			 general</header><text display-inline="yes-display-inline">Section 401 of the
			 Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/281">42 U.S.C. 281</external-xref>) is amended to read as

							</paragraph></subsection><subsection display-inline="no-display-inline" id="H806E49BF373F4ED5B20600222C803742"><enum>(c)</enum><header>Division of
				Program Coordination, Planning, and Strategic Initiatives</header>
							<paragraph id="H5883BC1EC81A477CA806B858E8734DC"><enum>(1)</enum><header>In
				general</header><text>Within the Office of the Director of the National
				Institutes of Health, there shall be a Division of Program Coordination,
				Planning, and Strategic Initiatives (referred to in this subsection as the
				<quote>Division</quote>).</text>
							</paragraph><paragraph id="HDD807699600D405191FF44D0DB45DC21"><enum>(2)</enum><header>Offices within
				division</header>
								<subparagraph id="HEA84E20A347040FAAB05C8436C2996F1"><enum>(A)</enum><header>Offices</header><text>The
				following offices are within the Division: The Office of AIDS Research, the
				Office of Research on Women’s Health, the Office of Behavioral and Social
				Sciences Research, the Office of Disease Prevention, the Office of Dietary
				Supplements, the Office of Rare Diseases, and any other office located within
				the Office of the Director of NIH as of the day before the date of the
				enactment of the <short-title>National Institutes of
				Health Reform Act of 2006</short-title>. In addition to such offices, the
				Director of NIH may establish within the Division such additional offices or
				other administrative units as the Director determines to be appropriate.</text>
								</subparagraph><subparagraph commented="no" id="H6F58D0A8AC6543E6A716806FE0F4234E"><enum>(B)</enum><header>Authorities</header><text>Each
				office in the Division—</text>
									<clause commented="no" id="HAA88433515654130AE1884D9A5E6EBD0"><enum>(i)</enum><text>shall continue to
				carry out the authorities that were in effect for the office before the date of
				enactment referred to in subparagraph (A); and</text>
									</clause><clause commented="no" id="HE1AEAC45455445DD9B7853EDBB5C6B8C"><enum>(ii)</enum><text>shall, as
				determined appropriate by the Director of NIH, support the Division with
				respect to the authorities described in section 402(b)(7).</text>
									</clause></subparagraph></paragraph></subsection><subsection id="H13B6FD0C9E524149BFB02B34511B89AC"><enum>(d)</enum><header>Organization</header>
							<paragraph commented="no" display-inline="no-display-inline" id="HBD2167706A2B40CDAB59AFE910DCA73D"><enum>(1)</enum><header>Number of
				institutes and centers</header><text display-inline="yes-display-inline">In the
				National Institutes of Health, the number of national research institutes and
				national centers may not exceed a total of 27, including any such institutes or
				centers established under authority of paragraph (2) or under authority of this
				title as in effect on the day before the date of the enactment of the
				<short-title>National Institutes of Health Reform Act of
				2006</short-title>.</text>
							</paragraph><paragraph commented="no" id="H506C71F82F70443883BDC34CF019D34B"><enum>(2)</enum><header>Reorganization
				of institutes and centers</header>
								<subparagraph commented="no" id="H276FD42012F64E758CAA2243622BF096"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">Notwithstanding
				subsection (b), and subject to paragraph (1), the Director of NIH may, with the
				approval of the Secretary, reorganize the national research institutes and the
				national centers, including the addition, removal, or transfer of functions of
				such institutes and centers, and the establishment or termination of such
				institutes and centers, if the Director determines that the overall mission of
				the National Institutes of Health, or the management and operation of programs
				and activities conducted or supported by the National Institutes of Health,
				would be more efficiently carried out under such a reorganization.</text>
								</subparagraph><subparagraph id="HE1FE2CE885FE4F04BC7CA9E614DE8CE9"><enum>(B)</enum><header>Administrative
				unit</header><text display-inline="yes-display-inline">For purposes of
				paragraph (1), an administrative unit within the National Institutes of Health
				that is established under authority of subparagraph (A) shall be considered a
				national research institute or a national center, without regard to whether the
				administrative unit is designated by the Director of NIH as such an institute
				or center.</text>
								</subparagraph><subparagraph commented="no" id="H99ABA2B0AB2C4A62A12200A62EA21FA3"><enum>(C)</enum><header>Public
				process</header><text display-inline="yes-display-inline">Any reorganization
				under subparagraph (A) shall be carried out by regulation in accordance with
				the procedures for substantive rules under
				section
				553 of title 5, United States Code.</text>
								</subparagraph></paragraph><paragraph id="HB8C9393F44BD4C6300943DBC3C969200"><enum>(3)</enum><header>Reorganization
				of office of director</header><text display-inline="yes-display-inline">Notwithstanding subsection (c), the
				Director of NIH may, after a series of public hearings, and with the approval
				of the Secretary, reorganize the offices within the Office of the Director,
				including the addition, removal, or transfer of functions of such offices, and
				the establishment or termination of such offices, if the Director determines
				that the overall management and operation of programs and activities conducted
				or supported by such offices would be more efficiently carried out under such a
				reorganization.</text>
							</paragraph><paragraph id="H00515725BB5242CD88347FA35156D55"><enum>(4)</enum><header>Internal
				reorganization of institutes and centers</header><text display-inline="yes-display-inline">Notwithstanding any conflicting provisions
				of this title, the director of a national research institute or a national
				center may, after a series of public hearings and with the approval of the
				Director of NIH, reorganize the divisions, centers, or other administrative
				units within such institute or center, including the addition, removal, or
				transfer of functions of such units, and the establishment or termination of
				such units, if the director of such institute or center determines that the
				overall management and operation of programs and activities conducted or
				supported by such divisions, centers, or other units would be more efficiently
				carried out under such a reorganization.</text>
							</paragraph><paragraph id="HECDDA9D66D9F4BCCBF89C97B007533F2"><enum>(5)</enum><header>Notice to
				Congress; effective date</header><text>A reorganization under paragraph (2),
				(3), or (4) may not take effect before the expiration of 90 days after the
				Secretary submits to the Committee on Energy and Commerce of the House of
				Representatives and the Committee on Health, Education, Labor, and Pensions of
				the Senate written notice of the reorganization.</text>
							</paragraph></subsection><subsection id="H10FE8494E33C4A04A9EB2DBAFB28AB71"><enum>(e)</enum><header>Scientific
				management review board for periodic organizational reviews</header>
							<paragraph id="H4DDEC2FAA9C849A98EE3B78DC99F54F8"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Not later than 60
				days after the date of the enactment of the <short-title>National Institutes of Health Reform Act of
				2006</short-title>, the Secretary shall establish an advisory council within
				the National Institutes of Health to be known as the Scientific Management
				Review Board (referred to in this subsection as the
				<quote>Board</quote>).</text>
							</paragraph><paragraph id="H8941AB77FC3E4D44B133F7F44B715886"><enum>(2)</enum><header>Duties</header>
								<subparagraph id="H0FE4C32ED06749BCB66F084DD3CD7C93"><enum>(A)</enum><header>Reports on
				organizational issues</header><text>The Board shall provide advice to the
				appropriate officials under subsection (d) regarding the use of the authorities
				established in paragraphs (2), (3), and (4) of such subsection to reorganize
				the National Institutes of Health (referred to in this subsection as
				<quote>organizational authorities</quote>). Not less frequently than once each
				7 years, the Board shall—</text>
									<clause id="H36D50672F56740B1A641BAAD496605D0"><enum>(i)</enum><text>determine whether
				and to what extent the organizational authorities should be used; and</text>
									</clause><clause id="H9DEDD3CF0F5440F089EAB4C1A59DB63D"><enum>(ii)</enum><text>issue a report
				providing the recommendations of the Board regarding the use of the authorities
				and the reasons underlying the recommendations.</text>
									</clause></subparagraph><subparagraph id="HE3313EA8739D472885DB04642D00EC00"><enum>(B)</enum><header>Certain
				responsibilities regarding reports</header><text>The activities of the Board
				with respect to a report under subparagraph (A) shall include the
				following:</text>
									<clause id="H19EACBAEF5324186B4CC67BDBE08A228"><enum>(i)</enum><text>Reviewing all
				programs of the National Institutes of Health (referred to in this subsection
				as <quote>NIH</quote>) in order to determine the progress and
				cost-effectiveness of such programs and the allocation among the programs of
				the resources of NIH.</text>
									</clause><clause id="H86EF44C910684346970038D06D369400"><enum>(ii)</enum><text display-inline="yes-display-inline">Determining pending scientific
				opportunities, and public health needs, with respect to research within the
				jurisdiction of NIH.</text>
									</clause><clause id="HEE46E2344AB3462F906BB00E058DED1"><enum>(iii)</enum><text>For any proposal
				for organizational changes to which the Board gives significant consideration
				as a possible recommendation in such report—</text>
										<subclause id="HC8FC81C15FA54B4598B1D1BB62718DD3"><enum>(I)</enum><text>analyzing the
				budgetary and operational consequences of the proposed changes;</text>
										</subclause><subclause id="H7F059A7BEFBB408DBCF38B3685A324E"><enum>(II)</enum><text>estimating the
				level of resources needed to implement the proposed changes; and</text>
										</subclause><subclause id="H5615054014B949358E7E2B870012A2DE"><enum>(III)</enum><text>assuming the
				proposed changes will be made and making a recommendation for the allocation of
				the resources of NIH among the national research institutes and national
				centers.</text>
										</subclause></clause></subparagraph><subparagraph id="HEDCF937F8556442385FAE6BCDC621926"><enum>(C)</enum><header>Consultation</header><text>In
				carrying out subparagraph (A), the Board shall consult with—</text>
									<clause id="HA0FDDC7E6B8F470F99E168983D0007AD"><enum>(i)</enum><text>the heads of
				national research institutes and national centers whose directors are not
				members of the Board;</text>
									</clause><clause id="H24CAA0789CAC41F5A21482439D1553A1"><enum>(ii)</enum><text>other scientific
				leaders who are officers or employees of NIH and are not members of the
				Board;</text>
									</clause><clause id="H5AE0B8094D88459B8300FB035F85AE82"><enum>(iii)</enum><text>advisory
				councils of the national research institutes and national centers;</text>
									</clause><clause id="HE98EA62130F641EDB4BAEC6687DC0030"><enum>(iv)</enum><text>organizations
				representing the scientific community; and</text>
									</clause><clause id="H09DF1572F80548A28030C91748A47425"><enum>(v)</enum><text>organizations
				representing patients.</text>
									</clause></subparagraph></paragraph><paragraph id="H2A6AE127E1114D5A8CECC48B3DA56247"><enum>(3)</enum><header>Composition of
				board</header><text>The membership of the Board may not exceed 21 individuals,
				all of whom shall be voting members. The Board shall be composed of the
				following:</text>
								<subparagraph id="H276AC6CA4D60479000848D2F2C484600"><enum>(A)</enum><text>The Director of
				NIH, who shall be a permanent member on an ex officio basis.</text>
								</subparagraph><subparagraph id="H182966E707684FC48E4400874CD68900"><enum>(B)</enum><text>Not fewer than 9
				officials who are directors of national research institutes or national
				centers. The Secretary shall designate such officials for membership and shall
				ensure that the group of officials so designated includes directors of—</text>
									<clause id="H0D99EDCA69C8475E00A73CA2FAD081E"><enum>(i)</enum><text>national research
				institutes whose budgets are substantial relative to a majority of the other
				institutes;</text>
									</clause><clause id="H3BFC8AC7C2154E88AAED00A67DCDC666"><enum>(ii)</enum><text display-inline="yes-display-inline">national research institutes whose budgets
				are small relative to a majority of the other institutes;</text>
									</clause><clause id="HC5B25558E99F438589A5F5D5116C657F"><enum>(iii)</enum><text display-inline="yes-display-inline">national research institutes that have been
				in existence for a substantial period of time without significant
				organizational change under subsection (d);</text>
									</clause><clause id="H8DDE46D613C74C4AA10066184530B659"><enum>(iv)</enum><text display-inline="yes-display-inline">as applicable, national research institutes
				that have undergone significant organization changes under such subsection, or
				that have been established under such subsection, other than national research
				institutes for which such changes have been in place for a substantial period
				of time; and</text>
									</clause><clause id="H63AB9E7D065E42C0951289DE35A0ADA"><enum>(v)</enum><text>national
				centers.</text>
									</clause></subparagraph><subparagraph id="HA08F0D3977B34805B4207653192216F6"><enum>(C)</enum><text>Members appointed
				by the Secretary from among individuals who are not officers or employees of
				the United States. Such members shall include—</text>
									<clause id="HACD553AD848041E89F9804EA7D00415F"><enum>(i)</enum><text>individuals
				representing the interests of public or private institutions of higher
				education that have historically received funds from NIH to conduct research;
				and</text>
									</clause><clause id="HA1EBE30727C24189A22B13392D825ED7"><enum>(ii)</enum><text display-inline="yes-display-inline">individuals representing the interests of
				private entities that have received funds from NIH to conduct research or that
				have broad expertise regarding how the National Institutes of Health functions,
				exclusive of private entities to which clause (i) applies.</text>
									</clause></subparagraph></paragraph><paragraph id="HA01BB9FC20354568B530DB003F1744AC"><enum>(4)</enum><header>Chair</header><text display-inline="yes-display-inline">The Chair of the Board shall be selected by
				the Secretary from among the appointed members of the Board, except that the
				Secretary may select the Director of NIH as the Chair. The term of office of
				the Chair shall be 2 years.</text>
							</paragraph><paragraph id="H90BAD1A9F7A64D6BB1A664C05DA9C839"><enum>(5)</enum><header>Meetings</header>
								<subparagraph id="H22EE65B186554F118F54FC4C30BB605E"><enum>(A)</enum><header>In
				general</header><text>The Board shall meet at the call of the Chair or upon the
				request of the Director of NIH, but not fewer than 5 times with respect to
				issuing any particular report under paragraph (2)(A). The location of the
				meetings of the Board is subject to the approval of the Director of NIH.</text>
								</subparagraph><subparagraph id="H97A1F761FF664D4DA1274DF50B21070"><enum>(B)</enum><header>Particular
				forums</header><text>Of the meetings held under subparagraph (A) with respect
				to a report under paragraph (2)(A)—</text>
									<clause id="H7BE3F44382044DA9A2167BA0778867E1"><enum>(i)</enum><text display-inline="yes-display-inline">one or more shall be directed toward the
				scientific community to address scientific needs and opportunities related to
				proposals for organizational changes under subsection (d), or as the case may
				be, related to a proposal that no such changes be made; and</text>
									</clause><clause id="H3FE726C10EDC4ADB93D7DB283EC3928"><enum>(ii)</enum><text>one or more shall
				be directed toward consumer organizations to address the needs and
				opportunities of patients and their families with respect to proposals referred
				to in clause (i).</text>
									</clause></subparagraph><subparagraph id="HBFE9ED9511F346B08E1094FC735B9D9D"><enum>(C)</enum><header>Availability of
				information from forums</header><text>For each meeting under subparagraph (B),
				the Director of NIH shall post on the Internet site of the National Institutes
				of Health a summary of the proceedings.</text>
								</subparagraph></paragraph><paragraph id="H72DF6F8D051F457496BE9FE446C9737"><enum>(6)</enum><header>Compensation;
				term of office</header><text>The provisions of subsections (b)(4) and (c) of
				section 406 apply with respect to the Board to the same extent and in the same
				manner as such provisions apply with respect to an advisory council referred to
				in such subsections, except that the reference in such subsection (c) to 4
				years regarding the term of an appointed member is deemed to be a reference to
				5 years.</text>
							</paragraph><paragraph id="HEA89134FF91448CB9E8E9E2D52711B3C"><enum>(7)</enum><header>Reports</header>
								<subparagraph id="HFAB8B7E5DE724960914FE7BB0329CFAC"><enum>(A)</enum><header>Recommendations
				for changes</header><text>Each report under paragraph (2)(A) shall be submitted
				to—</text>
									<clause id="H9944E43FCE44459882F25FE26016E51F"><enum>(i)</enum><text>the Committee on
				Energy and Commerce within the House of Representatives;</text>
									</clause><clause id="H28B322BC5ABC4647A05D870712839593"><enum>(ii)</enum><text>the Committee on
				Health, Education, Labor, and Pensions within the Senate;</text>
									</clause><clause id="HFB3AAB5850D0465EAAFFBB00A977E23F"><enum>(iii)</enum><text>the Secretary;
				and</text>
									</clause><clause id="H1E74437D4F234A96AAE10013111B54EA"><enum>(iv)</enum><text>officials with
				organizational authorities, other than any such official who served as a member
				of the Board with respect to the report involved.</text>
									</clause></subparagraph><subparagraph id="H91754EB9E23C4AFEAC32857528656221"><enum>(B)</enum><header>Availability to
				public</header><text>The Director of NIH shall post each report under paragraph
				(2) on the Internet site of the National Institutes of Health.</text>
								</subparagraph><subparagraph id="H20D3250A05AA405A933B59CB9F37D00"><enum>(C)</enum><header>Report on board
				activities</header><text>Not later than 18 months after the date of the
				enactment of the <short-title>National Institutes of
				Health Reform Act of 2006</short-title>, the Board shall submit to the
				committees specified in subparagraph (A) a report describing the activities of
				the Board.</text>
								</subparagraph></paragraph></subsection><subsection id="H632BB5BC40644EC79C6D04119860D355"><enum>(f)</enum><header>Organizational
				changes per recommendation of scientific management review board</header>
							<paragraph id="H665774B7A1F440F5AF002B5F3401008C"><enum>(1)</enum><header>In
				general</header><text>With respect to an official who has organizational
				authorities within the meaning of subsection (e)(2)(A), if a recommendation to
				the official for an organizational change is made in a report under such
				subsection, the official shall, except as provided in paragraph (2) of this
				subsection, make the change in accordance with the following:</text>
								<subparagraph id="H485C3FEDF0BA4DA29D5E20FF20BB5342"><enum>(A)</enum><text>Not later than 100
				days after the report is submitted under subsection (e)(7)(A), the official
				shall initiate the applicable public process required in subsection (d) toward
				making the change.</text>
								</subparagraph><subparagraph id="H2E0EC0B0ACEE4647BAA3CB339B668FB0"><enum>(B)</enum><text>The change shall
				be fully implemented not later than the expiration of the 3-year period
				beginning on the date on which such process is initiated.</text>
								</subparagraph></paragraph><paragraph id="HB76ED62AFC3B43440023F1E85BA4ABD0"><enum>(2)</enum><header>Objection by
				director of nih</header>
								<subparagraph id="H4F7BC50E8A744201AC32CB939E283DAD"><enum>(A)</enum><header>In
				general</header><text>Paragraph (1) does not apply to a recommendation for an
				organizational change made in a report under subsection (e)(2)(A) if, not later
				than 90 days after the report is submitted under subsection (e)(7)(A), the
				Director of NIH submits to the committees specified in such subsection a report
				providing that the Director objects to the change, which report includes the
				reasons underlying the objection.</text>
								</subparagraph><subparagraph id="H849A3111B53C4C0291E300EE6C294CD"><enum>(B)</enum><header>Scope of
				objection</header><text>For purposes of subparagraph (A), an objection by the
				Director of NIH may be made to the entirety of a recommended organizational
				change or to 1 or more aspects of the change. Any aspect of a change not
				objected to by the Director in a report under subparagraph (A) shall be
				implemented in accordance with paragraph (1).</text>
								</subparagraph></paragraph></subsection><subsection id="H487DD354042349EFAD8CA6B35D563CC9"><enum>(g)</enum><header>Definitions</header><text>For
				purposes of this title:</text>
							<paragraph id="H9DCC66B5E7EC468498839500E574352E"><enum>(1)</enum><text>The term
				<term>Director of NIH</term> means the Director of the National Institutes of
				Health.</text>
							</paragraph><paragraph commented="no" id="H5DAEE20E6A1E4A91BC13D1458DEFF924"><enum>(2)</enum><text>The terms
				<term>national research institute</term> and <term>national center</term> mean
				an agency of the National Institutes of Health that is—</text>
								<subparagraph commented="no" id="H4D8CBF9A72F8422000F0A64830C34DB3"><enum>(A)</enum><text>listed in
				subsection (b) and not terminated under subsection (d)(2)(A); or</text>
								</subparagraph><subparagraph commented="no" id="HC2BE44331BC842B7BD11E5EE2EFDFD3"><enum>(B)</enum><text>established by the
				Director of NIH under such subsection.</text>
								</subparagraph></paragraph></subsection><subsection id="H769805B7ECC74D5FB42B4307ACDDE836"><enum>(h)</enum><header>References to
				NIH</header><text>For purposes of this title, a reference to the National
				Institutes of Health includes its
				agencies.</text>

				the national research institutes and national centers, be responsible for

				centers, including conducting priority-setting reviews, to ensure that the
				research portfolio of the National Institutes of Health is balanced and free of
				unnecessary, duplicative research, and takes advantage of collaborative,
				cross-cutting research;</text>
						</paragraph><paragraph id="H6F0630FCB8384EA70071DFD3C3597175"><enum>(4)</enum><text display-inline="yes-display-inline">shall assemble accurate data to be used to
				assess research priorities, including information to better evaluate scientific
				opportunity, public health burdens, and progress in reducing health
				disparities;</text>
						</paragraph><paragraph display-inline="no-display-inline" id="H1DC858B9FA094846B52F7DC5C738C7F5"><enum>(5)</enum><text display-inline="yes-display-inline">shall ensure that scientifically based
				strategic planning is implemented in support of research priorities as
				determined by the agencies of the National Institutes of Health;</text>
						</paragraph><paragraph id="H550B675F61A6413893E759E0C1191168"><enum>(6)</enum><text>shall ensure that
				the resources of the National Institutes of Health are sufficiently allocated
				for research projects identified in strategic plans;</text>
						</paragraph><paragraph id="HD50329D6C0CD415B9B5410E4C31E00BA"><enum>(7)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H7640F50733704B90A952D04148CD62AE"><enum>(A)</enum><text display-inline="yes-display-inline">shall, through the Division of Program
				Coordination, Planning, and Strategic Initiatives—</text>
								<clause id="H5CADFFC74137418980C579BC27F5234F" indent="up1"><enum>(i)</enum><text display-inline="yes-display-inline">identify research that represents important
				areas of emerging scientific opportunities, rising public health challenges, or
				knowledge gaps that deserve special emphasis and would benefit from conducting
				or supporting additional research that involves collaboration between 2 or more
				national research institutes or national centers, or would otherwise benefit
				from strategic coordination and planning;</text>
								</clause><clause id="H4B7D1C88FB2B4F24A38391D9E2F5A6D" indent="up1"><enum>(ii)</enum><text>include information on such
				research in reports under section 403; and</text>
								</clause><clause commented="no" id="H3CFE42F58062468FBD1001188C354E4F" indent="up1"><enum>(iii)</enum><text>in the case of such research
				supported with funds referred to in subparagraph (B)—</text>
									<subclause commented="no" id="HD52F8F2BB0C14C05969449BCF236A6BB"><enum>(I)</enum><text>require as appropriate that proposals
				include milestones and goals for the research;</text>
									</subclause><subclause commented="no" id="H84C0350F8A884B24B64B68B6C4151FA7"><enum>(II)</enum><text>require that the proposals include
				timeframes for funding of the research; and</text>
									</subclause><subclause commented="no" id="HD08D07B0F9BF40B68C5746050207681B"><enum>(III)</enum><text>ensure appropriate consideration of
				proposals for which the principal investigator is an individual who has not
				previously served as the principal investigator of research conducted or
				supported by the National Institutes of Health;</text>
									</subclause></clause></subparagraph><subparagraph commented="no" id="HC7BAF315F6D3409AAF01B539796CB68E" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">may, with respect to funds reserved under
				section 402A(c)(1) for the Common Fund, allocate such funds to the national
				research institutes and national centers for conducting and supporting research
				that is identified under subparagraph (A); and</text>
							</subparagraph><subparagraph id="H2A760B92671A46CE0054E8AEDDF5CF25" indent="up1"><enum>(C)</enum><text>may assign additional functions to the
				Division in support of responsibilities identified in subparagraph (A), as
				determined appropriate by the Director;</text>
							</subparagraph></paragraph><paragraph id="HDC005BCA76044FE3004633D2BDF29FF8"><enum>(8)</enum><text display-inline="yes-display-inline">shall, in coordination with the heads of
				the national research institutes and national centers, ensure that such
				institutes and centers—</text>
							<subparagraph id="H74CCBBD9B1A0479FBEED1EAAEC087CF4"><enum>(A)</enum><text display-inline="yes-display-inline">preserve an emphasis on
				investigator-initiated research project grants, including with respect to
				research involving collaboration between 2 or more such institutes or centers;
				and</text>
							</subparagraph><subparagraph id="HA7863AC121F84BCDB3505E9BD3543F07"><enum>(B)</enum><text>when appropriate,
				maximize investigator-initiated research project grants in their annual
				research portfolios;</text>
							</subparagraph></paragraph><paragraph id="HC359F7A8727E497C8604F11B5FB82E11"><enum>(9)</enum><text display-inline="yes-display-inline">shall ensure that research conducted or
				supported by the National Institutes of Health is subject to review in
				accordance with section 492 and that, after such review, the research is
				reviewed in accordance with section 492A(a)(2) by the appropriate advisory
				council under section 406 before the research proposals are approved for
				funding;</text>
						</paragraph><paragraph id="H7ABA26796B19459D9E19FA88F734F994"><enum>(10)</enum><text>shall approve the
				establishment of all centers of excellence recommended by the national research
				institutes, other than centers recognized under section 414;</text>
						</paragraph><paragraph id="H7CF1157AF633423B92B5C64135B96755"><enum>(11)</enum><text display-inline="yes-display-inline">shall oversee research training for all of
				the national research institutes and National Research Service Awards in
				accordance with section 487;</text>
						</paragraph><paragraph id="H7700B965E5524DCE978C417C8C192900"><enum>(12)</enum><text display-inline="yes-display-inline">may, from funds appropriated under section
				402A(b), reserve funds to provide for research on matters that have not
				received significant funding relative to other matters, to respond to new
				issues and scientific emergencies, and to act on research opportunities of high
				priority;</text>
						</paragraph><paragraph id="H628935C52E244A52AA1DA416329060FC"><enum>(13)</enum><text display-inline="yes-display-inline">may, subject to appropriations Acts,
				collect and retain registration fees obtained from third parties to defray
				expenses for scientific, educational, and research-related
				conferences;</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H9FB59E630E974B5DAB3D1F36C80557A"><enum>(b)</enum><header>Certain
			 authorities</header><text display-inline="yes-display-inline">Section 402 of
			 the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/282">42 U.S.C. 282</external-xref>) is amended—</text>
				<paragraph id="H40BA898002A342F783D85B84A5C91226"><enum>(1)</enum><text>by striking
			 subsections (i) and (l); and</text>
				</paragraph><paragraph id="HCAB3C9B76F94429E9D204F9BD265931"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating subsections (j) and (k) as
			 subsections (i) and (j), respectively.</text>
				</paragraph></subsection><subsection id="H5741B9BF12404E0EB4C54416BE004622"><enum>(c)</enum><header>Advisory council
			 for director of NIH</header><text>Section 402 of the Public Health Service Act,
			 as amended by subsection (b) of this section, is amended by adding after
			 subsection (j) the following subsection:</text>
				<quoted-block display-inline="no-display-inline" id="HB63565C9B1974763BFC6F25B9603634E" style="traditional">
					<subsection id="H61F4246611A5446F802DEBB8036D275D"><enum>(k)</enum><header>Council of
				councils</header>
						<paragraph id="H48CEC7483FD14F1A8FDFBEB3652451AD"><enum>(1)</enum><header>Establishment</header><text>The
				Director of NIH shall establish within the Office of the Director an advisory
				council to be known as the <quote>Council of Councils</quote> (referred to in
				this subsection as the <quote>Council</quote>) for the purpose of advising the
				Director on matters related to the policies and activities of the Division of
				Program Coordination, Planning, and Strategic Initiatives, including making
				recommendations with respect to the conduct and support of research described
				in subsection (b)(7).</text>
						</paragraph><paragraph id="H6336D24C447B4D5EBDE3AC06BE3FB8AE"><enum>(2)</enum><header>Membership</header>
							<subparagraph id="H11B12ADC7D6A458890C2E79F3EF534B"><enum>(A)</enum><header>In
				general</header><text>The Council shall be composed of 27 members selected by
				the Director of NIH with approval from the Secretary from among the list of
				nominees under subparagraph (C).</text>
							</subparagraph><subparagraph id="HAFB6933B317B4708A065B49DEBE4A3B0"><enum>(B)</enum><header>Certain
				requirements</header><text>In selecting the members of the Council, the
				Director of NIH shall ensure—</text>
								<clause id="H8E5824B8FE7048B796710003BEA57E65"><enum>(i)</enum><text>the representation
				of a broad range of disciplines and perspectives; and</text>
								</clause><clause id="HB54F3CA6BE2A45E5B51D082C0993C61D"><enum>(ii)</enum><text>the ongoing
				inclusion of at least 1 representative from each national research institute
				whose budget is substantial relative to a majority of the other
				institutes.</text>
								</clause></subparagraph><subparagraph id="H8970F10157E5414EBBFD758600813115"><enum>(C)</enum><header>Nomination</header><text>The
				Director of NIH shall maintain an updated list of individuals who have been
				nominated to serve on the Council, which list shall consist of the
				following:</text>
								<clause id="H91CF78C3DAD2414BA0B6104D8DA9C780"><enum>(i)</enum><text>For each national
				research institute and national center, 3 individuals nominated by the head of
				such institute or center from among the members of the advisory council of the
				institute or center, of which—</text>
									<subclause id="H3362795F26844FB9A5F8CC09BEFEDDEE"><enum>(I)</enum><text>two shall be
				scientists; and</text>
									</subclause><subclause id="H88E34DE887B2466796F700B5C2223BCD"><enum>(II)</enum><text>one shall be from
				the general public or shall be a leader in the field of public policy, law,
				health policy, economics, or management.</text>
									</subclause></clause><clause id="HA81F6A3F07DD4EF691B6100000C527B4"><enum>(ii)</enum><text display-inline="yes-display-inline">For each office within the Division of
				Program Coordination, Planning, and Strategic Initiatives, 1 individual
				nominated by the head of such office.</text>
								</clause></subparagraph></paragraph><paragraph id="H79B25A3C6450489D91062977965953F2"><enum>(3)</enum><header>Terms</header>
							<subparagraph id="H3D23A7F194A2486F920280E326680248"><enum>(A)</enum><header>In
				general</header><text>The term of service for a member of the Council shall be
				6 years, except as provided in subparagraphs (B) and (C).</text>
							</subparagraph><subparagraph id="HB75C012944FE4380B9D33C44F352FF52"><enum>(B)</enum><header>Terms of initial
				appointees</header><text>Of the initial members selected for the Council, the
				Director of NIH shall designate—</text>
								<clause id="H6093AA2FB1B749B5A3A4E598F6DDA600"><enum>(i)</enum><text>nine for a term of
				6 years;</text>
								</clause><clause id="H0DF4BA63289742FD9CAD9B3F3136B0AA"><enum>(ii)</enum><text>nine for a term
				of 4 years; and</text>
								</clause><clause id="HBF660E71F30741779767624C106CA945"><enum>(iii)</enum><text>nine for a term
				of 2 years.</text>
								</clause></subparagraph><subparagraph id="HF9961F110C1E40C78CF9B468D57D2900"><enum>(C)</enum><header>Vacancies</header><text>Any
				member appointed to fill a vacancy occurring before the expiration of the term
				for which the member’s predecessor was appointed shall be appointed only for
				the remainder of that term. A member may serve after the expiration of that
				member’s term until a successor has taken
				office.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection display-inline="no-display-inline" id="H33C0FEEA57734E568816E73B1821FA"><enum>(d)</enum><header>Review by advisory
			 councils of research proposals</header><text>Section 492A(a)(2) of the Public
			 Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/289a-1">42 U.S.C. 289a–1(a)(2)</external-xref>) is
			 amended by inserting before the period the following: <quote>, and unless a
			 majority of the voting members of the appropriate advisory council under
			 section 406, or as applicable, of the advisory council under section 402(k),
			 has recommended the proposal for approval</quote>.</text>
			</subsection><subsection id="H3BA353C3013A40AE8583B79393053F61"><enum>(e)</enum><header>Conforming
			 amendment</header><text>Section 402(a) of the Public Health Service Act
			 (42 U.S.C.
			 282(a)) is amended by striking <quote>Director of the National
			 Institutes of Health</quote> and all that follows through <quote>who
			 shall</quote> and inserting <quote>Director of NIH who shall</quote>.</text>
			</subsection><subsection id="H344221D77CE642BEA5497E4173A400D0"><enum>(f)</enum><header>Rule of
			 construction regarding authorities of national research institutes and national
			 centers</header><text display-inline="yes-display-inline">This Act and the
			 amendments made by this Act may not be construed as affecting the authorities
			 of the national research institutes and national centers that were in effect
			 under the Public Health Service Act on the day before the date of the enactment
			 of this Act, subject to the authorities of the Director of NIH under section
			 401 of the Public Health Service Act (as amended by section 2(a) of this Act).
			 For purposes of the preceding sentence, the terms <term>national research
			 institute</term>, <term>national center</term>, and <term>Director of
			 NIH</term> have the meanings given such terms in such section 401.</text>
			</subsection></section><section id="H853A6D06D3844389BA7D5319CE1705D7"><enum>4.</enum><header>Authorization of
			 appropriations</header>
			<subsection id="H601EA480D71C4D599FF36FF695304B6E"><enum>(a)</enum><header>Funding</header><text display-inline="yes-display-inline">Title IV of the Public Health Service Act

			 seq.) is amended by inserting after section 402 the

				fund</header>
								<subparagraph commented="no" id="H8619B67F55BF4E47A12600E300F009D"><enum>(A)</enum><header>Annual
				reservation of amounts</header><text display-inline="yes-display-inline">Of the
				total amount appropriated under subsection (a) for fiscal year 2007 or any
				subsequent fiscal year, the Director of NIH shall reserve the applicable amount
				under subparagraph (B) for allocations under section 402(b)(7)(B) (relating to
				research identified by the Division of Program Coordination, Planning, and
				Strategic Initiatives), which reservations shall constitute an account to be
				known as the Common Fund.</text>
								</subparagraph><subparagraph commented="no" id="H45647F21879C4AB3BB29265322D745C9"><enum>(B)</enum><header>Amount of
				reservation</header><text>Subject to subparagraph (C), the amount reserved by
				the Director of NIH under subparagraph (A) for a fiscal year shall be the sum
				of—</text>
									<clause commented="no" id="H88C7718105B04A868013FA4741C6FD64"><enum>(i)</enum><text>the base amount
				determined under subparagraph (D); and</text>
									</clause><clause commented="no" id="HAA78AE31F4714C9FB42F2F4040747796"><enum>(ii)</enum><text>any additional
				amount determined under subparagraph (E).</text>
									</clause><continuation-text commented="no" continuation-text-level="subparagraph">Amounts reserved under the
				preceding sentence shall remain available until expended.</continuation-text></subparagraph><subparagraph commented="no" id="HA4B022F403A34E1FAA0397E9EC132DF9"><enum>(C)</enum><header>Maximum
				reservation</header>
									<clause commented="no" id="H1529490DD8CC44188ED2CD4F35D0C56B"><enum>(i)</enum><header>In
				general</header><text>The amount reserved by the Director of NIH under
				subparagraph (A) for a fiscal year shall not exceed 5 percent of the total
				amount appropriated under subsection (a) for such fiscal year, subject to
				clause (ii).</text>
									</clause><clause id="HAFE3628683DA45BB8DB5132300CE74C5"><enum>(ii)</enum><header>Applicability</header><text>Clause
				(i) may not apply with respect to any fiscal year beginning after the
				submission of recommendations under subparagraph (F).</text>
									</clause><clause commented="no" id="H6942A7D5B06E40F8A69633DABCF432D"><enum>(iii)</enum><header>Preservation of
				reservation</header><text display-inline="yes-display-inline">For any fiscal
				year following the first fiscal year for which the percentage that applies for
				purposes of clause (i) is 5 percent, the reservation under subparagraph (A) for
				the fiscal year involved may not be less than 5 percent of the total amount
				appropriated under subsection (a) for such fiscal year. For fiscal year 2008
				and each subsequent fiscal year, the percentage constituted by the reservation
				under subparagraph (A) relative to the total amount appropriated under
				subsection (a) for the fiscal year involved may not be less than the percentage
				constituted by the reservation under such subparagraph for the preceding fiscal
				year relative to the total amount appropriated under subsection (a) for such
				preceding fiscal year.</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7BF7C39DB38341F4B4A3EBC6FA829277"><enum>(D)</enum><header>Base
				amount</header><text display-inline="yes-display-inline">The base amount
				referred to in subparagraph (B)(i) for a fiscal year is—</text>
									<clause commented="no" id="H116E4251E7404F8B9538741DBD09C0D7"><enum>(i)</enum><text>for fiscal year
				2007, the amount reserved by the Director of NIH for fiscal year 2006 for
				research described in section 402(b)(7)(A)(i); and</text>
									</clause><clause commented="no" id="HA41AAED2973A43B2B18600DC7EBF4131"><enum>(ii)</enum><text>for fiscal year
				2008 and each subsequent fiscal year, the amount reserved under subparagraph
				(A) for the preceding fiscal year.</text>
									</clause></subparagraph><subparagraph commented="no" id="H3846F9133A144B6EBC21009DD5EB7E3E"><enum>(E)</enum><header>Additional
				amount corresponding to increases in appropriations</header><text display-inline="yes-display-inline">The additional amount referred to in
				subparagraph (B)(ii) is 50 percent of the amount by which the total amount
				appropriated under subsection (a) for the fiscal year involved exceeds the
				total amount appropriated under such subsection for the preceding fiscal year,
				except that for any fiscal year beginning after the submission of
				recommendations under subparagraph (F), such percentage may be adjusted by the
				Director of NIH, and such percentage shall be adjusted by the Director to the
				extent necessary for compliance with subparagraph (C)(iii).</text>
								</subparagraph><subparagraph commented="no" id="H7B1237BCFD714BBD87C6DE62C8CCCCF0"><enum>(F)</enum><header>Evaluation</header><text>During
				the 6-month period following the end of the first fiscal year for which the
				amount reserved by the Director of NIH under subparagraph (A) is equal to 5
				percent of the total amount appropriated under subsection (a) for such fiscal
				year, the Secretary, acting through the Director of NIH, in consultation with
				the advisory council established under section 402(k), shall submit
				recommendations to the Congress for changes to the amount of the reservation
				under subparagraph (A).</text>
								</subparagraph></paragraph><paragraph id="H0B6BC30A0D444762BEDFE1B6F4373785"><enum>(2)</enum><header>Trans-NIH
				research reporting</header>
								<subparagraph id="H6260834620DD4CA18BABDC262704584D"><enum>(A)</enum><header>Limitation</header><text>With
				respect to the total amount appropriated under subsection (a) for fiscal year
				2008 or any subsequent fiscal year, if the head of a national research
				institute or national center fails to submit the report required by
				subparagraph (B) for the preceding fiscal year, the amount made available for
				the institute or center for the fiscal year involved may not exceed the amount
				made available for the institute or center for fiscal year 2006.</text>
								</subparagraph><subparagraph id="H00DCC271E5A5413D99B3DE5E9932895B"><enum>(B)</enum><header>Reporting</header><text display-inline="yes-display-inline">Not later than January 1, 2008, and each
				January 1st thereafter—</text>
									<clause id="H21D0AE1528DC46B292962984FF668704"><enum>(i)</enum><text>the head of each
				national research institute or national center shall submit to the Director of
				NIH a report on the amount made available by the institute or center for
				conducting or supporting research that involves collaboration between the
				institute or center and 1 or more other national research institutes or
				national centers; and</text>
									</clause><clause id="HAEE6C3543072411195BC0086FC6C91E0"><enum>(ii)</enum><text display-inline="yes-display-inline">the Secretary shall submit a report to the
				Congress identifying the percentage of funds made available by each national
				research institute and national center with respect to such fiscal year for
				conducting or supporting research described in clause (i).</text>
									</clause></subparagraph><subparagraph id="H5B656CB124664131BB932000A378CC7"><enum>(C)</enum><header>Determination</header><text>For
				purposes of determining the amount or percentage of funds to be reported under
				subparagraph (B), any amounts made available to an institute or center under
				section 402(b)(7)(B) shall be included.</text>
								</subparagraph><subparagraph id="HC657FD90AB7E404E95BE20C694E48753"><enum>(D)</enum><header>Verification of
				amounts</header><text>Upon receipt of each report submitted under subparagraph
				(B)(i), the Director of NIH shall review and verify the accuracy of the amounts
				specified in the report.</text>
								</subparagraph><subparagraph commented="no" id="H159D573D9C0A45E8BBF7316263B7CCBA"><enum>(E)</enum><header>Waiver</header><text>At
				the request of any national research institute or national center, the Director
				of NIH may waive the application of this paragraph to such institute or center
				if the Director finds that the conduct or support of research described in
				subparagraph (B)(i) is inconsistent with the mission of such institute or
				center.</text>
								</subparagraph></paragraph></subsection><subsection commented="no" id="H2A0484A418B94BB7A35C21DB45000D3"><enum>(d)</enum><header>Transfer
				authority</header><text display-inline="yes-display-inline">Of the total amount
				appropriated under subsection (a) for a fiscal year, the Director of NIH may
				(in addition to the reservation under (c)(1) for such year) transfer not more
				than 1 percent for programs or activities that are authorized in this title and
				identified by the Director to receive funds pursuant to this subsection. In
				making such transfers, the Director may not decrease any appropriation account
				under subsection (a) by more than 1 percent.</text>
						</subsection><subsection commented="no" id="H89D575AC2672417D9BA7EA41C0025CE0"><enum>(e)</enum><header>Rule of
				construction</header><text>This section may not be construed as affecting the
				authorities of the Director of NIH under section
				401.</text>

						<section id="H4437E47570224E219C00A73C0138E9B0"><enum>402B.</enum><header>Electronic
				coding of grants and activities</header><text display-inline="no-display-inline">The Secretary, acting through the Director
				of NIH, shall establish an electronic system to uniformly code research grants
				and activities of the Office of the Director and of all the national research
				institutes and national centers. The electronic system shall be searchable by a
				variety of codes, such as the type of research grant, the research entity
				managing the grant, and the public health area of interest. When permissible,
				the Secretary, acting through the Director of NIH, shall provide information on
				relevant literature and patents that are associated with research activities of
				the National Institutes of Health.</text>
						</section><section id="HEEF02E5EAE434C5DB22355D9DED9BB07"><enum>403.</enum><header>Biennial
				reports of Director of NIH</header>
							<subsection id="HA8436141C7074C4DB68F00E6E0F47920"><enum>(a)</enum><header>In
				general</header><text>The Director of NIH shall submit directly to the Congress
				on a biennial basis a report in accordance with this section. The first report
				shall be submitted not later than 1 year after the date of the enactment of the
				<short-title>National Institutes of Health Reform Act of
				2006</short-title>. Each such report shall include the following
				information:</text>
								<paragraph id="H4240C4D1C4E747EFB450BE984162D71E"><enum>(1)</enum><text>An assessment of
				the state of biomedical and behavioral research.</text>
								</paragraph><paragraph id="HE54BB28BC4C94B9DA227C26D00A98502"><enum>(2)</enum><text>A description of
				the activities conducted or supported by the agencies of the National
				Institutes of Health and policies respecting the programs of such
				agencies.</text>
								</paragraph><paragraph id="H0169B3695DF54B0698977B2DC7E56C8"><enum>(3)</enum><text display-inline="yes-display-inline">Classification and justification for the
				priorities established by the agencies, including a strategic plan and
				recommendations for future research initiatives to be carried out under section
				402(b)(7) through the Division of Program Coordination, Planning, and Strategic
				Initiatives.</text>
								</paragraph><paragraph id="HD653097B80DA4030BD0000B2F6463D97"><enum>(4)</enum><text>A catalog of all
				the research activities of the agencies, prepared in accordance with the
				following:</text>
									<subparagraph id="HF2F148986C22401283C931AC4B02F66E"><enum>(A)</enum><text>The catalog
				shall, for each such activity—</text>
										<clause id="H4C2BA744C1B446789396309E74124030"><enum>(i)</enum><text>identify the
				agency or agencies involved;</text>
										</clause><clause id="HEAE3332C682A4BE3AAEC012BFBBEE175"><enum>(ii)</enum><text>state whether the
				activity was carried out directly by the agencies or was supported by the
				agencies and describe to what extent the agency was involved; and</text>
										</clause><clause id="H284C063D018F4F5FA1F9E25D00FAAA53"><enum>(iii)</enum><text display-inline="yes-display-inline">identify whether the activity was carried
				out through a center of excellence.</text>
										</clause></subparagraph><subparagraph id="H176BCC7322A14DB6BBFEC8B427B2C6B2"><enum>(B)</enum><text display-inline="yes-display-inline">In the case of clinical research, the
				catalog shall, as appropriate, identify study populations by demographic
				variables and other variables that contribute to research on health
				disparities.</text>
									</subparagraph><subparagraph id="H20AE68E644554F538D54A1C56466B7A7"><enum>(C)</enum><text>Research
				activities listed in the catalog shall include the following:</text>
										<clause id="HF02CAA5F2D06495A90EDFC0E6C1EAAD"><enum>(i)</enum><text display-inline="yes-display-inline">Epidemiological studies and longitudinal
				studies.</text>
										</clause><clause id="H11F9AE431BC14FD7999709CC1D939BC0"><enum>(ii)</enum><text>Disease
				registries, information clearinghouses, and other data systems.</text>
										</clause><clause id="HACEFAEA3F939481DB458F25987684FB8"><enum>(iii)</enum><text>Public education
				and information campaigns.</text>
										</clause><clause id="H2B188AA024D140FEBA25D0B005364E55"><enum>(iv)</enum><text display-inline="yes-display-inline">Training activities, including National
				Research Service Awards and a breakdown by demographic variables and other
				appropriate categories.</text>
										</clause><clause id="H738E2BB13B214C609F5574A500D7FEB9"><enum>(v)</enum><text display-inline="yes-display-inline">Clinical trials, including a breakdown of
				participation by study populations and demographic variables and such other
				information as may be necessary to demonstrate compliance with section 492B
				(regarding inclusion of women and minorities in clinical research).</text>
										</clause><clause id="H2C5F95AF6D5942CA8BEECDE627D7E608"><enum>(vi)</enum><text>Translational
				research activities with other agencies of the Public Health Service.</text>
										</clause></subparagraph></paragraph><paragraph id="H4307783541BA4DF5815374810059EBF3"><enum>(5)</enum><text>A summary of the
				research activities throughout the agencies, which summary shall be organized
				by the following categories:</text>
									<subparagraph id="HC7B55ACFE75D4B809753FCA822D57D7C"><enum>(A)</enum><text>Cancer.</text>
									</subparagraph><subparagraph id="H0093F7E613264818A69244D1AC21332C"><enum>(B)</enum><text>Neurosciences.</text>
									</subparagraph><subparagraph id="HA3AFB397356C40F68325E24300CC5DFC"><enum>(C)</enum><text>Life stages, human
				development, and rehabilitation.</text>
									</subparagraph><subparagraph id="H8E4ACA03DBA64B0F007551E7B8A8D91B"><enum>(D)</enum><text>Organ
				systems.</text>
									</subparagraph><subparagraph id="H78BF7F804A054DF195A956098278D93E"><enum>(E)</enum><text>Autoimmune
				diseases.</text>
									</subparagraph><subparagraph id="H6ACFAAC03C5847189361D7A9207F7BA7"><enum>(F)</enum><text>Genomics.</text>
									</subparagraph><subparagraph id="H4A4ABDFAF7294CED86641CC115FF5DED"><enum>(G)</enum><text>Molecular biology
				and basic science.</text>
									</subparagraph><subparagraph id="H6B65EC63D538446E8E76E960F18379C"><enum>(H)</enum><text>Technology
				development.</text>
									</subparagraph><subparagraph id="H62014F042F9A432591E19EA52EF65300"><enum>(I)</enum><text display-inline="yes-display-inline">Chronic diseases, including pain and
				palliative care.</text>
									</subparagraph><subparagraph id="H4D0B9069E74540E3BFB3558D3F28E9D7"><enum>(J)</enum><text>Infectious
				diseases and bioterrorism.</text>
									</subparagraph><subparagraph id="HC1E665F922874DD888598882E3CE68D"><enum>(K)</enum><text>Health
				disparities.</text>
									</subparagraph><subparagraph id="HC8447C55B0584D27A2EB3495162E0351"><enum>(L)</enum><text>Such additional
				categories as the Director determines to be appropriate.</text>
									</subparagraph></paragraph></subsection><subsection id="H8C8D55426AD44CEC9DC5E20D5F78820"><enum>(b)</enum><header>Requirement
				regarding disease-specific research activities</header><text>In a report under
				subsection (a), the Director of NIH, when reporting on research activities
				relating to a specific disease, disorder, or other adverse health condition,
				shall—</text>
								<paragraph id="H105C5A65DEEE4F48AB9654DF66D497EB"><enum>(1)</enum><text>present
				information in a standardized format;</text>
								</paragraph><paragraph id="H869E2207F99A4C5AB9310000DC00F76B"><enum>(2)</enum><text>identify the
				actual dollar amounts obligated for such activities; and</text>
								</paragraph><paragraph id="HECEA2E394A5E461DA2A48F3E28879F71"><enum>(3)</enum><text display-inline="yes-display-inline">include a plan for research on the specific
				disease, disorder, or other adverse health condition, including a statement of
				objectives regarding the research, the means for achieving the objectives, a
				date by which the objectives are expected to be achieved, and justifications
				for revisions to the plan.</text>
								</paragraph></subsection><subsection id="HA96ABA1843E04A800055F0FBF369E0CA"><enum>(c)</enum><header>Additional
				reports</header><text>In addition to reports required by subsections (a) and
				(b), the Director of NIH may submit to the Congress such additional reports as
				the Director determines to be appropriate.</text>
							</subsection></section><section display-inline="no-display-inline" id="HF1A9921618A74621BF299CA586D24EC5" section-type="subsequent-section"><enum>403A.</enum><header>Annual reporting to
				increase interagency collaboration and coordination</header>
							<subsection id="HF659B13104C94E819F99CA04CDA78BAC"><enum>(a)</enum><header>Collaboration
				with other HHS agencies</header><text>On an annual basis, the Director of NIH
				shall submit to the Secretary a report on the activities of the National
				Institutes of Health involving collaboration with other agencies of the
				Department of Health and Human Services.</text>
							</subsection><subsection id="H92ADDD962DD3437D904E2E6F5F46E9BB"><enum>(b)</enum><header>Clinical
				trials</header><text>Each calendar year, the Director of NIH shall submit to
				the Commissioner of Food and Drugs a report that identifies each clinical trial
				that is registered during such calendar year in the databank of information
				established under section 402(j).</text>
							</subsection><subsection id="H3BDFF72DA482439BA758B67311996F86"><enum>(c)</enum><header>Human tissue
				samples</header><text>On an annual basis, the Director of NIH shall submit to
				the Congress a report that describes how the National Institutes of Health and
				its agencies store and track human tissue samples.</text>
							</subsection><subsection id="HA06DF9D053D24597837ECDB1DDA400A1"><enum>(d)</enum><header>First
				report</header><text>The first report under subsections (a), (b), and (c) shall
				be submitted not later than 1 year after the date of the enactment of the
				National Institutes of Health Reform Act of 2006.</text>
							</subsection></section><section display-inline="no-display-inline" id="HABC0F23CBA9941DD83C7294DFB28C6D" section-type="subsequent-section"><enum>403B.</enum><header>Annual reporting to
				prevent fraud and abuse</header>
							<subsection id="H48DF5E145399445DA945873519B11D40"><enum>(a)</enum><header>Whistleblower
				complaints</header>
								<paragraph id="HBD5BAE30E5EA4FC984D629ADF6B2BC2B"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">On an annual basis,
				the Director of NIH shall submit to the Inspector General of the Department of
				Health and Human Services, the Secretary, the Committee on Energy and Commerce
				of the House of Representatives, and the Committee on Health, Education, Labor,
				and Pensions of the Senate a report summarizing the activities of the National
				Institutes of Health relating to whistleblower complaints.</text>
								</paragraph><paragraph id="HBF441F910BF747558C24135D5C5915D7"><enum>(2)</enum><header>Contents</header><text display-inline="yes-display-inline">For each whistleblower complaint pending
				during the year for which a report is submitted under this subsection, the
				report shall identify the following:</text>
									<subparagraph id="H5A02E3BCFDEC49A1A22F95EDCE640939"><enum>(A)</enum><text>Each agency of the
				National Institutes of Health involved.</text>
									</subparagraph><subparagraph id="H64E6DB73A8D24C7D83ED85A5C4B5E144"><enum>(B)</enum><text>The status of the
				complaint.</text>
									</subparagraph><subparagraph id="HE0A6C6F4549248C2845D947CF92E6E12"><enum>(C)</enum><text>The resolution of
				the complaint to date.</text>
									</subparagraph></paragraph></subsection><subsection id="H9BFB0B66D1CF4C7DB6EA67F22F7067BD"><enum>(b)</enum><header>Experts and
				consultants</header><text display-inline="yes-display-inline">On an annual
				basis, the Director of NIH shall submit to the Inspector General of the
				Department of Health and Human Services, the Secretary, the Committee on Energy
				and Commerce of the House of Representatives, and the Committee on Health,
				Education, Labor, and Pensions of the Senate a report that—</text>
								<paragraph id="H80C61447E9734C8A854838F3C9D8E106"><enum>(1)</enum><text>identifies the
				number of experts and consultants, including any special consultants, whose
				services are obtained by the National Institutes of Health or its
				agencies;</text>
								</paragraph><paragraph id="H92FBF7171C6D40578562D85141D1C7DF"><enum>(2)</enum><text>specifies whether
				such services were obtained under section 207(f), section 402(d), or other
				authority;</text>
								</paragraph><paragraph id="H7FCDF2FB45AE4B2C9C0030D9D6CBF97"><enum>(3)</enum><text>describes the
				qualifications of such experts and consultants;</text>
								</paragraph><paragraph id="HA2136A6C48C94DC6B488B8870300A98B"><enum>(4)</enum><text>describes the need
				for hiring such experts and consultants; and</text>
								</paragraph><paragraph id="HB58551FA8B654F6890AAE700FF91BAD6"><enum>(5)</enum><text>if such experts
				and consultants make financial disclosures to the National Institutes of Health
				or any of its agencies, specifies the income, gifts, assets, and liabilities so
				disclosed.</text>
								</paragraph></subsection><subsection id="H19B635A3DC6149D9B52B46538579C47"><enum>(c)</enum><header>First
				report</header><text>The first report under subsections (a) and (b) shall be
				submitted not later than 1 year after the date of the enactment of the National
				Institutes of Health Reform Act of
				2006.</text>

					</subparagraph></paragraph></subsection></section><section id="HA97A0C6762D743CE9E3517AFE299C18"><enum>6.</enum><header>Certain
			 demonstration projects</header>
			<subsection id="H439498A3BE6442D1ACBFCCB2FE51CF1D"><enum>(a)</enum><header>Bridging the
			 sciences</header>
				<paragraph id="H99282DC1A1E04FFA9EFC8CA7299C8037"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">From amounts to be
			 appropriated under section 402A(b) of the Public Health Service Act, the
			 Secretary of Health and Human Services, acting through the Director of NIH, (in
			 this subsection referred to as the <quote>Secretary</quote>) in consultation
			 with the Director of the National Science Foundation, the Secretary of Energy,
			 and other agency heads when necessary, may allocate funds for the national
			 research institutes and national centers to make grants for the purpose of
			 improving the public health through demonstration projects for biomedical
			 research at the interface between the biological, behavioral, and social
			 sciences and the physical, chemical, mathematical, and computational
			 sciences.</text>
				</paragraph><paragraph commented="no" id="H6940344ECEF6461E82EC2E26D75007F"><enum>(2)</enum><header>Goals,
			 priorities, and methods; interagency collaboration</header><text display-inline="yes-display-inline">The
			 Secretary shall establish goals, priorities, and methods of evaluation for
			 research under paragraph (1), and shall provide for interagency collaboration
			 with respect to such research. In developing such goals, priorities, and
			 methods, the Secretary shall ensure that—</text>
					<subparagraph commented="no" id="H2F90536257214294AA64BA7BF0B550F5"><enum>(A)</enum><text>the research
			 reflects the vision of innovation and higher risk with long-term payoffs;
			 and</text>
					</subparagraph><subparagraph commented="no" id="H768CCD8EEFD048E0BDBD812370FDF2"><enum>(B)</enum><text>the research
			 includes a wide spectrum of projects, funded at various levels, with varying
			 timeframes.</text>
					</subparagraph></paragraph><paragraph id="HBCF9516258EC4325834E5C74D52701B"><enum>(3)</enum><header>Peer
			 review</header><text display-inline="yes-display-inline">A grant may be made
			 under paragraph (1) only if the application for the grant has undergone
			 technical and scientific peer review under section 492 of the Public Health
			 Service Act (42
			 U.S.C. 289a) and has been reviewed by the advisory council
			 under section 402(k) of such Act (as added by section 3(c) of this Act) or has
			 been reviewed by an advisory council composed of representatives from
			 appropriate scientific disciplines who can fully evaluate the applicant.</text>
				</paragraph></subsection><subsection id="H67B4CAC907E94D12A0437DF7D05D0004"><enum>(b)</enum><header>High-risk,
			 high-reward research</header>
				<paragraph id="HEEE67B68BC214EC5AC16DB3FC98CEFD8"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">From amounts to be
			 appropriated under section 402A(b) of the Public Health Service Act, the
			 Director of NIH may allocate funds for the national research institutes and
			 national centers to make awards of grants or contracts or to engage in other
			 transactions for demonstration projects for high-impact, cutting-edge research
			 that fosters scientific creativity and increases fundamental biological
			 understanding leading to the prevention, diagnosis, and treatment of diseases
			 and disorders. The head of a national research institute or national center may
			 conduct or support such high-impact, cutting-edge research (with funds
			 allocated under the preceding sentence or otherwise available for such purpose)
			 if the institute or center gives notice to the Director of NIH beforehand and
			 submits a report to the Director of NIH on an annual basis on the activities of
			 the institute or center relating to such research.</text>
				</paragraph><paragraph id="HA470F6D947CF4CAB9463293C009BC1B9"><enum>(2)</enum><header>Special
			 consideration</header><text display-inline="yes-display-inline">In carrying out
			 the program under paragraph (1), the Director of NIH shall give special
			 consideration to coordinating activities with national research institutes
			 whose budgets are substantial relative to a majority of the other
			 institutes.</text>
				</paragraph><paragraph id="HD4013749BE7A4E60A675B352EF046540"><enum>(3)</enum><header>Administration
			 of program</header><text display-inline="yes-display-inline">Activities
			 relating to research described in paragraph (1) shall be designed by the
			 Director of NIH or the head of a national research institute or national
			 center, as applicable, to enable such research to be carried out with maximum
			 flexibility and speed.</text>
				</paragraph><paragraph id="H462CE2DF166840A39500DD007422859E"><enum>(4)</enum><header>Public-private
			 partnerships</header><text display-inline="yes-display-inline">In providing for
			 research described in paragraph (1), the Director of NIH or the head of a
			 national research institute or national center, as applicable, shall seek to
			 facilitate partnerships between public and private entities and shall
			 coordinate with the Foundation for the National Institutes of Health.</text>
				</paragraph><paragraph id="H7FEE80AAC8E34CBD8CDADACD0794208"><enum>(5)</enum><header>Peer
			 review</header><text>A grant for research described in paragraph (1) may be
			 made only if the application for the grant has undergone technical and
			 scientific peer review under section 492 of the Public Health Service Act
			 (42 U.S.C.
			 289a) and has been reviewed by the advisory council under
			 section 402(k) of such Act (as added by section 3(c) of this Act).</text>
				</paragraph></subsection><subsection display-inline="no-display-inline" id="H41C2C7F9EEA0404EA1F052542E648DED"><enum>(c)</enum><header>Report to
			 Congress</header><text>Not later than the end of fiscal year 2009, the Director
			 of NIH shall conduct an evaluation of the activities under this section and
			 submit a report to the Congress on the results of such evaluation.</text>
			</subsection><subsection id="H57A961C65C0E4FDC90BFBCDA00CB7B90"><enum>(d)</enum><header>Definitions</header><text>For
			 purposes of this section, the terms <term>Director of NIH</term>,
			 <term>national research institute</term>, and <term>national center</term> have
			 the meanings given such term in section 401 of the Public Health Service
			 Act.</text>
			</subsection></section><section display-inline="no-display-inline" id="H475B48F7293A4C0D8FB271F5C5FC87B" section-type="subsequent-section"><enum>7.</enum><header>Foundation for the
			 National Institutes of Health</header><text display-inline="no-display-inline">Section 499 of the
			 <act-name parsable-cite="PHSA">Public Health Service Act</act-name>
			 (42 U.S.C.
			 290b) is amended—</text>
			<paragraph id="HA81AD122755A440989446F28062CD225"><enum>(1)</enum><text>in subsection
			 (d)—</text>
				<subparagraph id="HBF21896ACE3A4490000835C8D753CEEA"><enum>(A)</enum><text>in paragraph
			 (1)—</text>
					<clause id="H0EF1E061D0614B0DA98C00241C539E3F"><enum>(i)</enum><text>by
			 amending subparagraph (D)(ii) to read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="HCDB8E36C94FC494188DF140562331295" style="OLC">
							<clause id="H88D71DFCC29C485DBB2870BB9FCD79FF"><enum>(ii)</enum><text>Upon the
				appointment of the appointed members of the Board under clause (i)(II), the
				terms of service as members of the Board of the ex officio members of the Board
				described in clauses (i) and (ii) of subparagraph (B) shall terminate. The ex
				officio members of the Board described in clauses (iii) and (iv) of
				subparagraph (B) shall continue to serve as ex officio members of the
				Board.</text>

					</clause><clause id="HF5E0924D5962439796A07787921CB7A1"><enum>(iii)</enum><text>in
			 subparagraph (G), by inserting <quote>appointed</quote> after <quote>that the

					</clause></subparagraph><subparagraph id="HFC37C6BD385C457C84F280B09836B363"><enum>(B)</enum><text>by amending
			 paragraph (3)(B) to read as follows:</text>

						<subparagraph id="HE3EC396C44084E1684C6DC7318CAB400"><enum>(B)</enum><text>Any vacancy in the
				membership of the appointed members of the Board shall be filled in accordance
				with the bylaws of the Foundation established in accordance with paragraph (6),
				and shall not affect the power of the remaining appointed members to execute
				the duties of the Board.</text>
						</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph><subparagraph id="HC29C3D950143481983227F56418DE216"><enum>(C)</enum><text>in paragraph (5),
			 by inserting <quote>appointed</quote> after <quote>majority of
			 the</quote>;</text>
				</subparagraph></paragraph><paragraph id="H95F4AC4E79CA477BACF8C40053013362"><enum>(2)</enum><text>in subsection
			 (j)—</text>
				<subparagraph id="HA1FE8D273BDC4E3EA3E280052F89D4C2"><enum>(A)</enum><text>in paragraph (2),
			 by striking <quote>(d)(2)(B)(i)(II)</quote> and inserting
			 <quote>(d)(6)</quote>;</text>

			 amounts transferred under subsection (l)</quote> before the period at the end;

			 striking subparagraph (C) and inserting the following:</text>

				shall make copies of each report submitted under subparagraph (A)

				public inspection, and shall upon request provide a copy of the report to any
				individual for a charge that shall not exceed the cost of providing the copy;

								</clause><clause id="H56B7F13AF1A6425F818FA428BC71BCF"><enum>(ii)</enum><text>to
				the appropriate committees of Congress.</text>
								</clause></subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</clause></subparagraph><subparagraph id="H0F8FFD9950CC47C3BE58F68292A7A60"><enum>(C)</enum><text>in paragraph (10),
			 by striking <quote>of Health.</quote> and inserting <quote>of Health and the
			 National Institutes of Health may accept transfers of funds from the
			 Foundation.</quote>; and</text>
				</subparagraph></paragraph><paragraph id="H1B855562C8F74F59B3C56F57048F6F11"><enum>(3)</enum><text>by striking
			 subsection (l) and inserting the following:</text>
				<quoted-block id="HF38C10FB0BA64F44B6FF7F66ED31FB1C">
					<subsection id="H338F954B98A5402F00AAE8F07F96B9C"><enum>(l)</enum><header>Funding</header><text>From
				amounts appropriated to the National Institutes of Health, for each fiscal
				year, the Director of NIH shall transfer not less than $500,000 and not more
				than $1,250,000 to the

			</paragraph></section><section id="H28C463B8BE2E4EB1001654E237001B7F"><enum>8.</enum><header>Applicability</header><text display-inline="no-display-inline">This Act and the amendments made by this Act
			 apply only with respect to amounts appropriated for fiscal year 2007 or
			 subsequent fiscal years.</text>
