<section id="H87C49BA7B009474BA5A9DFD834B5CCD" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Reconstruction and Stabilization Civilian Management Act of 2006</short-title></quote>.</text></section> 
<section id="HE10FACCEDC0A4B6484DEE347CC045C87"><enum>2.</enum><header>Finding; purpose</header> 
<subsection id="H705C6238AC974105843C0000F7767767"><enum>(a)</enum><header>Finding</header><text>Congress finds that the resources of the Armed Forces have been burdened by having to undertake stabilization and reconstruction tasks in the Balkans, Afghanistan, Iraq, and other countries of the world that could have been performed by civilians, which has resulted in lengthy deployments for members of the Armed Forces.</text></subsection> 
<subsection id="HC06E88F7C7F24F87A972262E0053DA76"><enum>(b)</enum><header>Purpose</header><text>The purpose of this Act is to provide for the continued development, as a core mission of the Department of State and the United States Agency for International Development, of an effective expert civilian response capability to carry out reconstruction and stabilization activities in a country or region that is at risk of, in, or is in transition from, conflict or civil strife.</text></subsection></section> 
<section id="H5DF96ABE00484B3D87011E9E00059EE4"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="H2A73A9A1C9924296803273AB97725FA7"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the United States Agency for International Development.</text></paragraph> 
<paragraph id="H983A05A81FF2476C9C035725C5BB91B"><enum>(2)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means the Committee on International Relations of the House of Representatives and the Committee on Foreign Relations of the Senate.</text></paragraph> 
<paragraph id="H93B1ABFD9C0740A1A9A350E49B30A21E"><enum>(3)</enum><header>Department</header><text>Except as otherwise provided in this Act, the term <term>Department</term> means the Department of State.</text></paragraph> 
<paragraph id="HEA3672D51C164A2581D6857E5EF1DD5F"><enum>(4)</enum><header>Executive agency</header><text>The term <term>Executive agency</term> has the meaning given that term in <external-xref legal-doc="usc" parsable-cite="usc/5/105">section 105</external-xref> of title 5, United States Code.</text></paragraph> 
<paragraph id="HE5A3D421E9E74C24AB03AF05848352AE"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of State.</text></paragraph></section> 
<section id="H50BFC4753C2449D7B22E44FC11108484"><enum>4.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text> 
<paragraph id="HAE928389D2DF4A9FAECB00847B693541"><enum>(1)</enum><text>the civilian element of United States joint civilian-military operations should be strengthened in order to enhance the execution of current and future reconstruction and stabilization activities in foreign countries or regions that are at risk of, in, or are in transition from, conflict or civil strife;</text></paragraph> 
<paragraph id="H3F1199EAF69A4559AF31F8B009FD49B"><enum>(2)</enum><text>the capability of civilian agencies of the United States Government to carry out reconstruction and stabilization activities in such countries or regions should also be enhanced through a new rapid response corps of civilian experts supported by the establishment of a new system of planning, organization, personnel policies, education and training, and the provision of adequate resources;</text></paragraph> 
<paragraph id="H20E0502289974C78973DABE951B6A3B7"><enum>(3)</enum><text>the international community, including nongovernmental organizations, and the United Nations and its specialized agencies, should be further encouraged to participate in planning and organizing reconstruction and stabilization activities in such countries or regions;</text></paragraph> 
<paragraph id="HDD226145E62B4551876CDA8722DA7FFF"><enum>(4)</enum><text display-inline="yes-display-inline">the executive branch has taken a number of steps to strengthen civilian capability, including the establishment in the Department of the Office of the Coordinator for Reconstruction and Stabilization, the Presidential designation of the Secretary as the interagency coordinator and leader of reconstruction and stabilization efforts, and Department of Defense directives to the military to support the Office of the Coordinator Reconstruction and Stabilization and to work closely with counterparts in the Department of State and other civilian agencies to develop and enhance personnel, training, planning, and analysis;</text></paragraph> 
<paragraph id="H381BEABD6DA24A5A9364A7893EABE8F8"><enum>(5)</enum><text>the Secretary and the Administrator should work with the Secretary of Defense to augment existing personnel exchange programs among the Department, the United States Agency for International Development, and the Department of Defense, including the regional commands and the Joint Staff, to enhance the stabilization and reconstruction skills of military and civilian personnel and their ability to undertake joint operations; and</text></paragraph> 
<paragraph id="H63B09FBCA2914912BF8E30CBC68D46E2"><enum>(6)</enum><text>the heads of other executive agencies should establish personnel exchange programs that are designed to enhance the stabilization and reconstruction skills of military and civilian personnel.</text></paragraph></section> 
<section id="H0524C66F678E4FE487C3A458015D8E4F"><enum>5.</enum><header>Authority to provide assistance for Reconstruction and Stabilization crises</header><text display-inline="no-display-inline">Chapter 1 of part III of the <act-name parsable-cite="FAA61">Foreign Assistance Act of 1961</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/22/2351">22 U.S.C. 2351 et seq.</external-xref>) is amended by inserting after section 617 the following new section:</text> 
<quoted-block display-inline="no-display-inline" id="HAE57C95D1ED74AC0BD33A544EE76F593" style="OLC"> 
<section id="HB45340083C554E30B9EB297DC3DC33EA"><enum>618.</enum><header>Assistance for a reconstruction and stabilization crisis</header> 
<subsection id="HDCEDF198638A498B008F1BC61100894C"><enum>(a)</enum><header>Authority</header><text>If the President determines that it is important to the security interests of the United States for United States civilian agencies or non-Federal employees to assist in stabilizing and reconstructing a country or region that is at risk of, in, or is in transition from, conflict or civil strife, the President may, in accordance with the provisions set forth in section 614(a)(3), notwithstanding any other provision of law, and on such terms and conditions as the President may determine, furnish assistance to respond to the crisis.</text></subsection> 
<subsection id="H0E674E0CAD744F88ABFD00D90026E954"><enum>(b)</enum><header>Special authorities</header><text>In furtherance of a determination made under subsection (a), the President may exercise the authorities contained in sections 552(c)(2) and 610 of this Act without regard to the percentage and aggregate dollar limitations contained in such sections.</text></subsection> 
<subsection id="HDFCEC6E5E58F4CF7AE95DAB9289A1C5"><enum>(c)</enum><header>Authorization of funding</header> 
<paragraph id="H8192D1B8A38B47F8B74053E6CE226E2"><enum>(1)</enum><header>Initial authorization</header><text>There is authorized to be appropriated, without fiscal year limitation, $75,000,000 to provide assistance authorized in subsection (a) and, to the extent authorized under paragraph (2), for the purpose described in such paragraph.</text></paragraph> 
<paragraph id="H83959A52E5C2438999EDA7A1ECE7F65"><enum>(2)</enum><header>Availability of funds for Response Readiness Corps</header><text>Of the amount authorized to be appropriated pursuant to paragraph (1), $25,000,000 may be made available for fiscal year 2007 for expenses related to the development, training, and operations of the Response Readiness Corps established under section 61(c) of the State Department Basic Authorities Act of 1956. The availability of such funds shall not be subject to a determination by the President under subsection (a).</text></paragraph> 
<paragraph id="H88819ED4F4B543DA9C70DD71E8D107DA"><enum>(3)</enum><header>Replenishment</header><text>There is authorized to be appropriated each fiscal year such sums as may be necessary to replenish funds expended as provided under paragraph (1). Funds authorized to be appropriated under this paragraph shall be available without fiscal year limitation for the same purpose and under the same conditions as are provided under paragraph (1).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HA2DB85A53965436EB29CC558687170C0"><enum>6.</enum><header>Office of the Coordinator for Reconstruction and Stabilization</header><text display-inline="no-display-inline">Title I of the <act-name parsable-cite="SDBAA">State Department Basic Authorities Act of 1956</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/22/2651">22 U.S.C. 2651 et seq.</external-xref>) is amended by adding at the end the following new section:</text> 
<quoted-block display-inline="no-display-inline" id="H5E3220BD6B4D44A1BD42B4B98D8BF578" style="OLC"> 
<section id="H51C51D03C2FF4FACAA13E946C36E9F06"><enum>61.</enum><header>Reconstruction and stabilization</header> 
<subsection id="HB5114D926E834686AD31E120B7C8591C"><enum>(a)</enum><header>Office of the Coordinator for Reconstruction and Stabilization</header> 
<paragraph id="H726BA28CD4D346F0BD20C0E411B04300"><enum>(1)</enum><header>Establishment</header><text>There is established within the Department of State the Office of the Coordinator for Reconstruction and Stabilization.</text></paragraph> 
<paragraph id="H9A58886755B54B8DB94C93CFBD412247"><enum>(2)</enum><header>Coordinator for Reconstruction and Stabilization</header><text>The head of the Office shall be the Coordinator for Reconstruction and Stabilization, who shall be appointed by the President, by and with the advice and consent of the Senate. The Coordinator shall report directly to the Secretary and shall have the rank and status of Ambassador at Large.</text></paragraph> 
<paragraph id="HF706BCB2136744E69E5500448FA3F842"><enum>(3)</enum><header>Functions</header><text>The functions of the Office of the Coordinator for Reconstruction and Stabilization shall include the following:</text> 
<subparagraph id="H16382136731D4F299C5EBDD2009B9E90"><enum>(A)</enum><text>Monitoring, in coordination with relevant bureaus within the Department of State, political and economic instability worldwide to anticipate the need for mobilizing United States and international assistance for the stabilization and reconstruction of countries or regions that are at risk of, in, or are in transition from, conflict or civil strife.</text></subparagraph> 
<subparagraph id="HD35F1F56A1764C3CBB8D111C34641CD3"><enum>(B)</enum><text>Assessing the various types of stabilization and reconstruction crises that could occur and cataloging and monitoring the non-military resources and capabilities of Executive agencies (as that term is defined in <external-xref legal-doc="usc" parsable-cite="usc/5/105">section 105</external-xref> of title 5, United States Code) that are available to address such crises.</text></subparagraph> 
<subparagraph id="HE3A39FAE7DF540ED91577126A2F81B38"><enum>(C)</enum><text>Planning to address requirements, such as demobilization, policing, human rights monitoring, and public information, that commonly arise in stabilization and reconstruction crises.</text></subparagraph> 
<subparagraph id="H34A2F53651C944C29476F9847FF3E190"><enum>(D)</enum><text>Coordinating with relevant Executive agencies to develop interagency contingency plans to mobilize and deploy civilian personnel to address the various types of such crises.</text></subparagraph> 
<subparagraph id="H3440C171C5EF4CA1B8D8F325A4CDA548"><enum>(E)</enum><text>Entering into appropriate arrangements with other Executive agencies to carry out activities under this section and the Reconstruction and Stabilization Civilian Management Act of 2006.</text></subparagraph> 
<subparagraph id="H1483BD8947904D3D9D4D00AEC2B2C600"><enum>(F)</enum><text>Identifying personnel in State and local governments and in the private sector who are available to participate in the Response Readiness Corps or the Response Readiness Reserve established under subsection (b) or to otherwise participate in or contribute to stabilization and reconstruction activities.</text></subparagraph> 
<subparagraph id="H2F1F6522C36E4E8D97E98D5E52A885"><enum>(G)</enum><text>Taking steps to ensure that training of civilian personnel to perform such stabilization and reconstruction activities is adequate and, as appropriate, includes security training that involves exercises and simulations with the Armed Forces, including the regional commands.</text></subparagraph> 
<subparagraph id="HD7B5844F89214B4A007406DE047F88F"><enum>(H)</enum><text>Sharing information and coordinating plans for stabilization and reconstruction activities, as appropriate, with the United Nations and its specialized agencies, the North Atlantic Treaty Organization, nongovernmental organizations, and other foreign national and international organizations.</text></subparagraph> 
<subparagraph id="H98BC86443441429D95085839FBF464C1"><enum>(I)</enum><text>Coordinating plans and procedures for joint civilian-military operations with respect to stabilization and reconstruction activities.</text></subparagraph> 
<subparagraph id="H9122F78207664B8EA930705EE8E29441"><enum>(J)</enum><text>Maintaining the capacity to field on short notice an evaluation team to undertake on-site needs assessment.</text></subparagraph></paragraph></subsection> 
<subsection id="H6BD342BAF791428A92179E58D7A23F00"><enum>(b)</enum><header>Response to stabilization and reconstruction crisis</header><text>If the President makes a determination regarding a stabilization and reconstruction crisis under section 618 of the <act-name parsable-cite="FAA61">Foreign Assistance Act of 1961</act-name>, the President may designate the Coordinator, or such other individual as the President may determine appropriate, as the Coordinator of the United States response. The individual so designated, or, in the event the President does not make such a designation, the Coordinator for Reconstruction and Stabilization, shall—</text> 
<paragraph id="HB0983458B8BB4005A19F54E7CD32C466"><enum>(1)</enum><text>assess the immediate and long-term need for resources and civilian personnel;</text></paragraph> 
<paragraph id="H3414D3301386495480917999FF00E4AA"><enum>(2)</enum><text>identify and mobilize non-military resources to respond to the crisis; and</text></paragraph> 
<paragraph id="HD55EA0B1A62546349E26BF105C41A38"><enum>(3)</enum><text>coordinate the activities of the other individuals or management team, if any, designated by the President to manage the United States response.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H63357C97D9DC444DA29771A8D3B5F69B"><enum>7.</enum><header>Response Readiness Corps</header> 
<subsection id="H26A3A706763D4E1E8E953FFF6FDEEDB9"><enum>(a)</enum><header>In General</header><text>Section 61 of the <act-name parsable-cite="SDBAA">State Department Basic Authorities Act of 1956</act-name> (as added by section 6) is amended by adding at the end the following new subsection:</text>

<subsection id="HD04137BD9B2943D3B0403720697299CC"><enum>(c)</enum><header>Response Readiness Corps</header> 
<paragraph id="HF3389707889945A5A35D92E289FA6F90"><enum>(1)</enum><header>Response readiness active duty personnel</header> 
<subparagraph id="H05B10CCF755B44E0B04B00BC84D68EF"><enum>(A)</enum><header>Establishment and purpose</header><text>The Secretary, in consultation with the Administrator of the United States Agency for International Development, is authorized to establish a Response Readiness Corps (hereafter referred to in this section as the <quote>Corps</quote>) to provide assistance in support of stabilization and reconstruction activities in foreign countries or regions that are at risk of, in, or are in transition from, conflict or civil strife.</text></subparagraph> 
<subparagraph id="H2ED91CDBCB1C4E618D10C800CD490000"><enum>(B)</enum><header>Composition</header><text>The Secretary and Administrator should coordinate in the recruitment, hiring, and training of—</text> 
<clause id="H1384F9A8BB5C4E2CBD1C7D07E5417D3F"><enum>(i)</enum><text>up to 250 personnel to serve in the active duty Corps; and</text></clause> 
<clause id="HB4DC97FCDF1D42C1BA94E6570057D040"><enum>(ii)</enum><text>such other personnel as the Secretary, in consultation with the Administrator, may designate as members of the Corps from among employees of the Department and the United States Agency for International Development.</text></clause></subparagraph> 
<subparagraph id="H726F2FC073404FF100F0BB6163FB598E"><enum>(C)</enum><header>Training</header><text>The Secretary is authorized to train the members of the Corps to perform services necessary to carry out the purpose of the Corps under subparagraph (A).</text></subparagraph> 
<subparagraph id="H7DFA42398A7D44A298F51D94AAC8C343"><enum>(D)</enum><header>Compensation</header><text>Members of the Corps hired under subparagraph (B)(i) shall be compensated in accordance with the appropriate salary class for the Foreign Service, as set forth in sections 402 and 403 of the <act-name parsable-cite="FSA80">Foreign Service Act of 1980</act-name> (22 U.S.C. 3962 and <external-xref legal-doc="usc" parsable-cite="usc/22/3963">22 U.S.C. 3963</external-xref>), or in accordance with the relevant authority under sections <external-xref legal-doc="usc" parsable-cite="usc/5/3101">3101</external-xref> and <external-xref legal-doc="usc" parsable-cite="usc/5/3392">3392</external-xref> of title 5, United States Code.</text></subparagraph></paragraph> 
<paragraph id="H3F2E1A4AC9064F8784A25CF83745CC7D"><enum>(2)</enum><header>Response readiness reserve duty personnel</header> 
<subparagraph id="H748CCE173D6D46B395987F0796CD08A4"><enum>(A)</enum><header>Establishment and purpose</header><text>The Secretary, in consultation with the heads of other relevant Executive agencies, is authorized to establish and maintain a roster of personnel who are trained and available as needed to perform services necessary to carry out the purpose of the Corps under paragraph (1)(A). The personnel listed on the roster shall constitute a reserve component of the Response Readiness Corps.</text></subparagraph> 
<subparagraph id="H52A0D069A54C434400A140014DD741D8"><enum>(B)</enum><header>Federal employees</header><text>The Response Readiness reserve component may include employees of the Department, including employees of the United States Agency for International Development, employees of any other Executive agency, and employees from the legislative and judicial branches who—</text> 
<clause id="HFF5C185138DA4E11BAD5CEB36D00BC76"><enum>(i)</enum><text>have the training and skills necessary to enable them to contribute to stabilization and reconstruction activities; and</text></clause> 
<clause id="HE7B20DB647904D19A508AB9915F5BCE4"><enum>(ii)</enum><text>have volunteered for deployment to carry out stabilization and reconstruction activities.</text></clause></subparagraph> 
<subparagraph id="HC8877377A9B54BB0A30068616349512F"><enum>(C)</enum><header>Non-Federal personnel</header><text>The Response Readiness reserve component should also include not fewer than 500 personnel, who may include retired employees of the Federal Government, contractor personnel, nongovernmental organization personnel, and State and local government employees, who—</text> 
<clause id="H05EEB306C7F7480DADFF8BC125CA3DF"><enum>(i)</enum><text>have the training and skills necessary to enable them to contribute to stabilization and reconstruction activities; and</text></clause> 
<clause id="HD01EAC6662B049B9BDE227A0CAE2BB30"><enum>(ii)</enum><text>have volunteered to carry out stabilization and reconstruction activities.</text></clause></subparagraph></paragraph> 
<paragraph id="H1FB15B1223A04F81819F00A6C3C06B43"><enum>(3)</enum><header>Use of Response Readiness Corps</header> 
<subparagraph id="H4D7B5B6886524A5BA2A063406B566F98"><enum>(A)</enum><header>Response readiness active duty component</header><text>The members of the active duty Corps are authorized to be available—</text> 
<clause id="HCD93A0AED15C49C396C24D76052DAE51"><enum>(i)</enum><text>if responding in support of stabilization and reconstruction activities pursuant to a determination by the President regarding a stabilization and reconstruction crisis under section 618 of the <act-name parsable-cite="FAA61">Foreign Assistance Act of 1961</act-name>, for deployment in support of such activities; and</text></clause> 
<clause id="H58245824B0EB41CCAF4CCC962D89003F"><enum>(ii)</enum><text>if not responding as described in clause (i), for assignment in the United States, United States diplomatic missions, and United States Agency for International Development missions.</text></clause></subparagraph> 
<subparagraph id="HE49F58DA09A240FABC76F89D99325B29"><enum>(B)</enum><header>Response readiness reserve component</header><text>The Secretary may deploy members of the reserve component under paragraph (2) in support of stabilization and reconstruction activities in a foreign country or region if the President makes a determination regarding a stabilization and reconstruction crisis under section 618 of the <act-name parsable-cite="FAA61">Foreign Assistance Act of 1961</act-name>.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HD314C2BD2E304B979F675BD4AD01A2B2"><enum>(b)</enum><header>Employment authority</header><text>The full-time personnel authorized to be employed in the Response Readiness Corps under section 61(c)(1)(B)(i) of the <act-name parsable-cite="SDBAA">State Department Basic Authorities Act of 1956</act-name> (as added by subsection (a)) shall be in addition to any other full-time personnel of the Department or the United States Agency for International Development authorized to be employed under any other provision of law.</text></subsection> 
<subsection id="HE620481C385548629E4D7DBAF3767B"><enum>(c)</enum><header>Report</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary shall submit to the appropriate congressional committees a report on the status of efforts to establish the Response Readiness Corps under this section. The report should include recommendations for any legislation necessary to implement subsection (a).</text></subsection></section> 
<section id="H625411027D414219B0C04C9CA91066CF"><enum>8.</enum><header>Stabilization and reconstruction training and education</header><text display-inline="no-display-inline">Section 701 of the <act-name parsable-cite="FSA80">Foreign Service Act of 1980</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/22/4021">22 U.S.C. 4021</external-xref>) is amended—</text> 
<paragraph id="HDF24AE39167C49149E84AAFA776EA4A9"><enum>(1)</enum><text>by redesignating subsection (g) as subsection (h); and</text></paragraph> 
<paragraph id="H1FBD0826A36B48F9AD233862D06B326C"><enum>(2)</enum><text>by inserting after subsection (f) the following new subsection:</text>

<subsection id="H2D11C801DCF7445DAB37CF6E00CEA770"><enum>(g)</enum><header>Stabilization and reconstruction curriculum</header> 
<paragraph id="H657CEFCD3D64492BBD1235E1180035E0" commented="no"><enum>(1)</enum><header>Establishment and mission</header><text>The Secretary, in cooperation with the Secretary of Defense and the Secretaries of the Army and Navy, is authorized to establish a stabilization and reconstruction curriculum for use in programs of the Foreign Service Institute, the Center for Stabilization and Reconstruction Studies at the Naval Postgraduate School, the National Defense University, and the United States Army War College. </text></paragraph> 
<paragraph id="H0A3506E4CCCB435CBD5C94337832DCFC"><enum>(2)</enum><header>Curriculum content</header><text>The curriculum referred to in paragraph (1) should include the following:</text> 
<subparagraph id="H6716BE695F694953BEE78BCA60325695"><enum>(A)</enum><text>An overview of the global security environment, including an assessment of transnational threats and an analysis of United States policy options to address such threats.</text></subparagraph> 
<subparagraph id="HAF2D54547F8C4F7AAA55B52E00B1E651"><enum>(B)</enum><text>A review of lessons learned from previous United States and international experiences in stabilization and reconstruction activities.</text></subparagraph> 
<subparagraph id="H1CE51F9309C24A98B261006000CCCD51"><enum>(C)</enum><text>An overview of the relevant responsibilities, capabilities, and limitations of various Executive agencies (as that term is defined in <external-xref legal-doc="usc" parsable-cite="usc/5/105">section 105</external-xref> of title 5, United States Code) and the interactions among them.</text></subparagraph> 
<subparagraph id="H45206F4A10C543D38914C7EA4DCA355D"><enum>(D)</enum><text>A discussion of the international resources available to address stabilization and reconstruction requirements, including resources of the United Nations and its specialized agencies, nongovernmental organizations, private and voluntary organizations, and foreign governments, together with an examination of the successes and failures experienced by the United States in working with such entities.</text></subparagraph> 
<subparagraph id="H57FA473D14694FBFADCCA1592FEE6E00"><enum>(E)</enum><text>A study of the United States interagency system.</text></subparagraph> 
<subparagraph id="H73820C6352164E3B83C5F14F63002DB0"><enum>(F)</enum><text>Foreign language training.</text></subparagraph> 
<subparagraph id="HBD48E87A5C33499E81007BA3BD07BE2D"><enum>(G)</enum><text>Training and simulation exercises for joint civilian-military emergency response operations.</text></subparagraph></paragraph> 
<paragraph id="H1BD1A73838CD406D9B046CFDA9F5435F" commented="no"><enum>(3)</enum><header>Existing training and education programs</header><text display-inline="yes-display-inline">The Secretary shall ensure that personnel of the Department make use of the relevant existing training and education programs offered within the Government, such as those at the Center for Stabilization and Reconstruction Studies at the Naval Postgraduate School and the Interagency Training, Education, and After Action Review Program at the National Defense University.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H93D540D2892D481C9393E0C28F702799"><enum>9.</enum><header>Service related to stabilization and reconstruction</header> 
<subsection id="HB9D3A264492E4ABD951EA6DF00B44384"><enum>(a)</enum><header>Promotion purposes</header><text>Service in stabilization and reconstruction activities overseas, membership in the Response Readiness Corps under section 61(c) of the <act-name parsable-cite="SDBAA">State Department Basic Authorities Act of 1956</act-name> (as added by section 7), and education and training in the stabilization and reconstruction curriculum established under section 701(g) of the <act-name parsable-cite="FSA80">Foreign Service Act of 1980</act-name> (as added by section 8) should be considered among the favorable factors for the promotion of employees of Executive agencies.</text></subsection> 
<subsection id="H9BFFE6E96C354AD2BC0098201F301DE6"><enum>(b)</enum><header>Personnel training and promotion</header><text>The Secretary and the Administrator should take steps to ensure that, not later than three years after the date of the enactment of this Act, at least ten percent of the employees of the Department and the United States Agency for International Development in the United States are members of the Response Readiness Corps or are trained in the activities of, or identified for potential deployment in support of, the Response Readiness Corps. The Secretary should provide such training as needed to Ambassadors and Deputy Chiefs of Mission.</text></subsection> 
<subsection id="HBFDE78949E92413086249F2CEFB71794"><enum>(c)</enum><header>Other incentives and benefits</header><text>The Secretary and the Administrator may establish and administer a system of awards and other incentives and benefits to confer appropriate recognition of and reward any individual who is assigned, detailed, or deployed to carry out stabilization or reconstruction activities in accordance with this Act.</text></subsection></section> 
<section id="H30BB4A680CF54944A95278298FBE8382"><enum>10.</enum><header>Authorities related to personnel</header> 
<subsection id="H07C016ECFA8F4926BFB27D456490A457"><enum>(a)</enum><header>Contracting authority</header> 
<paragraph id="H466FCF0F658C42A58B3E4E8BB75CBD"><enum>(1)</enum><header>In general</header><text>The Secretary, or the Administrator with the concurrence of the Secretary, may enter into contracts to procure the services of nationals of the United States (as defined in section 101(a)(22) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(22)</external-xref>) or aliens authorized to be employed in the United States as personal services contractors for the purpose of carrying out this Act, without regard to civil service or classification laws, for service in the Office of the Coordinator for Reconstruction and Stabilization or for service in foreign countries to assist in stabilizing and reconstructing a country or region that is at risk of, in, or is in transition from, conflict or civil strife.</text></paragraph> 
<paragraph id="H681F2BE4A7D146DBAF3366BD6D3E3D1"><enum>(2)</enum><header>Not employees</header><text>Individuals performing services under contracts described in paragraph (1) shall not by virtue of performing such services be considered to be employees of the United States Government for purposes of any law administered by the Office of Personnel Management (except that the Secretary or Administrator may determine the applicability to such individuals of any law administered by the Secretary or Administrator concerning the performance of such services by such individuals).</text></paragraph></subsection> 
<subsection id="H8CBBD385C89C49E2842578C6CE7F2962"><enum>(b)</enum><header>Experts and consultants</header><text>The Secretary and the Administrator may, to the extent necessary to obtain services without delay, employ experts and consultants under <external-xref legal-doc="usc" parsable-cite="usc/5/3109">section 3109</external-xref> of title 5, United States Code, for the purpose of carrying out this Act, without requiring compliance with any otherwise applicable requirements for that employment as the Secretary or Administrator may determine, except that such employment shall be terminated after 60 days if by that time the applicable requirements are not complied with.</text></subsection> 
<subsection id="H3792218B44A746648E9DDC48F27EA60"><enum>(c)</enum><header>Authority to accept and assign details</header><text>The Secretary is authorized to accept details or assignments of employees of Executive agencies, members of the uniformed services (as defined in <external-xref legal-doc="usc" parsable-cite="usc/5/2101">section 2101</external-xref> of title 5, United States Code), and employees of State or local governments on a reimbursable or nonreimbursable basis for the purpose of carrying out this Act. The assignment of an employee of a State or local government under this subsection shall be consistent with subchapter VI of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/33">chapter 33</external-xref> of title 5, United States Code.</text></subsection> 
<subsection id="H7C9B5FC2FB2D4F8CBC06B029A688D832" commented="no"><enum>(d)</enum><header>Dual compensation waiver for annuitants under Civil Service Retirement System and Federal Employees’ Retirement System</header><text>Notwithstanding sections <external-xref legal-doc="usc" parsable-cite="usc/5/8344">8344(i)</external-xref> and <external-xref legal-doc="usc" parsable-cite="usc/5/8468">8468(f)</external-xref> of title 5, United States Code, the Secretary or the head of another Executive agency, as authorized by the Secretary, may waive the application of subsections (a) through (h) of section 8344 and subsections (a) through (e) of section 8468 with respect to annuitants under the Civil Service Retirement System or the Federal Employees’ Retirement System who are assigned, detailed, or deployed to assist in stabilizing and reconstructing a country or region that is at risk of, in, or is in transition from, conflict or civil strife during the period of their reemployment.</text></subsection> 
<subsection id="HBF80B9E0351641C499D13B62CDB1D080"><enum>(e)</enum><header>Increase in premium pay cap</header><text>The Secretary, or the head of another Executive agency as authorized by the Secretary, may compensate an employee detailed, assigned, or deployed to assist in stabilizing and reconstructing a country or region that is at risk of, in, or is in transition from, conflict or civil strife, without regard to the limitations on premium pay set forth in <external-xref legal-doc="usc" parsable-cite="usc/5/5547">section 5547</external-xref> of title 5, United States Code, to the extent that the aggregate of the basic pay and premium pay of such employee for a year does not exceed the annual rate payable for level II of the Executive Schedule.</text></subsection> 
<subsection id="H799BB1DCEA3D47DC00BB76B00ACB0E3"><enum>(f)</enum><header>Extension of certain foreign service benefits</header><text>The Secretary, or the head of another Executive agency as authorized by the Secretary, may extend to any individuals assigned, detailed, or deployed to carry out stabilization and reconstruction activities in accordance with this Act, the benefits or privileges set forth in sections 412, 413, 704, and 901 of the <act-name parsable-cite="FSA80">Foreign Service Act of 1980</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/22/3972">22 U.S.C. 3972</external-xref>, <external-xref legal-doc="usc" parsable-cite="usc/22/3973">22 U.S.C. 3973</external-xref>, <external-xref legal-doc="usc" parsable-cite="usc/22/4024">22 U.S.C. 4024</external-xref>, and <external-xref legal-doc="usc" parsable-cite="usc/22/4081">22 U.S.C. 4081</external-xref>) to the same extent and manner that such benefits and privileges are extended to members of the Foreign Service.</text></subsection> 
<subsection id="H9D84AF5C4E654D1FA2CA6B18C8916DF6"><enum>(g)</enum><header>Compensatory time</header><text>Notwithstanding any other provision of law, the Secretary may, subject to the consent of an individual who is assigned, detailed, or deployed to carry out stabilization and reconstruction activities in accordance with this Act, grant such individual compensatory time off for an equal amount of time spent in regularly or irregularly scheduled overtime work. Credit for compensatory time off earned shall not form the basis for any additional compensation. Any such compensatory time not used within 26 pay periods shall be forfeited.</text></subsection> 
<subsection id="HD44C9E3044F9485E8FE0242F9BED00CC"><enum>(h)</enum><header>Acceptance of volunteer services</header> 
<paragraph id="HC0C6B5D8BBB943E098C2FEE01B00F3B6"><enum>(1)</enum><header>In general</header><text>The Secretary may accept volunteer services for the purpose of carrying out this Act without regard to <external-xref legal-doc="usc" parsable-cite="usc/31/1342">section 1342</external-xref> of title 31, United States Code.</text></paragraph> 
<paragraph id="HD0066D618FC54CC5B63BC336C2F749D"><enum>(2)</enum><header>Types of volunteers</header><text>Donors of volunteer services accepted for purposes of this section may include—</text> 
<subparagraph id="HAE9560169290401A84A1A90090FCDCA2"><enum>(A)</enum><text>advisors;</text></subparagraph> 
<subparagraph id="H3A27A90858454C80A0AA265618E2918B"><enum>(B)</enum><text>experts;</text></subparagraph> 
<subparagraph id="H9F3C0BD4FA8F4CF4B05EEE1C7342FC87"><enum>(C)</enum><text>consultants; and</text></subparagraph> 
<subparagraph id="HFE60AB381201453C8B2D321B005509CB"><enum>(D)</enum><text>persons performing services in any other capacity determined appropriate by the Secretary.</text></subparagraph></paragraph> 
<paragraph id="H557ECA9342704E748BB980EFDF267FD7"><enum>(3)</enum><header>Supervision</header><text>The Secretary shall—</text> 
<subparagraph id="H07109852C0E6478A80791388BC7DAC31"><enum>(A)</enum><text>ensure that each individual performing volunteer services accepted under this section is notified of the scope of the volunteer services accepted;</text></subparagraph> 
<subparagraph id="H9569942E144645298B24A6F5A95B7E21"><enum>(B)</enum><text>supervise the volunteer to the same extent as employees receiving compensation for similar services; and</text></subparagraph> 
<subparagraph id="H3A5C4125B214429C9B651E13FDE4D72"><enum>(C)</enum><text>ensure that the volunteer has appropriate credentials or is otherwise qualified to perform in each capacity for which the volunteer’s services are accepted.</text></subparagraph></paragraph> 
<paragraph id="H197682EA7D2449DFA16EF6D28E0C968"><enum>(4)</enum><header>Applicability of law relating to Federal Government employees</header><text>An individual providing volunteer services accepted under this section shall not be considered an employee of the Federal Government in the performance of those services, except for the purposes of the following provisions of law:</text> 
<subparagraph id="H8E3A8A0F13F7497B9406C8D91FE45C61"><enum>(A)</enum><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/81">Chapter 81</external-xref> of title 5, United States Code, relating to compensation for work-related injuries.</text></subparagraph> 
<subparagraph id="H284D2CBF13D44769BA6EFD7E1F1E3BBF"><enum>(B)</enum><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/11">Chapter 11</external-xref> of title 18, United States Code, relating to conflicts of interest.</text></subparagraph></paragraph> 
<paragraph id="H1C6D0F5507A04F10BBC0B7AA821DCAE"><enum>(5)</enum><header>Applicability of law relating to volunteer liability protection</header> 
<subparagraph id="HCB90EB3E67654D9D9B78270028D967A6"><enum>(A)</enum><header>In general</header><text>A person providing volunteer services accepted under this section shall be deemed to be a volunteer of a nonprofit organization or governmental entity, with respect to the accepted services, for purposes of the Volunteer Protection Act of 1997 (<external-xref legal-doc="usc" parsable-cite="usc/42/14501">42 U.S.C. 14501 et seq.</external-xref>).</text></subparagraph> 
<subparagraph id="H982E0A4805D648B191E5C1CE2E5170A3"><enum>(B)</enum><header>Inapplicability of exceptions to volunteer liability protection</header><text>Section 4(d) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/14503">42 U.S.C. 14503(d)</external-xref>) shall not apply with respect to the liability of a person with respect to services of such person that are accepted under this section.</text></subparagraph></paragraph></subsection> 
<subsection id="H53275DF688B34FB583C20001BE28D418"><enum>(i)</enum><header>Authority for outside advisors</header> 
<paragraph id="H5F47BCB10C7846288B0002E9198800A7"><enum>(1)</enum><header>In general</header><text>The Secretary may establish temporary advisory commissions composed of individuals with appropriate expertise to facilitate the carrying out of this Act.</text></paragraph> 
<paragraph id="H2751395F307B43ECBD765FF3F357EA2"><enum>(2)</enum><header>Inapplicability of FACA</header><text>The requirements of the <act-name parsable-cite="FACA">Federal Advisory Committee Act</act-name> (5 U.S.C. App.) shall not apply to the activities of a commission established under this subsection.</text></paragraph></subsection></section> 
<section id="H7D22E99FA9D44F84ABB1BE6214650068"><enum>11.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated $80,000,000 for fiscal year 2007 for personnel, education and training, equipment, and travel costs for purposes of carrying out this Act and the amendments made by this Act.</text></section>
