		<section id="H76E3245473C84A36BF2686DCA3C1851E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>September 11 Survivors Student Loan
			 Relief Act</short-title></quote>.</text>
		</section><section display-inline="no-display-inline" id="HAD92C10CC45840C3A604056066F589BC" section-type="subsequent-section"><enum>2.</enum><header>Cancellation of
			 student loan indebtedness for survivors of victims of the September 11, 2001,
			 attacks</header>
			<subsection id="H1A0D4EE9BE724AFEA7E67BA27C0BFE"><enum>(a)</enum><header>Definitions</header><text>For
			 purposes of this section:</text>
				<paragraph id="HBA997D91381E4BBB9EF082E43ED047CD"><enum>(1)</enum><header>Eligible public
			 servant</header><text>The term <term>eligible public servant</term> means an
			 individual who, as determined in accordance with regulations of the
			 Secretary—</text>
					<subparagraph id="HB3FC62F2C91E4492A900784177D354C7"><enum>(A)</enum><text>served as a police
			 officer, firefighter, other safety or rescue personnel, or as a member of the
			 Armed Forces; and</text>
					</subparagraph><subparagraph id="H89F14C113EDD41A086E588403633411B"><enum>(B)</enum><text>died (or dies) or
			 became (or becomes) permanently and totally disabled due to injuries suffered
			 in the terrorist attack on September 11, 2001.</text>
					</subparagraph></paragraph><paragraph id="H6B4299427E004B279CD7003C85EFAF2F"><enum>(2)</enum><header>Eligible
			 victim</header><text>The term <term>eligible victim</term> means an individual
			 who, as determined in accordance with regulations of the Secretary, died (or
			 dies) or became (or becomes) permanently and totally disabled due to injuries
			 suffered in the terrorist attack on September 11, 2001.</text>
				</paragraph><paragraph id="H2B3D0A888DBE4299AE1BEFE1690089DA"><enum>(3)</enum><header>Eligible
			 parent</header><text>The term <term>eligible parent</term> means the parent of
			 an eligible victim if—</text>
					<subparagraph id="H8FC2AF79F4B644FBB2DB032F3279FF92"><enum>(A)</enum><text>the parent owes a
			 Federal student loan that is a consolidation loan that was used to repay a PLUS
			 loan incurred on behalf of such eligible victim; or</text>
					</subparagraph><subparagraph id="H7A9DDD10199644E4008413184C284D5E"><enum>(B)</enum><text>the parent owes a
			 Federal student loan that is a PLUS loan incurred on behalf of an eligible
			 victim.</text>
					</subparagraph></paragraph><paragraph id="H7D962A1CADC54B9FB7282FD189EFAC08"><enum>(4)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Education.</text>
				</paragraph><paragraph id="H1911EF94C07644718BBDC6B0EB04487"><enum>(5)</enum><header>Federal student
			 loan</header><text>The term <term>Federal student loan</term> means any loan
			 made, insured, or guaranteed under part B, D, or E of title IV of the
			 <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name>.</text>
				</paragraph></subsection><subsection id="H586D0DBEF64A47F6B4E49789746C0022"><enum>(b)</enum><header>Relief From
			 Indebtedness</header>
				<paragraph id="H46B3EE5169DE4C09876E7CE600089997"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall provide for the discharge or
			 cancellation of—</text>
					<subparagraph id="HE6044F5573EE47C6856C254E834CB3D1"><enum>(A)</enum><text>the Federal
			 student loan indebtedness of the spouse of an eligible public servant, as
			 determined in accordance with regulations of the Secretary, including any
			 consolidation loan that was used jointly by the eligible public servant and his
			 or her spouse to repay the Federal student loans of the spouse and the eligible
			 public servant;</text>
					</subparagraph><subparagraph id="H9477DCF2140845E2BB67A87937AF8C78"><enum>(B)</enum><text>the portion
			 incurred on behalf of the eligible victim (other than an eligible public
			 servant), of a Federal student loan that is a consolidation loan that was used
			 jointly by the eligible victim and his or her spouse, as determined in
			 accordance with regulations of the Secretary, to repay the Federal student
			 loans of the eligible victim and his or her spouse;</text>
					</subparagraph><subparagraph id="HBED4E90C85C5449895C42E75D40806DE"><enum>(C)</enum><text>the portion of the
			 consolidation loan indebtedness of an eligible parent that was incurred on
			 behalf of an eligible victim; and</text>
					</subparagraph><subparagraph id="H77CE825CB4414089A0006B720046D1EB"><enum>(D)</enum><text>the PLUS loan
			 indebtedness of an eligible parent that was incurred on behalf of an eligible
			 victim.</text>
					</subparagraph></paragraph><paragraph id="H06E0000D28F94A6ABB22D56D71E8B5BB"><enum>(2)</enum><header>Method of
			 discharge or cancellation</header><text>A loan required to be discharged or
			 canceled under paragraph (1) shall be discharged or canceled by the method used
			 under section 437(a), 455(a)(1), or 464(c)(1)(F) of the
			 <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (20
			 U.S.C. 1087(a), 1087e(a)(1), 1087dd(c)(1)(F)), whichever is applicable to such
			 loan.</text>
				</paragraph></subsection><subsection id="HED004D5B965A4862A2D2C276C52B8067"><enum>(c)</enum><header>Facilitation of
			 Claims</header><text>The Secretary shall—</text>
				<paragraph id="H90510C099CE945909D24C85B72065D52"><enum>(1)</enum><text>establish
			 procedures for the filing of applications for discharge or cancellation under
			 this section by regulations that shall be prescribed and published within 90
			 days after the date of enactment of this Act and without regard to the
			 requirements of <external-xref legal-doc="usc" parsable-cite="usc/5/553">section 553</external-xref> of title 5, United States Code; and</text>
				</paragraph><paragraph id="H3494860F7FC744AFB8FC4000DCFE56C3"><enum>(2)</enum><text>take such actions
			 as may be necessary to publicize the availability of discharge or cancellation
			 of Federal student loan indebtedness under this section.</text>
				</paragraph></subsection><subsection id="H84C4EF20AE894A37B9FAB399C2CA729"><enum>(d)</enum><header>Availability of
			 Funds for Payments</header><text>Funds available for the purposes of making
			 payments to lenders in accordance with section 437(a) for the discharge of
			 indebtedness of deceased or disabled individuals shall be available for making
			 payments under section 437(a) to lenders of loans as required by this
			 section.</text>
			</subsection><subsection id="H6953E5CB70F84696922E2F3240BC49AB"><enum>(e)</enum><header>Applicable to
			 Outstanding Debt</header><text>The provisions of this section shall be applied
			 to discharge or cancel only Federal student loans (including consolidation
			 loans) on which amounts were owed on September 11, 2001. Nothing in this
			 section shall be construed to authorize any refunding of any repayment of a
			 loan.</text>
