		<section display-inline="no-display-inline" id="H257FB1AC6F1E4FFE89822FCAD278B700" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Kids Vision Care Act of
			 2006</short-title></quote>.</text>
		</section><section id="HD7AAF8318D9C4C178100CBAEC140763D"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following
			 findings:</text>
			<paragraph id="H5E9B645FE07A44CAAFF4FBD242625B58"><enum>(1)</enum><text>Good vision is
			 essential for proper physical development and educational progress in growing
			 children.</text>
			</paragraph><paragraph id="H27AAEF6F327A43FFB100A85B00059F68"><enum>(2)</enum><text>Many serious
			 ocular conditions are treatable if identified in the preschool and early
			 school-aged years.</text>
			</paragraph><paragraph id="H5E47A5303B8148A0A0E395203FE3C07"><enum>(3)</enum><text>Early detection of
			 ocular conditions provides the best opportunity for effective, inexpensive
			 treatment and can have far-reaching implications for vision.</text>
			</paragraph><paragraph id="H3913E2C5BC9B40B2BFD476E59C37CAC9"><enum>(4)</enum><text>Various
			 identification methods, whether vision screening or comprehensive eye exams
			 required by State laws, will identify children needing services. A child
			 identified through vision screening should receive a comprehensive eye exam
			 followed by subsequent treatment as needed. A child identified through a
			 comprehensive eye exam should receive subsequent treatment as needed. All
			 children identified as needing services should have access to subsequent
			 treatment as needed.</text>
			</paragraph></section><section id="H2F3CA0BA6160408C8299EC97F8427E00"><enum>3.</enum><header>Grants regarding
			 vision care for children</header>
			<subsection id="H6EAB9D8141FE47A88E005030B9F7605B"><enum>(a)</enum><header>In
			 general</header><text>The Secretary of Health and Human Services (referred to
			 in this section as the <quote>Secretary</quote>), acting through the Director
			 of the Centers for Disease Control and Prevention, may award grants to States
			 on the basis of an established review process for the purpose of complementing
			 existing State efforts for—</text>
				<paragraph id="HBA3C1B6AEC6748C6B21DA6CA00AF2B97"><enum>(1)</enum><text>providing
			 comprehensive eye examinations by a licensed optometrist or ophthalmologist for
			 children who have been previously identified through a vision screening or eye
			 examination by a licensed health care provider or vision screener as needing
			 such services, with priority given to children who are under the age of 9
			 years;</text>
				</paragraph><paragraph id="HE534D6A03B7C4147A5099E83E6BB21FB"><enum>(2)</enum><text>providing
			 treatment or services, subsequent to the examinations described in paragraph
			 (1), necessary to correct vision problems; and</text>
				</paragraph><paragraph id="HFDBCF0FFB29F4BB499DF2DB643AA8439"><enum>(3)</enum><text>developing and
			 disseminating, to parents, teachers, and health care practitioners, educational
			 materials on recognizing signs of visual impairment in children.</text>
				</paragraph></subsection><subsection id="H5B6D8E4BC6FB4138AC468D64517B2C62"><enum>(b)</enum><header>Criteria and
			 coordination</header>
				<paragraph id="H25331B874A28486280DA0457F6DA2841"><enum>(1)</enum><header>Criteria</header><text>The
			 Secretary, in consultation with appropriate professional and consumer
			 organizations including individuals with knowledge of age appropriate vision
			 services, shall develop criteria—</text>
					<subparagraph id="H0B27BE7B4FB3422EBAA25D81F0CF4530"><enum>(A)</enum><text>governing the
			 operation of the grant program under subsection (a); and</text>
					</subparagraph><subparagraph id="H1612815EEA3E4AC399293B9FF83D51F"><enum>(B)</enum><text>for the collection
			 of data related to vision assessment and the utilization of follow up
			 services.</text>
					</subparagraph></paragraph><paragraph id="HBA311BC50E864A6E96B33EF4BE00CB9F"><enum>(2)</enum><header>Coordination</header><text>The
			 Secretary shall, as appropriate, coordinate the program under subsection (a)
			 with the program under section 330 of the Public Health Service Act (relating
			 to health centers) (<external-xref legal-doc="usc" parsable-cite="usc/42/254b">42 U.S.C. 254b</external-xref>), the program under title XIX of the Social
			 Security Act (relating to the Medicaid program) (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396 et seq.</external-xref>), the
			 program under title XXI of such Act (relating to the State children's health
			 insurance program) (<external-xref legal-doc="usc" parsable-cite="usc/42/1397aa">42 U.S.C. 1397aa et seq.</external-xref>), and with other Federal or State
			 programs that provide services to children.</text>
				</paragraph></subsection><subsection id="H3F83F7296C4D4A52917CF9C0D1E5F8B7"><enum>(c)</enum><header>Application</header><text>To
			 be eligible to receive a grant under subsection (a), a State shall submit to
			 the Secretary an application in such form, made in such manner, and containing
			 such information as the Secretary may require, including—</text>
				<paragraph id="H0CE8D121147C4FF9B5EACFFB911D1DB2"><enum>(1)</enum><text>information on
			 existing Federal, Federal-State, or State-funded children's vision
			 programs;</text>
				</paragraph><paragraph id="HA8F61F5C86AD4FDDB38FE75444F0FE"><enum>(2)</enum><text>a
			 plan for the use of grant funds, including how funds will be used to complement
			 existing State efforts (including possible partnerships with non-profit
			 entities);</text>
				</paragraph><paragraph id="H555675212C9A4340AA907B0800A8E941"><enum>(3)</enum><text>a
			 plan to determine if a grant eligible child has been identified as provided for
			 in section 3(a); and</text>
				</paragraph><paragraph id="H88A701E511054173A62033B9FA1194AE"><enum>(4)</enum><text>a
			 description of how funds will be used to provide items or services only as a
			 secondary payer to—</text>
					<subparagraph id="HA1C3ADA2587147BCB3AF92D4F97301B1"><enum>(A)</enum><text>any State
			 compensation program, under an insurance policy, or under any Federal or State
			 health benefits program; or</text>
					</subparagraph><subparagraph id="HFD5713611AE144AAB046A8C781822C30"><enum>(B)</enum><text>by any entity that
			 provides health services on a prepaid basis.</text>
					</subparagraph></paragraph></subsection><subsection id="H677FE4A125B5425F8DCCC95ECCA1B95D"><enum>(d)</enum><header>Evaluations</header><text>To
			 be eligible to receive a grant under subsection (a), a State shall agree that,
			 not later than 1 year after the date on which amounts under the grant are first
			 received by the State, and annually thereafter while receiving amounts under
			 the grant, the State will submit to the Secretary an evaluation of the
			 operations and activities carried out under the grant, including—</text>
				<paragraph id="HD6B46ED0EA7D4A27BDF776ADEE350601"><enum>(1)</enum><text>an assessment of
			 the utilization of vision services and the status of children receiving these
			 services as a result of the activities carried out under the grant;</text>
				</paragraph><paragraph id="H47EDE8EFC2B24CD2A6A6A31203522DD8"><enum>(2)</enum><text>the collection,
			 analysis, and reporting of children's vision data according to guidelines
			 prescribed by the Secretary; and</text>
				</paragraph><paragraph id="H89E9EFBBFD2E48D1B4F67FF4F2E19848"><enum>(3)</enum><text>such other
			 information as the Secretary may require.</text>
				</paragraph></subsection><subsection id="HE07F9B047BFD4A2A93926637FC4D7928"><enum>(e)</enum><header>Limitations in
			 expenditure of grant</header><text>A grant may be made under subsection (a)
			 only if the State involved agrees that the State will not expend more than 20
			 percent of the amount received under the grant to carry out the purpose
			 described in paragraph (3) of such subsection.</text>
			</subsection><subsection id="HB381820DD9974A1E8E13D57D98E4ABD4"><enum>(f)</enum><header>Definition</header><text>For
			 purposes of this section, the term <term>comprehensive eye examination</term>
			 includes an assessment of a patient's history, general medical observation,
			 external and ophthalmoscopic examination, visual acuity, ocular alignment and
			 motility, refraction, and as appropriate, binocular vision or gross visual
			 fields, performed by an optometrist or an ophthalmologist.</text>
			</subsection><subsection id="HFFA704E7B63C4FB888B4A4CFFB23C217"><enum>(g)</enum><header>Authorization of
			 appropriations</header><text>For the purpose of carrying out this section,
			 there are authorized to be appropriated such sums as may be necessary for each
			 of fiscal years 2007 through 2011.</text>
