<section section-type="section-one" id="H78793A2987694D3FB9A65F5A9F9CF03" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Alcohol Without Liquid Machine Safety Act of 2005</short-title></quote>.</text></section> 
<section id="HC097FD88C3F34144854C685BD336C687"><enum>2.</enum><header>Alcohol without liquid machines</header> 
<subsection id="H4F3A230B3D734AF5A0DF36F1C370A3F"><enum>(a)</enum><header>Prohibition</header><text>It shall be unlawful for any person to introduce or deliver for introduction into interstate commerce any alcohol without liquid machine, unless an approval of an application submitted pursuant to subsection (b) is in effect with respect to such machine.</text></subsection> 
<subsection id="HA8B18731977047AE8982A1C91421DEB2"><enum>(b)</enum><header>Application</header><text>Any person may file with the Commissioner an application for premarket approval of an alcohol without liquid machine. Such an application shall be submitted in such manner, and containing such information, as the Commissioner may require.</text></subsection> 
<subsection id="HA183BFCBB4F945828E536900E1E3C200"><enum>(c)</enum><header>Approval</header><text>Upon receipt of an application submitted pursuant to subsection (b), the Commissioner shall—</text> 
<paragraph id="H26BFA5F58CAE430FB1076B66006DD532"><enum>(1)</enum><text>issue an order approving the application if the person submitting the application demonstrates to the Commissioner’s satisfaction that the alcohol without liquid machine is safe; or</text></paragraph> 
<paragraph id="HF9765AABCAF443BD9639F9373505BAFE"><enum>(2)</enum><text>deny approval of the application if the person submitting the application fails to demonstrate to the Commissioner’s satisfaction that the alcohol without liquid machine is safe.</text></paragraph></subsection> 
<subsection id="H4FEDB090707241B4A7BB009915CAA116"><enum>(d)</enum><header>Withdrawal of approval</header><text>The Secretary may issue an order withdrawing approval of an application submitted pursuant to subsection (b) if the Secretary finds that the alcohol without liquid machine is unsafe.</text></subsection> 
<subsection id="H52A92C959BE74B25A7F4FC6EEC206EEE"><enum>(e)</enum><header>Penalty</header><text>The provisions of the <act-name parsable-cite="FFDCA">Federal Food, Drug, and Cosmetic Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/301">21 U.S.C. 301 et seq.</external-xref>) shall apply to a violation of subsection (a) in the same manner and to the same extent as such provisions apply to a violation of section 515 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/21/360e">21 U.S.C. 360e</external-xref>; regarding premarket approval of class III devices).</text></subsection> 
<subsection id="HADFFA0357AB6410B009275020056F19"><enum>(f)</enum><header>Definitions</header><text>For purposes of this Act:</text> 
<paragraph id="H0B97E6B3F624474F97DA212CB543189"><enum>(1)</enum><text>The term <term>alcohol without liquid machine</term> means a device designed or marketed for the purpose of mixing alcohol with oxygen or another gas to produce a mist for inhalation for recreational purposes.</text></paragraph> 
<paragraph id="HCC3524B571C24A2798E7180014797D45"><enum>(2)</enum><text>The term <term>Commissioner</term> means the Commissioner of Food and Drugs.</text></paragraph></subsection></section>
