		  Bureau of Reclamation partnership with the North Bay Water Reuse Authority and
		  other regional partners to achieve objectives relating to water supply, water

		<section display-inline="no-display-inline" id="H9C0DAB26ADA04C97A06CE5218559DBCC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>North Bay Water Reuse Program Act of
			 2006</short-title></quote>.</text>
		</section><section id="H7459F1D41C9A40B796F192FF983243DC"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="HAA24594343A645E0AE880210AFE32511"><enum>(1)</enum><header>Eligible
			 entity</header><text>The term <term>eligible entity</term> means a member
			 agency of the North Bay Water Reuse Authority of the State located in the North
			 San Pablo Bay watershed in—</text>
				<subparagraph id="H162EC9C4ED6D4742AAB45BBA9224364B"><enum>(A)</enum><text>Marin
			 County;</text>
				</subparagraph><subparagraph id="H7CEB061644AA4949A04D6FA1FEDE005E"><enum>(B)</enum><text>Napa
			 County;</text>
				</subparagraph><subparagraph id="HCC778D358CC447F88680E9422EC86D43"><enum>(C)</enum><text>Solano County;
			 or</text>
				</subparagraph><subparagraph id="HB36FE5A96B6048C095B116E981D19E09"><enum>(D)</enum><text>Sonoma
			 County.</text>
				</subparagraph></paragraph><paragraph id="H96291526DFCA48FE92801F0141E7005C"><enum>(2)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1FFB999559EB4996A054CF29ED33BB"><enum>(3)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> means the State
			 of California.</text>
			</paragraph><paragraph id="H95BF5F26B58C4975A222D90022BE381C"><enum>(4)</enum><header>Water
			 Reclamation and Reuse Project</header><text>The term <quote>water reclamation
			 and reuse project</quote> means a project carried out by the Secretary and an
			 eligible entity in the North San Pablo Bay watershed relating to—</text>
				<subparagraph id="HA82E7DCE4C6940209300ED19EA480260"><enum>(A)</enum><text>water quality
			 improvement;</text>
				</subparagraph><subparagraph id="HE8B9E1CDB0EF4C04B36EB2ACA24BACFB"><enum>(B)</enum><text>wastewater
			 treatment;</text>
				</subparagraph><subparagraph id="H8FD181386CAA4C739697B1BF808E973"><enum>(C)</enum><text>water reclamation
			 and reuse;</text>
				</subparagraph><subparagraph id="H1CA7AA9E0B2547A49B53DFA85FFBBCCF"><enum>(D)</enum><text>groundwater
			 recharge and protection;</text>
				</subparagraph><subparagraph id="H9C34B17102AE44D781A5AB2280E3F64"><enum>(E)</enum><text>surface water
			 augmentation; or</text>
				</subparagraph><subparagraph id="H3F8693960A214B39BBE3780000EFAD73"><enum>(F)</enum><text>other related
			 improvements.</text>
				</subparagraph></paragraph></section><section id="H702F93B1A96F433781636207983F09D8"><enum>3.</enum><header>North bay water
			 reuse program</header>
			<subsection id="HBAFCABF72FF84B88ACC17107DBDAC01E"><enum>(a)</enum><header>In
			 general</header><text>The Secretary, acting through a cooperative agreement
			 with the State or a subdivision of a State, may offer to enter into cooperative
			 agreements with eligible entities for the planning, design, and construction of
			 water reclamation and reuse projects.</text>
			</subsection><subsection id="HD00D92BA0CD64848AFFFB84DBD8E008B"><enum>(b)</enum><header>Coordination
			 with other Federal agencies</header><text>In carrying out this section, the
			 Secretary and the eligible entity shall, to the maximum extent practicable, use
			 the design work and environmental evaluations initiated by—</text>
				<paragraph id="H29E6FB0F8A634961B1C9FE1EB3D429DC"><enum>(1)</enum><text>non-Federal
			 entities; and</text>
				</paragraph><paragraph id="HE877038287824461ABDE486685B61418"><enum>(2)</enum><text>the Corps of
			 Engineers in the San Pablo Bay Watershed of the State.</text>
				</paragraph></subsection><subsection id="H57273C75B45543C5A2F5980306FFF891"><enum>(c)</enum><header>Cooperative
			 agreement</header>
				<paragraph id="HCCF479619DAF4E9184B3014C9C0953DD"><enum>(1)</enum><header>Requirements</header><text>A
			 cooperative agreement entered into under paragraph (1) shall, at a minimum,
			 specify the responsibilities of the Secretary and the eligible entity with
			 respect to—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H60BD7B3007C8461D863F26E2271747D2"><enum>(A)</enum><text display-inline="yes-display-inline">ensuring that the cost-share requirements
			 established by subsection (e) are met;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H382B8039A5154509A750CE714D00FECA"><enum>(B)</enum><text display-inline="yes-display-inline">completing—</text>
						<clause commented="no" display-inline="no-display-inline" id="HBF1475C0D9064946B848BE39AE69BC52"><enum>(i)</enum><text display-inline="yes-display-inline">a needs assessment for the water
			 reclamation and reuse project; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="H51EE360F58F8465D8ED36FADEA347C0"><enum>(ii)</enum><text display-inline="yes-display-inline">the planning and final design of the water
			 reclamation and reuse project;</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE4EAF3AB9D2F4680A59921007C4942F3"><enum>(C)</enum><text display-inline="yes-display-inline">any environmental compliance activity
			 required for the water reclamation and reuse project;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H78B2EEB32FFC48B0A59F799753885ED"><enum>(D)</enum><text display-inline="yes-display-inline">the construction of facilities for the
			 water reclamation and reuse project; and</text>
					</subparagraph><subparagraph commented="no" id="H2F92BF0C54A148B99433756B238F57A0"><enum>(E)</enum><text>administrating any
			 contract relating to the construction of the water reclamation and reuse
			 project.</text>
					</subparagraph></paragraph><paragraph id="H9FAD9E2ECB644B9E8E5FB6F19C4EC3D4"><enum>(2)</enum><header>Phased
			 project</header>
					<subparagraph id="H70A98BC363C64E7D943FAA1F6EA545A"><enum>(A)</enum><header>In
			 general</header><text>A cooperative agreement described in paragraph (1) shall
			 require that any water reclamation and reuse project carried out under this
			 section shall consist of 2 phases.</text>
					</subparagraph><subparagraph id="H713FA0AAE01A4935A1A775EE5FF74561"><enum>(B)</enum><header>First
			 phase</header><text>During the first phase, the Secretary and an eligible
			 entity shall complete the planning, design, and construction of the main
			 treatment and main conveyance system of the water reclamation and reuse
			 project.</text>
					</subparagraph><subparagraph id="H330D08643D5648FFB428C0981588FDB"><enum>(C)</enum><header>Second
			 phase</header><text>During the second phase, the Secretary and an eligible
			 entity shall complete the planning, design, and construction of the
			 sub-regional distribution systems of the water reclamation and reuse
			 project.</text>
					</subparagraph></paragraph></subsection><subsection id="H47D2E6A049D644B0905FA14DA83BEB7"><enum>(d)</enum><header>Financial
			 assistance</header>
				<paragraph id="HB7EDB6D7834747E9BB000041DA25AEB9"><enum>(1)</enum><header>In
			 general</header><text>The Secretary may provide financial and technical
			 assistance to an eligible entity to assist in planning, designing, conducting
			 related preconstruction activities for, and constructing a water reclamation
			 and reuse project.</text>
				</paragraph><paragraph id="HD650B1244CBF4949977800F612D6C472"><enum>(2)</enum><header>Use</header><text>Any
			 financial assistance provided under paragraph (1) shall be obligated and
			 expended only in accordance with a cooperative agreement entered into under
			 this section.</text>
				</paragraph></subsection><subsection id="H7AC5A79E43A047C28B571C1644D9BFCE"><enum>(e)</enum><header>Cost-sharing
			 requirement</header>
				<paragraph id="H8DB9EF4594C445C0B7D0E8BA7FDD98C8"><enum>(1)</enum><header>Federal
			 share</header><text>The Federal share of the total cost of any activity or
			 construction carried out using amounts made available under this section shall
			 be not more than 25 percent of the total cost of a water reclamation and reuse
			 project.</text>
				</paragraph><paragraph id="H1E2A43E01E284B72B5725F12E78BDC96"><enum>(2)</enum><header>Form of
			 non-Federal Share</header><text>The non-Federal share may be in the form of any
			 in-kind services that the Secretary determines would contribute substantially
			 toward the completion of the water reclamation and reuse project,
			 including—</text>
					<subparagraph id="H5ECE296D28E34ECA91738784F095F2F3"><enum>(A)</enum><text>reasonable costs
			 incurred by the eligible entity relating to the planning, design, and
			 construction of the water reclamation and reuse project; and</text>
					</subparagraph><subparagraph id="H62BA63E3349F4D689506D13EE118A939"><enum>(B)</enum><text>the fair-market
			 value of land that is—</text>
						<clause id="H63FC51B860CC4BD9B1CF89C1D931B9DC"><enum>(i)</enum><text>used
			 for planning, design, and construction of the water reclamation and reuse
			 project facilities; and</text>
						</clause><clause id="H6D4B485D4CB145BB917CCE53EBF12FEA"><enum>(ii)</enum><text>owned by an
			 eligible entity.</text>
						</clause></subparagraph></paragraph></subsection><subsection commented="no" id="HD212206A622541B4A5DFF1C1959FD217"><enum>(f)</enum><header>Operation,
			 maintenance, and replacement costs</header>
				<paragraph commented="no" display-inline="no-display-inline" id="H6E3309415EB04996A8DE6700A36DEA7E"><enum>(1)</enum><header>In
			 General</header><text display-inline="yes-display-inline">The eligible entity
			 shall be responsible for the annual operation, maintenance, and replacement
			 costs associated with the water reclamation and reuse project.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBFE4B95AC39C45B1AF6579C45E63EF38"><enum>(2)</enum><header>Operation,
			 maintenance, and replacement plan</header><text display-inline="yes-display-inline">The eligible entity, in consultation with
			 the Secretary, shall develop an operation, maintenance, and replacement plan
			 for the water reclamation and reuse project.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H81415B9247564F71A30545AB1284244B"><enum>(g)</enum><header>Effect</header><text display-inline="yes-display-inline">Nothing in this Act—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HC7443DB8E27A40CC85BBCBAE6005B498"><enum>(1)</enum><text display-inline="yes-display-inline">affects or preempts—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="HCD9BDACFEEAC4FA4B3D81256A9059B6B"><enum>(A)</enum><text display-inline="yes-display-inline">State water law; or</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H91F3EF83F7BF4A6BAEFC48FC9FF763AC"><enum>(B)</enum><text display-inline="yes-display-inline">an interstate compact relating to the
			 allocation of water; or</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB8D5CF79960C409E8141E6133D10003D"><enum>(2)</enum><text display-inline="yes-display-inline">confers on any non-Federal entity the
			 ability to exercise any Federal right to—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H9014CF7724C14AEBAB81009D5FEBAC62"><enum>(A)</enum><text display-inline="yes-display-inline">the water of a stream; or</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H1C1C11D2558E4B54AD990631BEF7B1DF"><enum>(B)</enum><text display-inline="yes-display-inline">any groundwater resource.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" id="H07BA5710211F48A482CF53060085B66F"><enum>(h)</enum><header>Authorization of
			 appropriations</header><text>There is authorized to be appropriated for the
			 Federal share of the total cost of the first phase of water reclamation and
			 reuse projects carried out under this Act, an amount not to exceed 25 percent
			 of the total cost of those reclamation and reuse projects or $25,000,000,
			 whichever is less, to remain available until expended.</text>
