<official-title>To amend the Help America Vote Act of 2002 to require States to conduct Presidential elections using paper ballots and to count those ballots by hand, and for other purposes.</official-title>

<section id="HE03831AD1C3F4D30BC85E068009BC0C3" section-type="section-one"><enum>1.</enum><header>Short Title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Paper Ballot Act of 2006</short-title></quote>.</text></section> 
<section id="HB83D8A5B02934B959637FDA3F300E508"><enum>2.</enum><header>Requiring Use of Hand-Counted Paper Ballots in Presidential Elections</header><text display-inline="no-display-inline">Section 301(a) of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/42/15481">42 U.S.C. 15481(a)</external-xref>) is amended by adding at the end the following new paragraph:</text> 
<quoted-block style="OLC" id="HF79787D0F9DE4C32A4E2D190E5EAAD6D" display-inline="no-display-inline"> 
<paragraph id="HC243F9D6EEBD43A9BA57DD82303F84EA"><enum>(7)</enum><header>Special rules for Presidential elections</header><text>Notwithstanding any other provision of this subsection, in the case of a regularly scheduled general election for the electors of President and Vice President (beginning with the election in November 2008), the following rules shall apply:</text> 
<subparagraph id="H39866CDF192F474D944EAF524D340F7"><enum>(A)</enum><text>The State shall conduct the election using only paper ballots.</text></subparagraph> 
<subparagraph id="H77DFA8D4FFBB4E41AAF8C5D862BF5BA7"><enum>(B)</enum><text>The State shall ensure that the number of ballots cast at a precinct or equivalent location which are placed inside a single box or similar container does not exceed 500.</text></subparagraph> 
<subparagraph id="H350C572AB10441F996D41B9EE14BCD00"><enum>(C)</enum><text>The ballots cast at a precinct or equivalent location shall be counted by hand by election officials at the precinct, and a representative of each political party with a candidate on the ballot, as well as any interested member of the public, may observe the officials as they count the ballots. The previous sentence shall not apply with respect to provisional ballots cast under section 302(a).</text></subparagraph> </paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H211EE957F27545CD830000623C9FDA82"><enum>3.</enum><header>Moving Observation of Washington’s Birthday to Election Day During Presidential Election Years</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/5/6103">Section 6103(a)</external-xref> of title 5, United States Code, is amended—</text> 
<paragraph id="H9D1CC6C213A54285A1E28E123514511F"><enum>(1)</enum><text>by inserting <quote>the Tuesday next after the first Monday in November in 2008 and every fourth year thereafter, and</quote> after <quote>Washington’s Birthday,</quote>; and</text></paragraph> 
<paragraph id="H1447610C66864A0685A029AD3132D991"><enum>(2)</enum><text>by inserting <quote>in any other year</quote> after <quote>February</quote>.</text></paragraph></section>
