			 extension</header><text display-inline="yes-display-inline">Section 1241(a) of
			 the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3841">16 U.S.C. 3841(a)</external-xref>) is amended—</text>
						<subparagraph id="HFAE14031EE2F4417B208D244224F22EB"><enum>(A)</enum><text>in the matter

					<paragraph id="H617DDC1CAE5141788818B766FAE232A5"><enum>(1)</enum><text>by striking the
			 period at the end of paragraph (1) and inserting a semicolon;</text>
					</paragraph><paragraph id="H6C77FE833B074C04A99871EAC36E16BB"><enum>(2)</enum><text>in paragraph (4),
			 by striking <quote>or</quote> at the end of subparagraph (C);</text>

							</paragraph><paragraph id="H8AE951744DA14F89B09B39ADF9EC75C7"><enum>(7)</enum><text display-inline="yes-display-inline">marginal pasture land or hay land that is
				otherwise ineligible, if the land is to be devoted to native vegetation
				appropriate to the locale and will provide suitable habitat for a State or
				federally listed threatened or endangered species or a species determined by
				the Secretary of the Interior to be species of
				concern.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="H5E20BF34E52648DABCDCE96C40B133FE"><enum>(c)</enum><header>Enrollment
			 goals</header><text display-inline="yes-display-inline">Section 1231(d) of such
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/16/3831">16 U.S.C. 3831(d)</external-xref>) is amended—</text>
					<paragraph id="HA2518E822CF1497F9868D8DDA68900FE"><enum>(1)</enum><text>by striking
			 <quote>The Secretary</quote> and inserting:</text>

							<paragraph id="H1EB457F263B948A5BC04B7CB678615A5"><enum>(2)</enum><header>Enrollment
				goals</header><text>For the period beginning on the date of the enactment of
				this paragraph and ending on December 31, 2013, the Secretary shall establish a
				goal—</text>
								<subparagraph id="HA39C77DEA9A34E5FB99BE58DAF83295D"><enum>(A)</enum><text>to enroll not less
				than 7,000,000 acres of eligible land through the continuous enrollment program
				and the conservation reserve enhancement program; and</text>
								</subparagraph><subparagraph id="H5D79FB3272A640BB9902595F6934C36"><enum>(B)</enum><text display-inline="yes-display-inline">to maintain enrollment of at least
				7,800,000 acres in the Prairie Pothole Region National Conservation Priority
				Area.</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="H6DFCCD77992A436AB638249409A688F4"><enum>(d)</enum><header>Balance of
			 natural resource purposes</header><text display-inline="yes-display-inline">Section 1231(j) of such Act (16 U.S.C.
			 3831(j)) is amended—</text>
					<paragraph id="HC06FC7E5D9CF48D0A900EEBEE3A08226"><enum>(1)</enum><text>by striking “In
			 determining” and inserting the following:</text>
						<quoted-block display-inline="no-display-inline" id="H2F35621774BA4338AEC9E2A7D79F98FB" style="OLC">
							<paragraph id="HCECF142120B84C76B28CEF04A54BE25E"><enum>(1)</enum><header>Equitable
				balance of conservation purposes</header><text display-inline="yes-display-inline">In

			 adding at the end the following new paragraph:</text>

							<paragraph id="H2262DA93AD494535A511CA0878DF41E"><enum>(2)</enum><header>Wildlife</header><text>In
				considering the extent to which a contract offer will achieve the conservation
				purposes of the program related to wildlife habitat, the Secretary shall
				consider the extent to which the contract offer will contribute to increased
				populations of wildlife, including waterfowl, nongame grassland birds and
				neotropical migrants, and assist in the recovery of at-risk
				species.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="H852F00915BB9410EAD548F6CEE1A976"><enum>(e)</enum><header>Duties of
			 participants</header><text display-inline="yes-display-inline">Section 1232(a)
			 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/16/3832">16 U.S.C. 3832(a)</external-xref>) is amended—</text>
					<paragraph id="H43EC6D4CF97B4F3989FCFC27E4EF7805"><enum>(1)</enum><text>in paragraph
			 (4)—</text>
						<subparagraph id="H4D47CA43A99D42D6AE0083E526BCFB1C"><enum>(A)</enum><text>by redesignating
			 subparagraphs (A) and (B) as subparagraphs (B) and (C), respectively;
			 and</text>
						</subparagraph><subparagraph id="H1BD443E8A277414AB8674700BA8294D0"><enum>(B)</enum><text>by inserting
			 before subparagraph (B), as so redesignated, the following new
			 subparagraph:</text>
							<quoted-block display-inline="no-display-inline" id="HD7CE0873154E45EBA8F360AAE7F382F5" style="OLC">
								<subparagraph id="HE5D7DC99038249ADA46EDF00E207331C"><enum>(A)</enum><text display-inline="yes-display-inline">approved vegetative cover shall not include
				vegetative cover inappropriate to the
				locale;</text>
								</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
						</subparagraph></paragraph><paragraph id="HE4538E2BE6D74B30BABB843CD9E052D"><enum>(2)</enum><text>by
			 redesignating paragraphs (5) through (10) as paragraphs (6) through (11),
			 respectively;</text>
					</paragraph><paragraph id="HDD285A80E5C24021A1FD4696949037BA"><enum>(3)</enum><text>by inserting after
			 paragraph (4) the following new paragraph:</text>
						<quoted-block display-inline="no-display-inline" id="HFE8540AC3D2347F8AA1700FC22560977" style="OLC">
							<paragraph id="H857802930A404DB78696B54448AC6167"><enum>(5)</enum><text display-inline="yes-display-inline">to undertake appropriate management
				activities on the land as needed throughout the term of the contract to achieve
				the purposes of the conservation reserve
				program;</text>
							</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</paragraph><paragraph id="H19B2004D6EDB4DA0BCB363A1009307AF"><enum>(4)</enum><text>in subparagraph
			 (A)(i)(II) of paragraph (8), as so redesignated, by inserting after <quote>may
			 be conducted</quote> the following: <quote>, taking into account grassland
			 types and species, location, weather conditions, and other factors that
			 determine to what extent harvesting and grazing activities will advance the
			 conservation purposes of the program</quote>.</text>
					</paragraph></subsection><subsection id="HA2F8774C56AE43AE86B6000201EFF372"><enum>(f)</enum><header>Conservation
			 plan</header><text>Section 1232(b)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/16/3832">16 U.S.C. 3832(b)(1)</external-xref>) is
			 amended—</text>
					<paragraph id="H7F9CFDD1986648CB915BFED1C3B8CF"><enum>(1)</enum><text>in
			 subparagraph (A), by striking <quote>; and</quote> and inserting <quote>,
			 including appropriate management activities required by subsection
			 (a)(5);</quote> and</text>
					</paragraph><paragraph id="H8A683C4277604669A600537300D6CBC8"><enum>(2)</enum><text>by adding at the
			 end the following new subparagraph:</text>
						<quoted-block display-inline="no-display-inline" id="H8FC690C572C642478F2FFB6B8100FD07" style="OLC">
							<subparagraph id="H2A46888E85214372BFB982F6AD25664E"><enum>(C)</enum><text display-inline="yes-display-inline">criteria for conducting any commercial use
				to be permitted, including criteria for managed harvesting and grazing
				specifying frequency, timing, number of animal units, percentage of field, and
				other criteria to ensure that managed harvesting and grazing advances the
				conservation purposes of the program;
				and</text>
							</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="H0B77752D648D436C8D9D59002CE0811F"><enum>(g)</enum><header>Cost-Share and
			 management assistance</header><text display-inline="yes-display-inline">Section
			 1234(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/16/3834">16 U.S.C. 3834(b)</external-xref>) is amended—</text>
					<paragraph id="HB7D8B958DD144C349520C5C7DFEB4131"><enum>(1)</enum><text>in paragraph (1),
			 by inserting before the period at the end the following: <quote>, except that
			 the Secretary shall pay 75 percent of the cost of establishing bottomland
			 hardwood trees and longleaf pine</quote>; and</text>

				under a Tier II or Tier III conservation security contract at the time the Tier
				I contract expires if the producer demonstrates that the eligibility criteria
				for a Tier III conservation security contract are met.</text>
								</clause></subparagraph><subparagraph id="HB273EE416BB04192AD584BE7BDF4B86"><enum>(C)</enum><header>Tier II
				renewals</header><text display-inline="yes-display-inline">In the case of land
				enrolled under a Tier II conservation security contract of a producer, the
				producer may—</text>
								<clause id="HED2CABE2EDD340768E74D81E409B8E1F"><enum>(i)</enum><text>renew the contract
				if the producer agrees to a new conservation security plan that includes
				significant new conservation practices or activities, as determined by the
				Secretary; or</text>
								</clause><clause id="HFBE157DCAA2C4FC3AEF9467024BFF189"><enum>(ii)</enum><text display-inline="yes-display-inline">enroll the land under a Tier III
				conservation security contract at the time the Tier II contract expires if the
				producer demonstrates that the eligibility criteria for a Tier III conservation
				security contract are met.</text>
								</clause></subparagraph><subparagraph id="HC0C36D55BFBF45170094C81D1C91FC9E"><enum>(D)</enum><header>Tier III
				renewals</header><text display-inline="yes-display-inline">In the case of land
				enrolled under a Tier III conservation security contract of a producer, the
				producer may renew the contract, subject to a benchmark assessment by the
				Secretary to determine whether the producer fully complied with the
				requirements of the Tier III conservation security
				plan.</text>
							</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="H0615F245723249E281FE891EDADA48C6"><enum>(e)</enum><header>Elimination of
			 maintenance payments</header><text display-inline="yes-display-inline">Section
			 1238C(b)(1)(B) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/16/3838c">16 U.S.C. 3838c(b)(1)(B)</external-xref>) is amended by adding at
			 the end the following new sentence: <quote>Effective for payments made after
			 October 1, 2006, payments under a conservation security contract may not
			 include amounts for the maintenance of existing land management and vegetative
			 practices or the maintenance of existing land-based structural
			 practices.</quote>.</text>
				</subsection><subsection id="HEEE80526EB434CBFB99FDA68B2A29D52"><enum>(f)</enum><header>Minimum contract
			 payment</header><text display-inline="yes-display-inline">Section 1238C(b) of
			 such Act (<external-xref legal-doc="usc" parsable-cite="usc/16/3838c">16 U.S.C. 3838c(b)</external-xref>) is amended by adding at the end the following new
			 paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="HAD6703894E4C4836A84892FB7B4C42F9" style="OLC">

				conservation security program shall be entitled to an annual payment of not
				less than $1,500 under a conservation security
				contract.</text>

				</subsection><subsection id="H37B5660BED9F4726997C2FD79BBA387"><enum>(g)</enum><header>Enrollment
			 procedures</header><text display-inline="yes-display-inline">Subsection (f) of
			 section 1238C of such Act (<external-xref legal-doc="usc" parsable-cite="usc/16/3838c">16 U.S.C. 3838c</external-xref>) is amended to read as
			 follows:</text>

				entering into conservation security contracts with producers under this
				subchapter, the Secretary shall not use competitive bidding or any similar
				procedure.</text>
							</paragraph><paragraph id="H5653382F334243AAA3FE76A6E49D64C4"><enum>(2)</enum><header>Continuous
				enrollment for tier III contracts</header><text>The Secretary shall enroll
				lands that meet Tier III enrollment criteria on a continuous basis.</text>
							</paragraph><paragraph id="H23FEB88858E1410880305FA270600B"><enum>(3)</enum><header>Periodic
				enrollment opportunities for tier I and II contracts</header><text display-inline="yes-display-inline">The Secretary shall ensure that producers
				whose land meets the eligibility criteria for enrollment under a Tier I or Tier
				II conservation security contract have the opportunity to enroll the land in
				the conservation security program once every three
				years.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H5E2A55B22D204A9BB27ECFE443B080CB"><enum>(h)</enum><header>Technical
			 assistance</header><text>Subsection (f) of section 1238C of such Act (16 U.S.C.
			 3838c) is amended to read as follows:</text>

				assistance with respect to a conservation security contract over the life of
				the contract may not exceed 15 percent of the total amount expended over the
				life of the
				contract.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section display-inline="no-display-inline" id="HB380CE0359A44115A66833B8433CAB24" section-type="subsequent-section"><enum>104.</enum><header>Reauthorization of
			 and increased enrollment authority for grassland reserve program</header>
				<subsection id="H157EF68E05E04CC2A0268ED2729F8100"><enum>(a)</enum><header>Extension and
			 funding</header><text>Section 1241(a) of the Food Security Act of 1985 (16
			 U.S.C. 3841(a)) is amended by striking paragraph (5) and inserting the

				that, to the greatest extent practicable, landowners operating pasture-based
				systems have an equal opportunity to enroll in the

				cost-share payments and incentive payments, to evaluate the cost-effectiveness
				of the proposed conservation practices, systems, and approaches described in
				the applications and to prioritize the most cost-effective applications, as
				required by section
				1240C(1).</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H4521BB66229C4FDE9BFEFFE327FA9E6"><enum>(d)</enum><header>Evaluation of
			 applications for cost-share payments and incentive
			 payments</header><text>Section 1240C of such Act (<external-xref legal-doc="usc" parsable-cite="usc/16/3839aa-3">16 U.S.C. 3839aa–3</external-xref>) is
			 amended to read as follows:</text>

						<section id="HA8224C84EDF045E6801233C278F4C8A0"><enum>1240C.</enum><header>Evaluation of
				applications for cost-share payments and incentive payments</header><text display-inline="no-display-inline">In evaluating applications for cost-share
				payments and incentive payments, the Secretary shall—</text>
							<paragraph id="HADE0969BE34A4730987EA5432C7DB4F9"><enum>(1)</enum><text display-inline="yes-display-inline">prioritize applications based on their
				overall level of cost-effectiveness to ensure that the conservation practices,
				systems, and approaches proposed are the most efficient means of achieving the
				anticipated environmental benefits of the project;</text>
							</paragraph><paragraph id="H619D87B8C0EC46CE9838DDA42F4F63DD"><enum>(2)</enum><text display-inline="yes-display-inline">prioritize applications based on how
				effectively and comprehensively the project addresses the designated resource
				concern or resource concerns;</text>
							</paragraph><paragraph id="H01B433200E214D5AB300A51E8196FC84"><enum>(3)</enum><text>reward higher
				levels of environmental performance, such as advanced levels of management
				within land management practices;</text>
							</paragraph><paragraph id="H836AF7448B8F4797ADF8BBF4EC3DD2E0"><enum>(4)</enum><text>develop criteria
				for evaluating applications that will ensure that national, State, and local
				conservation priorities are effectively addressed; and</text>
							</paragraph><paragraph id="HC52CD219A4BD44A28D5E23005FE9004B"><enum>(5)</enum><text display-inline="yes-display-inline">prioritize applications that will improve
				environmental performance on existing
				operations.</text>
							</paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H178C4462602D4A138C008E267E1CB83C"><enum>(e)</enum><header>Conservation
			 innovation grants</header><text display-inline="yes-display-inline">Section

							</subsection><subsection id="H6D7D8D9D6C6C4B80BEA2093253A17682"><enum>(e)</enum><header>Funding</header><text display-inline="yes-display-inline">In addition to amounts made available under
				section 1241(a)(6) to carry out this chapter, the Secretary shall use funds of
				the Commodity Credit Corporation to carry out this section in the following
				amounts:</text>

				fiscal year 2008.</text>

								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			 ground and surface water conservation program</header><text>Subsection (c)

				fiscal years 2008 through 2013. These funds are in addition to amounts made
				available under section 1241(a)(6) to carry out this
				chapter.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H6B27EB6E8ECB4A28AC95116D8019AED4"><enum>(g)</enum><header>Forest
			 conservation and performance incentives for states</header><text display-inline="yes-display-inline">Chapter
			 4 of subtitle D of title XII of such Act is amended by adding at the end the
			 following new sections:</text>
					<quoted-block display-inline="no-display-inline" id="HFA48BB249F1C4DFD835F85EE3FFCD9C2" style="OLC">
						<section id="H98B061DD5D6E44D3920300A20521EE22"><enum>1240J.</enum><header>Promotion of
				forest stewardship practices</header>
							<subsection id="H399C6339EB6D45BA9189B2CBF7B0FC92"><enum>(a)</enum><header>Cost-share
				payments and incentive payments</header><text display-inline="yes-display-inline">In carrying out the program under this
				chapter, the Secretary shall promote forest stewardship by providing cost-share
				payments and incentive payments to non-industrial private forest owners to
				carry out eligible conservation activities, to—</text>
								<paragraph id="H7B182FFA7D6C468A006E626C5F43E271"><enum>(1)</enum><text>improve water
				quality;</text>
								</paragraph><paragraph id="H4F37A01D93CB48CCAE24F0C750067036"><enum>(2)</enum><text>improve habitat
				for at-risk species;</text>
								</paragraph><paragraph id="HC738263F81824459BE1D695D4200624D"><enum>(3)</enum><text>restore
				ecologically important forest types; or</text>
								</paragraph><paragraph id="HE9412BA1F1264B718D121FBA7F998262"><enum>(4)</enum><text>control invasive
				species.</text>
								</paragraph></subsection><subsection id="H8DA6F805C3A04956A2A4FF18BAE00B"><enum>(b)</enum><header>Priority</header><text display-inline="yes-display-inline">The Secretary shall give priority to
				projects that involve multiple landowners implementing eligible conservation
				activities in a coordinated way to address the purposes described in subsection
				(a).</text>
							</subsection><subsection id="HFF31B9233C4B4F189BAC51FFE3B297BF"><enum>(c)</enum><header>Funding</header>
								<paragraph id="H229BFCBCD73B4CA3B1A9C1A05752BF87"><enum>(1)</enum><header>Amounts</header><text>The
				Secretary shall use funds of the Commodity Credit Corporation to carry out this
				section in the following amounts:</text>
									<subparagraph id="HAC985AF5F0D247F3ACD7044742BF2732"><enum>(A)</enum><text display-inline="yes-display-inline">$25,000,000 for fiscal year 2008;</text>
									</subparagraph><subparagraph id="HBC0ECAF69B06403BBC13E64880374300"><enum>(B)</enum><text>$45,000,000 for
				fiscal year 2009;</text>
									</subparagraph><subparagraph id="HC28F0B665E1249088C5DD757DFB26BD7"><enum>(C)</enum><text>$60,000,000 for
				fiscal year 2010;</text>
									</subparagraph><subparagraph id="H60109B9C38CB4EF7B5ECB7C2D6B53C6F"><enum>(D)</enum><text>$75,000,000
				million for each of fiscal years 2011 and 2012; and</text>
									</subparagraph><subparagraph id="H804782902C05496CAD2B6771FC894D1F"><enum>(E)</enum><text>$100 million for
				fiscal year 2013.</text>
									</subparagraph></paragraph><paragraph id="H6DDF6C2983D644CD9BE09C457B1B8940"><enum>(2)</enum><header>Relation to
				other funds</header><text>The funds made available under paragraph (1) are in
				addition to amounts made available under section 1241(a)(6) to carry out this
				chapter.</text>
								</paragraph></subsection></section><section id="H691504AFAA014EDC92C5BFC0ACA1B2E6"><enum>1240K.</enum><header>Performance
				incentives for States</header>
							<subsection id="H01A3034771074146A6FBA3B0000096C3"><enum>(a)</enum><header>High level of
				performance bonus</header><text>For each of fiscal years 2008 through 2013, 10
				percent of the funds made available under this chapter shall be reserved by the
				Secretary for bonus allocations to States that demonstrate a high level of
				performance in implementing the environmental quality incentives
				program.</text>
							</subsection><subsection id="H335B19677B5D491E92E8FE5400EF3F2"><enum>(b)</enum><header>Special
				considerations</header><text>In evaluating State performance under subsection
				(a), the Secretary shall reward States that—</text>
								<paragraph id="HEB7D2826B52B460EB6ABCC4DCC52931D"><enum>(1)</enum><text>consistently meet
				the requirements of section 1240C in evaluating offers and payments;</text>
								</paragraph><paragraph id="H0DB88A8A74B74CFD8189E3FBE4FF573C"><enum>(2)</enum><text>dedicate a portion
				of their annual environmental quality incentives program allocation to
				multi-producer cooperative efforts to address specific resource
				concerns;</text>
								</paragraph><paragraph id="H0B20EF1C8C25417DABFF00C26494FF7E"><enum>(3)</enum><text display-inline="yes-display-inline">collaborate with other Federal and State
				agencies, local governments, educational institutions, and for-profit and
				nonprofit organizations to monitor and evaluate the environmental outcomes
				associated with implementation of the environmental quality incentives
				program;</text>
								</paragraph><paragraph id="H84F80C7AC8F44EF1BF1FABD65F56A1C4"><enum>(4)</enum><text>demonstrate
				effective and efficient program delivery, including the provision of adequate
				technical assistance to all program participants through appropriate staffing
				and through cooperation with other Federal, State, Tribal, and local agencies,
				for-profit and nonprofit organizations, and individuals with demonstrated
				expertise in the planning and implementation of conservation practices,
				systems, and approaches;</text>
								</paragraph><paragraph id="H0B86292CA95F4A1B8565C2393EE36D1D"><enum>(5)</enum><text>support and
				encourage innovative approaches to addressing resource concerns; and</text>
								</paragraph><paragraph id="HC4A61EAF330A4802807CF05D355BC78"><enum>(6)</enum><text display-inline="yes-display-inline">demonstrate effective outreach and
				innovative approaches to reaching and serving beginning farmers and ranchers,
				limited-resource producers, and operators with lower rates of historical
				participation in Federal farm and conservation
				programs.</text>
								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section display-inline="no-display-inline" id="HBAACD80850554779B1612B3573CA6579" section-type="subsequent-section"><enum>106.</enum><header>Reauthorization of
			 and increased funding for wildlife habitat incentive program</header>
				<subsection id="H1745FAD0B87E4DB8BFCD3D6500C9FEF3"><enum>(a)</enum><header>Extension and
			 funding</header><text display-inline="yes-display-inline">Section 1241(a)(7) of
			 the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3841">16 U.S.C. 3841(a)(7)</external-xref>) is amended by striking
			 subparagraphs (A) through (D) and inserting the following new

			 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/16/3839bb-1">16 U.S.C. 3839bb–1</external-xref>) is amended by adding at the end the following
			 new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="HF1B2CFDB829D44D0BD53D990833D0554" style="OLC">
						<subsection id="H8B2873A59A814EBE8368D843BEB05AF"><enum>(d)</enum><header>Incentive
				payments for certain agreements and applications</header><text display-inline="yes-display-inline">In a case in which the Secretary enters
				into an agreement or contract to protect or restore habitat for a federally or
				State-listed endangered, threatened, or candidate species or for applications
				that further the goals and objectives of a State’s comprehensive wildlife
				conservation plan, the Secretary may provide incentive payments to landowners
				to protect or restore the habitat, including the cost of management activities
				needed during the term of the agreement or
				contract.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="HF47317FFC67544EB95046335EE63CD54"><enum>(c)</enum><header>Fish
			 habitat</header><text>Section 1240N of such Act (<external-xref legal-doc="usc" parsable-cite="usc/16/3839bb-1">16 U.S.C. 3839bb–1</external-xref>) is further
			 amended by inserting after subsection (d), as added by subsection (b), the
			 following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="HE4B4F9F79B084D2ABA372399A01F99B6" style="OLC">
						<subsection id="H14D255B1E76E4563B9E61921F73E4247"><enum>(e)</enum><header>Development of
				fish habitat</header>
							<paragraph id="H4802AE44BF4E4BC4AE8EF9A454ED6DF3"><enum>(1)</enum><header>Purposes of
				cost-share payments</header><text>Subsection (b)(1)(D) authorizes the Secretary
				to make cost-share payments to landowners to develop fish habitat. The
				development of fish habitat using such cost-share payments may include
				activities—</text>
								<subparagraph id="H76DB782259484704BAF5FB4602B8A24"><enum>(A)</enum><text display-inline="yes-display-inline">to protect streamside areas, including
				through the installation of riparian fencing and improved stream
				crossings;</text>
								</subparagraph><subparagraph id="H296E91FE310A4E3A9CE015BA53A26D4B"><enum>(B)</enum><text>to repair
				in-stream habitat;</text>
								</subparagraph><subparagraph id="HD4B616DE06CE4E268C06D79072DF443C"><enum>(C)</enum><text>to improve water
				flows and water quality, including through channel restoration;</text>
								</subparagraph><subparagraph id="HBD42471A823443788030131B2511A2DE"><enum>(D)</enum><text>to initiate
				watershed management and planning in areas in which streams are in a degraded
				condition due to past agricultural or forestry practices; and</text>
								</subparagraph><subparagraph id="H519293AAFF094514AD926D012CAE5613"><enum>(E)</enum><text>to undertake other
				types of stream habitat improvement approved by the Secretary.</text>
								</subparagraph></paragraph><paragraph id="H2EF2B0F805474E23B542533BCFDC7900"><enum>(2)</enum><header>Priority
				projects</header><text display-inline="yes-display-inline">When considering
				applications describing projects to protect or restore fish habitat, the
				Secretary shall give priority to applicants who will use the cost-share
				payments to carry out a project—</text>
								<subparagraph id="HFAEFAED03DA14873B7150065C6A3EF96"><enum>(A)</enum><text>to remove a small
				dam or in-stream structure;</text>
								</subparagraph><subparagraph id="H4ED7E2BBBA86435095E944B9DCC6723"><enum>(B)</enum><text>to improve fish
				passage, including through culvert repair and maintenance;</text>
								</subparagraph><subparagraph id="HCC98E4E4BD294B02AB942EC306176989"><enum>(C)</enum><text>to protect
				streamside areas;</text>
								</subparagraph><subparagraph id="HE68C438166034CE7AE77EA5545754663"><enum>(D)</enum><text>to improve water
				flows, including through irrigation efficiency improvements; or</text>
								</subparagraph><subparagraph id="H9B9ABD05FEBE48A29F08E73E70153FC2"><enum>(E)</enum><text>to improve
				in-stream flow quality or timing or temperature regimes.</text>
								</subparagraph></paragraph><paragraph id="HD452A564C81848CD83E7BEFDE24EB441"><enum>(3)</enum><header>Priority for
				projects including upland improvements</header><text display-inline="yes-display-inline">In addition to the priority projects
				described in paragraph (2), to ensure that projects intended to protect or
				restore fish habitat also address the causes of stream habitat degradation, the
				Secretary shall give priority among applications describing such projects to
				applicants who demonstrate that upland improvements associated with the stream
				habitat improvement, including erosion and nutrient management have been, or
				will be, carried
				out.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section display-inline="no-display-inline" id="H68638A05CCE6439EBEF6A053111145D" section-type="subsequent-section"><enum>107.</enum><header>Cooperative
			 conservation partnership initiative</header>
				<subsection id="H810310B8B048411B8414BF62ED4F97EB"><enum>(a)</enum><header>Establishment of
			 grant program</header><text display-inline="yes-display-inline">Subtitle D of
			 title XII of the Food Security Act of 1985 is amended by adding at the end the
			 following new chapter:</text>
					<quoted-block display-inline="no-display-inline" id="H0F5855BADE6042DFAEE3357732B20087" style="OLC">

							<section id="H2667C33704654665004E41A922E64CE"><enum>1240W.</enum><header>Cooperative
				conservation partnership initiative</header>
								<subsection id="HDE323085A4CD45B390261FA6D2615072"><enum>(a)</enum><header>Agreements</header><text display-inline="yes-display-inline">The Secretary shall enter into agreements
				for not shorter than three-year or longer than five-year terms with eligible
				entities specified in subsection (c) to preferentially enroll producers in one
				or more of the programs specified in subsection (b) to carry out special
				projects and initiatives through which multiple producers and other interested
				persons cooperate to improve water quality or address other specific resources
				of concern related to agricultural production on a local, State, or regional
				scale.</text>
								</subsection><subsection id="H0C440ACD511545BC90862654EB383DF2"><enum>(b)</enum><header>Covered
				programs</header><text>The conservation programs referred to in subsection (a)
				are the following:</text>
									<paragraph id="H438A7B64A5084EADB0D33551EBDD25FC"><enum>(1)</enum><text>Farmland
				protection program.</text>
									</paragraph><paragraph id="HF7EFF68DCEF64F68AED8E5B2D2EFEE78"><enum>(2)</enum><text>Grassland reserve
				program.</text>
									</paragraph><paragraph id="H8BF723AD1C1743F0887F5F1B48EB1C4B"><enum>(3)</enum><text>Environmental
				quality incentives program.</text>
									</paragraph><paragraph id="H7CC46BB186C3457E916700C7D687AE99"><enum>(4)</enum><text display-inline="yes-display-inline">Ground and surface water conservation
				program.</text>
									</paragraph><paragraph id="H87E21F51FABA4F60A44EA4731245F449"><enum>(5)</enum><text>Wildlife habitat
				incentive program.</text>
									</paragraph></subsection><subsection id="HDD10A09F02B84BC29EAA64C609A8AD58"><enum>(c)</enum><header>Eligible
				partners</header><text>Agreements may be entered into under this section with
				any of the following (or a combination thereof):</text>
									<paragraph id="HD9BF52C7CB684AD8B248145F3D00F9D"><enum>(1)</enum><text display-inline="yes-display-inline">States and agencies of States.</text>
									</paragraph><paragraph id="H67D024D2C77F42F08599B2044F01E3B2"><enum>(2)</enum><text display-inline="yes-display-inline">Political subdivisions of States, including
				State-sponsored conservation districts.</text>
									</paragraph><paragraph id="HED1C1A9BF6E64E619EE7193E0059F4EB"><enum>(3)</enum><text>Indian
				tribes.</text>
									</paragraph><paragraph id="H5AD2A3528C73418A9300DA1DE1926C5C"><enum>(4)</enum><text display-inline="yes-display-inline">Nongovernmental organizations and
				associations, including conservation organizations and producer associations
				and cooperatives.</text>
									</paragraph></subsection><subsection id="HB17703243F1F48908397422294155FE6"><enum>(d)</enum><header>Applications</header>
									<paragraph id="H6219C4DDF09040698426BEC1BB6CA3F"><enum>(1)</enum><header>Competitive
				process</header><text display-inline="yes-display-inline">The Secretary shall
				establish a competitive process for considering applications for agreements
				under this section consistent with the evaluation criteria listed in subsection
				(e).</text>
									</paragraph><paragraph id="H62ABD9B58A1F45A4B54F536C22005817"><enum>(2)</enum><header>Program
				allocation</header><text>Applications shall include—</text>
										<subparagraph id="H2C87C5385B6E4862BB6635560001ACE"><enum>(A)</enum><text>specification of
				the amount of funding or acres of one or more covered programs specified in
				subsection (b) proposed to be allocated to carry out the special project or
				initiative; and</text>
										</subparagraph><subparagraph id="H48FA4FE9B1AC4B83B78B7029C857B431"><enum>(B)</enum><text>a schedule for
				utilization of funding or acres over the life of the proposed project or
				initiative.</text>
										</subparagraph></paragraph></subsection><subsection id="H866BAAB987614532BDE3D4607998C640"><enum>(e)</enum><header>Evaluation
				criteria</header><text>In evaluating applications for agreements under this
				section the Secretary shall consider the extent to which—</text>
									<paragraph id="HA71D978C8CBB46F9B0B6934CD6B3AB00"><enum>(1)</enum><text>preferential
				enrollment in the covered programs specified in the application will
				effectively address the environmental objectives established for the special
				project or initiative; and</text>
									</paragraph><paragraph id="HA8DEC64B0D7D4534A0ECAFBC4C3CDBA5"><enum>(2)</enum><text>the special
				project or initiative covered by the application—</text>
										<subparagraph id="H1285311F13FB4B0A88BC457412E46514"><enum>(A)</enum><text>enjoys broad local
				and regional support from producers and other interested persons, including
				governmental and nongovernmental organizations with appropriate expertise on
				the issues the project or initiative seeks to address;</text>
										</subparagraph><subparagraph id="HDEE30095AC234408964ECEDFE402F527"><enum>(B)</enum><text>includes clear
				environmental objectives and a high likelihood of success;</text>
										</subparagraph><subparagraph id="H33C549E10DC340EB98383EB5EFE9006F"><enum>(C)</enum><text display-inline="yes-display-inline">includes a well defined project or
				initiative plan that identifies sensitive areas requiring treatment and
				prioritizes conservation systems, practices, and activities needed to achieve
				environmental objectives;</text>
										</subparagraph><subparagraph id="H2E9A5E42008645BD82BEA42C83DB18D"><enum>(D)</enum><text>promises adequate
				and coordinated participation to achieve the objectives of the project or
				initiative;</text>
										</subparagraph><subparagraph id="HC2B045179EAA4121A5A8397EA6E1392"><enum>(E)</enum><text display-inline="yes-display-inline">coordinates integration of local, State,
				and Federal efforts to make the best use of available resources and maximize
				cost-effective investments;</text>
										</subparagraph><subparagraph id="H039A3207EF954D47B6003025964B27C2"><enum>(F)</enum><text>leverages
				financial and technical resources from sources other than the programs
				authorized by this subtitle, including financial and technical resources
				provided by Federal and State agencies, local governments, nongovernmental
				organizations and associations, and other private sector entities;</text>
										</subparagraph><subparagraph id="H8B1B1CCBA4A543F3B5D06213EC892822"><enum>(G)</enum><text>describes how all
				necessary technical assistance will be provided to each producer participating
				in the project or initiative, including cost estimates for technical assistance
				and whether such assistance will be provided by technical service
				providers;</text>
										</subparagraph><subparagraph id="HFCCB269CEB6C43A2A978A1DF5100EC16"><enum>(H)</enum><text display-inline="yes-display-inline">addresses a local, State, regional, or
				national environmental priority or priorities, with particular emphasis on any
				priority for which there is an existing State or federally approved plan in
				place for addressing that priority;</text>
										</subparagraph><subparagraph id="H5B7AA4901B6F4909986C00DD25D357C2"><enum>(I)</enum><text display-inline="yes-display-inline">links environmental and conservation
				objectives with other objectives, such as spurring rural economic development
				through increased opportunities in the project area for recreation, value-added
				enterprises, or direct marketing of agricultural products, and assisting
				beginning, limited resource, tribal, and other producers maintain the viability
				of their operations;</text>
										</subparagraph><subparagraph id="H389756DC631040EC8E0091D288F06FFB"><enum>(J)</enum><text>includes a plan to
				evaluate progress and measure results; and</text>
										</subparagraph><subparagraph id="HBF7A60D15C3C4C83B062C38096DCE4B5"><enum>(K)</enum><text display-inline="yes-display-inline">clearly demonstrates that enrollment of
				producers in covered programs will be consistent with the purposes and policies
				of each individual program, as established in statute, rules and regulations,
				and program guidance promulgated by implementing agencies.</text>
										</subparagraph></paragraph></subsection><subsection id="H88ECF3364DAC49B089C2EE0026ABC253"><enum>(f)</enum><header>Priorities</header><text display-inline="yes-display-inline">To the maximum extent practicable,
				consistent with the requirements of subsection (d), the Secretary shall ensure
				that, each fiscal year, agreements are entered into under this section to
				support projects and initiatives that collectively address the full range of
				resource concerns facing producers, ranchers, and small private forest
				landowners, including specifically projects and initiatives that are
				designed—</text>
									<paragraph id="HA0A310A5015B40EE000068BFB0F6CF4"><enum>(1)</enum><text>to achieve
				improvements in water quality in watersheds impacted by agriculture,
				particularly by increasing the participation of producers in implementing best
				management practices in a watershed or developing environmentally and
				economically viable alternative uses for manure and litter;</text>
									</paragraph><paragraph id="H7615E358A11241FFADF3A3DFDF2B00C4"><enum>(2)</enum><text display-inline="yes-display-inline">to achieve improvements in air quality in a
				geographical area where agricultural operations impact air quality, especially
				an area that, as determined by the Administrator of the Environmental
				Protection Agency, is a nonattainment area with respect to any of the national
				ambient air quality standards promulgated by the Administrator under section
				109 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7409">42 U.S.C. 7409</external-xref>);</text>
									</paragraph><paragraph id="H4AA580EB4A144468AC97F585AA7BD547"><enum>(3)</enum><text>to conserve water
				for environmental purposes such as enhanced in stream flows or aquifer recharge
				in regions, States, or local areas where water quantity is a concern;</text>
									</paragraph><paragraph id="H0966039A595C4F72A2D293D4A270FBFC"><enum>(4)</enum><text display-inline="yes-display-inline">to assist in the recovery of Federal or
				State-listed endangered species or species of special concern or to further the
				goals and objectives of a State’s comprehensive wildlife conservation plan
				through the cooperative efforts of multiple producers;</text>
									</paragraph><paragraph id="H14C4B94C720C4188BE43352F1715F1C"><enum>(5)</enum><text>to control invasive
				species on rangeland or other agricultural land through the cooperative efforts
				of multiple producers in a geographical area;</text>
									</paragraph><paragraph id="H9B8AB079D9D24E63BBFCBDB5EB390061"><enum>(6)</enum><text>to address a
				specific resource concern or set of concerns on private, non-industrial forest
				land;</text>
									</paragraph><paragraph id="HA0F0BB7A0DD34DF9918EE63CF93CDA60"><enum>(7)</enum><text>to reduce losses
				of pesticides to the environment by engaging multiple producers in a geographic
				area in adoption of integrated pest management practices and approaches;
				and</text>
									</paragraph><paragraph id="H75117BF28ECD43BA93FF537DFCAFBE9D"><enum>(8)</enum><text display-inline="yes-display-inline">to keep working farms and ranches facing
				development pressures in agricultural use.</text>
									</paragraph></subsection><subsection id="HA594F3FBD451404BA073E6625200F1DB"><enum>(g)</enum><header>Selection
				process</header><text>In evaluating applications under this section, the
				Secretary shall consider recommendations from scientists and others with
				appropriate expertise from agencies within the Department of Agriculture, other
				Federal and State agencies, and interest groups, including producer
				associations and conservation and environmental organizations.</text>
								</subsection><subsection id="H6C35F395ACF749CF9502003BDABCE1BB"><enum>(h)</enum><header>Cost
				share</header>
									<paragraph id="H39B42E2C0369420E8550FF8CE6CE69C9"><enum>(1)</enum><header>Maximum;
				exceptions</header><text display-inline="yes-display-inline">The Secretary
				shall not require more than 25 percent of the cost of a project or initiative
				supported under an agreement entered into under this section to come from
				non-Federal sources. However, the Secretary may award more points to projects
				or initiatives offering to cover a higher percentage of the cost of the project
				or initiative from non-Federal sources.</text>
									</paragraph><paragraph id="H0F72B07BE0524637A8B6C2CD3E295D1"><enum>(2)</enum><header>In-kind
				contributions</header><text display-inline="yes-display-inline">If the
				Secretary establishes a cost-share requirement for a project or initiative, the
				Secretary shall allow the use of in-kind contributions to meet that
				requirement.</text>
									</paragraph></subsection><subsection id="H40B6767C4EB2424BB700F0C6924382F"><enum>(i)</enum><header>Administration
				with conservation reserve enhancement program</header><text display-inline="yes-display-inline">In implementing this section, the Secretary
				shall ensure that States or other applicants seeking to combine an application
				for project or initiative under this section with an application for a
				conservation reserve enhancement program may do so in a manner that does not
				impose additional paperwork or other burdens on the applicant.</text>
								</subsection><subsection id="H6B86D72B54924999936622C0A31668F9"><enum>(j)</enum><header>Funding</header>
									<paragraph id="HE0DE09EF4E8E469692E495D030E02C31"><enum>(1)</enum><header>Set-aside</header><text display-inline="yes-display-inline">Of the funds provided each fiscal year to
				implement the programs specified in subsection (b), the Secretary shall use 20
				percent to provide funds under agreements entered into under this
				section.</text>
									</paragraph><paragraph id="HE2A3F1658F6E46BFB3D983A0032CDDD5"><enum>(2)</enum><header>Allocation to
				states</header><text display-inline="yes-display-inline">The Secretary shall
				allocate to States 50 percent of the funds reserved under paragraph (1) to
				allow State Conservationists, with the advice of State Technical Committees,
				scientists, and other persons with appropriate expertise, to select projects
				and initiatives for funding under this section at the State level.</text>
									</paragraph><paragraph id="H2E4B5B7F7D6F4041843CCA02ADC1D00"><enum>(3)</enum><header>Water
				quality</header><text display-inline="yes-display-inline">To the maximum extent
				practicable and consistent with the other requirements of this section, the
				Secretary shall ensure that 50 percent of the funds awarded each year under
				this section are awarded to projects and initiatives that will improve water
				quality.</text>
									</paragraph></subsection></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H357F2312B10849F0BBC6B6656EA69E36"><enum>(b)</enum><header>Conforming
			 repeal</header><text>Section 1243 of the Food Security Act of 1985 (16 U.S.C.
			 3843) is amended by striking subsection (f).</text>
				</subsection></section><section display-inline="no-display-inline" id="H17822461CEC04BF9BA0014A91B7754ED" section-type="subsequent-section"><enum>108.</enum><header>Regional equity in
			 funding of certain Department of Agriculture conservation
			 programs</header><text display-inline="no-display-inline">Subsection (d) of
			 section 1241 of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3841">16 U.S.C. 3841</external-xref>) is amended to
			 read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="HF55436E833504162BF333F6ECD34E11E" style="OLC">
					<subsection id="H3E8AD83F01DF47F2BD55B4B0FDF2B95"><enum>(d)</enum><header>Regional
				equity</header><text display-inline="yes-display-inline">In allocating funds to
				States to implement the conservation programs under subtitle D (excluding the
				conservation reserve program under subchapter B of chapter 1, the wetlands
				reserve program under subchapter C of chapter 1, and the conservation security
				program under subchapter A of chapter 2), the Secretary shall ensure that each
				State receives, at a minimum, $15,000,000 for each of the fiscal years 2007
				through
				2013.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section display-inline="no-display-inline" id="H3D10BBFCEB4841A8BD8C79ECF47800D7" section-type="subsequent-section"><enum>109.</enum><header>Exclusion of
			 payments under Department of Agriculture conservation programs from adjusted
			 gross income limitation</header>
				<subsection id="HCF604C7E5A744286B626E5DB2DB700F4"><enum>(a)</enum><header>Exclusion</header><text>Subsection
			 (b)(2) of section 1001D of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/7/1308-3a">7 U.S.C. 1308–3a</external-xref>) is
			 amended by striking subparagraph (C).</text>

			 Community Forestry and Open Space Program</header><text display-inline="no-display-inline">The Cooperative Forestry Assistance Act of
			 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2101">16 U.S.C. 2101 et seq.</external-xref>) is amended by adding at the end the following new
			 section:</text>

					<section id="HF557445DBE354BDFA9CF393D8533E49"><enum>21.</enum><header>Suburban and
				Community Forestry and Open Space Program</header>
						<subsection id="H4AD8053EDCA247A2A174A7F813D30D2"><enum>(a)</enum><header>Definitions</header><text>In
				this section:</text>
							<paragraph id="H7BCADE8A6BC04DF100D67F109D67B698"><enum>(1)</enum><header>Committee</header><text>The
				term <term>Committee</term> means a State Forest Stewardship Coordinating
				Committee established under section 19(b).</text>
							</paragraph><paragraph id="H7AB8C29296AD4E1600414434833038ED"><enum>(2)</enum><header>Eligible
				entity</header><text>The term <term>eligible entity</term> means a unit of
				local government or a nonprofit organization that—</text>
								<subparagraph id="HD3323CF4F81144A6A602144CCAED704"><enum>(A)</enum><text>the Secretary
				determines, in accordance with the criteria established under subsection
				(c)(2)(B) is eligible to receive a grant under subsection (d); and</text>
								</subparagraph><subparagraph id="HF4424CD71B7B457EBFF7944B6E576FB0"><enum>(B)</enum><text>the State
				forester, in consultation with the Committee, determines—</text>
									<clause id="HC89075D40696418B8F8BC53E9DF721F0"><enum>(i)</enum><text>has the abilities
				necessary to acquire and manage interests in real property; and</text>
									</clause><clause id="H49E78E464C4D4AC9B7941042B5C71200"><enum>(ii)</enum><text>has the resources
				necessary to monitor and enforce any terms applicable to the eligible
				project.</text>
									</clause></subparagraph></paragraph><paragraph id="H8FFB3F6436564EFE9BC6A22EFC63CD20"><enum>(3)</enum><header>Eligible
				project</header><text>The term <term>eligible project</term> means a fee
				purchase, easement, or donation of land to conserve private forest land
				identified for conservation under subsection (c)(2)(A).</text>
							</paragraph><paragraph id="HB6FA143CB3BC4E0B959D8C15F95BC7C0"><enum>(4)</enum><header>Indian
				tribe</header><text>The term <term>Indian tribe</term> has the meaning given
				the term in section 4 of the <act-name parsable-cite="ISDA">Indian
				Self-Determination and Education Assistance Act</act-name> (25 U.S.C.
				450b).</text>
							</paragraph><paragraph id="HECB1E1EDFB4B41F3B4F214445C54FC76"><enum>(5)</enum><header>Nonprofit
				organization</header><text>The term <term>nonprofit organization</term> means
				any organization that is—</text>
								<subparagraph id="HFA70393CC4254114B8D800F6A7D9274"><enum>(A)</enum><text>described in
				<external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)</external-xref> of the Internal Revenue Code of 1986; and</text>
								</subparagraph><subparagraph id="HB8B2DF8E617A4E8D9873825FB74579FC"><enum>(B)</enum><text>exempt from
				taxation under 501(a) of the Internal Revenue Code of 1986.</text>
								</subparagraph></paragraph><paragraph id="HC5DDF2E778784D3E84F0835443E9348D"><enum>(6)</enum><header>Private forest
				land</header><text>The term <term>private forest land</term> means land
				that—</text>
								<subparagraph id="H7971CB7368E54D1B949CCE2EBDDE27BD"><enum>(A)</enum><text display-inline="yes-display-inline">consists of at least 50 percent forest
				cover, with the remainder made up of—</text>
									<clause id="H600A946305074C51865EE1E99CE9F608"><enum>(i)</enum><text>compatible
				non-forest uses, including cultivated farmlands, pastures, orchards, shrub
				lands, grasslands, wetlands, or open waters; or</text>
									</clause><clause id="H35ECB92AB2AB404E94CA3B305C042D8E"><enum>(ii)</enum><text>preexisting
				structures that are inseparable from the landholding and do not have a
				detrimental effect on conservation values;</text>
									</clause></subparagraph><subparagraph id="H1445737FB10641DD9D8009127262F860"><enum>(B)</enum><text>is capable of
				producing commercial forest products; and</text>
								</subparagraph><subparagraph id="H6B2609841BE14094BDA22956BA464874"><enum>(C)</enum><text>is owned by a
				private entity or an Indian tribe.</text>
								</subparagraph></paragraph><paragraph id="H9EAC5FFD8C3F42F79F0052284EB180A8"><enum>(7)</enum><header>Program</header><text>The
				term <term>program</term> means the Suburban and Community Forestry and Open
				Space Program established by subsection (b).</text>
							</paragraph><paragraph id="H7EAE822F830E463E9FED15C3C4CBE100"><enum>(8)</enum><header>Relevant local
				government</header><text display-inline="yes-display-inline">The term
				<quote>relevant local government</quote> means the governing body of a unit of
				local government that has the authority to adopt a plan for development of an
				area and within which an identified eligible project would be carried
				out.</text>
							</paragraph><paragraph id="H12E649216C3343679D7B2F02007BD572"><enum>(9)</enum><header>Secretary</header><text>The
				term <term>Secretary</term> means the Secretary of Agriculture, acting through
				the Chief of the Forest Service.</text>
							</paragraph></subsection><subsection id="HD349528A9CFF436588A916EAC81181A8"><enum>(b)</enum><header>Establishment
				and purpose</header><text>There is established within the Forest Service a
				program to be known as the <quote>Suburban and Community Forestry and Open
				Space Program</quote>. The purpose of the program is to provide assistance to
				eligible entities to carry out eligible projects in States in which less than
				25 percent of the land is owned by the United States to—</text>
							<paragraph id="H2086A4BCD19D4925A4761ECC3D1C004D"><enum>(1)</enum><text>conserve private
				forest land and maintain working forests in suburban areas;</text>
							</paragraph><paragraph id="H49B53992090C42BBA070EFE34CC000FA"><enum>(2)</enum><text>provide
				communities a means by which to create community forests; and</text>
							</paragraph><paragraph id="H7215E3197BDA47EC936E2483D88141DC"><enum>(3)</enum><text>support primary
				and secondary value-added forest products industries and employment in areas
				threatened by conversion of forest land to nonforest uses.</text>
							</paragraph></subsection><subsection id="H28A77D97959640C5AFF046ACFC373CB5"><enum>(c)</enum><header>Identification
				of eligible private forest land and entities</header>
							<paragraph id="H8EF1ED74BD784567B59D6553FA7FA980"><enum>(1)</enum><header>National
				criteria</header><text>The Secretary shall establish national criteria—</text>
								<subparagraph id="H478788E34EA24C86887E55964B7C20F9"><enum>(A)</enum><text display-inline="yes-display-inline">for the identification of private forest
				land eligible for conservation under the program; and</text>
								</subparagraph><subparagraph id="H01E6617CE8AC4C56ADF952ECBA691EE"><enum>(B)</enum><text>for the
				identification of eligible entities.</text>
								</subparagraph></paragraph><paragraph id="H103AC3E449024AA2A85C576549A78FBA"><enum>(2)</enum><header>Conditions for
				eligible private forest land</header><text>Private forest land identified for
				conservation using the criteria established under paragraph (2)(A) shall be
				land that—</text>
								<subparagraph id="H5F043A4E687A48C88456DBC3E1FF536B"><enum>(A)</enum><text display-inline="yes-display-inline">is located in a State in which less than 25
				percent of the land is owned by the United States;</text>
								</subparagraph><subparagraph id="H05AB61BD060C43D8A4E176A86266418B"><enum>(B)</enum><text>is appropriate for
				conservation under a comprehensive plan for development adopted by the relevant
				local government; and</text>
								</subparagraph><subparagraph id="HAFCFCE20904C4CF2B4008E007593B8CF"><enum>(C)</enum><text display-inline="yes-display-inline">is determined by the relevant local
				government to be located in an area threatened by conversion of forest land to
				nonforest uses.</text>
								</subparagraph></paragraph></subsection><subsection id="HEEC4794A60664C1D81B73F80C5F492CA"><enum>(d)</enum><header>Grant
				program</header>
							<paragraph id="HC52C53DF1D884599920921CFBAA4E655"><enum>(1)</enum><header>Grants for
				eligible projects</header><text>In carrying out the program, the Secretary
				shall award competitive grants to eligible entities to carry out eligible
				projects.</text>
							</paragraph><paragraph id="H27B637F1C67247E88C00F3E13342444"><enum>(2)</enum><header>Public
				access</header><text>Eligible entities are encouraged to provide public access
				to land on which an eligible project is carried out, consistent with State law
				and preexisting access agreements.</text>
							</paragraph></subsection><subsection id="H4BE36A35CC4E43DF879F33F607B1A88E"><enum>(e)</enum><header>Application and
				stewardship plan</header>
							<paragraph id="H3644DD45825E4B21AAF4D0C465068B25"><enum>(1)</enum><header>Submission</header><text>An
				eligible entity that seeks to receive a grant under the program shall submit to
				the appropriate State forester and relevant local government—</text>
								<subparagraph id="H443A871A05A34772AC31E148E3E4FFAF"><enum>(A)</enum><text>at such time and
				in such form as the Secretary shall prescribe, an application for the grant
				(including a description of any private forest land to be conserved using funds
				from the grant and a description of the extent of the threat of conversion of
				the land to nonforest use); and</text>
								</subparagraph><subparagraph id="HB8A23EE3B42A489783313F7F3D651442"><enum>(B)</enum><text>a stewardship plan
				that describes—</text>
									<clause id="HEBE15FE8ADFE4899B1C830C81D59EDE6"><enum>(i)</enum><text>the manner in
				which any private forest land to be conserved using funds from the grant will
				be managed in accordance with this section;</text>
									</clause><clause id="H3AEC4D884D9E4FF78990390062315D42"><enum>(ii)</enum><text>the manner in
				which the stewardship plan will be implemented; and</text>
									</clause><clause id="H6799DEBF88B24A3C8B89D360EE4298D8"><enum>(iii)</enum><text>the public
				benefits, including economic and noneconomic benefits, to be achieved from
				implementation of the stewardship plan.</text>
									</clause></subparagraph></paragraph><paragraph id="H7A57761CD45C4B32A96DD19F67D1F048"><enum>(2)</enum><header>Assessment of
				need</header><text>With respect to an application submitted under paragraph
				(1)(A), the State forester shall—</text>
								<subparagraph id="HA6759BA537CA49F59EAB299BD23800CE"><enum>(A)</enum><text>assess the need
				for preserving working suburban forest land and open space and community
				forests in the State, taking into account the housing needs of the area in
				which the eligible project is to be carried out;</text>
								</subparagraph><subparagraph id="H5D348C4FD00A4121B887CDF7E82E0053"><enum>(B)</enum><text display-inline="yes-display-inline">certify that the preservation of suburban
				forest land as contemplated by the application is consistent with any
				comprehensive plan for development adopted by the relevant local government;
				and</text>
								</subparagraph><subparagraph id="H4E20F609CB1C406EB5DEF0C61000F982"><enum>(C)</enum><text display-inline="yes-display-inline">if approved by the relevant local
				government, submit the application and the assessment of need to the
				Secretary.</text>
								</subparagraph></paragraph></subsection><subsection id="H0C00B4A6E66E49FFAB7206261F71A92D"><enum>(f)</enum><header>Review of
				applications</header>
							<paragraph id="H50FE8EC25F48472C8268EFD778B4AFFB"><enum>(1)</enum><header>In
				general</header><text>As soon as practicable after the date on which the
				Secretary receives an application under subsection (e), or a resubmission of an
				application under subparagraph (B), the Secretary shall review the application
				and—</text>
								<subparagraph display-inline="no-display-inline" id="H8BC008AB4351492DB8C347BBDF177DC3"><enum>(A)</enum><text>award a grant to
				the applicant; or</text>
								</subparagraph><subparagraph id="H6CCA67B98FDA44CE8329E6784BB9DF97"><enum>(B)</enum><text>disapprove the
				application and provide the applicant with a statement that describes the
				reasons why the application was disapproved and specifies a deadline by which
				the applicant may resubmit the application under this subsection.</text>
								</subparagraph></paragraph><paragraph id="H402DC55D6BBB4B219E4942771CE0778E"><enum>(2)</enum><header>Considerations;
				priority</header><text>In awarding grants under the program, the Secretary
				shall—</text>
								<subparagraph id="H84F454F4E1B94880A1C6F599A71DB621"><enum>(A)</enum><text>consider the need
				for the eligible project based on the assessment of need submitted under
				subsection (e)(2) and subject to the criteria established under subsection
				(c);</text>
								</subparagraph><subparagraph id="H9F0399A4D1A049C191E8CA0001F0D93"><enum>(B)</enum><text>give priority to
				applicants that propose to fund eligible projects that promote—</text>
									<clause id="H73C46494E46C4E9C818019DE1102004C"><enum>(i)</enum><text>the preservation
				of suburban forest land;</text>
									</clause><clause id="H9378DF2B67D6419FAF01D7DCBEDF55D"><enum>(ii)</enum><text>the creation of
				community forests;</text>
									</clause><clause id="HE0A6F4DC923E4B6383C7A26491CA47AA"><enum>(iii)</enum><text>the sustainable
				management of private forest land;</text>
									</clause><clause id="HD1A7195E9ACC4C7694095B7E645BFC73"><enum>(iv)</enum><text>community
				involvement in determining the objectives for eligible projects that are funded
				under this section;</text>
									</clause><clause id="HC5F7044056044DF89EC063E68F9B66E0"><enum>(v)</enum><text>primary and
				secondary value-added forest products industries and employment;</text>
									</clause><clause id="H61B754E5A45B46579F4F37CB6001855"><enum>(vi)</enum><text display-inline="yes-display-inline">the protection of water, wildlife, scenic,
				and recreational resources on private forest lands; and</text>
									</clause><clause id="HAEFDCD0AAD0E46EB00AAEC91545CB280"><enum>(vii)</enum><text>the protection
				of forestlands recognized as conservation priorities within Federal, regional,
				State, or local watershed, open space, or other resource protection plans;
				and</text>
									</clause></subparagraph><subparagraph id="HE2EB151D784941829E711506C53CECBB"><enum>(C)</enum><text display-inline="yes-display-inline">require a certification from the relevant
				local government that the preservation of suburban forest land as contemplated
				by the application is consistent with any comprehensive plan for development
				adopted by the local government.</text>
								</subparagraph></paragraph></subsection><subsection id="H5A0E44D32D92472DBCC418833BDF02FD"><enum>(g)</enum><header>Cost
				sharing</header>
							<paragraph id="H288E59F7A5C540CA98F68B5001C430C3"><enum>(1)</enum><header>In
				general</header><text>The amount of a grant awarded under the program to carry
				out an eligible project shall not exceed 50 percent of the total cost of the
				eligible project.</text>
							</paragraph><paragraph id="H7E380B2477004A369BA188F41169F682"><enum>(2)</enum><header>Assurances</header><text>As
				a condition of receipt of a grant under the program, an eligible entity shall
				provide to the Secretary such assurances as the Secretary determines are
				sufficient to demonstrate that the share of the cost of each eligible project
				that is not funded by the grant awarded under this section has been
				secured.</text>
							</paragraph><paragraph id="H8ED01CD62EFF4F2FBC912DB673DA9FE2"><enum>(3)</enum><header>Form</header><text>The
				share of the cost of carrying out any eligible project that is not funded by a
				grant awarded under the program may be provided in cash or in kind (including a
				donation of land).</text>
							</paragraph></subsection><subsection id="H93C4B7A6B7EA4BD0A7F7AFA8605F43D"><enum>(h)</enum><header>Use of Grant
				Funds for Purchases of Land or Easements</header>
							<paragraph id="H4DAC5304014449E98713B20169861655"><enum>(1)</enum><header>Purchases</header>
								<subparagraph id="H52B1350C4A2B4377A069E33B79A8055D"><enum>(A)</enum><header>Purchase at fair
				market value</header><text>Except as provided in subparagraph (B), funds made
				available, and grants awarded, under the program may be used to purchase
				private forest land or interests in private forest land (including conservation
				easements) only from willing sellers at fair market value.</text>
								</subparagraph><subparagraph id="H080B634A4BAD4C5DB8CDC0525EED8532"><enum>(B)</enum><header>Purchase at less
				than fair market value</header><text>A sale of private forest land or an
				interest in private forest land at less than fair market value shall be
				permitted only on certification by the landowner that the sale is being entered
				into willingly and without coercion.</text>
								</subparagraph></paragraph><paragraph id="H87BA04952F104F2B82DE57728B8CF349"><enum>(2)</enum><header>Title</header><text>Title
				to private forest land or an interest in private forest land purchased under
				paragraph (1) may be held, as determined appropriate by the Secretary, in
				consultation with the State and relevant local government, by—</text>
								<subparagraph id="H47E322ACD4D74631BD9EAA922E909274"><enum>(A)</enum><text>a State;</text>
								</subparagraph><subparagraph id="H9D9D4A528A0545E684A564D10390098E"><enum>(B)</enum><text>a unit of local
				government; or</text>
								</subparagraph><subparagraph id="H92E166276F9341DF81E1BD3530059D5"><enum>(C)</enum><text>a nonprofit
				organization.</text>
								</subparagraph></paragraph><paragraph id="H356C0FF906FC4DA3A430C54FB489FEFC"><enum>(3)</enum><header>Termination of
				easement</header><text display-inline="yes-display-inline">Except as provided
				in paragraph (4), all right, title, and interest of a unit of local government
				or nonprofit organization in and to a conservation easement purchased under
				paragraph (1) shall terminate and vest in the State if the State determines
				that—</text>
								<subparagraph id="H904D4079AE95465C9170F3CC7F3B1031"><enum>(A)</enum><text>the unit of local
				government or nonprofit organization is unable or unwilling to enforce the
				terms of the conservation easement; or</text>
								</subparagraph><subparagraph id="H6E3DE0245BB34F719364F07C53423E44"><enum>(B)</enum><text>the conservation
				easement has been modified in a way that is inconsistent with the purposes of
				the program.</text>
								</subparagraph></paragraph><paragraph id="HC7941CECB5B64609A05E5F306819755F"><enum>(4)</enum><header>Conveyance to
				another unit of local government or nonprofit organization</header><text>If a
				State makes a determination under paragraph (3), the State may convey or
				authorize the unit of local government or nonprofit organization to convey the
				conservation easement to another unit of local government or nonprofit
				organization.</text>
							</paragraph></subsection><subsection id="H622ACFB4EC664A37AE39BD0480DA7C15"><enum>(i)</enum><header>Administrative
				Costs</header><text>The State, on approval of the Secretary and subject to any
				regulations promulgated by the Secretary, may use amounts made available under
				subsection (k) to pay the administrative costs of the State relating to the
				program.</text>
						</subsection><subsection id="HFC6DB99626294ED1A0EBBD55ECE5E665"><enum>(j)</enum><header>Report</header><text>The
				Secretary shall submit to Congress a report on the eligible projects carried
				out under this section in accordance with section 8(c) of the
				<act-name parsable-cite="FRRRP">Forest and Rangeland Renewable Resources
				Planning Act of 1974</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/16/1606">16 U.S.C. 1606(c)</external-xref>).</text>
						</subsection><subsection id="H6632E6022DE646C0964ED1EAE6A6A459"><enum>(k)</enum><header>Authorization of
				Appropriations</header><text display-inline="yes-display-inline">There are
				authorized to be appropriated to carry out this section $50,000,000 for each of
				the fiscal years 2008 through 2013.</text>
						</subsection><subsection id="H499CDE4DF4E34D348D660075AEB8DD9"><enum>(l)</enum><header>Private property
				protections</header>
							<paragraph id="HC335845669A94627965DFBC31CE55D4E"><enum>(1)</enum><header>Access</header><text display-inline="yes-display-inline">Nothing in this section—</text>
								<subparagraph id="HFA834ECF61FB4E1BABD8EF94794EEEC3"><enum>(A)</enum><text>requires a private
				property owner to permit public access (including Federal, State, or local
				government access) to private property; or</text>
								</subparagraph><subparagraph id="HAE368D72D1D34ADD9BBE1F2F27579C29"><enum>(B)</enum><text>modifies any
				provision of Federal, State, or local law with regard to public access to, or
				use of, private land.</text>
								</subparagraph></paragraph><paragraph id="H6D92E3B519B544A597338F62B6826233"><enum>(2)</enum><header>Liability</header><text display-inline="yes-display-inline">Nothing in this section creates any
				liability, or has any effect on liability under any other law, of a private
				property owner with respect to any persons injured on the private
				property.</text>
							</paragraph><paragraph id="HDF7DB1EDD1844D94AA80ABF719B753F1"><enum>(3)</enum><header>Recognition of
				authority to control land use</header><text>Nothing in this section modifies
				any authority of Federal, State, or local governments to regulate land
				use.</text>
							</paragraph><paragraph id="H53F13B9D0038432B96772657B996CB36"><enum>(4)</enum><header>Participation of
				private property owners</header><text display-inline="yes-display-inline">Nothing in this section requires a private
				property owner to participate in private forest conservation under this
				section.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section display-inline="no-display-inline" id="HE3688D7C344C472DA39BD5AA0087CC06" section-type="subsequent-section"><enum>112.</enum><header>Farmland protection
			 and farm viability programs</header>
				<subsection display-inline="no-display-inline" id="HD2FDA0D6F94640888C29F9FABF8B73D1"><enum>(a)</enum><header>Land eligible
			 for protection</header><text display-inline="yes-display-inline">Paragraph (2)
			 of section 1238H of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3838h">16 U.S.C. 3838h</external-xref>) is amended
			 to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="H3DD0CDF7600346DE87AB0075A3B5401E" style="OLC">
						<paragraph id="H8218FD4CF21F4E65B7B72B3BE2AB17F"><enum>(2)</enum><header>Eligible
				land</header><text display-inline="yes-display-inline">The term <quote>eligible
				land</quote> means land on a farm or ranch that is—</text>
							<subparagraph id="H049288462B4B487DB69FBD9309B85BF1"><enum>(A)</enum><text display-inline="yes-display-inline">cropland;</text>
							</subparagraph><subparagraph id="HCF39E6BD04D2494D80C8A6ABB95F7252"><enum>(B)</enum><text>rangeland;</text>
							</subparagraph><subparagraph id="H9B19CBB65A3043E19D33C145364936A3"><enum>(C)</enum><text>grassland;</text>
							</subparagraph><subparagraph id="H5C00467B088140EBAA34DF532E21E221"><enum>(D)</enum><text>pasture land;
				or</text>
							</subparagraph><subparagraph id="H7DB948B1E1E74CA4B6AB639DA5BC615"><enum>(E)</enum><text>forest land that is
				an incidental part of an agricultural operation, as determined by the
				Secretary.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="HFB8A16D22FE1457ABC001EF6BE10C6A7"><enum>(b)</enum><header>Qualified state
			 or local entity defined</header><text>Such section is further amended—</text>
					<paragraph id="H414A231A137C4776BDD7D0AA1BAB2C"><enum>(1)</enum><text>by
			 redesignating paragraph (4) as paragraph (5); and</text>
					</paragraph><paragraph id="H47BA0C34DCB744B0BDD0A63392249B95"><enum>(2)</enum><text>by inserting after
			 paragraph (3) the following new paragraph:</text>
						<quoted-block display-inline="no-display-inline" id="HAE14D4C560E04CFFA44419CC815CC99F" style="OLC">
							<paragraph id="HA47AF993A34145599E90E2555D1ED73"><enum>(4)</enum><header>Qualified state
				or local entity</header><text display-inline="yes-display-inline">The term
				<quote>qualified State or local entity</quote> means an eligible entity, public
				or private, that operates a farm and ranchland protection program under
				authority of State law, which has—</text>
								<subparagraph id="HDFF06B701D8A4556B3FB64B4E11DB75"><enum>(A)</enum><text display-inline="yes-display-inline">for at least 3 calendar or fiscal years
				used or provided public or private funds to purchase perpetual conservation
				easements or other interests in land on a cumulative total of at least 10
				properties for the primary purpose of protecting the agricultural production
				capacity of eligible land;</text>
								</subparagraph><subparagraph id="H9C802B0C60964C028DAD3814DD50E255"><enum>(B)</enum><text>the necessary
				authority under State law, as well as the technical and financial capacity, to
				monitor and enforce the terms of such conservation easements or other interests
				in land so that their purpose is carried out in perpetuity, or in the case of a
				governmental entity, to legally require other public or private holders of such
				easements or interests in land acquired with public funding to hold, monitor,
				and enforce them for the same purpose; and</text>
								</subparagraph><subparagraph id="H6C14629ECE064D0F00B9503F94FD5149"><enum>(C)</enum><text>financial control
				policies in place to assure that on average the purchase price of conservation
				easements and other interests in land purchased by the eligible entity or
				purchased using funds provided by the eligible entity does not exceed their
				appraised fair market
				value.</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection display-inline="no-display-inline" id="HA85AB9C341774AD399B78C27300A27E"><enum>(c)</enum><header>Farmland
			 protection program changes</header><text display-inline="yes-display-inline">Section 1238I of such Act (<external-xref legal-doc="usc" parsable-cite="usc/16/3838i">16 U.S.C. 3838i</external-xref>)
			 is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="HD1221AF28E404E3AA23C9000EED7664D" style="OLC">
						<section id="H4DB0341CF32F4F5E89DC053537F18CBA"><enum>1238I.</enum><header>Farmland
				protection</header>
							<subsection id="HCDCCE60DD9D74FF0AFF2E87F519139CD"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary, acting through the Natural
				Resources Conservation Service, shall establish and carry out a farm and
				ranchland protection program under which the Secretary shall facilitate and
				fund the purchase of conservation easements or other interests in eligible land
				for the purpose of protecting the agricultural production capacity of the land
				by limiting incompatible nonagricultural uses of the land.</text>
							</subsection><subsection id="HD6106909E47C4F5EA8C000989E3D8919"><enum>(b)</enum><header>Protection
				priorities</header><text display-inline="yes-display-inline">The program shall
				give the highest priority to protecting eligible land with prime, unique, or
				other productive soils that are at risk of non-farm development.</text>
							</subsection><subsection id="H1B341044D20243F7A6204BDE6DA4333C"><enum>(c)</enum><header>Grants</header>
								<paragraph id="HE695522C52B24B9FA16132E7F2523754"><enum>(1)</enum><header>Grants to
				qualified State or local entities</header><text display-inline="yes-display-inline">Not less than 75 percent of the funds made
				available to carry out the program shall be awarded as grants, administered by
				Natural Resources Conservation Service state conservationists, to qualified
				State and local entities. The Secretary shall distribute such grant funds among
				States based on demonstrated need for farm and ranch land protection and on the
				relative contribution of funds dedicated by States and eligible entities for
				this purpose.</text>
								</paragraph><paragraph id="H9EB75A015E3C48FD9D61A0E418172802"><enum>(2)</enum><header>Multiple
				transactions</header><text>Grants may be made under the program for multiple
				transactions without regard for whether pending purchase offers are
				outstanding, so long as all grant funds are used for the purpose of purchasing
				conservation easements or other interests in eligible land.</text>
								</paragraph><paragraph id="HE1ED5D9255EE403F84E72C984FE585EF"><enum>(3)</enum><header>Distribution of
				excess funds</header><text display-inline="yes-display-inline">Any funds not
				granted to qualified State or local entities under the program shall be
				available for distribution to other eligible entities as matching funds for
				individual purchases of conservation easements and other interests in eligible
				land.</text>
								</paragraph></subsection><subsection id="HEF37A621C81841DB937C281096F6498C"><enum>(d)</enum><header>Grant
				agreements</header>
								<paragraph id="H1E8A06A30A89444300860190976C3066"><enum>(1)</enum><header>Agreements
				authorized</header><text display-inline="yes-display-inline">The Secretary,
				acting through the Natural Resources Conservation Service, may enter into an
				agreement with a qualified State or local entity, under which the State or
				local entity may purchase conservation easements or other interests in eligible
				land using a combination of grant funds provided under subsection (c) and other
				funds available to the entity.</text>
								</paragraph><paragraph id="H9A56F1FF55E040309538E09CDA00A602"><enum>(2)</enum><header>Terms and
				conditions</header><text display-inline="yes-display-inline">An agreement under
				this subsection shall stipulate the terms and conditions under which the
				qualified State or local entity shall use funds provided by the Secretary under
				the program, subject to the following:</text>
									<subparagraph id="H8003AB8A0F4C4F09AB8E58F504E97D2"><enum>(A)</enum><text display-inline="yes-display-inline">The qualified State or local entity shall
				be authorized to determine their own criteria and priorities for purchasing
				conservation easements and other interests in eligible land.</text>
									</subparagraph><subparagraph id="HFAED46D057FC4EC588B845B10EA866B"><enum>(B)</enum><text display-inline="yes-display-inline">The qualified State or local entity may
				determine the terms and conditions for conservation easements and other
				interests in eligible land purchased using grant funds, if the attorney general
				of the State in which the land is located certifies that such terms and
				conditions are adequate under State law to achieve and permit effective
				enforcement of the conservation purposes of such easements or other
				interests.</text>
									</subparagraph><subparagraph id="H05EC81EC5EB84BBA85B579DD19ABD079"><enum>(C)</enum><text>No Federal
				contingent right of enforcement or reversionary interest in a conservation
				easement or other purchase of an interest in land shall be required.</text>
									</subparagraph></paragraph></subsection><subsection id="H471EF0989B56423D92223295D548AAA3"><enum>(e)</enum><header>Individual
				purchases</header><text display-inline="yes-display-inline">The Secretary may
				enter into agreements with eligible entities under which the Secretary shall
				provide matching funds for the purpose of purchasing conservation easements or
				other interests in eligible land on individual farm and ranch properties. The
				Secretary may agree to such terms as the Secretary considers appropriate to
				assure that the purpose of the program is carried out, except that subsection
				(d)(2)(C) shall apply to any easement held by a State or local agency or in
				which a qualified State or local entity will hold a contingent right of
				enforcement.</text>
							</subsection><subsection id="H069E24E009FF46A9809392F14320C3C8"><enum>(f)</enum><header>Conservation
				plan</header><text display-inline="yes-display-inline">Notwithstanding
				subsection (d)(2)(B), any highly erodible cropland for which a conservation
				easement or other interest in land is purchased using funds made available
				under the program shall be subject to the requirements of a conservation plan,
				except that, for easements and other interests in land that are perpetual in
				duration, the Secretary may not require the conversion of the cropland to less
				intensive uses if, under the conservation plan, soil erosion can be reduced to
				<quote>T</quote> or below.</text>
							</subsection><subsection id="H97EB216ADF684710B7D2AB6862BE4442"><enum>(g)</enum><header>Cost
				sharing</header>
								<paragraph id="H8E8C5E19C78A4CB69936B781C0A68781"><enum>(1)</enum><header>Maximum cost
				share using section 1241(d) funds</header><text display-inline="yes-display-inline">The share of the cost of purchasing a
				conservation easement or other interest in eligible land under the program
				using funds provided under section 1241(d) shall not exceed the greater
				of—</text>
									<subparagraph id="H676D7CAE32014A2D95AA58734697E961"><enum>(A)</enum><text>50 percent of the
				appraised fair market value of the conservation easement or other interest in
				eligible land; or</text>
									</subparagraph><subparagraph id="HBB87C0000E2E4590A63B2E009BE79267"><enum>(B)</enum><text display-inline="yes-display-inline">if a qualified conservation contribution,
				as defined by <external-xref legal-doc="usc" parsable-cite="usc/26/170">section 170(h)</external-xref> of the Internal Revenue Code of 1986, of at least
				25 percent of the market value of the conservation easement or other interest
				in eligible land is made by the landowner in connection with the purchase of
				the easement or other interest in land, two-thirds of the actual cost of
				purchasing the conservation easement or other interest in land.</text>
									</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H313C0C005D844FD992BBC0FAED16368D"><enum>(2)</enum><header>Maximum cost
				share using other funds</header><text display-inline="yes-display-inline">As
				part of the share of the cost of purchasing a conservation easement or other
				interest in eligible land under the program using funds that are not provided
				under section 1241(d), a qualified State or local agency or other eligible
				entity may include a qualified conservation contribution by the private
				landowner from which the eligible land is to be purchased of not more than 50
				percent of the fair market value of the conservation easement or other interest
				in eligible land.</text>
								</paragraph><paragraph id="HCF17809F746F4B0AB94CCC05DB249219"><enum>(3)</enum><header>Bidding
				down</header><text>If the Secretary determines that two or more applications
				under the program for the purchase of a conservation easement or other interest
				in eligible land are comparable in achieving the purposes of the program, the
				Secretary shall not assign a higher priority to any one of those applications
				solely on the basis of lesser cost to the
				program.</text>
								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection display-inline="no-display-inline" id="H81E969AF205A433EAE20EE6677A036AB"><enum>(d)</enum><header>Funding for
			 farmland protection program</header><text>Paragraph (4) of subsection (a) of
			 section 1241 of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3841">16 U.S.C. 3841</external-xref>) is amended to
			 read as follows:</text>

			 enrollment</header><text display-inline="yes-display-inline">Section
			 502(f)(1)of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6572">16 U.S.C. 6572(f)(1)</external-xref>)
			 is amended by striking subparagraph (C) and inserting the following new
			 subparagraph:</text>

				shall use the funds, facilities, and authorities of the Commodity Credit
				Corporation to carry out the healthy forests reserve program, including the
				provision of technical assistance under the program.</text>
							</subsection><subsection id="H492C69823DED4A5AAC4CE1FE4D055536"><enum>(b)</enum><header>Section 11
				cap</header><text display-inline="yes-display-inline">The use of Commodity
				Credit Corporation funds under subsection (a) to provide technical assistance
				under the healthy forests reserve program shall not be considered an allotment
				or fund transfer from the Commodity Credit Corporation for purposes of the
				limitation on expenditures for technical assistance imposed by section 11 of
				the Commodity Credit Corporation Charter Act (15 U.S.C.
				714i).</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section display-inline="no-display-inline" id="HB367A9C1D2E74C04BC6B5BAB9BB45B40" section-type="subsequent-section"><enum>114.</enum><header>Integrated pest
			 management initiative</header>
				<subsection id="HEC51059B4D4B43D680124DCBBEB9C372"><enum>(a)</enum><header>Initiative
			 required</header><text display-inline="yes-display-inline">The Secretary of
			 Agriculture shall implement an integrated pest management initiative in
			 priority areas identified by the Secretary pursuant to subsection (b) for the
			 purpose of assisting agricultural producers operating in a priority area to
			 comply with pest management regulations and alleviate the need for additional
			 regulations regarding pest management activities.</text>
				</subsection><subsection id="H97E94523C89B48319CD91BA5CB625CE4"><enum>(b)</enum><header>Identification
			 of priority areas</header>
					<paragraph id="HF1CEE1B0CC604726BE27CD3843B6415F"><enum>(1)</enum><header>Identification</header><text display-inline="yes-display-inline">The Secretary of Agriculture shall identify
			 priority areas where the adoption by agricultural producers of integrated pest
			 management practices and approaches offers the greatest potential benefit to
			 producers seeking to comply with pest management regulations and alleviate the
			 need for additional regulations regarding pest management activities. At a
			 minimum, priority areas shall include agricultural lands dominated by the
			 production of specialty crops and agricultural lands where agricultural pest
			 management activities are regulated for the purpose of mitigating specific
			 impacts to human health or the environment, such as an area in which pollutants
			 exceed authorized total maximum daily load or an air quality non-attainment
			 area.</text>
					</paragraph><paragraph id="HD6F992BC935640CD84115FEC3D420049"><enum>(2)</enum><header>Consultation</header><text display-inline="yes-display-inline">The Secretary shall identify priority areas
			 in consultation with the Environmental Protection Agency, the United States
			 Geological Service, the United States Fish and Wildlife Service, agricultural
			 producers, appropriated State agencies, and other interested persons.</text>
					</paragraph></subsection><subsection id="HA4ACAE5DEA9F4CA8A19334E853885195"><enum>(c)</enum><header>Activities in
			 priority areas</header>
					<paragraph id="H28A8EBF0CC5645118D589D113B19D6D9"><enum>(1)</enum><header>Expedited
			 approval of management practices</header><text display-inline="yes-display-inline">The Secretary of Agriculture shall develop
			 the best-available integrated pest management practices for the primary
			 agricultural commodities and significant pests in each priority area identified
			 under subsection (b) and expedite approval of these practices for
			 implementation by agricultural producers.</text>
					</paragraph><paragraph id="H897BC2CD141149D4B7B76DA73FC5721"><enum>(2)</enum><header>Improved
			 evaluation of management plans</header><text display-inline="yes-display-inline">The Secretary shall develop and make
			 available criteria to enable staff of the Natural Resources Conservation
			 Service and agricultural producers operating in priority areas identified under
			 subsection (b) to effectively compare pest management plans, considering
			 relative risks and potential benefits to multiple resources of concern,
			 including air, surface water, ground water, bees and other pollinators,
			 wildlife, and worker safety.</text>
					</paragraph><paragraph id="H645B793717314AD9BE0001D3EDF62020"><enum>(3)</enum><header>Technical
			 assistance</header><text display-inline="yes-display-inline">The Secretary may
			 enter in cooperative agreements, memorandums of understanding, and contracts
			 for services with technical service providers, other agencies, and non-Federal
			 organizations, as necessary, to assist in providing technical assistance
			 regarding integrated pest management planning and implementation to producers
			 operating in priority areas identified under subsection (b).</text>
					</paragraph><paragraph id="H426CD58D4089459CA9E706B8465C2EAD"><enum>(4)</enum><header>Marketing</header><text display-inline="yes-display-inline">The Secretary may market the availability
			 of integrated pest management tools and training to agricultural producers in
			 the priority areas identified under subsection (b).</text>
					</paragraph><paragraph id="HB34B2F1062134340AF8157C6989182B"><enum>(5)</enum><header>Program
			 integration</header><text display-inline="yes-display-inline">The Secretary
			 shall set goals for integrating the integrated pest management initiative with
			 the environmental quality incentives program established under chapter 4 of
			 subtitle D of title XII of the Food Security Act of 1985 (16 U.S.C. 3839aa et
			 seq.) and other conservation programs in each priority area identified under
			 subsection (b), including indicators of the extent to which these programs fund
			 integrated pest management practices and the extent to which supported
			 integrated pest management practices reduce pesticide use and risk.</text>
					</paragraph></subsection><subsection id="HE6E3ADEDC74E406884C78E00DA529EF4"><enum>(d)</enum><header>Annual
			 report</header><text display-inline="yes-display-inline">The Secretary of
			 Agriculture shall submit to Congress an annual report on the integrated pest
			 management initiative, including progress in meeting the program integration
			 goals set under subsection (c)(5).</text>
				</subsection><subsection id="H92333C7452034EE7BFF56603E5C0DD64"><enum>(e)</enum><header>Funding</header><text display-inline="yes-display-inline">The Secretary of Agriculture may use
			 resources provided for programs under subtitle D of title XII of the Food
			 Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3830">16 U.S.C. 3830 et seq.</external-xref>) to implement the integrated pest
			 management initiative.</text>
				</subsection></section><section display-inline="no-display-inline" id="HC3D011D57B974DA3B13032A62DC5CC68" section-type="subsequent-section"><enum>115.</enum><header>National organic
			 certification and transition cost share program</header><text display-inline="no-display-inline">Section 10606 of the Farm Security and Rural
			 Investment Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/7/6523">7 U.S.C. 6523</external-xref>) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H11F7A5F738834225A78F47D33425C281" style="OLC">
					<section id="H4046973A446F4DA086331CD257004ECA"><enum>10606.</enum><header>National
				organic certification and transition cost share program</header>
						<subsection id="HEBA00DB4BAB24A689F0700F6600006A"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">Of the funds of the
				Commodity Credit Corporation, the Secretary of Agriculture (acting through the
				Natural Resources Conservation Service) shall use $37,500,000 for each of
				fiscal years 2008 through 2013 to establish a national organic certification
				and transition cost-share program to assist producers and handlers of
				agricultural products in obtaining certification under the national organic
				production program established under the Organic Foods Production Act of 1990
				(<external-xref legal-doc="usc" parsable-cite="usc/7/6501">7 U.S.C. 6501 et seq.</external-xref>) and to assist producers and handlers in making the
				transition to organic production under the such program.</text>
						</subsection><subsection id="H80A4CFA8C8F449AA93BFD9118F8EBDC"><enum>(b)</enum><header>Certification
				costs</header>
							<paragraph id="H98B831C3205A447CBC47DD377B5473C6"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary shall
				pay under this section a portion of the costs incurred by a producer or handler
				in obtaining certification under the national organic production program, as
				certified to and approved by the Secretary.</text>
							</paragraph><paragraph id="HD5A8CF791EBD421C8BD4DE0400C4507F"><enum>(2)</enum><header>Maximum
				amount</header><text display-inline="yes-display-inline">The amount of a
				payment made to a producer or handler for certification under this section
				shall be $750 per year.</text>
							</paragraph><paragraph id="H08BE4A735E344110A52C53DA9150A7EC"><enum>(3)</enum><header>Funding</header><text display-inline="yes-display-inline">Of the funds made available under
				subsection (a), the Secretary (acting through the Agricultural Marketing
				Service) shall use $2,500,000 for each of the fiscal years 2008 through 2013 to
				share up to 75 percent of the cost of certification.</text>
							</paragraph></subsection><subsection id="HD518BCD2B7D84EDB86CC4970FE638E36"><enum>(c)</enum><header>Accreditation
				and enforcement costs</header><text display-inline="yes-display-inline">Of the
				funds made available under subsection (a), the Secretary (acting through the
				Agricultural Marketing Service) shall use $5,000,000 for each of the fiscal
				years 2008 through 2013 to fund the accreditation and enforcement programs
				operated by the National Organic Program to implement the accreditation and
				enforcement provisions of the Organic Foods Production Act of 1990.</text>
						</subsection><subsection id="H877D098511B5409189F3E669AF8D0015"><enum>(d)</enum><header>Reimbursements
				for Infrastructure Necessary to Implement Organic Practice Standards</header>
							<paragraph id="HCC46E054AF78495AA3E0BA75D968621E"><enum>(1)</enum><header>Establishment</header><text>Not
				later than 180 days after the date of the enactment of this Act, the Secretary
				shall establish a program to reimburse producers and handlers for the costs of
				transition to organic production.</text>
							</paragraph><paragraph id="H5CC8C97A8A5240F000C8BFB9B7DB2E"><enum>(2)</enum><header>Program</header><text display-inline="yes-display-inline">Under the program established under
				paragraph (1), the Secretary (acting through the Natural Resources Conservation
				Service) shall use $35,000,000 for each of the fiscal years 2008 through 2013
				to assist producers and handlers developing and implementing infrastructure and
				practices necessary to transition land and animals to meet the requirements of
				the Organic Food Production Act of 1990.</text>
							</paragraph><paragraph id="HB069A858A371463895E280CB5098F488"><enum>(3)</enum><header>Plan
				submission</header><text display-inline="yes-display-inline">The Secretary may
				only reimburse a producer or handler under this section if the producer or
				handler submits to the Secretary an organic transition plan that contains the
				expected costs for infrastructure and practices, the environmental and economic
				benefits derived from the infrastructure or implementing organic practice
				standards, and a demonstration of the existence of a market or the reasonable
				expectation of a future market for the products to be produced or
				handled.</text>
							</paragraph><paragraph id="H92218AF382DE43D6B6203FF5EE449C4D"><enum>(4)</enum><header>Appropriate
				infrastructure and practice standards</header><text>The Secretary shall only
				reimburse producers and handlers under this subsection for the costs of the
				following:</text>
								<subparagraph id="H63757D270B49485DA87DECEDEA4F1955"><enum>(A)</enum><text display-inline="yes-display-inline">Organic practices and activities during
				transition to certified organic production consistent with an approved plan to
				transition to certified organic production.</text>
								</subparagraph><subparagraph id="HCC7FF3072EE346D0BBCCD03DDE9B8D8"><enum>(B)</enum><text>Farm infrastructure
				necessary to implement organic practice standards, including livestock watering
				facilities and fencing, so long as such infrastructure is consistent with an
				approved plan to transition to certified organic production.</text>
								</subparagraph><subparagraph id="H4AEE5B62B0594B189400E37362FC0691"><enum>(C)</enum><text>Organic livestock
				welfare measures, so long as such infrastructure or practices and activities
				are necessary to implement an organic practice standard and are consistent with
				an approved plan to transition to certified organic production.</text>
								</subparagraph><subparagraph id="H275528B42DE0474B967973031DDB52B0"><enum>(D)</enum><text>Advanced organic
				practices consistent with approved certified organic production.</text>
								</subparagraph><subparagraph id="H8449B5F10968457BB8E2EF4F6B003E9F"><enum>(E)</enum><text>Technical
				assistance, including the costs of developing an approved transition plan under
				this section.</text>
								</subparagraph><subparagraph id="H590A3D0EE62640D4A171E4A7BB095D24"><enum>(F)</enum><text>Other measures the
				Secretary, after consultation with the National Organic Standards Board,
				determines are appropriate.</text>
								</subparagraph></paragraph><paragraph id="HA6B81292004E42ABA03CACA1B11ECE85"><enum>(5)</enum><header>Organic
				transition technical advice</header><text display-inline="yes-display-inline">The Secretary shall consult with the
				National Organic Standards Board regarding the elements of an approved organic
				transition plan and to identify and recommend ways that the Secretary may
				generally use the resources provided for programs under subtitle D of title XII
				of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3830">16 U.S.C. 3830 et seq.</external-xref>) to facilitate
				transition to organic production, including the resources provided by the
				Environmental Quality Incentives Program and the Conservation Security
				Program.</text>
							</paragraph><paragraph id="H24D12005BB2F48E1B169755E1FB35132"><enum>(6)</enum><header>Maximum amount
				for transition reimbursement</header><text display-inline="yes-display-inline">The maximum amount of reimbursement paid to
				a producer or handler for transition to organic production under this section
				shall be $10,000 per fiscal year.</text>
							</paragraph><paragraph id="H25E554ABAE65481887C2B00037F6EED3"><enum>(7)</enum><header>Eligible fiscal
				years</header><text>A producer or handler may only receive payments—</text>
								<subparagraph id="H07D321D06CC84346A12CC4FD2B386484"><enum>(A)</enum><text>in four fiscal
				years; and</text>
								</subparagraph><subparagraph id="H3739719965CF406A94F8ED7EE4510038"><enum>(B)</enum><text>after the first
				payment, in the fiscal year in which such payment was made and the three
				subsequent fiscal years.</text>
								</subparagraph></paragraph><paragraph commented="no" id="H798AD5A67ACA4EDC81D51C372E14D900"><enum>(8)</enum><header>Transition
				Reimbursements</header><text display-inline="yes-display-inline">A certified
				organic producer or handler under the national organic production program shall
				be eligible for reimbursements to make the transition to organic production for
				new lands and livestock.</text>
							</paragraph><paragraph id="H47FC6A52DC964C4B830020A0021A657"><enum>(9)</enum><header>Limitation on
				reimbursements</header><text>The Secretary shall not enroll a producer or
				handler under this subsection if, for any particular agricultural product, the
				producers and handlers currently enrolled in the program produce a number of
				that agricultural product that is greater than 10 percent of the amount of that
				agricultural product produced by all producers and handlers certified under the
				Organic Foods Production Act of 1990 on the date of the enactment of this
				section.</text>
							</paragraph><paragraph id="HEBF3541086324179ADCFE9642C7B11"><enum>(10)</enum><header>Appeals</header><text display-inline="yes-display-inline">An applicant seeking transition assistance
				under this section has the right to appeal an adverse decision by Secretary
				with regard to an application for assistance, as provided in section 275 of the
				Department of Agriculture Reorganization Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/7/6995">7 U.S.C. 6995</external-xref>).</text>
							</paragraph></subsection><subsection id="H5D194E679F5A4B43B7EDF161D53C2B49"><enum>(e)</enum><header>Technical
				Assistance</header><text display-inline="yes-display-inline">The Secretary may
				provide technical assistance to producers and handlers to carry out this
				section, including entering into cooperative agreements with qualified entities
				to implement the transition to organic production.</text>
						</subsection><subsection id="H5AAF2D1584954A0A95DF3D6697C6464F"><enum>(f)</enum><header>Reporting</header><text display-inline="yes-display-inline">Not later than March 1 of each year, the
				Secretary shall submit to Congress and the National Organic Standards Board a
				report detailing State-by-State expenditures on certification, including the
				number of producers and handlers served by the program, and State-by-State
				expenditures on transition assistance, including the number of producers and
				handlers served by the program, the practices implemented, an assessment of the
				impacts of the program on organic production, and recommended reforms, if
				any.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="HE708DFD61ECC403990E90917A06F8053"><enum>116.</enum><header>Organic
			 agriculture research and extension initiative</header><text display-inline="no-display-inline">Section 1672B(e) of the Food, Agriculture,
			 Conservation, and Trade Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/5925b">7 U.S.C. 5925b(e)</external-xref>) is amended to read as
			 follows:</text>
				<quoted-block display-inline="no-display-inline" id="H7F718EB35AC44DECA8341BA7C0FE0071" style="OLC">
					<subsection id="H86453B49222948C1A4A18748F6FE948F"><enum>(e)</enum><header>Funding</header><text>Of
				the funds available to the Commodity Credit Corporation, the Secretary shall
				use $10,000,000 for each of fiscal years 2008 through 2013 to carry out this
				section.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="H765231710CAE4E588DE074DAFD7AFEF"><enum>117.</enum><header>Funding for
			 education grants programs for Hispanic-serving institutions</header><text display-inline="no-display-inline">Subsection (c) of section 1455 of the
			 National Agricultural Research, Extension, and Teaching Policy Act of 1977 (7
			 U.S.C. 3241) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="HF864B98690E74E20A69064F3C8A3E793" style="OLC">
					<subsection id="H70BE09691BE64432B558DB330094BD9C"><enum>(c)</enum><header>Funding</header><text>Of

			</section><section id="H520D6F470D6243B1A9C403B7241E609F" section-type="subsequent-section"><enum>118.</enum><header>Initiative to
			 encourage greater participation by socially disadvantaged farmers and ranchers
			 in conservation programs</header>
				<subsection id="H1E1E4FD9F7E74DFB9D11408BE5F52362"><enum>(a)</enum><header>Definitions</header><text>In
			 this section:</text>
					<paragraph id="HEA7F0F2D876942918FFEDA604311589"><enum>(1)</enum><header>Socially
			 disadvantaged group</header><text display-inline="yes-display-inline">The term
			 <quote>socially disadvantaged group</quote> means a group of persons whose
			 members have been subjected to racial or ethnic prejudice because of their
			 identity as members of a group without regard to their individual
			 qualities.</text>
					</paragraph><paragraph id="H5A85B7393FB94C439E3BBD32F902F77F"><enum>(2)</enum><header>Socially
			 disadvantaged farmer or rancher</header><text>The term <quote>socially
			 disadvantaged farmer or rancher</quote> means a farmer or rancher who is a
			 member of a socially disadvantaged group.</text>
					</paragraph><paragraph id="H77E3431043BA4520A766496621CEFD09"><enum>(3)</enum><header>Eligible
			 entity</header><text>The term <quote>eligible entity</quote> means any of the
			 following:</text>
						<subparagraph id="HCFD99D7FB9D44639966D8FBF98016D5D"><enum>(A)</enum><text>Any
			 community-based organization, network, or coalition of community-based
			 organizations that—</text>
							<clause id="H11F26C9AB80B43A69FDEE11015CFCBD6"><enum>(i)</enum><text>has
			 demonstrated experience in providing agricultural education or other
			 agriculturally related services to socially disadvantaged farmers or
			 ranchers;</text>
							</clause><clause id="H0896CB9D520D4038B311F96085E46E36"><enum>(ii)</enum><text>has
			 provided to the Secretary of Agriculture documentary evidence of work with
			 socially disadvantaged farmers or ranchers for not less than a five-year period
			 preceding the submission of an application for assistance under this section;
			 and</text>
							</clause><clause id="H510513A497DC4554BD62DE6D028F2F41"><enum>(iii)</enum><text display-inline="yes-display-inline">does not engage in activities prohibited
			 under <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986.</text>
							</clause></subparagraph><subparagraph id="H0196F02EDE5F40BEAEF7898FBEC36525"><enum>(B)</enum><text display-inline="yes-display-inline">An Indian tribe (as defined in section 4 of
			 the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/450b">25 U.S.C. 450b</external-xref>)) or
			 a national tribal organization that has demonstrated experience in providing
			 agriculture education or other agriculturally related services to socially
			 disadvantaged farmers or ranchers in a region.</text>
						</subparagraph><subparagraph id="H0475F1F73BA04EF0968FC9CBD00838F7"><enum>(C)</enum><text display-inline="yes-display-inline">An 1890 institution or 1994 institution (as
			 defined in section 2 of the Agricultural Research, Extension, and Education
			 Reform Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/7/7601">7 U.S.C. 7601</external-xref>)), including West Virginia State
			 College.</text>
						</subparagraph><subparagraph id="H8C6B461BE1CD40F8A97BF55489B8FDF8"><enum>(D)</enum><text display-inline="yes-display-inline">An Indian tribal community college or an
			 Alaska Native cooperative college.</text>
						</subparagraph><subparagraph id="HF908694FA96D4DE292BDFA15B523CED"><enum>(E)</enum><text display-inline="yes-display-inline">An Hispanic-serving institution (as defined
			 in section 1404 of the National Agricultural Research, Extension, and Teaching
			 Policy Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/7/3103">7 U.S.C. 3103</external-xref>)).</text>
						</subparagraph><subparagraph id="HDA0BB1A93FD04F9099D0C9C0672E8790"><enum>(F)</enum><text display-inline="yes-display-inline">Any other institution of higher education
			 (as defined in section 101 of the Higher Education Act of 1965 (20 U.S.C.
			 1001)) that has demonstrated experience in providing agriculture education or
			 other agriculturally related services to socially disadvantaged farmers or
			 ranchers in a region.</text>
						</subparagraph></paragraph></subsection><subsection id="H0F3B6EEB2D5E44E69300C07100CC2134"><enum>(b)</enum><header>Initiative</header><text display-inline="yes-display-inline">With respect to all programs authorized or
			 amended by this title, the Secretary of Agriculture shall establish a
			 conservation initiative for socially disadvantaged farmers or ranchers. With
			 respect to such programs that serve an Indian tribe, the Secretary shall be
			 required to pay the costs of office space to carry out conservation functions
			 authorized under this section.</text>
				</subsection><subsection id="H80384C661B244BDCB9B2B09104B5049F"><enum>(c)</enum><header>Special rule for
			 cost-share payments</header><text display-inline="yes-display-inline">The
			 Secretary of Agriculture shall pay 100 percent of the costs incurred by a
			 socially disadvantaged farmer or rancher entitled to participate in a program
			 authorized or amended by this title.</text>
				</subsection><subsection id="H36D9F7F04D144868002819068BE0FFF4"><enum>(d)</enum><header>Outreach and
			 assistance</header><text display-inline="yes-display-inline">The Secretary of
			 Agriculture shall carry out an outreach and technical assistance program to
			 encourage and assist socially disadvantaged farmers or ranchers to participate
			 equitably in the full range of agricultural programs authorized or amended by
			 this title.</text>
				</subsection><subsection id="H1BF5C3748D1C4CE4843EBA4B5681B069"><enum>(e)</enum><header>Grants and
			 contracts</header><text display-inline="yes-display-inline">The Secretary of
			 Agriculture may make grants to, and enter into contracts and other agreements
			 with, an eligible entity to provide information and technical assistance to
			 socially disadvantaged farmers or ranchers so that they can participate
			 equitably in the full range of agricultural programs authorized or amended by
			 this title.</text>
				</subsection><subsection id="HF435D02689C04B3F8DEA6742CF3EC07"><enum>(f)</enum><header>Relationship to
			 other law</header><text display-inline="yes-display-inline">The authority to
			 carry out this section shall be in addition to any other authority provided in
			 this or any other Act.</text>
				</subsection><subsection id="H7191C121660F446B824158F1D636B851"><enum>(g)</enum><header>Funding</header>
					<paragraph id="HA582C31F9EAD4AB489B169532DB30796"><enum>(1)</enum><header>Availability of
			 funds</header><text display-inline="yes-display-inline">The Secretary of
			 Agriculture shall use not less $25,000,000 of the funds of the Commodity Credit
			 Corporation in each of fiscal years 2008 through 2013 to carry out this
			 section.</text>
					</paragraph><paragraph id="HAF8F3EA9A6744F1182F8A3D5C608C357"><enum>(2)</enum><header>Interagency
			 funding</header><text display-inline="yes-display-inline">In addition to funds
			 made available by paragraph (1), any agency of the Department of Agriculture
			 may participate in any grant, contract, or agreement entered into under this
			 section by contributing funds, if the agency determines that the objectives of
			 the grant, contract, or agreement will further the authorized programs of the
			 contributing agency.</text>
					</paragraph></subsection></section></title><title id="H146F78083E4A4530B2C2879EFCEE5A6"><enum>II</enum><header>Energy</header>
			<section id="H08E3A6B4CC474D4B89DBC66F9557C2CD"><enum>201.</enum><header>Definition of
			 biomass</header><text display-inline="no-display-inline">Section 9001(3)(B)(i)
			 of the Farm Security and Rural Investment Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/7/8101">7 U.S.C. 8101(3)(B)(i)</external-xref>)
			 is amended by inserting <quote>and crop waste</quote> after <quote>agricultural
			 crops</quote>.</text>
			</section><section id="HBA5269C39C724963B9F34F572901D3C"><enum>202.</enum><header>Support for
			 development of biorefineries</header>
				<subsection id="HAC46A938A8424D8193B18B26C35FF6DB"><enum>(a)</enum><header>Assistance
			 methods</header><text display-inline="yes-display-inline">Subsection (c) of
			 section 9003 of the Farm Security and Rural Investment Act of 2002 (7 U.S.C.
			 8103) to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="HE465B66EA9904D22BA00CD1E29A95865" style="OLC">
						<subsection id="H3711F236D041436C8B7FCBDED52E4F9E"><enum>(c)</enum><header>Assistance</header><text display-inline="yes-display-inline">The Secretary shall award grants and make
				loans and loan guarantees to eligible entities to assist in covering the cost
				of development and construction of biorefineries to carry out projects to
				demonstrate the commercial viability of 1 or more processes for converting
				biomass to fuels or
				chemicals.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H93AF2DD2C62248259CF99F77206DD76C"><enum>(b)</enum><header>Environmental
			 goals</header><text display-inline="yes-display-inline">Subsection (e)(2) of
			 such section is amended—</text>
					<paragraph id="HBAA7B243099643E0909C36590064E592"><enum>(1)</enum><text>by striking
			 <quote>and</quote> at the end of clause (i);</text>
					</paragraph><paragraph id="HFB4050DE967E40CFA252968946D30400"><enum>(2)</enum><text>by redesignating
			 clause (ii) as clause (iii); and</text>
					</paragraph><paragraph id="H2E412529A5624BBAB6FCE07B732E1BC2"><enum>(3)</enum><text>by striking after
			 clause (i) the following new clause:</text>
						<quoted-block display-inline="no-display-inline" id="HA09EA24B59204C5B8C2F3DF535CFB727" style="OLC">
							<clause id="H4C555324AC3A4414A643ACB263BB8E04"><enum>(ii)</enum><text display-inline="yes-display-inline">shall select projects based upon the extent
				to which the projects meet environmental goals for feed stocks and refineries,
				developed by the Secretary in consultation with the Secretary of the Interior,
				the Secretary of Energy, and the National Academy of Sciences;
				and</text>
							</clause><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="HD986E108BE65495FB600D3207FC1B7E4"><enum>(c)</enum><header>Cost
			 sharing</header><text display-inline="yes-display-inline">Subsection (f) of
			 such section is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="HC1B77C4BF0334AF489CEA22956E4708" style="OLC">
						<subsection id="HBD848B48828D4EA3903C9B2259876BC8"><enum>(f)</enum><header>Cost sharing and
				interest rates</header>
							<paragraph id="HBEA623EB521943B3AB8F22BC0035D3BB"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The combined amount
				of a grant and loan made or guaranteed under this section shall not exceed 50
				percent of the cost of the project.</text>
							</paragraph><paragraph id="HBD054C0AB7944562A2F1DAE8B577CE5"><enum>(2)</enum><header>Form of recipient
				share</header><text display-inline="yes-display-inline">The recipient share of
				the cost of a project may be made in the form of cash or the provision of
				services, material, or other in-kind contributions. The amount of the recipient
				share made in the form of the provision of services, material, or other in-kind
				contributions shall not exceed 25 percent of the amount of the share determined
				under paragraph (1).</text>
							</paragraph><paragraph id="H09FC03A35EC44F219BBA8C77D5A9D3B0"><enum>(3)</enum><header>Interest
				rate</header><text display-inline="yes-display-inline">A loan made under
				subsection (c) shall bear interest at the rate equivalent to the rate of
				interest charged on Treasury securities of comparable maturity on the date the
				loan is approved. The interest rate shall remain in effect for the term of the
				loan.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H6E5BF4A8F95C4308A200D898B2EC63AB"><enum>(d)</enum><header>Energy reserve
			 program</header><text>Such section is further amended—</text>
					<paragraph id="HD2885AC624574F218BF9B2940034F5BC"><enum>(1)</enum><text>by redesignating
			 subsections (g) and (h) as subsections (h) and (i), respectively; and</text>
					</paragraph><paragraph id="HC54528178EF143429EC5FA62875759D"><enum>(2)</enum><text>by
			 inserting after subsection (f) the following new subsection:</text>
						<quoted-block display-inline="no-display-inline" id="H461A769787EB46F28EED840014E18E92" style="OLC">
							<subsection id="H0FD945D70DC14C41BD4038086B45883B"><enum>(g)</enum><header>Energy reserve
				program</header>
								<paragraph id="HB04F9E8248164B84879500C71431D710"><enum>(1)</enum><header>Program
				required</header><text display-inline="yes-display-inline">Until December 31,
				2013, the Secretary shall carry out an energy reserve program under which not
				more than 100,000 acres of land may be enrolled through the use of five-year
				contracts to assist owners and operators with the production of feed stocks for
				the projects carried out pursuant to this section.</text>
								</paragraph><paragraph id="H1C2F053CDA314EAE9F523BD5E359200"><enum>(2)</enum><header>Eligible
				lands</header><text>The Secretary may include any land, regardless of a
				cropping history, so long as the feed stock is produced and harvested
				consistent with the needs of the environment, as provided in paragraph
				(3).</text>
								</paragraph><paragraph id="H6D405A8D73584A428C5337E39EADBDA1"><enum>(3)</enum><header>Duties of owners
				and operators</header><text>Under a contract entered into under this
				subsection, an owner or operator of land shall implement a feed stock
				conservation plan to ensure that lands enrolled are managed consistent with the
				needs of the environment, including the needs of wildlife. Paragraphs (5) and
				(6) of section 1232(a) of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3832">16 U.S.C. 3832(a)</external-xref>)
				shall apply to the contracts</text>
								</paragraph><paragraph id="HB86240806D1145FA808CB4B630AD53C8"><enum>(4)</enum><header>Payments</header><text>The
				Secretary shall provide annual rental payments to owners and operators of lands
				of amounts not greater than $25,000 for any fiscal year, and shall establish
				the amounts of payments through—</text>
									<subparagraph id="H54B21DB83F6A48A3B9458B7643F26165"><enum>(A)</enum><text>the submission of
				bids for such contracts by owners and operators in such manner as the Secretary
				may prescribe; or</text>
									</subparagraph><subparagraph id="HED910EF0D490485E8500CED200357748"><enum>(B)</enum><text>such other means
				as the Secretary determines are
				appropriate.</text>
									</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="H6E1A0BBD5FE64A2C997581E4CBD5100"><enum>(e)</enum><header>Funding</header><text display-inline="yes-display-inline">Subsection (i) of such section, as amended
			 by subsection (d)(1), is amended to read as follows:</text>

			 Rural Investment Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/7/8105">7 U.S.C. 8105(f)</external-xref>) is amended by striking
			 <quote>fiscal years 2002 through 2007</quote> and inserting <quote>fiscal years
			 2008 through 2013</quote>.</text>

			 striking <quote>such sums as are necessary</quote> and all that follows through
			 the period at the end and inserting <quote>to carry out this subsection
			 $20,000,000 for each of fiscal years 2008 through 2013.</quote>.</text>

			 Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1786">42 U.S.C. 1786(m)(9)(A)</external-xref>) is amended—</text>

			 striking <quote>2009</quote> and inserting <quote>2013</quote>; and</text>

				Secretary shall prioritize for funding projects that will support, encourage,
				or promote the transition to organic and other environmentally beneficial forms

						</paragraph></subsection><subsection id="H53FAA15FEB7547F69925E6E18500DD3C"><enum>(e)</enum><header>Funding</header><text display-inline="yes-display-inline">The Secretary shall use $20,000,000 of
				funds of the Commodity Credit Corporation to carry out this section in each of
				the fiscal years 2008 through
