		<section id="HA7AC160396B046F8889B45BE874413D9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Hedge Fund Study
			 Act</short-title></quote>.</text>
		</section><section id="HC7A568E2A7F3464B95EC6B7EA84749F0"><enum>2.</enum><header>Study and report
			 on hedge fund industry</header>
			<subsection id="H45204C6F77A1404D88558B7299CF4B1F"><enum>(a)</enum><header>Study</header><text display-inline="yes-display-inline">The President’s Working Group on Financial
			 Markets shall conduct a study of the hedge fund industry. The study shall
			 include an analysis of—</text>
				<paragraph id="H2BF342CBB8394CD1AEF4EADF7167982"><enum>(1)</enum><text display-inline="yes-display-inline">the changing nature of hedge funds and what
			 characteristics define a hedge fund;</text>
				</paragraph><paragraph id="H5DDB325D669F4D34A19E71D08D03A433"><enum>(2)</enum><text>the growth of
			 hedge funds within financial markets;</text>
				</paragraph><paragraph id="HB9C719FF90B9484191F427A3E8A4BAB0"><enum>(3)</enum><text>the growth of
			 pension funds investing in hedge funds;</text>
				</paragraph><paragraph id="H76D02F39F87C4B5B9D87E5544703C03F"><enum>(4)</enum><text>whether hedge fund
			 investors are able to protect themselves adequately from the risk associated
			 with their investments;</text>
				</paragraph><paragraph id="H57D996EE9AA14F8BB9F4952892C92FED"><enum>(5)</enum><text>whether hedge fund
			 leverage is effectively constrained;</text>
				</paragraph><paragraph id="H1BBFBCA41BC047B69BB3DF3024ECF2D1"><enum>(6)</enum><text>the potential
			 risks hedge fund pose to financial markets or to investors;</text>
				</paragraph><paragraph id="H3ABDE04156F8438FBB56E4CEE16747C9"><enum>(7)</enum><text display-inline="yes-display-inline">various international approaches to the
			 regulation of hedge funds; and</text>
				</paragraph><paragraph id="HBDDF4F4470494D44AAA4EDB41099B877"><enum>(8)</enum><text display-inline="yes-display-inline">the benefits of the hedge fund industry to
			 the economy and the markets.</text>
				</paragraph></subsection><subsection id="H42B1399EDBF54FB4B8DF8623E7602F15"><enum>(b)</enum><header>Report and
			 recommendations</header><text display-inline="yes-display-inline">Not later
			 than 180 days after the date of enactment of this Act, the President’s Working
			 Group on Financial Markets shall submit a report on its findings to the
			 Committee on Financial Services of the House of Representatives and the
			 Committee on Banking, Housing, and Urban Affairs of the Senate. The report
			 shall include recommendations, including—</text>
				<paragraph id="H2978F0B9AAD24199B16C32E65D64F019"><enum>(1)</enum><text>any proposed
			 legislation relating to appropriate disclosure requirements for hedge
			 funds;</text>
				</paragraph><paragraph id="H8B7B0B06208A4CBBAC83448B541D3809"><enum>(2)</enum><text display-inline="yes-display-inline">the type of information hedge funds should
			 disclose to regulators and to the public;</text>
				</paragraph><paragraph id="H2AE0C5C3E0764F2B94D81DD680EFAE5"><enum>(3)</enum><text display-inline="yes-display-inline">any efforts the hedge fund industry or
			 regulators of financial institutions should undertake to improve practices or
			 provide examples of successful industry initiatives; and</text>
				</paragraph><paragraph id="HA167CD0390684DF28C007400D8D4DA2C"><enum>(4)</enum><text>any oversight
			 responsibilities that members of the President’s Working Group should have over
			 the hedge fund industry, and the degree and scope of such oversight.</text>
				</paragraph></subsection></section></legis-body>
