		<section id="H7F8DDE52F72649E5859D15D288918BDF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>More
			 Border Patrol Agents Now Act of 2006</quote>.</text>
		</section><section id="H81130CAA406B425EBDCE95C8606B002F"><enum>2.</enum><header>Border Patrol
			 agent enhancement</header>
			<subsection id="H5BD29356A82243798B1FD267851EAAF1"><enum>(a)</enum><header>Plan</header><text>In
			 order to address the recruitment and retention challenges faced by the United
			 States Border Patrol, the Secretary of Homeland Security shall, not later than
			 six months after the date of the enactment of this Act, submit to the Committee
			 on Homeland Security and the Committee on Government Reform of the House of
			 Representatives and the Committee on Homeland Security and Governmental Affairs
			 of the Senate a plan to determine how the Border Patrol can better recruit and
			 retain Border Patrol agents with the appropriate skills and training to
			 effectively carry out its mission and responsibilities.</text>
			</subsection><subsection id="HE64D118E39A54BC79657974875E82C9D"><enum>(b)</enum><header>Contents</header><text>The
			 plan shall include, at a minimum, the following components:</text>
				<paragraph id="H57A42A3A0FE743CBA95647A762D4BCC7"><enum>(1)</enum><text>A
			 strategy for the utilization of the recruitment authority provided under
			 subsection (b), as well as any other strategies the Secretary determines to be
			 important in recruiting well-qualified Border Patrol agents.</text>
				</paragraph><paragraph id="H7A92951F66EC4A54B95839E3A9B13CE8"><enum>(2)</enum><text>A
			 strategy for the utilization of the retention authority provided under
			 subsection (b), as well as any other strategies the Secretary determines to be
			 important in retaining well-qualified Border Patrol agents.</text>
				</paragraph><paragraph id="HB00BBACFFB5B43E9AED0C27B8645229E"><enum>(3)</enum><text>An assessment of
			 the impact that current pay levels for Border Patrol agents has on the
			 Department’s ability to recruit and retain Border Patrol agents, especially in
			 high cost-of-living areas.</text>
				</paragraph><paragraph id="HFE0F9087CDA4407298DF733971CB1C33"><enum>(4)</enum><text>An assessment of
			 whether increased flexibility in the Department’s ability to transfer Border
			 Patrol agents between duty stations would improve employee morale and enhance
			 the Department’s ability to recruit and retain well-qualified Border Patrol
			 agents.</text>
				</paragraph></subsection></section><section id="HD268018E105B43E783E474E318FE66AE"><enum>3.</enum><header>Recruitment and
			 retention bonuses for Border Patrol agent enhancement</header>
			<subsection id="H0CA084D93A2947F696ECF06C297CD005"><enum>(a)</enum><header>In
			 general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/97">Chapter 97</external-xref> of title 5, United States Code, is amended by
			 adding at the end the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="H59EE271DA55C40C089962E9C00FF3468" style="USC">
					<section id="H36A5091306524E749087FA12A8261318"><enum>9702.</enum><header>Border Patrol
				agent enhancement</header>
						<subsection id="H3BB456D5645546CF9F9E53BD4F3C98A3"><enum>(a)</enum><header>Recruitment
				bonuses for Border Patrol agents</header>
							<paragraph id="H735947031AC4432D9D28BB513672D000"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">In order to carry out
				the plan described in section 2(a) of the More Border Patrol Agents Now Act of
				2006, the Secretary of Homeland Security may pay a bonus to an individual to
				recruit a sufficient number of Border Patrol agents.</text>
							</paragraph><paragraph id="H6EE0A13E6C604FE797B4D3C0E5F4F11E"><enum>(2)</enum><header>Bonus
				amount</header>
								<subparagraph id="HB8A4E192FF5144779C9BDDB6BD506075"><enum>(A)</enum><header>In
				general</header><text>The amount of a bonus under this subsection shall be
				determined by the Secretary, but may not exceed 25 percent of the annual rate
				of basic pay of the position involved as of the beginning of the period of
				service referred to in paragraph (3)(A).</text>
								</subparagraph><subparagraph id="H06A5686F9913469EA7156C6C9184F6C4"><enum>(B)</enum><header>Lump-sum</header><text>A
				bonus under this subsection shall be paid in the form of a lump-sum payment and
				shall not be considered to be part of basic pay.</text>
								</subparagraph></paragraph><paragraph id="HD2D09C1300984A3394C13799F8EA95E7"><enum>(3)</enum><header>Service
				agreements</header><text>Payment of a bonus under this section shall be
				contingent upon the individual entering into a written service agreement with
				the United States Border Patrol. The agreement shall include—</text>
								<subparagraph id="H747C0F9DE2324B0AB92141AF3C228B57"><enum>(A)</enum><text>the period of
				service the individual shall be required to complete in return for the bonus;
				and</text>
								</subparagraph><subparagraph id="HEFB50821F8394683B96FD74468943F65"><enum>(B)</enum><text>the conditions
				under which the agreement may be terminated before the agreed-upon service
				period has been completed, and the effect of such termination.</text>
								</subparagraph></paragraph><paragraph id="HE32DC94EE3854AC782CEBDFBE0106961"><enum>(4)</enum><header>Limitation on
				eligibility</header><text>A bonus under this section may not be paid to recruit
				an individual for—</text>
								<subparagraph id="HD60BCADCD6AD474187CC2E8B93CD4B6B"><enum>(A)</enum><text>a position to
				which an individual is appointed by the President, by and with the advice and
				consent of the Senate;</text>
								</subparagraph><subparagraph id="H808EECDB0CC14626B5CF7C4B906EBE8E"><enum>(B)</enum><text>a position in the
				Senior Executive Service as a noncareer appointee (as defined in section
				3132(a)); or</text>
								</subparagraph><subparagraph id="HB8DA44D2D88B41B5BC2DA5402C4819B4"><enum>(C)</enum><text>a position which
				has been excepted from the competitive service by reason of its confidential,
				policy-determining, policy-making, or policy-advocating character.</text>
								</subparagraph></paragraph><paragraph id="H90282123D02545B6BC7CD4ECEE9778DA"><enum>(5)</enum><header>Termination</header><text>The
				authority to pay bonuses under this subsection shall terminate five years after
				the date of the enactment of this section.</text>
							</paragraph></subsection><subsection id="H11206DDC93354FD4A027C67223D0266"><enum>(b)</enum><header>Retention bonuses
				for Border Patrol agents</header>
							<paragraph id="H8EA07DB8D2894DE39900BA89FD006EC9"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">In order to carry out
				the plan described in section 2(a) of the More Border Patrol Agents Now Act of
				2006, the Secretary of Homeland Security may pay a retention bonus to a Border
				Patrol agent.</text>
							</paragraph><paragraph id="H4119848E98094D92BA598BB25FD519D"><enum>(2)</enum><header>Service
				agreement</header><text>Payment of a bonus under this subsection is contingent
				upon the employee entering into a written service agreement with the United
				States Border Patrol to complete a period of service with the Border Patrol.
				Such agreement shall include—</text>
								<subparagraph id="H369E542A41294DEFBBC85D4643562D37"><enum>(A)</enum><text display-inline="yes-display-inline">the period of service the employee shall be
				required to complete in return for the bonus; and</text>
								</subparagraph><subparagraph id="H0714E2AE497A46A6BB6303263904FC2C"><enum>(B)</enum><text>the conditions
				under which the agreement may be terminated before the agreed-upon service
				period has been completed, and the effect of such termination.</text>
								</subparagraph></paragraph><paragraph id="H503D19F11E814A4596ABF4BC055CC5E"><enum>(3)</enum><header>Bonus
				amount</header>
								<subparagraph id="HEE6ACBB50556447B87F61649F0A6416E"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">The amount of a bonus
				under this subsection shall be determined by the Secretary, but may not exceed
				25 percent of the annual rate of basic pay of the position involved as of the
				beginning of the period of service referred to in paragraph (2)(A).</text>
								</subparagraph><subparagraph id="H8E803C0893CF4AC58153F4E4658C25E7"><enum>(B)</enum><header>Lump-sum</header><text>A
				bonus under this subsection shall be paid in the form of a lump-sum payment and
				shall not be considered to be part of basic pay.</text>
								</subparagraph></paragraph><paragraph id="H900CE96B80244E9E9249FC4C7C01C4D0"><enum>(4)</enum><header>Limitation</header><text>A
				bonus under this subsection may not be based on any period of service which is
				the basis for a recruitment bonus under subsection (a).</text>
							</paragraph><paragraph id="H258A564BFFA542718598C1CD61DC0446"><enum>(5)</enum><header>Termination of
				authority</header><text>The authority to grant bonuses under this subsection
				shall expire five years after the date of the enactment of this section.</text>
							</paragraph></subsection><subsection display-inline="no-display-inline" id="H88A5391427DB4EB3A183532BBA3165D9"><enum>(c)</enum><header>Waiver authority
				relating to reemployed annuitants</header>
							<paragraph id="HBAB9CDDAA3224E5C884C6FE1D32D560"><enum>(1)</enum><header>In
				general</header><text>In order to help address the challenges faced by the
				United States Border Patrol, the Secretary of Homeland Security may appoint
				annuitants to positions within the United States Border Patrol in accordance
				with succeeding provisions of this subsection.</text>
							</paragraph><paragraph id="HFF2F0BD58FB54C9095461F80E700D0B6"><enum>(2)</enum><header>Exclusion from
				offset</header><text>An annuitant serving in a position within the United
				States Border Patrol pursuant to an appointment made under paragraph
				(1)—</text>
								<subparagraph id="HB5FC2742245C4708A8E200FF887F7685"><enum>(A)</enum><text>shall not be
				subject to the provisions of section 8344 or 8468, as the case may be;
				and</text>
								</subparagraph><subparagraph id="HFFA6F7198EB249EBA094F3F9B6508F31"><enum>(B)</enum><text display-inline="yes-display-inline">shall not, for purposes of subchapter III
				of chapter 83 or chapter 84, be considered an employee.</text>
								</subparagraph></paragraph><paragraph id="H95F1040E28D64D2DA37028913D1EFDBE"><enum>(3)</enum><header>Limitations</header>
								<subparagraph id="H380186A05AFD4EDE98E22D5856FEF06F"><enum>(A)</enum><header>Appointments</header><text>The
				authority to make any appointments under paragraph (1) shall terminate five
				years after the date of the enactment of this subsection.</text>
								</subparagraph><subparagraph id="H37538F224FC143C1A8D6082225DDB064"><enum>(B)</enum><header>Exclusion</header><text>The
				provisions of paragraph (2) shall not, in the case of any annuitant appointed
				under paragraph (1), remain in effect—</text>
									<clause id="H4E962B9DDD3548E1A46766E61F16C31C"><enum>(i)</enum><text>with respect to
				more than five years of service (in the aggregate); nor</text>
									</clause><clause id="H217005857E6D4DFDA3CE9E77FE1CF7A7"><enum>(ii)</enum><text>with respect to
				any service performed after the end of the ten-year period beginning on the
				date of the enactment of this subsection.</text>
									</clause></subparagraph></paragraph><paragraph id="H91AE7C2D458F47ABAF7388560025FA31"><enum>(4)</enum><header>Definition</header><text>For
				purposes of this subsection, the term <quote>annuitant</quote> has the meaning
				given such term by section 8331 or 8401, as the case may
				be.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H29CB7A67CFA7425FBDEE5FA72263132"><enum>(b)</enum><header>Conforming
			 amendment</header><text>The table of contents for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/97">chapter 97</external-xref> of title 5, United
			 States Code, is amended by adding at the end the following:</text>
