<official-title>To amend title XVIII of the Social Security Act to permit a physician assistant, when delegated by a physician, to order or provide post-hospital extended care services, home health services, and hospice care under the Medicare Program.</official-title>

<section id="H91964E607F794AC4BB747B00967FDC18" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Medicare Physician Assistant Continuity of Care Act of 2006</short-title></quote>.</text> </section>
<section id="H3B91749659414B6585638BC7099BDF3"><enum>2.</enum><header>Permitting physician assistants when delegated by a physician to order or provide post-hospital extended care services, home health services, and hospice care under the Medicare program</header> 
<subsection id="HB64793F86AFA408A95DB98C87A229D"><enum>(a)</enum><header>Post-hospital extended care services</header><text display-inline="yes-display-inline">Section 1814(a)(2) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395f">42 U.S.C. 1395f(a)(2)</external-xref>) is amended, in the matter before subparagraph (A)—</text> 
<paragraph id="H611C509EC37A4E7CA23E182018D78385"><enum>(1)</enum><text>by inserting <quote>or a physician assistant as delegated by a physician</quote> after <quote>a physician</quote> the first place it appears; and</text> </paragraph>
<paragraph id="H38F3B8998AF64A539265D7F4240F839"><enum>(2)</enum><text>by inserting <quote>a physician assistant as delegated by a physician, </quote> after <quote>a physician,</quote> the second place it appears.</text> </paragraph></subsection>
<subsection id="HEF29D24AB9774A97B711EE7BF4AFB32B"><enum>(b)</enum><header>Home health services</header> 
<paragraph id="HB7F3FAF66FBE4ABCAB1C33FA767CE080"><enum>(1)</enum><header>Under part A</header><text display-inline="yes-display-inline">Section 1814(a)(2)(C) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395f">42 U.S.C. 1395f(a)(2)(C)</external-xref>) is amended—</text> 
<subparagraph id="H05AD47E380CF41CDAE7FAD00FD0D9E"><enum>(A)</enum><text>by inserting <quote>by a physician or by a physician assistant as delegated by a physician,</quote> after <quote>established</quote>; and</text> </subparagraph>
<subparagraph id="H71262B2AC01E4F0E8DE27423F07D6E77"><enum>(B)</enum><text>by inserting <quote>or a physician assistant as delegated by a physician</quote> after <quote>a physician</quote> each place it appears.</text> </subparagraph></paragraph>
<paragraph id="H069AE0C13CA74352B95BA6A148BEDBC4"><enum>(2)</enum><header>Under part B</header><text display-inline="yes-display-inline">Section 1835(a)(2) of such Act (42 U.S. C. 1395n(a)(2)) is amended—</text> 
<subparagraph id="H7316F7A6477F41D4BC88D3F8FBBEB24"><enum>(A)</enum><text>in the matter before subparagraph (A), by inserting <quote>or a physician assistant as delegated by a physician,</quote> after <quote>a physician</quote>; and</text> </subparagraph>
<subparagraph id="H38BAE6C57AAD45D6BEFC3D7C79BBE6BE"><enum>(B)</enum><text>in each of clauses (ii) and (iii) of subparagraph (A)(ii), by inserting <quote>or a physician assistant as delegated by a physician</quote> after <quote>a physician</quote>.</text> </subparagraph></paragraph></subsection>
<subsection id="H963E85793C87472C9964B1A868DB337C"><enum>(c)</enum><header>Hospice care</header> 
<paragraph id="H314C6F8D26D4447D9ED5B36C78D5BC69"><enum>(1)</enum><header>Certification of terminal illness</header><text display-inline="yes-display-inline">Section 1814(a)(7)(A) of such Act is (<external-xref legal-doc="usc" parsable-cite="usc/42/1395f">42 U.S.C. 1395f(a)(7)(A)</external-xref>) is amended—</text> 
<subparagraph id="H5C5D1102EB674CAE9B00E8FFABD5E900"><enum>(A)</enum><text>in clause (i)(I), by inserting <quote>or a physician assistant as delegated by such attending physician</quote> after <quote>nurse practitioner)</quote>; and</text> </subparagraph>
<subparagraph id="H2B2380C3B2E04FAF8D39AE036227A472"><enum>(B)</enum><text>in clause (ii), by inserting <quote>or physician assistant</quote> after <quote>physician</quote>.</text> </subparagraph></paragraph>
<paragraph id="H6A2B9C86E71A45AAA0B92E948021D096"><enum>(2)</enum><header>Including professional services of physician assistant</header><text display-inline="yes-display-inline">Section 1861(dd)(1)(F) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(dd)(1)(F)</external-xref>) is amended by inserting after <quote>physicians' services</quote> the following: <quote>and services which would be physicians' services if furnished by a physician (as defined in subsection (r)(1)) and which are performed by a physician assistant under the supervision of a physician (as so defined) and which the physician assistant is legally authorized to perform in the State in which the services are performed</quote>.</text> </paragraph></subsection>
<subsection id="HB3ADA5CE0C4A4ABBA6ACCF6226DA6371"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall apply to services furnished on or after January 1, 2007.</text> </subsection></section>
