		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Gulf Coast Housing Accessibility
			 Act of 2006</short-title></quote>.</text>
		</section><section id="IDc2649fb7b2d24b0cabedc35f80b32403"><enum>2.</enum><header>Project-based
			 vouchers</header>
			<subsection id="ID1b4d6f470e0d47c5a5d0a086dc1ccb08"><enum>(a)</enum><header>In
			 general</header><text>The Secretary of Housing and Urban Development (in this
			 Act referred to as the <quote>Secretary</quote>) shall allocate additional
			 assistance for project-based housing vouchers under section 8(o)(13) of the
			 United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f(o)(13)</external-xref>) for individuals and
			 households located within the area in which assistance to individuals has been
			 authorized by the President under a declaration of a major disaster under the
			 Robert T. Stafford Disaster Relief and Emergency Assistance Act, as a
			 consequence of Hurricane Katrina, Rita, or Wilma of 2005.</text>
			</subsection><subsection id="IDfa29b62db73742c3be0dd3d3ba9425ba"><enum>(b)</enum><header>Authorized
			 uses</header><text>The Secretary shall make funds available under this section
			 for project-based vouchers used to support—</text>
				<paragraph id="ID618a8904102c496fa6614f8e781af6cf"><enum>(1)</enum><text>affordable
			 housing in repaired or rebuilt housing that has been damaged or destroyed as a
			 consequence of Hurricane Katrina, Rita, or Wilma of 2005; or</text>
				</paragraph><paragraph commented="no" id="ID711c7a4cab37433ca864de9dea13d55b"><enum>(2)</enum><text>to support
			 affordable housing in new housing structures in the affected areas created
			 under the low income housing tax credit under section 42 or section 1400N(c) of
			 the Internal Revenue Code of 1986.</text>
				</paragraph></subsection><subsection id="IDabb47c13b86f4bd584874ebc5c52d172"><enum>(c)</enum><header>Funds</header>
				<paragraph id="idF7EF676BD74E4FC48BF9E84193842299"><enum>(1)</enum><header>In
			 general</header><text>Of amounts authorized under this section, funds shall be
			 made available for 4,500 project-based vouchers for—</text>
					<subparagraph id="ID7191ccdb835b41d1ab45047cc2ce30e0"><enum>(A)</enum><text>support of
			 housing units for persons, including adults and children, with
			 disabilities;</text>
					</subparagraph><subparagraph id="IDf2c5a6a1a7c34f83b0122a758315a873"><enum>(B)</enum><text>elderly families;
			 and</text>
					</subparagraph><subparagraph id="ID5a2f9e62465c48fda2562862262d4674"><enum>(C)</enum><text>individuals and
			 families who were homeless prior to the occurrence of the disaster.</text>
					</subparagraph></paragraph><paragraph id="id5E4F6EDAFE14407C86A37D046D8B27BD"><enum>(2)</enum><header>Definitions</header><text>As
			 used in this subsection:</text>
					<subparagraph id="idBB0F35362FDF48A182EE10C510301FB2"><enum>(A)</enum><header>Disability</header><text>The
			 term <quote>disability</quote> has the same meaning as in section 422(2) of the
			 McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11382">42 U.S.C. 11382(2)</external-xref>).</text>
					</subparagraph><subparagraph id="id108AE6C33C8847109359E8497EC8D9A3"><enum>(B)</enum><header>Homeless</header><text>The
			 term <quote>homeless</quote> has the same meaning as the term <quote>homeless
			 children and youths</quote> as defined in section 725(2) of the McKinney-Vento
			 Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11434a">42 U.S.C. 11434a(2)</external-xref>), except that such term shall also
			 include any adult individual who is homeless.</text>
					</subparagraph></paragraph></subsection><subsection id="ID17c0ea9db98a461f9421b12cc729b766"><enum>(d)</enum><header>Requests for
			 assistance</header><text>The Secretary shall award the project-based vouchers
			 authorized under this section to a State agency designated by the Governor of
			 the State, upon submission of a request to the Secretary, in such form and
			 containing such information as the Secretary may require. If a State agency is
			 unable to provide such a request, a local housing agency may submit the request
			 for funds to implement project-based vouchers under this section. If a State
			 agency enters into an agreement with 1 or more local housing agencies to
			 transfer the administration of vouchers after commitment to a particular
			 development, the Secretary shall make the appropriate transfer.</text>
			</subsection><subsection id="IDfbdf3637f82942f9bce889d090c22a89"><enum>(e)</enum><header>Exemption from
			 certain limitations</header><text>The limitation provided for in section
			 8(o)(13)(B) of the United States Housing Act of 1937 (42 U.S.C.
			 1437f(o)(13)(B)) shall not apply to the project-based vouchers allocated and
			 administered under this section.</text>
			</subsection><subsection id="IDca5a0f639c5144358d730d176d9e749f"><enum>(f)</enum><header>Authorization
			 of funds</header>
				<paragraph id="id7A49558D1A9446608A62DE2CDEEDB220"><enum>(1)</enum><header>In
			 general</header><text>There are authorized to be appropriated to the Secretary
			 $200,000,000 for purposes of allocating and administering project-based
			 assistance under section 8(o)(13) of the United States Housing Act of 1937 (42
			 U.S.C. 1437f(o)(13)), which shall remain available until expended.</text>
				</paragraph><paragraph id="IDb54fdc50d23d440e960fb92e0e0bfe22"><enum>(2)</enum><header>Purpose</header><text>Such
			 funds are authorized for the purpose of ensuring that 25 percent of the units
			 created, repaired, or refurbished under the low income housing tax credit under
			 section 42 or <external-xref legal-doc="usc" parsable-cite="usc/26/1400N">section 1400N(c)</external-xref> of the Internal Revenue Code of 1986, are
			 affordable to very low-income and extremely low-income individuals and
			 households.</text>
				</paragraph></subsection><subsection id="IDd9b69cd41aa4460da61c7de462e6edd6"><enum>(g)</enum><header>Effective
			 date</header><text>This section shall become effective upon appropriation of
			 the necessary funds to carry out this section.</text>
			</subsection><subsection id="ID8f62d697128845c5b9042869e0e96a55"><enum>(h)</enum><header>Offset</header><text>Section
			 843(a) of title 18, United States Code, is amended by—</text>
				<paragraph id="id3898792CAADA4D698F128448CEFB49A0"><enum>(1)</enum><text>inserting
			 <quote>(1)</quote> after <quote>(a)</quote>; and</text>
				</paragraph><paragraph id="idBEB98ECC30C34A959D127687354D6510"><enum>(2)</enum><text>adding at the end
			 the following:</text>
					<quoted-block display-inline="no-display-inline" id="id5104B0704C87468EA23C539240F4E25F" style="OLC">
						<subsection id="idFF970CB4F6F246BA81EC93B18A408339"><enum>(2)</enum><text>The Attorney
				General shall collect a user fee from each licensee under this section of $0.02
				per pound for any commercial, non-military explosive material manufactured in
				or imported into the United States by that
				licensee.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="IDf3edfc3343da453e8de6d6c66a36b18f"><enum>3.</enum><header>FEMA housing
			 assistance</header>
			<subsection id="ID99ddae834d684800b2c859a701bc6c24"><enum>(a)</enum><header>Amendments to
			 Stafford Disaster Relief and Emergency Assistance Act</header><text>Section
			 408(c)(1) of the Robert T. Stafford Disaster Relief and Emergency Assistance
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5174">42 U.S.C. 5174(c)(1)</external-xref>) is amended—</text>
				<paragraph id="ID062d0695b8e449f38d1f72ba00f7c45c"><enum>(1)</enum><text>in the paragraph
			 heading, by inserting <quote><header-in-text level="paragraph" style="OLC">semipermanent, and permanent</header-in-text></quote> after
			 <quote><header-in-text level="paragraph" style="OLC">temporary</header-in-text></quote>; and</text>
				</paragraph><paragraph id="ID072008305fa442e48d78837767dbc07c"><enum>(2)</enum><text>in subparagraph
			 (B)</text>
					<subparagraph id="id70BCB3684CE241C083E34F35BB84499B"><enum>(A)</enum><text>in clause
			 (i)—</text>
						<clause id="id7D8610C9DFA24128BB0F4983B31ADB55"><enum>(i)</enum><text>by
			 inserting <quote>semipermanent, and permanent</quote> after
			 <quote>temporary</quote>; and</text>
						</clause><clause id="id2C8E8621CDD347C38C523924EA2512CB"><enum>(ii)</enum><text>by
			 inserting <quote>subject to certain conditions outlined below</quote> after
			 <quote>units</quote>;</text>
						</clause></subparagraph><subparagraph id="IDc9fcdc95a48f477eb4f385b0cae46ed2"><enum>(B)</enum><text>by redesignating
			 clauses (ii) and (iii) as clauses (iii) and (iv), respectively; and</text>
					</subparagraph><subparagraph id="IDc6db6d00830c43faba02ec3438755905"><enum>(C)</enum><text>by inserting
			 after clause (i) the following:</text>
						<quoted-block display-inline="no-display-inline" id="id261A0E68049643FA89230350B457BC2F" style="OLC">
							<clause id="id30BD883C4CBA461BBF48B7605CDFA9BF"><enum>(ii)</enum><header>Conditions for
				providing temporary, semipermanent, and permanent housing units</header>
								<subclause id="id0E1448E5B38F456DB7DD12EB8EEEACB0"><enum>(I)</enum><header>In
				general</header><text>When determining whether to provide temporary,
				semipermanent, or permanent housing under clause (i), the President shall
				examine certain conditions, including—</text>
									<item id="ID6c29f3d355504e46ba9788904a5b6c99"><enum>(aa)</enum><text>the relative
				cost efficiency of providing the housing units;</text>
									</item><item id="ID31d34702d77345168c90a3247920dc2f"><enum>(bb)</enum><text>the likelihood
				that individuals and families will be living in Federal Emergency Management
				Agency (in this subparagraph referred to as <quote>FEMA</quote>) assisted
				housing longer than 3 to 6 months, due to the scope of the disaster where
				individuals and households are located;</text>
									</item><item id="id1F510C84125B44FDA3D4AB865E7FF8B2"><enum>(cc)</enum><text>the potential
				benefits of providing housing that will help to restore permanent housing stock
				lost as a result of the disaster; and</text>
									</item><item id="IDcb1837180995402aa14138a510777964"><enum>(dd)</enum><text>any other
				conditions that the President deems necessary to examine, depending on the
				scope of the disaster and the subsequent rebuilding and recovery
				process.</text>
									</item></subclause><subclause id="IDd1cbac035aff4a64ad9295773e9b575f"><enum>(II)</enum><header>Meeting
				needs</header><text>When providing temporary, semipermanent, or permanent
				housing units under clause (i), the President shall ensure that—</text>
									<item id="ID6952d4a2e9954b858aad3f3f143b21d7"><enum>(aa)</enum><text>an
				adequate share of the housing units will be deployed to meet the needs of
				predisaster renters, especially low-income households;</text>
									</item><item id="ID112f185fc4ef47979b22d95c86f35683"><enum>(bb)</enum><text>that the
				deployment of the housing units will minimize the concentration of
				poverty;</text>
									</item><item id="ID5a70063b39fb4aa49eac1d94c999ed0b"><enum>(cc)</enum><text>that an adequate
				share of the housing units is accessible for persons with disabilities, as that
				term is defined in section 422(2) of the McKinney-Vento Homeless Assistance Act
				(<external-xref legal-doc="usc" parsable-cite="usc/42/11382">42 U.S.C. 11382(2)</external-xref>); and</text>
									</item><item id="id04C4EBF6EA854F9A962802B60AEFCE0E"><enum>(dd)</enum><text>the housing
				units will be placed within a reasonable distance from needed services, such as
				access to transportation, employment opportunities, health care facilities,
				schools, day care services, and financial and employment
				counseling.</text>
									</item></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection id="IDeba48e9556d649b58b92c6a21a4ab82b"><enum>(b)</enum><header>Effective
			 date</header><text>This section and the amendments made by this section shall
			 apply with respect to individuals and households affected—</text>
				<paragraph id="id19A52825727F414D842EC2BEE029CE67"><enum>(1)</enum><text>by a disaster to
			 which section 408(c)(1) of the Robert T. Stafford Disaster Relief and Emergency
			 Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5174">42 U.S.C. 5174(c)(1)</external-xref>) would otherwise apply, occurring on or
			 after the date of enactment of this Act; and</text>
				</paragraph><paragraph id="idAEF801E4DCBA4879AA06ACFE358E7A3E"><enum>(2)</enum><text>by the
			 consequences of Hurricanes Katrina, Rita, and Wilma of 2005.</text>
				</paragraph></subsection></section><section id="idB7F8C5D97F90485D832FB9ADC40E967C"><enum>4.</enum><header>Transfer of
			 temporary rental assistance</header>
			<subsection id="idF8AAB2D4D73649C58C17C48E9C821E63"><enum>(a)</enum><header>In
			 general</header><text>The Director of the Federal Emergency Management Agency
			 (in this section referred to as the <quote>Director</quote> and
			 <quote>FEMA</quote>, respectively) shall enter into a mission assignment with
			 the Secretary to transfer adequate funds from FEMA Disaster Relief Funds into
			 the Disaster Voucher Program at the Department of Housing and Urban Development
			 in order to fully implement subsection (b).</text>
			</subsection><subsection id="idE74AD4E94AB44E5F91D33A9BE59328A1"><enum>(b)</enum><header>Transfers</header><text>The
			 Director shall ensure that the following individuals and households are
			 transferred into the Disaster Voucher Program:</text>
				<paragraph id="idC3A89141681746D1937503146D57A70A"><enum>(1)</enum><text>Individuals and
			 households receiving assistance through FEMA's transitional housing program
			 authorized under section 408 of the Robert T. Stafford Disaster Relief and
			 Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5174">42 U.S.C. 5174</external-xref>) .</text>
				</paragraph><paragraph id="id8F1987C02ABC4CC6A776DD4FFB4444A9"><enum>(2)</enum><text>Individuals and
			 households receiving assistance through—</text>
					<subparagraph id="id101E6C7D4985444FA87C4C29D8E8834E"><enum>(A)</enum><text>rental assistance
			 programs administered through State and local voucher programs that receive
			 reimbursement from FEMA; or</text>
					</subparagraph><subparagraph id="id7BA908DBCCE24C8CAF0655C9F653FAAC"><enum>(B)</enum><text>any other program
			 authorized under section 403 of the Robert T. Stafford Disaster Relief and
			 Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170b">42 U.S.C. 5170b</external-xref>).</text>
					</subparagraph></paragraph></subsection><subsection id="id3D8216D174F7427DBB9DA54CC7432053"><enum>(c)</enum><header>State and local
			 governments</header><text>FEMA shall work with State and local governments, as
			 well as private entities providing services, to ensure that proper notice and
			 assistance is provided to individuals and households, while the transfer under
			 this section is completed.</text>
			</subsection><subsection id="idEF6677FDCD7D4F49B7888738E292C332"><enum>(d)</enum><header>Opt-out
			 provision</header><text>Individuals and families receiving FEMA housing
			 assistance under subsection (b) may opt-out of the transfer to the Disaster
			 Voucher Program authorized in subsection (a).</text>
			</subsection><subsection id="id5CDBBFA2BE2F4C5B8E728F6FCF057B62"><enum>(e)</enum><header>Applicability</header><text>This
			 section shall apply with respect to individuals and households affected—</text>
				<paragraph id="id780FC4A4BF384103AE678861BE4E27F8"><enum>(1)</enum><text>by a disaster
			 occurring on or after the date of enactment of this Act; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9B18EA93A7214EBF9B0D80565AA6E673"><enum>(2)</enum><text>by the
			 consequences of Hurricanes Katrina, Rita, and Wilma of 2005.</text>
				</paragraph></subsection></section></legis-body>
