		<official-title>To prohibit deceptive acts and practices in the content
		  rating and labeling of video games.</official-title>

		<section id="HD10D4D9EFFA74C8192FAE1F300CEC957" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Video Game Decency Act of
			 2006</short-title></quote>.</text>
		</section><section id="H9F2B9831404C45688F00F472B61EE5D0"><enum>2.</enum><header>Requirements for
			 content rating of video games</header><text display-inline="no-display-inline">It shall be unlawful for any person to ship
			 or otherwise distribute in interstate commerce any video game that contains a
			 rating label containing an age-based content rating for that video game where
			 the person, with the intent of obtaining a less restrictive age-based content
			 rating, failed to disclose content of the video game that was required to be
			 disclosed to the independent ratings organization that assigned such age-based
			 content rating, and which resulted in the video game receiving a
			 less-restrictive age-based content rating than otherwise would have resulted.</text>
		</section><section id="H51557AC5333B4B3C9230AF1C1C5E1B00"><enum>3.</enum><header>Unfair or
			 Deceptive Act or Practice</header><text display-inline="no-display-inline">A
			 violation of section 2 shall be treated as an unfair or deceptive act or
			 practice affecting commerce within the meaning proscribed in section 5(a)(1) of
			 the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/45">15 U.S.C. 45(a)(1)</external-xref>), and shall be treated by
			 the Commission as a violation of a rule under section 18(a) of such Act.</text>
		</section><section id="H38A40EE18AF24614B05296AED125E1F6"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">As used in this Act—</text>
			<paragraph id="H555BA5AB99CC4CBFBDE37300C8E2DDEE"><enum>(1)</enum><text display-inline="yes-display-inline">the term <quote>age-based content
			 rating</quote> means the classification assigned by an independent rating
			 organization to a video game for the purpose of informing consumers about the
			 potential suitability of a video game for particular age groups;</text>
			</paragraph><paragraph id="HC79F91D915334AC5BC2F293EF542CE20"><enum>(2)</enum><text display-inline="yes-display-inline">the term <quote>content</quote>, with
			 respect to a video game, means—</text>
				<subparagraph id="H1B88BFD9F2F04DBFBB6F00F500DADE95"><enum>(A)</enum><text>the software
			 contained in the video game that is capable of rendering, depicting,
			 displaying, or activating scenes, images, words, or sounds on a computer or
			 telecommunication device; and</text>
				</subparagraph><subparagraph id="H7B90663977834D1C98ECB51C3012C4D8"><enum>(B)</enum><text display-inline="yes-display-inline">any scenes, images, words, or sounds
			 contained in the video game;</text>
				</subparagraph></paragraph><paragraph id="H561FA98D1C30476DA85739409E62733B"><enum>(3)</enum><text display-inline="yes-display-inline">the term <quote>independent rating
			 organization</quote> means the Entertainment Software Rating Board or any other
			 organization that assigns age-based content ratings for video games; and</text>
			</paragraph><paragraph id="HE099D402481F4DDF96C798B11ECD4342"><enum>(4)</enum><text display-inline="yes-display-inline">the term <quote>video game</quote> means
			 any product, whether distributed electronically or through a tangible device,
			 consisting of data, programs routines, instructions, applications, symbolic
			 languages, or similar electronic information (collectively referred to as
			 <quote>software</quote>) that controls the operation of a computer or
			 telecommunication device and that enables a user to interact with a computer
			 controlled virtual environment for entertainment purposes.</text>
			</paragraph></section><section id="HE910E73F429548B9876F1470EB7E7BBA"><enum>5.</enum><header>Effect on other
			 laws</header><text display-inline="no-display-inline">This Act supersedes any
			 provision of a statute, regulation, or rule of a State or political subdivision
			 of a State that regulates the rating of video game content, or regulates the
			 sale, rental, or display of a video game on the basis of the video game’s
			 constitutionally protected content.</text>
