<subsection id="HDBCDD2B77B7E4B4A92DE313D78BDFEBA"><enum>(a)</enum><header>Short Title</header><text>This Act may be cited as the <quote><short-title>Veterans Health Care Act of 2006</short-title></quote>.</text></subsection> 
<subsection id="HE6F3A25D4D244CDEABF0AB98D72E51E8"><enum>(b)</enum><header>References</header><text>Except as otherwise expressly provided, whenever in this Act an amendment or repeal is expressed in terms of an amendment or repeal to a section or other provision, the reference shall be considered to be made to a section or other provision of title 38, United States Code.</text></subsection>

<subsection id="H942A833C081345DBAC53848E571B2F21"><enum>(a)</enum><header>In General</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/17">Chapter 17</external-xref> is amended by adding at the end the following new section:</text>

<section id="H749B6A8B97DE430885165665963E692F"><enum>1786.</enum><header>Care for newborn children of women veterans receiving maternity care</header><text display-inline="no-display-inline">The Secretary may furnish care to a newborn child of a woman veteran, who is receiving maternity care furnished by the Department, for not more than 14 days after the birth of the child if the veteran delivered the child in a Department facility or in another facility pursuant to a Department contract for the delivery services.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H631B3F1E8FAD454D9009C70539445E45"><enum>(b)</enum><header>Clerical Amendment</header><text>The table of sections at the beginning of such chapter is amended by adding at the end the following new item:</text>

<subsection id="H097B8CA603F94813AAAEA10083E95DD0"><enum>(a)</enum><header>Health Care for Spina Bifida and Associated Disabilities</header><text><external-xref legal-doc="usc" parsable-cite="usc/38/1803">Section 1803</external-xref> is amended—</text> 
<paragraph id="HA9C9E0B4177640888C414DA08E231F24"><enum>(1)</enum><text>by redesignating subsection (c) as subsection (d); and</text></paragraph>

<paragraph display-inline="yes-display-inline" id="HBCCC897025A3487B85EFCBF636492DC1"><enum>(1)</enum><text>If a payment made by the Secretary for health care under this section is less than the amount billed for such health care, the health care provider or agent of the health care provider may, in accordance with paragraphs (2) through (4), seek payment for the difference between the amount billed and the amount paid by the Secretary from a responsible third party to the extent that the provider or agent would be eligible to receive payment for such health care from such third party.</text></paragraph> 
<paragraph indent="up1" id="H3A82F378DA50433181A21D61B79B71CD"><enum>(2)</enum><text>The health care provider or agent may not impose any additional charge on the beneficiary who received the health care, or the family of such beneficiary, for any service or item for which the Secretary has made payment under this section.</text></paragraph> 
<paragraph indent="up1" id="H7BBF26E7CC32427DB86913671C356496"><enum>(3)</enum><text>The total amount of payment a health care provider or agent may receive for health care furnished under this section may not exceed the amount billed to the Secretary.</text></paragraph> 
<paragraph indent="up1" id="HC4FB889C45C447AAAD20B371B34C5C7F"><enum>(4)</enum><text>The Secretary, upon request, shall disclose to such third party information received for the purposes of carrying out this section.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>

<subsection id="HB3F34B2D12A74D95BF6113ACE7928B1B"><enum>(a)</enum><header>Qualifications</header><text><external-xref legal-doc="usc" parsable-cite="usc/38/7402">Section 7402(b)</external-xref> is amended—</text> 
<paragraph id="H559932C72499449AB5D3A44CCFA17BD"><enum>(1)</enum><text>by redesignating paragraph (10) as paragraph (12); and</text></paragraph> 
<paragraph id="HB93F9C0EC3994F1D95CD5CF3B62900A3"><enum>(2)</enum><text>by inserting after paragraph (9) the following new paragraphs:</text> 
<quoted-block style="OLC" id="HD195B5C3172B4C45B64F3F6C1471A6E3"> 
<paragraph indent="up1" id="HEAEE9A97E28D4ABA91E115F9D92C25C5"><enum>(10)</enum><header>Marriage and family therapist</header><text>To be eligible to be appointed to a marriage and family therapist position, a person shall—</text> 
<subparagraph id="HFB68F0FCA80F47EE9BE3115F1406EEB"><enum>(A)</enum><text>hold a master’s degree in marriage and family therapy, or a comparable degree in mental health, from a college or university approved by the Secretary; and</text></subparagraph> 
<subparagraph id="H6EAD67D20AB44351B5C22FFCB61B9103"><enum>(B)</enum><text>be licensed or certified to independently practice marriage and family therapy in a State, except that the Secretary may waive the requirement of licensure or certification for an individual marriage and family therapist for a reasonable period of time recommended by the Under Secretary for Health.</text></subparagraph></paragraph> 
<paragraph indent="up1" id="H206BB00394434264A496A374008BF000"><enum>(11)</enum><header>Licensed professional mental health counselors</header><text>To be eligible to be appointed to a licensed professional mental health counselor position, a person shall—</text> 
<subparagraph id="HB719969A7F5B40E4AC4496758E7700C5"><enum>(A)</enum><text>hold a master’s degree in mental health counseling, or a related field, from a college or university approved by the Secretary; and</text></subparagraph> 
<subparagraph id="H687ADCABB73F4E42821D9500A6FFA450"><enum>(B)</enum><text>be licensed or certified to independently practice mental health counseling.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H3066D0B6AFB3404C00F10060E6A8EAAD"><enum>(b)</enum><header>Report on Marriage and Family Therapy Workload</header> 
<paragraph id="H9B49B02488D14837B7DE7308603C4FD1"><enum>(1)</enum><header>In general</header><text>Not later than 90 days after the date of the enactment of this Act, the Under Secretary for Health of the Department of Veterans Affairs shall submit to the Committee on Veterans’ Affairs of the Senate and the Committee on Veterans’ Affairs of the House of Representatives a report on the provisions of post-traumatic stress disorder treatment by marriage and family therapists.</text></paragraph> 
<paragraph id="H089432B7C4EE4E35BE600688C13576DF"><enum>(2)</enum><header>Contents</header><text>The report submitted under paragraph (1) shall include—</text> 
<subparagraph id="HEF81C125E678457EB5E3CFA5CA25DE"><enum>(A)</enum><text>the actual and projected workloads in facilities of the Veterans Readjustment Counseling Service and the Veterans Health Administration for the provision of marriage and family counseling for veterans diagnosed with, or otherwise in need of treatment for, post-traumatic stress disorder;</text></subparagraph> 
<subparagraph id="H56E9C4155FB645C0A100398937D8D072"><enum>(B)</enum><text>the resources available and needed to support the workload projections described in subparagraph (A);</text></subparagraph> 
<subparagraph id="H477FED6167FC4BB79C7428FA35A429D2"><enum>(C)</enum><text>an assessment by the Under Secretary for Health of the effectiveness of treatment by marriage and family therapists; and</text></subparagraph> 
<subparagraph id="HB20BF09E98BF4FE49235C87730681356"><enum>(D)</enum><text>recommendations, if any, for improvements in the provision of such counseling treatment.</text></subparagraph></paragraph></subsection></section> 
<section id="H2B0C841712924A4C9EEFACCAE005D1B"><enum>6.</enum><header>Pay comparability for chief nursing officer, office of nursing services</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/38/7404">Section 7404</external-xref> is amended—</text> 
<paragraph id="HFCCC47BC60404212AA59DFAF24E600E3"><enum>(1)</enum><text>in subsection (d), by striking <quote>subchapter III and in</quote> and inserting <quote>subsection (e), subchapter III, and</quote>; and</text></paragraph> 
<paragraph id="H87942AC6FE5244BF86E78B9CBD3C252D"><enum>(2)</enum><text>by adding at the end the following new subsection:</text> 
<quoted-block style="OLC" id="H5A4471FD81574DDBB6D8DB7EA0CF94FE"> 
<subsection id="H964D20206EF147A1A41910437F306464"><enum>(e)</enum><text>The position of Chief Nursing Officer, Office of Nursing Services, shall be exempt from the provisions of <external-xref legal-doc="usc" parsable-cite="usc/38/7451">section 7451</external-xref> of this title and shall be paid at a rate not to exceed the maximum rate established for the Senior Executive Service under <external-xref legal-doc="usc" parsable-cite="usc/5/5382">section 5382</external-xref> of title 5, as determined by the Secretary.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H3578B698B73A4A43B13E43A3FADEADF"><enum>7.</enum><header>Cost comparison studies</header> 
<subsection id="HED475225ABC04F71AE4C43E1C70316B2"><enum>(a)</enum><header>Studies Authorized</header> 
<paragraph id="H30E1D8D486CC4701B9F409DA82F7F2BF"><enum>(1)</enum><header>In general</header><text>Notwithstanding <external-xref legal-doc="usc" parsable-cite="usc/38/8110">section 8110(a)(5)</external-xref> of title 38, United States Code, the Secretary of Veterans Affairs may conduct studies to compare the amount that would be expended if private contractors provided specific commercial or industrial products and services for the Veterans Health Administration with the amount that would be expended if the Department of Veterans Affairs provided such products and services for the Veterans Health Administration.</text></paragraph> 
<paragraph id="H49E071153B0340499948B6D67219F219"><enum>(2)</enum><header>Limitation</header><text>In the course of conducting the private-public cost comparison studies under paragraph (1), a private contractor may not receive an advantage for a proposal that would reduce costs for the Department of Veterans Affairs by—</text> 
<subparagraph id="H8A5FEB806E7A439095BA62E2E0F7CB38"><enum>(A)</enum><text>not making an employer-sponsored health insurance plan available to the workers who are to be employed in the performance of that activity or function under the contract; or</text></subparagraph> 
<subparagraph id="HF5F9698AD3A64C54A9ABF334B37C232F"><enum>(B)</enum><text>offering to such workers an employer-sponsored health benefits plan that requires the employer to contribute less towards the premium or subscription share than the amount that is paid by the Department of Veterans Affairs for health benefits for civilian employees under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/89">chapter 89</external-xref> of title 5, United States Code.</text></subparagraph></paragraph> 
<paragraph id="H31135A495DC84B9EB86824A0B0250044"><enum>(3)</enum><header>Authorization of appropriations</header> 
<subparagraph id="HD2D3F87FFEB340C8A8E3A1A79387BFAF"><enum>(A)</enum><header>In general</header><text>There are authorized to be appropriated $15,000,000 to carry out paragraph (1), of which—</text> 
<clause id="HFCC0C7D9A801455DBC04BA808632489"><enum>(i)</enum><text>not more than $7,500,000 shall be available to evaluate activities that have been performed by employees of the Federal Government; and</text></clause> 
<clause id="H82DE8AA222274ABBA18251619400C55C"><enum>(ii)</enum><text>not more than $7,500,000 shall be available to evaluate activities that have been performed by private contractors.</text></clause></subparagraph> 
<subparagraph id="H4BA540457E3141149400F7AB00677708"><enum>(B)</enum><header>Sunset date</header><text>This paragraph is repealed on September 30, 2008.</text></subparagraph></paragraph></subsection> 
<subsection id="H3820A16C51754FD4BFA913C206FCB9D"><enum>(b)</enum><header>Report</header><text>Not later than March 15, 2008, the Secretary of Veterans Affairs shall submit to the Committee on Veterans’ Affairs of the Senate and the Committee on Veterans’ Affairs of the House of Representatives a report that—</text> 
<paragraph id="H138C45BF77714FB6A440FAA5024C4C51"><enum>(1)</enum><text>identifies the amount expended by the Department of Veterans Affairs during fiscal year 2007 to conduct cost comparison studies, including—</text> 
<subparagraph id="H74B09E02B62348DC0080147D498FBDE4"><enum>(A)</enum><text>studies conducted in accordance with Office of Management and Budget Circular A–76; and</text></subparagraph> 
<subparagraph id="HCBBB9D4F305D41918311FF2675C4800"><enum>(B)</enum><text>studies to identify the most efficient internal processes for the Department of Veterans Affairs;</text></subparagraph></paragraph> 
<paragraph id="HF79D28A3C2CC4D1FA6327F8CB56565E7"><enum>(2)</enum><text>summarizes the benefits and burdens of the studies described in paragraph (1);</text></paragraph> 
<paragraph id="HCD0B669DAC8249A8A55414F9FAB65167"><enum>(3)</enum><text>analyzes each approach for determining—</text> 
<subparagraph id="H58EF433CA1EC402884524F45148E333F"><enum>(A)</enum><text>the best method of allocating the resources of the Department of Veterans Affairs; and</text></subparagraph> 
<subparagraph id="H1911EDED997F4E3983038B003B73335E"><enum>(B)</enum><text>the appropriate use of nongovernmental employees; and</text></subparagraph></paragraph> 
<paragraph id="HC028D546B7F54126B0CAD27BBC9A579"><enum>(4)</enum><text>identifies the amount of savings (calculated in terms of full-time employee reinvestment), if any, to the Department of Veterans Affairs as a result of—</text> 
<subparagraph id="H4630C4ECA55B40D69E732331F7C69D30"><enum>(A)</enum><text>the private-public cost comparison studies conducted under subsection (a); and</text></subparagraph> 
<subparagraph id="H3387FBBEE3594D11B2CDF06FFCEDEED"><enum>(B)</enum><text>the Department of Veterans Affairs internal processes for the same positions.</text></subparagraph></paragraph></subsection></section> 
<section id="HEE3CCFE596B44132B44D8189414393D4"><enum>8.</enum><header>Improvements and expansion of mental Health services</header> 
<subsection id="H2CBC3E71C18D44D79C229EF000BFF701"><enum>(a)</enum><header>Findings</header><text>Congress makes the following findings:</text> 
<paragraph id="H7E79F41F4F18411F8D7278BB38B296A7"><enum>(1)</enum><text>Mental health treatment capacity at community-based outpatient clinics remains inadequate and inconsistent, despite the requirement under <external-xref legal-doc="usc" parsable-cite="usc/38/1706">section 1706(c)</external-xref> of title 38, United States Code, that every primary care health care facility of the Department of Veterans Affairs develop and carry out a plan to meet the mental health care needs of veterans who require such services.</text></paragraph> 
<paragraph id="H508AA770F4AB47239603C608F96ED0C6"><enum>(2)</enum><text>In 2001, the minority staff of the Committee on Veterans’ Affairs of the Senate conducted a survey of community-based outpatient clinics and found that there was no established systemwide baseline of acceptable mental health service levels at such clinics.</text></paragraph> 
<paragraph id="HCAD43055E6334FAAA3271C4459BE883E"><enum>(3)</enum><text>In February 2005, the Government Accountability Office reported that the Department of Veterans Affairs had not fully met any of the 24 clinical care and education recommendations made in 2004 by the Special Committee on Post-Traumatic Stress Disorder of the Under Secretary for Health of the Department of Veterans Affairs.</text></paragraph></subsection> 
<subsection id="H691486F69DAF474CBBCDAAC1A3A844E0"><enum>(b)</enum><header>Clinical Services and Education</header> 
<paragraph id="HF80ACB7558014B2B952FC039F424DC55"><enum>(1)</enum><header>In general</header><text>The Secretary of Veterans Affairs shall—</text> 
<subparagraph id="H67FC973596AA467CB21E362BD3C6FB60"><enum>(A)</enum><text>expand the number of clinical treatment teams principally dedicated to the treatment of post-traumatic stress disorder in medical facilities of the Department of Veterans Affairs;</text></subparagraph> 
<subparagraph id="HFC2BF63A8E3A4B149FA79C6F1BCADA3"><enum>(B)</enum><text>expand and improve the services available to diagnose and treat substance abuse;</text></subparagraph> 
<subparagraph id="H921566F55D92497A98E589B1AB609261"><enum>(C)</enum><text>expand and improve telehealth initiatives to provide better access to mental health services in areas of the country in which the Secretary determines that a need for such services exist due to the distance of such locations from an appropriate facility of the Department of Veterans Affairs;</text></subparagraph> 
<subparagraph id="HF2A3AD55BFA94B5685A4C13644582F2D"><enum>(D)</enum><text>improve education programs available to primary care delivery professionals and dedicate such programs to recognize, treat, and clinically manage veterans with mental health care needs;</text></subparagraph> 
<subparagraph id="H4D36C9DEAA02484A9E4ECD09FDB62C4D"><enum>(E)</enum><text>expand the delivery of mental health services in community-based outpatient clinics of the Department of Veterans Affairs in which such services are not available as of the date of enactment of this Act; and</text></subparagraph> 
<subparagraph id="HD7C6A044E9794D4292908C32408D5CF2"><enum>(F)</enum><text>expand and improve the Mental Health Intensive Case Management Teams for the treatment and clinical case management of veterans with serious or chronic mental illness.</text></subparagraph></paragraph> 
<paragraph id="HA3CEA70D544A4CCE8B8DE716FC9F8202"><enum>(2)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated $95,000,000 in each of fiscal years 2007 and 2008 to improve and expand the treatment services and options available to veterans in need of mental health treatment from the Department of Veterans Affairs, of which—</text> 
<subparagraph id="H60D559B92A6943F29170AA2D703DF4E1"><enum>(A)</enum><text>$5,000,000 shall be allocated to carry out paragraph (1)(A);</text></subparagraph> 
<subparagraph id="H3722AF122D0C463BB0F05FFF674ECD71"><enum>(B)</enum><text>$50,000,000 shall be allocated to carry out paragraph (1)(B);</text></subparagraph> 
<subparagraph id="H8EF89DF06E3C4B10BFDDFBA59903D7C3"><enum>(C)</enum><text>$10,000,000 shall be allocated to carry out paragraph (1)(C);</text></subparagraph> 
<subparagraph id="H6C9EB79917A2412FAA98AD993852B051"><enum>(D)</enum><text>$1,000,000 shall be allocated to carry out paragraph (1)(D);</text></subparagraph> 
<subparagraph id="H4A4A0FB58342463AA46F4B0069E06702"><enum>(E)</enum><text>$20,000,000 shall be allocated to carry out paragraph (1)(E); and</text></subparagraph> 
<subparagraph id="H97A694520F65466F97DE91D4E86946DF"><enum>(F)</enum><text>$5,000,000 shall be allocated to carry out paragraph (1)(F).</text></subparagraph></paragraph></subsection> 
<subsection id="H181274BB94DF4AC7982202546BAAD7EA"><enum>(c)</enum><header>Required Capacity for Community-Based Outpatient Clinics</header> 
<paragraph id="HB86B897B07434A1AB8780041B1252067"><enum>(1)</enum><header>Accountability for the provision of mental health services</header><text>The Under Secretary shall take appropriate steps and provide necessary incentives (including appropriate performance incentives) to ensure that each Regional Director of the Veterans Health Administration is encouraged to—</text> 
<subparagraph id="HE7DD758CEE984F4CB97771CEA3C178D"><enum>(A)</enum><text>prioritize the provision of mental health services to veterans in need of such services;</text></subparagraph> 
<subparagraph id="HE9D825D47CC2421EAC92A79E54CA15A6"><enum>(B)</enum><text>foster collaborative working environments among clinicians for the provision of mental health services; and</text></subparagraph> 
<subparagraph id="H564FF3D3C56744B7ADEDE656AF38C523"><enum>(C)</enum><text>conduct mental health consultations during primary care appointments.</text></subparagraph></paragraph> 
<paragraph id="HD544E2DC5DD4405E82A428AD252EBC9F"><enum>(2)</enum><header>Mental health and substance abuse services</header> 
<subparagraph id="H04672AC50BB449EF9596033D1E1D95EB"><enum>(A)</enum><header>In general</header><text>The Secretary shall ensure that each community-based outpatient clinic of the Department has the capacity to provide, or monitor the provision of, mental health services to enrolled veterans in need of such services.</text></subparagraph> 
<subparagraph id="H81E43434C05F43209FC73C009D4C2F40"><enum>(B)</enum><header>Settings</header><text>In carrying out subparagraph (A), the Secretary shall ensure that mental health services are provided through—</text> 
<clause id="H246D706043274517886BD538947F8E8C"><enum>(i)</enum><text>a community-based outpatient clinic of the Department by an employee of the Department;</text></clause> 
<clause id="H4F76AA2BB5294C01A4E35B002570BD91"><enum>(ii)</enum><text>referral to another facility of the Department;</text></clause> 
<clause id="HA1205EFD63FE4ADF8D06485158427CA3"><enum>(iii)</enum><text>contract with an appropriate mental health professional in the local community; or</text></clause> 
<clause id="H58CB076FB5C14DBFB56D31007F01A049"><enum>(iv)</enum><text>tele-mental health service.</text></clause></subparagraph></paragraph> 
<paragraph id="HCB0AC35085254244919E454EFCA737BB"><enum>(3)</enum><header>Reporting requirement</header><text>Not later than January 31, 2009, the Secretary of Veterans Affairs shall submit to Congress a report that—</text> 
<subparagraph id="H39FE43D07C6748FB85679C9D40B2B831"><enum>(A)</enum><text>describes the status and availability of mental health services at community-based outpatient clinics;</text></subparagraph> 
<subparagraph id="H1128A6CB4A7545CEB3B2BF023D695340"><enum>(B)</enum><text>describes the substance of services available at such clinics; and</text></subparagraph> 
<subparagraph id="H75094BD5696B4DAAB4468EDAA5CD72"><enum>(C)</enum><text>includes the ratios between mental health staff and patients at such clinics.</text></subparagraph></paragraph></subsection> 
<subsection id="H2E5BC63FE59A43EDB9507F1E97DDB67D"><enum>(d)</enum><header>Cooperation on Mental Health Awareness and Prevention</header> 
<paragraph id="H7B76B10EF19A49C0A100608B44FE4BFA"><enum>(1)</enum><header>Agreement</header><text>The Secretary of Defense and the Secretary of Veterans Affairs shall enter into a Memorandum of Understanding—</text> 
<subparagraph id="H5A78B784176048DF97FFEEC92C6B954C"><enum>(A)</enum><text>to ensure that separating service members receive standardized individual mental health and sexual trauma assessments as part of separation exams; and</text></subparagraph> 
<subparagraph id="H8D005557F7004D54B5F290006B34D600"><enum>(B)</enum><text>that includes the development of shared guidelines on how to conduct the assessments.</text></subparagraph></paragraph> 
<paragraph id="HBC457971B79B47AAA600004DE88E68E8"><enum>(2)</enum><header>Establishment of joint veterans affairs–department of defense workgroup on mental health</header> 
<subparagraph id="H8F41794080CF4D4791F36495C5864363"><enum>(A)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of Defense and the Secretary of Veterans Affairs shall establish a joint workgroup on mental health, which shall be comprised of not less than seven leaders in the field of mental health appointed from their respective departments.</text></subparagraph> 
<subparagraph id="H372EAA01B57842C7BC0063257E94AB06"><enum>(B)</enum><header>Study</header><text>Not later than one year after the establishment of the workgroup under subparagraph (A), the workgroup shall analyze the feasibility, content, and scope of initiatives related to—</text> 
<clause id="H3BEFA56179EE40A9AAC2957763A13FA"><enum>(i)</enum><text>combating stigmas and prejudices associated with service members who suffer from mental health disorders or readjustment issues, through the use of peer counseling programs or other educational initiatives;</text></clause> 
<clause id="HB126593CADAF49CCA3549486A63655CB"><enum>(ii)</enum><text>ways in which the Department of Veterans Affairs can make its expertise in treating mental health disorders more readily available to Department of Defense mental health care providers;</text></clause> 
<clause id="HCC390AAAAE6C486CBA922452B061F51D"><enum>(iii)</enum><text>family and spousal education to assist family members of veterans and service members to recognize and deal with signs of potential readjustment issues or other mental health disorders; and</text></clause> 
<clause id="HC37CB33A6D0C429699CA6E02C8D2EA73"><enum>(iv)</enum><text>the seamless transition of service members who have been diagnosed with mental health disorders from active duty to veteran status (in consultation with the Seamless Transition Task Force and other entities assisting in this effort).</text></clause></subparagraph> 
<subparagraph id="HD8D0B75CFE3C47B7B6D08BBF786900F2"><enum>(C)</enum><header>Report</header><text>Not later than June 30, 2008, the Secretary of Defense and the Secretary of Veterans Affairs shall submit to Congress a report containing the findings and recommendations of the workgroup established under subparagraph (A).</text></subparagraph></paragraph></subsection> 
<subsection id="H74B39343385F4A8600BC5507418F9589"><enum>(e)</enum><header>Primary Care Consultations for Mental Health</header> 
<paragraph id="H08E8A70D815240EC99408C65005B4487"><enum>(1)</enum><header>Guidelines</header><text>The Under Secretary for Health of the Department of Veterans Affairs shall establish systemwide guidelines for screening primary care patients for mental health disorders and illnesses.</text></paragraph> 
<paragraph id="H0FE4EFF462944932BB3BAC2B2F3406FC"><enum>(2)</enum><header>Training</header><text>Based upon the guidelines established under paragraph (1), the Under Secretary shall conduct appropriate training for clinicians of the Department of Veterans Affairs to carry out mental health consultations.</text></paragraph></subsection> 
<subsection id="H371AFB9B5A3A4AE0A83CB3A9CA564499"><enum>(f)</enum><header>Clinical Training and Protocols</header> 
<paragraph id="H9C951D55170340A99C8B005C4BBCCCD8"><enum>(1)</enum><header>Findings</header><text>Congress finds that—</text> 
<subparagraph id="HE90C9C9D49CF4DB3830396E871C1739D"><enum>(A)</enum><text>the Iraq War Clinician Guide has tremendous value; and</text></subparagraph> 
<subparagraph id="H89F6B6959F10425096F5B95C00AB0023"><enum>(B)</enum><text>the Secretary of Defense and the National Center on Post Traumatic Stress Disorder should continue to work together to ensure that the mental health care needs of service members and veterans are met.</text></subparagraph></paragraph> 
<paragraph id="H11644FDB085A433293C7B00011796C2B"><enum>(2)</enum><header>Collaboration</header><text>The National Center on Post Traumatic Stress Disorder shall collaborate with the Secretary of Defense—</text> 
<subparagraph id="H8BCC195B59B2484FA2CD8456BE67CD00"><enum>(A)</enum><text>to enhance the clinical skills of military clinicians through training, treatment protocols, web-based interventions, and the development of evidence-based interventions; and</text></subparagraph> 
<subparagraph id="H8678E5A21CF84AC900EAA923C076BF49"><enum>(B)</enum><text>to promote pre-deployment resilience and post-deployment readjustment among service members serving in Operation Iraqi Freedom and Operation Enduring Freedom.</text></subparagraph></paragraph> 
<paragraph id="H5182F1BED9694188ABE0C8256F19F1B"><enum>(3)</enum><header>Training</header><text>The National Center on Post Traumatic Stress Disorder shall work with the Secretary of Defense to ensure that clinicians in the Department of Defense are provided with the training and protocols developed pursuant to paragraph (2)(A).</text></paragraph> 
<paragraph id="HC98B3EB5DB894587A6D38155A5842974"><enum>(4)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated $2,000,000 for 2007 to carry out this subsection.</text></paragraph></subsection></section> 
<section id="H354320DE300B491489502620FD5D1500"><enum>9.</enum><header>Disclosure of medical records</header> 
<subsection id="H0F24CEE926F941CFA9FDEA4826B7601D"><enum>(a)</enum><header>Limited Exception to Confidentiality of Medical Records</header><text><external-xref legal-doc="usc" parsable-cite="usc/38/5701">Section 5701</external-xref> is amended by adding at the end the following new subsection:</text>

<subsection id="H374B1F8871B24F53BBB8C0584D7229A3"><enum>(k)</enum> 
<paragraph display-inline="yes-display-inline" id="HD88FF49CCFE7416E87DE93C2C911D3C1"><enum>(1)</enum> 
<subparagraph display-inline="yes-display-inline" id="H91C474CE862A4CCB86EE18A7AE7707C7"><enum>(A)</enum><text>The Secretary may disclose the name and address of any individual described in subparagraph (C) to an entity described in subparagraph (B) in order to facilitate the determination by such entity whether the individual is, or after death will be, a suitable organ, tissue, or eye donor if—</text> 
<clause indent="up2" id="HC0D68B106602433480CCBE4D7259A07B"><enum>(i)</enum><text>the individual is near death (as determined by the Secretary) or is deceased; and</text></clause> 
<clause indent="up2" id="H6B1FBA2CB8894D93B099F76F7C09CD63"><enum>(ii)</enum><text>the disclosure is permitted under regulations promulgated pursuant to section 264 of the <act-name parsable-cite="HIPAA">Health Insurance Portability and Accountability Act of 1996</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1320d-2">42 U.S.C. 1320d–2</external-xref> note).</text></clause></subparagraph> 
<subparagraph indent="up2" id="HA4EA3BA21BF54C9498353121E404E00"><enum>(B)</enum><text>An entity described in this subparagraph is—</text> 
<clause id="H558FE2972D744D359FCCBADB5DE03110"><enum>(i)</enum><text>an organ procurement organization; or</text></clause> 
<clause id="H4DDCF5F6F1684D1D9D161142FDFFE00"><enum>(ii)</enum><text>an entity that the Secretary has determined—</text> 
<subclause id="H923224544E2944EDB10052686FD288A3"><enum>(I)</enum><text>is substantially similar in function, professionalism, and reliability to an organ procurement organization; and</text></subclause> 
<subclause id="HA8D6F9B24145464E86CE39AEF52565B4"><enum>(II)</enum><text>should be treated for purposes of this subsection in the same manner as an organ procurement organization.</text></subclause></clause></subparagraph> 
<subparagraph indent="up2" id="H96C8BD28ADE44DEEA4FA93DB0569CDD"><enum>(C)</enum><text>An individual described in this subparagraph is—</text> 
<clause id="H189F11CCFB9C487081A189E2F99C3C5C"><enum>(i)</enum><text>a member or former member of the Armed Forces; or</text></clause> 
<clause id="H723FCE21E71E465DBDA5C686FA5FBD5F"><enum>(ii)</enum><text>a dependent of a member or former member of the Armed Forces.</text></clause></subparagraph></paragraph> 
<paragraph indent="up1" id="H33535777F8FA4D7CA5DB698B31A4547E"><enum>(2)</enum><text>In this subsection, the term <term>organ procurement organization</term> has the meaning given the term <term>qualified organ procurement organization</term> in section 371(b) of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/273">42 U.S.C. 273(b)</external-xref>).</text></paragraph></subsection><after-quoted-block></after-quoted-block></quoted-block></subsection> 
<subsection id="H9A1A0FD679EE44F58B5DE013FC2B2AB"><enum>(b)</enum><header>Disclosures From Certain Medical Records</header><text><external-xref legal-doc="usc" parsable-cite="usc/38/7332">Section 7332(b)(2)</external-xref> is amended by adding at the end the following new subparagraph:</text>

<section id="H856C5A085DA64D9FB34CBEB045B87CB1"><enum>10.</enum><header>Expansion of National Guard Outreach Program</header> 
<subsection id="H84E246834DFA4987A21E778839BB0066"><enum>(a)</enum><header>Requirement</header><text>The Secretary of Veterans Affairs shall expand the total number of personnel employed by the Department of Veterans Affairs as part of the Readjustment Counseling Service’s Global War on Terrorism Outreach Program (referred to in this section as the <quote>Program</quote>).</text></subsection> 
<subsection id="H211C01F8808C45098913005D0044787C"><enum>(b)</enum><header>Coordination</header><text>In carrying out subsection (a), the Secretary shall coordinate participation in the Program by appropriate employees of the Veterans Benefits Administration and the Veterans Health Administration.</text></subsection> 
<subsection id="HC8B64790B09949999FF3CD974EEADB"><enum>(c)</enum><header>Information and Assessments</header><text>The Secretary shall ensure that—</text> 
<paragraph id="H38583AF0B58E423DAE3BAD3508BAEBB5"><enum>(1)</enum><text>all appropriate health, education, and benefits information is available to returning members of the National Guard; and</text></paragraph> 
<paragraph id="H8F43B7A2A3B94FE69C31514200FB50D6"><enum>(2)</enum><text>proper assessments of the needs in each of these areas is made by the Department of Veterans Affairs.</text></paragraph></subsection> 
<subsection id="H82E3FEDADBB548F8BF79007EF86555D7"><enum>(d)</enum><header>Collaboration</header><text>The Secretary of Veterans Affairs shall collaborate with appropriate State National Guard officials and provide such officials with any assets or services of the Department of Veterans Affairs that the Secretary determines to be necessary to carry out the Program.</text></subsection></section> 
<section id="H96A0CCB3285A426C9CF8ADD6008D3DBA"><enum>11.</enum><header>Expansion of telehealth services</header> 
<subsection id="HF1C2F0B858C84397B2C9972D87C6C12"><enum>(a)</enum><header>In General</header><text>The Secretary shall increase the number of Veterans Readjustment Counseling Service facilities capable of providing health services and counseling through telehealth linkages with facilities of the Veterans Health Administration.</text></subsection> 
<subsection id="HDF4E8110A5BF4C22995656CFFFE88B00"><enum>(b)</enum><header>Plan</header><text>The Secretary shall submit to the Committee on Veterans’ Affairs of the Senate and the Committee on Veterans’ Affairs of the House of Representatives a plan to implement the requirement under subsection (a), which shall describe the facilities that will have such capabilities at the end of each of fiscal years 2006, 2007, and 2008.</text></subsection></section> 
<section id="H54618DDDB33147498DDF4429B2AECC95"><enum>12.</enum><header>Mental Health data sources report</header> 
<subsection id="HA53E9D71AD3848CCAD1B604707488BEE"><enum>(a)</enum><header>In General</header><text>Not less than 180 days after the date of the enactment of this Act, the Secretary of Veterans Affairs shall submit to the Committee on Veterans’ Affairs of the Senate and the Committee on Veterans’ Affairs of the House of Representatives a report describing the mental health data maintained by the Department of Veterans Affairs.</text></subsection> 
<subsection id="HE34092E081D04677A1BD1E51A5B1327"><enum>(b)</enum><header>Contents</header><text>The report submitted under subsection (a) shall include—</text> 
<paragraph id="HC60F30DD842A4EBBBC9CBB6624B35170"><enum>(1)</enum><text>a comprehensive list of the sources of all such data, including the geographic locations of facilities of the Department of Veterans Affairs maintaining such data;</text></paragraph> 
<paragraph id="HC21CE91D60264A72B904FC8CC69282CB"><enum>(2)</enum><text>an assessment of the limitations or advantages to maintaining the current data configuration and locations; and</text></paragraph> 
<paragraph id="H521E8F67630A482097B044714CADA44C"><enum>(3)</enum><text>any recommendations, if any, for improving the collection, use, and location of mental health data maintained by the Department of Veterans Affairs.</text></paragraph></subsection></section> 
<section id="H4267633B59E84571A717DF3F74C0D2AE"><enum>13.</enum><header>Veterans travel reimbursement for health care</header> 
<subsection id="H7443247E7E6A456290B339B08E1BD3D3"><enum>(a)</enum><header>Payments for certain additional medical care</header><text><external-xref legal-doc="usc" parsable-cite="usc/38/111">Section 111(b)(1)</external-xref> of title 38, United States Code, is amended by adding at the end the following new subparagraph:</text> 
<quoted-block id="H024E8D5DA7CD4A589DCBE06ED8862091" style="OLC"> 
<subparagraph id="H2F17A0CCAE2F4DE8B16921F114D1EDE6" indent="up1"><enum>(G)</enum><text>A veteran whose travel is in connection with treatment or care for a non-service-connected disability at a non-Department facility, if the treatment or care—</text> 
<clause id="H56387ED871684984A34B84783FBA5B88"><enum>(i)</enum><text>is provided upon the recommendation of medical personnel of a Department medical center or clinic; and</text></clause> 
<clause id="H9EAAEAC2B9514524A7BC17D7019F3894"><enum>(ii)</enum><text>is not available at the Department medical center or clinic at which such recommendation is made.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H590B643842374A48A981F87D003998CA"><enum>(b)</enum><header>Calculation of expenses of travel</header> 
<paragraph id="H29A82A1F590F4866AC0608F3DC5F1569"><enum>(1)</enum><header>In general</header><text>In calculating expenses of travel for purposes of the Veterans Beneficiary Travel Program, the Secretary of Veterans Affairs shall use the mileage reimbursement rates for the use of privately owned vehicles by Government employees on official business, as prescribed by the Administrator of General Services under <external-xref legal-doc="usc" parsable-cite="usc/5/5707">section 5707(b)</external-xref> of title 5, United States Code.</text></paragraph> 
<paragraph id="H274D77ADC005413E9173A2A6BBC69C37"><enum>(2)</enum><header>Definition</header><text>In this subsection, the term <quote>Veterans Beneficiary Travel Program</quote> means the program of payment or reimbursement for necessary expenses of travel of veterans and their beneficiaries prescribed under sections <external-xref legal-doc="usc" parsable-cite="usc/38/111">111</external-xref> and <external-xref legal-doc="usc" parsable-cite="usc/38/1728">1728</external-xref> of title 38, United States Code, and under any other provision of law administered by the Secretary of Veterans Affairs for payment or reimbursement for such expenses of travel.</text></paragraph></subsection> 
<subsection id="HA0EA9806569847378EC207DFDED48D64"><enum>(c)</enum><header>Effective date</header><text>Subparagraph (G) of <external-xref legal-doc="usc" parsable-cite="usc/38/111">section 111(b)(1)</external-xref> of title 38, United States Code, as added by subsection (a), and the provisions of subsection (b) shall apply with respect to travel performed after the end of the 60-day period beginning on the date of the enactment of this Act.</text> </subsection> </section> 
<section id="HABEF678624964ABF909B7C3E5BBDA574"><enum>14.</enum><header>Blind rehabilitation outpatient specialists</header> 
<subsection id="H11076DD2528B40E197FCBE49E3F1D340"><enum>(a)</enum><header>Findings</header><text>Congress makes the following findings:</text> 
<paragraph id="H27282E9BCC2945C3900626A35E6B2625"><enum>(1)</enum><text>There are approximately 135,000 blind veterans throughout the United States, including approximately 35,000 who are enrolled in the health-care system of the Department of Veterans Affairs. An aging veteran population and injuries incurred in Operation Iraqi Freedom and Operation Enduring Freedom are increasing the number of blind veterans.</text></paragraph> 
<paragraph id="HAD91F59E680C4F21818274B704A07B00"><enum>(2)</enum><text>Since 1996, when the Department of Veterans Affairs hired its first 14 blind rehabilitation outpatient specialists (referred to in this section as <quote>Specialists</quote>), Specialists have been a critical part of the continuum of care for blind and visually impaired veterans.</text></paragraph> 
<paragraph id="HEA99CCC72E8843C090A6FC7C33D650"><enum>(3)</enum><text>The Department of Veterans Affairs operates 10 residential blind rehabilitation centers that are considered among the best in the world. These centers have had long waiting lists, with as many as 1,500 blind veterans waiting for openings in 2004.</text></paragraph> 
<paragraph id="H631B8C7087C2437BB28B20CEA6AF1C93"><enum>(4)</enum><text>Specialists provide—</text> 
<subparagraph id="H9A43A5361A4D4A6E96231F6BF962F9D"><enum>(A)</enum><text>critically needed services to veterans who are unable to attend residential centers or are waiting to enter such a program;</text></subparagraph> 
<subparagraph id="H83C0790152614A4DA200C32F3D93D818"><enum>(B)</enum><text>a range of services, including training with living skills, mobility, and adaptation of manual skills; and</text></subparagraph> 
<subparagraph id="H63E7D23973CB491F899B77A8B5B6FB6E"><enum>(C)</enum><text>pre-admission screening and follow-up care for blind rehabilitation centers.</text></subparagraph></paragraph> 
<paragraph id="H417709F9D87F411984CFEFD70EFFEB7"><enum>(5)</enum><text>There are not enough Specialist positions to meet the increased numbers and needs of blind veterans.</text></paragraph></subsection> 
<subsection id="H29212C11306A488200336EA17DA89DE9"><enum>(b)</enum><header>Establishment of Specialist Positions</header><text>Not later than 30 months after the date of the enactment of this Act, the Secretary of Veterans Affairs shall establish a Specialist position at not fewer than 35 facilities of the Department of Veterans Affairs at which such a position does not exist as of the date of the enactment of this Act.</text></subsection> 
<subsection id="HFDA3C0A96EEE4385831086901291CF1B"><enum>(c)</enum><header>Selection of Facilities</header><text>In identifying the most appropriate facilities at which a Specialist position shall be established pursuant to subsection (b), the Secretary shall—</text> 
<paragraph id="H8274382B51284F8C95BAC41379265D07"><enum>(1)</enum><text>give priority to facilities with large numbers of enrolled legally blind veterans;</text></paragraph> 
<paragraph id="HB3F32A829F16423D8D2C083484918EFD"><enum>(2)</enum><text>ensure that each facility does not have such a position; and</text></paragraph> 
<paragraph id="H0C8C2D0799794A6586E39DC7E0C08583"><enum>(3)</enum><text>ensure that each facility is in need of the services of such Specialists.</text></paragraph></subsection> 
<subsection id="H03B1722BFAB74323A200A1689B88A2A3"><enum>(d)</enum><header>Coordination</header><text>The Secretary shall coordinate the provision of blind rehabilitation services for veterans with services for the care of the visually impaired offered by State and local agencies, especially if such State and local agencies can provide similar services to veterans in settings located closer to the residences of such veterans.</text></subsection> 
<subsection id="H0ED263E972F24C08A5CCF068009E2DA5"><enum>(e)</enum><header>Authorization of Appropriations</header><text>There are authorized to be appropriated to carry out this section $3,500,000 for each of the fiscal years 2007 through 2012.</text></subsection></section> 
<section id="H2007F1464B744D429B1CD61FA2E69FDB"><enum>15.</enum><header>Compliance report</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/38/1706">Section 1706(b)(5)(A)</external-xref> is amended by striking <quote>2004</quote> and inserting <quote>2007</quote>.</text></section> 
<section id="H1FDD50975635447F91A462D707C92656"><enum>16.</enum><header>Health care and services for veterans affected by Hurricane Katrina</header> 
<subsection id="HCA17D7BAF40B45F2A0D6E1F904F73762"><enum>(a)</enum><header>Requirement for Hospital Care and Medical Services for Priority 8 Veterans Affected by Hurricane Katrina</header> 
<paragraph id="H99013AF94A8748D0A2A44381D0B55868"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of law and any notwithstanding any previous decisions made by the Secretary of Veterans Affairs pursuant to <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/17">chapter 17</external-xref> of title 38 United States Code, the Secretary shall provide necessary medical and health care services to any veteran affected by Hurricane Katrina as if such veteran was enrolled for care under <external-xref legal-doc="usc" parsable-cite="usc/38/1705">section 1705</external-xref> of title 38, United States Code.</text></paragraph> 
<paragraph id="H749919768C144DDC89C35994DEAA7C8F"><enum>(2)</enum><header>Status of veterans</header><text>For purposes of managing the health care system, as required under <external-xref legal-doc="usc" parsable-cite="usc/38/1705">section 1705</external-xref> of title 38, United States Code, a veteran who seeks care under paragraph (1) shall not be considered to be an enrollee of the health care system under such section unless the Secretary subsequently designates such a veteran as such an enrollee.</text></paragraph></subsection> 
<subsection id="HA0B20A432FCC4FB983B1CA26C900F648"><enum>(b)</enum><header>Prohibition on Collection of Copayments for Veterans Affected by Hurricane Katrina</header><text>In furnishing hospital care and medical services to any veteran affected by Hurricane Katrina, the Secretary shall not collect from, or with respect to, such veteran any payment for such care and services otherwise required under any provision of law, including any copayment for medications otherwise required under <external-xref legal-doc="usc" parsable-cite="usc/38/1722A">section 1722A</external-xref> of title 38, United States Code.</text></subsection> 
<subsection id="H787F18E94DE94912A2CEB931CC53D9D2"><enum>(c)</enum><header>Definition</header><text>In this section, the term <term>veteran affected by Hurricane Katrina</term> means any veteran who, as of August 29, 2005, resided in the catchment region of the Department of Veterans Affairs medical center in—</text> 
<paragraph id="H63657417BB7F407A95CAC193598BF940"><enum>(1)</enum><text>New Orleans, Louisiana;</text></paragraph> 
<paragraph id="H9F4CAFD03489473F8C3F783B4EA29E76"><enum>(2)</enum><text>Biloxi, Mississippi; or</text></paragraph> 
<paragraph id="HE805796213F547889C99B1DD46EBA547"><enum>(3)</enum><text>Gulfport, Mississippi.</text></paragraph></subsection> 
<subsection id="H5588FC72DD0E4B8499131D029148E2E7"><enum>(d)</enum><header>Sunset Provision</header><text>The authority under this section shall expire on January 31, 2007.</text></subsection></section> 
<section id="H7FF7DD276D7447BBA580BA1E3E49E1AC"><enum>17.</enum><header>Reimbursement for certain veterans’ outstanding emergency treatment expenses</header> 
<subsection id="HC4D4EDFEA980401ABC59D3F354866D56"><enum>(a)</enum><header>In General</header><text>Subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/17">chapter 17</external-xref> is amended by inserting after section 1725 the following new section:</text> 
<quoted-block style="USC" id="HA05A1C7B384A40F2BFB74FF612B21E66"> 
<section id="HD8DB050D59F5411090EB9654675E8FCD"><enum>1725A.</enum><header>Reimbursement for emergency treatment expenses for which certain veterans remain personally liable</header> 
<subsection id="H734EB8B8A1E740D6B5165FE7EA2B10B9"><enum>(a)</enum> 
<paragraph display-inline="yes-display-inline" id="H4CD9629BF70F4307A455973705036334"><enum>(1)</enum><text>Subject to subsection (c), the Secretary may reimburse a veteran described in subsection (b) for expenses resulting from emergency treatment furnished to the veteran in a non-Department facility for which the veteran remains personally liable.</text></paragraph> 
<paragraph indent="up1" id="HD77DD333100E4938A090EE105756B1D"><enum>(2)</enum><text>In any case in which reimbursement is authorized under subsection (a)(1), the Secretary, in the Secretary’s discretion, may, in lieu of reimbursing the veteran, make payment—</text> 
<subparagraph id="H5EA16CF6B55F46BBAF8873CCBF26A286"><enum>(A)</enum><text>to a hospital or other health care provider that furnished the treatment; or</text></subparagraph> 
<subparagraph id="H1E6DC5393E624810B07BAB70EB851814"><enum>(B)</enum><text>to the person or organization that paid for such treatment on behalf of the veteran.</text></subparagraph></paragraph></subsection> 
<subsection id="H71A4A16F12C8437E96F6CF59B4E0BBF"><enum>(b)</enum><text>A veteran referred to in subsection (a) is an individual who—</text> 
<paragraph id="HED13B5CC557144698CEB8B7E5D3089C0"><enum>(1)</enum><text>is enrolled in the health care system established under <external-xref legal-doc="usc" parsable-cite="usc/38/1705">section 1705(a)</external-xref> of this title;</text></paragraph> 
<paragraph id="H90492D52EFF24B16AC2FF761A0FADAF"><enum>(2)</enum><text>received care under this chapter during the 24-month period preceding the furnishing of such emergency treatment;</text></paragraph> 
<paragraph id="H0F75BD4A735C4A61942F4CFC47CCBF6E"><enum>(3)</enum><text>is entitled to care or services under a health-plan contract that partially reimburses the cost of the veteran’s emergency treatment;</text></paragraph> 
<paragraph id="H6D1CF6CF01A2401500E71C29D8A508D7"><enum>(4)</enum><text>is financially liable to the provider of emergency care treatment for costs not covered by the veteran’s health-plan contract, including copayments and deductibles; and</text></paragraph> 
<paragraph id="HBBB14B8B21E2416286B55CA449B99759"><enum>(5)</enum><text>is not eligible for reimbursement for medical care or services under <external-xref legal-doc="usc" parsable-cite="usc/38/1725">section 1725</external-xref> or <external-xref legal-doc="usc" parsable-cite="usc/38/1728">1728</external-xref> of this title.</text></paragraph></subsection> 
<subsection id="HCA7FC63C887C42D0B61216937CE9C2E"><enum>(c)</enum> 
<paragraph display-inline="yes-display-inline" id="H0043166CD95B49FCBE8BBE71F7B63D05"><enum>(1)</enum><text>Any amount paid by the Secretary under subsection (a) shall exclude the amount of any payment the veteran would have been required to make to the United States under this chapter if the veteran had received the emergency treatment from the Department.</text></paragraph> 
<paragraph indent="up1" id="H3B8E94112D3647B8A76B59EBCBC000D8"><enum>(2)</enum><text>The Secretary may not provide reimbursement under this section with respect to any item or service—</text> 
<subparagraph id="HDABE1E103423407E8D1425483F7FCF34"><enum>(A)</enum><text>provided or for which payment has been made, or can reasonably be expected to be made, under the veteran’s health-plan contract; or</text></subparagraph> 
<subparagraph id="HA23C8F195BE047D2A9AAB8B1FD88A9CB"><enum>(B)</enum><text>for which payment has been made or can reasonably be expected to be made by a third party.</text></subparagraph></paragraph> 
<paragraph indent="up1" id="H9128F4F5126848F5BD97167894A06DE7"><enum>(3)</enum> 
<subparagraph display-inline="yes-display-inline" id="H77809DDED9F445EEBCD7F1A2E248D683"><enum>(A)</enum><text>Payment by the Secretary under this section on behalf of a veteran to a provider of emergency treatment shall, unless rejected and refunded by the provider within 30 days of receipt, extinguish any liability on the part of the veteran for that treatment.</text></subparagraph> 
<subparagraph indent="up1" id="HD7BDD227CBE04B2FA72CE5E2479CC509"><enum>(B)</enum><text>The absence of a contract or agreement between the Secretary and the provider, any provision of a contract or agreement, or an assignment to the contrary shall not operate to modify, limit, or negate the requirement under subparagraph (A).</text></subparagraph></paragraph> 
<paragraph indent="up1" id="H0DEBADB3E1EC474C890544221D39C452"><enum>(4)</enum><text>In accordance with regulations prescribed by the Secretary, the Secretary shall—</text> 
<subparagraph id="H0DD22A74643A4D5AB997FDCBCF4909"><enum>(A)</enum><text>establish criteria for determining the amount of reimbursement (which may include a maximum amount) payable under this section; and</text></subparagraph> 
<subparagraph id="HF0B50B1344E2437CB153C285B5DBDD15"><enum>(B)</enum><text>delineate the circumstances under which such payment may be made, including requirements for requesting reimbursement.</text></subparagraph></paragraph></subsection> 
<subsection id="H5C02B69D194849D9805018564ED300D"><enum>(d)</enum> 
<paragraph display-inline="yes-display-inline" id="H9B8C8B46C95849468169285F4B7F3345"><enum>(1)</enum><text>In accordance with regulations prescribed by the Secretary, the United States shall have the independent right to recover any amount paid under this section if, and to the extent that, a third party subsequently makes a payment for the same emergency treatment.</text></paragraph> 
<paragraph indent="up1" id="H0C2AE97A46384707BD9499D459E30005"><enum>(2)</enum><text>Any amount paid by the United States to the veteran, the veteran’s personal representative, successor, dependents, or survivors, or to any other person or organization paying for such treatment shall constitute a lien in favor of the United States against any recovery the payee subsequently receives from a third party for the same treatment.</text></paragraph> 
<paragraph indent="up1" id="H0676DEB025764E56B651F758BBD8D091"><enum>(3)</enum><text>Any amount paid by the United States to the provider that furnished the veteran’s emergency treatment shall constitute a lien against any subsequent amount the provider receives from a third party for the same emergency treatment for which the United States made payment.</text></paragraph> 
<paragraph indent="up1" id="HE48C464CFD2A46C3A004F958B4146D8E"><enum>(4)</enum><text>The veteran or the veteran’s personal representative, successor, dependents, or survivors shall—</text> 
<subparagraph id="HB9F9BEA5258D49F9B0EA58BD26659EA2"><enum>(A)</enum><text>ensure that the Secretary is promptly notified of any payment received from any third party for emergency treatment furnished to the veteran;</text></subparagraph> 
<subparagraph id="H34169C198D5746F6A2E383008C64D7D4"><enum>(B)</enum><text>immediately forward all documents relating to a payment described in subparagraph (A);</text></subparagraph> 
<subparagraph id="HF63259477DF244D3BAE093EB2FD523B0"><enum>(C)</enum><text>cooperate with the Secretary in an investigation of a payment described in subparagraph (A); and</text></subparagraph> 
<subparagraph id="H875207F2BE3F445C93AF35B8186058E9"><enum>(D)</enum><text>assist the Secretary in enforcing the United States right to recover any payment made under subsection (c)(3).</text></subparagraph></paragraph></subsection> 
<subsection id="HAEE77EF0AE3745B8AD31DED887BCE030"><enum>(e)</enum><text>The Secretary may waive recovery of a payment made to a veteran under this section that is otherwise required under subsection (d)(1) if the Secretary determines that such waiver would be in the best interest of the United States, as defined by regulations prescribed by the Secretary.</text></subsection> 
<subsection id="H8E87014D5C7241D19700EC4295763DA6"><enum>(f)</enum><text>For purposes of this section—</text> 
<paragraph id="H1F91C60BB4A44CC5BC0063D342042900"><enum>(1)</enum><text>The term <term>health-plan contract</term> includes—</text> 
<subparagraph id="H3C3FD6F543CB489CBC9BDF64E840B6E1"><enum>(A)</enum><text>an insurance policy or contract, medical or hospital service agreement, membership or subscription contract, or similar arrangement, under which health services for individuals are provided or the expenses of such services are paid;</text></subparagraph> 
<subparagraph id="H593272178F984BF1B76CDF6B597B37B0"><enum>(B)</enum><text>an insurance program described in section 1811 of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395c">42 U.S.C. 1395c</external-xref>) or established by section 1831 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395j">42 U.S.C. 1395j</external-xref>);</text></subparagraph> 
<subparagraph id="H10F427270F344930AE71DC9F26C9FB4F"><enum>(C)</enum><text>a State plan for medical assistance approved under title XIX of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396 et seq.</external-xref>); and</text></subparagraph> 
<subparagraph id="H2445C42F63004A6190836FAAD5C06858"><enum>(D)</enum><text>a workers’ compensation law or plan described in <external-xref legal-doc="usc" parsable-cite="usc/38/1729">section 1729(A)(2)(B)</external-xref> of this title.</text></subparagraph></paragraph> 
<paragraph id="H19C2A5CDFD3E4411A7AA3CDF02E340C9"><enum>(2)</enum><text>The term <term>third party</term> means—</text> 
<subparagraph id="H103FAF007665461DBF15214DB53EB983"><enum>(A)</enum><text>a Federal entity;</text></subparagraph> 
<subparagraph id="H521BF03967EB4F5CBC9BB311B393293B"><enum>(B)</enum><text>a State or political subdivision of a State;</text></subparagraph> 
<subparagraph id="HCD253802DE8140C39495F9323298DD6D"><enum>(C)</enum><text>an employer or an employer’s insurance carrier; and</text></subparagraph> 
<subparagraph id="H9129C44ABB1C493480FB1820FF8CEF14"><enum>(D)</enum><text>a person or entity obligated to provide, or pay the expenses of, such emergency treatment.</text></subparagraph></paragraph> 
<paragraph id="H1590F2E3AD5B4EDE936892EC83EF2E46"><enum>(3)</enum><text>The term <term>emergency treatment</term> has the meaning given such term in <external-xref legal-doc="usc" parsable-cite="usc/38/1725">section 1725</external-xref> of this title.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H90A2C154334046498302F915DFBBE64"><enum>(b)</enum><header>Clerical Amendment</header><text>The table of sections at the beginning of such chapter is amended by inserting after the item relating to section 1725 the following new item:</text>

<subsection id="HFB4E95CAB52D4B2CB67CE555AADDC67B"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="HD7A04E7F0A2E411793DE55DF00083251"><enum>(1)</enum><header>City</header><text>The term <term>City</term> means the city of Fort Thomas, Kentucky.</text></paragraph> 
<paragraph id="HA787DAA8FD1A458BA209F5778FC23487"><enum>(2)</enum><header>Fair market value consideration</header><text>The term <term>fair market value consideration</term> means the monetary value of the Federal land as of the date of conveyance under subsection (b), as determined by the Secretary.</text></paragraph> 
<paragraph id="HBF2623B55DBB42FB858BEE01824CC82C"><enum>(3)</enum><header>Federal land</header><text>The term <term>Federal land</term> means an approximately 11.75 acre parcel of federally-owned property, including the 15 structures located on such property, which is managed by the Department of Veterans Affairs and located in the northeastern portion of Tower Park in the City.</text></paragraph> 
<paragraph id="H333B179AFC1F4BDBB1DC512BAAB026EC"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Veterans Affairs.</text></paragraph></subsection> 
<subsection id="H7797A82F30DD445EA29D9C6FFB009358"><enum>(b)</enum><header>In General</header><text>Subject to valid existing rights, easements, and rights-of-way, the Secretary may convey all right, title, and interest of the United States in and to the Federal land to the City in exchange for fair market value consideration.</text></subsection> 
<subsection id="H74FB0E6BA9BA4207AE389C611FEBCDF"><enum>(c)</enum><header>Release From Liability</header><text>Effective on the date of conveyance to the City of the parcel of Federal land under subsection (b), the United States shall not be liable for damages arising out of any act, omission, or occurrence relating to the Federal land and facilities conveyed, but shall continue to be liable for damages caused by acts of negligence committed by the United States or by any employee or agent of the United States before the date of conveyance, consistent with <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/171">chapter 171</external-xref> of title 28, United States Code.</text></subsection> 
<subsection id="HC4A259F9EDAE48198068B983C27EA208"><enum>(d)</enum><header>Administrative Costs</header><text>All administrative costs relating to the conveyance of the Federal land under subsection (b) shall be paid by the City to the United States.</text></subsection></section> 
<section id="HE3E6C09855214C11B4F430F0A40FAC3"><enum>19.</enum><header>Technical and clerical amendments</header> 
<subsection id="H0C55EDEC5ABF4195B3EC4F162491D400"><enum>(a)</enum><header>Title <enum-in-header>38</enum-in-header>, United States Code</header><text>Title 38, United States Code, is amended as follows:</text>
