<official-title>To amend the Internal Revenue Code of 1986 to allow penalty-free withdrawals from retirement plans during the period that a military reservist or national guardsman is called to active duty for an extended period, and for other purposes.</official-title>

<section id="H0B02E8A9850E42FD8097D930B4002660" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Guardsmen and Reservists Financial Relief Act of 2005</short-title></quote>.</text></section> 
<section id="H41217D1F8A714ED29EE8BA353C52F54"><enum>2.</enum><header>Penalty-free withdrawals from retirement plans for individuals called to active duty for at least 179 days</header> 
<subsection id="HFA5FC8E216214674B3E72C00883F7E28"><enum>(a)</enum><header>In general</header><text>Paragraph (2) of <external-xref legal-doc="usc" parsable-cite="usc/26/72">section 72(t)</external-xref> of the Internal Revenue Code of 1986 (relating to 10-percent additional tax on early distributions from qualified retirement plans) is amended by adding at the end the following new subparagraph:</text>

<subparagraph id="H00C5F439DCE34E2388EE221376C2ED34"><enum>(G)</enum><header>Distributions from retirement plans to individuals called to active duty</header> 
<clause id="H22E028D9C5A3456E9259E7A5CDF9D4B4"><enum>(i)</enum><header>In general</header><text>Any qualified reservist distribution.</text></clause> 
<clause id="H3C469D7A488B4296AD9BBD8000D228BB"><enum>(ii)</enum><header>Amount distributed may be repaid</header><text>Any individual who receives a qualified reservist distribution may, at any time during the 2-year period beginning on the day after the end of the active duty period, make one or more contributions to an individual retirement plan of such individual in an aggregate amount not to exceed the amount of such distribution. The dollar limitations otherwise applicable to contributions to individual retirement plans shall not apply to any contribution made pursuant to the preceding sentence. No deduction shall be allowed for any contribution pursuant to this clause.</text></clause> 
<clause id="HEC5D2B38A6064D7AB39ED95609688143"><enum>(iii)</enum><header>Qualified reservist distribution</header><text>For purposes of this subparagraph, the term <quote>qualified reservist distribution</quote> means any distribution to an individual if—</text> 
<subclause id="H0AD9B62AAE0141D0A72262C72636F072"><enum>(I)</enum><text>such distribution is from an individual retirement plan, or from amounts attributable to employer contributions made pursuant to elective deferrals described in subparagraph (A) or (C) of section 402(g)(3) or section 501(c)(18)(D)(iii),</text></subclause> 
<subclause id="H699075C059C74DDEA00025888784CFA0"><enum>(II)</enum><text>such individual was (by reason of being a member of a reserve component (as defined in <external-xref legal-doc="usc" parsable-cite="usc/37/101">section 101</external-xref> of title 37, United States Code)), ordered or called to active duty for a period in excess of 179 days or for an indefinite period, and</text></subclause> 
<subclause id="HFF89345F0D80442585DB1B69411E0513"><enum>(III)</enum><text>such distribution is made during the period beginning on the date of such order or call and ending at the close of the active duty period.</text></subclause></clause> 
<clause id="H5F7FCF624C8E44FAA8677B307C791CB7"><enum>(iv)</enum><header>Application of subparagraph</header><text>This subparagraph applies to individuals ordered or called to active duty after September 11, 2001, and before September 12, 2007. In no event shall the 2-year period referred to in clause (ii) end before the date which is 2-years after the date of the enactment of this subparagraph.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HE1421D9ECB0741BB88DFAAD3EC1E5483"><enum>(b)</enum><header>Conforming amendments</header> 
<paragraph id="H6FC8DFFB254D4D4395A0EAAA93E41308"><enum>(1)</enum><text>Section 401(k)(2)(B)(i) of such Code is amended by striking <quote>or</quote> at the end of subclause (III), by striking <quote>and</quote> at the end of subclause (IV) and inserting <quote>or</quote>, and by inserting after subclause (IV) the following new subclause:</text>

<subclause id="HD1AB14833A2C4B2F8635006D9F7C42A"><enum>(V)</enum><text>the date on which a period referred to in section 72(t)(2)(G)(iii)(III) begins, and</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HB450CC77DC5C419C8FFD6E0929CD09EC"><enum>(2)</enum><text display-inline="yes-display-inline">Section 403(b)(7)(A)(ii) of such Code is amended by inserting <quote>unless such amount is a distribution to which section 72(t)(2)(G) applies or</quote> after <quote>distributee</quote>.</text></paragraph> 
<paragraph id="HE01B7D89FC5D4924A3484C7F175376AE"><enum>(3)</enum><text>Section 403(b)(11) of such Code is amended by striking <quote>or</quote> at the end of subparagraph (A), by striking the period at the end of subparagraph (B) and inserting <quote>, or</quote>, and by inserting after subparagraph (B) the following new subparagraph:</text>

<subparagraph id="H927EE5DA52B64A5383BC7FB12CC734E"><enum>(C)</enum><text>for distributions to which section 72(t)(2)(G) applies.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HDF0DA235B25D4B5693E900AB009BA2FA"><enum>(c)</enum><header>Effective date; waiver of limitations</header> 
<paragraph id="HD57D572905D34E3489296701D3157937"><enum>(1)</enum><header>Effective date</header><text>The amendment made by this section shall apply to distributions after September 11, 2001.</text></paragraph> 
<paragraph id="HF8CAD6BE8F6B4AA99288CD546B5C1270"><enum>(2)</enum><header>Waiver of limitations</header><text>If refund or credit of any overpayment of tax resulting from the amendments made by this section is prevented at any time before the close of the 1-year period beginning on the date of the enactment of this Act by the operation of any law or rule of law (including res judicata), such refund or credit may nevertheless be made or allowed if claim therefor is filed before the close of such period.</text></paragraph></subsection></section>
