		  ex-offender low-income housing credit to encourage the provision of housing,
		  job training, and other essential services to ex-offenders through a structured
		  living environment designed to assist the ex-offenders in becoming
		  self-sufficient.</official-title>

		<section display-inline="no-display-inline" id="H6191A3FEDAE34C2E8D8CC498F9BF3695" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Public Safety Ex-Offender
			 Self-Sufficiency Act of 2006</short-title></quote>.</text>
		</section><section id="H1EB7B3EE34FF41F7A16783E9340068E3"><enum>2.</enum><header>Temporary
			 ex-offender low-income housing credit</header>
			<subsection id="HD57B911E63124061B9C54FDB59718194"><enum>(a)</enum><header>In
			 general</header><text>Subpart D of part IV of subchapter A of chapter 1 of the
			 Internal Revenue Code of 1986 is amended by adding at the end the following new
			 section:</text>
				<quoted-block id="H2C144736BBD04A2BA51F42F7DD0400B7">
					<section id="H02793E22E40749DB8B1302D123654027"><enum>45N.</enum><header>Ex-offender
				low-income housing credit</header>
						<subsection id="H235EBC43EE9A4BF9921D4FEA3D655BD3"><enum>(a)</enum><header>In
				general</header><text>For purposes of section 38, the amount of the ex-offender
				low-income housing credit determined under this section for any taxable year in
				the credit period shall be an amount equal to—</text>
							<paragraph id="H4EF05E1FAF3541D087AEAC3DE72ED22"><enum>(1)</enum><text>the applicable
				percentage of</text>
							</paragraph><paragraph id="H77D7ED6E30644586B2C1AB00E40011CD"><enum>(2)</enum><text>the qualified
				basis of each qualified ex-offender residential building.</text>
							</paragraph></subsection><subsection id="HEB9E619F2C344676B1EB00A0AB036249"><enum>(b)</enum><header>Applicable
				percentage</header><text>In the case of any qualified ex-offender residential
				building, the term <term>applicable percentage</term> has the meaning given
				such term in section 42(b)(2) with respect to qualified low-income buildings,
				except that, for the purposes of this subsection, the percentages prescribed by
				the Secretary under section 42(b)(2)(B) shall yield amounts of credit which
				have a present value equal to 70 percent of the qualified basis of any
				qualified ex-offender residential building.</text>
						</subsection><subsection id="H3E71FF7A3EF94C27B4C2D055F12DB75"><enum>(c)</enum><header>Qualified
				basis</header>
							<paragraph id="H9F02C5292CD446748EECEF51B65B1627"><enum>(1)</enum><header>In
				general</header><text>For purposes of subsection (a) and except as otherwise
				provided in this subsection, the term <term>qualified basis</term> means the
				adjusted basis of a qualified ex-offender residential building as of the close
				of the 1st taxable year of the credit period.</text>
							</paragraph><paragraph id="H9DE8E1D0AAD0431F80F826A9B0F9AD1D"><enum>(2)</enum><header>Qualified basis
				to include portion of building used to provide ex-offender support
				services</header><text>The qualified basis of any qualified ex-offender
				residential building for any taxable year shall be increased by the lesser
				of—</text>
								<subparagraph id="HEEA009325BAF455BB1B2576967CFA37"><enum>(A)</enum><text>so much of the
				qualified basis of such building as is used throughout the year to provide
				ex-offender support services, or</text>
								</subparagraph><subparagraph id="HF3BB086806174832852506EDC4BEEA65"><enum>(B)</enum><text>20 percent of the
				qualified basis of such building (determined without regard to this
				paragraph).</text>
								</subparagraph></paragraph><paragraph id="H65AC6244ED0045EEAEF7B400E4A22200"><enum>(3)</enum><header>Special
				rules</header><text>Rules similar to the rules of paragraphs (4), (5) (other
				than subparagraph (A) thereof), and (7) of section 42(d) shall apply in
				determining the adjusted basis of any qualified ex-offender residential
				building.</text>
							</paragraph></subsection><subsection id="H941FA5B3F3F64D2BAA0050BDFD7BBC6"><enum>(d)</enum><header>Rehabilitation
				expenditures</header><text>Rules similar to the rules of section 42(e) shall
				apply in determining the treatment of rehabilitation expenditures paid or
				incurred by the taxpayer with respect to a qualified ex-offender residential
				building.</text>
						</subsection><subsection id="HD992BC1FA5E0406C8FB7903D58BBAE00"><enum>(e)</enum><header>Credit
				period</header><text>For purposes of this section, rules similar to the rules
				of section 42(f) shall apply in determining the credit period with respect to
				any qualified ex-offender residential building.</text>
						</subsection><subsection id="H196CC0402DAB42BD9B37D6529DD90392"><enum>(f)</enum><header>Qualified
				ex-offender residential building</header><text>For purposes of this section,
				the term <term>qualified ex-offender residential building</term> means any
				building which, at all times during the compliance period, meets the following
				requirements:</text>
							<paragraph id="HBD3F60B1C9374F71B3EAB2BB00D05C09"><enum>(1)</enum><header>Ex-offender
				residential units</header>
								<subparagraph id="HC0B9E9054FAE464E98563F603C4E22B7"><enum>(A)</enum><header>In
				general</header><text>Each residential unit in such building shall be made
				available for occupancy to not more than 1 ex-offender.</text>
								</subparagraph><subparagraph id="H0C384C1FFA874DE8A36D56FA6E292814"><enum>(B)</enum><header>Residency
				requirements</header><text>Such ex-offender must—</text>
									<clause id="H349D72FBC07047ABBBA1BFE8ECE065C"><enum>(i)</enum><text>meet the residency
				requirements under subsection (g);</text>
									</clause><clause id="HD59A1E314EE346C79E1CACCF75A5E0D3"><enum>(ii)</enum><text>have failed to
				meet such requirements for fewer than 14 days; or</text>
									</clause><clause id="HB911EFE102474301B8E6ABE4C5929F31"><enum>(iii)</enum><text>be in the
				process of being evicted from such building for failing to meet such
				requirements.</text>
									</clause></subparagraph><subparagraph id="H9DF709ED030243A6B548843F59C281C1"><enum>(C)</enum><header>Flexibility</header><text>A
				building shall not be determined to fail to satisfy the requirements of this
				paragraph solely because—</text>
									<clause id="HC7A4F07C894E45E700FCE17B94FD0995"><enum>(i)</enum><text>some or all of the
				residential units in such building are single room occupancy (as defined in
				section (8)(n) of the <act-name parsable-cite="USHA">United States Housing Act
				of 1937</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f(n)</external-xref>)), or</text>
									</clause><clause id="HB567E254BEAE47A28FC4AD753F13E69"><enum>(ii)</enum><text>any unit made
				available to an ex-offender is also made available to one or more members of
				the ex-offender’s family (as determined by the taxpayer).</text>
									</clause></subparagraph></paragraph><paragraph id="H10EC30D48F874BFB95A8645496274ED0"><enum>(2)</enum><header>Self-sufficiency
				centers for ex-offenders</header><text>The building shall include a
				self-sufficiency center for ex-offenders that—</text>
								<subparagraph id="H68D435B76E9F4D2F957E97C544B15989"><enum>(A)</enum><text>is specifically
				designed to accommodate, and reserved for, the provision of ex-offender support
				services to residents of the facility and other ex-offenders;</text>
								</subparagraph><subparagraph id="HEC0C43C8C1834438BFB8A35F9893F2D4"><enum>(B)</enum><text>is made available
				for rental by providers of such services at a rate determined by the owner of
				the facility; and</text>
								</subparagraph><subparagraph id="HC474FC7F49DC4F82B6B7EFCDF5377132"><enum>(C)</enum><text>provides an array
				of such services sufficient to meet a significant portion of the needs of
				ex-offenders for ex-offender support services.</text>
								</subparagraph></paragraph><paragraph id="HD9919E7A3C0045D29BAC1F6EA0B6FF00"><enum>(3)</enum><header>Rent
				limitations</header><text>The portion of the monthly rent payable by the
				occupant of each unit in the building may not exceed 30 percent of the adjusted
				monthly income (as such term is defined in section 3(b) of the
				<act-name parsable-cite="USHA">United States Housing Act of 1937</act-name> (42
				U.S.C. 1437a(b)) of the occupant.</text>
							</paragraph></subsection><subsection id="H5592487980CF4CA59FEBAD49C0DBC4D7"><enum>(g)</enum><header>Residency
				requirements</header>
							<paragraph id="H53BF4BCF8EB9474683DE68DA4750D7E3"><enum>(1)</enum><header>In
				general</header><text>An ex-offender meets the residency requirements for a
				qualified ex-offender residential building if such ex-offender—</text>
								<subparagraph id="H31B84A40C0B4499BA6ABD07185167892"><enum>(A)</enum><text>has a low
				income;</text>
								</subparagraph><subparagraph id="HAC2B79DCEFC34A6C9933285612E4FDA"><enum>(B)</enum><text>is participating in
				an ex-offender support services program as described in paragraph
				(3)(B);</text>
								</subparagraph><subparagraph id="H7A109749BBB54AFE81C4DBC125BED3B"><enum>(C)</enum><text>has not been
				prohibited from residency under paragraph (4); and</text>
								</subparagraph><subparagraph id="H13F1F0C17CF34533ACF83C90737E008D"><enum>(D)</enum><text>commences
				occupancy of a unit in a qualified ex-offender residential building on a date
				that is not later than—</text>
									<clause id="H865615A3E75A457D81CD85647C9706C3"><enum>(i)</enum><text>in
				the case of an ex-offender who has been discharged from prison, jail, a
				half-way house, or any other correctional facility, 12 months after such
				discharge; or</text>
									</clause><clause id="HC54A07B31612449200124CB0BBA4AFC7"><enum>(ii)</enum><text>in the case of
				any ex-offender whose sentence did not include confinement to a correctional
				facility, 12 months after the date of the ex-offender’s conviction.</text>
									</clause></subparagraph></paragraph><paragraph id="H451F0F7FC02845F300B678009EF5B2A3"><enum>(2)</enum><header>Low-income</header><text>For
				purposes of this section, an ex-offender is considered to have a low income if,
				at the commencement of the ex-offender’s occupancy of a residential unit, the
				income (if any) of the ex-offender does not exceed 60 percent of area median
				gross income (as determined consistent with section 8 of the
				<act-name parsable-cite="USHA">United States Housing Act of
				1937</act-name>).</text>
							</paragraph><paragraph id="H1944E24421E24EA3932E57E0801F9BBB"><enum>(3)</enum><header>Participation in
				ex-offender support services program</header>
								<subparagraph id="H15B56035C23F4DBB947673B442B65DF3"><enum>(A)</enum><header>Program</header><text>For
				purposes of this section, an ex-offender support services program is a program
				for the provision of specific ex-offender support services for an ex-offender
				that—</text>
									<clause id="H40EDF173B1BA46C3838CB4A0C611ECB"><enum>(i)</enum><text>is
				created and managed by a coordinating individual or entity having education,
				training, and experience with ex-offenders and their support services
				needs;</text>
									</clause><clause id="H2D63904C26CF483094358F0268172DFE"><enum>(ii)</enum><text>is specifically
				designed to meet the needs of the particular ex-offender for ex-offender
				support services;</text>
									</clause><clause id="HC15AB276C874469CA679A593DF7EE21C"><enum>(iii)</enum><text>sets forth a
				specific duration over which the ex-offender support services are to be
				provided and goals by which to assess the progress of the ex-offender;
				and</text>
									</clause><clause id="HFB9CD61804564C94A341F555452705B"><enum>(iv)</enum><text>provides for
				continual oversight to monitor the progress and needs of the ex-offender and to
				ensure that the ex-offender is being provided the appropriate ex-offender
				support services and is complying with the requirements of the program.</text>
									</clause></subparagraph><subparagraph id="HBC4325C00586428BBA2C489F00CA54E1"><enum>(B)</enum><header>Participation</header><text>For
				purposes of this section, an ex-offender is considered to be participating in
				an ex-offender support services program if the ex-offender—</text>
									<clause id="H2032DA66877245969CED08FBA2668CA1"><enum>(i)</enum><text>has entered into a
				written agreement with the coordinator for the program that—</text>
										<subclause id="H834884FE83654846849CDB83F368F6C1"><enum>(I)</enum><text>sets forth the
				ex-offender support services that are appropriate for, and will be made
				available to, the ex-offender and the duration of the program for the
				ex-offender; and</text>
										</subclause><subclause id="HDD9825D15F1144DBB909AF56CDFE2EE"><enum>(II)</enum><text>provides that the
				ex-offender’s continued attendance at scheduled program meetings and events and
				obtaining of program services are a condition of the ex-offender’s continued
				residency in the facility; and</text>
										</subclause></clause><clause id="H03FA37347050487FBF3562C6A993B2B0"><enum>(ii)</enum><text>is not in default
				with regard to the ex-offender’s obligations under such agreement.</text>
									</clause></subparagraph><subparagraph id="H2CA5A5BFE6734DA2B867ABCA712EB781"><enum>(C)</enum><header>Ex-offender
				support services</header><text>For purposes of this section, the term
				<term>ex-offender support services</term> means services that assist
				ex-offenders to develop skills necessary for life outside of the environment of
				a correctional institution, and includes—</text>
									<clause id="H740FB8B178EB4CDAA0A945B392EF37B8"><enum>(i)</enum><text>job
				training;</text>
									</clause><clause id="H7A3CEE3D82A24243BDAAF205E0AFA103"><enum>(ii)</enum><text>employment
				counseling and placement;</text>
									</clause><clause id="HF69973BB01D443DE9B6692DE2D94CF1C"><enum>(iii)</enum><text>entrepreneurial
				training;</text>
									</clause><clause id="HB9C6568038634303BF68C18298D37FC0"><enum>(iv)</enum><text>financial
				management training;</text>
									</clause><clause id="H81AB81BBCFCC4BA68210C794133B6335"><enum>(v)</enum><text>homeownership and
				rental counseling;</text>
									</clause><clause id="H2A8D54F5AD034F6E8B12FB39D617C74E"><enum>(vi)</enum><text>drug and alcohol
				abuse counseling;</text>
									</clause><clause id="H58B058C93E444E609806AFEEAA9D66"><enum>(vii)</enum><text>self-esteem and
				peer development assistance;</text>
									</clause><clause id="H946281DFB5DE4CE1B39E7D00ADA8F2A2"><enum>(viii)</enum><text>anger
				management counseling;</text>
									</clause><clause id="HF8A7293FADD94DD1965B25B99C13DB9D"><enum>(ix)</enum><text>health care
				services, including mental health services and behavioral counseling;</text>
									</clause><clause id="H084E3DB1AED34C02A7AC20224E526CC7"><enum>(x)</enum><text>probation
				services;</text>
									</clause><clause id="HF1567E077E1C430992FF19E01F5C26FC"><enum>(xi)</enum><text>family and crisis
				management counseling; and</text>
									</clause><clause id="HD82EEDDD0E1A45C8AEBA26CE9907FBD6"><enum>(xii)</enum><text>general
				educational assistance and counseling.</text>
									</clause></subparagraph></paragraph><paragraph id="H413AC33BF5F145818328A866E80A642"><enum>(4)</enum><header>Limitation on
				term of residency</header><text>An ex-offender may not reside in an ex-offender
				residential facility at any time after the expiration of the 2-year period
				beginning upon the commencement of the ex-offender’s occupancy in the
				ex-offender residential facility.</text>
							</paragraph></subsection><subsection id="H7A6C572CC4C1422BBBB77817B9406606"><enum>(h)</enum><header>Ex-offender</header><text>For
				purposes of this section, the term <term>ex-offender</term> means any
				individual who has been convicted of a crime under State or Federal law which
				is punishable by imprisonment for a maximum term of 6 months or longer.</text>
						</subsection><subsection id="H3D0D0D13FD5748EAABE77DB7EC8DB570"><enum>(i)</enum><header>Allocation and
				determination of credit</header>
							<paragraph id="H6C23F4E65CC64CE29F6B2D27A3009E66"><enum>(1)</enum><header>In
				general</header><text>Except as otherwise provided in this subsection, rules
				similar to the rules of section 42(h) (other than subparagraphs (E) and (F) of
				paragraph (1) thereof) shall apply with respect to allocating and determining
				any credit under this section.</text>
							</paragraph><paragraph id="H5B6C12A7E9EA42DFA15BFDA0F59D04AD"><enum>(2)</enum><header>State housing
				credit ceiling</header><text>For purposes of this section:</text>
								<subparagraph id="H17A901776C36436BB9573B2EFE4CF8B6"><enum>(A)</enum><header>In
				general</header><text>The State housing credit ceiling shall be calculated by
				substituting the amount determined under section 42(h)(3)(C)(ii) with the State
				allocation.</text>
								</subparagraph><subparagraph id="HCCDBAD3B55A04BB68F3FA2ED9BD4A500"><enum>(B)</enum><header>State
				allocation</header>
									<clause id="H23F7C32C88C24506AFFD67FD3E3814A1"><enum>(i)</enum><header>Competitive
				process</header><text>The State allocation for any State shall be determined by
				the Secretary, utilizing a competitive application process.</text>
									</clause><clause id="H96ECB00FE6884A85B4C343A4CB142F36"><enum>(ii)</enum><header>Basis for
				competition</header><text>In determining the State allocation for any State,
				the Secretary shall consider the following:</text>
										<subclause id="H9A8EB87F00AB40D7847D0154C5CEFCE7"><enum>(I)</enum><text>Need, as
				determined by the ratio between the reported number of sentenced prisoners
				released from State or Federal jurisdiction in the applicant State during the
				most recent year for which information is available, and the total population
				of the applicant State.</text>
										</subclause><subclause id="H8F52FB69DEE74F60A4D31EB69EB3C8DD"><enum>(II)</enum><text>The commitment of
				Federal and other funds within the applicant State for operating costs and
				ex-offender support services in projects that are to be funded by the State
				temporary ex-offender low-income housing credit.</text>
										</subclause><subclause id="HB114CC5E31F04A97837FCCADC065B17"><enum>(III)</enum><text>The applicant’s
				plan to collect available information about the success of the program with
				respect to increased housing stability and lack of additional incarceration of
				ex-offeder participants.</text>
										</subclause><subclause id="H0F07AEF425234397ABF3BA4491FE1543"><enum>(IV)</enum><text>The applicant’s
				organizational capacity for the successful development or operation of
				qualified ex-offender residential buildings.</text>
										</subclause><subclause id="HE7D3173C41F446A09369B5926049D2EE"><enum>(V)</enum><text>The goal of making
				allocations to the largest feasible number of States.</text>
										</subclause></clause><clause id="H4C85BB9DA2AB44FFB37C8B87EBE914D3"><enum>(iii)</enum><header>Aggregate
				amount</header><text>The aggregate amount of State allocations for any year
				shall be $85,000,000.</text>
									</clause></subparagraph><subparagraph id="HB692DEED6E0F4284B62EA99BD5F3A63D"><enum>(C)</enum><header>Building
				allocations</header><text>The Secretary may allocate a housing credit dollar
				amount to any building. In making such allocations, the Secretary shall utilize
				a competitive application process and shall consider the factors described in
				subparagraph (B)(ii). Any allocation made under this subparagraph shall be
				treated for purposes of this subsection as part of the State allocation for the
				State in which such building is located.</text>
								</subparagraph><subparagraph id="HB62D222978FD423092056E75CD62557D"><enum>(D)</enum><header>Unused housing
				credit carryovers</header>
									<clause id="HD002C5C47ECE472E00A05B00E59080D"><enum>(i)</enum><header>In
				general</header><text>The State housing credit ceiling shall be calculated by
				substituting the amount determined under section 42(h)(3)(C)(iv) with the State
				carryover allocation.</text>
									</clause><clause id="HCECFD200348C4DBBA9B334B5B269DE65"><enum>(ii)</enum><header>State carryover
				allocation</header><text>The State carryover allocation for any State shall be
				determined by the Secretary in a manner similar to the manner in which the
				State allocation is determined under subparagraph (B). The aggregate amount of
				State carryover allocations for any year shall be equal to the aggregate unused
				housing credit carryovers (within the meaning of section 42(h)(3)(D)) of all
				States for the preceding calendar year.</text>
									</clause></subparagraph></paragraph><paragraph commented="no" id="H1F48715A03E44035A4EECA2B0176CB19"><enum>(3)</enum><header>Required
				involvement of qualified non-profit organizations</header><text>For purposes of
				this section, section 42(h)(5)(A) shall be applied by substituting
				<quote>75</quote> for <quote>90</quote>.</text>
							</paragraph></subsection><subsection id="HE2BA023F57CA4FB1941578C0001644F9"><enum>(j)</enum><header>Recapture of
				credit</header><text>Rules similar to the rules of subsections (i)(1) and (j)
				of section 42 shall apply for purposes of this section.</text>
						</subsection><subsection id="H1D9C1EF9BD0143B39BDE5020225E003D"><enum>(k)</enum><header>Application of
				at-risk rules</header><text>Rules similar to the rules of section 42(k) shall
				apply for purposes of this section.</text>
						</subsection><subsection id="HFE404DE679FA48AA92A3ED55C3C20006"><enum>(l)</enum><header>Certification
				and other reports to Secretary</header><text>Subject to such regulations as the
				Secretary may prescribe, rules similar to the rules of section 42(l) shall
				apply for purposes of this section.</text>
						</subsection><subsection id="H631A4567AC0D4429B571C8249772FAAC"><enum>(m)</enum><header>Responsibilities
				of the Secretary and housing credit agencies</header><text>Rules similar to the
				rules of subsections (m) and (n) of section 42 shall apply for purposes of this
				section.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H58106C486BD54C73A36ED6351459663F"><enum>(b)</enum><header>Inclusion as
			 current year business credit</header><text>Section 38(b) of the Internal
			 Revenue Code of 1986 is amended by striking <quote>and</quote> at the end of
			 paragraph (29), by striking the period at the end of paragraph (30) and
			 inserting <quote>, and</quote>, and by adding at the end the following new
			 paragraph:</text>
				<quoted-block id="H525DB3E87F80487C93A8FE005EBF74EA">
					<paragraph id="H033F5AA2155E46ABB2E3FA6CDF21579E"><enum>(31)</enum><text>the ex-offender
				low-income housing credit under section
				45N(a).</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H2975C85D39AE400C912E40171DCAD176"><enum>(c)</enum><header>Clerical
			 amendment</header><text>The table of sections for subpart D of part IV of
			 subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by
			 adding at the end the following new item:</text>
