		<official-title>To authorize the Secretary of Energy to make energy
		  consumption reduction incentive payments to encourage the utilization of the
		  best available technology in the development of desalination facilities, and
		  for other purposes.</official-title>

		<section id="H5CFBC5214AA84B75AD906FC900D05199" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Desalination Energy Consumption
			 Reduction Act of 2006</short-title></quote>.</text>
		</section><section id="HC978979818E14E90A6DC87D715482D3"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">For purposes of this Act:</text>
			<paragraph id="HC73268758F07497FAD5E15381762A683"><enum>(1)</enum><header>Qualified
			 desalination facility</header><text>The term <quote>qualified desalination
			 facility</quote> means a facility that—</text>
				<subparagraph id="H8911020C7A1E4AFCBA698B43916F76FC"><enum>(A)</enum><text>produces for sale
			 to domestic customers desalinated seawater, brackish groundwater, or surface
			 water whose source water is greater than 1000 milligrams per liter total
			 dissolved solids;</text>
				</subparagraph><subparagraph id="H673D5A9E14F946E6B66203F2A374A0E6"><enum>(B)</enum><text>is owned or
			 operated by—</text>
					<clause id="HDF10BAB80B534DE8B9200091A5FDDAD1"><enum>(i)</enum><text>a
			 State or any political subdivision, agency, authority, or instrumentality of a
			 State;</text>
					</clause><clause id="H8300519D3F7B4F41A0E3ACA9664F838E"><enum>(ii)</enum><text>an
			 Indian tribe; or</text>
					</clause><clause id="H274A750BF4FE4440BCAE59F90058F555"><enum>(iii)</enum><text>a
			 corporation responsible for providing municipal water service pursuant to State
			 or tribal law;</text>
					</clause></subparagraph><subparagraph id="H97914DA488964452B900D6C5EABB211"><enum>(C)</enum><text>is first used to
			 produce commercial desalinated water for sale during the 10-year period
			 beginning on October 1 of the first fiscal year occurring after the date of
			 enactment of this Act; and</text>
				</subparagraph><subparagraph id="H03A4F7AB7F8A4A6183867D35E3B6C6D7"><enum>(D)</enum><text>uses the best
			 available technology as determined by the Secretary.</text>
				</subparagraph></paragraph><paragraph commented="no" id="HF511E6FCC3934C9C0032F410C7E4EDA7"><enum>(2)</enum><header>Indian
			 tribe</header><text>The term <quote>Indian tribe</quote> has the meaning given
			 that term in section 4(e) of the Indian Self-Determination and Education
			 Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/450b">25 U.S.C. 450b(e)</external-xref>).</text>
			</paragraph><paragraph id="H603E0C411B25468D828EA7BE71B641F2"><enum>(3)</enum><header>Secretary</header><text>The
			 term <quote>Secretary</quote> means the Secretary of Energy.</text>
			</paragraph><paragraph id="HD6630B296C8C4291B56656E70091E682"><enum>(4)</enum><header>State</header><text>The
			 term <quote>State</quote> means the several States, the District of Columbia,
			 Puerto Rico, American Samoa, the Virgin Islands, Guam, and the Northern Mariana
			 Islands.</text>
			</paragraph></section><section id="H83343B0B2C6A49B38FDF6D9600A189BA"><enum>3.</enum><header>Desalinated water
			 energy consumption reduction incentive payments</header>
			<subsection id="H462A671ABDCD4740BE023EBB9CE41F74"><enum>(a)</enum><header>Incentive
			 payments</header><text>The Secretary shall make incentive payments in an amount
			 determined under subsection (d) to the owners of qualified desalination
			 facilities to encourage the utilization of the best available technology to
			 reduce the consumption of electrical energy in the desalination process.</text>
			</subsection><subsection id="HEA2EE5AF5E4D43F5B2108DEB723ED441"><enum>(b)</enum><header>Agreement;
			 deadline</header><text>The Secretary may not make any payment to the owner or
			 operator of a quailfied desalination facility under this section unless, not
			 later than the end of fiscal year 2018, the Secretary enters into a written
			 agreement with the owner or operator to make such payment.</text>
			</subsection><subsection id="H89EE87BC21AA41EE9E3C82CC506FC9D9"><enum>(c)</enum><header>Payment
			 period</header><text>The Secretary may make payments to the owner or operator
			 of a qualified desalination facility under this section for a period not to
			 exceed 10 years—</text>
				<paragraph id="H9A2C05BBBE544052A35EFE07CA78B341"><enum>(1)</enum><text>beginning on the
			 date on which the facility is first used to produce desalinated water;
			 and</text>
				</paragraph><paragraph id="HA873D95E18D943EA8B0008A5929FE4E4"><enum>(2)</enum><text>ending not later
			 than September 30, 2028.</text>
				</paragraph></subsection><subsection id="H2819313AE32B46D3A07920AC6CECD000"><enum>(d)</enum><header>Amount of
			 payment</header>
				<paragraph id="H9196EAC1F476480F83791FBCB35EAD7C"><enum>(1)</enum><header>In
			 general</header><text>Payments made by the Secretary under this section to the
			 owner or operator of any qualified desalination facility shall be based on the
			 amount of electrical energy conserved by the facility below the benchmarks
			 included in the formula established under paragraph (2) during the payment
			 period described in subsection (c), adjusted as provided in paragraph
			 (3).</text>
				</paragraph><paragraph id="H6FED98592AC04B86BDFA75C2E741EA00"><enum>(2)</enum><header>Base
			 payment</header><text display-inline="yes-display-inline">The Secretary shall
			 establish a formula for making incentive payments to owners of qualified
			 desalination facilities producing potable water from source waters ranging from
			 1,000 to 35,000 milligrams per liter total dissolved solids or more. The
			 payment shall range from 30 cents per 1,000 gallons of potable water produced
			 for any facility that can demonstrate a savings of .25 kilowatt hours per
			 gallon to 90 cents per 1,000 gallons of potable water produced for any facility
			 that can demonstrate a savings of 4.75 kilowatt hours per gallon from a
			 benchmark for energy consumption by such facilities that ranges along a linear
			 scale from 1.8 kilowatt hours per gallon for facilities utilizing source water
			 of 1,000 milligrams per liter total dissolved solids to 14 kilowatt hours per
			 gallon for facilities utilizing source water of 35,000 milligrams per liter
			 total dissolved solids or more.</text>
				</paragraph><paragraph id="H4F17EC92E68842B487EE39AAD810B5F5"><enum>(3)</enum><header>Adjustments</header><text display-inline="yes-display-inline">In the case of any payment made to any
			 person under this subsection in a fiscal year beginning after calendar year
			 2008, the amount of such payment shall be adjusted by multiplying such amount
			 by the inflation adjustment factor (determined under section 45K(d)(2) of the
			 Internal Revenue Code of 1986 by substituting <quote>2008</quote> for
			 <quote>1979</quote> in subparagraph (B) thereof) for the calendar year in which
			 the payment is made.</text>
				</paragraph></subsection><subsection id="H2C5B709A08DF4FB3BC29CA65CE440A5"><enum>(e)</enum><header>Application</header><text display-inline="yes-display-inline">The Secretary may not make a grant to the
			 owner or operator of a qualified desalination facility under this section
			 unless the facility submits an application to the Secretary in such form, at
			 such time, and containing such information and assurances as the Secretary may
			 require. Further, as a part of the application the applicant shall provide a
			 written assurance to the Secretary that the financial benefit of any incentive
			 payments received by the applicant will be utilized for the benefit of the rate
			 payers.</text>
			</subsection><subsection id="H2BF618802D7E4469AEB756CAAFC66634"><enum>(f)</enum><header>Limitation</header><text>In
			 any fiscal year not more than 60 percent of the funds made available by the
			 Secretary under this section shall be made available to the owners or operators
			 of qualified desalination facilities that obtain source water directly from the
			 sea, an estuary, or from in-bank extraction wells that are of seawater
			 origin.</text>
			</subsection><subsection id="HA5D17AF63EAF493399E466B7D3B7CD42"><enum>(g)</enum><header>Priority</header><text>In
			 awarding incentive payments under this section, the Secretary shall give
			 priority to any application for a project that—</text>
				<paragraph id="HA1576CDBEA444C47002ED25D040000E4"><enum>(1)</enum><text>uses innovative
			 technologies to reduce the energy demand of the project;</text>
				</paragraph><paragraph id="HAABDB2A8C77046BA9EFEA6A216745B1C"><enum>(2)</enum><text>uses renewable
			 energy supplies in the desalination process;</text>
				</paragraph><paragraph id="H0FD6E51A6B2442CFBBBE6842ABBF85B7"><enum>(3)</enum><text>provides regional
			 water supply benefits;</text>
				</paragraph><paragraph id="HE4E5AC7D110F4D179EE858000042866B"><enum>(4)</enum><text>provides a secure
			 source of new water supplies for national defense activities;</text>
				</paragraph><paragraph id="H62BA8ED53E5D483189CFD077412E32F4"><enum>(5)</enum><text>reduces the threat
			 of a water supply disruption as a result of a natural disaster or acts of
			 terrorism;</text>
				</paragraph><paragraph id="H1414F44CCD734DBA8DCF22B38D126EE0"><enum>(6)</enum><text>uses technologies
			 that minimize the damage to marine life; or</text>
				</paragraph><paragraph id="HA53C9E14F7B44B988C39DEACAE8644A4"><enum>(7)</enum><text>provides
			 significant water quality benefits.</text>
				</paragraph></subsection><subsection id="HE05E54B00367463C87314836BAE5D63"><enum>(h)</enum><header>Budget act
			 compliance</header><text>The authority provided by this section may be
			 exercised only in such amounts or to such extent as is provided in advance in
			 appropriations Acts.</text>
			</subsection><subsection id="HD4B6375271574DDBA619EDD0DC9B00EB"><enum>(i)</enum><header>Authorization of
			 appropriations</header><text>There are authorized to be appropriated to the
			 Secretary $200,000,000 to carry out this section for the period encompassing
			 fiscal years 2008 through 2018.</text>
