		<official-title>To amend the Public Health Service Act to provide revised
		  standards for quality assurance in screening and evaluation of gynecologic
		  cytology preparations, and for other purposes.</official-title>

		<section id="HA8DBE7A460D5400DBFE35B012ECE3FDC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Cytology Proficiency Improvement Act
			 of 2006</short-title></quote>.</text>
		</section><section id="HD68EFA41DCC747DF801E6F1C4C6B39E6"><enum>2.</enum><header>Revised standards
			 for quality assurance in screening and evaluation of gynecologic cytology
			 preparations</header>
			<subsection id="H878FCA48AA214D7BA1DFF6D4FD444BD"><enum>(a)</enum><header>In
			 general</header><text>Section 353(f)(4)(B)(iv) of the Public Health Service Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/263a">42 U.S.C. 263a(f)(4)(B)(iv)</external-xref>) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H57B9566F283C4790BBF3E9E48400DF2F" style="OLC">
					<clause id="H99152EE3F19D4942999D6F20A508EC8"><enum>(iv)</enum><text>requirements that
				each clinical laboratory—</text>
						<subclause id="H61760F72356D451A944C93B2F54177B3"><enum>(I)</enum><text>ensure that all
				individuals involved in screening and interpreting cytological preparations at
				the laboratory participate annually in a continuing medical education program
				in gynecologic cytology that—</text>
							<item id="H57C7B7BC0C2C4AFDB308C9BEAF7DA54"><enum>(aa)</enum><text>is
				approved by the Accrediting Council for Continuing Medical Education or the
				American Academy of Continuing Medical Education, and</text>
							</item><item id="H8AD0D058B51B456084293FD6A6910D5"><enum>(bb)</enum><text>provides each
				individual participating in the program with gynecologic cytologic preparations
				(in the form of referenced glass slides or equivalent technologies) designed to
				improve the locator, recognition and interpretive skills of the individual,
				and</text>
							</item></subclause><subclause id="H275F0CF7E3C745B5A6B1E1008935DBED"><enum>(II)</enum><text>maintain a record
				of the cytology continuing medical education results of each individual
				involved in screening and interpreting cytological preparations at the
				laboratory,</text>
						</subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H13A166EE06074791AB3895AAF216B055"><enum>(b)</enum><header>Effective date
			 and implementation; termination of current program of individual proficiency
			 testing</header>
				<paragraph id="H67970C21605244DEA8FBDB53AF067EE6"><enum>(1)</enum><header>Effective date
			 and implementation</header><text>Except as provided in paragraph (2), the
			 amendment made by subsection (a) applies to gynecologic cytology services
			 provided on or after the date that is one year after the date of the enactment
			 of this Act, and the Secretary of Health and Human Services (hereafter in this
			 subsection referred to as the <quote>Secretary</quote>) shall issue final
			 regulations implementing such amendment not later than 270 days after such date
			 of enactment.</text>
				</paragraph><paragraph id="HD28B7E08A97149CB8186633260BDEF64"><enum>(2)</enum><header>Termination of
			 current individual proficiency testing program</header><text>As of the date of
			 the enactment of this Act, the Secretary shall terminate the individual
			 proficiency testing program established pursuant to section 353(f)(4)(B)(iv) of
			 the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/263a">42 U.S.C. 263a(f)(4)(B)(iv)</external-xref>), as in effect
			 before the enactment of this section.</text>
				</paragraph></subsection></section></legis-body>
