<paragraph id="HEDA0A28F72584A5483373F71F8A8C2CC"><enum>(1)</enum><header>Applied programs</header><text display-inline="yes-display-inline">The term <quote>applied programs</quote> means the research, development, demonstration, and commercial application programs of the Department concerning energy efficiency, renewable energy, nuclear energy, fossil energy, and electricity transmission and distribution.</text></paragraph> 
<paragraph id="H1B42DADC2D604AD4B3A548DB1FE8D206" display-inline="no-display-inline"><enum>(2)</enum><header>Biomass</header><text>The term <quote>biomass</quote> means—</text> 
<subparagraph id="HFA4EBB20403D4C55B030FCE7D427FCA3"><enum>(A)</enum><text>any organic material grown for the purpose of being converted to energy;</text></subparagraph> 
<subparagraph id="H8774CF1A20794F0F923622635D135FB0"><enum>(B)</enum><text>any organic byproduct of agriculture (including wastes from food production and processing) that can be converted into energy; or</text></subparagraph> 
<subparagraph id="H8E7279FE60E64A6B943B031F01E071D2"><enum>(C)</enum><text>any waste material that can be converted to energy, is segregated from other waste materials, and is derived from—</text> 
<clause id="HA9957941930D424694FDE9AB65D0726C"><enum>(i)</enum><text>any of the following forest-related resources: mill residues, precommercial thinnings, slash, brush, or otherwise nonmerchantable material; or</text></clause> 
<clause id="HCCFE2FB747C44C46982E3C13E2723228"><enum>(ii)</enum><text>wood waste materials, including waste pallets, crates, dunnage, manufacturing and construction wood wastes (other than pressure-treated, chemically-treated, or painted wood wastes), and landscape or right-of-way tree trimmings, but not including municipal solid waste, gas derived from the biodegradation of municipal solid waste, or paper that is commonly recycled.</text></clause></subparagraph></paragraph> 
<paragraph id="HB77971992EE34AD7A000F3005E7DEB5B"><enum>(3)</enum><header>Department</header><text>The term <quote>Department</quote> means the Department of Energy.</text></paragraph> 
<paragraph id="HB5357C3D665E474D91AB44CBE7E922E6"><enum>(4)</enum><header>Departmental mission</header><text>The term <quote>departmental mission</quote> means any of the functions vested in the Secretary of Energy by the Department of Energy Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7101">42 U.S.C. 7101 et seq.</external-xref>) or other law.</text></paragraph> 
<paragraph id="H0EDD8BB05F7944A4ACB3C8EE5C56A76E"><enum>(5)</enum><header>Institution of higher education</header><text>The term <quote>institution of higher education</quote> has the meaning given that term in section 101(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>).</text></paragraph>

<paragraph id="HF56275D18BFB4ADE98C8AB33CAC05F8" display-inline="no-display-inline"><enum>(9)</enum><header>State</header><text>The term <quote>State</quote> means any of the several States, the District of Columbia, the Commonwealth of Puerto Rico, the United States Virgin Islands, Guam, American Samoa, the Northern Mariana Islands, and any other commonwealth, territory, or possession of the United States. </text></paragraph> 
<paragraph id="H016D68C065F8422CBE8E922000F03446" display-inline="no-display-inline"><enum>(10)</enum><header>University</header><text>The term <quote>university</quote> has the meaning given the term <quote>institution of higher education</quote> in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>).</text></paragraph> 
<paragraph id="HEC74D81D11F54E6E9EEEE778DD58D074"><enum>(11)</enum><header>User facility</header><text>The term <quote>user facility</quote> means a research and development facility supported, in whole or in part, by Departmental funds that is open, at a minimum, to all qualified United States researchers.</text></paragraph></section>

<section id="HB2779283BC0F4062B4090091AE12B4A1" section-type="subsequent-section"><enum>101.</enum><header>Office of Science programs</header> 
<subsection id="H957EA5A41AFE4036963F5EE9C34DADCA"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall conduct, through the Office of Science, programs of research, development, demonstration, and commercial application in high energy physics and nuclear physics, biological and environmental research, basic energy sciences, advanced scientific and computing research, and fusion energy sciences, including activities described in this title. The programs shall include support for facilities and infrastructure, education, outreach, information, analysis, and coordination activities.</text></subsection> 
<subsection id="H48CA640262764BFEADA46500447135A0"><enum>(b)</enum><header>Rare isotope accelerator</header> 
<paragraph id="H2673EBA4BD3F4865AF15A6BFD2007BAE"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary shall construct and operate a Rare Isotope Accelerator. The Secretary shall commence construction no later than September 30, 2008.</text></paragraph> 
<paragraph id="H71734287077B4A88851445DA19F78052"><enum>(2)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated to the Secretary such sums as may be necessary to carry out this subsection. The Secretary shall not spend more than $1,100,000,000 for all activities associated with the Rare Isotope Accelerator prior to operation.</text></paragraph></subsection></section> 
<section id="H3959E4C3F0304E05BCB1C79FBACA9E3" display-inline="no-display-inline"><enum>102.</enum><header>Systems biology program</header> 
<subsection id="H86013F2BFD3B4EB89E5DAA1F00B05937"><enum>(a)</enum><header>Program</header> 
<paragraph id="H113B8FEC0FE8469FA1F7A65D86BB00C1"><enum>(1)</enum><header>Establishment</header><text>The Secretary shall establish a research, development, and demonstration program in genetics, protein science, and computational biology to support the energy, national security, and environmental missions of the Department.</text></paragraph> 
<paragraph id="HCA4FCA3D1FF7457D9713E370404596B7"><enum>(2)</enum><header>Grants</header><text>The program shall support individual researchers and multidisciplinary teams of researchers through competitive, merit-reviewed grants.</text></paragraph> 
<paragraph id="H487C2A3B01B1456CA9783CAF2D187924"><enum>(3)</enum><header>Consultation</header><text>In carrying out the program, the Secretary shall consult with other Federal agencies that conduct genetic and protein research.</text></paragraph></subsection> 
<subsection id="H8FE248BACFCA43DBB2FCD88E488E4DD7"><enum>(b)</enum><header>Goals</header><text>The program shall have the goal of developing technologies and methods based on the biological functions of genomes, microbes, and plants that—</text> 
<paragraph id="H70608E9AE5404009988753A493DD454B"><enum>(1)</enum><text>can facilitate the production of fuels, including hydrogen;</text></paragraph> 
<paragraph id="H18358F36C5F84FA7808E1600BBA7BA"><enum>(2)</enum><text>convert carbon dioxide to organic carbon;</text></paragraph> 
<paragraph id="HAE6DCDF467834D0FB7A9A8CC729718B"><enum>(3)</enum><text>detoxify soils and water, including at Departmental facilities, contaminated with heavy metals and radiological materials; and</text></paragraph> 
<paragraph id="H8BB2947CF3C74107AF165E20F8FA4940"><enum>(4)</enum><text>address other Department missions as identified by the Secretary.</text></paragraph></subsection> 
<subsection id="H9635BB6A2B014511001E5CEAA62B607B"><enum>(c)</enum><header>Plan</header> 
<paragraph id="H031E7CCF90ED4C72BEC195CCEEF16D79"><enum>(1)</enum><header>Development of plan</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary shall prepare and transmit to Congress a research plan describing how the program authorized pursuant to this section will be undertaken to accomplish the program goals established in subsection (b).</text></paragraph> 
<paragraph id="H0FA2D2E9AD6E424DBCC194E6C4752E8"><enum>(2)</enum><header>Review of plan</header><text>The Secretary shall contract with the National Academy of Sciences to review the research plan developed under this subsection. The Secretary shall transmit the review to Congress not later than 18 months after transmittal of the research plan under paragraph (1), along with the Secretary’s response to the recommendations contained in the review.</text></paragraph></subsection> 
<subsection id="HE7BD8F4069BD4C74B12CCEFD1300B800"><enum>(d)</enum><header>User facilities and ancillary equipment</header><text>Within the funds authorized to be appropriated pursuant to this title, the amounts specified under section 109(b)(1), (c)(1), (d)(1), (e)(1), and (f)(1) shall be available for projects to develop, plan, construct, acquire, or operate special equipment, instrumentation, or facilities, including user facilities, for researchers conducting research, development, demonstration, and commercial application in systems biology and proteomics and associated biological disciplines.</text></subsection> 
<subsection id="H43EDD4A1193E452180EAEECB12720000"><enum>(e)</enum><header>Prohibition on biomedical and human cell and human subject research</header> 
<paragraph id="H986653D7B833458DB7B991B28DD48CD0"><enum>(1)</enum><header>No biomedical research</header><text>In carrying out the program under this section, the Secretary shall not conduct biomedical research.</text></paragraph> 
<paragraph id="H5EF90DCDD1714D9F9B62CEEB09E43ECF"><enum>(2)</enum><header>Limitations</header><text>Nothing in this section shall authorize the Secretary to conduct any research or demonstrations—</text> 
<subparagraph id="HE8B3B20E417B4368A5863E7D005EF2AF"><enum>(A)</enum><text>on human cells or human subjects; or</text></subparagraph> 
<subparagraph id="HD41EE88350984EA59E9B31DABFC1205"><enum>(B)</enum><text>designed to have direct application with respect to human cells or human subjects.</text></subparagraph></paragraph></subsection></section> 
<section id="H125A73DDDFF54EA1963360BAC4A98700"><enum>103.</enum><header>Catalysis Research and Development Program</header> 
<subsection id="H59F98CA6E28F4A9DA8258FDFC17CD7D2"><enum>(a)</enum><header>Establishment</header><text>The Secretary shall conduct a program of research and development in catalysis science, including efforts to—</text> 
<paragraph id="H430EEA8D6B4B423E85316CC6B68BA1DA"><enum>(1)</enum><text>enable molecular-level catalyst design by coupling experimental and computational approaches;</text></paragraph> 
<paragraph id="HD15837592EAB47C1A274609CCFBAF699"><enum>(2)</enum><text> enable nanoscale, high-throughput synthesis, assay, and characterization; and</text></paragraph> 
<paragraph id="H717704A2FFFD47B8A603F2C22A6A17F"><enum>(3)</enum><text> synthesize catalysts with specific site architectures.</text></paragraph></subsection> 
<subsection id="H33C0EF84187A4F11BC647C52AB9E39AC"><enum>(b)</enum><header>Program activities</header><text>In carrying out the program under this section, the Secretary shall—</text> 
<paragraph id="HF8021C427323444EA8E18887C38CC95"><enum>(1)</enum><text>support both individual researchers and multidisciplinary teams of researchers to pioneer new approaches in catalytic design;</text></paragraph> 
<paragraph id="H54FDCC30BA2C4BFB8DA4CDA75B931C9C"><enum>(2)</enum><text>develop, plan, construct, acquire, or operate special equipment or facilities, including user facilities;</text></paragraph> 
<paragraph id="H810A42A08336494E86F87BCB9BC8B300"><enum>(3)</enum><text display-inline="yes-display-inline">support technology transfer activities to benefit industry and other users of catalysis science and engineering; and</text></paragraph> 
<paragraph id="HC065741A97904677832D2288225EF0CF"><enum>(4)</enum><text>coordinate research and development activities with industry and other Federal agencies.</text></paragraph></subsection></section> 
<section id="H10BC89FC74D945968EC2217943BF9F17"><enum>104.</enum><header>Hydrogen</header><text display-inline="no-display-inline">The Secretary shall conduct a program of fundamental research and development in support of programs authorized in title VII of this Act.</text></section> 
<section id="H4B91A8A117534A589D281810002CA178"><enum>105.</enum><header>Advanced scientific computing research</header><text display-inline="no-display-inline"> The Secretary shall conduct an advanced scientific computing research and development program, including in applied mathematics and the activities authorized by the Department of Energy High-End Computing Revitalization Act of 2004 (<external-xref legal-doc="usc" parsable-cite="usc/15/5541">15 U.S.C. 5541 et seq.</external-xref>). The Secretary shall carry out this program with the goal of supporting departmental missions and providing the high-performance computational, networking, and workforce resources that are required for world leadership in science.</text></section> 
<section id="HCE23D78F853548619DAFCF8BAFF22EE"><enum>106.</enum><header>Fusion Energy Sciences program</header> 
<subsection id="H230365B038134471AB0266659ECBC8F9"><enum>(a)</enum><header>Declaration of Policy</header><text>It shall be the policy of the United States to conduct research, development, demonstration, and commercial application to provide for the scientific, engineering, and commercial infrastructure necessary to ensure that the United States is competitive with other nations in providing fusion energy for its own needs and the needs of other nations, including by demonstrating electric power or hydrogen production for the United States energy grid utilizing fusion energy at the earliest date possible.</text></subsection> 
<subsection id="H5556532074084BD500113E3075B70072"><enum>(b)</enum><header>Planning</header> 
<paragraph id="H587E33EFAA924FBF84461B601BC1795F"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary shall transmit to Congress a plan, with proposed cost estimates, budgets, and lists of potential international partners, for the implementation of the policy described in subsection (a). The plan shall ensure that—</text> 
<subparagraph id="HB205916544E84856841510E238A92F08"><enum>(A)</enum><text> existing fusion research facilities are more fully utilized;</text></subparagraph> 
<subparagraph id="HDB5796FEDB124600B31F86D29D161248"><enum>(B)</enum><text>fusion science, technology, theory, advanced computation, modeling, and simulation are strengthened;</text></subparagraph> 
<subparagraph id="H01D12A0C60C6478ABCB48573D0000024"><enum>(C)</enum><text>new magnetic and inertial fusion research and development facilities are selected based on scientific innovation, cost effectiveness, and their potential to advance the goal of practical fusion energy at the earliest date possible, and those that are selected are funded at a cost-effective rate;</text></subparagraph> 
<subparagraph id="HFD3931AB59054B589408C040A22600BD"><enum>(D)</enum><text display-inline="yes-display-inline">communication of scientific results and methods between the fusion energy science community and the broader scientific and technology communities is improved;</text></subparagraph> 
<subparagraph id="H306C3C93A9BF4703B201007732F8C2C9"><enum>(E)</enum><text>inertial confinement fusion facilities are utilized to the extent practicable for the purpose of inertial fusion energy research and development; and</text></subparagraph> 
<subparagraph id="H69AEFFDCE1BA4FB78E5950B95B66B2C"><enum>(F)</enum><text>attractive alternative inertial and magnetic fusion energy approaches are more fully explored.</text></subparagraph></paragraph> 
<paragraph id="H5634174772ED4EEF84C175C1994D72A9"><enum>(2)</enum><header>Costs and schedules</header><text>Such plan shall also address the status of and, to the degree possible, costs and schedules for—</text> 
<subparagraph id="H3C2A963B9FB24335BF1BD926F58C33FD"><enum>(A)</enum><text>the design and implementation of international or national facilities for the testing of fusion materials; and</text></subparagraph> 
<subparagraph id="H17F06E35FFC541E9BF7039C918725B00"><enum>(B)</enum><text display-inline="yes-display-inline"> the design and implementation of international or national facilities for the testing and development of key fusion technologies. </text></subparagraph></paragraph></subsection> 
<subsection id="HB8EE41A6EA8C4B2A92EF30019A91456"><enum>(c)</enum><header>United States participation in ITER</header> 
<paragraph id="HC12AA949A9264BFDA630D3A4A964A787"><enum>(1)</enum><header>In general</header><text>The United States may participate in ITER only in accordance with this subsection.</text></paragraph> 
<paragraph id="H1D09853D18074D82AE6FCB24DF9E21E8"><enum>(2)</enum><header>Agreement</header> 
<subparagraph id="HE89833473DE1471C8E1E008D03A115D8"><enum>(A)</enum><header>In general</header><text>The Secretary is authorized to negotiate an agreement for United States participation in ITER.</text></subparagraph> 
<subparagraph id="H346832400ADE46B684162998CFA0175E"><enum>(B)</enum><header>Contents</header><text>Any agreement for United States participation in ITER shall, at a minimum—</text> 
<clause id="H6032A65DC78946AD9F22362ED2D13E00"><enum>(i)</enum><text display-inline="yes-display-inline">clearly define the United States financial contribution to construction and operating costs, as well as any other costs associated with the project;</text></clause> 
<clause id="H7334001938A243CDBC78430388B283F8"><enum>(ii)</enum><text>ensure that the share of ITER’s high-technology components manufactured in the United States is at least proportionate to the United States financial contribution to ITER;</text></clause> 
<clause id="H811AB39534AF4846A4F2F6F5AC59F28C"><enum>(iii)</enum><text>ensure that the United States will not be financially responsible for cost overruns in components manufactured in other ITER participating countries; </text></clause> 
<clause id="HF7B56AC1AAB34E3F84D9F239D0D298FD"><enum>(iv)</enum><text> guarantee the United States full access to all data generated by ITER;</text></clause> 
<clause id="HA50131BC8BA74B8AB7C3C94264A14408"><enum>(v)</enum><text>enable United States researchers to propose and carry out an equitable share of the experiments at ITER;</text></clause> 
<clause id="H1E80317B9B0943DA95467FEC6828263B"><enum>(vi)</enum><text>provide the United States with a role in all collective decisionmaking related to ITER; and</text></clause> 
<clause id="HF39BD0A2BD83459C9B7280C9012EB1BE"><enum>(vii)</enum><text>describe the process for discontinuing or decommissioning ITER and any United States role in that process.</text></clause></subparagraph></paragraph> 
<paragraph id="H156ADC9D3C934887A9273B023F9F96CD"><enum>(3)</enum><header>Plan</header><text>The Secretary, in consultation with the Fusion Energy Sciences Advisory Committee, shall develop a plan for the participation of United States scientists in ITER that shall include the United States research agenda for ITER, methods to evaluate whether ITER is promoting progress toward making fusion a reliable and affordable source of power, and a description of how work at ITER will relate to other elements of the United States fusion program. The Secretary shall request a review of the plan by the National Academy of Sciences.</text></paragraph> 
<paragraph id="H87F3171EEB95456597E4E64EA9574F99"><enum>(4)</enum><header>Limitation</header><text>No Federal funds shall be expended for the construction of ITER until the Secretary has transmitted to Congress—</text> 
<subparagraph id="H30EEC2FE1DF74078A129B545A4CB6012"><enum>(A)</enum><text> the agreement negotiated pursuant to paragraph (2) and 120 days have elapsed since that transmission;</text></subparagraph> 
<subparagraph id="HB15FE5A199754542ABEAE26655521100"><enum>(B)</enum><text>a report describing the management structure of ITER and providing a fixed dollar estimate of the cost of United States participation in the construction of ITER, and 120 days have elapsed since that transmission;</text></subparagraph> 
<subparagraph id="HFD8486922822459299D3C8814C28986"><enum>(C)</enum><text>a report describing how United States participation in ITER will be funded without reducing funding for other programs in the Office of Science, including other fusion programs, and 60 days have elapsed since that transmission; and</text></subparagraph> 
<subparagraph id="H19C33BED35F44787B3F915BB768F64D9"><enum>(D)</enum><text>the plan required by paragraph (3) (but not the National Academy of Sciences review of that plan), and 60 days have elapsed since that transmission.</text></subparagraph></paragraph> 
<paragraph id="H182E70F3AFDC496FB850DC77CDBE3C5B"><enum>(5)</enum><header>Alternative to ITER</header><text>If at any time during the negotiations on ITER, the Secretary determines that construction and operation of ITER is unlikely or infeasible, the Secretary shall send to Congress, as part of the budget request for the following year, a plan for implementing a domestic burning plasma experiment including costs and schedules for such a plan. The Secretary shall refine such plan in full consultation with the Fusion Energy Sciences Advisory Committee and shall also transmit such plan to the National Academy of Sciences for review.</text></paragraph> 
<paragraph id="H23774E9BE9CF447EB44261CEDFC37F9"><enum>(6)</enum><header>Definitions</header><text>In this subsection:</text> 
<subparagraph id="H8C304CDD20C041F6925EC0344689F1F"><enum>(A)</enum><header>Construction</header><text> The term <quote>construction</quote> means the physical construction of the ITER facility, and the physical construction, purchase, or manufacture of equipment or components that are specifically designed for the ITER facility, but does not mean the design of the facility, equipment, or components. </text></subparagraph> 
<subparagraph id="H4505D313DD2A4FFABDABA9DB4CC6D66"><enum>(B)</enum><header>ITER</header><text>The term <quote>ITER</quote> means the international burning plasma fusion research project in which the President announced United States participation on January 30, 2003, or any similar international project.</text></subparagraph></paragraph></subsection></section> 
<section id="HCE41A41649284452BBABDBB242F089E" display-inline="no-display-inline" section-type="subsequent-section"><enum>107.</enum><header>Science and Technology Scholarship Program</header> 
<subsection id="HD0CBB2E5EE8E4881B6C8BE256B3B1B3F"><enum>(a)</enum><header>Establishment of Program</header> 
<paragraph id="H343705B4273640F694D149A809738470"><enum>(1)</enum><header>In general</header><text>The Secretary is authorized to establish a Science and Technology Scholarship Program to award scholarships to individuals that is designed to recruit and prepare students for careers in the Department.</text></paragraph> 
<paragraph id="H169422DDF1244666A3AFCDA9CB19841E"><enum>(2)</enum><header>Competitive process</header><text>Individuals shall be selected to receive scholarships under this section through a competitive process primarily on the basis of academic merit, with consideration given to financial need and the goal of promoting the participation of individuals identified in section 33 or 34 of the Science and Engineering Equal Opportunities Act (42 U.S.C. 1885a or 1885b).</text></paragraph> 
<paragraph id="H2D7A024A5D3B4BD8911F31EA8C9DAA8"><enum>(3)</enum><header>Service agreements</header><text>To carry out the Program the Secretary shall enter into contractual agreements with individuals selected under paragraph (2) under which the individuals agree to serve as full-time employees of the Department, for the period described in subsection (f)(1), in positions needed by the Department and for which the individuals are qualified, in exchange for receiving a scholarship.</text></paragraph></subsection> 
<subsection id="H7F22EE8F3AF942F9B098D14875737F58"><enum>(b)</enum><header>Scholarship eligibility</header><text>In order to be eligible to participate in the Program, an individual must—</text> 
<paragraph id="H4A16C9F8A44D40F1928DA27DE040AC85"><enum>(1)</enum><text>be enrolled or accepted for enrollment as a full-time student at an institution of higher education in an academic program or field of study described in the list made available under subsection (d);</text></paragraph> 
<paragraph id="H401589E13DCE4673ABC5BE7D48069275"><enum>(2)</enum><text>be a United States citizen; and</text></paragraph> 
<paragraph id="HB8A6C28D9E594B359C3C2ECC5F8B55DD"><enum>(3)</enum><text>at the time of the initial scholarship award, not be a Federal employee as defined in <external-xref legal-doc="usc" parsable-cite="usc/5/2105">section 2105</external-xref> of title 5 of the United States Code.</text></paragraph></subsection> 
<subsection id="H357A62C2F1104D1998347F4C7576D0EC"><enum>(c)</enum><header>Application required</header><text>An individual seeking a scholarship under this section shall submit an application to the Secretary at such time, in such manner, and containing such information, agreements, or assurances as the Secretary may require.</text></subsection> 
<subsection id="H737ED33EE964491085F5F718BC653F01"><enum>(d)</enum><header>Eligible academic programs</header><text>The Secretary shall make publicly available a list of academic programs and fields of study for which scholarships under the Program may be utilized, and shall update the list as necessary.</text></subsection> 
<subsection id="H8CEDBED36FB0413C96E8B77066EA800"><enum>(e)</enum><header>Scholarship requirement</header> 
<paragraph id="HE75F5DA9AF75441481911354014E3C7B"><enum>(1)</enum><header>In general</header><text>The Secretary may provide a scholarship under the Program for an academic year if the individual applying for the scholarship has submitted to the Secretary, as part of the application required under subsection (c), a proposed academic program leading to a degree in a program or field of study on the list made available under subsection (d).</text></paragraph> 
<paragraph id="H5EBE5ED8CE244FAAB610DCBDA2A0FBEB"><enum>(2)</enum><header>Duration of eligibility</header><text>An individual may not receive a scholarship under this section for more than 4 academic years, unless the Secretary grants a waiver.</text></paragraph> 
<paragraph id="H8025D5F0A8704E900034D992F2338BBF"><enum>(3)</enum><header>Scholarship amount</header><text>The dollar amount of a scholarship under this section for an academic year shall be determined under regulations issued by the Secretary, but shall in no case exceed the cost of attendance.</text></paragraph> 
<paragraph id="HAC307DB97AB047F2A39E3000923F7174"><enum>(4)</enum><header>Authorized uses</header><text>A scholarship provided under this section may be expended for tuition, fees, and other authorized expenses as established by the Secretary by regulation.</text></paragraph> 
<paragraph id="HE2B9BE4F87F042969BB8922700B94D47"><enum>(5)</enum><header>Contracts regarding direct payments to institutions</header><text>The Secretary may enter into a contractual agreement with an institution of higher education under which the amounts provided for a scholarship under this section for tuition, fees, and other authorized expenses are paid directly to the institution with respect to which the scholarship is provided.</text></paragraph></subsection> 
<subsection id="H412E4A8125AB4F2ABF33B3964718CA80"><enum>(f)</enum><header>Period of obligated service</header> 
<paragraph id="H9C09A592026B43DA8542C1DDA7EABE98"><enum>(1)</enum><header>Duration of service</header><text>The period of service for which an individual shall be obligated to serve as an employee of the Department is, except as provided in subsection (h)(2), 24 months for each academic year for which a scholarship under this section is provided.</text></paragraph> 
<paragraph id="H913E2530C9D34E7683EFD00D5EB6F5E"><enum>(2)</enum><header>Schedule for service</header> 
<subparagraph id="H9B6FFE2DEF3F489C972646E61001466"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), obligated service under paragraph (1) shall begin not later than 60 days after the individual obtains the educational degree for which the scholarship was provided.</text></subparagraph> 
<subparagraph id="H6953509E77214935BE5BFFE900817169"><enum>(B)</enum><header>Deferral</header><text>The Secretary may defer the obligation of an individual to provide a period of service under paragraph (1) if the Secretary determines that such a deferral is appropriate. The Secretary shall prescribe the terms and conditions under which a service obligation may be deferred through regulation.</text></subparagraph></paragraph></subsection> 
<subsection id="H4728899D2C0F41ADA418BBE5CCA85230"><enum>(g)</enum><header>Penalties for breach of scholarship agreement</header> 
<paragraph id="H2EB9CF164EB94F9CA3267F2FE166BA39"><enum>(1)</enum><header>Failure to complete academic training</header><text>Scholarship recipients who fail to maintain a high level of academic standing, as defined by the Secretary by regulation, who are dismissed from their educational institutions for disciplinary reasons, or who voluntarily terminate academic training before graduation from the educational program for which the scholarship was awarded, shall be in breach of their contractual agreement and, in lieu of any service obligation arising under such agreement, shall be liable to the United States for repayment not later than 1 year after the date of default of all scholarship funds paid to them and to the institution of higher education on their behalf under the agreement, except as provided in subsection (h)(2). The repayment period may be extended by the Secretary when determined to be necessary, as established by regulation.</text></paragraph> 
<paragraph id="H65616AF921B5443A96AD22035C12C062"><enum>(2)</enum><header>Failure to begin or complete the service obligation or meet the terms and conditions of deferment</header><text>A scholarship recipient who, for any reason, fails to begin or complete a service obligation under this section after completion of academic training, or fails to comply with the terms and conditions of deferment established by the Secretary pursuant to subsection (f)(2)(B), shall be in breach of the contractual agreement. When a recipient breaches an agreement for the reasons stated in the preceding sentence, the recipient shall be liable to the United States for an amount equal to—</text> 
<subparagraph id="HC90AE8ACE75944BAA08035F598C13B40"><enum>(A)</enum><text>the total amount of scholarships received by such individual under this section; plus</text></subparagraph> 
<subparagraph id="HB25EE0CA173D44C495860074A3AE5600"><enum>(B)</enum><text>the interest on the amounts of such awards which would be payable if at the time the awards were received they were loans bearing interest at the maximum legal prevailing rate, as determined by the Treasurer of the United States,</text></subparagraph><continuation-text continuation-text-level="paragraph">multiplied by 3.</continuation-text></paragraph></subsection> 
<subsection id="HD0F0A1DD4BC24F5CB896D430DC00005B"><enum>(h)</enum><header>Waiver or suspension of obligation</header> 
<paragraph id="HBCABA7ABAFF1430F812700C3CA48FD57"><enum>(1)</enum><header>Death of individual</header><text>Any obligation of an individual incurred under the Program (or a contractual agreement thereunder) for service or payment shall be canceled upon the death of the individual.</text></paragraph> 
<paragraph id="H093BD1832D93434BB9B7ABC1C535F1D"><enum>(2)</enum><header>Impossibility or extreme hardship</header><text>The Secretary shall by regulation provide for the partial or total waiver or suspension of any obligation of service or payment incurred by an individual under the Program (or a contractual agreement thereunder) whenever compliance by the individual is impossible or would involve extreme hardship to the individual, or if enforcement of such obligation with respect to the individual would be contrary to the best interests of the Government.</text></paragraph></subsection> 
<subsection id="H4B00BCE2632D4DD181D05DB400AE484D"><enum>(i)</enum><header>Definitions</header><text>In this section the following definitions apply:</text> 
<paragraph id="H5F8047C752144AF5BFC970CF1E7E6011"><enum>(1)</enum><header>Cost of attendance</header><text>The term <term>cost of attendance</term> has the meaning given that term in section 472 of the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (20 U.S.C. 1087<italic>ll</italic>).</text></paragraph> 
<paragraph id="H42E81A877454477BB2627121B98E7390"><enum>(2)</enum><header>Program</header><text>The term <term>Program</term> means the Science and Technology Scholarship Program established under this section.</text></paragraph></subsection></section>

<title id="HEC89CA880312487689831FA3192C9EAA"><enum>II</enum><header>Research Administration and Operations</header> 
<section id="H3184A61BB5514188B2DD007499D600FA"><enum>201.</enum><header>Cost sharing</header> 
<subsection id="H3F4903EFCBF842D9A4A43991834FBCA"><enum>(a)</enum><header>Research and development</header><text>Except as otherwise provided in this Act, for research and development programs carried out under this Act, the Secretary shall require a commitment from non-Federal sources of at least 20 percent of the cost of the project. The Secretary may reduce or eliminate the non-Federal requirement under this subsection if the Secretary determines that the research and development is of a basic or fundamental nature.</text></subsection> 
<subsection id="HF0FEBDCB43E8458FA7DF00218C72784F"><enum>(b)</enum><header>Demonstration and commercial application</header><text>Except as otherwise provided in this Act, the Secretary shall require at least 50 percent of the costs related to any demonstration or commercial application activities under this Act to be provided from non-Federal sources. The Secretary may reduce the non-Federal requirement under this subsection if the Secretary determines that the reduction is necessary and appropriate considering the technological risks involved in the project and is necessary to meet the objectives of this Act.</text></subsection> 
<subsection id="H631735A888DC46EEB4CBF9E05D3D9F67"><enum>(c)</enum><header>Calculation of amount</header><text>In calculating the amount of the non-Federal commitment under subsection (a) or (b), the Secretary may include personnel, services, equipment, and other resources.</text></subsection> 
<subsection id="HF77A10B168C3489E91F6A63565DB1F81"><enum>(d)</enum><header>Size of non-federal share</header><text>The Secretary may consider the amount of the non-Federal share in selecting projects under this Act.</text></subsection></section> 
<section id="HC78D4B632C1042789152E05F8D7C18C8"><enum>202.</enum><header>Reprogramming</header> 
<subsection id="HFF3D034607AA410A8999D99DE446E4C"><enum>(a)</enum><header>Distribution Report</header><text>Not later than 60 days after the date of enactment of an Act appropriating amounts authorized under this Act, the Secretary shall transmit to Congress a report explaining how such amounts will be distributed among the activities authorized by this Act.</text></subsection> 
<subsection id="H34CDAB0EF168457788F887A239299865"><enum>(b)</enum><header>Reprogramming letter</header><text>No amount authorized by this Act shall be obligated or expended for a purpose inconsistent with the appropriations Act appropriating such amount, the report accompanying such appropriations Act, or a distribution report transmitted under subsection (a) if such obligation or expenditure would change an individual amount, as represented in such an Act, report, or distribution report, by more than 2 percent or $2,000,000, whichever is smaller, unless the Secretary has transmitted to Congress a letter of explanation and a period of 30 days has elapsed after Congress receives the letter.</text></subsection> 
<subsection id="H5985B58C0A064D5E8B6BDD7D7003948"><enum>(c)</enum><header>Computation</header><text>The computation of the 30-day period described in subsection (b) shall exclude any day on which either House of Congress is not in session because of an adjournment of more than 3 days to a day certain.</text></subsection></section> 
<section id="H03B181C8C9474F14B4D9D541F4FAD7"><enum>203.</enum><header>Merit-based competition</header> 
<subsection id="H3E4F09D7D12F4B7C99003FE685639D88"><enum>(a)</enum><header>Competitive merit review</header><text display-inline="yes-display-inline">Awardees of funds authorized under this Act shall be selected through open competitions. Funds shall be competitively awarded only after an impartial review of the scientific and technical merit of the proposals for such awards has been carried out by or for the Department on the basis of criteria outlined by the Secretary in the solicitation of proposals.</text></subsection> 
<subsection id="HBC7147D3F7C64A0BA9427B00D700AB5E"><enum>(b)</enum><header>Competition</header><text>Competitive awards under this Act shall involve competitions open to all qualified entities within one or more of the following categories:</text> 
<paragraph id="H3CCB625F0B654E0BBBD79FBA3EB0CF31"><enum>(1)</enum><text>Institutions of higher education.</text></paragraph> 
<paragraph id="H916E3C9F5F024D7E90AF52AE9EC03969"><enum>(2)</enum><text>National Laboratories.</text></paragraph> 
<paragraph id="HAB4A4140EEDD45E2B5699861831E8927"><enum>(3)</enum><text>Nonprofit and for-profit private entities.</text></paragraph> 
<paragraph id="HC60E021E37904303ADE03E25D0882301"><enum>(4)</enum><text>State and local governments.</text></paragraph> 
<paragraph id="HB661AB0AB1504735B700ABF1BF04062"><enum>(5)</enum><text>Consortia of entities described in paragraphs (1) through (4).</text></paragraph></subsection> 
<subsection id="H88A0C50722724A21A18C66F8BCF6896C"><enum>(c)</enum><header>Congressional notification</header><text display-inline="yes-display-inline">The Secretary shall notify Congress within 30 days after awarding more than $500,000 through a competition described in subsection (b) that is limited to 1 of the categories described in paragraphs (1) through (4) of subsection (b).</text></subsection> 
<subsection id="HF5209E985B784617805197E42CAE2DCD"><enum>(d)</enum><header>Waivers</header><text>The Secretary may waive the requirement under subsection (a) requiring competition if the Secretary considers it necessary to more quickly advance research, development, demonstration, or commercial application activities. The Secretary shall notify Congress within 30 days when a waiver is granted under this subsection. The Secretary may not delegate the waiver authority under this subsection for awards over $500,000.</text></subsection></section> 
<section id="H08DD58C463DD461E9BBE378128583FA"><enum>204.</enum><header>External technical review of departmental programs</header> 
<subsection id="H96FE0E823557436DB7CD53F5CAE87622"><enum>(a)</enum><header>National applied energy research and development advisory committees</header> 
<paragraph id="H7D13C4EFA245480BB9AEF18FD4E4EE7D"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish one or more advisory committees to review and advise the Department’s applied programs in the following areas:</text> 
<subparagraph id="H5FA355B4D03B4EDA9C73FFF30033FC72"><enum>(A)</enum><text>Energy efficiency.</text></subparagraph> 
<subparagraph id="H621727A3B3F74319866CE4BB5E7FC066"><enum>(B)</enum><text>Renewable energy.</text></subparagraph> 
<subparagraph id="HBCCF0778750C4A989100DAA8150BCF7"><enum>(C)</enum><text>Nuclear energy.</text></subparagraph> 
<subparagraph id="HB6EA3F38A54446DFA2BD09008D30FE49"><enum>(D)</enum><text>Fossil energy.</text></subparagraph></paragraph> 
<paragraph id="HB594C6411288462EB8EE0001C74EE588"><enum>(2)</enum><header>Existing advisory committees</header><text>The Secretary may designate an existing advisory committee within the Department to fulfill the responsibilities of an advisory committee under this subsection.</text></paragraph></subsection> 
<subsection id="H8E3F50A1F7794DE2A8B6B6ABD3622806"><enum>(b)</enum><header>Office of science advisory committees</header> 
<paragraph id="HD3A9CE04E13C4EAE85052F62D8A4D2D7"><enum>(1)</enum><header>Use of existing committees</header><text>Except as otherwise provided under the Federal Advisory Committee Act, the Secretary shall continue to use the scientific program advisory committees chartered under the Federal Advisory Committee Act (5 U.S.C. App.) by the Office of Science to oversee research and development programs under that Office.</text></paragraph> 
<paragraph id="H7A080CA1B9CC4871A6EDB6CF519D15B6" commented="no"><enum>(2)</enum><header>Report</header><text>Before the Department issues any new guidance regarding the membership for Office of Science scientific program advisory committees, the Secretary shall transmit a report to the Congress outlining the reasons for the proposed changes, and 60 days must have elapsed after transmittal of the report before the Department may implement those changes.</text></paragraph> 
<paragraph id="H20509EDBEC5E4CD6B8B8854FEEAF00A7"><enum>(3)</enum><header>Science advisory committee</header> 
<subparagraph id="HA33E8DE626D44E16B08941ACE90537D6"><enum>(A)</enum><header>Establishment</header><text>There shall be a Science Advisory Committee for the Office of Science that includes the chairs of each of the advisory committees described in paragraph (1).</text></subparagraph> 
<subparagraph id="H13F7D6B971954864A395A3D218161FD6"><enum>(B)</enum><header>Responsibilities</header><text>The Science Advisory Committee shall—</text> 
<clause id="HEEFD0EFBF78A40E9946DEB45E8C15D7F"><enum>(i)</enum><text>advise the Secretary on science issues;</text></clause> 
<clause id="HF937701CC58C438495C290FC2F8100D5"><enum>(ii)</enum><text>advise the Secretary with respect to the well-being and management of the National Laboratories and Department research facilities;</text></clause> 
<clause id="H8B596FC00BEC4FECB77E10AF38A691CB"><enum>(iii)</enum><text>advise the Secretary with respect to education and workforce training activities required for effective short-term and long-term basic and applied research activities of the Office of Science; and</text></clause> 
<clause id="H6B4669EE5FCE4FDD9CC977109F33C84B"><enum>(iv)</enum><text>advise the Secretary with respect to the well-being of the university research programs supported by the Office of Science.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="HE17BF1B3506B4443B5EE28C21D42CACC"><enum>(c)</enum><header>Membership</header><text display-inline="yes-display-inline">Each member of an advisory committee appointed under this section shall have significant scientific, technical, or other appropriate expertise. The membership of each committee shall represent a wide range of expertise, including at least one third with expertise from outside the disciplines covered by the program, and a diverse set of interests.</text></subsection> 
<subsection id="H96AB51AA5D99491790C040B333007FDE"><enum>(d)</enum><header>Meetings and Purposes</header><text>Each advisory committee under this section shall meet at least semiannually to review and advise on the progress made by the respective research, development, demonstration, and commercial application program or programs. The advisory committee shall also review the measurable cost and performance-based goals for the applied programs, and the progress on meeting such goals.</text></subsection> 
<subsection id="H268DCD753FF5442E9211FC588058C0CD"><enum>(e)</enum><header>Review and Assessment</header><text>Not later than 6 months after the date of enactment of this Act, the Secretary shall enter into arrangements with the National Academy of Sciences to conduct reviews and assessments of the programs authorized by this Act, the measurable cost and performance-based goals for the applied programs, and the progress in meeting such goals. Such reviews and assessments shall be completed and reports containing the results of all such reviews and assessments transmitted to the Congress not later than 2 years after the date of enactment of this Act.</text></subsection></section> 
<section id="H0682CDA69E4F423700E9BEC0916FBAC"><enum>205.</enum><header>Competitive award of management contracts</header><text display-inline="no-display-inline">None of the funds authorized to be appropriated to the Secretary by this Act may be used to award a management and operating contract for a National Laboratory (excluding those named in subparagraphs (G), (H), (N), (O) of section 2(6)), unless such contract is competitively awarded, or the Secretary grants, on a case-by-case basis, a waiver. The Secretary may not delegate the authority to grant such a waiver and shall submit to the Congress a report notifying it of the waiver, and setting forth the reasons for the waiver, at least 60 days prior to the date of the award of such contract.</text></section> 
<section id="H7FFF1913C3CF4528A8B6BB8869B538C0"><enum>206.</enum><header>National Laboratory designation</header><text display-inline="no-display-inline">After the date of enactment of this Act the Secretary shall not designate a facility that is not referred to in section 2(6) as a National Laboratory.</text></section> 
<section id="H4847530AED674E7B8C14EA006D64A0B9" display-inline="no-display-inline"><enum>207.</enum><header>Report on equal employment opportunity practices</header><text display-inline="no-display-inline">Not later than 12 months after the date of enactment of this Act, and biennially thereafter, the Secretary shall transmit to Congress a report on the equal employment opportunity practices at National Laboratories. Such report shall include—</text> 
<paragraph id="H9B7CB54D78684F988544C9522BF0235E"><enum>(1)</enum><text>a thorough review of each laboratory contractor’s equal employment opportunity policies, including promotion to management and professional positions and pay raises;</text></paragraph> 
<paragraph id="HC2EB3221DDF747BEA59FD3BC9C127A6"><enum>(2)</enum><text>a statistical report on complaints and their disposition in the laboratories;</text></paragraph> 
<paragraph id="HA095005ECF424094B259B9C0728BF9C6"><enum>(3)</enum><text>a description of how equal employment opportunity practices at the laboratories are treated in the contract and in calculating award fees for each contractor;</text></paragraph> 
<paragraph id="H9A6F38B891F74EB7A78F9805008785A1"><enum>(4)</enum><text>a summary of disciplinary actions and their disposition by either the Department or the relevant contractors for each laboratory;</text></paragraph> 
<paragraph id="HAAD5D102450740469CE22B1259542DA2"><enum>(5)</enum><text>a summary of outreach efforts to attract women and minorities to the laboratories;</text></paragraph> 
<paragraph id="HFE697B2B1540471D8F181392D3FF6325"><enum>(6)</enum><text>a summary of efforts to retain women and minorities in the laboratories; and</text></paragraph> 
<paragraph id="H6BA7B95F290C43DC8D5B1D9FF5ECDCAD"><enum>(7)</enum><text>a summary of collaboration efforts with the Office of Federal Contract Compliance Programs to improve equal employment opportunity practices at the laboratories.</text></paragraph></section> 
<section id="H71CC9CEA87164161A37C3D9BA2CB126"><enum>208.</enum><header>User facility best practices plan</header><text display-inline="no-display-inline"> The Secretary shall not designate any new or existing facility as a user facility until the Secretary, for that facility—</text> 
<paragraph id="HDF9BEE53F987445C8110CA39B8BD55BF"><enum>(1)</enum><text>develops a plan to ensure that the facility will—</text> 
<subparagraph id="HB58E2BC88E8F48818624B8A1CC630081"><enum>(A)</enum><text>have a skilled staff to support a wide range of users;</text></subparagraph> 
<subparagraph id="HD507E42C6C844E63887B2309F05F00A8"><enum>(B)</enum><text>have a fair method for allocating time to users that provides for input from facility management, user representatives, and outside experts; and</text></subparagraph> 
<subparagraph id="H32B12544C3224BEDA8F6CD00316803AC"><enum>(C)</enum><text>be operated in a safe and fiscally prudent manner; and</text></subparagraph></paragraph> 
<paragraph id="H67366256881C4A7482E4068789D08CBF"><enum>(2)</enum><text>transmits such plan to Congress and 60 days have elapsed.</text></paragraph></section> 
<section id="H783536A5BEFC4B0200809C64ACD4C92" display-inline="no-display-inline" section-type="subsequent-section"><enum>209.</enum><header>Support for science and energy infrastructure and facilities</header> 
<subsection id="H0317B183B94A40629F55AEC7F64504D"><enum>(a)</enum><header>Strategy</header><text display-inline="yes-display-inline">The Secretary shall develop and implement a strategy for infrastructure and facilities supported primarily from the Office of Science and the applied programs at each National Laboratory and Department research facility. Such strategy shall provide cost-effective means for—</text> 
<paragraph id="HF4148BA584CF493792B8000063FB161B"><enum>(1)</enum><text>maintaining existing facilities and infrastructure, as needed;</text></paragraph> 
<paragraph id="HD5E29D94DF3A4881BC1E973039A782B0"><enum>(2)</enum><text>closing unneeded facilities;</text></paragraph> 
<paragraph id="H76E797CBBA6247168D00E1A62975088D"><enum>(3)</enum><text>making facility modifications; and</text></paragraph> 
<paragraph id="H8E698CA23E8B40A693003EACB1A24F6E"><enum>(4)</enum><text>building new facilities.</text></paragraph></subsection> 
<subsection id="HB1767DAF0EB948288037106EDC304FD"><enum>(b)</enum><header>Report</header> 
<paragraph id="HC290DCEBA97D4AFDA9E8CB7FA86B5C85"><enum>(1)</enum><header>Requirement</header><text>The Secretary shall prepare and transmit to the Congress not later than June 1, 2007, a report summarizing the strategies developed under subsection (a).</text></paragraph> 
<paragraph id="H7527A2E3B4D741E383B49088A4CBE971"><enum>(2)</enum><header>Contents</header><text display-inline="yes-display-inline">For each National Laboratory and Department research facility, for the facilities primarily used for science and energy research, such report shall contain—</text> 
<subparagraph id="H1216A8D736BA48F983FB60B501C1FD00"><enum>(A)</enum><text> the current priority list of proposed facilities and infrastructure projects, including cost and schedule requirements;</text></subparagraph> 
<subparagraph id="H3D78AF826613454FB053C08579D1DF6B"><enum>(B)</enum><text> a current 10-year plan that demonstrates the reconfiguration of its facilities and infrastructure to meet its missions and to address its long-term operational costs and return on investment;</text></subparagraph> 
<subparagraph id="H97D9DB8A8BF442BB99728C265062C432"><enum>(C)</enum><text>the total current budget for all facilities and infrastructure funding; and</text></subparagraph> 
<subparagraph id="HC21EAB412D8941219C91F81351EBCEAE"><enum>(D)</enum><text>the current status of each facility and infrastructure project compared to the original baseline cost, schedule, and scope.</text></subparagraph></paragraph></subsection></section> 
<section id="H4851D442F1494533A3DE6DE7FB11669F" section-type="subsequent-section" display-inline="no-display-inline"><enum>210.</enum><header>Coordination plan</header> 
<subsection id="HA67FD5BB1A6742698EFFFF649F885721"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall develop a coordination plan to improve coordination and collaboration in research, development, demonstration, and commercial application activities across Department organizational boundaries.</text></subsection> 
<subsection id="HEF93243082824FDDB2E5003F02A600D8"><enum>(b)</enum><header>Plan contents</header><text display-inline="yes-display-inline">The plan shall describe—</text> 
<paragraph id="H8C9DB56982AB4AC2A400AC5DFA1F2BB0"><enum>(1)</enum><text>how the Secretary will ensure that the applied programs are coordinating their activities, including a description of specific research questions that cross organizational boundaries and of how the relevant applied programs are coordinating their efforts to answer those questions, and how such cross-cutting research questions will be identified in the future;</text></paragraph> 
<paragraph id="HAE215CECAD39451A84CE5565009C84B9"><enum>(2)</enum><text>how the Secretary will ensure that research that has been supported by the Office of Science is being or will be used by the applied programs, including a description of specific Office of Science-supported research that is relevant to the applied programs and of how the applied programs have used or will use that research; and</text></paragraph> 
<paragraph id="H8A3A62BE86E948109FFADD2E89E7D3E1"><enum>(3)</enum><text>a description of how the Secretary will ensure that the research agenda of the Office of Science includes research questions of concern to the applied programs, including a description of specific research questions that the Office of Science will address to assist the applied programs.</text></paragraph></subsection> 
<subsection id="H0431932A25294CCFA50639115D7E131D"><enum>(c)</enum><header>Plan transmittal</header><text>The Secretary shall transmit the coordination plan to Congress not later than 9 months after the date of enactment of this Act, and every 2 years thereafter shall transmit a revised coordination plan.</text></subsection> 
<subsection id="HFC1D8DC98EFB42CCA534C208B487CD48"><enum>(d)</enum><header>Conference</header><text>Not less than 6 months after the date of enactment of this Act, the Secretary shall convene a conference of program managers from the Office of Science and the applied programs to review ideas and explore possibilities for effective cross-program collaboration. The Secretary also shall invite participation relevant Federal agencies and other programs in the Federal Government conducting relevant research, and other stakeholders as appropriate.</text></subsection></section> 
<section id="H86B6C1357A4447F39425E3C80888829D" display-inline="no-display-inline"><enum>211.</enum><header>Availability of funds</header><text display-inline="no-display-inline">Funds appropriated to the Secretary for activities authorized under this Act shall remain available for three years. Funds that are not obligated at the end of three years shall be returned to the Treasury.</text></section></title> 
<title id="H7D576515E5804B99A24EB95E6E410836"><enum>III</enum><header>Energy Efficiency</header> 
<subtitle id="HB52804A4FA8F42E5B2F164C2E2B89388"><enum>A</enum><header>Vehicles, Buildings, and Industries</header> 
<section id="H3E6B5C67122D46259D74F3042FE8949D" section-type="subsequent-section"><enum>301.</enum><header>Programs</header> 
<subsection id="HF59F8C0C88E54C8AB54F5855257EB683"><enum>(a)</enum><header>In general</header><text>The Secretary shall conduct programs of energy efficiency research, development, demonstration, and commercial application, including activities described in this subtitle. Such programs shall be focused on the following objectives:</text> 
<paragraph id="H7792A7F275E443CFAD1B21CE20EB2CCC"><enum>(1)</enum><text>Increasing the energy efficiency of vehicles, buildings, and industrial processes.</text></paragraph> 
<paragraph id="H491F1126B4AE4EBDA420D9B213715944"><enum>(2)</enum><text>Reducing the Nation’s demand for energy, especially energy from foreign sources.</text></paragraph> 
<paragraph id="H644D6E2481CD4D249859F316C82725C3"><enum>(3)</enum><text>Reducing the cost of energy and making the economy more efficient and competitive.</text></paragraph> 
<paragraph id="HDE456AE876B14065A2912D03648100CC"><enum>(4)</enum><text>Improving the Nation’s energy security.</text></paragraph> 
<paragraph id="HD54AC68E083A4FEDA600DF1E3D222D09"><enum>(5)</enum><text>Reducing the environmental impact of energy-related activities.</text></paragraph></subsection> 
<subsection id="H92D8903E8BC24454A5253FF2C35E54BD"><enum>(b)</enum><header>Goals</header> 
<paragraph id="H32F461C11AF14E4EBE9D01342540D5C6"><enum>(1)</enum><header>Initial goals</header><text>In accordance with the performance plan and report requirements in section 4 of the Government Performance Results Act of 1993, the Secretary shall transmit to the Congress, along with the President’s annual budget request for fiscal year 2007, a report containing outcome measures with explicitly stated cost and performance baselines. The measures shall specify energy efficiency performance goals, with quantifiable 5-year cost and energy savings target levels, for vehicles, buildings, and industries, and any other such goals the Secretary considers appropriate.</text></paragraph> 
<paragraph id="HC63AEBA0D4F9413196F1A7E17DD54236"><enum>(2)</enum><header>Subsequent transmittals</header><text>The Secretary shall transmit to the Congress, along with the President’s annual budget request for each fiscal year after 2007, a report containing—</text> 
<subparagraph id="H425118D33F1D4BB2853B4B4D6E393E69"><enum>(A)</enum><text>a description, including quantitative analysis, of progress in achieving performance goals transmitted under paragraph (1), as compared to the baselines transmitted under paragraph (1); and</text></subparagraph> 
<subparagraph id="H010AB393EC2E4162AF043711D295A291"><enum>(B)</enum><text>any amendments to such goals.</text></subparagraph></paragraph></subsection> 
<subsection id="HC6F9CAA0AD8842B190DB95E61B493098"><enum>(c)</enum><header>Public input</header><text>The Secretary shall consider advice from industry, universities, and other interested parties through seeking comments in the Federal Register and other means before transmitting each report under subsection (b).</text></subsection></section> 
<section id="HF05EAD5938134065BCE4D59D7EB188DE"><enum>302.</enum><header>Vehicles</header><text display-inline="no-display-inline"> The Secretary shall conduct a program of research, development, demonstration, and commercial application of advanced, cost-effective technologies to improve the energy efficiency and environmental performance of light-duty and heavy-duty vehicles, including—</text> 
<paragraph id="H2BF51744F7FA41E18D00295703D7093E"><enum>(1)</enum><text>hybrid and electric propulsion systems, including plug-in hybrid systems;</text></paragraph> 
<paragraph id="HA0F2B6A2F90442D896FEE386F2468DF"><enum>(2)</enum><text>advanced engines, including combustion engines;</text></paragraph> 
<paragraph id="H114F637B21F547C58B512BE301B3CA78"><enum>(3)</enum><text>advanced materials, including high strength, lightweight materials, such as nanostructured materials, composites, multimaterial parts, carbon fibers, and materials with high thermal conductivity;</text></paragraph> 
<paragraph id="H37AFDD3D4B2749D49EC9004C9BD3C8B1"><enum>(4)</enum><text>technologies for reduced drag and rolling resistance;</text></paragraph> 
<paragraph id="H4A0611B6D9F04AC689F138F00542914"><enum>(5)</enum><text>whole-vehicle design optimization to reduce the weight of component parts and thus increase the fuel economy of the vehicle, including fiber optics to replace traditional wiring;</text></paragraph> 
<paragraph id="H55ABD14CA4E8421B8741E351D6717F8E"><enum>(6)</enum><text>thermoelectric devices that capture waste heat and convert thermal energy into electricity; and</text></paragraph> 
<paragraph id="HEE2AEBCB53AA4B02A05EF80048C287B"><enum>(7)</enum><text>advanced drivetrains.</text></paragraph></section> 
<section id="HA01C06848EB64FE1A0D55B4F81451000"><enum>303.</enum><header>Buildings</header> 
<subsection id="H5464D5CA45A74C45A94C433C8E96C64C"><enum>(a)</enum><header>Program</header><text>The Secretary shall conduct a program of research, development, demonstration, and commercial application of cost-effective technologies, for new construction and retrofit, to improve the energy efficiency and environmental performance of commercial, industrial, institutional, and residential buildings. The program shall use a whole-buildings approach, integrating work on elements including—</text> 
<paragraph id="H15884994C1A24F18A0C46D359BFD8998"><enum>(1)</enum><text display-inline="yes-display-inline">advanced controls, including occupancy sensors, daylighting controls, wireless technologies, automated responses to changes in the internal and external environment, and real time delivery of information on building system and component performance; </text></paragraph> 
<paragraph id="H5E92BE1EDE3D457280A45053B4397D97"><enum>(2)</enum><text>building envelope, including windows, roofing systems and materials, and building-integrated photovoltaics;</text></paragraph> 
<paragraph id="H8725FFE592154F2B867C588BA73C1BAB"><enum>(3)</enum><text>building systems components, including—</text> 
<subparagraph id="H0CF75762778A40C8A4DF101FE707A4A2"><enum>(A)</enum><text>lighting, including the Next Generation Lighting Initiative described in subsection (b);</text></subparagraph> 
<subparagraph id="HAECE1D6AE93F4FA3879442634CBFF7D6"><enum>(B)</enum><text>appliances, including advanced technologies, such as stand-by load technologies, for office equipment, food service equipment, and laundry equipment; and</text></subparagraph> 
<subparagraph id="HAB7C1F7B54F947AF8365A72021A2C2FF"><enum>(C)</enum><text>heating, ventilation, and cooling systems, including ground-source heat pumps and radiant heating; and</text></subparagraph></paragraph> 
<paragraph id="HA3E4779AAA9C480784938D2767F57905"><enum>(4)</enum><text>onsite renewable energy generation.</text></paragraph></subsection> 
<subsection id="HE8BBAAA1CE7347989971BB56D33CF4FE"><enum>(b)</enum><header>Next generation lighting initiative</header><text>The program conducted under subsection (a)(3)(A) shall include a Next Generation Lighting Initiative to support research, development, demonstration, and commercial application activities related to advanced lighting technologies for both general white light illumination needs and specialized applications such as exit ramp and stairway illumination. Such activities shall be focused on advanced lighting technologies, including solid-state organic and inorganic technologies that, compared to current lighting technologies, deliver superior performance, are longer lasting, are more energy-efficient, are better matched to customer needs, have less environmental impact, and are cost-competitive.</text></subsection> 
<subsection id="HEFA25E17C6DC42319125E3C6A1A31800" display-inline="no-display-inline"><enum>(c)</enum><header>Energy efficient building pilot grant program</header> 
<paragraph id="H1AE499FC102B4C7286D3CA2FAF500D5"><enum>(1)</enum><header>In general</header><text>Not later than 6 months after the date of enactment of this Act, the Secretary shall establish a pilot program to award grants to businesses and organizations for new construction of energy efficient buildings, or major renovations of buildings that will result in energy efficient buildings, to demonstrate innovative energy efficiency technologies, especially those sponsored by the Department.</text></paragraph> 
<paragraph id="HE4931B41556E427C8776CBC10798946"><enum>(2)</enum><header>Awards</header><text>The Secretary shall award grants under this subsection competitively to those applicants whose proposals—</text> 
<subparagraph id="HCEDD670426E5475C8D7B493D25832C05"><enum>(A)</enum><text>best demonstrate—</text> 
<clause id="HC745FC30244A48818B55655DFB8658A1"><enum>(i)</enum><text>likelihood to meet or exceed the design standards referred to in paragraph (7);</text></clause> 
<clause id="HC76D383ACEB6435385CBFD37E968EF84"><enum>(ii)</enum><text>likelihood to maximize cost-effective energy efficiency opportunities; and</text></clause> 
<clause id="H7B604F83585D4EE7BC43A8BA8B113DB8"><enum>(iii)</enum><text>advanced energy efficiency technologies; and</text></clause></subparagraph> 
<subparagraph id="H4829FE1299CE4BDB932300457C52B07E"><enum>(B)</enum><text>are least likely to be realized without Federal assistance.</text></subparagraph></paragraph> 
<paragraph id="HA2D366030EDC4DDBBD357D16121F0001"><enum>(3)</enum><header>Amount of grants</header><text display-inline="yes-display-inline">Grants under this subsection shall be for up to 50 percent of design and energy modeling costs, not to exceed $50,000 per building. No single grantee may be eligible for more than 3 grants per year under this program.</text></paragraph> 
<paragraph id="HF7ED4C5E757246CF863451B419E2E1CD"><enum>(4)</enum><header>Grant payments</header> 
<subparagraph id="H73E17A75EB054E87A71E0075C67BF148"><enum>(A)</enum><header>Initial payment</header><text>The Secretary shall pay 50 percent of the total amount of the grant to grant recipients upon selection.</text></subparagraph> 
<subparagraph id="H1C374B3FBA844063B6A43CA811D448EE"><enum>(B)</enum><header>Remainder of payment</header><text>The Secretary shall pay the remaining 50 percent of the grant only after independent certification of operational buildings for compliance with the standards for energy efficient buildings described in paragraph (7).</text></subparagraph> 
<subparagraph id="H1B376C70042842F2882786DE5F972FD5"><enum>(C)</enum><header>Failure to comply</header><text display-inline="yes-display-inline">The Secretary shall not provide the remainder of the payment unless the building is certified within 6 months after operation of the completed building to meet the requirements described in subparagraph (B), or in the case of major renovations the building is certified within 6 months of the completion of the renovations.</text></subparagraph></paragraph> 
<paragraph id="H71C18093CD454D33AFBB5F05B1945383"><enum>(5)</enum><header>Report to congress</header><text>Not later than 3 years after awarding the first grant under this subsection, the Secretary shall transmit to Congress a report containing—</text> 
<subparagraph id="H552A692740F14C1CB9CE002984B57882"><enum>(A)</enum><text>the total number and dollar amount of grants awarded under this subsection; and</text></subparagraph> 
<subparagraph id="HEB42656D28CB4FA4986B48D6FB00F9EF"><enum>(B)</enum><text>an estimate of aggregate cost and energy savings enabled by the pilot program under this subsection.</text></subparagraph></paragraph> 
<paragraph id="HF2045AC5034A4856A73DF2A2312454A9"><enum>(6)</enum><header>Administrative expenses</header><text>Administrative expenses for the program under this subsection shall not exceed 10 percent of appropriated funds.</text></paragraph> 
<paragraph id="HC717F9E39AAA4344A29E34D6E4BD3700"><enum>(7)</enum><header>Definition of energy efficient building</header><text>For purposes of this subsection, the term <quote>energy efficient building</quote> means a building that is independently certified—</text> 
<subparagraph id="H93E8800B835E4E62B700DC7570E2BA14"><enum>(A)</enum><text>to meet or exceed the applicable United States Green Building Council’s Leadership in Energy and Environmental Design standards for a silver, gold, or platinum rating; and</text></subparagraph> 
<subparagraph id="H6A59FCA6A63E4FA390CD3C00EA3CED07"><enum>(B)</enum><text display-inline="yes-display-inline">to achieve a reduction in energy consumption of—</text> 
<clause id="H01BCAF49EB1641A09EB92BF63FFD004"><enum>(i)</enum><text display-inline="yes-display-inline">at least 25 percent for new construction, compared to the energy standards set by the Federal Building Code (10 C.F.R. part 434); and</text></clause> 
<clause id="HAD8925A4925942A095CD33B0BE706F48"><enum>(ii)</enum><text display-inline="yes-display-inline">at least 20 percent for major renovations, compared to energy consumption before renovations are begun.</text></clause></subparagraph></paragraph></subsection></section> 
<section id="H49B465C06D1343EEB2A319A93FD85CE2"><enum>304.</enum><header>Industries</header> 
<subsection id="H48AF2D07650B42608C5BAD02FAB9CF2D"><enum>(a)</enum><header>Program</header><text>The Secretary shall conduct a program of research, development, demonstration, and commercial application of advanced technologies to improve the energy efficiency, environmental performance, and process efficiency of energy-intensive and waste-intensive industries. Such program shall be focused on industries whose total annual energy consumption amounts to more than 1.0 percent of the total nationwide annual energy consumption, according to the most recent data available to the Department. Research and development efforts under this section shall give a higher priority to broad-benefit efficiency technologies that have practical application across industry sectors.</text></subsection> 
<subsection id="HF2221BB822B14DD593B6F3A7C498CD54"><enum>(b)</enum><header>Electric motor control technology</header><text display-inline="yes-display-inline">The program conducted under subsection (a) shall include research on, and development, demonstration, and commercial application of, advanced control devices to improve the energy efficiency of electric motors, including those used in industrial processes, heating, ventilation, and cooling.</text></subsection> 
<subsection id="H0CDE49274D574D35B754BC0008E28B3"><enum>(c)</enum><header>Reauthorization of Steel and Aluminum Energy Conservation and Technology Competitiveness Act of 1988</header> 
<paragraph id="H098A99DF008547D48424F0D1AD793E33"><enum>(1)</enum><header>Authorization of appropriations</header><text>Section 9 of the Steel and Aluminum Energy Conservation and Technology Competitiveness Act of 1988 (15. U.S.C. 5108) is amended to read as follows:</text>

<subparagraph id="H05A143C85C774259BA488D00B5AA9D20"><enum>(B)</enum><text>by adding at the end the following new subparagraph:</text>

<subparagraph id="HD9EAD86E95744183A020A502D0F10BC"><enum>(A)</enum><text>by striking section 7 (<external-xref legal-doc="usc" parsable-cite="usc/15/5106">15 U.S.C. 5106</external-xref>); and</text></subparagraph>

<section id="H8E03CD30B8264B728D4668EF23BAB529"><enum>305.</enum><header>Demonstration and commercial application</header> 
<subsection id="HE9186750818847DBAAD4378C07AAD5A1"><enum>(a)</enum><header>Appliances and testing</header><text display-inline="yes-display-inline">The Secretary shall conduct research and analysis to determine whether, given Department-sponsored and other advances in energy efficiency technologies, demonstration and commercial application of innovative, cost-effective energy savings and pollution reducing technologies could be used to improve appliances and test procedures used to measure appliance efficiency.</text></subsection> 
<subsection id="HF88478D693964B179B6DD1C8C3C926E7"><enum>(b)</enum><header>Building energy codes</header><text>The Secretary shall, in coordination with government, nongovernment, and commercial partners, conduct research and analyses of the best cost-effective practices in the development and updating of building energy codes, including for manufactured housing. Analyses shall focus on how to encourage energy efficiency and adoption of newly developed energy production and use equipment.</text></subsection> 
<subsection id="H5728812D9B774865A5529F42B175CC9" display-inline="no-display-inline"><enum>(c)</enum><header>Advanced energy technology transfer centers</header> 
<paragraph id="H5EB3D8DE9E954246B555FC2BBCF5FD2"><enum>(1)</enum><header>Grants</header><text>Not later than 18 months after the date of enactment of this Act, the Secretary shall make grants to nonprofit institutions, State and local governments, or universities (or consortia thereof), to establish a geographically dispersed network of Advanced Energy Technology Transfer Centers, to be located in areas the Secretary determines have the greatest need of the services of such Centers.</text></paragraph> 
<paragraph id="H50C3EB22A76D469690BE91D951AFF224"><enum>(2)</enum><header>Activities</header> 
<subparagraph id="H0E7C04CFE9CC4CB59807798B38752084"><enum>(A)</enum><header>In general</header><text>Each Center shall operate a program to encourage demonstration and commercial application of advanced energy methods and technologies through education and outreach to building and industrial professionals, and to other individuals and organizations with an interest in efficient energy use.</text></subparagraph> 
<subparagraph id="H85423A766A2F4227A96E9E891221C674"><enum>(B)</enum><header>Advisory panel</header><text>Each Center shall establish an advisory panel to advise the Center on how best to accomplish the activities under subparagraph (A).</text></subparagraph></paragraph> 
<paragraph id="H357C600E42164E8FA5323F69E71CA3B7"><enum>(3)</enum><header>Application</header><text>A person seeking a grant under this subsection shall submit to the Secretary an application in such form and containing such information as the Secretary may require. The Secretary may award a grant under this subsection to an entity already in existence if the entity is otherwise eligible under this subsection.</text></paragraph> 
<paragraph id="HD29CC5C0132A411C9865B309A674CC3B"><enum>(4)</enum><header>Selection criteria</header><text>The Secretary shall award grants under this subsection on the basis of the following criteria, at a minimum:</text> 
<subparagraph id="H19D47784C7A74CEF81DC74A2D9770342"><enum>(A)</enum><text>The ability of the applicant to carry out the activities in paragraph (2).</text></subparagraph> 
<subparagraph id="H413DC461D6034F2BB7413152A1696952"><enum>(B)</enum><text>The extent to which the applicant will coordinate the activities of the Center with other entities, such as State and local governments, utilities, and educational and research institutions.</text></subparagraph></paragraph> 
<paragraph id="H92D904B9562647A0B874A08CA2812190"><enum>(5)</enum><header>Matching funds</header><text>The Secretary shall require a non-Federal matching requirement of at least 50 percent of the costs of establishing and operating each Center.</text></paragraph> 
<paragraph id="H41ECEDA3637E40439D33C9F4FA9DEDD3"><enum>(6)</enum><header>Advisory committee</header><text>The Secretary shall establish an advisory committee to advise the Secretary on the establishment of Centers under this subsection. The advisory committee shall be composed of individuals with expertise in the area of advanced energy methods and technologies, including at least 1 representative from—</text> 
<subparagraph id="HD509B24ABE184A58AFB3A7E6267B01AA"><enum>(A)</enum><text>State or local energy offices;</text></subparagraph> 
<subparagraph id="HD7240CA62B654C00007600F283DBDBB1"><enum>(B)</enum><text>energy professionals;</text></subparagraph> 
<subparagraph id="H5E1C398BB46C4E5C97E7D207B2C6CCF"><enum>(C)</enum><text>trade or professional associations;</text></subparagraph> 
<subparagraph id="H848E86BF72E44BCCA8FD7171C8F2BB9B"><enum>(D)</enum><text>architects, engineers, or construction professionals;</text></subparagraph> 
<subparagraph id="H2852A90FE8CB447FAD103DCB54F32FA7"><enum>(E)</enum><text>manufacturers;</text></subparagraph> 
<subparagraph id="H3423E339E4314B37B83C363229D13E24"><enum>(F)</enum><text>the research community; and</text></subparagraph> 
<subparagraph id="H0AD3186F66434D758E081150C04B72E3"><enum>(G)</enum><text>nonprofit energy or environmental organizations.</text></subparagraph></paragraph> 
<paragraph id="H1ECBC7A1869B4B32B5C7B8F46E501249"><enum>(7)</enum><header>Definitions</header><text>For purposes of this subsection:</text> 
<subparagraph id="H52B24EC9D65D4631A42FE1005F00CBBC"><enum>(A)</enum><header>Advanced energy methods and technologies</header><text>The term <quote>advanced energy methods and technologies</quote> means all methods and technologies that promote energy efficiency and conservation, including distributed generation technologies, and life-cycle analysis of energy use.</text></subparagraph> 
<subparagraph id="H8E136212E69E4D9FB7C58D88F887FFF"><enum>(B)</enum><header>Center</header><text>The term <quote>Center</quote> means an Advanced Energy Technology Transfer Center established pursuant to this subsection.</text></subparagraph> 
<subparagraph id="H90F5387E76EB465CB4A960CB9F8E006D"><enum>(C)</enum><header>Distributed generation</header><text>The term <quote>distributed generation</quote> means an electric power generation facility that is designed to serve retail electric consumers at or near the facility site.</text></subparagraph></paragraph></subsection> 
<subsection id="HA3F1406BAB9D4D15853BEBEF005D1619"><enum>(d)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this Act, and once every 3 years thereafter, the Secretary shall transmit to Congress a report on the results of research and analysis under this section. In calculating cost-effectiveness for purposes of such reports, the Secretary shall include, at a minimum, the avoided cost of additional energy production, savings to the economy from lower peak energy prices and reduced price volatility, and the public and private benefits of reduced pollution.</text></subsection></section> 
<section id="H81E154CAD6504DF589EBA81D1666B6EF" display-inline="no-display-inline" section-type="subsequent-section"><enum>306.</enum><header>Secondary electric vehicle battery use program</header> 
<subsection id="HC300E1D322F84FE1955EEDCC351609F"><enum>(a)</enum><header>Definitions</header><text>For purposes of this section:</text> 
<paragraph id="H43D6C59CD1D6408DBAD0C221D1576F4C"><enum>(1)</enum><header>Associated equipment</header><text>The term <quote>associated equipment</quote> means equipment located where the batteries will be used that is necessary to enable the use of the energy stored in the batteries.</text></paragraph> 
<paragraph id="H2E05BCB6FF6E4F43B7FFB18F56D08600"><enum>(2)</enum><header>Battery</header><text>The term <quote>battery</quote> means an energy storage device that previously has been used to provide motive power in a vehicle powered in whole or in part by electricity.</text></paragraph></subsection> 
<subsection id="H7BD3F8159CBE4D4492A1DDEDA91FD97D"><enum>(b)</enum><header>Program</header><text>The Secretary shall establish and conduct a research, development, demonstration, and commercial application program for the secondary use of batteries if the Secretary finds that there are sufficient numbers of such batteries to support the program. The program shall be—</text> 
<paragraph id="H0A898828963C4328BB6E2623C4B4B69E"><enum>(1)</enum><text>designed to demonstrate the use of batteries in secondary applications, including utility and commercial power storage and power quality;</text></paragraph> 
<paragraph id="H766E0F7DF50A4CA3B0C2DDAF86EF8405"><enum>(2)</enum><text>structured to evaluate the performance, including useful service life and costs, of such batteries in field operations, and the necessary supporting infrastructure, including reuse and disposal of batteries; and</text></paragraph> 
<paragraph id="H786FB7F8D1E341CA89FC46DC7EDCEABB"><enum>(3)</enum><text>coordinated with ongoing secondary battery use programs at the National Laboratories and in industry.</text></paragraph></subsection> 
<subsection id="HE7973F03830C46CDAC6B4112CD3900EF"><enum>(c)</enum><header>Solicitation</header><text>Not later than 180 days after the date of enactment of this Act, if the Secretary finds under subsection (b) that there are sufficient numbers of batteries to support the program, the Secretary shall solicit proposals to demonstrate the secondary use of batteries and associated equipment and supporting infrastructure in geographic locations throughout the United States. The Secretary may make additional solicitations for proposals if the Secretary determines that such solicitations are necessary to carry out this section.</text></subsection> 
<subsection id="H0CE0F87806734A97BAAD730331FC75E4"><enum>(d)</enum><header>Selection of proposals</header> 
<paragraph id="HD9650698073C4521B63D340301EF72D"><enum>(1)</enum><header>In general</header><text>The Secretary shall, not later than 90 days after the closing date established by the Secretary for receipt of proposals under subsection (c), select up to 5 proposals which may receive financial assistance under this section, subject to the availability of appropriations.</text></paragraph> 
<paragraph id="H94E9F98221E449258711AC1CF5998F78"><enum>(2)</enum><header>Diversity; environmental effect</header><text>In selecting proposals, the Secretary shall consider diversity of battery type, geographic and climatic diversity, and life-cycle environmental effects of the approaches.</text></paragraph> 
<paragraph id="HAFE5D5327C0D48D9B401DD508FC68445"><enum>(3)</enum><header>Limitation</header><text>No 1 project selected under this section shall receive more than 25 percent of the funds authorized for the program under this section.</text></paragraph> 
<paragraph id="H4666B709608B4D508B194C3280A8C19"><enum>(4)</enum><header>Optimization of federal resources</header><text>The Secretary shall consider the extent of involvement of State or local government and other persons in each demonstration project to optimize use of Federal resources.</text></paragraph> 
<paragraph id="H407F6E1B773D43098100928EF755EEB2"><enum>(5)</enum><header>Other criteria</header><text>The Secretary may consider such other criteria as the Secretary considers appropriate.</text></paragraph></subsection> 
<subsection id="HBFA4BAC1E0624DDEA2F323C486332870"><enum>(e)</enum><header>Conditions</header><text>The Secretary shall require that—</text> 
<paragraph id="HB3864097649A45E58E46F645ECA2C61"><enum>(1)</enum><text>relevant information be provided to the Department, the users of the batteries, the proposers, and the battery manufacturers;</text></paragraph> 
<paragraph id="HF4E9D1CE4DAC42C49067B8F2108C6158"><enum>(2)</enum><text>the proposer provide at least 50 percent of the costs associated with the proposal; and</text></paragraph> 
<paragraph id="H5EC3C626890B4B67B37CD5303CD1F887"><enum>(3)</enum><text>the proposer provide to the Secretary such information regarding the disposal of the batteries as the Secretary may require to ensure that the proposer disposes of the batteries in accordance with applicable law.</text></paragraph></subsection></section> 
<section id="HF9AAFA168DFD4A03B05158753DC458A" display-inline="no-display-inline"><enum>307.</enum><header>Definition of cost-effective</header><text display-inline="no-display-inline">For purposes of this subtitle, the term <quote>cost-effective</quote> means resulting in a simple payback of costs in 10 years or less.</text></section> 
<section id="H8D06D619590C4B2584F8F8008BFD7867"><enum>308.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">In addition to the sums authorized in the Steel and Aluminum Energy Conservation and Technology Competitiveness Act of 1988, as amended in section 304 of this Act, the following sums are authorized to be appropriated to the Secretary for the purposes of carrying out this subtitle:</text>

<paragraph id="H2FFBD572B6374451AE559B9E9EA21F21"><enum>(2)</enum><text>the Weatherization Assistance Program under part A of title IV of the Energy Conservation and Production Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6861">42 U.S.C. 6861 et seq.</external-xref>);</text></paragraph>

<subtitle id="HC381B406D38D49598C3DAB469D33001E"><enum>B</enum><header>Distributed Energy and Electric Energy Systems</header> 
<section id="H1259FB3B7587449FB900329611449894"><enum>321.</enum><header>Distributed energy</header> 
<subsection id="H9ACC08D2AC7B4C6D9927CC00D9069F42"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall conduct programs of distributed energy resources and systems reliability and efficiency research, development, demonstration, and commercial application to improve the reliability and efficiency of distributed energy resources and systems, including activities described in this subtitle. The programs shall address advanced energy technologies and systems and advanced grid reliability technologies. The programs shall include the integration of—</text> 
<paragraph id="H51DC3D9AF7FC468EAF3CC64154527BEE"><enum>(1)</enum><text>renewable energy resources;</text></paragraph> 
<paragraph id="H512F5F2571224448B3023588493116F4"><enum>(2)</enum><text>fuel cells;</text></paragraph> 
<paragraph id="H57449666F95541C6976E84B808B9ED5B"><enum>(3)</enum><text>combined heat and power systems;</text></paragraph> 
<paragraph id="H666A64158A714CDF0026E528033D568C"><enum>(4)</enum><text>microturbines;</text></paragraph> 
<paragraph id="H1A9CEBF3185F4BAB80DA58E0D5BDA8CB"><enum>(5)</enum><text>advanced natural gas turbines;</text></paragraph> 
<paragraph id="HC62632DA3FD0430C9064867D20580094"><enum>(6)</enum><text>advanced internal combustion engine generators;</text></paragraph> 
<paragraph id="HA12C6D7C733A47729DFA83D0E8FE16D4"><enum>(7)</enum><text>energy storage devices;</text></paragraph> 
<paragraph id="H0A9B4A03232E487885663688BE81CF8B"><enum>(8)</enum><text>interconnection standards, protocols, and equipment;</text></paragraph> 
<paragraph id="H1024E16A9BEB423E9B1EA6EFCDDA0ED"><enum>(9)</enum><text>ancillary equipment for dispatch and control; and</text></paragraph> 
<paragraph id="H637B9F7FC7CE4176BD77DFEE058731A8"><enum>(10)</enum><text>any other energy technologies, as appropriate.</text></paragraph></subsection> 
<subsection id="H5264F2C0359A4746A5DA005EA1A85FEC"><enum>(b)</enum><header>Micro-cogeneration energy technology</header><text>The Secretary shall make competitive, merit-based grants to consortia for the development of micro-cogeneration energy technology. The consortia shall explore—</text> 
<paragraph id="H89309493720D4F4BA971BDEB146EED2B"><enum>(1)</enum><text>the use of small-scale combined heat and power in residential heating appliances; or</text></paragraph> 
<paragraph id="H997ACA6C2C62447A87233B5C1E7CBA0"><enum>(2)</enum><text>the use of excess power to operate other appliances within the residence and supply excess generated power to the power grid.</text></paragraph></subsection> 
<subsection id="HF7F834E39FFE4194B09963729EB4C5FC" display-inline="no-display-inline"><enum>(c)</enum><header>Goals</header> 
<paragraph id="H2068457EA7E144B6A51537C76096D603"><enum>(1)</enum><header>Initial goals</header><text display-inline="yes-display-inline">In accordance with the performance plan and report requirements in section 4 of the Government Performance Results Act of 1993, the Secretary shall transmit to the Congress, along with the President’s annual budget request for fiscal year 2007, a report containing outcome measures with explicitly stated cost and performance baselines. The measures shall specify performance goals, with quantifiable 5-year cost and energy savings target levels, for distributed energy resources and systems, and any other such goals the Secretary considers appropriate.</text></paragraph> 
<paragraph id="HF93C21B0110B476F95DE8865206214CF"><enum>(2)</enum><header>Subsequent transmittals</header><text>The Secretary shall transmit to the Congress, along with the President’s annual budget request for each fiscal year after 2007, a report containing—</text> 
<subparagraph id="HC670BE39D5DB43E1A7B8BEEA1BEAD99"><enum>(A)</enum><text>a description, including quantitative analysis, of progress in achieving performance goals transmitted under paragraph (1), as compared to the baselines transmitted under paragraph (1); and</text></subparagraph> 
<subparagraph id="H458CB84D795C49BD94705B6D46DB8C74"><enum>(B)</enum><text>any amendments to such goals.</text></subparagraph></paragraph></subsection></section> 
<section id="H0674613DAC4B4A17B5296883E643009E"><enum>322.</enum><header>Electricity transmission and distribution and energy assurance</header> 
<subsection id="H987ADDE3E0A74767ABD000B41E6C26F8"><enum>(a)</enum><header>Program</header><text display-inline="yes-display-inline">The Secretary shall conduct a research, development, demonstration, and commercial application program on advanced control devices to improve the energy efficiency and reliability of the electric transmission and distribution systems and to protect the Nation against severe energy supply disruptions. This program shall address, at a minimum—</text> 
<paragraph id="H3882A1546297435D904CDCA2B0D53EEA"><enum>(1)</enum><text>advanced energy delivery and storage technologies, materials, and systems, including new transmission technologies, such as flexible alternating current transmission systems, composite conductor materials, and other technologies that enhance reliability, operational flexibility, or power-carrying capability;</text></paragraph>

<paragraph id="H1A93CDF2D0EE45A892F58635E1B5C87"><enum>(1)</enum><header>Initial goals</header><text display-inline="yes-display-inline">In accordance with the performance plan and report requirements in section 4 of the Government Performance Results Act of 1993, the Secretary shall transmit to the Congress, along with the President’s annual budget request for fiscal year 2007, a report containing outcome measures with explicitly stated cost and performance baselines. The measures shall specify performance goals, with quantifiable 5-year cost and energy savings target levels, for electricity transmission and distribution and energy assurance, and any other such goals the Secretary considers appropriate.</text></paragraph>

<section id="HA8ED03C6C42144F095A8661E7B870059" section-type="subsequent-section"><enum>401.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following findings:</text> 
<paragraph id="HFFDCB04765C44164AB161F00E1399C75"><enum>(1)</enum><text>Renewable energy is a growth industry around the world. However, the United States has not been investing as heavily as other countries, and is losing market share.</text></paragraph> 
<paragraph id="HAC45B85E93554891BC95E4964FE2A069"><enum>(2)</enum><text>Since 1996, the United States has lost significant market share in the solar industry, dropping from 44 percent of the world market to 13 percent in 2003.</text></paragraph> 
<paragraph id="HAB8B9CAFA33B444593BCE9881229C260"><enum>(3)</enum><text display-inline="yes-display-inline">In 2003, Japan spent more than $200,000,000 on solar research, development, demonstration, and commercial application and other incentives, and Germany provided more than $750,000,000 in low cost financing for solar photovoltaic projects. This compares to United States Government spending of $139,000,000 in 2003 for research, development, demonstration, and commercial application and other incentives.</text></paragraph> 
<paragraph id="HC7B43757370641C79E2F801E0627D2C0"><enum>(4)</enum><text>Germany and Japan each had domestic photovoltaic industries that employed more than 10,000 people in 2003, while in the same year the United States photovoltaics industry employed only 2,000 people.</text></paragraph>

<section id="H4E72B33A80764587B441109E2F6673F8"><enum>402.</enum><header>Definitions</header><text display-inline="no-display-inline">For purposes of this title:</text> 
<paragraph id="H9EF6E67100D24899AC07D4FF9F7204D7"><enum>(1)</enum><header>Biobased product</header><text>The term <quote>biobased product</quote> means a product determined by the Secretary to be a commercial or industrial product (other than food or feed) that is—</text> 
<subparagraph id="H8C7096D662DE4305AB24C952F7D4DC10"><enum>(A)</enum><text>composed, in whole or in significant part, of—</text> 
<clause id="H2B211746992845118CBA3262286B5322"><enum>(i)</enum><text>biological products;</text></clause> 
<clause id="H216CA274F71D49FBA6F49966786EE6DC"><enum>(ii)</enum><text>renewable domestic agricultural materials (including plant, animal, and marine materials); or</text></clause> 
<clause id="H7EABC85326C945E08FB4E4D04B985366"><enum>(iii)</enum><text>forestry materials; and</text></clause></subparagraph> 
<subparagraph id="H468609472B35478D9D698562786B827E"><enum>(B)</enum><text>produced in connection with the conversion of biomass to energy or fuel.</text></subparagraph></paragraph> 
<paragraph id="HCE012BD9F8DF422099913DEA63A29BDC" display-inline="no-display-inline"><enum>(2)</enum><header>Cellulosic biomass</header><text display-inline="yes-display-inline">The term <quote>cellulosic biomass</quote> means a crop containing lignocellulose or hemicellulose, including barley grain, grapeseed, forest thinnings, rice bran, rice hulls, rice straw, soybean matter, sugarcane bagasse, and any crop grown specifically for the purpose of producing cellulosic feedstocks.</text></paragraph></section> 
<section id="HABEDD87240544DAC98268F335C0031F8"><enum>403.</enum><header>Programs</header> 
<subsection id="H2FA9263E23154CEFA63FB4C68F68A2C4"><enum>(a)</enum><header>In general</header><text>The Secretary shall conduct programs of renewable energy research, development, demonstration, and commercial application, including activities described in this title. Such programs shall be focused on the following objectives:</text> 
<paragraph id="H7FCD009531D94552B46470781BA58BBB"><enum>(1)</enum><text>Increasing the conversion efficiency of all forms of renewable energy through improved technologies.</text></paragraph> 
<paragraph id="H81B7C630C1C4489C00C00024779474C"><enum>(2)</enum><text>Decreasing the cost of renewable energy generation and delivery.</text></paragraph> 
<paragraph id="H91140C6DC4C248FF974CDB28F2DCBADC"><enum>(3)</enum><text>Promoting the diversity of the energy supply.</text></paragraph> 
<paragraph id="H701C7DD4E5B8434EAC549B29D45E4386"><enum>(4)</enum><text>Decreasing the Nation’s dependence on foreign energy supplies.</text></paragraph> 
<paragraph id="H51ABB86D33FB4C11A6DDEF4D4C697DB4"><enum>(5)</enum><text>Improving United States energy security.</text></paragraph>

The measures shall specify renewable energy performance goals, with quantifiable 5-year cost and energy savings target levels, for wind power, photovoltaics, solar thermal systems (including concentrating and solar hot water), geothermal energy, biomass-based systems, biofuels, and hydropower, and any other such goals the Secretary considers appropriate.</text></paragraph> 
<paragraph id="H08CBD64F34124F72ACEA80C2518DC1F2"><enum>(2)</enum><header>Subsequent transmittals</header><text>The Secretary shall transmit to the Congress, along with the President’s annual budget request for each fiscal year after 2007, a report containing—</text>

<subsection id="H8E8EF9F3353F4952A0F6DFCEE7D6B3FE" display-inline="no-display-inline"><enum>(c)</enum><header>Public input</header><text display-inline="yes-display-inline">The Secretary shall consider advice from industry, universities, and other interested parties through seeking comments in the Federal Register and other means before transmitting each report under subsection (b).</text></subsection></section>

<subsection id="H7A2D13E72B1C46140094B22977F4DF8"><enum>(a)</enum><header>Program</header><text>The Secretary shall conduct a program of research, development, demonstration, and commercial application for solar energy, including—</text> 
<paragraph id="H6CFFFC129D3F44A5AD009D353C6F65C2"><enum>(1)</enum><text>photovoltaics;</text></paragraph> 
<paragraph id="HF666494FFB784EF193FB35B692999F21"><enum>(2)</enum><text>solar hot water and solar space heating; and</text></paragraph> 
<paragraph id="HD99D015B2EAB4956A500A78503A256E7"><enum>(3)</enum><text>concentrating solar power.</text></paragraph></subsection> 
<subsection id="H5D6C4FF3AD614B69B196AB6D7CF286A3"><enum>(b)</enum><header>Building integration</header><text>For photovoltaics, solar hot water, and space heating, the Secretary shall conduct research, development, demonstration, and commercial application to support the development of products that can be easily integrated into new and existing buildings.</text></subsection> 
<subsection id="H86A53A4B17824EC7884C7C7F005934F4"><enum>(c)</enum><header>Manufacture</header><text>The Secretary shall conduct research, development, demonstration, and commercial application of manufacturing techniques that can produce low-cost, high-quality solar systems.</text></subsection></section> 
<section id="HD64E6A2AAAAD49A6AB009E5822C5C407"><enum>405.</enum><header>Bioenergy programs</header> 
<subsection id="H1A2DBF4B83104826BB7FC89BB9000AF"><enum>(a)</enum><header>Program</header><text>The Secretary shall conduct a program of research, development, demonstration, and commercial application for cellulosic biomass, including—</text> 
<paragraph id="H06335FD37765438000121886D1424083"><enum>(1)</enum><text>biomass conversion to heat and electricity;</text></paragraph> 
<paragraph id="H65A54E5FAE404EFB879926F6CE505500"><enum>(2)</enum><text>biomass conversion to liquid fuels;</text></paragraph> 
<paragraph id="H4D866472ED134746AF1BA32FCBD39B09"><enum>(3)</enum><text>biobased products;</text></paragraph> 
<paragraph id="H6FD0D5E73A144C7683E7931B3F64125"><enum>(4)</enum><text>integrated biorefineries that may produce heat, electricity, liquid fuels, and biobased products;</text></paragraph> 
<paragraph id="HDD359A857DAD4818844938D20000F12C"><enum>(5)</enum><text>cross-cutting activities on feedstocks and enzymes; and</text></paragraph> 
<paragraph id="HDEB6EC6DCBA34EB4B40014522BDC454F"><enum>(6)</enum><text>life-cycle economic analysis.</text></paragraph></subsection> 
<subsection id="H1E614823DEC140C7BB95613061CCE838"><enum>(b)</enum><header>Biofuels and biobased products</header><text>The objectives of the biofuels and biobased products programs under paragraphs (2), (3), and (4) of subsection (a), and of the biorefinery demonstration program under subsection (c), shall be to develop, in partnership with industry—</text> 
<paragraph id="H3318AA0F9AB24F41B2FAFFA0D8B506DF"><enum>(1)</enum><text>advanced biochemical and thermochemical conversion technologies capable of making high-value biobased chemical feedstocks and products, to substitute for petroleum-based feedstocks and products, biofuels that are price-competitive with gasoline or diesel in either internal combustion engines or fuel cell-powered vehicles, and biobased products from a variety of feedstocks, including grains, cellulosic biomass, and agricultural byproducts; and</text></paragraph> 
<paragraph id="H20C62465C7034D399141E35D15BE90B0"><enum>(2)</enum><text>advanced biotechnology processes capable of making biofuels and biobased products, with emphasis on development of biorefinery technologies, including enzyme-based processing technologies.</text></paragraph></subsection> 
<subsection id="H1484BB8E418A45DFA954FB1737F51D6D"><enum>(c)</enum><header>Biomass integrated refinery demonstration</header> 
<paragraph id="HC833BD456369405D8780A94B22E3EF"><enum>(1)</enum><header>In general</header><text>The Secretary shall conduct a program to demonstrate the commercial application of at least 5 integrated biorefineries. The Secretary shall ensure geographical distribution of biorefinery demonstrations under this subsection. The Secretary shall not provide more than $100,000,000 under this subsection for any single biorefinery demonstration. The Secretary shall award the biorefinery demonstrations so as to encourage—</text> 
<subparagraph id="H30402937808846FB929945569EC97504"><enum>(A)</enum><text>the demonstration of a wide variety of cellulosic biomass feedstocks;</text></subparagraph> 
<subparagraph id="H99F6D3E3962B49DCAE911323AB2995F4"><enum>(B)</enum><text>the commercial application of biomass technologies for a variety of uses, including—</text> 
<clause id="HBD29E686D6FB434B8D006EBE2624D1D8"><enum>(i)</enum><text>liquid transportation fuels;</text></clause> 
<clause id="H5F22A9BC0A824077AA233EE7968F789E"><enum>(ii)</enum><text>high-value biobased chemicals;</text></clause> 
<clause id="HDCB254807E9A47D48F17E72EFFC33125"><enum>(iii)</enum><text>substitutes for petroleum-based feedstocks and products; and</text></clause> 
<clause id="HCAAB08ADABAC497980F576503BC13F9"><enum>(iv)</enum><text>energy in the form of electricity or useful heat; and</text></clause></subparagraph> 
<subparagraph id="H27C844A7D91F4754811F4946C1C8A83E"><enum>(C)</enum><text>the demonstration of the collection and treatment of a variety of biomass feedstocks.</text></subparagraph></paragraph> 
<paragraph id="H45E6A5A374F14B21001C67D93F416B00"><enum>(2)</enum><header>Proposals</header><text>Not later than 6 months after the date of enactment of this Act, the Secretary shall solicit proposals for demonstration of advanced biorefineries. The Secretary shall select only proposals that—</text> 
<subparagraph id="H38C4CED3C69747C6B832DAFB20B90585"><enum>(A)</enum><text>demonstrate that the project will be able to operate profitably without direct Federal subsidy after initial construction costs are paid; and</text></subparagraph> 
<subparagraph id="H3D3BC37BC1504E6AA302F2C45175E71B"><enum>(B)</enum><text>enable the biorefinery to be easily replicated.</text></subparagraph></paragraph></subsection> 
<subsection id="HFBA1E9CD827F4F6B8FAA9D24BE98A36C" display-inline="no-display-inline"><enum>(d)</enum><header>Grants</header><text>Of the funds authorized to be appropriated for activities authorized under this section, not less than $5,000,000 for each fiscal year shall be made available for grants to Historically Black Colleges and Universities, Tribal Colleges, and Hispanic-Serving Institutions.</text></subsection></section> 
<section id="H1ACB4B8E331A41A190308DFC1CFA0555"><enum>406.</enum><header>Wind</header> 
<subsection id="H7F1C0AA7CD1547B3AF18DF2C4DA11B05"><enum>(a)</enum><header>Program</header><text>The Secretary shall conduct a program of research, development, demonstration, and commercial application for wind energy, including—</text> 
<paragraph id="H8DD750EFEE43471DA0BDEC9BE5F9868E"><enum>(1)</enum><text>low speed wind energy;</text></paragraph> 
<paragraph id="H88C0BE52BB2C4EE09DD7CBD4F5B43BF"><enum>(2)</enum><text>offshore wind energy;</text></paragraph> 
<paragraph id="H2BF75930969E47D49087EE8E68E4C33"><enum>(3)</enum><text>testing and verification; and</text></paragraph> 
<paragraph id="H897B2FF7EA7E4B05A6F704EA47B563A1"><enum>(4)</enum><text>distributed wind energy generation.</text></paragraph></subsection> 
<subsection id="H0603AFC3FA15472E8DB83B3DDB70DB80"><enum>(b)</enum><header>Facility</header><text>The Secretary shall construct and operate a research and testing facility capable of testing the largest wind turbines that are expected to be manufactured in the next 15 years. The Secretary shall consider the need for testing offshore turbine designs in siting the facility. All private users of the facility shall be required to pay the Department all costs associated with their use of the facility, including capital costs prorated at normal business amortization rates.</text></subsection> 
<subsection id="HBE3F10D08DBD40979FA3CEC1EDEC0466"><enum>(c)</enum><header>Regional field verification program</header><text>Of the funds authorized to be appropriated for activities authorized under this section, not less than $4,000,000 for each fiscal year shall be made available for the Regional Field Verification Program of the Department.</text></subsection></section> 
<section id="H519F6735BBF44D70B278C7C6CCDC9459"><enum>407.</enum><header>Geothermal</header><text display-inline="no-display-inline">The Secretary shall conduct a program of research, development, demonstration, and commercial application for geothermal energy. The program shall focus on developing improved technologies for reducing the costs of geothermal energy installations, including technologies for—</text> 
<paragraph id="H36C5636CC202447D8D1694686C22F1D3"><enum>(1)</enum><text>improving detection of geothermal resources;</text></paragraph> 
<paragraph id="HC41A437C005644FEB97FC12432F9B9C"><enum>(2)</enum><text>decreasing drilling costs;</text></paragraph> 
<paragraph id="H1C23E3B818C2492E95995700F582DC07"><enum>(3)</enum><text>decreasing maintenance costs through improved materials;</text></paragraph> 
<paragraph id="H526C17813DA64A2CA148DE56BA9E5366"><enum>(4)</enum><text>increasing the potential for other revenue sources, such as mineral production; and</text></paragraph> 
<paragraph id="H3E137C9224CE410AB4C0638700A99BCA"><enum>(5)</enum><text>increasing the understanding of reservoir life cycle and management.</text></paragraph></section> 
<section id="H15BFD2DC4AD74190A54C417F169836EA" section-type="subsequent-section" display-inline="no-display-inline"><enum>408.</enum><header>Photovoltaic demonstration program</header> 
<subsection id="HFDFE2961411B4FAB920000B8909BC81C"><enum>(a)</enum><header>In general</header><text>The Secretary shall establish a program of grants to States to demonstrate advanced photovoltaic technology.</text></subsection> 
<subsection id="HFACBCA329D644363BBD0E28E808C0017"><enum>(b)</enum><header>Requirements</header> 
<paragraph id="H44E1E5137295447BBA47A918EADC93B1" display-inline="yes-display-inline"><enum>(1)</enum><text>To receive funding under the program under this section, a State must submit a proposal that demonstrates, to the satisfaction of the Secretary, that the State will meet the requirements of subsection (f).</text></paragraph> 
<paragraph id="HBA0CA3F2121D435AA7403E2000DEC407" indent="up1"><enum>(2)</enum><text>If a State has received funding under this section for the preceding year, the State must demonstrate, to the satisfaction of the Secretary, that it complied with the requirements of subsection (f) in carrying out the program during that preceding year, and that it will do so in the future.</text></paragraph> 
<paragraph id="HC78749C911D4492DA96499F9AB90F92F" indent="up1"><enum>(3)</enum><text>Except as provided in subsection (c), each State submitting a qualifying proposal shall receive funding under the program based on the proportion of United States population in the State according to the 2000 census. In each fiscal year, the portion of funds attributable under this paragraph to States that have not submitted qualifying proposals in the time and manner specified by the Secretary shall be distributed pro rata to the States that have submitted qualifying proposals in the specified time and manner.</text></paragraph></subsection> 
<subsection id="HE715EA6CBE1B42F888799B6F2FB43C1B"><enum>(c)</enum><header>Competition</header><text>If more than $80,000,000 is available for the program under this section for any fiscal year, the Secretary shall allocate 75 percent of the funds available according to subsection (b), and shall award the remaining 25 percent on a competitive basis to the States with the proposals the Secretary considers most likely to encourage the widespread adoption of photovoltaic technologies.</text></subsection> 
<subsection id="HD86048B79C3746E9A0AFEB27F52DB456"><enum>(d)</enum><header>Proposals</header><text>Not later than 6 months after the date of enactment of this Act, and in each subsequent fiscal year for the life of the program, the Secretary shall solicit proposals from the States to participate in the program under this section.</text></subsection> 
<subsection id="H0CF78539138F4D7297FF06C7DAA1816E"><enum>(e)</enum><header>Competitive criteria</header><text>In awarding funds in a competitive allocation under subsection (c), the Secretary shall consider—</text> 
<paragraph id="HD61F8428CC5C48D494B28DF4CB46FC3"><enum>(1)</enum><text>the likelihood of a proposal to encourage the demonstration of, or lower the costs of, advanced photovoltaic technologies; and</text></paragraph> 
<paragraph id="H3DFB940694B346479F3500B77644E19"><enum>(2)</enum><text>the extent to which a proposal is likely to—</text> 
<subparagraph id="HE770170A706D46D3B8FDBEB9009E532C"><enum>(A)</enum><text>maximize the amount of photovoltaics demonstrated;</text></subparagraph> 
<subparagraph id="HEF932A0ACAE74E838CF160005C75B01B"><enum>(B)</enum><text>maximize the proportion of non-Federal cost share; and</text></subparagraph> 
<subparagraph id="HE531E2EDF8664EF0A5C954E0C3398CA"><enum>(C)</enum><text>limit State administrative costs.</text></subparagraph></paragraph></subsection> 
<subsection id="HE4B8D303420046508F4B2699006B7CE3"><enum>(f)</enum><header>State program</header><text display-inline="yes-display-inline">A program operated by a State with funding under this section shall provide competitive awards for the demonstration of advanced photovoltaic technologies. Each State program shall—</text> 
<paragraph id="H9600C58E4B1149639F942083F1506262"><enum>(1)</enum><text>require a contribution of at least 60 percent per award from non-Federal sources, which may include any combination of State, local, and private funds, except that at least 10 percent of the funding must be supplied by the State;</text></paragraph> 
<paragraph id="H5CF10E383E80461886C10916E29059D1"><enum>(2)</enum><text>limit awards for any single project to a maximum of $1,000,000;</text></paragraph> 
<paragraph id="HF3228AAB73604D08A1F9A1434B85C849"><enum>(3)</enum><text>prohibit any nongovernmental recipient from receiving more than $1,000,000 per year;</text></paragraph> 
<paragraph id="H4CF0D39C5EC94D629D4EADC6E6FA0016"><enum>(4)</enum><text>endeavor to fund recipients in the commercial, industrial, institutional, governmental, and residential sectors;</text></paragraph> 
<paragraph id="HA7D2A32C69B54716B10047FEF5BD22"><enum>(5)</enum><text>limit State administrative costs to no more than 10 percent of the grant;</text></paragraph> 
<paragraph id="H54D8A93E75114F4183DA23AAEC3AA61"><enum>(6)</enum><text>report annually to the Department on—</text> 
<subparagraph id="H19C206E1DD364E9CB4819013DA8CDCF1"><enum>(A)</enum><text>the amount of funds disbursed;</text></subparagraph> 
<subparagraph id="H0CAD0AE3F392456E8FDB1EAC073F10AF"><enum>(B)</enum><text>the amount of photovoltaics purchased; and</text></subparagraph> 
<subparagraph id="H3BD9340E997A4B868C4E776EA6672D00"><enum>(C)</enum><text>the results of the monitoring under paragraph (7);</text></subparagraph></paragraph> 
<paragraph id="HBE7AA76D5E8A41B5AC145319C46EE26"><enum>(7)</enum><text>provide for measurement and verification of the output of a representative sample of the photovoltaics systems demonstrated throughout the average working life of the systems, or at least 20 years; and</text></paragraph> 
<paragraph id="H1746BC1F5FDA418EB02F9815A3EA5197"><enum>(8)</enum><text>require that applicant buildings must have received an independent energy efficiency audit during the 6-month period preceding the filing of the application.</text></paragraph></subsection> 
<subsection id="H431A3E2A99C24E03B9C9B5E147907610"><enum>(g)</enum><header>Unexpended funds</header><text>If a State fails to expend any funds received under subsection (b) or (c) within 3 years of receipt, such remaining funds shall be returned to the Treasury.</text></subsection> 
<subsection id="HAD8B329C2BA74B8B8FEE612FB2D1D6DC"><enum>(h)</enum><header>Reports</header><text>The Secretary shall report to Congress 5 years after funds are first distributed to the States under this section—</text> 
<paragraph id="H811E38D0C77E47BD9FF25C6379434E63"><enum>(1)</enum><text>the amount of photovoltaics demonstrated;</text></paragraph> 
<paragraph id="H81EA0B4D0EC04AECAE545D00ACDB6000"><enum>(2)</enum><text>the number of projects undertaken;</text></paragraph> 
<paragraph id="H56821F06966B40BAA59293789E5005E8"><enum>(3)</enum><text>the administrative costs of the program;</text></paragraph> 
<paragraph id="H722E77F8880743ED8000A34BB47D9DA"><enum>(4)</enum><text>the amount of funds that each State has not received because of a failure to submit a qualifying proposal, as described in subsection (b)(3);</text></paragraph> 
<paragraph id="H436B4AAF23BD4DB2A7BC98AC3B687450"><enum>(5)</enum><text>the results of the monitoring under subsection (f)(7); and</text></paragraph> 
<paragraph id="H3B61C056F6B74B8485549FC2F4E8BB00"><enum>(6)</enum><text>the total amount of funds distributed, including a breakdown by State.</text></paragraph></subsection></section> 
<section id="H422E829F4DD7477390FBAEA400F9E15C"><enum>409.</enum><header>Additional programs</header> 
<subsection id="H7A5078875B0F4FDF93F987B05D51F4C"><enum>(a)</enum><header>In general</header><text>The Secretary may conduct research, development, demonstration, and commercial application programs of—</text> 
<paragraph id="H54D963E36D664C25A0E0AA0038F447BA"><enum>(1)</enum><text>ocean energy, including wave energy;</text></paragraph> 
<paragraph id="H47E9D03D81CC44F09ED802ADD2DE44D4"><enum>(2)</enum><text>kinetic hydro turbines; and</text></paragraph> 
<paragraph id="H7711B7BBA4C64A70A5B57144D9824477"><enum>(3)</enum><text>the combined use of renewable energy technologies with one another and with other energy technologies.</text></paragraph></subsection> 
<subsection id="HEFDD468C5E994438A3F81EC589C00634"><enum>(b)</enum><header>Marine renewable energy study</header> 
<paragraph id="H5683FE8F9DEA4E30B7383B2EDBBC3232"><enum>(1)</enum><header>Study</header><text>The Secretary shall enter into an arrangement with the National Academy of Sciences to conduct a study on—</text> 
<subparagraph id="HEA167228D1804C35A82B002D0603DD1E"><enum>(A)</enum><text>the feasibility of various methods of renewable generation of energy from the ocean, including energy from waves, tides, currents, and thermal gradients; and</text></subparagraph> 
<subparagraph id="H09E82D7A119C497A89423D9453A09100"><enum>(B)</enum><text>the research, development, demonstration, and commercial application activities required to make marine renewable energy generation competitive with other forms of electricity generation.</text></subparagraph></paragraph> 
<paragraph id="HC532421CD43147B700C914F244FCC18"><enum>(2)</enum><header>Transmittal</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary shall transmit the study to Congress along with the Secretary’s recommendations for implementing the results of the study.</text></paragraph></subsection></section> 
<section id="HA42EB97EF2E3468CBA7972EC8972CF8B"><enum>410.</enum><header>Analysis and evaluation</header> 
<subsection id="HB7B65F23B49E4832007835A444C75C09"><enum>(a)</enum><header>In general</header><text>The Secretary shall conduct analysis and evaluation in support of the renewable energy programs under this title. These activities shall be used to guide budget and program decisions, and shall include—</text> 
<paragraph id="HBFDE05396D174705B3222CAA8DF0148B"><enum>(1)</enum><text>economic and technical analysis of renewable energy potential, including resource assessment;</text></paragraph> 
<paragraph id="H7FA2D82D76044EF0A3CAAAA383CCA6B"><enum>(2)</enum><text>analysis of past program performance, both in terms of technical advances and in market introduction of renewable energy; and</text></paragraph> 
<paragraph id="H046E5C7941D949C1AF157EA7AB322FEF"><enum>(3)</enum><text>any other analysis or evaluation that the Secretary considers appropriate.</text></paragraph></subsection> 
<subsection id="HFED376C1A346452C007E2EB593F8C56D"><enum>(b)</enum><header>Funding</header><text>The Secretary may designate up to 1 percent of the funds appropriated for carrying out this title for analysis and evaluation activities under this section.</text></subsection></section> 
<section id="H2044C3774DBE401D833592FFD9140534"><enum>411.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">The following sums are authorized to be appropriated to the Secretary for the purposes of carrying out this title:</text>

<section id="HF0342CB3209B43C3AA3175813C4230DC" section-type="subsequent-section"><enum>501.</enum><header>Definition</header><text display-inline="no-display-inline">In this title, the term <quote>junior faculty</quote> means a faculty member who was awarded a doctorate less than 10 years before receipt of an award from the grant program described in section 512(b)(2).</text></section> 
<section id="H9BD4AEB51D0D404B8BCBF1B35C969BBB"><enum>502.</enum><header>Programs</header> 
<subsection id="H4BDF3D5B57F04739A9EF1F2812B7D149"><enum>(a)</enum><header>In general</header><text>The Secretary shall conduct programs of civilian nuclear energy research, development, demonstration, and commercial application, including activities described in this title. Programs under this title shall be focused on—</text> 
<paragraph id="HC6A346FC0D1A4D8C81354772A9C2206C"><enum>(1)</enum><text>enhancing nuclear power’s viability as part of the United States energy portfolio;</text></paragraph> 
<paragraph id="HDABBDEE33E044CD6974078509C63EC4F"><enum>(2)</enum><text>providing the technical means to reduce the likelihood of nuclear proliferation;</text></paragraph> 
<paragraph id="H2D50086BBEB9454AAE4284BD00A7F016"><enum>(3)</enum><text>maintaining a cadre of nuclear scientists and engineers;</text></paragraph> 
<paragraph id="H561EC087313F408AB1CC24E82E9C8B77"><enum>(4)</enum><text>maintaining National Laboratory and university nuclear programs, including their infrastructure;</text></paragraph> 
<paragraph id="H6D140631D1BA44F794A2B191B2007CC4"><enum>(5)</enum><text>supporting both individual researchers and multidisciplinary teams of researchers to pioneer new approaches in nuclear energy, science, and technology;</text></paragraph> 
<paragraph id="H1B7698D767C046E5B0FF68D0DD19FA8"><enum>(6)</enum><text>developing, planning, constructing, acquiring, and operating special equipment and facilities for the use of researchers;</text></paragraph> 
<paragraph id="H3048E9A4CB79470288CC3771FF6192F"><enum>(7)</enum><text>supporting technology transfer and other appropriate activities to assist the nuclear energy industry, and other users of nuclear science and engineering, including activities addressing reliability, availability, productivity, component aging, safety, and security of nuclear power plants; and</text></paragraph> 
<paragraph id="H72D0D5BAF1D14A96A56434E3B0FF9343"><enum>(8)</enum><text>reducing the environmental impact of nuclear energy-related activities.</text></paragraph></subsection> 
<subsection id="H720C04EC322A46398FFEB6E516EC24E6" display-inline="no-display-inline"><enum>(b)</enum><header>Goals</header> 
<paragraph id="H830599D86B6F4C048DA01E6CCC397CE6"><enum>(1)</enum><header>Initial goals</header><text display-inline="yes-display-inline">In accordance with the performance plan and report requirements in section 4 of the Government Performance Results Act of 1993, the Secretary shall transmit to the Congress, along with the President’s annual budget request for fiscal year 2007, a report containing outcome measures with explicitly stated cost and performance baselines. The measures shall specify performance goals, with quantifiable 5-year cost improvement and reliability, availability, productivity, and component aging target levels for a wide range of nuclear energy technologies, and any other such goals the Secretary considers appropriate.</text></paragraph> 
<paragraph id="H71E1B233189B4F6782DB004BAA90DD5F"><enum>(2)</enum><header>Subsequent transmittals</header><text>The Secretary shall transmit to the Congress, along with the President’s annual budget request for each fiscal year after 2007, a report containing—</text> 
<subparagraph id="H38F7D251C8354FF89CCBA371AFB6DB11"><enum>(A)</enum><text>a description, including quantitative analysis, of progress in achieving performance goals transmitted under paragraph (1), as compared to the baselines transmitted under paragraph (1); and</text></subparagraph> 
<subparagraph id="H4F1AC0373D4F481F9BA5F2DD5FFCDF2B"><enum>(B)</enum><text>any amendments to such goals.</text></subparagraph></paragraph></subsection> 
<subsection id="H28D0DBB956ED4A2F8F01DF568EE3B62E"><enum>(c)</enum><header>Public input</header><text display-inline="yes-display-inline">The Secretary shall consider advice from industry, universities, and other interested parties through seeking comments in the Federal Register and other means before transmitting each report under subsection (b).</text></subsection></section> 
<subtitle id="H07566C5112D0496B996D5B8134B6C830"><enum>A</enum><header>Nuclear energy research programs</header> 
<section id="H40EBFA957AD74B0BBBDF8C2D5BBC5BE1"><enum>511.</enum><header>Advanced fuel recycling program</header> 
<subsection id="HE19AE75C266445FD00C073664DCC77C"><enum>(a)</enum><header>In general</header><text>The Secretary shall conduct an advanced fuel recycling technology research, development, demonstration, and commercial application program to evaluate fuel recycling or transmutation technologies which are proliferation-resistant and minimize environmental and public health and safety impacts, as an alternative to aqueous reprocessing technologies deployed as of the date of enactment of this Act, in support of evaluation of alternative national strategies for spent nuclear fuel and advanced reactor concepts. The program shall be subject to annual review by the Secretary’s Nuclear Energy Research Advisory Committee or other independent entity, as appropriate.</text></subsection> 
<subsection id="HB6148119DFFE4B8783D389DF615D5BD"><enum>(b)</enum><header>International cooperation</header><text>The Secretary shall seek opportunities to engage international partners with expertise in advanced fuel recycling technologies where such partnerships may help achieve program goals.</text></subsection></section> 
<section id="HBBF47D8756B24703B66969F685E4B417"><enum>512.</enum><header>University nuclear science and engineering support</header> 
<subsection id="H761E882700054FFFB22B024B186CC6CE"><enum>(a)</enum><header>In general</header><text>The Secretary shall conduct a program to invest in human resources and infrastructure in the nuclear sciences and related fields, including health physics, nuclear engineering, and radiochemistry, consistent with Departmental missions related to civilian nuclear research, development, demonstration, and commercial application.</text></subsection> 
<subsection id="HFE22381E8B024804BD9D3FE78843E2D8"><enum>(b)</enum><header>Requirements</header><text>In carrying out the program under this section, the Secretary shall—</text> 
<paragraph id="HA7C517C5CDCF4E8499455FCFAD04BF59"><enum>(1)</enum><text>conduct a graduate and undergraduate fellowship program to attract new and talented students, which may include fellowships for students to spend time at National Laboratories in the areas of nuclear science, engineering, and health physics with a member of the National Laboratory staff acting as a mentor;</text></paragraph> 
<paragraph id="H9E698402CB9049718D404D9737F78EB8"><enum>(2)</enum><text>conduct a junior faculty research initiation grant program to assist universities in recruiting and retaining new faculty in the nuclear sciences and engineering by awarding grants to junior faculty for research on issues related to nuclear energy engineering and science;</text></paragraph> 
<paragraph id="H280AED8ECDF648B5BA800091B34CA86E"><enum>(3)</enum><text>support fundamental nuclear sciences, engineering, and health physics research through a nuclear engineering education and research program;</text></paragraph>

<paragraph id="H7B284B52A21E473FB5337D512D9C4B00"><enum>(5)</enum><text>support communication and outreach related to nuclear science, engineering, and health physics.</text></paragraph></subsection> 
<subsection id="H979092B9D88F4465B92CF88F71F64029"><enum>(c)</enum><header>Strengthening university research and training reactors and associated infrastructure</header><text>In carrying out the program under this section, the Secretary may support—</text> 
<paragraph id="HA350170BD6DE49BD99FC2148E8FA4DC6"><enum>(1)</enum><text>converting research reactors from high-enrichment fuels to low-enrichment fuels and upgrading operational instrumentation;</text></paragraph> 
<paragraph id="HEA57E2C8FB514ECCA25C0035782475FC"><enum>(2)</enum><text>consortia of universities to broaden access to university research reactors;</text></paragraph> 
<paragraph id="HA1244EC54059448DBB2872E62280947F"><enum>(3)</enum><text>student training programs, in collaboration with the United States nuclear industry, in relicensing and upgrading reactors, including through the provision of technical assistance; and</text></paragraph> 
<paragraph id="HE6228178C80649DBB869E071004D0530"><enum>(4)</enum><text>reactor improvements as part of a focused effort that emphasizes research, training, and education, including through the Innovations in Nuclear Infrastructure and Education Program or any similar program.</text></paragraph></subsection> 
<subsection id="H0FA54DF71C0C4A1F8FB8700DF524FAC"><enum>(d)</enum><header>Operations and maintenance</header><text display-inline="yes-display-inline">Funding for a project provided under this section may be used for a portion of the operating and maintenance costs of a research reactor at a university used in the project.</text></subsection></section> 
<section id="HABB5B86F8A784F9FBD7EF9B452376D4C" commented="no"><enum>513.</enum><header>University-National Laboratory interactions</header><text display-inline="no-display-inline">The Secretary shall conduct—</text> 
<paragraph id="H90B557A8391C4C11A54C62DB40B0A3DB" commented="no"><enum>(1)</enum><text>a fellowship program for professors at universities to spend sabbaticals at National Laboratories in the areas of nuclear science and technology; and</text></paragraph> 
<paragraph id="HEF9254AF4636444EBD2D437C55C4CABD" commented="no"><enum>(2)</enum><text>a visiting scientist program in which National Laboratory staff can spend time in academic nuclear science and engineering departments.</text></paragraph></section> 
<section id="HEE5B7059BD444A11BB496BC573D13EF6"><enum>514.</enum><header>Nuclear Power 2010 Program</header><text display-inline="no-display-inline">The Secretary shall carry out a Nuclear Power 2010 Program, consistent with recommendations in the October 2001 report entitled <quote>A Roadmap to Deploy New Nuclear Power Plants in the United States by 2010</quote> issued by the Nuclear Energy Research Advisory Committee of the Department. The Program shall include—</text> 
<paragraph id="H4216E1E615BE48E4A75DF8D66761F199"><enum>(1)</enum><text>the expertise and capabilities of industry, universities, and National Laboratories in evaluation of advanced nuclear fuel cycles and fuels testing;</text></paragraph> 
<paragraph id="HE29553D61C24450EAAC6A4DF6606B0DE"><enum>(2)</enum><text>a variety of reactor designs suitable for both developed and developing nations;</text></paragraph> 
<paragraph id="H5D3822763E0B4057A2F1109C84802B00"><enum>(3)</enum><text>participation of international collaborators in research, development, and design efforts as appropriate; and</text></paragraph> 
<paragraph id="H319C4B987D2642429BE5FC9867015D29"><enum>(4)</enum><text>university and industry participation.</text></paragraph></section> 
<section id="H0BBB57F5B161465B890654A0580917D7"><enum>515.</enum><header>Generation IV Nuclear Energy Systems Initiative</header><text display-inline="no-display-inline">The Secretary shall carry out a Generation IV Nuclear Energy Systems Initiative to develop an overall technology plan and to support research, development, demonstration, and commercial application necessary to make an informed technical decision about the most promising candidates for the eventual commercial application of advanced fission reactor technology for the generation of electricity. The Initiative shall examine advanced proliferation-resistant and passively safe reactor designs, including designs that—</text> 
<paragraph id="H0C59168D18F943F99E9600F291F0C987"><enum>(1)</enum><text>are economically competitive with other electric power generation plants;</text></paragraph> 
<paragraph id="H458FB68C007D4CEC8E4B15F0FD761E4B"><enum>(2)</enum><text>have higher efficiency, lower cost, and improved safety compared to reactors in operation on the date of enactment of this Act;</text></paragraph> 
<paragraph id="H30639E56EFA54331A7AEA65EBE34D05"><enum>(3)</enum><text>use fuels that are proliferation-resistant and have substantially reduced production of high-level waste per unit of output; and</text></paragraph> 
<paragraph id="H757AF51F049F488681E9C5D787F32EDD"><enum>(4)</enum><text>use improved instrumentation.</text></paragraph></section> 
<section id="H8D0686E5C4D14D429742E6509504C7F4" section-type="subsequent-section" display-inline="no-display-inline"><enum>516.</enum><header>Civilian infrastructure and facilities</header><text display-inline="no-display-inline">The Secretary shall operate and maintain infrastructure and facilities to support the nuclear energy research, development, demonstration, and commercial application programs, including radiological facilities management, isotope production, and facilities management.</text></section> 
<section id="H5936D5F782B4410396F0FA28E1F261FC"><enum>517.</enum><header>Nuclear energy research and development infrastructure plan</header><text display-inline="no-display-inline">In carrying out section 209, the Secretary shall—</text> 
<paragraph id="H74E9FA5F58484E1CB686449438A72FD5"><enum>(1)</enum><text>develop an inventory of nuclear science and engineering facilities, equipment, expertise, and other assets at all of the National Laboratories;</text></paragraph> 
<paragraph id="HE7C8285AFB37464ABEE32BC5AA44897B"><enum>(2)</enum><text>develop a prioritized list of nuclear science and engineering plant and equipment improvements needed at each of the National Laboratories;</text></paragraph> 
<paragraph id="HA0D042F013B74BA7B25163BBE4B4C92"><enum>(3)</enum><text>consider the available facilities and expertise at all National Laboratories and emphasize investments which complement rather than duplicate capabilities; and</text></paragraph> 
<paragraph id="HF0B3C8E18C634DCF8FFEB67F3BDD957"><enum>(4)</enum><text>develop a timeline and a proposed budget for the completion of deferred maintenance on plant and equipment,</text></paragraph><continuation-text continuation-text-level="section">with the goal of ensuring that Department programs under this title will be generally recognized to be among the best in the world.</continuation-text></section> 
<section id="H4555D10076FD4757A5F35BB230005288"><enum>518.</enum><header>Idaho National Laboratory facilities plan</header> 
<subsection id="HE8D6F3E055094D5C8CBCA5EEEBDF7C4B"><enum>(a)</enum><header>Plan</header><text display-inline="yes-display-inline">The Secretary shall develop a comprehensive plan for the facilities at the Idaho National Laboratory, especially taking into account the resources available at other National Laboratories. In developing the plan, the Secretary shall—</text> 
<paragraph id="HBE0ABF5EA8D4426D8FDBD34F6328A1C3"><enum>(1)</enum><text>evaluate the facilities planning processes utilized by other physical science and engineering research and development institutions, both in the United States and abroad, that are generally recognized as being among the best in the world, and consider how those processes might be adapted toward developing such facilities plan;</text></paragraph> 
<paragraph id="H1198350E561C4CA5988DC54034C1E203"><enum>(2)</enum><text>avoid duplicating, moving, or transferring nuclear science and engineering facilities, equipment, expertise, and other assets that currently exist at other National Laboratories;</text></paragraph> 
<paragraph id="HD16A84C603EA4B36A1CB8FF15D393537"><enum>(3)</enum><text>consider the establishment of a national transuranic analytic chemistry laboratory as a user facility at the Idaho National Laboratory;</text></paragraph> 
<paragraph id="HBEAC6648362D4204AE2080B72284581E"><enum>(4)</enum><text>include a plan to develop, if feasible, the Advanced Test Reactor and Test Reactor Area into a user facility that is more readily accessible to academic and industrial researchers;</text></paragraph> 
<paragraph id="HBE6829526E3B410B9F581D00DD904041"><enum>(5)</enum><text>consider the establishment of a fast neutron source as a user facility;</text></paragraph> 
<paragraph id="H999197E29180474F814D446B1D39D2F4"><enum>(6)</enum><text>consider the establishment of new <quote>hot cells</quote> and the configuration of <quote>hot cells</quote> most likely to advance research, development, demonstration, and commercial application in nuclear science and engineering, especially in the context of the condition and availability of these facilities elsewhere in the National Laboratories; and</text></paragraph> 
<paragraph id="H4D48095915184C39AB2E68118FB09900"><enum>(7)</enum><text>include a timeline and a proposed budget for the completion of deferred maintenance on plant and equipment.</text></paragraph></subsection> 
<subsection id="H783AB93C9DA74D4F91AEF43500704055"><enum>(b)</enum><header>Transmittal to Congress</header><text>Not later than one year after the date of enactment of this Act, the Secretary shall transmit such plan to Congress.</text></subsection></section>

<paragraph id="H875F6E40C2E640909D8273B3BD15AA64"><enum>(1)</enum><header>Construction</header><text>The term <quote>construction</quote> means the physical construction of the demonstration plant, and the physical construction, purchase, or manufacture of equipment or components that are specifically designed for the demonstration plant, but does not mean the design of the facility, equipment, or components.</text></paragraph> 
<paragraph id="H372A3BAF700E4A6E969DD75857005ED"><enum>(2)</enum><header>Demonstration plant</header><text display-inline="yes-display-inline">The term “demonstration plant” means an advanced fission reactor power plant constructed and operated in accordance with this subtitle.</text></paragraph> 
<paragraph id="HC4686CC7641745EBA2691310FF4315AE"><enum>(3)</enum><header>Operation</header><text>The term <quote>operation</quote> means the operation of the demonstration plant, including general maintenance and provision of power, heating and cooling, and other building services that are specifically for the demonstration plant, but does not mean operations that support other activities colocated with the demonstration plant.</text></paragraph></section> 
<section id="H93A7B8F85C694F41B4115C2F5DFAB842"><enum>532.</enum><header>Next generation nuclear power plant</header> 
<subsection id="H67F70D663E7543DD9830A1EF022D4833"><enum>(a)</enum><header>In general</header><text>The Secretary shall conduct a program of research, development, demonstration, and commercial application of advanced nuclear fission reactor technology. The objective of this program shall be to demonstrate the technical and economic feasibility of an advanced nuclear fission reactor power plant design for the commercial production of electricity.</text></subsection> 
<subsection id="H221124309FEB434D8CCAFF1C4100F597"><enum>(b)</enum><header>Research and development</header><text>The program shall include research, development, design, planning, and all other necessary activities to support the construction and operation of the demonstration plant.</text></subsection> 
<subsection id="HA93D2845D36340F8857870A0C59D53D8" display-inline="no-display-inline"><enum>(c)</enum><header>Subsystem demonstrations</header><text>The Secretary shall support demonstration of enabling technologies and subsystems and other research, development, demonstration, and commercial application activities necessary to support the activities in this subtitle.</text></subsection> 
<subsection id="H7F207AC3D34F4C6FB058E643103520D0"><enum>(d)</enum><header>Construction and operation</header><text>The program shall culminate in the construction and operation of the demonstration plant based on a design selected by the Secretary in accordance with procedures described in the plan required by section 534(c). The demonstration plant shall be located and constructed within the United States and shall be operational, and capable of demonstrating the commercial production of electricity, by December 31, 2015.</text></subsection> 
<subsection id="H9416E6D7173F490E90138490AF7BC300"><enum>(e)</enum><header>Limitation</header><text>No funds shall be expended for the construction or operation of the demonstration plant until 90 days have elapsed after the transmission of the plan described in section 534(c).</text></subsection></section> 
<section id="H68EA3E341D094A4CBF3C67187CB4A115" display-inline="no-display-inline"><enum>533.</enum><header>Advisory committee</header><text display-inline="no-display-inline">The Secretary shall appoint a Next Generation Nuclear Power Plant Subcommittee of the Nuclear Energy Research Advisory Council to provide advice to the Secretary on technical matters and program management for the duration of the program and construction project under this subtitle.</text></section> 
<section id="HD27870375A4845F600D54DAA27214898"><enum>534.</enum><header>Program requirements</header> 
<subsection id="HA69DF21EE5A041179C56005B23087D00"><enum>(a)</enum><header>Partnerships</header><text>In carrying out the program under this subtitle, the Secretary shall make use of partnerships with industry for the research, development, design, construction, and operation of the demonstration plant. In establishing such partnerships, the Secretary shall give preference to companies for which the principal base of operations is located in the United States.</text></subsection> 
<subsection id="H7074FA46A39E493398DD00953455D499"><enum>(b)</enum><header>International collaboration</header> 
<paragraph id="HEA6CA0E24E864B28A8973DE96013A800" display-inline="yes-display-inline"><enum>(1)</enum><text>The Secretary shall seek international cooperation, participation, and financial contribution in this program, including assistance from specialists or facilities from member countries of the Generation IV International Forum, the Russian Federation, or other international partners where such specialists or facilities provide access to cost-effective and relevant skills or test capabilities.</text></paragraph> 
<paragraph id="H1BF3B7A7D88C4F11B37085E2453941C8" indent="up1"><enum>(2)</enum><text>International activities shall be carried out in consultation with the Generation IV International Forum.</text></paragraph> 
<paragraph id="HF4B382E1740B436090116EB710BA13FE" indent="up1"><enum>(3)</enum><text>The program may include demonstration of selected program objectives in a partner nation.</text></paragraph></subsection> 
<subsection id="H55B6E46D16004F3398E39E663FA2B6AE"><enum>(c)</enum><header>Program plan</header><text>Not later than one year after the date of enactment of this Act, the Secretary shall transmit to Congress a comprehensive program plan. The program plan shall—</text> 
<paragraph id="H418A644C60334007BD3816E641FB0023"><enum>(1)</enum><text>describe the plan for development, selection, management, ownership, operation, and decommissioning of the demonstration plant;</text></paragraph> 
<paragraph id="HF611011FF379471084BCF034001D5C24"><enum>(2)</enum><text>identify program milestones and a timeline for achieving these milestones;</text></paragraph> 
<paragraph id="H6B12285E1B5342E58DCE009FB725EEE5"><enum>(3)</enum><text>provide for development of risk-based criteria for any future commercial development of a reactor architecture based on that of the demonstration plant;</text></paragraph> 
<paragraph id="H026D0070CEF54BE5BECAD2BA65FACDC"><enum>(4)</enum><text>include a projected budget required to meet the milestones; and</text></paragraph> 
<paragraph id="H5420510F5E5446D88908A0A8659ED6E"><enum>(5)</enum><text>include an explanation of any major program decisions that deviate from program advice given to the Secretary by the advisory committee established under section 533.</text></paragraph></subsection></section>

<section id="H7F2F6FDC8996411C92E5E17039D22542" section-type="subsequent-section" display-inline="no-display-inline"><enum>601.</enum><header>Enhanced fossil energy research and development programs</header> 
<subsection id="HFFA8A824BB514B61B92559B7601004D"><enum>(a)</enum><header>In general</header><text>The Secretary shall, in conjunction with industry, conduct fossil energy research, development, demonstration, and commercial applications programs, including activities under this subtitle, with the goal of improving the efficiency, effectiveness, and environmental performance of fossil energy production, upgrading, conversion, and consumption. Such programs shall be focused on—</text> 
<paragraph id="H06E60324973044D6917D6C3C5789BE20"><enum>(1)</enum><text>increasing the conversion efficiency of all forms of fossil energy through improved technologies;</text></paragraph> 
<paragraph id="HE840FE170A1B4AA7B9E395C8160345AB"><enum>(2)</enum><text>decreasing the cost of all fossil energy production, generation, and delivery;</text></paragraph> 
<paragraph id="HCF2E8EF27EA74BB99BBDC361D200A4CA"><enum>(3)</enum><text>promoting diversity of energy supply;</text></paragraph> 
<paragraph id="HEBF7EAD46A164FCCAD8DE8FCFA3872E"><enum>(4)</enum><text>decreasing the Nation’s dependence on foreign energy supplies;</text></paragraph> 
<paragraph id="HDC84837E16C041F7BE9DED7E858EFEA6"><enum>(5)</enum><text>improving United States energy security;</text></paragraph> 
<paragraph id="H8865A35933E34F8DA1905E00727D80E0"><enum>(6)</enum><text>decreasing the environmental impact of energy-related activities; and</text></paragraph> 
<paragraph id="H3621872CFBA94BE00057BF37C2DAA624"><enum>(7)</enum><text>increasing the export of fossil energy-related equipment, technology, and services from the United States.</text></paragraph></subsection> 
<subsection id="HFF85902FC1FE4A0888B90061C5D965F" display-inline="no-display-inline"><enum>(b)</enum><header>Goals</header> 
<paragraph id="H37F32D8DADB34830951F5F04E8D822C8"><enum>(1)</enum><header>Initial goals</header><text display-inline="yes-display-inline">In accordance with the performance plan and report requirements in section 4 of the Government Performance Results Act of 1993, the Secretary shall transmit to the Congress, along with the President’s annual budget request for fiscal year 2007, a report containing outcome measures with explicitly stated cost and performance baselines. The measures shall specify production or efficiency performance goals, with quantifiable 5-year cost and energy savings target levels, for fossil energy, and any other such goals the Secretary considers appropriate.</text></paragraph> 
<paragraph id="H056EC7C01ABE40F7916B0028384525B6"><enum>(2)</enum><header>Subsequent transmittals</header><text>The Secretary shall transmit to the Congress, along with the President’s annual budget request for each fiscal year after 2007, a report containing—</text> 
<subparagraph id="H71E99ECDC1C64C1B903894982C122D82"><enum>(A)</enum><text>a description, including quantitative analysis, of progress in achieving performance goals transmitted under paragraph (1), as compared to the baselines transmitted under paragraph (1); and</text></subparagraph> 
<subparagraph id="H032B55CD323C481F962E714165F99800"><enum>(B)</enum><text>any amendments to such goals.</text></subparagraph></paragraph></subsection> 
<subsection id="H139F42CE8AFC44A691EA6C5400041111"><enum>(c)</enum><header>Covered activities</header><text>The Secretary shall ensure that the goals stated in subsection (b) are illustrative of the outcomes necessary to promote acceptance of the programs’ efforts in the marketplace, but at a minimum shall encompass the following areas:</text> 
<paragraph id="H4CD4F6BAB7F04881B08BF2C59B395F9F"><enum>(1)</enum><text>Coal gasifiers.</text></paragraph> 
<paragraph id="H78CE85E547FC4979B87D88CBCBC5B751"><enum>(2)</enum><text>Turbine generators, including both natural gas and syngas fueled.</text></paragraph> 
<paragraph id="HC66D1C69F7AD45558B341BCDD6527667"><enum>(3)</enum><text>Oxygen separation devices, hydrogen separation devices, and carbon dioxide separation technologies.</text></paragraph> 
<paragraph id="H44BF5BC2F60D461B82C21B06FAB778EE"><enum>(4)</enum><text>Coal gas and post-combustion emission cleanup and disposal equipment, including carbon dioxide capture and disposal equipment.</text></paragraph> 
<paragraph id="HFC6B596F08D64EE2A7315700888300F0"><enum>(5)</enum><text>Average per-foot drilling costs for oil and gas, segregated by appropriate drilling regimes, including onshore versus offshore and depth categories.</text></paragraph> 
<paragraph id="H73ECCDD49AA047A48DF12D667C478C21"><enum>(6)</enum><text>Production of liquid fuels from nontraditional feedstocks, including syngas, biomass, methane, and combinations thereof.</text></paragraph> 
<paragraph id="HB86D17CF4C7143689B60A115BCF3CA"><enum>(7)</enum><text>Environmental discharge per barrel of oil or oil-equivalent production, including reinjected waste.</text></paragraph> 
<paragraph id="HEB5F2EBED7AC4D018247DF572DA06200"><enum>(8)</enum><text>Surface disturbance on both a per-well and per-barrel of oil or oil-equivalent production basis.</text></paragraph></subsection> 
<subsection id="H988F9E38F5434BC993E76DAC00700634"><enum>(d)</enum><header>Public input</header><text display-inline="yes-display-inline">The Secretary shall consider advice from industry, universities, and other interested parties through seeking comments in the Federal Register and other means before transmitting each report under subsection (b).</text></subsection></section> 
<section id="HB78C520E4AD84488A15342B5058FB2BB"><enum>602.</enum><header>Fossil research and development</header> 
<subsection id="H23030F24DAB4415299FEF08498C5D41D"><enum>(a)</enum><header>Objectives</header><text>The Secretary shall conduct a program of fossil research, development, demonstration, and commercial application, whose objective shall be to reduce emissions from fossil fuel use by developing technologies, including precombustion technologies, by 2015 with the capability of—</text> 
<paragraph id="H279D779E2F5F4C55ACBDF8AAC17E4FF2"><enum>(1)</enum><text>dramatically increasing electricity generating efficiencies of coal and natural gas;</text></paragraph> 
<paragraph id="H0CB35DEDBC6145FF9EB4326C1D35B9AF"><enum>(2)</enum><text>improving combined heat and power thermal efficiencies;</text></paragraph> 
<paragraph id="H7FC6E4C8916F47FE9C6B29E074F9DFA7"><enum>(3)</enum><text>improving fuels utilization efficiency of production of liquid transportation fuels from coal;</text></paragraph> 
<paragraph id="HDA3FA5D2F7474DAE96C466D9FC32E99F"><enum>(4)</enum><text>achieving near-zero emissions of mercury and of emissions that form fine particles, smog, and acid rain;</text></paragraph> 
<paragraph id="H5D507D53C6B84B5AB124E79EC500CF51"><enum>(5)</enum><text>reducing carbon dioxide emissions by at least 40 percent through efficiency improvements and by 100 percent with sequestration; and</text></paragraph> 
<paragraph id="H4D6092D8F26F4782BA7FD169E2E57950"><enum>(6)</enum><text>improved reliability, efficiency, reductions of air pollutant emissions, and reductions in solid waste disposal requirements.</text></paragraph></subsection> 
<subsection id="HC55E1EA9DCFC495D99107FD4369C00BF"><enum>(b)</enum><header>Coal-based projects</header><text>The coal-based projects authorized under this section shall be consistent with the objective stated in subsection (a). The program shall emphasize carbon capture and sequestration technologies and gasification technologies, including gasification combined cycle, gasification fuel cells, gasification coproduction, hybrid gasification/combustion, or other technologies with the potential to address the capabilities described in paragraphs (4) and (5) of subsection (a).</text></subsection></section> 
<section id="H767BCA0689A8437889E1F45F82B43977"><enum>603.</enum><header>Oil and gas research and development</header><text display-inline="no-display-inline">The Secretary shall conduct a program of oil and gas research, development, demonstration, and commercial application, whose objective shall be to advance the science and technology available to domestic petroleum producers, particularly independent operators, to minimize the economic dislocation caused by the decline of domestic supplies of oil and natural gas resources by focusing research on—</text> 
<paragraph id="H2335867F12DB44F184A847876CDFC011"><enum>(1)</enum><text>assisting small domestic producers of oil and gas to develop new and improved technologies to discover and extract additional supplies;</text></paragraph> 
<paragraph id="H41DFCE27BCA74FA28731E8D366EF6B82"><enum>(2)</enum><text>developing technologies to extract methane hydrates in an environmentally sound manner;</text></paragraph> 
<paragraph id="H26A17284C5DB46D1A867129FE6E35832"><enum>(3)</enum><text>improving the ability of the domestic industry to extract hydrocarbons from known reservoirs and classes of reservoirs; and</text></paragraph> 
<paragraph id="H782D9E4FBA9C4D15A13066FF44B7B9D0"><enum>(4)</enum><text>reducing the cost, and improving the efficiency and environmental performance, of oil and gas exploration and extraction activities, focusing especially on unconventional sources such as tar sands, heavy oil, and shale oil.</text></paragraph></section> 
<section id="HC84DEF9D4E754C65A600EB2E008F40C2"><enum>604.</enum><header>Transportation fuels</header><text display-inline="no-display-inline">The Secretary shall conduct a program of transportation fuels research, development, demonstration, and commercial application, whose objective shall be to increase the price elasticity of oil supply and demand by focusing research on—</text> 
<paragraph id="H93F9FBF7E7284C44898CFF192ACF29D"><enum>(1)</enum><text>reducing the cost of producing transportation fuels from coal and natural gas; and</text></paragraph> 
<paragraph id="HEDE16247896540EBAE8C70D23FE47FED"><enum>(2)</enum><text>indirect liquefaction of coal and biomass.</text></paragraph></section> 
<section id="H6FE53E6A5EE3454E82C2E9B5E72C1213"><enum>605.</enum><header>Fuel cells</header> 
<subsection id="H35556E7FB29F4DAA86EA79DB0073D324"><enum>(a)</enum><header>Program</header><text>The Secretary shall conduct a program of research, development, demonstration, and commercial application of fuel cells for low-cost, high-efficiency, fuel-flexible, modular power systems.</text></subsection> 
<subsection id="H125F3BA27FF84A86B269A3A846742823"><enum>(b)</enum><header>Demonstration</header><text>The program under this section shall include demonstration of fuel cell proton exchange membrane technology for commercial, residential, and transportation applications, and distributed generation systems, utilizing improved manufacturing production and processes.</text></subsection></section> 
<section id="H89BF0D9DC7214665B7433F30A7B2C2A7"><enum>606.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">The following sums are authorized to be appropriated to the Secretary for the purposes of carrying out this subtitle:</text>

<paragraph id="H54EFB48EDD424AE7A827C09CEE6F616"><enum>(3)</enum><text>For fiscal year 2008, $626,000,000.</text></paragraph> 
<paragraph id="H3A6FD85C33634EEBBB5F91358838B2AC"><enum>(4)</enum><text>For fiscal year 2009, $641,000,000.</text></paragraph>

<subtitle id="HEC7B05AF0B664B2FBB2E71C0A9006170"><enum>B</enum><header>Ultra-Deepwater and Unconventional Natural Gas and Other Petroleum Resources</header> 
<section id="H811E2513A81B40209F414431D288949E"><enum>611.</enum><header>Program authority</header> 
<subsection id="H5AB25186DB0C4D778000186D1F946B00"><enum>(a)</enum><header>In general</header><text>The Secretary shall carry out a program under this subtitle of research, development, demonstration, and commercial application of technologies for ultra-deepwater and unconventional natural gas and other petroleum resource exploration and production, including addressing the technology challenges for small producers, safe operations, and environmental mitigation (including reduction of greenhouse gas emissions and sequestration of carbon).</text></subsection> 
<subsection id="H0A3BFE61EDC64950A5D03C084DD58200" display-inline="no-display-inline"><enum>(b)</enum><header>Methane hydrate report</header><text>Within 6 months of enactment, the Secretary shall report to Congress on whether the activities described in the Methane Hydrates Act of 2000 (114 Stat. 234 or <external-xref legal-doc="usc" parsable-cite="usc/30/1902">30 U.S.C. 1902</external-xref> note) should be carried out under this subtitle.</text></subsection> 
<subsection id="HBCF14AD318DD41EC94A96CCD41A17FAB"><enum>(c)</enum><header>Program elements</header><text>The program under this subtitle shall address the following areas, including improving safety and minimizing environmental impacts of activities within each area:</text> 
<paragraph id="HB17F98AF86294DBEA3FA7BD3B5F34F4B"><enum>(1)</enum><text>Ultra-deepwater technology, including drilling to formations in the Outer Continental Shelf to depths greater than 15,000 feet.</text></paragraph> 
<paragraph id="H8D4C03292472432EB5A658DE12F923D5"><enum>(2)</enum><text>Ultra-deepwater architecture.</text></paragraph> 
<paragraph id="H38C34303897743C491A81CEDF5C1E3EE"><enum>(3)</enum><text>Unconventional natural gas and other petroleum resource exploration and production technology, including the technology challenges of small producers.</text></paragraph></subsection> 
<subsection id="HB27DEC5703DC49CDB5E8DDEEC06FFF36"><enum>(d)</enum><header>Limitation on location of field activities</header><text>Field activities under the program under this subtitle shall be carried out only—</text> 
<paragraph id="HBCB23F65DC434C9397AB54DEB5A576F8"><enum>(1)</enum><text>in—</text> 
<subparagraph id="H76A11882E0B447DEBF031600EF1A592"><enum>(A)</enum><text>areas in the territorial waters of the United States not under any Outer Continental Shelf moratorium as of September 30, 2002;</text></subparagraph> 
<subparagraph id="H1C7FB18E83B24069B0F57CD5CB07C7D"><enum>(B)</enum><text>areas onshore in the United States on public land administered by the Secretary of the Interior available for oil and gas leasing, where consistent with applicable law and land use plans; and</text></subparagraph> 
<subparagraph id="HD712CA578B74452CA5AAF129EEB38237"><enum>(C)</enum><text>areas onshore in the United States on State or private land, subject to applicable law; and</text></subparagraph></paragraph> 
<paragraph id="H735E2BA7C4B34316894417C3216DB8B"><enum>(2)</enum><text>with the approval of the appropriate Federal or State land management agency or private land owner.</text></paragraph></subsection> 
<subsection id="HCDBD0473E8304CE9B48369362BA94B77"><enum>(e)</enum><header>Research at National Energy Technology Laboratory</header><text>The Secretary, through the National Energy Technology Laboratory, shall carry out research complementary to research under subsection (b).</text></subsection> 
<subsection id="H0B120B782BD04E2CA6D722D2C0E00E2"><enum>(f)</enum><header>Consultation with Secretary of the Interior</header><text>In carrying out this subtitle, the Secretary shall consult regularly with the Secretary of the Interior.</text></subsection></section> 
<section id="HA23B37C541804094B870F8D715559BFE"><enum>612.</enum><header>Ultra-deepwater program</header> 
<subsection id="HB4A5D8801D404316B2C9CCF98199D6B5"><enum>(a)</enum><header>In general</header><text>The Secretary shall carry out the activities under section 611(a), to maximize the use of the ultra-deepwater natural gas and other petroleum resources of the United States by increasing the supply of such resources, through reducing the cost and increasing the efficiency of exploration for and production of such resources, while improving safety and minimizing environmental impacts.</text></subsection> 
<subsection id="H6BF0E21D66674D7EACC2007E96B57600"><enum>(b)</enum><header>Role of the Secretary</header><text>The Secretary shall have ultimate responsibility for, and oversight of, all aspects of the program under this section.</text></subsection> 
<subsection id="HAB5D37E59B4440CBA000ADBED94C4E9C"><enum>(c)</enum><header>Role of the Program consortium</header> 
<paragraph id="H987B8579AB3A4E9500A2D2BFA624361"><enum>(1)</enum><header>In general</header><text>The Secretary may contract with a consortium to—</text> 
<subparagraph id="H22DDA8B5A30B4BCFBD28B9CA52599D0"><enum>(A)</enum><text>manage awards pursuant to subsection (f)(4);</text></subparagraph> 
<subparagraph id="H2649F4679D1B4372BDA81A67442C305"><enum>(B)</enum><text>make recommendations to the Secretary for project solicitations;</text></subparagraph> 
<subparagraph id="HFA76CF5B300F4C8F87D5810000360000"><enum>(C)</enum><text>disburse funds awarded under subsection (f) as directed by the Secretary in accordance with the annual plan under subsection (e); and</text></subparagraph> 
<subparagraph id="HC09C0ED9518A452180CC48E3EB16FBFF"><enum>(D)</enum><text>carry out other activities assigned to the program consortium by this section.</text></subparagraph></paragraph> 
<paragraph id="H4C65FA289ABA4A5000E745492CDB1FEC"><enum>(2)</enum><header>Limitation</header><text>The Secretary may not assign any activities to the program consortium except as specifically authorized under this section.</text></paragraph> 
<paragraph id="H33D5FA0F304248E6A5A0A0554F880040"><enum>(3)</enum><header>Conflict of interest</header> 
<subparagraph id="H4745780BDC544E60BB8F8E4757698079"><enum>(A)</enum><header>Procedures</header><text>The Secretary shall establish procedures—</text> 
<clause id="H468604BCE29F4799A073989C76DDEAB3"><enum>(i)</enum><text>to ensure that each board member, officer, or employee of the program consortium who is in a decision-making capacity under subsection (f)(3) or (4) shall disclose to the Secretary any financial interests in, or financial relationships with, applicants for or recipients of awards under this section, including those of his or her spouse or minor child, unless such relationships or interests would be considered to be remote or inconsequential; and</text></clause> 
<clause id="H9C3358CA91694EFD9B5174770105B58B"><enum>(ii)</enum><text>to require any board member, officer, or employee with a financial relationship or interest disclosed under clause (i) to recuse himself or herself from any review under subsection (f)(3) or oversight under subsection (f)(4) with respect to such applicant or recipient.</text></clause></subparagraph> 
<subparagraph id="H1FDE277C23A94BECA4C35BECA2DAB843"><enum>(B)</enum><header>Failure to comply</header><text>The Secretary may disqualify an application or revoke an award under this section if a board member, officer, or employee has failed to comply with procedures required under subparagraph (A)(ii).</text></subparagraph></paragraph></subsection> 
<subsection id="HB20A2F622ECB40888F04A05E1DD9007B"><enum>(d)</enum><header>Selection of the Program consortium</header> 
<paragraph id="HCFFD494AB64748349864CE9742D9ECC"><enum>(1)</enum><header>In general</header><text>The Secretary shall select the program consortium through an open, competitive process.</text></paragraph> 
<paragraph id="HEB33AE67AFC34DC4B5C03E6EBD078428"><enum>(2)</enum><header>Members</header><text>The program consortium may include corporations, trade associations, institutions of higher education, National Laboratories, or other research institutions. After submitting a proposal under paragraph (4), the program consortium may not add members without the consent of the Secretary.</text></paragraph> 
<paragraph id="H8948287C130749D3AE831CBD0048A67C"><enum>(3)</enum><header>Tax status</header><text>The program consortium shall be an entity that is exempt from tax under <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986.</text></paragraph> 
<paragraph id="HC0FBE111D8104FD981ECA2558DB078D1"><enum>(4)</enum><header>Schedule</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall solicit proposals from eligible consortia to perform the duties in subsection (c)(1), which shall be submitted not later than 360 days after the date of enactment of this Act. The Secretary shall select the program consortium not later than 18 months after such date of enactment.</text></paragraph> 
<paragraph id="HA7E314D0E9084076A8F64641CD29D94F"><enum>(5)</enum><header>Application</header><text>Applicants shall submit a proposal including such information as the Secretary may require. At a minimum, each proposal shall—</text> 
<subparagraph id="HD621ABD660344B409E601F6D6CC93492"><enum>(A)</enum><text>list all members of the consortium;</text></subparagraph> 
<subparagraph id="H95D1E9BF047F485989D1C543F8063D01"><enum>(B)</enum><text>fully describe the structure of the consortium, including any provisions relating to intellectual property; and</text></subparagraph> 
<subparagraph id="HD84B9C8685734321B0053BF5062FAFBE"><enum>(C)</enum><text>describe how the applicant would carry out the activities of the program consortium under this section.</text></subparagraph></paragraph> 
<paragraph id="HDCC7BBACA0DA495EA8DA53400F1144E"><enum>(6)</enum><header>Eligibility</header><text>To be eligible to be selected as the program consortium, an applicant must be an entity whose members collectively have demonstrated capabilities in planning and managing research, development, demonstration, and commercial application programs in natural gas or other petroleum exploration or production.</text></paragraph> 
<paragraph id="HAD6EBB8091F642F3BF00BAD18445BEF9"><enum>(7)</enum><header>Criterion</header><text>The Secretary shall consider the amount of the fee an applicant proposes to receive under subsection (g) in selecting a consortium under this section.</text></paragraph></subsection> 
<subsection id="H60AE04E5BF7C4D0A84A1A94F06641D9C"><enum>(e)</enum><header>Annual plan</header> 
<paragraph id="H52CE146D38BC42B19B450808579280BD"><enum>(1)</enum><header>In general</header><text>The program under this section shall be carried out pursuant to an annual plan prepared by the Secretary in accordance with paragraph (2).</text></paragraph> 
<paragraph id="HDCCA32A666314BA09375AE87EC74DA51"><enum>(2)</enum><header>Development</header> 
<subparagraph id="H0148596AA9064B21A60089F04100C5D0"><enum>(A)</enum><header>Solicitation of recommendations</header><text>Before drafting an annual plan under this subsection, the Secretary shall solicit specific written recommendations from the program consortium for each element to be addressed in the plan, including those described in paragraph (4). The Secretary may request that the program consortium submit its recommendations in the form of a draft annual plan.</text></subparagraph> 
<subparagraph id="HB926D67CC9BB4C059757CED1229DB39E"><enum>(B)</enum><header>Submission of recommendations; other comment</header><text>The Secretary shall submit the recommendations of the program consortium under subparagraph (A) to the Ultra-Deepwater Advisory Committee established under section 615(a) for review, and such Advisory Committee shall provide to the Secretary written comments by a date determined by the Secretary. The Secretary may also solicit comments from any other experts.</text></subparagraph> 
<subparagraph id="HC6FD76C32EAF409E85E5AF9BB8D258BC"><enum>(C)</enum><header>Consultation</header><text>The Secretary shall consult regularly with the program consortium throughout the preparation of the annual plan.</text></subparagraph></paragraph> 
<paragraph id="H4BCED2DC405B48198500E5777950FF08"><enum>(3)</enum><header>Publication</header><text>The Secretary shall transmit to Congress and publish in the Federal Register the annual plan, along with any written comments received under paragraph (2)(A) and (B).</text></paragraph> 
<paragraph id="HCA400A08E7D14F8D973E000285FD982C"><enum>(4)</enum><header>Contents</header><text>The annual plan shall describe the ongoing and prospective activities of the program under this section and shall include—</text> 
<subparagraph id="H2B0D1B52527746A59CE8D812297E0032"><enum>(A)</enum><text>a list of any solicitations for awards that the Secretary plans to issue to carry out research, development, demonstration, or commercial application activities, including the topics for such work, who would be eligible to apply, selection criteria, and the duration of awards; and</text></subparagraph> 
<subparagraph id="H597C7F9FF7E1439B84B022FE89600B9"><enum>(B)</enum><text>a description of the activities expected of the program consortium to carry out subsection (f)(4).</text></subparagraph></paragraph> 
<paragraph id="H77154671C22449A5B768276C67FDA14E"><enum>(5)</enum><header>Estimates of increased royalty receipts</header><text>The Secretary, in consultation with the Secretary of the Interior, shall provide an annual report to Congress with the President’s budget on the estimated cumulative increase in Federal royalty receipts (if any) resulting from the implementation of this subtitle. The initial report under this paragraph shall be submitted in the first President’s budget following the completion of the first annual plan required under this subsection.</text></paragraph></subsection> 
<subsection id="H8E2A31F918914ED09FB2D1D7CAE5F941"><enum>(f)</enum><header>Awards</header> 
<paragraph id="HC5F4EF031C0E4AA2AEB8BBE00B14FBB"><enum>(1)</enum><header>In general</header><text>The Secretary shall make awards to carry out research, development, demonstration, and commercial application activities under the program under this section. The program consortium shall not be eligible to receive such awards, but members of the program consortium may receive such awards.</text></paragraph> 
<paragraph id="HB60DF47796A34BC7AA06CAC008923018"><enum>(2)</enum><header>Proposals</header><text>The Secretary shall solicit proposals for awards under this subsection in such manner and at such time as the Secretary may prescribe, in consultation with the program consortium.</text></paragraph> 
<paragraph id="HD7F4505CDC0B492AB046AAC557009E56"><enum>(3)</enum><header>Review</header><text>The Secretary shall make awards under this subsection through a competitive process, which shall include a review by individuals selected by the Secretary. Such individuals shall include, for each application, Federal officials, the program consortium, and non-Federal experts who are not board members, officers, or employees of the program consortium or of a member of the program consortium.</text></paragraph> 
<paragraph id="H6BDE06F5A87A4E4C8B8874D0FE06D1CF"><enum>(4)</enum><header>Oversight</header> 
<subparagraph id="HF9131A0C55574FDB9D50E6E96C07D357"><enum>(A)</enum><header>In general</header><text>The program consortium shall oversee the implementation of awards under this subsection, consistent with the annual plan under subsection (e), including disbursing funds and monitoring activities carried out under such awards for compliance with the terms and conditions of the awards.</text></subparagraph> 
<subparagraph id="H0663D90A460B4FF4006E42EA8FF4EB21"><enum>(B)</enum><header>Effect</header><text>Nothing in subparagraph (A) shall limit the authority or responsibility of the Secretary to oversee awards, or limit the authority of the Secretary to review or revoke awards.</text></subparagraph> 
<subparagraph id="H84F23B4AB16A48D3B11468D778CB9CB3"><enum>(C)</enum><header>Provision of information</header><text>The Secretary shall provide to the program consortium the information necessary for the program consortium to carry out its responsibilities under this paragraph.</text></subparagraph></paragraph></subsection> 
<subsection id="HB9314BA67920447FAF03D4A0285BB6E6"><enum>(g)</enum><header>Administrative costs</header> 
<paragraph id="HEBE8F9EC9B87490B95784B9381AEB5DE"><enum>(1)</enum><header>In general</header><text>To compensate the program consortium for carrying out its activities under this section, the Secretary shall provide to the program consortium funds sufficient to administer the program. This compensation may include a management fee consistent with Department of Energy contracting practices and procedures.</text></paragraph> 
<paragraph id="HEF333F9962E24BBA9200CDB896BF8907"><enum>(2)</enum><header>Advance</header><text>The Secretary shall advance funds to the program consortium upon selection of the consortium, which shall be deducted from amounts to be provided under paragraph (1).</text></paragraph></subsection> 
<subsection id="H0DE4DA2E20504772A2DC79D0467218F7"><enum>(h)</enum><header>Audit</header><text>The Secretary shall retain an independent, commercial auditor to determine the extent to which funds provided to the program consortium, and funds provided under awards made under subsection (f), have been expended in a manner consistent with the purposes and requirements of this subtitle. The auditor shall transmit a report annually to the Secretary, who shall transmit the report to Congress, along with a plan to remedy any deficiencies cited in the report.</text></subsection></section> 
<section id="H723AE31383F94D598366AC064BAE8700"><enum>613.</enum><header>Unconventional natural gas and other petroleum resources program</header> 
<subsection id="H338AE062842347E5A020A6D54CB986D2"><enum>(a)</enum><header>In general</header><text>The Secretary shall carry out activities under section 611(b)(3), to maximize the use of the onshore unconventional natural gas and other petroleum resources of the United States, by increasing the supply of such resources, through reducing the cost and increasing the efficiency of exploration for and production of such resources, while improving safety and minimizing environmental impacts.</text></subsection> 
<subsection id="H7F0AD79F95234A8AA350661DB5FA8507"><enum>(b)</enum><header>Awards</header> 
<paragraph id="HF63AD4CD6315468CA3B0DD1EC4A47CC"><enum>(1)</enum><header>In general</header><text>The Secretary shall carry out this section through awards to research consortia made through an open, competitive process. As a condition of award of funds, qualified research consortia shall—</text> 
<subparagraph id="H855B757603F24D9EAC1FC54775BC387D"><enum>(A)</enum><text>demonstrate capability and experience in unconventional onshore natural gas or other petroleum research and development;</text></subparagraph> 
<subparagraph id="HE31E1E1E74E3415FA9B971D91EEC1C60"><enum>(B)</enum><text>provide a research plan that demonstrates how additional natural gas or oil production will be achieved; and</text></subparagraph> 
<subparagraph id="H95620BB2D41641F192E8A2024D6FB54E"><enum>(C)</enum><text>at the request of the Secretary, provide technical advice to the Secretary for the purposes of developing the annual plan required under subsection (e).</text></subparagraph></paragraph> 
<paragraph id="H797687006622444194A2A4167E592850"><enum>(2)</enum><header>Production potential</header><text>The Secretary shall seek to ensure that the number and types of awards made under this subsection have reasonable potential to lead to additional oil and natural gas production on Federal lands.</text></paragraph> 
<paragraph id="H15DB4DC313C5449C8B12916D07176F23"><enum>(3)</enum><header>Schedule</header><text>To carry out this subsection, not later than 180 days after the date of enactment of this Act, the Secretary shall solicit proposals from research consortia, which shall be submitted not later than 360 days after the date of enactment of this Act. The Secretary shall select the first group of research consortia to receive awards under this subsection not later than 18 months after such date of enactment.</text></paragraph></subsection> 
<subsection id="HF4992600A8FF49E690A8ED035DDA3E12"><enum>(c)</enum><header>Audit</header><text>The Secretary shall retain an independent, commercial auditor to determine the extent to which funds provided under awards made under this section have been expended in a manner consistent with the purposes and requirements of this subtitle. The auditor shall transmit a report annually to the Secretary, who shall transmit the report to Congress, along with a plan to remedy any deficiencies cited in the report.</text></subsection> 
<subsection id="H12629E702ADD40E6B2A526F6967BC20"><enum>(d)</enum><header>Focus areas for awards</header> 
<paragraph id="H85B4B569D8F145E48200F6CDDBF0009D"><enum>(1)</enum><header>Unconventional resources</header><text>Awards from allocations under section 619(d)(2) shall focus on areas including advanced coalbed methane, deep drilling, natural gas production from tight sands, natural gas production from gas shales, stranded gas, innovative exploration and production techniques, enhanced recovery techniques, and environmental mitigation of unconventional natural gas and other petroleum resources exploration and production.</text></paragraph> 
<paragraph id="HF36577DAAA284FF485D419E3F45F05F7"><enum>(2)</enum><header>Small producers</header><text>Awards from allocations under section 619(d)(3) shall be made to consortia consisting of small producers or organized primarily for the benefit of small producers, and shall focus on areas including complex geology involving rapid changes in the type and quality of the oil and gas reservoirs across the reservoir; low reservoir pressure; unconventional natural gas reservoirs in coalbeds, deep reservoirs, tight sands, or shales; and unconventional oil reservoirs in tar sands and oil shales.</text></paragraph></subsection> 
<subsection id="H3EC410D37408461A80975CEB3DBD2E5"><enum>(e)</enum><header>Annual plan</header> 
<paragraph id="HD23F28E00A5E4784884F4F8291003192"><enum>(1)</enum><header>In general</header><text>The program under this section shall be carried out pursuant to an annual plan prepared by the Secretary in accordance with paragraph (2).</text></paragraph> 
<paragraph id="HCA9B630394F34723004EEB6D951109B2"><enum>(2)</enum><header>Development</header> 
<subparagraph id="H222A01E0191647C6AF09C25D381EEE22"><enum>(A)</enum><header>Written recommendations</header><text>Before drafting an annual plan under this subsection, the Secretary shall solicit specific written recommendations from the research consortia receiving awards under subsection (b) and the Unconventional Resources Technology Advisory Committee for each element to be addressed in the plan, including those described in subparagraph (D).</text></subparagraph> 
<subparagraph id="H41A2B571718444FBAB9467047E3EB03D"><enum>(B)</enum><header>Consultation</header><text>The Secretary shall consult regularly with the research consortia throughout the preparation of the annual plan.</text></subparagraph> 
<subparagraph id="HD79EF562B084466197934F07801345F4"><enum>(C)</enum><header>Publication</header><text>The Secretary shall transmit to Congress and publish in the Federal Register the annual plan, along with any written comments received under subparagraph (A).</text></subparagraph> 
<subparagraph id="H19A0F35C0E2B46BD9988BF2C7ECC6369"><enum>(D)</enum><header>Contents</header><text>The annual plan shall describe the ongoing and prospective activities under this section and shall include a list of any solicitations for awards that the Secretary plans to issue to carry out research, development, demonstration, or commercial application activities, including the topics for such work, who would be eligible to apply, selection criteria, and the duration of awards.</text></subparagraph></paragraph> 
<paragraph id="HC24A1376F0094B2DB7D71CE96DE56151"><enum>(3)</enum><header>Estimates of increased royalty receipts</header><text>The Secretary, in consultation with the Secretary of the Interior, shall provide an annual report to Congress with the President’s budget on the estimated cumulative increase in Federal royalty receipts (if any) resulting from the implementation of this subtitle. The initial report under this paragraph shall be submitted in the first President’s budget following the completion of the first annual plan required under this subsection.</text></paragraph></subsection> 
<subsection id="H4B7047D3329642DEB06F75092B24016D"><enum>(f)</enum><header>Activities by the United States Geological Survey</header><text>The Secretary of the Interior, through the United States Geological Survey, shall, where appropriate, carry out programs of long-term research to complement the programs under this section.</text></subsection></section> 
<section id="H3C554FD3658F4184858CE2C9CCB99F36"><enum>614.</enum><header>Additional requirements for awards</header> 
<subsection id="H0B73EA9877F2460EACED859099E905F2"><enum>(a)</enum><header>Demonstration projects</header><text>An application for an award under this subtitle for a demonstration project shall describe with specificity the intended commercial use of the technology to be demonstrated.</text></subsection> 
<subsection id="HD1BFF96F9B2B4F3AB4177C8CC4E34FDC"><enum>(b)</enum><header>Flexibility in locating demonstration projects</header><text>Subject to the limitation in section 611(c), a demonstration project under this subtitle relating to an ultra-deepwater technology or an ultra-deepwater architecture may be conducted in deepwater depths.</text></subsection> 
<subsection id="HA94BF105CFC244329065EBC51061308D"><enum>(c)</enum><header>Intellectual property agreements</header><text>If an award under this subtitle is made to a consortium (other than the program consortium), the consortium shall provide to the Secretary a signed contract agreed to by all members of the consortium describing the rights of each member to intellectual property used or developed under the award.</text></subsection> 
<subsection id="H200D9FA6CA224DDB9F6D9967440011DB"><enum>(d)</enum><header>Technology transfer</header><text>2.5 percent of the amount of each award made under this subtitle shall be designated for technology transfer and outreach activities under this subtitle.</text></subsection> 
<subsection id="H21137FF85637435C91E7C5E586A1A43D"><enum>(e)</enum><header>Cost sharing reduction for independent producers</header><text>In applying the cost sharing requirements under <inline-comment display="yes">section __</inline-comment> to an award under this subtitle the Secretary may reduce or eliminate the non-Federal requirement if the Secretary determines that the reduction is necessary and appropriate considering the technological risks involved in the project.</text></subsection></section> 
<section id="H4172675E34544254A6C3FE52EA7BD68"><enum>615.</enum><header>Advisory committees</header> 
<subsection id="H525B36DF8EE54350BDB7B9CA8B091F6B"><enum>(a)</enum><header>Ultra-Deepwater Advisory Committee</header> 
<paragraph id="H65E0176759E04FA2B1A81B3B103C3442"><enum>(1)</enum><header>Establishment</header><text>Not later than 270 days after the date of enactment of this Act, the Secretary shall establish an advisory committee to be known as the Ultra-Deepwater Advisory Committee.</text></paragraph> 
<paragraph id="HE22765731C474CFBB1F0AAB8D500076"><enum>(2)</enum><header>Membership</header><text>The advisory committee under this subsection shall be composed of members appointed by the Secretary including—</text> 
<subparagraph id="HDCA8BD0601084308A391CA1DCEFE54C5"><enum>(A)</enum><text>individuals with extensive research experience or operational knowledge of offshore natural gas and other petroleum exploration and production;</text></subparagraph> 
<subparagraph id="H88498B37E66E42A69CE5E90465484B8B"><enum>(B)</enum><text>individuals broadly representative of the affected interests in ultra-deepwater natural gas and other petroleum production, including interests in environmental protection and safe operations;</text></subparagraph> 
<subparagraph id="HDDECF3B94A364C4B90CA11B81B635D7F"><enum>(C)</enum><text>no individuals who are Federal employees; and</text></subparagraph> 
<subparagraph id="HC4B1085ABEA44C72B4FA5D00F9D3B321"><enum>(D)</enum><text>no individuals who are board members, officers, or employees of the program consortium.</text></subparagraph></paragraph> 
<paragraph id="H40DECA426DF747F9864EA759AE36805C"><enum>(3)</enum><header>Duties</header><text>The advisory committee under this subsection shall—</text> 
<subparagraph id="H29EBA616C12A4593B8A9A211B5AFEB5D"><enum>(A)</enum><text>advise the Secretary on the development and implementation of programs under this subtitle related to ultra-deepwater natural gas and other petroleum resources; and</text></subparagraph> 
<subparagraph id="HBD8A65F732924D8EB3A4CABDA8CFE183"><enum>(B)</enum><text>carry out section 612(e)(2)(B).</text></subparagraph></paragraph> 
<paragraph id="H497B0A94E1C94BD8B78CC0A4F4AAF4F6"><enum>(4)</enum><header>Compensation</header><text>A member of the advisory committee under this subsection shall serve without compensation but shall receive travel expenses in accordance with applicable provisions under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code.</text></paragraph></subsection> 
<subsection id="H166342D3D24E43B297E84DDB379EBDA5"><enum>(b)</enum><header>Unconventional Resources Technology Advisory Committee</header> 
<paragraph id="HC82F437019D9480D96004E7E87B84CE6"><enum>(1)</enum><header>Establishment</header><text>Not later than 270 days after the date of enactment of this Act, the Secretary shall establish an advisory committee to be known as the Unconventional Resources Technology Advisory Committee.</text></paragraph> 
<paragraph id="H2AFD715E18B54D88B56670D1398011DF"><enum>(2)</enum><header>Membership</header><text>The advisory committee under this subsection shall be composed of members appointed by the Secretary including—</text> 
<subparagraph id="HCAE1B1DED4FC445F83263DE638C97EE8"><enum>(A)</enum><text>a majority of members who are employees or representatives of independent producers of natural gas and other petroleum, including small producers;</text></subparagraph> 
<subparagraph id="H1A92655D92F34885BB01605130A67626"><enum>(B)</enum><text>individuals with extensive research experience or operational knowledge of unconventional natural gas and other petroleum resource exploration and production;</text></subparagraph> 
<subparagraph id="HDD0F6BCFC6AE4F61B5E7DB77307D27E0"><enum>(C)</enum><text>individuals broadly representative of the affected interests in unconventional natural gas and other petroleum resource exploration and production, including interests in environmental protection and safe operations; and</text></subparagraph> 
<subparagraph id="HEFF5C74477964CF0A0B03875973814E"><enum>(D)</enum><text>no individuals who are Federal employees.</text></subparagraph></paragraph> 
<paragraph id="H01D1742E3E42498993FBDCC0FB7D7FA9"><enum>(3)</enum><header>Duties</header><text>The advisory committee under this subsection shall advise the Secretary on the development and implementation of activities under this subtitle related to unconventional natural gas and other petroleum resources.</text></paragraph> 
<paragraph id="H2FAD43661D6E407BA6009D3900C3EBC"><enum>(4)</enum><header>Compensation</header><text>A member of the advisory committee under this subsection shall serve without compensation but shall receive travel expenses in accordance with applicable provisions under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code.</text></paragraph></subsection> 
<subsection id="HE126BCCE4CE7442A9BAFFA5BD00016B5"><enum>(c)</enum><header>Prohibition</header><text>No advisory committee established under this section shall make recommendations on funding awards to particular consortia or other entities, or for specific projects.</text></subsection></section> 
<section id="H64511D368A814EAC9EB5660115AD93CF"><enum>616.</enum><header>Limits on participation</header><text display-inline="no-display-inline">An entity shall be eligible to receive an award under this subtitle only if the Secretary finds—</text> 
<paragraph id="H10CD5722E4B241E5B37860BB2678625"><enum>(1)</enum><text>that the entity’s participation in the program under this subtitle would be in the economic interest of the United States; and</text></paragraph> 
<paragraph id="HD5877799F3B24B03BC00773047A00044"><enum>(2)</enum><text>that either—</text> 
<subparagraph id="H8FF950751D9F49DAA594D2A4E037385"><enum>(A)</enum><text>the entity is a United States-owned entity organized under the laws of the United States; or</text></subparagraph> 
<subparagraph id="HBBBDEF7928434688B9F1941DB7651943"><enum>(B)</enum><text>the entity is organized under the laws of the United States and has a parent entity organized under the laws of a country that affords—</text> 
<clause id="H37AB007938C64767B6B257EB185B2F20"><enum>(i)</enum><text>to United States-owned entities opportunities, comparable to those afforded to any other entity, to participate in any cooperative research venture similar to those authorized under this subtitle;</text></clause> 
<clause id="H6794778192A848C8B3FAB2D945F9E41E"><enum>(ii)</enum><text>to United States-owned entities local investment opportunities comparable to those afforded to any other entity; and</text></clause> 
<clause id="H5EE6656B432B4F528547D9795D81AF54"><enum>(iii)</enum><text>adequate and effective protection for the intellectual property rights of United States-owned entities.</text></clause></subparagraph></paragraph></section> 
<section id="H62787BBC4BDD45C794D9D3359000FA1F"><enum>617.</enum><header>Sunset</header><text display-inline="no-display-inline">The authority provided by this subtitle shall terminate on September 30, 2015.</text></section> 
<section id="H2030F23A37324447843F2E99BFE93C6E"><enum>618.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subtitle:</text> 
<paragraph id="H25401CA057E745E080CAAC23BD9E75E5"><enum>(1)</enum><header>Deepwater</header><text>The term <term>deepwater</term> means a water depth that is greater than 200 but less than 1,500 meters.</text></paragraph> 
<paragraph id="HFC9DDE453A704CF39DEA651062A0C4A0"><enum>(2)</enum><header>Independent producer of oil or gas</header> 
<subparagraph id="H5D43D7E54A4049D1871CF9A0DA265B6"><enum>(A)</enum><header>In general</header><text>The term <term>independent producer of oil or gas</term> means any person that produces oil or gas other than a person to whom subsection (c) of <external-xref legal-doc="usc" parsable-cite="usc/26/613A">section 613A</external-xref> of the Internal Revenue Code of 1986 does not apply by reason of paragraph (2) (relating to certain retailers) or paragraph (4) (relating to certain refiners) of section 613A(d) of such Code.</text></subparagraph> 
<subparagraph id="HE0A38787E29E4120BF7EE073AB61F639"><enum>(B)</enum><header>Rules for applying paragraphs (2) and (4) of Section 613a<enum-in-header>(d)</enum-in-header></header><text>For purposes of subparagraph (A), paragraphs (2) and (4) of <external-xref legal-doc="usc" parsable-cite="usc/26/613A">section 613A(d)</external-xref> of the Internal Revenue Code of 1986 shall be applied by substituting <quote>calendar year</quote> for <quote>taxable year</quote> each place it appears in such paragraphs.</text></subparagraph></paragraph> 
<paragraph id="H8F7EEF4EBB474DBDA7A2127946C7F336"><enum>(3)</enum><header>Program consortium</header><text>The term <term>program consortium</term> means the consortium selected under section 612(d).</text></paragraph> 
<paragraph id="H2E77A09ECDA648A2B9E018F3756DB077"><enum>(4)</enum><header>Remote or inconsequential</header><text>The term <term>remote or inconsequential</term> has the meaning given that term in regulations issued by the Office of Government Ethics under <external-xref legal-doc="usc" parsable-cite="usc/18/208">section 208(b)(2)</external-xref> of title 18, United States Code.</text></paragraph> 
<paragraph id="H30C5BA301E224C578889A960B96F566D"><enum>(5)</enum><header>Small producer</header><text>The term <term>small producer</term> means an entity organized under the laws of the United States with production levels of less than 1,000 barrels per day of oil equivalent.</text></paragraph> 
<paragraph id="H5AE1858A4E9A4A589EE05FE2DF71BD5B"><enum>(6)</enum><header>Ultra-deepwater</header><text>The term <term>ultra-deepwater</term> means a water depth that is equal to or greater than 1,500 meters.</text></paragraph> 
<paragraph id="H7FF624602D844B3BAD2C9CF5F52C2550"><enum>(7)</enum><header>Ultra-deepwater architecture</header><text>The term <term>ultra-deepwater architecture</term> means the integration of technologies for the exploration for, or production of, natural gas or other petroleum resources located at ultra-deepwater depths.</text></paragraph> 
<paragraph id="HCBF7C4C77A05449AA28CCB2C8E474FA"><enum>(8)</enum><header>Ultra-deepwater Technology</header><text>The term <term>ultra-deepwater technology</term> means a discrete technology that is specially suited to address 1 or more challenges associated with the exploration for, or production of, natural gas or other petroleum resources located at ultra-deepwater depths.</text></paragraph> 
<paragraph id="HC5B741714B0340C186B926D972466B84"><enum>(9)</enum><header>Unconventional natural gas and other petroleum resource</header><text>The term <term>unconventional natural gas and other petroleum resource</term> means natural gas and other petroleum resource located onshore in an economically inaccessible geological formation, including resources of small producers.</text></paragraph></section> </subtitle></title>
