<section id="H6E9485BD5A42463F8DD0DBFFD227E959"><enum>101.</enum><header>Ranchman’s Camp land exchange, Lincoln National Forest, New Mexico</header> 
<subsection id="H41C15E98618041018CFBE02F8D4E7F3B"><enum>(a)</enum><header>Conveyance authorized</header><text display-inline="yes-display-inline">If the owners of Ranchman’s Camp, New Mexico, offer to convey to the United States all right, title, and interest of the owners in and to the non-Federal land depicted for exchange on the map entitled <quote>Ranchman’s Camp Land Exchange</quote> and dated June 3, 2006, the Secretary of Agriculture may accept title to the land on behalf of the United States and convey in exchange to the owners all right, title, and interest of the United States in and to the Federal land in the Lincoln National Forest depicted for exchange on such map.</text> </subsection> 
<subsection id="HFF180FDBE17D4EC49890D5FA20BB16A8"><enum>(b)</enum><header>Easements</header><text>Simultaneously with the exchange of Federal land and non-Federal land under subsection (a), the Secretary and the owners of Ranchman’s Camp shall exchange, at no additional consideration, nonexclusive reciprocal easements for access and utilities across, over, and through Forest Road 105, as depicted on the map referred to in such subsection.</text> </subsection> 
<subsection id="H09E3FB71F2024B5DABF8E426A9ECBE1F"><enum>(c)</enum><header>Treatment of map</header><text display-inline="yes-display-inline">The map referred to in subsection (a) shall be available for inspection in the Office of the Chief of the Forest Service and the Office of the Supervisor of Lincoln National Forest during the period beginning on the date of the enactment of this Act until one year after completion of the land exchange authorized by such subsection.</text> </subsection> 
<subsection id="H1F93A8313D95464992509B27BD5CE5F1"><enum>(d)</enum><header>Completion</header><text display-inline="yes-display-inline">To the extent practicable, the Secretary shall complete the land exchange authorized by subsection (a) not later than 180 days after the date on which the owners of Ranchman’s Camp make the offer described in such subsection, unless the Secretary and the owners agree to extend such deadline.</text> </subsection></section> 
<section id="HF8C8DF62F2534B44A04E5B00AF96FF21"><enum>102.</enum><header>C Bar X Ranch land exchange, Lincoln National Forest, New Mexico</header> 
<subsection display-inline="no-display-inline" id="H0486C60E19394EDAA50097B4235F869D"><enum>(a)</enum><header>Conveyance authorized</header><text display-inline="yes-display-inline">If the owners of C Bar X Ranch, New Mexico, offer to convey to the United States all right, title, and interest of the owners in and to the non-Federal land depicted for exchange on the map entitled <quote>C Bar X Ranch Land Exchange</quote> and dated June 3, 2006, the Secretary of Agriculture may accept title to the land on behalf of the United States and convey in exchange to the owners all right, title, and interest of the United States in and to the Federal land in the Lincoln National Forest depicted for exchange on such map.</text> </subsection> 
<subsection id="HA054818985FC4A98A948E1B91D209EEC"><enum>(b)</enum><header>Easements</header><text display-inline="yes-display-inline">Simultaneously with the exchange of Federal land and non-Federal land under subsection (a), the Secretary and the owners of C Bar X Ranch shall exchange, at no additional consideration, nonexclusive reciprocal easements for access and utilities across, over, and through Forest Road 488 and Forest Road 105, as depicted on the map referred to in such subsection.</text> </subsection> 
<subsection id="H1A21935827F14D0FBF13DDA42B863CBC"><enum>(c)</enum><header>Treatment of map</header><text display-inline="yes-display-inline">The map referred to in subsection (a) shall be available for inspection in the Office of the Chief of the Forest Service and the Office of the Supervisor of Lincoln National Forest during the period beginning on the date of the enactment of this Act until one year after completion of the land exchange authorized by such subsection.</text> </subsection> 
<subsection id="H6E0F4205431C4C02A1B6223F6F5C9DF5"><enum>(d)</enum><header>Completion</header><text display-inline="yes-display-inline">To the extent practicable, the Secretary shall complete the land exchange authorized by subsection (a) not later than 180 days after the date on which the owners of C Bar X Ranch make the offer described in such subsection, unless the Secretary and the owners agree to extend such deadline.</text> </subsection></section> 
<section id="H2FA41876A973460A914389D7DD7DB700"><enum>103.</enum><header>Provisions applicable to both land exchanges</header> 
<subsection id="H0F5B512915234F9FA3B9E6E24F87959C"><enum>(a)</enum><header>Exchange processing</header><text display-inline="yes-display-inline">Numerous surveys, clearances, reviews for threatened and endangered species, and reviews of cultural and historical resources have been conducted with regard to the land authorized for exchange under this title. There is no need to conduct additional duplicate studies or surveys to complete the land exchanges.</text> </subsection> 
<subsection id="HC2B1C264D31640C58842F4830600FFD1"><enum>(b)</enum><header>Final maps and descriptions</header><text display-inline="yes-display-inline">The exact acreage and legal description of the land authorized to be exchanged under this title shall be more particularly delineated and described by the Secretary of the Interior according to a final boundary map and boundary description, which shall be filed in the Office of the Chief of the Forest Service.</text> </subsection> 
<subsection id="HD18AF8385C1747C7A1C4F285BD9F434B"><enum>(c)</enum><header>Equal value exchange</header> 
<paragraph id="HC8D0CAE55EF2431694FBF300E66D77A2"><enum>(1)</enum><header>Equal value exchange required</header><text>The market value of the Federal land and non-Federal land covered by each land exchange authorized by this title shall be equal or equalized as provided by subsection (d) or by adjusting the acreage to be conveyed in the land exchange, as determined by the Secretary and agreed to by the private land owners.</text> </paragraph> 
<paragraph id="HBD48BC3C60F14670903B00D4BDF4CE39"><enum>(2)</enum><header>Appraiser qualifications</header><text display-inline="yes-display-inline">The appraisal of the land authorized to be exchanged under this title shall be conducted by an appraiser with the following minimum qualifications:</text> 
<subparagraph id="H7D4579A1E995457FBCD5A413C07E34"><enum>(A)</enum><text>Licensed New Mexico real estate appraiser.</text> </subparagraph> 
<subparagraph id="HF1A223A75DFB45D8B659D8C6D12DC854"><enum>(B)</enum><text>Certified New Mexico real estate appraiser.</text> </subparagraph> 
<subparagraph id="H2A92EBD533C649B19613FDF0A37300CD"><enum>(C)</enum><text>Accredited rural appraiser.</text> </subparagraph></paragraph> 
<paragraph id="H09544621C94A475200A4C74597004482"><enum>(3)</enum><header>Costs of appraisal; other costs</header><text display-inline="yes-display-inline">The owners of the non-Federal land to be exchanged under this title shall cover the costs of the land appraisal. The private land owners and the Secretary shall each pay half of any additional costs.</text> </paragraph></subsection> 
<subsection id="HA1B36F9B912548B8AD70A8A41BEACBAC"><enum>(d)</enum><header>Cash equalization</header> 
<paragraph id="H4FBDE4A731A84635AD2057D1E55500B8"><enum>(1)</enum><header>Authorized amount</header><text>Notwithstanding section 206(b) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1716">43 U.S.C. 1716(b)</external-xref>), the Secretary may accept a cash equalization payment in excess of 25 percent of the total value of the Federal land conveyed by the Secretary under section 101 or 102.</text> </paragraph> 
<paragraph id="H3E91257E9C164DAA9294C09C147CDD1B"><enum>(2)</enum><header>Deposit and use</header><text display-inline="yes-display-inline">Any cash equalization payment received by the Secretary under this section shall be deposited into a fund established under the Act of December 4, 1967 (commonly known as the Sisk Act; <external-xref legal-doc="usc" parsable-cite="usc/16/484a">16 U.S.C. 484a</external-xref>). The deposited amounts shall be available to the Secretary, until expended and without further appropriation, for the acquisition of lands and interest in land in New Mexico and associated administrative costs. Such amounts shall not be subject to transfer or reprogramming for wildland fire management or any other emergency purposes.</text> </paragraph></subsection> 
<subsection id="HAA6ACE139FA944EEA685545F80EC6DB1"><enum>(e)</enum><header>Title</header><text display-inline="yes-display-inline">Title to the non-Federal land to be acquired by the United States under this title shall be acceptable to the Secretary and in conformity with the title standards of the Attorney General. Title to the Federal land shall be conveyed under this title by patent.</text> </subsection> 
<subsection id="HD2B96EC8CA344C63B1020616C845B3D3"><enum>(f)</enum><header>Completion</header><text>To the extent practicable, the Secretary shall complete the land exchange authorized by subsection (a) not later than 180 days after the date of enactment, unless the Secretary and the owners of the non-Federal lands, respectively, agree to extend such deadline.</text> </subsection> 
<subsection id="HC6D2C48311724C3CBC40F6C7011157A"><enum>(g)</enum><header>Revocations and withdrawal</header> 
<paragraph id="H74A0043FA36D46059D72B16B58156011"><enum>(1)</enum><header>Revocation</header><text>Any public land orders withdrawing any of the Federal land from appropriation or disposal under the public land laws are revoked to the extent necessary to permit conveyance of the Federal land under this title.</text> </paragraph> 
<paragraph id="H276951552B3448389700F5E9F9730804"><enum>(2)</enum><header>Withdrawal</header><text>Subject to valid existing rights, pending the completion of the land exchanges authorized by this title, the Federal land identified for conveyance are withdrawn from all forms of location, entry, and patent under the mining and public land laws, and from disposition under the mineral leasing laws and the Geothermal Steam Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/30/1001">30 U.S.C. 1001 et seq.</external-xref>).</text> </paragraph></subsection> 
<subsection id="HE08F16021815408398C3E47565ABE7F5"><enum>(h)</enum><header>Valid existing rights</header><text>The conveyance of any Federal land under this title shall be subject to valid existing rights, and to such terms and conditions as the Secretary considers are in the public interest and agreed to by the private land owners.</text> </subsection> 
<subsection id="H3F3C571F31C043E7AF5D7E6724631308"><enum>(i)</enum><header>Administration</header><text>The Secretary shall manage the land acquired by the United States under this title in accordance with the Act of March 1, 1911 (commonly known as the Weeks Act; <external-xref legal-doc="usc" parsable-cite="usc/16/480">16 U.S.C. 480 et seq.</external-xref>), and in accordance with the other laws and regulations applicable to the National Forest System.</text> </subsection></section></title> 
<title id="H3A5EEC4C73CD43DE8F088F254048B756"><enum>II</enum><header>Boundary Adjustment</header> 
<section id="HF488C5487C2E4FFC92FA8B79BFFDABC7"><enum>201.</enum><header>Proclamation boundary defined</header><text display-inline="no-display-inline">In this title, the term <quote>Proclamation Boundary</quote> means the exterior limits of the Lincoln National Forest in the State of New Mexico established by Presidential Proclamation 32 (32 Stat. 2018) signed by President Theodore Roosevelt on July 26, 1902, and subsequently modified by Presidential Proclamation 1474 (40 Stat. 1832), signed by President Woodrow Wilson on August 9, 1918.</text> </section> 
<section id="H97F43791F1E84FD6A8C5E4343F3C2466"><enum>202.</enum><header>Lincoln National Forest proclamation boundary adjustment</header> 
<subsection id="H2545E740799A4FCEBC22D00FB6D18B9"><enum>(a)</enum><header>Modification</header><text>The 1902 Proclamation Boundary of the Lincoln National Forest is modified in section 20, township 7 south, range 16 east, New Mexico principal meridian to include only the NE<fraction>¼</fraction>NE<fraction>¼</fraction> of such section, thereby excluding all non-National Forest System lands in such section as of the date of the enactment of this Act.</text> </subsection> 
<subsection id="H65F2C972A497495698FF417EA200268D"><enum>(b)</enum><header>Availability</header><text>To reflect the boundary adjustment effected by subsection (a), a legal land description signed and approved by the Regional Forester, Albuquerque, New Mexico, shall be on file and available for public inspection in the Office of the Chief of the Forest Service and the office of the Regional Forester, Albuquerque, New Mexico.</text> </subsection> 
<subsection id="H67C63B158C9F48C1A9FDA31F0885626F"><enum>(c)</enum><header>Correction authority</header><text>The Secretary of Agriculture may make minor technical and clerical corrections to the legal description to facilitate the boundary adjustment.</text> </subsection></section> 
<section id="HCE6ECE45ACB14B85B6B4001E347BFA2C"><enum>203.</enum><header>Miscellaneous provisions</header> 
<subsection id="HEFF1619C15984EEABE77D79BD21110D1"><enum>(a)</enum><header>Administration</header><text>Any and all land or interests in land remaining within the boundaries of the Lincoln National Forest shall be managed for National Forest System purposes in accordance with—</text> 
<paragraph id="H414643FEFB314825BCB9582103299D"><enum>(1)</enum><text>the Act of March 1, 1911 (commonly known as the Weeks Act; <external-xref legal-doc="usc" parsable-cite="usc/16/480">16 U.S.C. 480 et seq.</external-xref>); and</text> </paragraph> 
<paragraph id="HF2D76874EF904257B5DE39FA6EA8E3CB"><enum>(2)</enum><text>the laws and regulations applicable to the National Forest System.</text> </paragraph></subsection> 
<subsection id="HC7353A5E28964C74AA643BF65166B7A9"><enum>(b)</enum><header>Land and water conservation fund</header><text>For purposes of section 7 of the Land and Water Conservation Fund Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/16/460l-9">16 U.S.C. 460l–9</external-xref>), the boundaries of the Lincoln National Forest, as adjusted by this title, shall be considered to be the boundaries of the national forest as of January 1, 1965.</text> </subsection> 
<subsection id="HD662B9F38AD442148917F29F248F4E17"><enum>(c)</enum><header>Effect</header><text>Nothing in this Act limits the authority of the Secretary of Agriculture to adjust the boundaries of the Lincoln National Forest under section 11 of the Act of March 1, 1911 (<external-xref legal-doc="usc" parsable-cite="usc/16/521">16 U.S.C. 521</external-xref>).</text> </subsection></section></title>
