		<official-title>To amend the Internal Revenue Code of 1986 to treat
		  income earned by mutual funds from exchange-traded funds holding precious metal
		  bullion as qualifying income.</official-title>

		<section display-inline="no-display-inline" id="H222F897C71D64F1DA300A8F445152249" section-type="section-one"><enum>1.</enum><header>Income earned by mutual funds
			 from exchange-traded funds holding precious metal bullion treated as qualifying
			 income</header>
			<subsection id="HDD94D5DF1EE64C22BA845CFA4B59E7A5"><enum>(a)</enum><header>In
			 general</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/851">Section 851</external-xref> of the Internal Revenue Code of 1986 is
			 amended by adding at the end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H75AF9FF8729F478DB44DE8F9A3A49F2F" style="OLC">
					<subsection id="HCA318867BB78405185577268CB019D25"><enum>(i)</enum><header>Bullion
				exchange-traded funds</header>
						<paragraph id="H11E0AC7558F74BF494AA108F80AA84D9"><enum>(1)</enum><header>In
				general</header><text>In the case of any interest in a trust which is described
				in paragraph (2)—</text>
							<subparagraph id="H80F611CA596E4BF38DA265BA932F0015"><enum>(A)</enum><text>such interest
				shall not fail to be treated as a security for purposes of this section by
				reason of any provision of subpart E of subchapter J (relating to grantors and
				others treated as substantial owners),</text>
							</subparagraph><subparagraph id="H0BBF1018002245CDBF87ECD5D2DC636"><enum>(B)</enum><text>any net income
				derived from such interest shall be treated for purposes of subsection (b)(2)
				as gain from the disposition of such interest, and</text>
							</subparagraph><subparagraph id="HA1134E902DBE45CCBA8108BF2D62C593"><enum>(C)</enum><text>the last sentence
				of subsection (b) shall not apply to such interest.</text>
							</subparagraph></paragraph><paragraph id="H22D6D001ADBC41D28875D93EA8E4BD9"><enum>(2)</enum><header>Interests in
				bullion exchange-traded funds described</header><text>An interest in a trust is
				described in this paragraph if—</text>
							<subparagraph id="H8A71EE6ECEF040348572D0AD95129B56"><enum>(A)</enum><text>such interest is a
				security (as defined in section 2(a)(36) of the Investment Company Act of 1940,
				as amended), determined without regard to subpart E of subchapter J,</text>
							</subparagraph><subparagraph id="H3DE4DB4082E642589112EBE86B799BB7"><enum>(B)</enum><text display-inline="yes-display-inline">such interests are regularly traded on an
				established securities market in the United States, and</text>
							</subparagraph><subparagraph id="H30C8022047AD4F74ACA827F9D923E887"><enum>(C)</enum><text>at least 95
				percent of the assets of the trust are bullion described in section
				408(m)(3)(B).</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H5EE0B4F17F7842C70007703CDA2500F"><enum>(b)</enum><header>Effective
			 date</header><text>The amendment made by this section shall apply to taxable
			 years beginning after the date of the enactment of this Act.</text>
