<section display-inline="no-display-inline" id="H96C64F2412D84D2BB9B0A555E0EC47C7" section-type="subsequent-section"><enum>101.</enum><header>Limitation on length of noncompetitive contracts</header> 
<subsection id="H12AD29FB366540179F23D28C75B8B531"><enum>(a)</enum><header>Revision of FAR</header><text>Not later than one year after the date of the enactment of this Act, the Federal Acquisition Regulation shall be revised to restrict the contract period of any contract described in subsection (c) to the minimum contract period necessary—</text> 
<paragraph id="H2E4CC65CBB2A4E35B6A378858988F786"><enum>(1)</enum><text>to meet the urgent and compelling requirements of the work to be performed under the contract; and</text> </paragraph>
<paragraph id="H14F4DD21A59D44C4BF462795C7CBF851"><enum>(2)</enum><text>to enter into another contract for the required goods or services through the use of competitive procedures.</text> </paragraph></subsection>
<subsection id="HDE02B3F847BF4F9082F678CF97D8774D"><enum>(b)</enum><header>Contract period</header><text>The regulations promulgated under subsection (a) shall require the contract period to not exceed 240 days, unless the head of the executive agency concerned determines that exceptional circumstances apply.</text> </subsection>
<subsection id="H2B0299CCB8024D9989C77BDBF7C492D5"><enum>(c)</enum><header>Covered contracts</header><text display-inline="yes-display-inline">This section applies to any contract in an amount greater than the simplified acquisition threshold entered into by an executive agency using procedures other than competitive procedures pursuant to the exception provided in section 303(c)(2) of the Federal Property and Administrative Services Act of 1949 (<external-xref legal-doc="usc" parsable-cite="usc/41/253">41 U.S.C. 253(c)(2)</external-xref>) or <external-xref legal-doc="usc" parsable-cite="usc/10/2304">section 2304(c)(2)</external-xref> of title 10, United States Code.</text> </subsection>
<subsection id="H8342D5A007E04A63BEF7CB0025217DB8"><enum>(d)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="HDF0E83468D5844DABD5DE122F4176E1B"><enum>(1)</enum><text>The term <quote>executive agency</quote> has the meaning provided in section 4(1) of the Office of Federal Procurement Policy Act (<external-xref legal-doc="usc" parsable-cite="usc/41/403">41 U.S.C. 403(1)</external-xref>).</text> </paragraph>
<paragraph id="H2956737B590B4C348E00EADB6037A8D3"><enum>(2)</enum><text>The term <quote>head of the executive agency</quote> means the head of an executive agency except that, in the case of a military department, the term means the Secretary of Defense.</text> </paragraph></subsection></section>
<section display-inline="no-display-inline" id="HC0332B5E550E44BAAD6800E6B9C1ADC" section-type="subsequent-section"><enum>102.</enum><header>Competition in multiple award contracts</header> 
<subsection id="HC8F0948D3D4C40E984B59EDC84D0FE96"><enum>(a)</enum><header>Expansion of applicability to all government contracts</header><text>Title III of the Federal Property and Administrative Services Act of 1949 (<external-xref legal-doc="usc" parsable-cite="usc/41/251">41 U.S.C. 251 et seq.</external-xref>) is amended by inserting after section 303M the following new section:</text> 
<quoted-block id="H3AA9AB55AA354F7C00155F3749C022C9"> 
<section id="HCDFA8FA8EE26447C8B2E8370F8ED9EBC"><enum>303N.</enum><header>Competition in multiple award contracts</header> 
<subsection id="HA949F5EC57BF4DDE9953BEE93E21058B"><enum>(a)</enum><header>Regulations required</header><text>Not later than 180 days after the date of the enactment of this section, the Federal Acquisition Regulation shall be revised to require competition in the purchase of goods and services by each executive agency pursuant to multiple award contracts.</text> </subsection>
<subsection id="H2DF148FF36564280B2EE004B20A2BEF9"><enum>(b)</enum><header>Content of regulations</header>
<paragraph commented="no" display-inline="yes-display-inline" id="H14DFBBF5453E48AD81DC227D59524BD5"><enum>(1)</enum><text>The regulations required by subsection (a) shall provide, at a minimum, that each individual purchase of goods or services in excess of $100,000 that is made under a multiple award contract shall be made on a competitive basis unless a contracting officer of the executive agency—</text> 
<subparagraph id="H64D837CB473D4228B3C73F1CD007699D" indent="up1"><enum>(A)</enum><text>waives the requirement on the basis of a determination that—</text> 
<clause id="H040769A4A5A1492FB121001C5EF5875E"><enum>(i)</enum><text>one of the circumstances described in paragraphs (1) through (4) of section 303J(b) applies to such individual purchase; or</text> </clause>
<clause id="H1B40D4C9B97C481CA06C9FE9F4E61B5"><enum>(ii)</enum><text>a statute expressly authorizes or requires that the purchase be made from a specified source; and</text> </clause></subparagraph>
<subparagraph id="HFEEA186D75264E149255DD88BED86D60" indent="up1"><enum>(B)</enum><text>justifies the determination in writing.</text> </subparagraph></paragraph>
<paragraph id="H4C2D0D150A3248A5008700906FEA99EB" indent="up1"><enum>(2)</enum><text>For purposes of this subsection, an individual purchase of goods or services is made on a competitive basis only if it is made pursuant to procedures that—</text> 
<subparagraph id="H470110ED5D5549E896E5F09196CCFA70"><enum>(A)</enum><text>require fair notice of the intent to make that purchase (including a description of the work to be performed and the basis on which the selection will be made) to be provided to all contractors offering such goods or services under the multiple award contract; and</text> </subparagraph>
<subparagraph id="H66E677593C8A44B4B07B4016EFFE5866"><enum>(B)</enum><text>afford all contractors responding to the notice a fair opportunity to make an offer and have that offer fairly considered by the official making the purchase.</text> </subparagraph></paragraph>
<paragraph id="HF1AF44BB577D4DA3A342D2A1F737CFC" indent="up1"><enum>(3)</enum><text>Notwithstanding paragraph (2), notice may be provided to fewer than all contractors offering such goods or services under a multiple award contract described in subsection (c)(2)(A) if notice is provided to as many contractors as practicable.</text> </paragraph>
<paragraph id="H4B48A1D5673E4EFB84B4A1DE95F787DF" indent="up1"><enum>(4)</enum><text>A purchase may not be made pursuant to a notice that is provided to fewer than all contractors under paragraph (3) unless—</text> 
<subparagraph id="H21346B679F0B4F619021C3195727EA05"><enum>(A)</enum><text>offers were received from at least three qualified contractors; or</text> </subparagraph>
<subparagraph id="HBA956BAFE2CE4EB8A51F5055E4300083"><enum>(B)</enum><text>a contracting officer of the executive agency determines in writing that no additional qualified contractors were able to be identified despite reasonable efforts to do so.</text> </subparagraph></paragraph></subsection>
<subsection id="H10C8212D30054B5788DB995522B1B4F7"><enum>(c)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H0EFA594A0BE346C5A6F79BDDE411109E"><enum>(1)</enum><text>The term <quote>individual purchase</quote> means a task order, delivery order, or other purchase.</text> </paragraph>
<paragraph id="HAE22200F9DC643ABB12C213400FD58D2"><enum>(2)</enum><text>The term <quote>multiple award contract</quote> means—</text> 
<subparagraph id="HF57554998F48466CAA268B1D9B8B1C57"><enum>(A)</enum><text>a contract that is entered into by the Administrator of General Services under the multiple award schedule program referred to in section 309(b)(3);</text> </subparagraph>
<subparagraph id="H41916A23D0D7445FA660D937959BD28D"><enum>(B)</enum><text>a multiple award task order contract that is entered into under the authority of sections 2304a through 2304d of title 10, United States Code, or sections 303H through 303K; and</text> </subparagraph>
<subparagraph id="HA58B6B7AC9F9466FB4D88CDE66CD95DC"><enum>(C)</enum><text>any other indefinite delivery, indefinite quantity contract that is entered into by the head of an executive agency with two or more sources pursuant to the same solicitation.</text> </subparagraph></paragraph></subsection>
<subsection id="HCC80501F36D34FBD90DB6F847746043E"><enum>(d)</enum><header>Applicability</header><text>The revisions to the Federal Acquisition Regulation pursuant to subsection (a) shall take effect not later than 180 days after the date of the enactment of this section and shall apply to all individual purchases of goods or services that are made under multiple award contracts on or after the effective date, without regard to whether the multiple award contracts were entered into before, on, or after such effective date.</text> </subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection>
<subsection id="HB20D57F3E6BD46FDA3E73559F85699C8"><enum>(b)</enum><header>Conforming amendments to defense contract provision</header><text>Section 803 of the National Defense Authorization Act for Fiscal Year 2002 (<external-xref legal-doc="public-law" parsable-cite="pl/107/107">Public Law 107–107</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/10/2304">10 U.S.C. 2304</external-xref> note) is amended as follows:</text> 
<paragraph id="HD0D048B0BCE34CAA86C76C0004294EFC"><enum>(1)</enum><text>The section heading is amended by inserting <quote><header-in-text level="section">GOODS OR</header-in-text></quote> before <quote><header-in-text level="section">SERVICES</header-in-text></quote>.</text> </paragraph>
<paragraph id="HED58F850BD3C43DBBACD808F7F019600"><enum>(2)</enum><text>Subsection (a) is amended by inserting <quote>goods and</quote> before <quote>services</quote>.</text> </paragraph>
<paragraph id="H54325C7734364980AC8DE1E558FB6FA"><enum>(3)</enum><text>The following provisions are amended by inserting <quote>goods or</quote> before <quote>services</quote> each place it appears:</text> 
<subparagraph id="H8D7DF165C2BE4D15A6BFAF871B38383B"><enum>(A)</enum><text>Paragraphs (1), (2), and (3) of subsection (b).</text> </subparagraph>
<subparagraph id="H7F6CC5BD2CD543798132D8BDA4455BB"><enum>(B)</enum><text>Subsection (d).</text> </subparagraph></paragraph>
<paragraph id="H6CD3909AA12A45959775826000CA70CA"><enum>(4)</enum><text>Such section is amended by adding at the end the following new subsection:</text>

<subsection id="H3CBEDE3509B24F8B91BD11F9FED5126"><enum>(e)</enum><header>Applicability to goods</header><text>The Secretary shall revise the regulations promulgated pursuant to subsection (a) to cover purchases of goods by the Department of Defense pursuant to multiple award contracts. The revised regulations shall take effect in final form not later than 180 days after the date of the enactment of this subsection and shall apply to all individual purchases of goods that are made under multiple award contracts on or after the effective date, without regard to whether the multiple award contracts were entered into before, on, or after such effective date.</text> </subsection><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection></section>
<section id="H99023A458AFE46FFA063B4B0794B6DF7"><enum>103.</enum><header>Minimizing sole-source contracts</header> 
<subsection id="H4A0D0CFCA6F6401889416EC9DDFB6FED"><enum>(a)</enum><header>Plans required</header><text display-inline="yes-display-inline">The head of each executive agency covered by title III of the Federal Property and Administrative Services Act of 1949 (<external-xref legal-doc="usc" parsable-cite="usc/41/251">41 U.S.C. 251 et seq.</external-xref>) and the head of each agency covered by <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/137">chapter 137</external-xref> of title 10, United States Code, shall develop and implement a plan to minimize the use of contracts entered into using procedures other than competitive procedures by the agency concerned. The plan shall contain measurable goals and shall be completed and submitted to the Committee on Government Reform of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate, with a copy provided to the Comptroller General, not later than 1 year after the date of the enactment of this Act.</text> </subsection>
<subsection id="H20EBD5A0CBFD4E2F93262E9B2DCE2EDE"><enum>(b)</enum><header>Comptroller General review</header><text>The Comptroller General shall review the plans provided under subsection (a) and submit a report to Congress on the plans not later than 18 months after the date of the enactment of this Act.</text> </subsection></section>
<section id="H9C66CD6FB6874D8F87DAF1009759C2CD"><enum>104.</enum><header>Public disclosure of justification and approval documents and other determinations for noncompetitive contracts</header> 
<subsection display-inline="no-display-inline" id="H33E3680748F44152B5899757B26181BE"><enum>(a)</enum><header>Civilian agency contracts</header><text>Section 303 of the Federal Property and Administrative Services Act of 1949 (<external-xref legal-doc="usc" parsable-cite="usc/41/253">41 U.S.C. 253</external-xref>) is amended by adding at the end the following new subsection:</text> 
<quoted-block display-inline="no-display-inline" id="H68A34E6CC99D4150A9AC9FDD01220660" style="OLC"> 
<subsection id="H66063A6DDA5844EC9442658BDFC9C3EE"><enum>(j)</enum>
<paragraph commented="no" display-inline="yes-display-inline" id="H0AD45E876F4144A6A2DDEEF32F59CBCA"><enum>(1)</enum><text>In the case of a procurement permitted by subsection (c), the head of an executive agency shall make publically available, within 14 days after the award of the contract, the documents containing the following:</text> 
<subparagraph id="HAC1100A2AFFE461EBAC2A5A5A4B1086D"><enum>(A)</enum><text>The justification and approval required by subsection (f)(1) with respect to the procurement.</text> </subparagraph>
<subparagraph id="HE022CC9040FB401CB0CC261697E06508"><enum>(B)</enum><text>Any determination with respect to the procurement that exceptional circumstances apply, under section 101(b) of the <short-title>Clean Contracting Act</short-title>.</text> </subparagraph>
<subparagraph id="H64CB4B5AAED14813B77DE0FF59E2A02C"><enum>(C)</enum><text>Any determination with respect to the procurement under section 303H(d)(3)(C) (relating to a monopoly contract).</text> </subparagraph>
<subparagraph id="H8D4878415D7A4DEFBF7E00463FA60050"><enum>(D)</enum><text>Any determination with respect to the procurement that exceptional circumstances apply, under section 202(b) of the <short-title>Clean Contracting Act</short-title>.</text> </subparagraph></paragraph>
<paragraph id="H727D88CA52194E73AB8B2E863900BA81" indent="up1"><enum>(2)</enum><text>The documents shall be made available on the website of the agency and through the Federal Procurement Data System.</text> </paragraph>
<paragraph id="HF6DBA2E9E4804605B1DFE9ACEFE3205C" indent="up1"><enum>(3)</enum><text>Nothing in this subsection shall be construed to supersede or otherwise affect <external-xref legal-doc="usc" parsable-cite="usc/5/552">section 552</external-xref> of title 5.</text> </paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection>
<subsection id="HB9C8A3F75CBD46DCA1C1332B2C24F014"><enum>(b)</enum><header>Defense agency contracts</header><text><external-xref legal-doc="usc" parsable-cite="usc/10/2304">Section 2304</external-xref> of title 10, United States Code, is amended by adding at the end the following new subsection:</text>

<subsection id="H639A81AEEDC6430A91FFE6E7AE407BA6"><enum>(l)</enum>
<paragraph commented="no" display-inline="yes-display-inline" id="H52E360ADEAA342BCA2AC2482B3DFA203"><enum>(1)</enum><text>In the case of a procurement permitted by subsection (c), the head of an agency shall make publically available, within 14 days after the award of the contract, the documents containing the following:</text> 
<subparagraph id="HC67BD40299BF48FF8F70982DA42C47B8"><enum>(A)</enum><text>The justification and approval required by subsection (f)(1) with respect to the procurement.</text> </subparagraph>

<subsection id="HA91A6C49B6D4476482A294AAF638804C"><enum>(a)</enum><header>Civilian agency contracts</header><text></text> 
<paragraph id="H615F4A34F53D4EA585E83E4EEE364291"><enum>(1)</enum><text>Paragraph (3) of section 303H(d) of title III of the Federal Property and Administrative Services Act of 1949 (<external-xref legal-doc="usc" parsable-cite="usc/41/253h">41 U.S.C. 253h(d)</external-xref>) is amended to read as follows:</text>

<section id="HA018BB34D730474B8562A79E1D1E9340"><enum>202.</enum><header>Limitations on tiering of subcontractors</header> 
<subsection id="HE2BB7D9600284C4DABEC526257352600"><enum>(a)</enum><header>Revision of FAR</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of this Act, the Federal Acquisition Regulation shall be revised to minimize the excessive use by contractors of subcontractors or tiers of subcontractors to perform the principal work of any contract described in subsection (c).</text> </subsection>
<subsection id="HC78DEC2EEA4643C6ABA14E394F4B92AF"><enum>(b)</enum><header>Specific requirement</header><text>At a minimum, the regulations promulgated under subsection (a) shall—</text> 
<paragraph id="H6B1161DA179B4735AD3BBA6F9BE4852F"><enum>(1)</enum><text>preclude a contractor from using subcontracts for more than 65 percent of the cost of the contract (not including overhead and profit), unless the head of the executive agency concerned determines that exceptional circumstances apply; and</text> </paragraph>
<paragraph id="H89A52A2CA3A6467D826807971C04BEC1"><enum>(2)</enum><text display-inline="yes-display-inline">preclude a subcontractor from using a lower tier subcontractor for more than 65 percent of the cost of the subcontract (not including overhead and profit), unless the head of the executive agency concerned determines that exceptional circumstances apply.</text> </paragraph></subsection>
<subsection id="H178615688CF542DE965900ED8D17BF19"><enum>(c)</enum><header>Covered contracts</header><text display-inline="yes-display-inline">This section applies to any cost-reimbursement type contract in an amount greater than the simplified acquisition threshold entered into by an executive agency.</text> </subsection>
<subsection id="HB5D8655F44DF4B00852E98E117F587D6"><enum>(d)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="HBDC6B91DE6F045C90013D69F712DA454"><enum>(1)</enum><text>The term <quote>executive agency</quote> has the meaning provided in section 4(1) of the Office of Federal Procurement Policy Act (<external-xref legal-doc="usc" parsable-cite="usc/41/403">41 U.S.C. 403(1)</external-xref>).</text> </paragraph>
<paragraph id="H35F03CE0E49E415C9E0059F6DA662100"><enum>(2)</enum><text>The term <quote>head of the executive agency</quote> means the head of an executive agency except that, in the case of a military department, the term means the Secretary of Defense.</text> </paragraph></subsection></section>
<section id="H8B353CA476EC407798C050A773349460"><enum>203.</enum><header>Minimizing cost-reimbursement type contracts</header> 
<subsection id="H6BE009A03BD44ED4BF70E4003C727BDE"><enum>(a)</enum><header>Plans required</header><text display-inline="yes-display-inline">The head of each executive agency covered by title III of the Federal Property and Administrative Services Act of 1949 (<external-xref legal-doc="usc" parsable-cite="usc/41/251">41 U.S.C. 251 et seq.</external-xref>) and the head of each agency covered by <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/137">chapter 137</external-xref> of title 10, United States Code, shall develop and implement a plan to minimize the use of cost-reimbursement type contracts by the agency concerned. The plan shall contain measurable goals and shall be completed and submitted to the Committee on Government Reform of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate, with a copy provided to the Comptroller General, not later than 1 year after the date of the enactment of this Act.</text> </subsection>
<subsection id="HF962F09B2CE74F74B152AE1687049166"><enum>(b)</enum><header>Comptroller General review</header><text>The Comptroller General shall review the plans provided under subsection (a) and submit a report to Congress on the plans not later than 18 months after the date of the enactment of this Act.</text> </subsection></section></title>
<title id="H6B7FA13C0D0C4BE3B5AB4489DAE4F914"><enum>III</enum><header>Preventing the abuse of contract flexibilities</header> 
<section id="H9FCB7D91CF404564B77E81F2D3646C8D"><enum>301.</enum><header>Preventing abuse of commercial item authority</header><text display-inline="no-display-inline">Section 4(12) of the Office of Federal Procurement Policy Act (<external-xref legal-doc="usc" parsable-cite="usc/41/403">41 U.S.C. 403(12)</external-xref>) is amended—</text> 
<paragraph id="H7FBB0F7A08B743F3BC007B78DBD94457"><enum>(1)</enum><text>by striking the following:</text> 
<quoted-block display-inline="no-display-inline" id="H810B5B09340449439D190023E1F8F21" style="OLC"> 
<subparagraph id="H0EB10254D5784CCDBCBB0000A7528D75"><enum>(C)</enum><text>Any item that, but for—</text>

<clause id="H9AC78DF6B54E4984B2FFAF94895706F"><enum>(ii)</enum><text>minor modifications made to meet Federal Government requirements,</text> </clause><continuation-text continuation-text-level="subparagraph">would satisfy the criteria in subparagraph (A) or (B).</continuation-text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block> </paragraph>
<paragraph id="HCB95C57C0E50482F9F342B409FD21EF6"><enum>(2)</enum><text>in subparagraphs (D) and (E), by striking <quote>(C),</quote> each place it appears.</text> </paragraph></section>
<section id="H77CA7F2BC2A647B9B3E35BE99052E61B"><enum>302.</enum><header>Preventing abuse of other transaction authority</header><text display-inline="no-display-inline">Section 845(d)(1) of the National Defense Authorization Act for Fiscal Year 1994 (<external-xref legal-doc="usc" parsable-cite="usc/10/2371">10 U.S.C. 2371</external-xref> note) is amended—</text> 
<paragraph id="HF2F945808EEE48728E676BECABEBAD63"><enum>(1)</enum><text>by striking <quote>unless— </quote> and all that follows in subparagraph (A) through <quote>at least</quote> and inserting <quote>unless there is at least</quote>;</text> </paragraph>
<paragraph id="HF965CF2D53B8404B88390858AF6C2F60"><enum>(2)</enum><text>by striking <quote>; or</quote> and inserting a period; and</text> </paragraph>
<paragraph id="HC2D35999E1EF4620AFDB7BEAA4CFE7D4" indent="up1"><enum>(3)</enum><text>by striking the following:</text> 
<quoted-block display-inline="no-display-inline" id="HF9E87640C48C4C4E955E0925FA00F25" style="OLC"> 
<subparagraph commented="no" id="H787C0C1E58CF4D7AAE51679DE202C2DD"><enum>(B)</enum><text>no nontraditional defense contractor is participating to a significant extent in the prototype project, but at least one of the following circumstances exists:</text> 
<clause id="H1319DC42CCBA4DA8AEE5D1006707B2DD"><enum>(i)</enum><text>At least one third of the total cost of the prototype project is to be paid out of funds provided by parties to the transaction other than the Federal Government.</text> </clause>
<clause id="HE79F2A1301564D73A572C6AEA8A84B6E"><enum>(ii)</enum><text>The senior procurement executive for the agency (as designated for the purposes of section 16(3) of the Office of Federal Procurement Policy Act (<external-xref legal-doc="usc" parsable-cite="usc/41/414">41 U.S.C. 414(3)</external-xref>) determines in writing that exceptional circumstances justify the use of a transaction that provides for innovative business arrangements or structures that would not be feasible or appropriate under a contract.</text> </clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></section>
<section id="HB1E817C217174912B588B04452BE5CBE"><enum>303.</enum><header>Preventing abuse of interagency contracts</header> 
<subsection id="H95B48FE702054B3795AEC084DB01C82C"><enum>(a)</enum><header>Office of management and budget policy guidance</header> 
<paragraph id="H9840913B3BE84C07859DBF84391F22D3"><enum>(1)</enum><header>Report and guidelines</header><text>Not later than one year after the date of the enactment of this Act, the Director of the Office of Management and Budget shall—</text> 
<subparagraph id="HF7F99759FDE74762BEB900F900C9FB3D"><enum>(A)</enum><text>submit to Congress a comprehensive report on interagency acquisitions, including their frequency of use, management controls, cost-effectiveness, and savings generated; and</text> </subparagraph>
<subparagraph id="HA0B3E6792FCB41E2A6DB00A3BCD32300"><enum>(B)</enum><text>issue guidelines to assist the heads of executive agencies in improving the management of interagency acquisitions.</text> </subparagraph></paragraph>
<paragraph id="H6FB14A64D6DF48668D4D46CFEA002C3F"><enum>(2)</enum><header>Matters covered by guidelines</header><text>For purposes of paragraph (1)(B), the Director shall include guidelines on the following matters:</text> 
<subparagraph id="HCE0F9B5F6A7E41499C4C67FC88344412"><enum>(A)</enum><text>Procedures for the use of interagency acquisitions to maximize competition, deliver best value to executive agencies, and minimize waste, fraud, and abuse.</text> </subparagraph>
<subparagraph id="H90B26FF5302042058BC766A1C665C88"><enum>(B)</enum><text display-inline="yes-display-inline">Categories of contracting inappropriate for interagency acquisition, due to high risk of waste, fraud, or abuse.</text> </subparagraph>
<subparagraph id="H7DBD3E3975494881B114B518BFD6666F"><enum>(C)</enum><text>Requirements for training acquisition workforce personnel in the proper use of interagency acquisitions.</text> </subparagraph></paragraph></subsection>
<subsection id="H657702DA5DC4402C9232A0F7CB059407"><enum>(b)</enum><header>Regulations required</header><text>Not later than one year after the date of the enactment of this Act, the Federal Acquisition Regulation shall be revised to require that all interagency acquisitions—</text> 
<paragraph id="H2F557B649CD54E8DAAD188241BFFFFEE"><enum>(1)</enum><text>include a written agreement between the requesting agency and the servicing agency assigning responsibility for the administration and management of the contract;</text> </paragraph>
<paragraph id="HF0FE7AED36764260A5E47006949ABB"><enum>(2)</enum><text>include a determination that an interagency acquisition is the best procurement alternative; and</text> </paragraph>
<paragraph id="H56711A5CFBA7412BB83B3064CCB4E468"><enum>(3)</enum><text>include sufficient documentation to ensure an adequate audit.</text> </paragraph></subsection>
<subsection id="H2DF1E737E9944FA7ADD380F625344C12"><enum>(c)</enum><header>Agency reporting requirement</header><text>The senior procurement executive for each executive agency shall, as directed by the Director of the Office of Management and Budget, submit to the Director annual reports on the actions taken by the executive agency pursuant to the guidelines issued under subsection (a).</text> </subsection>
<subsection id="H665E61363A2A4F3D9F01EED681E12D0"><enum>(d)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H5856D26F7226419C8DF28E3E7D3B2C41"><enum>(1)</enum><text>The term <quote>executive agency</quote> has the meaning given such term in section 4(1) of the Office of Federal Procurement Policy Act (<external-xref legal-doc="usc" parsable-cite="usc/41/403">41 U.S.C. 403(1)</external-xref>).</text> </paragraph>
<paragraph id="H4067F8653FCE49FC8918BDA3AC384F10"><enum>(2)</enum><text>The term <quote>head of executive agency</quote> means the head of an executive agency except that, in the case of a military department, the term means the Secretary of Defense.</text> </paragraph>
<paragraph id="HDD771AD81800454BAE035100CB3F92A"><enum>(3)</enum><text>The term <quote>interagency acquisition</quote> means a procedure by which an executive agency needing supplies or services (the requesting agency) obtains them from another executive agency (the servicing agency). The term includes acquisitions under <external-xref legal-doc="usc" parsable-cite="usc/31/1535">section 1535</external-xref> of title 31, United States Code (commonly referred to as the <quote>Economy Act</quote>, Federal Supply Schedules, and government-wide acquisition contracts.</text> </paragraph></subsection></section>
<section id="H2D020C7A845D4976BCDB5413B29077DD"><enum>304.</enum><header>Preventing abuse of Government credit cards</header> 
<subsection id="HBD3982FB73F9469082167BE8B89C9B00"><enum>(a)</enum><header>Office of management and budget policy guidance</header><text>Not later than 180 days after the date of enactment of this Act, the Director of the Office of Management and Budget shall revise Appendix B of OMB Circular A–123 to ensure the adequacy of the following:</text> 
<paragraph id="HDCFB2D718AFF4EEAA742C71E3B0100EA"><enum>(1)</enum><text>Procedures for identifying employees who should receive government credit cards.</text> </paragraph>
<paragraph id="HFB071F7C6D1E4AA2B0149CCFE98E8778"><enum>(2)</enum><text>Requirements for training employees in the proper use of government credit cards.</text> </paragraph>
<paragraph id="H30D3C362780A4D7CADC7F8AF69C03706"><enum>(3)</enum><text>Procedures for monitoring and auditing government credit cards to prevent waste, fraud, and abuse.</text> </paragraph>
<paragraph id="HC96AC1702BD94ACAA700EEB1F071F444"><enum>(4)</enum><text>Procedures for preventing the use of government credit cards for personal purchases.</text> </paragraph>
<paragraph id="H6230DCEB278243F0AFCE47A0DFE8A1D6"><enum>(5)</enum><text>Requirements to ensure adequate personnel for monitoring and auditing government credit card use.</text> </paragraph>
<paragraph id="H811FB31F9876419285AE780087B7A5B2"><enum>(6)</enum><text>Procedures for the collection and dissemination of best practices and successful strategies for achieving savings through the use of government credit cards.</text> </paragraph></subsection>
<subsection id="H0169FB19ADB040A492F0FD7280BE17BF"><enum>(b)</enum><header>Reporting requirement</header><text>Not later than one year after the date of the enactment of this Act, the Director of the Office of Management and Budget shall report to Congress a Government-wide summary for the previous fiscal year of the information required to be reported to OMB by executive agencies pursuant to OMB Circular A–123 (as revised February, 2006).</text> </subsection>
<subsection id="H6C23B44625A546A6AB4CFA8C4364C93"><enum>(c)</enum><header>Definitions</header><text>In this section the term <quote>government credit card</quote> means an account established by a commercial financial institution on behalf of agencies or individual agency employees to which the cost of purchasing goods and services may be charged and includes government-issued purchase, travel, and fleet cards.</text> </subsection></section>
<section display-inline="no-display-inline" id="HFDC0F29CC42843E7B431CE46B09535A7" section-type="subsequent-section"><enum>305.</enum><header>Repeal of Alaska Native Corporation loophole</header><text display-inline="no-display-inline">Section 602(a) of the Business Opportunity Development Reform Act of 1988 (<external-xref legal-doc="public-law" parsable-cite="pl/100/656">Public Law 100–656</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/15/637">15 U.S.C. 637</external-xref> note) is hereby repealed.</text> </section></title>

<paragraph id="HB8B582D2F6B34B9A86C15D149B4E9121"><enum>(4)</enum><text>Contract audits and enforcement.</text> </paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection>
<subsection id="H286650ADD8A742FFB4B0875BF3FE2FD3"><enum>(b)</enum><header>Defense contracts</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/141">Chapter 141</external-xref> of title 10, United States Code, is amended by adding at the end the following new section:</text> 
<quoted-block display-inline="no-display-inline" id="HABE4B9DD899F47A8BE04FB001D95EE4F" style="USC"> 
<section id="H8C55331133A748CF9BFA5000AC82F5BA"><enum>2410p.</enum><header>Requirement for 1 percent of contract amounts to be used for contract personnel, administration, oversight, and planning</header><text display-inline="no-display-inline">In addition to the sums used for the purposes listed in this section as of the date of the enactment of this section, each fiscal year, the head of an agency (as defined in section 2302(1) of this title) shall ensure that the agency uses an additional amount equal to 1 percent of the aggregate amount of contracts entered into by the agency during that fiscal year for the following purposes:</text> 
<paragraph id="HBBD97B43BD9246D7BD8F9D8102735200"><enum>(1)</enum><text>Hiring and training of acquisition workforce personnel.</text> </paragraph>
<paragraph id="H332FD1F4127F4DA9946803942E954DF7"><enum>(2)</enum><text>Contract planning.</text> </paragraph>
<paragraph id="H451B1C42B4034A7691A72DB0F5B05866"><enum>(3)</enum><text>Contract administration and oversight.</text> </paragraph>
<paragraph id="HBE7196C8E9BE41149607B8CEF387A591"><enum>(4)</enum><text>Contract audits and enforcement.</text> </paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection></section>
<section id="H8A8EE9D18F694F6EA07D32765F698581"><enum>402.</enum><header>Prohibition on contractor conflicts of interest</header> 
<subsection id="H23447B67078E492C80E17EE3668DDD20"><enum>(a)</enum><header>Prohibition</header><text>An agency may not enter into a contract for the performance of a function relating to contract oversight with any contractor with a conflict of interest.</text> </subsection>
<subsection id="HC287F60925E64BA4B5AEE5B09D07F04"><enum>(b)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="HDB89C890940C49DA9CBB20A5F44277AD"><enum>(1)</enum><text>The term <quote>function relating to contract oversight</quote> includes the following specific functions:</text> 
<subparagraph id="H222AC4E2EF8D40FC9B00C3ACE0D13505"><enum>(A)</enum><text>Evaluation of a contractor’s performance.</text> </subparagraph>
<subparagraph id="H16A660E5B1844B9C96FEE157EB091922"><enum>(B)</enum><text>Evaluation of contract proposals.</text> </subparagraph>
<subparagraph id="HDEFCEF2A1E92433487290344A351B659"><enum>(C)</enum><text>Development of statements of work.</text> </subparagraph>
<subparagraph id="HB703B24635C9448EA4A442E298AFD57E"><enum>(D)</enum><text>Services in support of acquisition planning.</text> </subparagraph>
<subparagraph id="H88B655ADF8414B6A9CC788A015D91965"><enum>(E)</enum><text>Contract management.</text> </subparagraph></paragraph>
<paragraph id="HEB07B03F90F34B3698E80407CB9D4574"><enum>(2)</enum><text>The term <quote>conflict of interest</quote> includes cases in which the contractor performing the function relating to contract oversight, or any related entity—</text> 
<subparagraph id="H21DAFE3B2D2A4504B9EA007F9D306274"><enum>(A)</enum><text>is performing all or some of the work to be overseen;</text> </subparagraph>
<subparagraph id="HA56F4787EBEC465A9BC885ACC8247266"><enum>(B)</enum><text>has a separate ongoing business relationship, such as a joint venture or contract, with any of the contractors to be overseen or any related entity;</text> </subparagraph>
<subparagraph id="H6C33719C838547B881843E9E0050DD28"><enum>(C)</enum><text>would be placed in a position to affect the value or performance of work it or any related entity is doing under any other Government contract;</text> </subparagraph>
<subparagraph id="H9A43FB083F23440E80815D38269BA125"><enum>(D)</enum><text>has a reverse role with the contractor to be overseen under one or more separate Government contracts; and</text> </subparagraph>
<subparagraph id="HFF0329A6E609495881001789A8D98200"><enum>(E)</enum><text>has some other relationship with the contractor to be overseen that could reasonably appear to bias the contractor’s judgment.</text> </subparagraph></paragraph>
<paragraph id="HB22FD311FE30467889BC5B27CE3CAAB"><enum>(3)</enum><text display-inline="yes-display-inline">The term <quote>related entity</quote>, with respect to a contractor, means any subsidiary, parent, affiliate, joint venture, or other entity related to the contractor.</text> </paragraph></subsection>
<subsection id="H530ABB9DD6D44E4100B4C152C283009C"><enum>(c)</enum><header>Contracts relating to inherently governmental functions</header><text>An agency may not enter into a contract for the performance of inherently governmental functions for contract oversight (as described in subpart 7.5 of part 7 of the Federal Acquisition Regulation).</text> </subsection>
<subsection id="HCB0FA901918C400F93E204964C0867E0"><enum>(d)</enum><header>Effective date and applicability</header><text>This section shall take effect on the date of enactment of this Act and shall apply to—</text> 
<paragraph id="H7A754EC1B1C84A42A4C910C4ED0379F7"><enum>(1)</enum><text>contracts entered into on or after such date;</text> </paragraph>
<paragraph id="H85BEFCFAEB79400FA59B775120BB0714"><enum>(2)</enum><text>any task or delivery order issued on or after such date under a contract entered into before, on, or after such date; and</text> </paragraph>
<paragraph id="H2BB2C9B3FEE04CB08FB4E2B50397893"><enum>(3)</enum><text>any decision on or after such date to exercise an option or otherwise extend a contract for the performance of a function relating to contract oversight regardless of whether such contract was entered into before, on, or after the date of enactment of this Act.</text> </paragraph></subsection></section>
<section id="HD607104E0E65429EAB4F8F2BF038BB11"><enum>403.</enum><header>Disclosure of Government contractor overcharges</header> 
<subsection id="H49219D85A29B406A9628C9544E1CBF99"><enum>(a)</enum><header>Quarterly Report to Congress</header> 
<paragraph id="H4215428C1DE04E67A99E7C82947322BE"><enum>(1)</enum><text>The head of each Federal agency or department shall submit to the chairman and ranking member of each committee described in paragraph (2) on a quarterly basis a report that includes the following:</text> 
<subparagraph id="HCD5C51BE62C947EABFBFE03B00CA82EE"><enum>(A)</enum><text>A list of audits or other reports issued during the applicable quarter that describe contractor costs in excess of $1,000,000 that have been identified as unjustified, unsupported, questioned, or unreasonable under any contract, task or delivery order, or subcontract.</text> </subparagraph>
<subparagraph id="HAA96F9593AFD4977BA787100A53100C5"><enum>(B)</enum><text>The specific amounts of costs identified as unjustified, unsupported, questioned, or unreasonable and the percentage of their total value of the contract, task or delivery order, or subcontract.</text> </subparagraph>
<subparagraph id="H297A0D7C721443439F1362D446C1A912"><enum>(C)</enum><text>A list of audits or other reports issued during the applicable quarter that identify significant or substantial deficiencies in the performance of any contractor or in any business system of any contractor under any contract, task or delivery order, or subcontract.</text> </subparagraph></paragraph>
<paragraph id="HB8C55DC32BA149B08BD9A5BB7444796F"><enum>(2)</enum><text>The report described in paragraph (1) shall be submitted to the Committee on Government Reform of the House of Representatives, the Committee on Homeland Security and Governmental Affairs of the Senate, and other committees of jurisdiction.</text> </paragraph></subsection>
<subsection id="H93B7EAF5183D4428A08481771B8B844C"><enum>(b)</enum><header>Submission of individual audits</header><text>The head of each Federal agency or department shall provide, within 14 days after a request in writing by the chairman or ranking member of any of the committees described in subsection (a)(2), a full and unredacted copy of any audit or other report described in subsection (a)(1).</text> </subsection></section>
<section display-inline="no-display-inline" id="H4B035A8194C84CF0A7DE33214610D083" section-type="subsequent-section"><enum>404.</enum><header>Public availability of Federal contract awards</header> 
<subsection id="H782539E9284C4BF6B4F31EF69B465500"><enum>(a)</enum><header>Amendment</header><text>The Office of Federal Procurement Policy Act (<external-xref legal-doc="usc" parsable-cite="usc/41/403">41 U.S.C. 403 et seq.</external-xref>) is amended by inserting after section 19 the following new section:</text> 
<quoted-block display-inline="no-display-inline" id="H427990C5AC2B4C7D91FD72FEBF83B59" style="OLC"> 
<section id="H44E93D76B2B543E090A14C9BEBAFAE17"><enum>19A.</enum><header>Public availability of contract award information</header> 
<subsection id="H5DCED36804E044FF86A400739E8DA864"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subsection (b), not later than 14 days after the award of a contract by an executive agency, the head of the executive agency shall make publicly available, including by posting on the Internet in a searchable database, the following information with respect to the contract:</text> 
<paragraph id="HB48F8726E3324DF2AC61AFAFABEFA88"><enum>(1)</enum><text>The name and address of the contractor.</text> </paragraph>
<paragraph id="HE77D96B4529D40A4BE34DD33B9F9DCA"><enum>(2)</enum><text>The date of award of the contract.</text> </paragraph>
<paragraph id="H0B8B2FE893DC4645A7A91F6045D0E972"><enum>(3)</enum><text>The number of offers received in response to the solicitation.</text> </paragraph>
<paragraph id="HEB5DE966AC6C4DFFB3CDC78B657303D8"><enum>(4)</enum><text>The total amount of the contract.</text> </paragraph>
<paragraph id="H6E060A0D08924A498C9546398FE549EF"><enum>(5)</enum><text>The contract type.</text> </paragraph>
<paragraph id="H1D4E7C80371147429FD470DDF96300DA"><enum>(6)</enum><text>The items, quantities, and any stated unit price of items or services to be procured under the contract.</text> </paragraph>
<paragraph id="H1986A350C95845E2A31198724EF486BE"><enum>(7)</enum><text>With respect to a procurement carried out using procedures other than competitive procedures—</text> 
<subparagraph id="H64C43A1B9DA148218FB1DA51960CB97"><enum>(A)</enum><text>the authority for using such procedures under section 303(c) of title III of the Federal Property and Administrative Services Act of 1949 (<external-xref legal-doc="usc" parsable-cite="usc/41/253">41 U.S.C. 253(c)</external-xref>) or <external-xref legal-doc="usc" parsable-cite="usc/10/2304">section 2304(c)</external-xref> of title 10, United States Code; and</text> </subparagraph>
<subparagraph id="HA4CFA0632E094B68AE14B4DEB55CD7D6"><enum>(B)</enum><text>the number of sources from which bids or proposals were solicited.</text> </subparagraph></paragraph>
<paragraph id="H901C9EBC945943E7B2511E49DDB1C996"><enum>(8)</enum><text>The general reasons for selecting the contractor.</text> </paragraph>
<paragraph id="HD1DC8614743445E688C81032D8D08574"><enum>(9)</enum><text>The name of the executive agency that will receive the goods or services procured under the contract, if other than the agency awarding the contract.</text> </paragraph></subsection>
<subsection id="H4EDCA8EEBCC84818AF75F6D0D3227565"><enum>(b)</enum><header>Exception</header><text display-inline="yes-display-inline">Nothing in this section shall require the disclosure of classified information.</text> </subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection>
<subsection id="H99F69B07013542CBB883D9FC9863D17D"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents contained in section 1(b) of such Act is amended by inserting after the item relating to section 19 the following new item:</text>

<section display-inline="no-display-inline" id="HFF62BE882F1A4054B8FEFEFEAADE77C4" section-type="subsequent-section"><enum>405.</enum><header>Provision of information to Congress</header> 
<subsection id="H273BF631987C4E388F6893B363471810"><enum>(a)</enum><header>Provision of information to congress</header><text>Upon request of the chairman or ranking member of a committee described in subsection (b), the head of an executive agency shall provide, with respect to any contract or task or delivery order under a task or delivery order contract entered into by the agency, within 14 days after receipt of the request, unredacted copies of any documents required to be maintained in the contracting office contract file, the contract administration office contract file, and the paying office contract file pursuant to subpart 4.8 of the Federal Acquisition Regulation, including—</text> 
<paragraph id="H35CD65AC86A74DEABC8BBA87B8A760D9"><enum>(1)</enum><text>copies of the contract and all modifications;</text> </paragraph>
<paragraph id="H1387BFC2564346C0B542A8DCBEB0253C"><enum>(2)</enum><text>orders issued under the contract;</text> </paragraph>
<paragraph id="HFFAC5849EC71431F8FC7F0A61F73CB53"><enum>(3)</enum><text>justifications and approvals;</text> </paragraph>
<paragraph id="H8534BF5BE8014F31B8C0E8B91315C9D8"><enum>(4)</enum><text>any government estimate of contract price;</text> </paragraph>
<paragraph id="H65903A31F5514120A6C06B633E8E0058"><enum>(5)</enum><text>source selection documentation;</text> </paragraph>
<paragraph id="H0EAD19D182964DC998F623F812A022C0"><enum>(6)</enum><text>cost or price analysis;</text> </paragraph>
<paragraph id="HE0393D9C764641A0B55D93041B224915"><enum>(7)</enum><text>audit reports and other evaluations;</text> </paragraph>
<paragraph id="HB1EA8F26BEC14136A67C8DE2755DFA57"><enum>(8)</enum><text>justification for type of contract;</text> </paragraph>
<paragraph id="H3F08325CDA1546CB8105C8B1523BDC3"><enum>(9)</enum><text>authority for deviations from regulations, statutory requirements, or other restrictions;</text> </paragraph>
<paragraph id="H572E350519D7450DBD84547EF0F7B74"><enum>(10)</enum><text>bills, invoices, vouchers, and supporting documents;</text> </paragraph>
<paragraph id="H896545BB19114F6D9EEFAD019C844CE5"><enum>(11)</enum><text>records of payments or receipts; and</text> </paragraph>
<paragraph id="H237B0AC2B5AD43F0BED0E9762974D964"><enum>(12)</enum><text>compensation determinations.</text> </paragraph></subsection>
<subsection id="HFC3EBD6E28A04C3AA24CEB4CC947C6D1"><enum>(b)</enum><header>Committees</header><text>The committees referred to in subsection (a) are the following:</text> 
<paragraph id="H5195FFC25BFE41899BF5789312320065"><enum>(1)</enum><text>The Committee on Governmental Affairs of the Senate and the Committee on Government Reform of the House of Representatives.</text> </paragraph>
<paragraph id="HFE34DDCD79BE49489CCA67F62DF3B6E4"><enum>(2)</enum><text>The Committees on Appropriations of the Senate and House of Representatives.</text> </paragraph>
<paragraph id="H94D2B6E9DA514EDAA53038A1273FD555"><enum>(3)</enum><text>Each committee that the head of the executive agency determines has legislative jurisdiction for the operations of the department or agency to which the contract, task or delivery order, or other information referred to in subsection (a) relates.</text> </paragraph>
<paragraph id="HCAC0EC9D19FC4FF2BB8007BA4F5FEC5C"><enum>(4)</enum><text display-inline="yes-display-inline">A subcommittee of jurisdiction of any of the committees referred to in paragraphs (1), (2), or (3).</text> </paragraph></subsection></section>
<section id="H8222AF0BC4C2428086CF500FA7E5916"><enum>406.</enum><header>Oversight by the Government Reform Committee</header><text display-inline="no-display-inline">Clause (4)(c) of Rule X of the Rules of the House of Representatives is amended by adding at the end the following new subparagraph:</text> 
<quoted-block display-inline="no-display-inline" id="HC5B026F075F84487B0695C7F8712F4DD" style="OLC"> 
<paragraph id="H4706C90533AD4AB3BD7C7C41141C39C3"><enum>(3)</enum><text>In addition to its duties under subparagraph (1), the Committee on Government Reform, or their subcommittees of jurisdiction, shall hold hearings to investigate credible evidence or allegations of waste, fraud, abuse, or mismanagement in Federal contracts, including allegations or evidence presented in reports by an Inspector General of a Federal agency, the Government Accountability Office, or the Defense Contract Audit Agency.</text> </paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </section>
<section display-inline="no-display-inline" id="H3939D29B64EA4071B595DAF663C5A9E1" section-type="subsequent-section"><enum>407.</enum><header>Nonpartisan Chief Acquisition Officers</header><text display-inline="no-display-inline">Section 16 of the Office of Federal Procurement Policy Act (<external-xref legal-doc="usc" parsable-cite="usc/41/414">41 U.S.C. 414</external-xref>) is amended in subsection (a)(1) by striking <quote>non-career employee as</quote>.</text> </section>
<section id="H35DBA921809847BFB6AA04BF55D2C32C"><enum>408.</enum><header>Improving the Federal Procurement Data System</header> 
<subsection id="HD37F91ECD9234BD19DF04FCD3B6EB01"><enum>(a)</enum><header>Availability on single website</header> 
<paragraph id="H952042CB8BDC43839810CFABFE444FB0"><enum>(1)</enum><header>Requirement</header><text>The Federal Procurement Data System described in section 6(d)(4) of the Office of Federal Procurement Policy Act (<external-xref legal-doc="usc" parsable-cite="usc/41/405">41 U.S.C. 405(d)(4)</external-xref>) shall be modified, under the direction of the Administrator for Federal Procurement Policy, so that not later than one year after the date of the enactment of this Act, the complete data contained in the system are available from a single Internet website that—</text> 
<subparagraph id="H709AE995E6554EC2A24B0323542B7E31"><enum>(A)</enum><text>allows for downloading of the data;</text> </subparagraph>
<subparagraph id="H08C34011D0354DD1A005D9EA3C70CCC7"><enum>(B)</enum><text>is publicly accessible at no cost;</text> </subparagraph>
<subparagraph id="H7A6F41BBF0D64514A29B2363E561CB84"><enum>(C)</enum><text>is user-friendly; and</text> </subparagraph>
<subparagraph id="HE3CB6A8223DB4711918904D7E9005BF0"><enum>(D)</enum><text>is in a format that is easily searchable and that can be aggregated by data element.</text> </subparagraph></paragraph>
<paragraph id="H129C02A0D3114EC7BF5E1710F101EF97"><enum>(2)</enum><header>Comptroller General report</header><text>Not later than 1 year after the date of the enactment of this Act, the Comptroller General shall submit to Congress a report on compliance with the requirement of paragraph (1).</text> </paragraph></subsection>
<subsection id="HE50F3614AF6D4CA0913300CBEBD2F452"><enum>(b)</enum><header>Classified annex</header> 
<paragraph id="HDF508BB8533846CB89955C75B4D1009C"><enum>(1)</enum><header>Requirement</header><text>The Federal Procurement Data System also shall be modified, under the direction of the Administrator for Federal Procurement Policy, to contain a classified annex. The annex shall contain the same information for classified contracts that is required for unclassified contracts. The annex shall be protected at all times by procedures established for information that has been specifically authorized under criteria established by an Executive order or an Act of Congress to be kept classified in the interest of national defense or foreign policy.</text> </paragraph>
<paragraph id="HD94004C1AED74CBE90F3BEACC6E1F857"><enum>(2)</enum><header>Agency reporting requirement</header><text>The head of each executive agency shall submit to Congress each year a report, in unclassified form, that includes the following:</text> 
<subparagraph id="HCE29733E51F44E3ABC9145AAA48D66F"><enum>(A)</enum><text>The agency’s total budget for classified procurement spending.</text> </subparagraph>
<subparagraph id="HF1FC89137C1F4A8B91003C12566930D9"><enum>(B)</enum><text>The percentage of that agency’s annual classified procurement spending that is awarded for contracts—</text> 
<clause id="H072CDB3F1E144E3B9DAEA9DCD2BBF9C6"><enum>(i)</enum><text>entered into using procedures other than competitive procedures when the goods or services are available from only one responsible source;</text> </clause>
<clause id="HF076B5DCED9648AEBD44E2BB246ED6F5"><enum>(ii)</enum><text>entered into using procedures other than competitive procedures when the goods or services are available from a limited number of responsible sources; and</text> </clause>
<clause id="HFCB10992FFEA4AAB89F910426FD4BBC4"><enum>(iii)</enum><text>entered into using full and open competition.</text> </clause></subparagraph></paragraph></subsection>
<subsection display-inline="no-display-inline" id="HBCEC341DE7E34A24BF87DA9C3E095250"><enum>(c)</enum><header>Agency reporting requirement</header><text>The senior procurement officer for each executive agency shall, as directed by the Director of the Office of Management and Budget, submit to the Director annual reports on the actions taken by the executive agency pursuant to the guidelines issued under subsection (a).</text> </subsection></section>
<section id="H774D368458244186B6B591B2278F74"><enum>409.</enum><header>Enforcement through bid protest</header><text display-inline="no-display-inline">Any aggrieved party may protest a lack of compliance with sections 101, 102, 201, 202, or 602 of this Act or any amendments made by those sections, including an arbitrary decision by the agency head. Nothing in the preceding sentence shall be interpreted to affect protest rights available to an aggrieved party under other provisions of law.</text> </section></title>
<title id="H5AAC5B0F23254665BF3100010436082E"><enum>V</enum><header>Preventing unjustified award fees</header> 
<section id="HAEF62CE6C5F3436CB6C68220E2E755DE"><enum>501.</enum><header>Encouraging excellent contract performance</header> 
<subsection id="H5BE3664A0AFE47548C1F99EF1EE99EFB"><enum>(a)</enum><header>Limitation</header><text display-inline="yes-display-inline">For any cost-based contract entered into by the Federal Government that includes an award or incentive fee—</text> 
<paragraph id="H4C3AD1084094456DA5875B178DE43F70"><enum>(1)</enum><text>the fee may be paid only for above-satisfactory performance of the contract; and</text> </paragraph>
<paragraph id="HF0A35BF63DB6485A9DC407767F413EC2"><enum>(2)</enum><text display-inline="yes-display-inline">at a minimum, the following factors shall be considered in making a determination regarding whether, and in what amount, the fee shall be paid to the contractor:</text> 
<subparagraph display-inline="no-display-inline" id="H236C9CB16438484598C2334FD0CD3087"><enum>(A)</enum><text>Whether the contractor met cost goals.</text> </subparagraph>
<subparagraph id="H3197B4CCD79B4D5D93834C7EB3486DB1"><enum>(B)</enum><text>Whether the contractor met schedule goals.</text> </subparagraph>
<subparagraph id="HC91EBED38B3E47CAADBDCA3CF00A36"><enum>(C)</enum><text>Whether the contractor met performance goals and delivered the goods or services required to be provided under the contract.</text> </subparagraph></paragraph></subsection>
<subsection id="H96970E425BCC45328BF7C9FAE2BDF3B"><enum>(b)</enum><header>Definition</header><text>In this section, the term <quote>above-satisfactory performance</quote> includes ratings of excellent, outstanding, and very good, as well as equivalent ratings, but excludes ratings of acceptable, average, expected, good, and satisfactory, as well as equivalent ratings.</text> </subsection></section></title>
<title id="H2E06A4993676476FA500774DB0EFE17E"><enum>VI</enum><header>Deterring corruption in contracting</header> 
<section display-inline="no-display-inline" id="H7205049F47D34274A2DCFAD22B454518"><enum>601.</enum><header>Closing the revolving door</header> 
<subsection id="HDB054F604780463081473B0914B95F55"><enum>(a)</enum><header>Elimination of loopholes that allow former Federal officials to accept compensation from contractors or related entities</header><text>Section 27(d) of the Office of Federal Procurement Policy Act (<external-xref legal-doc="usc" parsable-cite="usc/41/423">41 U.S.C. 423(d)</external-xref>) is amended—</text> 
<paragraph id="H3425BC2C2B834924B51E99688BE33F2B"><enum>(1)</enum><text>in paragraph (1)—</text> 
<subparagraph id="H2CA857DD1E7F433DBEEE24606065286D"><enum>(A)</enum><text>by striking <quote>or consultant</quote> and inserting <quote>consultant, lawyer, or lobbyist</quote>;</text> </subparagraph>
<subparagraph id="H19FECA3BC68048198BE8387F46A9543B"><enum>(B)</enum><text>by striking <quote>one year</quote> and inserting <quote>two years</quote>; and</text> </subparagraph>
<subparagraph id="HA460C8BC8E5F4CA499CA35B9F046624D"><enum>(C)</enum><text>in subparagraph (C), by striking <quote>personally made for the Federal agency—</quote> and inserting <quote>participated personally and substantially in—</quote>; and</text> </subparagraph></paragraph>
<paragraph id="H8FF2F31EF1A44372AD57B95D93E70096"><enum>(2)</enum><text>by amending paragraph (2) to read as follows:</text> 
<quoted-block display-inline="no-display-inline" id="H1B0CC3229E2341BE85004F50542BF1C7" style="OLC"> 
<paragraph id="H2CC6782875BD438EA8D89BE09FF891E0"><enum>(2)</enum><text display-inline="yes-display-inline">Paragraph (1) shall not prohibit a former official of a Federal agency from accepting compensation from any division or affiliate of a contractor that does not produce the same or similar products or services as the entity of the contractor that is responsible for the contract referred to in subparagraph (A), (B), or (C) of such paragraph if the agency’s designated ethics officer determines that—</text> 
<subparagraph id="HDC85266048CF4F079BBABEFE4BB55C"><enum>(A)</enum><text>the offer of compensation is not a reward for any action described in paragraph (1); and</text> </subparagraph>
<subparagraph id="HBBB162540361430D9B89D74E8FD44C75"><enum>(B)</enum><text>acceptance of the compensation is appropriate and will not affect the integrity of the procurement process.</text> </subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection>
<subsection id="HED7293EBBA70406299E6A31D000598F0"><enum>(b)</enum><header>Requirement for Federal Procurement Officers to Disclose Job Offers Made to Relatives</header><text>Section 27(c)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/41/423">41 U.S.C. 423(c)(1)</external-xref>) is amended by inserting after <quote>that official</quote> the following: <quote>or for a relative of that official (as defined in <external-xref legal-doc="usc" parsable-cite="usc/5/3110">section 3110</external-xref> of title 5, United States Code),</quote>.</text> </subsection>
<subsection id="H9D1263F128554FF9882172F0EEA900D"><enum>(c)</enum><header>Requirement on award of government contracts to former employers</header><text display-inline="yes-display-inline">Section 27 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/41/423">41 U.S.C. 423</external-xref>) is amended by adding at the end the following new subsection:</text> 
<quoted-block display-inline="no-display-inline" id="H5092C2663A82455DB29738066FB43CEE" style="OLC"> 
<subsection id="H10F4AF87B5304A97B4968317E3ADD4A8"><enum>(i)</enum><header>Prohibition on involvement by certain former contractor employees in procurements</header><text display-inline="yes-display-inline">An employee of the Federal Government who is a former employee of a contractor with the Federal Government shall not be personally and substantially involved with any award of a contract to the employee’s former employer, or the administration of such a contract, for the two-year period beginning on the date on which the employee leaves the employment of the contractor.</text> </subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection>
<subsection commented="no" id="HAB0DBCB2A2E240BF84E975E0E9B41C6E"><enum>(d)</enum><header>Regulations</header><text>Section 27 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/41/423">41 U.S.C. 423</external-xref>) is further amended by adding at the end of the following new subsection:</text>

<subsection commented="no" id="HFF7A581A89CC482AB156242025E17572"><enum>(j)</enum><header>Regulations</header><text>The Administrator, in consultation with the Director of the Office of Government Ethics, shall—</text> 
<paragraph commented="no" id="HC6036CE24C1C4600938B0028610769A2"><enum>(1)</enum><text>promulgate regulations to carry out and ensure the enforcement of this section; and</text> </paragraph>
<paragraph commented="no" id="H7E4088BEA0C045F380312BD6A31FACA7"><enum>(2)</enum><text>monitor and investigate individual and agency compliance with this section.</text> </paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection></section>
<section display-inline="no-display-inline" id="HF7CE16A40ABD4ACCADA8E72EEA051FE7"><enum>602.</enum><header>Requiring contractor integrity and business ethics</header> 
<subsection id="H29744EB5890E41B893D55BB096DE2348"><enum>(a)</enum><header>Civilian Agency Contractors</header>
<paragraph commented="no" display-inline="yes-display-inline" id="H64EBB70489224A3589C03DE68166B184"><enum>(1)</enum><text>Title III of the <act-name parsable-cite="FPASA">Federal Property and Administrative Services Act of 1949</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/41/251">41 U.S.C. 251 et seq.</external-xref>) is amended by inserting after section 303N, as added by section 102, the following new section:</text>

<section id="HAC17C6283D674038B68004F963F55487"><enum>303O.</enum><header>Prohibition of award to unethical contractors</header> 
<subsection id="H7BAD6C26AB3744F9B125E06D69EFEB"><enum>(a)</enum><header>In General</header><text>No prospective contractor may be awarded a contract with an agency unless the contracting officer for the contract determines that such prospective contractor has a satisfactory record of integrity and business ethics.</text> </subsection>
<subsection id="H158B420B32E04F8EAB478FF24C7507D0"><enum>(b)</enum><header>Definition</header><text>No prospective contractor shall be considered to have a satisfactory record of integrity and business ethics if it—</text> 
<paragraph id="H32A40FF5A88B4595A7AF5B0031F20012"><enum>(1)</enum><text>has exhibited a pattern of overcharging the Government under Federal contracts;</text> </paragraph>
<paragraph id="HC76EAB3FC9C8434196BE1B8919D209F"><enum>(2)</enum><text>has exhibited a pattern of failing to comply with the law, including tax, labor and employment, environmental, antitrust, and consumer protection laws; or</text> </paragraph>
<paragraph id="HADF960C9E78143E391F956F35DCA84F1"><enum>(3)</enum><text>has an outstanding debt with a Federal agency in a delinquent status.</text> </paragraph></subsection></section><after-quoted-block></after-quoted-block></quoted-block> </paragraph>
<paragraph id="H04688D0F5EAA4F0BADF7E13E93F7F61" indent="up1"><enum>(2)</enum><text>The table of sections at the beginning of such Act is amended by inserting after the item relating to section 303N, as added by section 102, the following new item:</text>

<paragraph commented="no" display-inline="yes-display-inline" id="H90B0309E398E4A59ACE60125DF114D1E"><enum>(1)</enum><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/137">Chapter 137</external-xref> of title 10, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/10/2305a">section 2305a</external-xref> the following new section:</text>

<section id="HF31DC4ACC61141C88D74F527B7B1A225"><enum>2305b.</enum><header>Prohibition of award to unethical contractors</header><text display-inline="no-display-inline">Section 303O of the <act-name parsable-cite="FPASA">Federal Property and Administrative Services Act of 1949</act-name> shall apply to a prospective contractor that may be awarded a contract with an agency under this title in the same manner as such section applies to a prospective contractor that may be awarded a contract with an agency covered by that section.</text> </section><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph>
<paragraph id="H110A5405E0E04D4E00EB79B88D1071F4" indent="up1"><enum>(2)</enum><text>The table of sections at the beginning of such chapter is amended by inserting after the item relating to section 2305a the following new item:</text>

<section display-inline="no-display-inline" id="H2216659D5C014B0498BD6EF92F696367" section-type="subsequent-section"><enum>603.</enum><header>Enhancement of whistleblower protections</header> 
<subsection id="HD5685445710C4CD787C4AF17B775C266"><enum>(a)</enum><header>Civilian agency contracts</header><text display-inline="yes-display-inline">Section 315(c) of the Federal Property and Administrative Services Act of 1949 (<external-xref legal-doc="usc" parsable-cite="usc/41/265">41 U.S.C. 265(c)</external-xref>), is amended—</text> 
<paragraph id="H5BCE3386A41440CA9C32EFF664CDED27"><enum>(1)</enum><text>in paragraph (1), by striking <quote>If the head</quote> and all that follows through <quote>actions:</quote> and inserting the following: <quote>Not later than 180 days after submission of a complaint under subsection (b), the head of the executive agency concerned shall determine whether the contractor concerned has subjected the complainant to a reprisal prohibited by subsection (a) and shall either issue an order denying relief or shall take one or more of the following actions:</quote>; and</text> </paragraph>
<paragraph id="H55F20A303DB042AD889466BCAC0016C4"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating paragraph (3) as paragraph (4) and adding after paragraph (2) the following new paragraph (3):</text> 
<quoted-block display-inline="no-display-inline" id="H2990D3D362ED4FD2A6D9CD00524C47A9" style="OLC"> 
<paragraph id="HFE7914210B6642799563FBCF4DFCFBD" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">If the head of an executive agency has not issued an order within 180 days after the submission of a complaint under subsection (b) and there is no showing that such delay is due to the bad faith of the complainant, the complainant shall be deemed to have exhausted his administrative remedies with respect to the complaint, and the complainant may bring an action at law or equity for de novo review to seek compensatory damages and other relief available under this section in the appropriate district court of the United States, which shall have jurisdiction over such an action without regard to the amount in controversy.</text> </paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection>
<subsection id="HC1E060B8B40D4EE583CFB6945F6C1404"><enum>(b)</enum><header>Armed services contracts</header><text><external-xref legal-doc="usc" parsable-cite="usc/10/2409">Section 2409</external-xref> of title 10, United States Code, is amended—</text> 
<paragraph id="HD691CB4FAEB342658B14FA99F3D28C58"><enum>(1)</enum><text>in paragraph (1), by striking <quote>If the head</quote> and all that follows through <quote>actions:</quote> and inserting the following: <quote>Not later than 180 days after submission of a complaint under subsection (b), the head of the agency concerned shall determine whether the contractor concerned has subjected the complainant to a reprisal prohibited by subsection (a) and shall either issue an order denying relief or shall take one or more of the following actions:</quote>; and</text> </paragraph>
