		  eliminate the authorization for the United States to recover or collect from
		  health plans, and for other purposes.</official-title>

		<section id="H22F4D8295C284473B72E6364D1B0AF22" section-type="section-one"><enum>1.</enum><header>Elimination of authority to
			 recover or collect from health plans</header>
			<subsection id="H1E2A8B00BA034B6AAE8CB99C18556367"><enum>(a)</enum><header>Amendments in
			 general</header><text><external-xref legal-doc="usc" parsable-cite="usc/38/1729">Section 1729</external-xref> of title 38, United States Code, is
			 amended—</text>
				<paragraph id="HAE763ED875BF417DAA072CD7005803D2"><enum>(1)</enum><text>in subsection (a),
			 by striking paragraphs (2)(D), (2)(E), and (3);</text>
				</paragraph><paragraph id="HC8027EB6B99C4CA39D81B66D2755E746"><enum>(2)</enum><text>in subsection (c),
			 by striking paragraph (2)(B);</text>
				</paragraph><paragraph id="HA9469B80067847FFBCEC26EAF3F31989"><enum>(3)</enum><text>by striking
			 subsection (h); and</text>
				</paragraph><paragraph id="H6CBE950219254625BD931EEB9F472EB6"><enum>(4)</enum><text>in subsection (i),
			 by striking paragraphs (1) and (3)(D).</text>
				</paragraph></subsection><subsection id="H9F833C7C1A9F469CBB1FA9EE35EB6EE8"><enum>(b)</enum><header>Technical
			 amendments</header>
				<paragraph id="HFB72D218A966480BB7D9FFFC22B5E589"><enum>(1)</enum><text>Section 1729 of
			 title 38, United States Code, is amended—</text>
					<subparagraph id="H534888085B0D48EDA461139D2526E5E5"><enum>(A)</enum><text>in subsection
			 (a)(2)(B), by adding <quote>or</quote> at the end;</text>
					</subparagraph><subparagraph id="H2ED292E376C547C7AF076E7673B4C8C"><enum>(B)</enum><text>in subsection
			 (a)(2)(C), by striking the semicolon at the end and inserting a period;</text>
					</subparagraph><subparagraph id="HEF3F32E892C84DF68D5CCCA9BF0648DB"><enum>(C)</enum><text>in subsection
			 (c)(2), by redesignating subparagraph (C) as subparagraph (B);</text>
					</subparagraph><subparagraph id="HF909788F686F43A097E4007BBCD83F6F"><enum>(D)</enum><text>in subsection
			 (i)(3)(B), by adding <quote>or</quote> at the end;</text>
					</subparagraph><subparagraph id="H22AEBE9E1737453BABF43318343610E9"><enum>(E)</enum><text>in subsection
			 (i)(3)(C) by striking the semicolon at the end and inserting a period;</text>
					</subparagraph><subparagraph id="HD09E4C8F58B346B189C100FDA7F2024"><enum>(F)</enum><text>in subsection (i),
			 by redesignating paragraphs (2) and (3) as paragraphs (1) and (2),
			 respectively; and</text>
					</subparagraph><subparagraph id="H4FFCF2E158A44AE784CBF11B9497BF8"><enum>(G)</enum><text>by redesignating
			 subsection (i) as subsection (g).</text>
					</subparagraph></paragraph><paragraph id="H97A2D7D65E194B6BB3063F9E2751A3D4"><enum>(2)</enum><text>Subsection
			 (d)(4)(B) of <external-xref legal-doc="usc" parsable-cite="usc/38/1781">section 1781</external-xref> of title 38, United States Code, is amended to read
			 as follows:</text>
					<quoted-block display-inline="no-display-inline" id="HE016943130B94A0EBD2DA3FAA315C051" style="OLC">
						<subsection id="H20B21FB34F9248A6B1072B2B1F39C7E8"><enum>(B)</enum><text display-inline="yes-display-inline">The term <term>third party</term>
				means—</text>
							<paragraph id="HA109465ECC0C409AADE658CB900E100"><enum>(i)</enum><text display-inline="yes-display-inline">a State or political subdivision of a
				State;</text>
							</paragraph><paragraph id="H37ED7603ECB0457486E26729E15B48E"><enum>(ii)</enum><text display-inline="yes-display-inline">an employer or an employer's insurance
				carrier;</text>
							</paragraph><paragraph id="H7B6D633CB7DD4C1F8D4D72B588FA5F45"><enum>(iii)</enum><text>an automobile
				accident reparations insurance carrier; or</text>
							</paragraph><paragraph id="H3D980F57A52E4F7FA08FD992A04FB217"><enum>(iv)</enum><text>a person
				obligated to provide, or to pay the expenses of, health services under a
				health-plan
				contract.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HC231C01E71884A3DADE19F096D251BA8"><enum>(3)</enum><text>Subsection (d)(4)
			 of <external-xref legal-doc="usc" parsable-cite="usc/38/1781">section 1781</external-xref> of title 38, United States Code, is amended by adding at the
			 end the following new subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="H6D63AAD754D6470800A173D73F78CD9" style="OLC">
						<subparagraph id="H5883560E3FCE44E5BE653803BDC00167"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="HCF9BF41FA489407DBBB5F18FCAC0076"><enum>(i)</enum><text>For purposes of
				subparagraph (B), the term <term>health-plan contract</term> means an insurance
				policy or contract, medical or hospital service agreement, membership or
				subscription contract, or similar arrangement, under which health services for
				individuals are provided or the expenses of such services are paid.</text>
							</clause><clause id="H0B7E9234324F4B70A243E91EC5E15B96"><enum>(ii)</enum><text display-inline="yes-display-inline">Such term does not include—</text>
								<subclause id="H5394B80F4ED24F52B9BD9C00039DA775"><enum>(I)</enum><text>an insurance
				program described in section 1811 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395c">42 U.S.C. 1395c</external-xref>)
				or established by section 1831 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395j">42 U.S.C. 1395j</external-xref>);</text>
								</subclause><subclause id="H37556F5B44E9452ABFD8D3EB682C31A0"><enum>(II)</enum><text display-inline="yes-display-inline">a State plan for medical assistance
				approved under title XIX of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396 et seq.</external-xref>);</text>
								</subclause><subclause id="H1E05910E70C9498AB9D8E5BE5720093"><enum>(III)</enum><text display-inline="yes-display-inline">a workers' compensation law or plan
				described in subparagraph (A) of subsection (a)(2) of section 1729 of this
				title; or</text>
								</subclause><subclause id="HCB1E111727C24180BBBD3DACFABEE1B"><enum>(IV)</enum><text display-inline="yes-display-inline">a program, plan, or policy under a law
				described in subparagraph (B) or (C) of such subsection.</text>
								</subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="HB72FC4D7B5F74938872D00218817005E"><enum>2.</enum><header>Ability to
			 recover or collect on existing claims</header><text display-inline="no-display-inline">The amendments made by this Act shall not
			 effect the right of the United States to recover or collect reasonable charges
			 for care or services provided before the date of enactment of this Act if such
			 care or services were recoverable or collectable when performed.</text>
