		<section id="H04CD5381E19D4099B5D140FCF37AF2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>9/11 Comprehensive Health Benefits Act
			 of 2006</short-title></quote>.</text>
		</section><section id="H23E64FC6E0EB4F67A9EF4147B6C2B9C0"><enum>2.</enum><header>Medicare-based
			 eligibility and benefits for individuals with a 9/11 disaster-connected health
			 condition</header>
			<subsection id="H5617925402E44B8582681D437B411E88"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Title XVIII of the
			 Social Security Act is amended by inserting after section 1808 the following
			 new section:</text>
				<quoted-block display-inline="no-display-inline" id="H64F7252011FB4EE3AE005271741354FA" style="traditional">
					<section id="H13A0E16EDE67483681AF75AA29876C91"><enum>1809.</enum><header>Benefits for individuals with a 9/11 disaster-connected
		  health condition</header><subsection commented="no" display-inline="yes-display-inline" id="H8761200BBD3A42B3B3B7BD00E1C26E15"><enum>(a)</enum><header>In
				general</header><text>Every 9/11 impacted individual (as defined in subsection
				(b)(1)(A)) who has a 9/11 disaster-connected health condition (as defined in
				subsection (b)(2))—</text>
							<paragraph id="HE65D57496CAC4FBDB5D2C4AC62E298B5"><enum>(1)</enum><text>is entitled to
				9/11-related benefits (as defined in subsection (c)(1)) under this title
				without payment of any premium; and</text>
							</paragraph><paragraph id="HDA48B845DA474975898866BFF687B72E"><enum>(2)</enum><text display-inline="yes-display-inline">if the individual is not otherwise entitled
				to benefits under part A (or enrolled under part B), is eligible to enroll
				under subsection (d) for benefits under parts A, B, and D that are in addition
				to the 9/11-related benefits provided under paragraph (1).</text>
							</paragraph><continuation-text continuation-text-level="subsection">Paragraph
				(1) shall apply regardless of whether or not the individual is otherwise
				entitled to benefits under part A, B, or D. Paragraph (2) shall apply
				regardless of whether the individual is covered under a group health plan or
				otherwise has other health insurance or benefits coverage.</continuation-text></subsection><subsection id="H9708595592BB40AF84665C4216A8B47D"><enum>(b)</enum><header>Eligibility</header>
							<paragraph id="HFB22DF39C15A42D7BC95006615EB88EE"><enum>(1)</enum><header>9/11 impacted
				individual defined</header>
								<subparagraph id="HF113F8356F2B41A98C82F5DA7D78649E"><enum>(A)</enum><header>In
				general</header><text>For purposes of this section, the term <quote>9/11
				impacted individual</quote> means any of the following:</text>
									<clause id="HB6BAD2CAD7B7421B9F65A1FD2FA300A9"><enum>(i)</enum><header>Emergency
				services or rescue and recovery personnel</header><text>Any emergency services
				or rescue and recovery personnel who responded to the 9/11 New York terrorist
				attacks at any time during the period beginning on September 11, 2001, and
				ending on August 31, 2002.</text>
									</clause><clause id="HB409CE7A31144B75A69CF2B11B7FA96"><enum>(ii)</enum><header>Individuals
				exposed to hazardous substances, pollutants, or contaminants</header><text display-inline="yes-display-inline">Any individual exposed in New York City to
				hazardous substances, pollutants, or contaminants released from the collapse of
				the World Trade Center that occurred in the 9/11 New York terrorist attacks or
				from the fires that occurred, or from the handling of resulting debris,
				thereafter.</text>
									</clause><clause commented="no" id="H28CE07BA0C3D4B9F9C37A46105C1A6EF"><enum>(iii)</enum><header>Other
				individuals</header><text>Any other individual whom the Secretary determines to
				be appropriate.</text>
									</clause></subparagraph><subparagraph id="H3264A06A4C7C40A1AB42AF50593DF7CE"><enum>(B)</enum><header>Emergency
				services or rescue and recovery personnel included</header><text>For purposes
				of this paragraph, the term <quote>emergency services personnel or rescue and
				recovery personnel</quote> includes any of the following:</text>
									<clause id="H58413352D7E14C19963F21E5B922B6B"><enum>(i)</enum><text display-inline="yes-display-inline">A Federal, State, or city employee who
				responded to the 9/11 New York terrorist attacks.</text>
									</clause><clause id="HEEC685FFA45340B883235624813EB975"><enum>(ii)</enum><text display-inline="yes-display-inline">An individual who, as a worker or
				volunteer, was involved in clean-up, repair, or infrastructure restoration
				activities related to the 9/11 New York terrorist attacks.</text>
									</clause><clause id="H8E659C632B324D08B1CB59D81998FE28"><enum>(iii)</enum><text display-inline="yes-display-inline">An individual participating in a search and
				rescue team, or who assisted in the recovery of human remains, after the 9/11
				New York terrorist attacks.</text>
									</clause><clause id="H55B25544F0F54948AC5C008B30DAEA68"><enum>(iv)</enum><text display-inline="yes-display-inline">Any other relief or rescue worker who the
				Secretary determines to be appropriate.</text>
									</clause></subparagraph><subparagraph id="H1C601F3C315C45AA89BB2BC55E37B63D"><enum>(C)</enum><header>Presumption of
				exposure to hazardous substances, pollutants, or contaminants</header>
									<clause id="H55BA83455597408AA3E40100F528AF1B"><enum>(i)</enum><header>In
				general</header><text display-inline="yes-display-inline">An individual shall
				be treated as described in subparagraph (A)(ii) if the individual resided,
				owned a business, was employed, or attended school, child care, or adult day
				care in a building that was exposed to hazardous substances, pollutants, or
				contaminants released from the collapse of the World Trade Center that occurred
				during such attacks on or after September 11, 2001 or from the fires that
				occurred, or from the handling of resulting debris, thereafter.</text>
									</clause><clause id="H75C357B73C03433D8B1BD0CAD3A2B"><enum>(ii)</enum><header>Treatment of
				buildings</header><text display-inline="yes-display-inline">For purposes of
				clause (i), any building in Manhattan, Brooklyn, Queens, Staten Island, or
				Northern New Jersey (as delineated by the Secretary) shall be treated as being
				described in such clause if there is evidence that the building was exposed to
				hazardous substances, pollutants, or contaminants released from the collapse of
				the World Trade Center or from the fires that occurred thereafter at any time
				during the period beginning on September 11, 2001, and ending on December 31,
				2001.</text>
									</clause></subparagraph></paragraph><paragraph id="H346E60CE2EC043548B0715E8E5FD9FA4"><enum>(2)</enum><header>9/11
				disaster-connected health condition defined</header><text></text>
								<subparagraph id="H59EA3722354646B58D4061FAF736E593"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">For purposes of this
				section, the term <quote>9/11 disaster-connected health condition</quote> means
				an adverse health condition (including the exacerbation of a pre-existing
				health condition), which also may be an adverse mental health condition, that,
				in the judgment of a qualified medical practitioner (including a therapist in
				the case of an adverse mental health condition), can reasonably be considered
				to be associated with exposure to the 9/11 New York terrorist attacks.</text>
								</subparagraph><subparagraph id="HA69D8607A5124712B104B705314697D8"><enum>(B)</enum><header>9/11 New York
				terrorist attacks defined</header><text>For purposes of this section, the term
				<quote>9/11 New York terrorist attacks</quote> means the terrorist attacks that
				occurred on September 11, 2001, in New York City, New York.</text>
								</subparagraph><subparagraph id="HA7A2300433804CF600186FDBAF6C49DF"><enum>(C)</enum><header>Treatment of
				adverse mental health condition</header><text>For purposes of subparagraph (A),
				an individual shall be considered to have a 9/11 disaster-connected health
				condition if the individual has an adverse emotional or psychological health
				impact that—</text>
									<clause id="HC5408A6F7C534DCB9B5D69F8085B3B00"><enum>(i)</enum><text>has been formally
				diagnosed by a qualified medical practitioner or therapist; and</text>
									</clause><clause id="H69A723B7433B457C8E039EFF4F6543B"><enum>(ii)</enum><text display-inline="yes-display-inline">can be reasonably considered, in the
				judgment of such practitioner or therapist, to be associated with exposure to
				the 9/11 New York terrorist attacks.</text>
									</clause></subparagraph></paragraph><paragraph id="HB1BA3889C9664EED8DEA00B25C3818AA"><enum>(3)</enum><header>Criteria</header><text display-inline="yes-display-inline">Not later than 30 days after the date of
				establishment of the Consortium established under section 3 of the
				<short-title>9/11 Comprehensive Health Benefits Act of
				2006</short-title>, the Secretary, in consultation with such Consortium, shall
				initially develop standardized criteria for medical practitioners to consult
				with for assistance in their determination of whether an individual has a 9/11
				disaster-connected health condition consistent with this subsection. The
				Secretary shall periodically review such criteria and may, from time to time
				and in consultation with the Consortium, modify such criteria as the Secretary
				determines appropriate.</text>
							</paragraph><paragraph id="H6C1B0005AFF94D15879B983B5CA044FF"><enum>(4)</enum><header>Appeals
				process</header><text display-inline="yes-display-inline">The Secretary shall
				specify a process for the appeal of a determination that an individual is not
				eligible for benefits under this section. Such process shall be consistent with
				the process under section 1869 for the appeal of a determination that an
				individual is entitled to benefits under parts A and B.</text>
							</paragraph><paragraph id="H9319B25D44B7410C89B1137C6E668C71"><enum>(5)</enum><header>Treatment of
				nonresidents and undocumented aliens</header><text>Nothing in this section
				shall be construed as making an individual ineligible for benefits under this
				section because the individual is not a resident of New York or the United
				States or because the individual is an alien or is not authorized to reside in
				the United States. Nothing in this paragraph shall be construed to provide for
				any benefits under this title for items and services furnished outside the
				United States, except as may otherwise be authorized under this title.</text>
							</paragraph></subsection><subsection id="HAEDF3D1CD0644FAB9CBD4929A6A828AC"><enum>(c)</enum><header>9/11-related
				benefits defined</header>
							<paragraph id="HF62088A993E1482982EB61BD64A8A1E6"><enum>(1)</enum><header>In
				general</header><text>For purposes of this section, the term
				<quote>9/11-related benefits</quote> means benefits under parts A, B, and D for
				the treatment of any 9/11 disaster-related health condition, subject to the
				following modifications with respect to such treatment:</text>
								<subparagraph id="HC6C1DF3FF9B54577919544322BB4D66F"><enum>(A)</enum><header>No
				cost-sharing</header><text display-inline="yes-display-inline">No deductibles,
				coinsurance, copayments, or other cost-sharing shall be applicable.</text>
								</subparagraph><subparagraph id="H128DD9C4CA334006A6E8361BAC86A789"><enum>(B)</enum><header>Elimination of
				day or dollar limitations</header><text>Any day or dollar limitations on
				coverage with respect to such treatment, including such limitations under
				sections 1812, 1833(g), and 1860D–2(b)(3), shall not be applicable.</text>
								</subparagraph></paragraph><paragraph id="H319FF9AFB5D04BFDB3F9AD8F4CC628D0"><enum>(2)</enum><header>Entitlement
				without premiums</header><text>An individual entitled to 9/11-related benefits
				under this section is deemed to be entitled to benefits under parts A, B, and D
				with respect to such 9/11-related benefits without requirement for payment for
				any premium. The entitlement to such benefits shall begin on the date that the
				individual is determined to be eligible for such benefits, but in no case
				before the date of the enactment of this section.</text>
							</paragraph><paragraph id="HDFC765B035E345AABF2429E912FB8AF"><enum>(3)</enum><header>Relation to part
				C</header><text display-inline="yes-display-inline">Except in the case of an
				individual enrolled under part A or B under subsection (d) or otherwise,
				9/11-related benefits are not available through enrollment in a Medicare
				Advantage plan under part C.</text>
							</paragraph></subsection><subsection id="H1344BAFDB94249D9A0ECB8F2BE322399"><enum>(d)</enum><header>Enrollment
				option for additional medicare benefits</header>
							<paragraph id="H3E5697C293014F959317037450FA2997"><enum>(1)</enum><header>In
				general</header><text>With respect to the enrollment option described in
				subsection (a)(2), an eligible individual may enroll under part A or B (or
				both), and under part D, in a manner and form prescribed in regulations. Such
				regulations shall provide for continuous open enrollment for such
				individuals.</text>
							</paragraph><paragraph id="H7933D0A0B757446587758E252848F002"><enum>(2)</enum><header>Premiums</header>
								<subparagraph id="H7CF5A6129A9142C49605C1AA00004600"><enum>(A)</enum><header>In
				general</header><text>Except as provided in this paragraph, the premium for
				enrollment under part A under this subsection shall be the same as the premium
				established under subsection (d) of section 1818 for enrollment under such
				section, subject to any reduction provided under such subsection.</text>
								</subparagraph><subparagraph id="H754F9DB8F11D439D9B4964FED4F37974"><enum>(B)</enum><header>Elimination of
				premium based on quarters of coverage</header><text display-inline="yes-display-inline">No premium shall be imposed under
				subparagraph (A) in the case of an individual if the individual would be
				entitled, based solely on the number of quarters of coverage under title II, to
				benefits under part A under section 226(a), 226(b), or 226A.</text>
								</subparagraph><subparagraph id="H45E8F3EA8FBD4E90009309DFE9FED31"><enum>(C)</enum><header>No late
				enrollment penalty</header><text display-inline="yes-display-inline">An
				individual enrolling under part A, B, or D under this subsection shall not be
				subject to any late enrollment penalty, including under sections 1839(b) and
				1860D–13(b).</text>
								</subparagraph></paragraph><paragraph id="H5D1D1D276F5B42E8B292D66BB2A04BF"><enum>(3)</enum><header>Enrollment under
				parts b and d</header><text>For purposes of parts B and D, in the case of an
				individual eligible to enroll under this subsection, the individual’s initial
				enrollment period under such parts shall be treated as beginning on the date of
				such eligibility and having no end date.</text>
							</paragraph><paragraph id="HF8C5E380F85044888C3CA993D68B2101"><enum>(4)</enum><header>Coverage</header>
								<subparagraph id="HF152918DF15B4C8BBAB9E430D88FECF5"><enum>(A)</enum><header>In
				general</header><text>The period (in this subsection referred to as a
				<quote>coverage period</quote>) during which an individual enrolled under this
				subsection is entitled to benefits under the respective part shall begin on the
				first day of the first month that begins at least 15 days after the date of the
				individual’s enrollment under such part.</text>
								</subparagraph><subparagraph id="HE91D2D435FEF4864B8BA7C26A02C7C6F"><enum>(B)</enum><header>Termination</header><text display-inline="yes-display-inline">An individual's coverage period under this
				subsection under a part shall continue until the individual's enrollment under
				such part is terminated as follows:</text>
									<clause id="H1D78E8EDB42A475E9839C284335CE3F5"><enum>(i)</enum><text>As
				of the month following the month in which the individual files notice that the
				individual no longer wishes to be enrolled in the part under this
				subsection.</text>
									</clause><clause id="HB32D349853654BFB8EEF61FAE4232822"><enum>(ii)</enum><text>For nonpayment of
				any applicable premiums under such part.</text>
									</clause><clause id="H27103C4F877747CCB0FEB4CADBD91968"><enum>(iii)</enum><text>With respect to
				coverage under part D, as of the month in which the individual is neither
				enrolled in part A nor enrolled in part B.</text>
									</clause><continuation-text continuation-text-level="subparagraph">The
				termination of a coverage period under clause (ii) shall take effect on a date
				determined under regulations, which may be determined so as to provide a grace
				period in which overdue premiums may be paid and coverage continued. The grace
				period determined under the preceding sentence shall not exceed 90 days; except
				that it may be extended to not to exceed 180 days in any case where the
				Secretary determines that there was good cause for failure to pay the overdue
				premiums within such 90-day period.</continuation-text></subparagraph></paragraph></subsection><subsection id="H3519ED0DA9E645F0AFD4FF3838FB658"><enum>(e)</enum><header>Payment-related
				provisions</header>
							<paragraph id="H97C6B5957E01497CBC3517301B661920"><enum>(1)</enum><header>Authorization of
				appropriations to cover additional benefits</header><text>There are authorized
				to be appropriated to the Federal Hospital Insurance Trust Fund and the Federal
				Supplementary Medical Insurance Trust Fund, and the Medicare Prescription Drug
				Account in such Trust Fund, such sums as may be necessary to cover the costs
				under such Trust Funds and Account of providing benefits under this section,
				net of any premiums paid with respect to such benefits under subsection (d).
				Nothing in this section shall be construed as conditioning the provision of
				benefits under this section upon the making of such appropriations.</text>
							</paragraph><paragraph id="H3FA80459CD74482A8856FF73D5998E62"><enum>(2)</enum><header>Reimbursement of
				prescription drug plans and MA plans for 9/11-related
				benefits</header><text>With respect to benefits under a prescription drug plan
				under part D or under a Medicare Advantage plan under part C, the Secretary
				shall provide for reimbursement to the plan from the appropriate Trust Funds
				and Accounts under this title for the cost of 9/11-related benefits provided
				under the plan under this section, including costs related to the application
				of the benefit modifications described in subsection
				(c)(1).</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H5BAE06DF8BE049FB86785C0040FB139C"><enum>(b)</enum><header>Medicare
			 secondary payor for 9/11-related coverage; no discrimination against
			 individuals in employment-based health insurance</header><text>Section 1862(b)
			 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395y">42 U.S.C. 1395y(b)</external-xref>) is amended—</text>
				<paragraph id="H22DF7256168542ACB1C85B12E95EF914"><enum>(1)</enum><text>by redesignating
			 subparagraph (D) of paragraph (1) as subparagraph (G) and by moving it to the
			 end of such paragraph;</text>
				</paragraph><paragraph id="H0BB1A1F2EE59459B9673571E46DB6C49"><enum>(2)</enum><text>by inserting after
			 subparagraph (C) of paragraph (1) the following new subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="HCD10FF536C694098A9910024431FB61D" style="OLC">
						<subparagraph id="HDC37226514FE438E85E52CEEC30092C5"><enum>(D)</enum><header>Individuals with
				a 9/11-disaster connected health condition</header>
							<clause id="H24A5628444444CB0BF0537B4B4051482"><enum>(i)</enum><header>In
				general</header><text display-inline="yes-display-inline">A group health plan,
				individual health insurance coverage, or any other form of health benefits
				coverage—</text>
								<subclause id="HF11F0E66ADD04756846956775DAA53C9"><enum>(I)</enum><text>may not take into
				account that an individual who is covered under the plan or coverage is
				entitled to 9/11-related benefits under this title under section 1809;
				and</text>
								</subclause><subclause id="H4F099CC7786546B100CFE61131FBFD67"><enum>(II)</enum><text display-inline="yes-display-inline">shall provide that any covered individual
				shall be entitled to the same benefits under the plan with respect to treatment
				of a 9/11 disaster-related health condition (as defined in section
				1809(b)(2)(A)) under the same conditions as any similarly situated individual
				who is not so entitled.</text>
								</subclause></clause><clause id="HB68155F63B054785B221005B83333F70"><enum>(ii)</enum><header>Enforcement</header>
								<subclause id="H231D494E17384C4F8B5330C4D00BE29"><enum>(I)</enum><header>Civil money
				penalties</header><text display-inline="yes-display-inline">Any plan or
				coverage that violates clause (i) is subject to a civil money penalty of not to
				exceed $25,000 for each such violation. The provisions of section 1128A (other
				than subsections (a) and (b)) shall apply to a civil money penalty under the
				previous sentence in the same manner as such provisions apply to a penalty or
				proceeding under section 1128A(a).</text>
								</subclause><subclause id="H0893E4299614466EB203E59B3BBFF996"><enum>(II)</enum><header>Private cause
				of action</header><text display-inline="yes-display-inline">An individual
				adversely affected by a violation of clause (i) may bring a private cause of
				action to enjoin the violation and to obtain damages (which shall be in an
				amount double the amount otherwise provided and may include reasonable
				attorney’s fees) resulting from such a
				violation.</text>
								</subclause></clause></subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H5523B3325B8B4719BFF64C74B35F58D5"><enum>(3)</enum><text>in the second
			 sentence of paragraph (2)(A), by inserting after <quote>large group health
			 plan</quote> the following: <quote>or other coverage described in paragraph
			 (1)(D)(i)</quote>;</text>
				</paragraph><paragraph id="H9FD03CE1D6D340E3B8F48BB23B58C1F4"><enum>(4)</enum><text>in paragraph
			 (2)(B)(vi), by inserting <quote>or other coverage described in paragraph
			 (1)(D)(i)</quote> after <quote>employer group health plan</quote>; and</text>
				</paragraph><paragraph id="H503CEF5F65164B2C9F2555EBD4D02821"><enum>(5)</enum><text>in paragraph
			 (3)(C)—</text>
					<subparagraph id="H56D2598B47E34FA7B82B942E26C6ED5"><enum>(A)</enum><text>in the heading by
			 inserting <quote><header-in-text level="subparagraph" style="OLC">or other
			 coverage</header-in-text></quote> after <quote><header-in-text level="subparagraph" style="OLC">large group health
			 plan</header-in-text></quote>; and</text>
					</subparagraph><subparagraph id="H9967809393FD4E1F931B00E4BA2DC862"><enum>(B)</enum><text>by inserting
			 <quote>or other coverage described in paragraph (1)(D)(i)</quote> after
			 <quote>large group health plan</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="HC8DC383938904E519EA81EF525E61258"><enum>(c)</enum><header>Prohibition of
			 discrimination in workers’ compensation and employment</header>
				<paragraph id="HA4A86D4C43274911ADCD54572FA8228B"><enum>(1)</enum><header>Workers’
			 compensation</header>
					<subparagraph id="H2D269B654C9E4E5D90D742D20048006E"><enum>(A)</enum><header>Discrimination
			 prohibited</header><text>A workers’ compensation law or plan may not
			 discriminate against an individual by virtue of the individual’s entitlement to
			 benefits under title XVIII of the Social Security Act under section 1809 of
			 such Act, as inserted by subsection (a).</text>
					</subparagraph><subparagraph display-inline="no-display-inline" id="H22BBE093AFD641D6A9C703FC2D444988"><enum>(B)</enum><header>Private cause of
			 action</header><text display-inline="yes-display-inline">An individual
			 adversely affected by a violation of subparagraph (A) may bring a private cause
			 of action to enjoin the violation and to obtain damages (which shall be in an
			 amount double the amount such individual was otherwise entitled to under such
			 law or plan and may include reasonable attorney’s fees) resulting from such a
			 violation.</text>
					</subparagraph></paragraph><paragraph id="H47B6CA8B0C4446FAA5FEB52D89B6B8E2"><enum>(2)</enum><header>Employment</header>
					<subparagraph id="H33BECF8C72804151A2B919D0BB6F89C5"><enum>(A)</enum><header>Discrimination
			 prohibited</header><text>An employer may not discriminate against an individual
			 in regards to hiring, advancement, compensation, or other terms, conditions,
			 and privileges of employment by virtue of the individual’s entitlement to
			 benefits under title XVIII of the Social Security Act under section 1809 of
			 such Act, as inserted by subsection (a).</text>
					</subparagraph><subparagraph id="H76A37D0C220F48B190A5C2AF62784420"><enum>(B)</enum><header>Enforcement</header><text display-inline="yes-display-inline">The powers, remedies, and procedures
			 provided in sections 705, 706, 707, 709, 710, and 711 of the Civil Rights Act
			 of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e-4">42 U.S.C. 2000e–4 et seq.</external-xref>) to the Equal Employment Opportunity
			 Commission, the Attorney General, or any person, alleging a violation of title
			 VII of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e">42 U.S.C. 2000e et seq.</external-xref>) shall be the powers, remedies, and
			 procedures this subsection provides to the Equal Employment Opportunity
			 Commission, the Attorney General, or any person, respectively, alleging
			 discrimination in violation of subparagraph (A), except that any employer found
			 by a court to have intentionally engaged in discrimination in violation of
			 subparagraph (A) shall be additionally subject to a civil penalty of not to
			 exceed $25,000 for each such violation.</text>
					</subparagraph><subparagraph id="HFFA8DFD086254790822208E2D4E18E57"><enum>(C)</enum><header>Employer
			 defined</header><text>As used in this paragraph, the term
			 <quote>employer</quote> has the same meaning given that term in section 101(5)
			 of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12112">42 U.S.C. 12112(5)</external-xref>).</text>
					</subparagraph></paragraph></subsection><subsection id="HCF47BC48DA644EB4B033FB118422C768"><enum>(d)</enum><header>Conforming
			 amendments</header>
				<paragraph id="H26BE307C562E4C4693FDE0A1415B64EC"><enum>(1)</enum><header>Application of
			 enrollment correction provisions</header><text>Section 1837(h) of the Social
			 Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395p">42 U.S.C. 1395p(h)</external-xref>) is amended by inserting <quote>or section
			 1809(d)</quote> after <quote>1818</quote>.</text>
				</paragraph><paragraph id="HAE5CE7CE4DB74A4296C3C18FA574B13"><enum>(2)</enum><header>Conforming
			 reference</header><text>The second sentence of section 1818(a) of such Act (42
			 U.S.C. 1395i–2(a)) is amended by inserting <quote>or 1809(d)</quote> after
			 <quote>1818A</quote> .</text>
				</paragraph><paragraph id="HEFC49A887EF948CDA16C1E562F299CE2"><enum>(3)</enum><header>Application of
			 QMB provisions</header><text>Section 1905(p)(1)(A) of such Act (42 U.S.C.
			 1396d(p)(1)(A)) is amended by inserting <quote>or 1809(d)</quote> after
			 <quote>1818</quote>.</text>
				</paragraph></subsection></section><section id="HC2C3B9E138D54FF69E7F1BC469B5F341"><enum>3.</enum><header>Consortium to
			 conduct screening, monitoring, treatment, and research regarding 9/11
			 disaster-connected health conditions</header>
			<subsection id="H3EB3C343A70241CBB5BC52E7D1A30004"><enum>(a)</enum><header>Establishment of
			 Consortium</header>
				<paragraph id="H336A896C46DD4F199300B12F4FC21176"><enum>(1)</enum><header>In
			 general</header><text>Not later than 90 days after the date of the enactment of
			 this Act, the Secretary of Health and Human Services, in consultation with the
			 Director of the Centers for Disease Control and Prevention and the Director of
			 the National Institutes of Health, shall establish a consortium (in this
			 section referred to as the <quote>Consortium</quote>).</text>
				</paragraph><paragraph id="HA78391D4E0F94B7FAFF8F81D0987A846"><enum>(2)</enum><header>Composition</header>
					<subparagraph id="H9C73000533CA41458C177852297F46BD"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Consortium shall
			 consist of institutions, programs, and practitioners that have provided, or are
			 qualified to provide, screening, clinical examinations, or long-term health
			 monitoring and analysis and treatment regarding 9/11 disaster-connected health
			 conditions. The Consortium shall also include community-based organizations
			 with expertise in providing outreach to hard-to-reach affected
			 communities.</text>
					</subparagraph><subparagraph id="H3EC8CDA0C2074FDEA80081E2255EB3E8"><enum>(B)</enum><header>Director</header><text display-inline="yes-display-inline">The Consortium shall have a director,
			 appointed by the Secretary, who shall be a Federal official responsible for the
			 administration of the Consortium, including its governance and management. The
			 director also shall be the primary Federal official responsible for general
			 health issues relating to the 9/11 New York terrorist attacks.</text>
					</subparagraph><subparagraph id="H711EC641650149508735D429C8B593F3"><enum>(C)</enum><header>Public
			 participation in governance</header><text display-inline="yes-display-inline">The Secretary shall provide for public
			 participation, including representatives of affected communities or members of
			 affected populations, in the governance of the Consortium.</text>
					</subparagraph></paragraph><paragraph id="HD5E38E85B0FE4563BB686002005CDC3B"><enum>(3)</enum><header>Duties</header>
					<subparagraph id="H22A2B54AAA8449979E416ECB1822D00"><enum>(A)</enum><header>In
			 general</header><text>The Consortium shall conduct and coordinate screening,
			 monitoring, treatment, and diagnostic research on the 9/11 disaster-connected
			 health conditions.</text>
					</subparagraph><subparagraph id="H2C390F9FC59C49CBA933D774F04BE900"><enum>(B)</enum><header>Specific
			 duties</header><text>Specifically, the Consortium shall—</text>
						<clause id="HE1928E689FE84ED49097A9F04F1074F8"><enum>(i)</enum><text display-inline="yes-display-inline">conduct outreach to hard-to-reach affected
			 communities;</text>
						</clause><clause id="H5FD41C5FA8D54CCB9401201DE3E02EE7"><enum>(ii)</enum><text display-inline="yes-display-inline">develop diagnostic criteria for the
			 purposes of identifying latent and late-onset 9/11 disaster-connected health
			 conditions;</text>
						</clause><clause id="HE47100A5426D4475AE212161001000D"><enum>(iii)</enum><text display-inline="yes-display-inline">develop treatments for 9/11
			 disaster-connected health conditions; and</text>
						</clause><clause id="HBA69189EED624215B004928CB987AB59"><enum>(iv)</enum><text display-inline="yes-display-inline">track the adverse health and mental health
			 conditions on historically underserved populations, including children, the
			 elderly, and minority populations.</text>
						</clause></subparagraph></paragraph><paragraph id="H78911B19C08D4015955DD71C585C4CAB"><enum>(4)</enum><header>Clinical
			 facility</header><text>The Consortium shall have a clinical facility located in
			 Lower Manhattan, New York City.</text>
				</paragraph></subsection><subsection id="HDC7D51759C174D4E9249D5CDBBB4D8F1"><enum>(b)</enum><header>Annual report by
			 NIH</header><text>The Director of the National Institutes of Health shall
			 submit to Congress an annual report describing the findings of research
			 conducted under this section.</text>
			</subsection><subsection id="HE05E2E89255A41B588781EC610434F48"><enum>(c)</enum><header>Authorization of
			 appropriations</header><text>There are authorized to be appropriated such sums
			 as may be required to carry out this section.</text>
			</subsection><subsection id="H19E975B52CA7454E9FE7BCC63EEAAACD"><enum>(d)</enum><header>9/11
			 disaster-connected health condition</header><text display-inline="yes-display-inline">The term <quote>9/11 disaster-connected
			 health condition</quote> has the meaning given such term in section
			 1809(b)(2)(A) of the Social Security Act, as inserted by the amendment made by
			 section 2(a).</text>
