		<official-title>To include costs incurred by the Indian Health Service, a
		  federally qualified health center, an AIDS drug assistance program, certain
		  hospitals, or a pharmaceutical manufacturer patient assistance program in
		  providing prescription drugs toward the annual out of pocket threshold under
		  part D of title XVIII of the Social Security Act and to provide a safe harbor
		  for assistance provided under a pharmaceutical manufacturer patient assistance
		  program.</official-title>

		<section display-inline="no-display-inline" id="H71064DC04AE14C50AD00BC07B00A27E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Helping Fill the Medicare Rx Gap Act
			 of 2006</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="H0955E42DA46C4C499FF64D6EC3D4A4A6" section-type="subsequent-section"><enum>2.</enum><header>Including costs
			 incurred by the indian health service, a Federally qualified health center, an
			 AIDS drug assistance program, certain hospitals, or a pharmaceutical
			 manufacturer patient assistance program in providing prescription drugs toward
			 the annual out of pocket threshold under part D</header>
			<subsection commented="no" display-inline="no-display-inline" id="H30B705C289144F66943866F9009EEFB1"><enum>(a)</enum><header>In
			 general</header><text>Section 1860D–2(b)(4)(C) of the Social Security Act (42
			 U.S.C. 1395w–102(b)(4)(C)) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HAE0D3BA14D43483100891DFDD72BCE4F"><enum>(1)</enum><text>in clause (i), by
			 striking <quote>and</quote> at the end;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HEA3292E6305A4A4A8F28F7B882B9C3E9"><enum>(2)</enum><text>in clause
			 (ii)—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="HF740E96752064759AB9E4DAF6800A02F"><enum>(A)</enum><text>by striking
			 <quote>such costs shall be treated as incurred only if</quote> and inserting
			 <quote>subject to clause (iii), such costs shall be treated as incurred
			 if</quote>;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H1CD4C49AE37F4CB700946C37588DE83D"><enum>(B)</enum><text>by striking
			 <quote>, under section 1860D–14, or under a State Pharmaceutical Assistance
			 Program</quote>; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2337A3533729465BA1234F9EE92DF519"><enum>(C)</enum><text>by striking the
			 period at the end and inserting <quote>; and</quote>; and</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H14DB36B9064948E28DF9BEA5DCD41B49"><enum>(3)</enum><text>by inserting after
			 clause (ii) the following new clause:</text>
					<quoted-block display-inline="no-display-inline" id="HC6701B6A1B5348158BD39B884E2554AD" style="OLC">
						<clause commented="no" display-inline="no-display-inline" id="H2CB06226157942BC88F9C43953BF88D2"><enum>(iii)</enum><text>such costs shall
				be treated as incurred and shall not be considered to be reimbursed under
				clause (ii) if such costs are borne or paid—</text>
							<subclause commented="no" display-inline="no-display-inline" id="HAFB058E3310C4FA5B273AA7F4F3E5767"><enum>(I)</enum><text>under section
				1860D–14;</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="H428380FE40354F20BCB2B501D96FDF8E"><enum>(II)</enum><text>under a State
				Pharmaceutical Assistance Program;</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="H0288083E5B764B59BB50A747EEF6B861"><enum>(III)</enum><text>by the Indian
				Health Service, an Indian tribe or tribal organization, or an urban Indian
				organization (as defined in section 4 of the Indian Health Care Improvement
				Act);</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="H24D4EAFBA2FD4A0BA796B6C1534272BD"><enum>(IV)</enum><text>by a federally
				qualified health center (as defined in section 1861(aa)(4));</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="H5B049115D137413AA23FE2A850BCCE4D"><enum>(V)</enum><text>under an AIDS Drug
				Assistance Program under part B of title XXVI of the Public Health Service
				Act;</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="HE264608D9BF0442FACDBC2BF7E00383C"><enum>(VI)</enum><text>by a subsection
				(d) hospital (as defined in section 1886(d)(1)(B)) that meets the requirements
				of clauses (i) and (ii) of section 340B(a)(4)(L) of the Public Health Service
				Act; or</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="H1BDC84F5D5B740658E10604E03C0E82"><enum>(VII)</enum><text>by a
				pharmaceutical manufacturer patient assistance program, either directly or
				through the distribution or donation of covered part D drugs, which shall be
				valued at the negotiated price of such covered part D drug under the enrollee’s
				prescription drug plan or MA–PD plan as of the date that the drug was
				distributed or
				donated.</text>
							</subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H472975B5B6254C7DAEAA718BB8DC66EE"><enum>(b)</enum><header>Effective
			 date</header><text>The amendments made by subsection (a) shall apply to costs
			 incurred on or after January 1, 2006.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="H3FEE1810BCD0430B00B9D84755DB9B17"><enum>3.</enum><header>Providing a safe
			 harbor for pharmaceutical manufacturer patient assistance programs</header>
			<subsection id="HCA1EEC5F7C8144E29667CF732D082423"><enum>(a)</enum><header>Safe
			 Harbor</header><text>Section 1128B(b)(3) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C. 1320a–7b(b)(3))
			 is amended—</text>
				<paragraph id="H5E9DF2BC289A4B9B99197E2D33EDE54"><enum>(1)</enum><text>in
			 subparagraph (G), by striking <quote>and</quote> at the end;</text>
				</paragraph><paragraph id="HE70E3351FAA4491DA46EA55C9018C28B"><enum>(2)</enum><text>in subparagraph
			 (H), as added by section 237(d) of the Medicare Prescription Drug, Improvement,
			 and Modernization Act of 2003 (<external-xref legal-doc="public-law" parsable-cite="pl/108/173">Public Law 108–173</external-xref>; 117 Stat. 2213)—</text>
					<subparagraph id="HB1F599C933EE4D378B062F328061D280"><enum>(A)</enum><text>by moving such
			 subparagraph 2 ems to the left; and</text>
					</subparagraph><subparagraph id="HA34707E3630243608ED04BE3ADE14C0"><enum>(B)</enum><text>by striking the
			 period at the end and inserting a semicolon;</text>
					</subparagraph></paragraph><paragraph id="HDBE1264ABAEC433182CBACAD4739B2E"><enum>(3)</enum><text>by
			 redesignating subparagraph (H), as added by section 431(a) of the Medicare
			 Prescription Drug, Improvement, and Modernization Act of 2003 (Public Law
			 108–173; 117 Stat. 2287), as subparagraph (I);</text>
				</paragraph><paragraph id="H058DBD9F310E4196B4C35530F0F72EF3"><enum>(4)</enum><text>in subparagraph
			 (I), as so redesignated—</text>
					<subparagraph id="H865B2D239C9D4887986F6988D8549F8E"><enum>(A)</enum><text>by moving such
			 subparagraph 2 ems to the left; and</text>
					</subparagraph><subparagraph id="HADE37F227F204EADBB018E16C6B854F"><enum>(B)</enum><text>by striking the
			 period at the end and inserting <quote>; and</quote>; and</text>
					</subparagraph></paragraph><paragraph id="HB9FE1CFFAF8342B89E947B2D48C6E500"><enum>(5)</enum><text>by adding at the
			 end the following new subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="HCC0267B3BB3746AC958779213BC03470" style="OLC">
						<subparagraph id="H64177450FD8B4A3D890007E8FFEB00F3" indent="up1"><enum>(J)</enum><text>any remuneration paid by a
				pharmaceutical manufacturer patient assistance program, either in cash or
				through the distribution or donation of covered Part D drugs (as defined in
				section 1860D–2(e)), to an individual enrolled in a prescription drug plan
				under part D of title XVIII or in an MA–PD plan under part C of such
				title.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection changed="not-changed" commented="no" display-inline="no-display-inline" id="H5E5C5A5853ED41D09BCC3F4B04C16EBA"><enum>(b)</enum><header>Effective
			 date</header><text>The amendments made by subsection (a) shall apply to
			 remuneration paid on or after January 1, 2006.</text>
