			 and detection account</header><text display-inline="no-display-inline">Section
			 286(v)(2)(A) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1356">8 U.S.C. 1356(v)(2)(A)</external-xref>) is
			 amended—</text>
			<paragraph id="HF3C0DEFD08BE4A44B5F161B5CDE4273"><enum>(1)</enum><text>in
			 clause (i), by inserting <quote>or primarily</quote> after
			 <quote>exclusively</quote>; and</text>
			</paragraph><paragraph id="H4054B28EA5CA49EEB5046B319925B021"><enum>(2)</enum><text>by amending clause
			 (ii) to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H1978CA74F55645FFA2F064379B04C88E" style="OLC">
					<clause id="H38E982D290B04F96A81728D01956DA32"><enum>(ii)</enum><text>otherwise to
				prevent and detect visa fraud, including primarily fraud by applicants for
				visas described in subparagraph (H)(i), (H)(ii), or (L) of section 101(a)(15),
				in cooperation with the Secretary of Homeland Security or pursuant to the terms
				of a memorandum of understanding or other agreement between the Secretary of
				State and the Secretary of Homeland Security;
				and</text>
					</clause><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section display-inline="no-display-inline" id="HD299047EDA9B4B6B959E4CB704C0025F"><enum>3.</enum><header>Education
			 allowances</header><text display-inline="no-display-inline">Section 5924(4) of
			 title 5, United States Code, is amended—</text>
			<paragraph id="H1C1D4441592742D1A80049CC6EDD7DA1"><enum>(1)</enum><text>in the first
			 sentence of subparagraph (A), by inserting <quote>United States</quote> after
			 <quote>nearest</quote>;</text>
			</paragraph><paragraph id="H4CCCC8102A0F4FBC92BB5C6559FDBEAC"><enum>(2)</enum><text>by amending
			 subparagraph (B) to read as follows:</text>
				<quoted-block id="H3FA9446118664A9580C70769008685B5" style="OLC">
					<subparagraph id="H1E5AAA138F284ECFBB757D44A5D63CB"><enum>(B)</enum><text display-inline="yes-display-inline">The travel expenses of dependents of an
				employee to and from a secondary or post-secondary educational institution, not
				to exceed one annual trip each way for each dependent, except that an allowance
				payment under subparagraph (A) may not be made for a dependent during the 12
				months following the arrival of the dependent at the selected educational
				institution under authority contained in this
				subparagraph.</text>
					</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H214C8176483D4A75ADBF001C267F2BF2"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block id="H93600DFD50BC41D4ABF0D8A99E3FA007" style="OLC">
					<subparagraph id="HC124249B0D9D48C185D69C1E867FFF1"><enum>(D)</enum><text display-inline="yes-display-inline">Allowances provided pursuant to
				subparagraphs (A) and (B) may include, at the election of the employee, payment
				or reimbursement of the costs incurred to store baggage for the employee’s
				dependent at or in the vicinity of the dependent’s school during the
				dependent’s annual trip between the school and the employee’s duty station,
				except that such payment or reimbursement may not exceed the cost that the
				Government would incur to transport the baggage in connection with the annual
				trip, and such payment or reimbursement shall be in lieu of transportation of
				the
				baggage.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section display-inline="no-display-inline" id="HDE655D76573346A8938CFCA3D73C5763" section-type="subsequent-section"><enum>4.</enum><header>Protection of refugees
			 from North Korea</header>
			<subsection id="HDA818B89275043ADA1E152994650D0FE"><enum>(a)</enum><header>Responsibilities
			 of the special envoy on human rights in North Korea</header><text display-inline="yes-display-inline">Section 107(c) of the North Korean Human
			 Rights Act of 2004 (<external-xref legal-doc="public-law" parsable-cite="pl/108/333">Public Law 108–333</external-xref>) is amended—</text>
				<paragraph id="HB18A2C1D3ABD43089E1222F5DA34A716"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (5), by striking
			 <quote>and</quote> at the end;</text>
				</paragraph><paragraph id="H2E904A0629CD4D6FA5E1AB94B960ACCB"><enum>(2)</enum><text>in paragraph (6),
			 by striking the period at the end and inserting <quote>; and</quote>;
			 and</text>
				</paragraph><paragraph id="HB9A9066DCEE04E8EBB662492A6B1447"><enum>(3)</enum><text>by
			 adding at the end the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="H7B22226314E448BD8EDB6B115C285E05" style="traditional">
						<paragraph id="H079C24EA97F7404BA5B000005E4C3F6F"><enum>(7)</enum><text display-inline="yes-display-inline">help coordinate efforts by the Secretary of
				State to assist North Korean refugees and migrants, including the activities
				directed by section
				303.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H52B3A3B767BD4316B3E086080253C574"><enum>(b)</enum><header>Reporting
			 requirements</header><text display-inline="yes-display-inline">Section 305(a)
			 of the North Korean Human Rights Act of 2004 is amended—</text>
				<paragraph id="HCBAB291E2F9D4497B7B4DA92204CF573"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking
			 <quote>and</quote> at the end;</text>
				</paragraph><paragraph id="H46B425DAA1CA4178A7E3BDF4AD3FD8FD"><enum>(2)</enum><text>in paragraph (2),
			 by striking the period at the end and inserting <quote>; and</quote>;
			 and</text>
				</paragraph><paragraph id="HD59824071D6B4BD7A063FFF1D29BC694"><enum>(3)</enum><text>by adding at the
			 end the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="HDE2F59EBFB8449868F66619B1F4B2102" style="OLC">
						<paragraph id="H24DE0061FFF847CBB854A2F7C700A447"><enum>(3)</enum><text display-inline="yes-display-inline">a detailed description of the measures
				undertaken by the Secretary of State to carry out section 303, including
				country-specific information with respect to United States efforts to secure
				the cooperation and permission of the governments of countries in East and
				Southeast Asia to facilitate United States processing of North Koreans seeking
				protection as refugees. The information required by this paragraph may be
				provided in a classified format, if
				necessary.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section display-inline="no-display-inline" id="H3AE5AE2C25E341CBBA0068E5BFB1DF3D"><enum>5.</enum><header>Interference with
			 protective functions</header>
			<subsection id="H854DA8DFCFF64075AFBE3378E05D7E5"><enum>(a)</enum><header>Offense</header><text>Chapter
			 7 of title 18, United States Code, is amended by adding at the end the
			 following:</text>
				<quoted-block id="H9BEE3F8EDF3C41BE859395C0D48DBF27" style="USC">
					<section id="HBE9BBCED7217435DB79B88E5C19ED95"><enum>118.</enum><header>Interference
				with certain protective functions</header><text display-inline="no-display-inline">Any person who knowingly and willfully
				obstructs, resists, or interferes with a Federal law enforcement agent engaged,
				within the United States or the special maritime territorial jurisdiction of
				the United States, in the performance of the protective functions authorized
				under section 37 of the <act-name parsable-cite="SDBAA">State Department Basic
				Authorities Act of 1956</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/22/2709">22 U.S.C. 2709</external-xref>) or section 103 of the
				Diplomatic Security Act (<external-xref legal-doc="usc" parsable-cite="usc/22/4802">22 U.S.C. 4802</external-xref>) shall be fined under this title,
				imprisoned not more than 1 year, or
				both.</text>
					</section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H3306EB79FECC4AD8A0FA8F37E631F9C3"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of sections at the beginning of such chapter
			 is amended by adding at the end the following:</text>

			 acts of discrimination</header>
			<subsection id="H692C9640F85C499DBD7DA71CFA5C2B9"><enum>(a)</enum><header>Inclusion of
			 Information Relating to Incitement to Acts of Discrimination in Annual Country
			 Reports on Human Right Practices</header>
				<paragraph commented="no" id="HA6488EC0887D45719847006254E0B05E"><enum>(1)</enum><header>Countries
			 receiving economic assistance</header><text display-inline="yes-display-inline">Section 116(d) of the Foreign Assistance
			 Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2151n">22 U.S.C. 2151n(d)</external-xref>) is amended—</text>
					<subparagraph commented="no" id="H8E0990EE94D341F7BA1F7DC5BE28C006"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (10), by striking
			 <quote>and</quote> at the end;</text>
					</subparagraph><subparagraph commented="no" id="HB2EEF4A9232F429C8903B14B6025B723"><enum>(B)</enum><text>in paragraph
			 (11)(C), by striking the period at the end and inserting <quote>; and</quote>;
			 and</text>
					</subparagraph><subparagraph commented="no" id="H7E4463967E914804AEDAA77BDD64B45D"><enum>(C)</enum><text>by adding at the
			 end the following new paragraph:</text>
						<quoted-block display-inline="no-display-inline" id="H5F5A65A17F7F4AD1B9208D02B28F771F" style="traditional">
							<paragraph commented="no" id="H26BB0AFDCD94474EA02DEFCD9F30F38F"><enum>(12)</enum><text display-inline="yes-display-inline">wherever applicable, a description of the
				nature and extent of—</text>
								<subparagraph commented="no" id="HE0602F01DA1F478395CAEE9E950035E"><enum>(A)</enum><text display-inline="yes-display-inline">propaganda in foreign government and
				foreign government-controlled media and other sources, including foreign
				government-produced educational materials and textbooks, that attempt to
				justify or promote racial hatred or incite acts of violence against any race or
				people;</text>
								</subparagraph><subparagraph commented="no" id="HB3A4A8A5230C46F2BD40182690956CB3"><enum>(B)</enum><text>complicity or
				involvement by the foreign government in the creation of such propaganda or
				incitement of acts of violence against any race or people; and</text>
								</subparagraph><subparagraph commented="no" id="HF7BA3397D83649E4910200A393B578BB"><enum>(C)</enum><text>a description of
				the actions, if any, taken by the foreign government to eliminate such
				propaganda or
				incitement.</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph commented="no" id="H585F89AAEC1A43E0B35B48EF2126262B"><enum>(2)</enum><header>Countries
			 receiving security assistance</header><text display-inline="yes-display-inline">Section 502B(b) of the Foreign Assistance
			 Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2304">22 U.S.C. 2304(b)</external-xref>) is amended by inserting after the ninth
			 sentence the following new sentence: <quote>Each report under this section
			 shall also include, wherever applicable, a description of the nature and extent
			 of propaganda in foreign government and foreign government-controlled media and
			 other sources, including foreign government-produced educational materials and
			 textbooks, that attempt to justify or promote racial hatred or incite acts of
			 violence against any race or people, complicity or involvement by the foreign
			 government in the creation of such propaganda or incitement of acts of violence
			 against any race or people, and a description of the actions, if any, taken by
			 the foreign government to eliminate such propaganda or
			 incitement.</quote>.</text>
				</paragraph></subsection><subsection id="HD4DE864113A14D6DA1110286D9CCA93B"><enum>(b)</enum><header>Effective date
			 of amendments</header><text display-inline="yes-display-inline">The amendments
			 made by subsection (a) shall take effect on the date of the enactment of this
			 Act and apply beginning with the first report submitted by the Secretary of
			 State under sections 116(d) and 502B(b) of the Foreign Assistance Act of 1961
			 (<external-xref legal-doc="usc" parsable-cite="usc/22/2151n">22 U.S.C. 2151n(d)</external-xref> and 2304(b)) after such date.</text>
			</subsection></section><section display-inline="no-display-inline" id="H2F4330BB28964B5A893100F3BAF3CB9"><enum>7.</enum><header>Persons excused
			 from payment of fees for execution and issuance of passports</header><text display-inline="no-display-inline">Section 1 of the Act of June 4, 1920 (22
			 U.S.C. 214) is amended—</text>
			<paragraph id="H5ABF51F0D85D4C1C9C5CE6361862EAE5"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>or from a widow</quote>
			 and inserting <quote>from a widow</quote>; and</text>
			</paragraph><paragraph id="HB198B10B777F488E8BC1ED00BACD676B"><enum>(2)</enum><text>by inserting
			 <quote>; or from an individual or individuals abroad, returning to the United
			 States, when the Secretary determines that foregoing the collection of such fee
			 is justified for humanitarian reasons or for law enforcement purposes</quote>
			 after <quote>such member</quote> the second place it appears.</text>
			</paragraph></section><section display-inline="no-display-inline" id="H0D260020546842A6B6D591DEFD4643C0"><enum>8.</enum><header>Authority to
			 administratively amend surcharges</header>
			<subsection id="HF3F4D0DC9FD44A68927CE29562247F28"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Beginning in fiscal
			 year 2007 and thereafter, the Secretary of State is authorized to amend
			 administratively the amounts of the surcharges related to consular services in
			 support of enhanced border security (provided for in the last paragraph under
			 the heading <quote><header-in-text level="paragraph" style="OLC">diplomatic and
			 consular programs</header-in-text></quote> under title IV of division B of the
			 Consolidated Appropriations Act, 2005 (<external-xref legal-doc="public-law" parsable-cite="pl/108/447">Public Law 108–447</external-xref>)) that are in
			 addition to the passport and immigrant visa fees in effect on January 1,
			 2004.</text>
			</subsection><subsection id="HDD8FA22CCC2F495487BF2B2032452CBA"><enum>(b)</enum><header>Requirements</header><text display-inline="yes-display-inline">In carrying out subsection (a) and the
			 provision of law described in such subsection, the Secretary shall meet the
			 following requirements:</text>
				<paragraph id="HACBD19635DB24F9B96286388381C6ED6"><enum>(1)</enum><text display-inline="yes-display-inline">The amounts of the surcharges shall be
			 reasonably related to the costs of providing services in connection with the
			 activity or item for which the surcharges are charged.</text>
				</paragraph><paragraph id="H5DE371F050F5491BB9CBD99C1DCB3B76"><enum>(2)</enum><text>The aggregate
			 amount of surcharges collected may not exceed the aggregate amount obligated
			 and expended for the costs related to consular services in support of enhanced
			 border security incurred in connection with the activity or item for which the
			 surcharges are charged.</text>
				</paragraph><paragraph id="H80F91E29A84E42628EAE65AE28E4B0FD"><enum>(3)</enum><text>A
			 surcharge may not be collected except to the extent the surcharge will be
			 obligated and expended to pay the costs related to consular services in support
			 of enhanced border security incurred in connection with the activity or item
			 for which the surcharge is charged.</text>
				</paragraph><paragraph id="H80A2C0020AEF423BA2BF87BA5CB3EB9"><enum>(4)</enum><text>A
			 surcharge shall be available for obligation and expenditure only to pay the
			 costs related to consular services in support of enhanced border security
			 incurred in providing services in connection with the activity or item for
			 which the surcharge is charged.</text>
				</paragraph></subsection></section><section display-inline="no-display-inline" id="HE5D3AD1602AA410492EC549249B9839D"><enum>9.</enum><header>Extension of
			 privileges and immunities</header>
			<subsection id="HB2DF9E36264E4D5792AAF2E06C1537C1"><enum>(a)</enum><header>The African
			 Union</header><text display-inline="yes-display-inline">Section 12 of the
			 International Organizations Immunities Act (<external-xref legal-doc="usc" parsable-cite="usc/22/288f-2">22 U.S.C. 288f–2</external-xref>) is
			 amended—</text>
				<paragraph id="H5D301D13FA94405591632DE604B1DE11"><enum>(1)</enum><text display-inline="yes-display-inline">in the header, by striking
			 <quote><header-in-text level="section" style="traditional">Organization of
			 African Unity</header-in-text></quote> and inserting <quote><header-in-text level="section" style="traditional">African
			 Union</header-in-text></quote>;</text>
				</paragraph><paragraph id="HC76F2B2A63724AEDB77C1253FFF2E5C2"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting <quote>(a)</quote> before
			 <quote>The provisions</quote>; and</text>
				</paragraph><paragraph id="H6FC62CA2C327477CBA9BDE81A9E3A742"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HB6B2F5842F564A5490772502A0B3944" style="OLC">
						<subsection id="H7E458F33384441E790B5441C6774B35F"><enum>(b)</enum><text>Under such terms
				and conditions as the President shall determine, consistent with the purposes
				of this title, the President is authorized to extend, or enter into an
				agreement to extend, to the African Union Mission to the United States of
				America, and to its members, the privileges and immunities enjoyed by
				diplomatic missions accredited to the United States, and by members of such
				missions, subject to corresponding conditions and
				obligations.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H967764C736C44A158DBBF819274F0191"><enum>(b)</enum><header>Bank for
			 International Settlements</header><text display-inline="yes-display-inline">The
			 International Organizations Immunities Act (<external-xref legal-doc="usc" parsable-cite="usc/22/288">22 U.S.C. 288 et seq.</external-xref>) is amended
			 by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HF1C8D301C6A74788B6002997CF1856F3" style="traditional">
					<section id="H606C8E5B82C74595B65F9057519217B5"><enum>17.</enum><text display-inline="yes-display-inline">The provisions of this title may be
				extended to the Bank for International Settlements in the same manner, to the
				same extent, and subject to the same conditions, as they may be extended to a
				public international organization in which the United States participates
				pursuant to any treaty or under the authority of any Act of Congress
				authorizing such participation or making an appropriation for such
				participation.</text>
					</section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H34684A1858EB4AC592B0BD32DB43D39B"><enum>(c)</enum><header>The Holy
			 See</header><text>Under such terms and conditions as the President shall
			 determine, the President is authorized to extend, or to enter into an agreement
			 to extend, to the Permanent Observer Mission of the Holy See to the United
			 Nations in New York, and to its members, the privileges and immunities enjoyed
			 by the diplomatic missions of member states to the United Nations, and their
			 members, subject to corresponding conditions and obligations.</text>
			</subsection></section><section display-inline="no-display-inline" id="H62F40956FE1546F18FF862340051C6C4" section-type="subsequent-section"><enum>10.</enum><header>Property
			 disposition</header><text display-inline="no-display-inline">Section 633(e) of
			 the Departments of Commerce, Justice, and State, the Judiciary, and Related
			 Agencies Appropriations Act, 2004 (division B of <external-xref legal-doc="public-law" parsable-cite="pl/108/199">Public Law 108–199</external-xref>; 22 U.S.C.
			 2078(e)) is amended—</text>
			<paragraph id="H7A68E83A665747CBA9FD2B5B524E00E0"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>The United States,
			 through the Department of State, shall retain ownership of the Palazzo Corpi
			 building in Istanbul, Turkey, and the</quote> and inserting <quote>The</quote>;
			 and</text>
			</paragraph><paragraph id="HCA411EDAC025473894F229502F4B8E21"><enum>(2)</enum><text display-inline="yes-display-inline">by striking <quote>at such location</quote>
			 and inserting <quote>at an appropriate location</quote>.</text>
			</paragraph></section><section display-inline="no-display-inline" id="HE2238CEC2AC4452E83E7383DC15DFDD3"><enum>11.</enum><header>Services for
			 children with autism at overseas missions</header>
			<subsection id="HEA417041D4BB4EDCA97E00F121790620"><enum>(a)</enum><header>Study</header><text display-inline="yes-display-inline">With respect to countries in which there is
			 at least one mission of the United States, the Secretary of State shall conduct
			 a study of the availability of programs that address the special needs of
			 children with autism, including the availability of speech therapists and
			 pediatric occupational therapists at Department of Defense sponsored schools.
			 Such study shall include the estimated incidence of autism among dependents of
			 members of the Foreign Service and dependents of specialist Foreign Service
			 personnel. Such study shall also include an analysis of the possibility of
			 establishing <quote>Educational Centers of Excellence</quote> for such
			 children.</text>
			</subsection><subsection id="H7F44F7627F3543E296EA80EECC3CAFC2"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 30 days after the completion
			 of the study required under subsection (a), the Secretary shall submit to the
			 Committee on International Relations of the House of Representatives and the
			 Committee on Foreign Relations of the Senate a report containing the findings
			 of the study together with any recommendations for related action.</text>
			</subsection></section><section display-inline="no-display-inline" id="H1B072E79DF5249CFB724FFE03C321ECB"><enum>12.</enum><header>Removal of
			 contracting prohibition</header><text display-inline="no-display-inline">Section 406 of the Omnibus Diplomatic
			 Security and Antiterrorism Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/22/4856">22 U.S.C. 4856</external-xref>) is amended by striking
			 subsection (c).</text>
		</section><section display-inline="no-display-inline" id="HC924EA2C16DF4340B625CA00062858D1"><enum>13.</enum><header>Assistance for
			 maternal and prenatal care for certain individuals of Belarus and Ukraine
			 affected by the Chernobyl disaster</header><text display-inline="no-display-inline">Of the amounts made available for each of
			 the fiscal years 2007 and 2008 to carry out chapters 11 and 12 of part I of the
			 Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2295">22 U.S.C. 2295 et seq.</external-xref> and 2296 et seq.) and
			 the FREEDOM Support Act (<external-xref legal-doc="usc" parsable-cite="usc/22/5801">22 U.S.C. 5801 et seq.</external-xref>), such sums as may be necessary
			 for each such fiscal year are authorized to be available for assistance to
			 improve maternal and prenatal care, especially for the purpose of helping
			 prevent birth defects and pregnancy complications, for individuals in the
			 Republic of Belarus and Ukraine affected by the Chernobyl disaster.</text>
		</section><section display-inline="no-display-inline" id="HBB370985D54C4E74AA071528C815C08E"><enum>14.</enum><header>Foreign Service
			 pay for performance system</header>
			<subsection id="HA8FFF45930B74E2481D9F361586FB944"><enum>(a)</enum><header>Purpose</header><text>The
			 purposes of this section are—</text>
				<paragraph id="HB6C057F49C3A4FA182543E5327DFA169"><enum>(1)</enum><text>to recruit,
			 retain, and reward high-performing Foreign Service members required to be
			 available for worldwide assignment;</text>
				</paragraph><paragraph id="HFDF038BE4A0249EC9042B2F9B13308BA"><enum>(2)</enum><text>to ensure
			 performance management that effectively communicates performance expectations
			 and makes meaningful distinctions based upon relative performance; and</text>
				</paragraph><paragraph id="HAE5FB70E7B764589915EB327AE514C79"><enum>(3)</enum><text>to institute a
			 worldwide pay system, consistent with the requirement that Foreign Service
			 members be available for worldwide assignment.</text>
				</paragraph></subsection><subsection id="H8BB89782A4B64F528F002657B63F5513"><enum>(b)</enum><header>Foreign service
			 schedule</header><text display-inline="yes-display-inline">Section 403 of the
			 Foreign Service Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/22/3963">22 U.S.C. 3963</external-xref>) is amended to read as
			 follows:</text>
				<quoted-block display-inline="no-display-inline" id="H9B30E0689A9B46BFAD7EE386A83D90AD" style="USC">
					<section id="H19D834621C3F4FCA818E8CC3EE4C60F9"><enum>403.</enum><header>Foreign service
				schedule</header>
						<subsection id="H958AAF0325A242E7831C33805D8CF829"><enum>(a)</enum><header>Establishment</header><text>The
				President shall establish, and periodically adjust, a Foreign Service Schedule,
				which shall consist of 9 salary classes that apply to members of the Service
				who are citizens of the United States and for whom salary rates are not
				otherwise provided under this chapter. The maximum salary rate for the highest
				class established under this section, which shall be designated class 1, may
				not exceed the rate of basic pay for level IV of the Executive Schedule under
				<external-xref legal-doc="usc" parsable-cite="usc/5/5315">section 5315</external-xref> of title 5, United States Code.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="HAB129C0A607D46FDB0950094B02F3DD4"><enum>(b)</enum><header>Adjustments</header><text>Any
				adjustment in the basic salary rates for members of the Service made at the
				time of a schedule adjustment under subsection (a) shall be made in accordance
				with section
				406.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H0666136B09114F3BB10687D980BC362F"><enum>(c)</enum><header>Within class
			 salary increases</header><text>Section 406 of the Foreign Service Act of 1980
			 (<external-xref legal-doc="usc" parsable-cite="usc/22/3966">22 U.S.C. 3966</external-xref>) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H0A9169B0695A4C528076B188E0F2C3A" style="USC">
					<section id="HBA44A52B6FE6456AA2FED57F6FE1DC2"><enum>406.</enum><header>Within class
				salary increases</header>
						<subsection id="H94036F08287A4824916400B77D556849"><enum>(a)</enum><header>Determination</header><text>The
				Secretary, in the Secretary’s sole and exclusive discretion, shall determine
				which basic salary rate within a band of rates of pay prescribed by the
				President under section 403(a) shall be paid to members of the Service, taking
				into account individual performance, contribution to the mission of the
				Department, or both, under a rigorous performance management system
				that—</text>
							<paragraph id="HF840ADD07A03485C947146008CE19484"><enum>(1)</enum><text>makes meaningful
				distinctions based upon relative performance; and</text>
							</paragraph><paragraph id="H12C1F5706D504BF98C2638C4A1A81C85"><enum>(2)</enum><text>clearly links
				individual pay and performance under precepts prescribed by the
				Secretary.</text>
							</paragraph></subsection><subsection id="H58DF8F5C1E3A4B148D6832BE005E8341"><enum>(b)</enum><header>Equal basic
				salary adjustments</header><text>Notwithstanding subsection (a), the Secretary,
				in the Secretary’s sole and exclusive discretion, may provide equal basic
				salary adjustments for all career candidates or other members of the
				Service—</text>
							<paragraph id="HCD2DE6F892824D7A9E6C39453BF48452"><enum>(1)</enum><text>whose performance
				has not been reviewed by a selection board under section 602; and</text>
							</paragraph><paragraph id="HFF068170C604403A9625A4F42E2443B8"><enum>(2)</enum><text>who are found to
				meet the standards of performance for their class.</text>
							</paragraph></subsection><subsection id="H1C364BD5A69A4EEB8100A481833740C7"><enum>(c)</enum><header>Performance-based
				salary adjustments</header>
							<paragraph id="HFA6E296FBBE74B1EBEF638C451C908F"><enum>(1)</enum><header>In
				general</header><text>For performance-based pay adjustments, the Secretary in
				the Secretary’s sole and exclusive discretion, shall annually allocate an
				amount equal to or greater than the sum of—</text>
								<subparagraph id="HC7CD9D09FE814717BEF1D7F85624A33D"><enum>(A)</enum><text>an amount that
				would be sufficient to fund increases under section 406(a) of the Foreign
				Service Act as in effect on March 31, 2008; and</text>
								</subparagraph><subparagraph id="H435CAB590C3947B5BAF53C45E60188CE"><enum>(B)</enum><text>the amount
				necessary to provide for pay adjustments based on mission requirements, labor
				market conditions, availability of funds, pay adjustments received by employees
				of other Federal agencies, and any other relevant factors.</text>
								</subparagraph></paragraph><paragraph id="H798DCB09655E47FD9BBB4EC3F7F866EE"><enum>(2)</enum><header>Flexibility</header><text>The
				formula set forth in paragraph (1) shall—</text>
								<subparagraph id="HB022AD9CD36B4EFC9132909DC688F5EA"><enum>(A)</enum><text>ensure that
				employees, in the aggregate, are not disadvantaged in terms of the overall
				amount of pay available as a result of conversion to the new foreign service
				performance-based compensation system; and</text>
								</subparagraph><subparagraph id="HBA703A07184648D5B1FD9C1916FD5E2C"><enum>(B)</enum><text>provide
				flexibility to accommodate changes in the mix of employees performing those
				functions, and other changed circumstances that might impact pay levels.</text>
								</subparagraph></paragraph><paragraph id="HBDD2E451CCBA46A0ADC1E29360241411"><enum>(3)</enum><header>Limitation</header><text>No
				performance-based salary adjustments authorized by this section may be paid to
				any member of the Service if the performance of the member falls below the
				standards of performance for the salary class of the
				member.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H37E775FC6967419B84C47551F4C02588"><enum>(d)</enum><header>Exceptions</header>
				<paragraph id="H64F69AAA33EC45EC9D3E8BD727F5DE4B"><enum>(1)</enum><header>Locality
			 payments for prior service</header><text>A member of the Foreign Service may
			 not receive a locality payment under <external-xref legal-doc="usc" parsable-cite="usc/5/5304">section 5304</external-xref> of title 5, United States
			 Code, for service performed on or after the first day of the first pay period
			 beginning on or after April 1, 2008.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0AC6CE81F709470280DE96095748CA32"><enum>(2)</enum><header>Prior service
			 pay</header><text>Except as provided in section 16(c)(1), a member of the
			 Foreign Service may not receive a nonforeign area allowance or differential
			 under <external-xref legal-doc="usc" parsable-cite="usc/5/5941">section 5941</external-xref> of title 5, United States Code, for service performed on or
			 after the first day of the first pay period beginning on or after April 1,
			 2008.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HB5F84112D4464F6C99D4CE86CD86C84"><enum>(e)</enum><header>Effective
			 date</header><text>This section and the amendments made by this section shall
			 take effect on the first day of the first pay period beginning on or after
			 April 1, 2008.</text>
			</subsection></section><section display-inline="no-display-inline" id="HD18D65EE653240C0006C621E81EA0677"><enum>15.</enum><header>Pay for
			 performance interim schedule</header>
			<subsection id="H460EC6F03F3A460882A89B834E9DDEEA"><enum>(a)</enum><header>Rates of
			 pay</header>
				<paragraph id="H6EE71ECF1CDB4AE39F843404CDF8EF08"><enum>(1)</enum><header>In
			 general</header><text>Except as provided under subsection (b), the Foreign
			 Service Schedule established under section 403 of the Foreign Service Act of
			 1980, in effect on the date of the enactment of this Act, including step
			 rates—</text>
					<subparagraph id="HA27DDCD6E63A45E291306065EE5980F8"><enum>(A)</enum><text>shall be adjusted
			 in accordance with <external-xref legal-doc="usc" parsable-cite="usc/5/5303">section 5303</external-xref> of title 5, United States Code; and</text>
					</subparagraph><subparagraph id="HF749BBB0975F4EDEBFE2573BDC75B2EA"><enum>(B)</enum><text>shall be capped at
			 the maximum rate of basic pay for grade GS–15 of the General Schedule under
			 section 5332 of that title.</text>
					</subparagraph></paragraph><paragraph id="H954731B58BC84FB0B4CC4379D4B363B1"><enum>(2)</enum><header>Locality
			 pay</header><text>A member of the Service whose official duty station is
			 located in an applicable locality pay area shall continue to receive
			 locality-based comparability payments under section 5304 of that title.</text>
				</paragraph></subsection><subsection id="H0794C60C290647B58CA1A69D70654ED9"><enum>(b)</enum><header>Interim Foreign
			 Service Schedule</header>
				<paragraph id="HE80F492B38034797864570D04EA19956"><enum>(1)</enum><header>Establishment</header><text>The
			 Secretary of State shall establish an interim Foreign Service Schedule for
			 members of the Service designated class 1 or below whose official duty station
			 is not located in areas for which such members receive payments pursuant to
			 section <external-xref legal-doc="usc" parsable-cite="usc/5/5304">5304</external-xref> or <external-xref legal-doc="usc" parsable-cite="usc/5/5941">5941</external-xref> of title 5, United States Code.</text>
				</paragraph><paragraph id="H3F335CD3454848BC842C3BDB551B42D"><enum>(2)</enum><header>Increased
			 rates</header><text>The rates under the Foreign Service Schedule established
			 under this subsection shall be 9 percent higher than the rates under the
			 Foreign Service Schedule described in subsection (a) unless a different
			 percentage is prescribed by the President. Each covered member shall receive a
			 corresponding increase in the member’s rate of basic pay. Any adjustment of the
			 rates under the Foreign Service Schedule described in subsection (a) shall
			 result in a corresponding adjustment of rates under the Foreign Service
			 Schedule established under this subsection.</text>
				</paragraph><paragraph id="H074C39574DEC47479D27073F76530031"><enum>(3)</enum><header>Conversion
			 rules</header><text>The Secretary, in the Secretary’s sole and exclusive
			 discretion, shall establish conversion rules for a member who is transferred
			 between the Foreign Service Schedule described in subsection (a) and the
			 Foreign Service Schedule established under this subsection due to a change in
			 official duty station.</text>
				</paragraph></subsection><subsection id="H70D90A9ABF774DB8B65C2E8DD6983B3B"><enum>(c)</enum><header>Step
			 Increases</header><text>A member covered by the Foreign Service Schedule
			 (including the interim Foreign Service Schedule) shall receive within class
			 salary step increases in accordance with section 406 of the Foreign Service Act
			 of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/22/3966">22 U.S.C. 3966</external-xref>), including step increases that become effective on the
			 first day of the first pay period beginning on or after April 1, 2008.</text>
			</subsection><subsection id="HD0CDA8767CEE47DE92D012B77C312B76"><enum>(d)</enum><header>Effective
			 date</header><text>This section shall take effect beginning on the first day of
			 the first pay period beginning on or after April 1, 2007, and ending on the
			 effective date described in section 14(e).</text>
			</subsection></section><section display-inline="no-display-inline" id="HCD64D12A5AFC4D699779DCCD907DE58B"><enum>16.</enum><header>Uniform
			 compensation for worldwide service</header>
			<subsection id="H34148BA09B8E469BB3B400E14B0021F4"><enum>(a)</enum><header>Transitions and
			 pay formulas</header>
				<paragraph id="H2471D0DF602549F888B1C7DCE8C33776"><enum>(1)</enum><header>Transition
			 date</header><text>Subject to paragraphs (2) through (4), a member of the
			 Service designated class 1 or below shall be converted to the new Foreign
			 Service Schedule established under section 403 of the Foreign Service Act of
			 1980, as amended by section 14, on the first day of the first pay period
			 beginning on or after April 1, 2008.</text>
				</paragraph><paragraph id="HA1DAC9A333BC4A15B28966E0B2B3134"><enum>(2)</enum><header>Simultaneous pay
			 actions</header><text>Subject to section 15(c), the Secretary, in the
			 Secretary’s sole and exclusive discretion, shall determine whether and how any
			 applicable simultaneous pay actions will be applied in connection with a
			 conversion, under paragraph (1).</text>
				</paragraph><paragraph id="H98E19F47136E4AE8A70229ABD6006105"><enum>(3)</enum><header>Pay conversion
			 formula</header><text>Any member described in paragraph (1) whose official duty
			 station is not located in an area for which members receive payments pursuant
			 to section <external-xref legal-doc="usc" parsable-cite="usc/5/5304">5304</external-xref> or <external-xref legal-doc="usc" parsable-cite="usc/5/5941">5941</external-xref> of title 5, United States Code, shall receive an
			 increase in the member’s rate of basic pay upon conversion, if necessary, to
			 ensure that the resulting rate equals the sum of—</text>
					<subparagraph id="H2522843B8ED7426A8029EEBE3BB37D87"><enum>(A)</enum><text>the base rate
			 under the Foreign Service Schedule described in subsection (a) for the member’s
			 class and step; and</text>
					</subparagraph><subparagraph id="H265F16B3C1D44672B730774357617829"><enum>(B)</enum><text>the amount
			 resulting from multiplying the rate described in subparagraph (A) by the
			 locality-based comparability percentage in effect for the Washington, D.C.
			 locality pay area at that time.</text>
					</subparagraph></paragraph><paragraph id="H4C9861B9F9F34A728BA2B4C19465D1D7"><enum>(4)</enum><header>Locality-based
			 pay</header><text>Any member described in paragraph (1) whose official duty
			 station is located in an area for which such members receive payments pursuant
			 to section <external-xref legal-doc="usc" parsable-cite="usc/5/5304">5304</external-xref> or <external-xref legal-doc="usc" parsable-cite="usc/5/5941">5941</external-xref> of title 5, United States Code, shall, upon conversion,
			 cease to receive payments authorized under such sections and shall receive
			 instead an increase in the member’s rate of basic pay equivalent to the
			 percentage value of the locality-based comparability payment received by
			 members of the Service designated class 1 or below whose official duty station
			 was Washington, D.C. on the date of conversion.</text>
				</paragraph></subsection><subsection id="HBC424AA24B5B48B795A4E032D2FE00DA"><enum>(b)</enum><header>Adjustments in
			 the rate of basic pay</header>
				<paragraph id="HB4768B82B0024B4CAE1245DB8EA5D06"><enum>(1)</enum><header>In
			 general</header><text>After conversion to the Foreign Service Schedule
			 established under section 403 of the Foreign Service Act of 1980, as amended by
			 section 14, the Secretary, in the Secretary’s sole and exclusive discretion,
			 may provide a special one-time adjustment in the rate of basic pay for career
			 candidates or other members of the Service—</text>
					<subparagraph id="H4DC3837258A7431E9F6800101EBE9100"><enum>(A)</enum><text>whose performance
			 has not been reviewed by a selection board under section 602 of such Act (22
			 U.S.C. 4002); and</text>
					</subparagraph><subparagraph id="HFA7CAF71149E40EFB3DAC6E625F3347B"><enum>(B)</enum><text>who, if not for
			 such conversion, would have been scheduled to receive a step increase after the
			 date of conversion and before September 30, 2008.</text>
					</subparagraph></paragraph><paragraph id="HDB7C1859DF6B48B9B8C50227AD0003C7"><enum>(2)</enum><header>Limitations</header><text>Any
			 such adjustment shall be prorated based on the portion of the waiting period
			 completed as of the day before conversion. No adjustment under this subsection
			 may result in a rate above the maximum rate of the applicable rate
			 range.</text>
				</paragraph></subsection><subsection id="HBC89BEB89B1C4B2E94E51B37F6F1B300"><enum>(c)</enum><header>Special
			 transitional rules</header>
				<paragraph id="H39DC2EF117814DB6BE33D38F3BDC08C9"><enum>(1)</enum><header>Special
			 rules</header><text>The Secretary, in the Secretary’s sole and exclusive
			 discretion, may establish special transitional rules to prevent a reduction in
			 a member’s rate of pay due to a conversion to the Foreign Service Schedule
			 established under section 15(b). Notwithstanding subsection (a)(4), such rules
			 may authorize a member stationed in a nonforeign area to temporarily continue
			 to receive a portion of an allowance or post differential under section 5941 of
			 title 5, United States Code.</text>
				</paragraph><paragraph id="H8713A56F89CD4ECDB6A3085FB7549B00"><enum>(2)</enum><header>Applicability</header><text>This
			 subsection shall apply to a member who, immediately before conversion—</text>
					<subparagraph id="H035CB22ABC124A7C984BA3AECD77B6CB"><enum>(A)</enum><text>is entitled to a
			 locality-based comparability payment under <external-xref legal-doc="usc" parsable-cite="usc/5/5304">section 5304</external-xref> of title 5, United
			 States Code, at a rate exceeding the locality rate applicable in Washington,
			 D.C., at that time; or</text>
					</subparagraph><subparagraph id="H6117EF94EDC34853B648A7AB4E50B9FE"><enum>(B)</enum><text>is entitled to a
			 nonforeign area allowance or differential under section 5941 of such
			 title.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE8EF7C65C44E42A8BEFF43DB0071C393"><enum>(3)</enum><header>Treatment of
			 temporary adjustment</header><text>Any temporary adjustment provided to a
			 member described in paragraph (2)(A) shall be treated as basic pay for the same
			 purposes as the locality-based comparability payment under section 5304 of
			 title 5, United States Code.</text>
				</paragraph></subsection></section><section id="HAEDF092DA63349E3ACB9A394352C5BE7"><enum>17.</enum><header>Technical and
			 conforming amendments</header>
			<subsection id="HC000EC2486C544B3B94000A6991392C5"><enum>(a)</enum><header>Technical and
			 conforming amendments to the Foreign Service Act</header><text>The Foreign
			 Service Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/22/3901">22 U.S.C. 3901 et seq.</external-xref>) is amended—</text>
				<paragraph id="HED9D4373C23B4E6AAA5054FC073CF7F"><enum>(1)</enum><text>in
			 section 402(a)(2) (<external-xref legal-doc="usc" parsable-cite="usc/22/3962">22 U.S.C. 3962(a)(2)</external-xref>)—</text>
					<subparagraph commented="no" id="HF1D6145B16B9422CA124E9DFFD143C7D"><enum>(A)</enum><text>by striking
			 <quote>The Secretary shall</quote> and inserting <quote>The Secretary, in the
			 Secretary’s sole and exclusive discretion, shall</quote>;</text>
					</subparagraph><subparagraph commented="no" id="H916B4036D99442B0B72845A3AD572440"><enum>(B)</enum><text>by striking
			 <quote>the Secretary may</quote> and inserting <quote>The Secretary, in the
			 Secretary’s sole and exclusive discretion, may</quote>; and</text>

			 dates</header><text>The amendments made by subsections (a) and (b)(1) shall
			 take effect on the first day of the first pay period beginning on or after
			 April 1, 2008.</text>
			</subsection></section><section id="HD7C26E96C8C647E3ACDE4251AA67FE3F"><enum>18.</enum><header>Dual gateway
			 policy of the Government of Ireland</header>
			<subsection id="H9C3C85F8FECA4EB3A815C517CEFBC8C4"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary of
			 State shall review the dual gateway policy and determine the effects the
			 discontinuation of such policy might have on the economy of the United States
			 and the economy of western Ireland before the United States takes any action
			 that could lead to the discontinuation of such policy.</text>
			</subsection><subsection id="HC798522E03D2459C965DF84FEA2DA83"><enum>(b)</enum><header>Economic impact
			 study</header><text display-inline="yes-display-inline">In determining the
			 effects that the discontinuation of such policy might have on the economy of
			 the United States, the Secretary, in consultation with the heads of other
			 appropriate departments and agencies, shall consider the effects the
			 discontinuation of such policy might have on United States businesses operating
			 in western Ireland, Irish businesses operating in and around Shannon Airport,
			 and United States air carriers serving Ireland.</text>
			</subsection><subsection id="H30FEBD3D30F74E789500386D87991F78"><enum>(c)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 180 days after the date of
			 the enactment of this Act, the Secretary shall submit to the Committee on
			 International Relations of the House of Representatives and the Committee on
			 Foreign Relations of the Senate a report describing the determinations made
			 under subsection (a), together with any recommendations for United States
			 action.</text>
			</subsection><subsection id="HB8CA6770E9BA4D95B1B23DC3FF39FE2"><enum>(d)</enum><header>Definition</header><text display-inline="yes-display-inline">In this section, the term <quote>dual
			 gateway policy</quote> means the policy of the Government of Ireland requiring
			 certain air carriers serving Dublin Airport to undertake an equal numbers of
			 flights to Shannon Airport and Dublin Airport during each calendar year.</text>
			</subsection></section><section id="H1151CE83FF7842468538B57983FF70C6"><enum>19.</enum><header>Personal
			 services contracting program</header><text display-inline="no-display-inline">Section 504 of the Foreign Relations
			 Authorization Act, Fiscal Year 2003 (<external-xref legal-doc="public-law" parsable-cite="pl/107/228">Public Law 107–228</external-xref>) is amended—</text>
			<paragraph id="HB7C83272FB454F8195F43E74808F7736"><enum>(1)</enum><text display-inline="yes-display-inline">in the section heading, by striking
			 <quote><header-in-text level="section" style="OLC">Pilot</header-in-text></quote>;</text>
			</paragraph><paragraph id="HF71A3D2796284A3299B53F048CFBC02B"><enum>(2)</enum><text>in subsection
			 (a)—</text>
				<subparagraph id="HB4AD6EED2FD040DB80EA254123DCC224"><enum>(A)</enum><text>by striking

			</paragraph></section><section id="HCFC27D2E6A864E3CAFB1E7FF00BB8493"><enum>20.</enum><header>Worldwide
			 availability</header><text display-inline="no-display-inline">Section 301(b) of
			 the Foreign Service Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/22/3491">22 U.S.C. 3491(b)</external-xref>) is amended by adding at the
			 end the following new sentence: <quote>At the time of entry into the Service,
			 each member of the Service must be worldwide available, as determined by the
			 Secretary of State through appropriate medical examinations, unless the
			 Secretary determines that a waiver of the worldwide availability requirement is
			 required to fulfill a compelling Service need. The Secretary shall establish an
			 internal administrative review process for medical ineligibility
			 determinations.</quote>.</text>
