</subparagraph></paragraph></section><section id="H566ACF2C31674AFB807BEC4374003F03"><enum>3.</enum><header>Database for
			 Federal debarment officials and contracting officers</header>
			<subsection id="HF8CCD5DB74854C36AA23376600B0B271"><enum>(a)</enum><header>In
			 general</header><text>The Administrator of General Services shall establish and
			 maintain a database of information regarding integrity and performance of
			 Federal contracts and assistance recipients for use by Federal procurement
			 award officials and Federal officials having authority to debar or suspend
			 persons from Federal contracts or assistance.</text>
			</subsection><subsection id="HAEC092DFBF2C4214A61034C5B1BF3028"><enum>(b)</enum><header>Information
			 included</header><text>The database—</text>
				<paragraph id="HADE945F8E45D4B23B6001BAC879037B4"><enum>(1)</enum><text>shall consist of
			 information regarding judicial and administrative proceedings initiated or
			 concluded by the Federal Government and State governments against Federal
			 contractors or assistance recipients; and</text>
				</paragraph><paragraph id="HD93AA4A9A8284626A8F946DEC5F1FBF0"><enum>(2)</enum><text>shall include with
			 respect to each entity awarded a Federal contract or assistance—</text>
					<subparagraph id="H4DDB9B0EA75E4168B2076332E3DACED1"><enum>(A)</enum><text>information
			 regarding all proceedings referred to in paragraph (1) against that person in
			 at least the most recent 5-year period;</text>
					</subparagraph><subparagraph id="HE65B035AB1DC43EAA2E90002EF33DF08"><enum>(B)</enum><text>with respect to
			 each proceeding—</text>
						<clause id="H2506FD6C1BC04EC8912B446780115B90"><enum>(i)</enum><text>a
			 brief description of the proceeding; and</text>
						</clause><clause id="H6DE429F071C44BEFAE00FF0870C52B14"><enum>(ii)</enum><text>any
			 amount paid by the person to the Federal Government or a State
			 government;</text>
						</clause></subparagraph><subparagraph id="HA2D788328E9D489BAC1FF120BD3B3225"><enum>(C)</enum><text>all Federal
			 contracts and assistance awarded to the person that were terminated in such
			 period due to default;</text>
					</subparagraph><subparagraph id="HFB99AB1C2CD441008EAFD93038F14C80"><enum>(D)</enum><text>all Federal
			 debarments and suspensions of the person in that period; and</text>
					</subparagraph><subparagraph id="HF39D316C90524A8B9FD2CD723EC73534"><enum>(E)</enum><text>all Federal
			 suspension and debarment or administrative agreements signed with such person
			 in that period.</text>
					</subparagraph></paragraph></subsection><subsection id="H2B55C5AF7B91486BA1FCD87CABB124F2"><enum>(c)</enum><header>Input of
			 data</header><text>The Administrator shall design and maintain the database in
			 a manner that allows the appropriate officials of each Federal agency to
			 directly input and update in the database information relating to actions it
			 has taken with regard to contractors or assistance recipients.</text>
			</subsection><subsection id="H162E195C748C4A35BCD91E1199966B42"><enum>(d)</enum><header>Availability</header><text>The
			 Administrator shall make the database available to all Federal agencies and to
			 the public in accordance with <external-xref legal-doc="usc" parsable-cite="usc/5/552">section 552</external-xref> of title 5, United States Code,
			 popularly known as the Freedom of Information Act.</text>
			</subsection></section><section id="HB68D9652DE364494B2D1E282D0154106"><enum>4.</enum><header>Suspension and
			 debarment presumption for repeat violators and poor performers</header>
			<subsection id="HA5B0342E9E7D4ED6AC1FD8DD74F3765"><enum>(a)</enum><header>In
			 general</header><text>Federal agency suspension and debarment regulations shall
			 be amended by no later than 180 days after the date of the enactment of this
			 Act to provide that an entity shall be presumed nonresponsible with respect to
			 award of a Federal contract or assistance if the entity has rendered against it
			 twice within any 3-year period a judgment or conviction for the same offense,
			 or similar offenses, if each conviction constitutes a cause for debarment under
			 the governmentwide debarment system.</text>
			</subsection><subsection id="HAAEAC18FBE924391ACAE471C622C3230"><enum>(b)</enum><header>Rebuttal</header><text>The
			 presumption under subsection (a) shall be rebutted only if the entity
			 demonstrates, by clear and convincing evidence, that the entity is presently
			 responsible and has corrected the conditions that gave rise to the
			 violations.</text>
			</subsection><subsection id="HC319770666624A3684573BC2F7EC05B4"><enum>(c)</enum><header>Repeat
			 violations</header><text>An agency suspending official may deem evidence of
			 repeat violations under subsection (a) as sufficient reason to find that
			 immediate action is necessary to suspend an entity under the regulations until
			 the entity fulfills the requirements of subsection (b).</text>
			</subsection></section><section id="H43D0B577452E42A98746E36069FDD348"><enum>5.</enum><header>Disclosure in
			 applications</header><text display-inline="no-display-inline">Federal
			 regulations shall be amended by no later than 180 days after the date of the
			 enactment of this Act to require that in applying for any Federal contract or
			 assistance, whether by submission of a proposal, any solicitation, bid, or
			 other offer, an entity shall disclose in writing—</text>
			<paragraph id="H79F1283A71BC4078A9D4001F7ED82DF9"><enum>(1)</enum><text>all Federal or
			 State debarments or suspensions of the entity from contracts or assistance in
			 the 5-year period preceding the date of submission of the application;</text>
			</paragraph><paragraph id="H6305BCF3AB8C4E4BA33FBBDD89994838"><enum>(2)</enum><text>all judicial and
			 administrative proceedings against the entity by the Federal Government or any
			 State that occurred in the 5-year period preceding the date of the application;
			 and</text>
			</paragraph><paragraph id="H29D30876B697470AA2E6C6E32FBE1795"><enum>(3)</enum><text>all administrative
			 agreements with respect to Federal contracts or assistance that the entity is
			 implementing to avoid suspension or debarment within 5 years of the date of the
			 submission of the application.</text>
			</paragraph></section><section id="HE45094745E3F4124B8102F72E7BC4800"><enum>6.</enum><header>Role of
			 Interagency Committee</header><text display-inline="no-display-inline">The
			 Interagency Committee on Debarment and Suspension shall—</text>
			<paragraph id="HEEAC3033C0D842308358A3F031DE004D"><enum>(1)</enum><text>resolve issues
			 regarding which of several Federal agencies is the lead agency having
			 responsibility to initiate suspension or debarment proceedings;</text>
			</paragraph><paragraph id="HDFBE4B6C68BF4F658E96D2C14F1A751"><enum>(2)</enum><text>coordinate actions
			 among interested agencies with respect to such action;</text>
			</paragraph><paragraph id="H4F2A2407006E4C3489B03F6B2288FCB"><enum>(3)</enum><text>encourage and
			 assist Federal agencies in entering into cooperative efforts to pool resources
			 and achieve operational efficiencies in the governmentwide suspension and
			 debarment system;</text>
			</paragraph><paragraph id="H18A5ECADEE5045D5A270B6D3502E9600"><enum>(4)</enum><text>recommend to the
			 Office of Management and Budget changes to Government debarment and suspension
			 system and its rules, if such recommendations are approved by a majority of the
			 Interagency Committee;</text>
			</paragraph><paragraph id="H524780B4269F49A688E6B731D3FFBB2"><enum>(5)</enum><text>authorize the
			 Office of Management and Budget to issue guidelines that implement those
			 recommendations;</text>
			</paragraph><paragraph id="H2A2BCA49AD2244EE00F8C74135A46167"><enum>(6)</enum><text>authorize the
			 chair of the Committee to establish subcommittees as appropriate to best enable
			 the Interagency Committee to carry out its functions; and</text>
			</paragraph><paragraph id="H0D2A3BAB1C164FBFBAD761E49F9E6BC4"><enum>(7)</enum><text>submit to the
			 Congress an annual report on—</text>
				<subparagraph id="H26D305421D3C4BFA885FDE03FE896B5D"><enum>(A)</enum><text>the progress and
			 efforts to improve the suspension and debarment system;</text>
				</subparagraph><subparagraph id="H9DB4C7AE0F3C40B5A97D04A1D69CCA45"><enum>(B)</enum><text>member agencies’
			 active participation in the committee’s work; and</text>
				</subparagraph><subparagraph id="HD1C38CF1D1644C3F8B675D31D7337D0"><enum>(C)</enum><text>a summary of each
			 agency’s activities and accomplishments in the governmentwide debarment
			 system.</text>
				</subparagraph></paragraph></section><section id="HE1CD5A8B545E4141B9FAE746FA06E735"><enum>7.</enum><header>Authorization of
			 independent agencies</header><text display-inline="no-display-inline">Any
			 agency, commission, or organization of the Federal Government to which
			 Executive Order 12549 does not apply is authorized to participate in the
			 governmentwide suspension and debarment system and may recognize the suspension
			 or debarment issued by an executive branch agency in its own procurement or
			 assistance activities.</text>
		</section><section id="H7986FAE798FD4A5E883000E568980714"><enum>8.</enum><header>Use of payments
			 under administrative agreements</header>
			<subsection id="H304C7078CA1840A580E3D2676C00C9EB"><enum>(a)</enum><header>In
			 general</header><text>A Federal agency may—</text>
				<paragraph id="H71B9B86C0E96427C95A0258E48C6D6D4"><enum>(1)</enum><text>retain amounts
			 described in subsection (b); and</text>
				</paragraph><paragraph id="H8A0CB91323964CD6B4AD6900C13D8E1D"><enum>(2)</enum><text>use those amounts
			 solely—</text>
					<subparagraph id="H11E6FA7682AA414688ED4FB364F8AFAB"><enum>(A)</enum><text>to administer,
			 review, or oversee compliance with suspension or debarment administrative
			 agreements; and</text>
					</subparagraph><subparagraph id="HEE769A57F32943188BFF062C909F9B37"><enum>(B)</enum><text>for costs
			 associated with establishing and maintaining the database under section 3,
			 including for input and update of information in the database.</text>
					</subparagraph></paragraph></subsection><subsection id="H2908F8084AF84D9A8F35F5408262A4C9"><enum>(b)</enum><header>Amounts
			 described</header><text>The amounts referred to in subsection (a) are amounts
			 received by the agency as payment made by any Federal contractor or assistance
			 participant pursuant to an administrative agreement with respect to a Federal
			 contract or assistance activity.</text>
			</subsection><subsection id="H5B8EC73E367A49D5B02CD18F31222449"><enum>(c)</enum><header>Restriction</header><text>Amounts
			 retained under subsection (a)(1) may not be used for agency administration or
			 expenses not described in subsection (a)(2).</text>
			</subsection></section><section id="H8B1FC94043864A92B59DEA20F52DEAD2"><enum>9.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="H51B4B85761584AD4B8D8017E45D726C3"><enum>(1)</enum><header>Interagency
			 Committee</header><text>The term <term>Interagency Committee on Debarment and
			 Suspension</term> means such committee constituted under sections 4 and 5 and
			 of Executive Order 12549.</text>
			</paragraph><paragraph id="H3051A5E5DFA14AC9A64BAE66E454CA3"><enum>(2)</enum><header>Assistance</header><text>The
			 term <term>assistance</term> means Federal grants, cooperative agreements,
			 loans, loan guarantees, and other benefits included as covered transactions
			 under the governmentwide nonprocurement suspension and debarment rules.</text>
			</paragraph><paragraph id="H0E33DF3E57604DA9A02BF0C0067EC722"><enum>(3)</enum><header>Contract</header><text>The
			 term <term>contract</term> means those direct procurement transactions covered
			 by subpart 9.4 of the Federal Acquisition Regulation.</text>
