		  respect to market exclusivity for certain drugs, and for other

		<section display-inline="no-display-inline" id="HA83F9186F36C4AB39D528182E630F65E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Lower
			 Prices Reduced with Increased Competition and Efficient Development of Drugs
			 Act</quote> or the <quote><short-title>Lower PRICED Drugs
			 Act</short-title></quote>.</text>
		</section><section id="H82C622A136A1447AAD5B094386A5D24"><enum>2.</enum><header>Generic drug use
			 certification</header>
			<subsection id="H310973135A3242A4B1F97407006DE23C"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 505(j)(2)(A)
			 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/355">21 U.S.C. 355(j)(2)(A)</external-xref>) is
			 amended—</text>
				<paragraph id="H392CE800A6E3422592A0613B65B96413"><enum>(1)</enum><text>in clause (vii),
			 by striking <quote>; and</quote> and inserting a semicolon;</text>
				</paragraph><paragraph id="HE620D5DD51A344259E2F00A2997C1EB4"><enum>(2)</enum><text>in clause (viii),
			 by striking the period and inserting <quote>; and</quote>;</text>
				</paragraph><paragraph id="H879D00FEDFFD4218958160A49EB9EEC5"><enum>(3)</enum><text>by inserting after
			 clause (viii) the following:</text>
					<quoted-block display-inline="no-display-inline" id="HF3B19CC6CC12499D991F4C9900E201FF" style="OLC">
						<clause id="H2F84038094D84D9780F77FFBAD12E1B0" indent="up2"><enum>(ix)</enum><text>if with respect to a listed drug
				product referred to in clause (i) that contains an antibiotic drug and the
				antibiotic drug was the subject of any application for marketing received by
				the Secretary under section 507 (as in effect before the date of the enactment
				of the Food and Drug Administration Modernization Act of 1997) before November
				20, 1997, the approved labeling includes a method of use which, in the opinion
				of the applicant, is claimed by any patent, a statement that—</text>
							<subclause id="H1BD1CFB8D00943CFB257E85E004CC3BB"><enum>(I)</enum><text>identifies the relevant patent and
				the approved use covered by the patent; and</text>
							</subclause><subclause id="H78A1E04F991F42299434C870DFBA675"><enum>(II)</enum><text>the applicant is not seeking
				approval of such use under this
				subsection.</text>
							</subclause></clause><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H47E7E4106CEC4EC8AB2FC13922F7395F"><enum>(4)</enum><text>in the last
			 sentence, by striking <quote>clauses (i) through (viii)</quote> and inserting
			 <quote>clauses (i) through (ix)</quote>.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H45CD66127A034118A30725E7A97BA900"><enum>(b)</enum><header>Effective
			 date</header><text>The amendments made by this section apply to any abbreviated
			 new drug application under section 505(j) of the Federal Food, Drug, and
			 Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/355">21 U.S.C. 355(j)</external-xref>) that is submitted on, before, or after the date
			 of the enactment of this Act.</text>
			</subsection></section><section id="H865179CFDA4A4D218BD5BC3C8494B3E7"><enum>3.</enum><header>Preventing abuse
			 of the thirty-month stay-of-effectiveness period</header>
			<subsection id="HDF159F08B1D8458194D92F7D33F1ADE3"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section
			 505(j)(5)(B)(iii) of the Federal Food, Drug, and Cosmetic Act (21 U.S.C.
			 355(j)(5)(B)(iii)) is amended—</text>
				<paragraph id="H0481892490CE4D409093CF4E67FADAD"><enum>(1)</enum><text display-inline="yes-display-inline">in the second sentence by striking
			 <quote>may order</quote> and inserting <quote>shall order</quote>; and</text>
				</paragraph><paragraph id="H9D5BBE4479474321A81DD555B600959C"><enum>(2)</enum><text>by adding at the
			 end the following: <quote>In determining whether to shorten the thirty-month
			 period under this clause, the court shall consider the totality of the
			 circumstances, including whether the plaintiff sought to extend the discovery
			 schedule, delayed producing discovery, or otherwise acted in a dilatory manner,
			 and the public interest.</quote>.</text>
				</paragraph></subsection><subsection id="HD9622ED695564058B4639EA39492FCAB"><enum>(b)</enum><header>Effective
			 date</header><text>The amendments made by this section apply to any stay of
			 effectiveness period under section 505(j)(5)(B)(iii) of the Federal Food, Drug,
			 and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/355">21 U.S.C. 355(j)(5)(B)(iii)</external-xref>) pending or filed on or after the
			 date of the enactment of this Act.</text>
			</subsection></section><section id="H5BEE130527B64CE19C4000FF3E742521"><enum>4.</enum><header>Ensuring proper
			 use of pediatric exclusivity</header>
			<subsection id="HA8C6DC09D2B74387B1E272F7AC654114"><enum>(a)</enum><header>In
			 general</header><text>Section 505A of the Federal Food, Drug, and Cosmetic Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/21/355a">21 U.S.C. 355a</external-xref>) is amended by striking subsections (b) and (c) and inserting
			 the following:</text>
				<quoted-block display-inline="no-display-inline" id="H638810C760E7471381D65540A307F7E" style="OLC">
					<subsection id="H4737958E4E734E0396EB76AFA295DC36"><enum>(b)</enum><header>Market
				exclusivity for new drugs</header>
						<paragraph id="H65488F09D47C4E98B3DFA1602D932869"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">With respect to a
				pending application under section 505(b)(1), each of the periods of time under
				this chapter specified in paragraph (2) that is applicable with respect to the
				drug involved is deemed to be extended by the period of time determined under
				subsection (d) if, prior to approval of such application—</text>
							<subparagraph id="HE6B08695CD24495DBE12A37C6FD637B0"><enum>(A)</enum><text>the Secretary
				determines that information relating to the use in the pediatric population of
				the drug may produce health benefits in that population;</text>
							</subparagraph><subparagraph id="H926B671D310142E8AED7DADC081E2098"><enum>(B)</enum><text>the Secretary
				makes a written request to the sponsor of the application for one or more
				pediatric studies, which request shall include a timeframe for completing such
				studies;</text>
							</subparagraph><subparagraph display-inline="no-display-inline" id="H71157201AC3448BFBEF2B305ABAC7148"><enum>(C)</enum><text>the sponsor agrees
				to the request;</text>
							</subparagraph><subparagraph id="H6E9A9A0D90F84DABAABC31177C8CD501"><enum>(D)</enum><text>such studies are
				completed within any such timeframe and the reports thereof submitted in
				accordance with subsection (e)(2) or accepted in accordance with subsection
				(e)(3); and</text>
							</subparagraph><subparagraph id="H48D94BEC2F654AD493B296CA6C159808"><enum>(E)</enum><text display-inline="yes-display-inline">based on the results of such studies, the
				Secretary approves labeling for the drug or drug product that provides
				specific, therapeutically meaningful information about the use of the drug in
				pediatric patients.</text>
							</subparagraph></paragraph><paragraph id="H0460EAFD04B94E0D824F758B9389B204"><enum>(2)</enum><header>Period of time
				to be extended</header><text>For purposes of paragraph (1), the periods of time
				under this chapter that are specified in this paragraph with respect to the
				drug involved are the following:</text>
							<subparagraph id="HA1F4C8483034468B8432217E0630BCBD"><enum>(A)</enum><text display-inline="yes-display-inline">In section 505:</text>
								<clause id="HE9D638A0C7444FAFBEC24677AE93013E"><enum>(i)</enum><text>In
				each of subsections (c)(3)(E)(ii) and (j)(5)(F)(ii):</text>
									<subclause id="H9252BF9C82204009834F66BC366225E0"><enum>(I)</enum><text>The period of five
				years.</text>
									</subclause><subclause id="HDDEDD050CF474D0786D096CD5D542C4"><enum>(II)</enum><text>The period of four
				years, the period of forty-eight months, and the period of seven and one-half
				years.</text>
									</subclause></clause><clause id="HBBCED3B3309B44BF813497D503173CB4"><enum>(ii)</enum><text display-inline="yes-display-inline">In each of clauses (iii) and (iv) of
				subsection (c)(3)(E), and in each of clauses (iii) and (iv) of subsection
				(j)(5)(F), the period of three years.</text>
								</clause></subparagraph><subparagraph id="HD273ED63A5FD40F79CD98D08F8D89BDB"><enum>(B)</enum><text>In section 527(a),
				the period of seven years, in the case of a drug designated under section 526
				for a rare disease or condition.</text>
							</subparagraph><subparagraph id="HC82722CE0FF048EE9BE450AB0203F025"><enum>(C)</enum><text>In section 505,
				under subsections (c)(3) and (j)(5)(B), the period of time during which the
				approval of an application may not be made effective, in the case of a drug
				that—</text>
								<clause id="H124488E008EE4B4A80C2D8C45BA9F082"><enum>(i)</enum><text display-inline="yes-display-inline">is the subject of a qualifying listed
				patent for which a certification has been submitted under subsection
				(b)(2)(A)(ii) or (j)(2)(A)(vii)(II) of such section and for which pediatric
				studies were submitted prior to the expiration of the patent (including any
				patent extensions);</text>
								</clause><clause id="H1C044D754839402D88039D5E94FE0352"><enum>(ii)</enum><text display-inline="yes-display-inline">is the subject of a qualifying listed
				patent for which a certification has been submitted under subsections
				(b)(2)(A)(iii) or (j)(2)(A)(vii)(III) of such section; or</text>
								</clause><clause id="HEA49E5A6C69442C696A2515BC0ED3B74"><enum>(iii)</enum><text display-inline="yes-display-inline">is the subject of a qualifying listed
				patent for which a certification has been submitted under subsection
				(b)(2)(A)(iv) or (j)(2)(A)(vii)(IV) of such section, and with respect to which,
				in the patent infringement litigation resulting from the certification, the
				court determines that the patent is valid and would be infringed.</text>
								</clause></subparagraph><continuation-text continuation-text-level="paragraph">With
				respect to subparagraph (C), the extension of time that applies under this
				subsection begins on the day after the date of the expiration of the patent
				involved (including any patent extension).</continuation-text></paragraph><paragraph commented="no" id="H906D3EF54F784949A4076E225970D8AE"><enum>(3)</enum><header>Qualifying
				listed patent</header><text>With respect to a study submitted pursuant to
				paragraph (1), a patent concerning a drug is a qualifying listed patent for
				purposes of this subsection if the patent meets the condition described in
				subparagraph (A), or the condition described in subparagraph (B), as
				follows:</text>
							<subparagraph commented="no" id="HCD566435BA91442A00A0542BA9649213"><enum>(A)</enum><text>Information on the
				patent had been filed with the Secretary as required under subsection (b)(1) or
				(c)(2) of section 505 as of the date on which the study was submitted to the
				Secretary pursuant to paragraph (1).</text>
							</subparagraph><subparagraph commented="no" id="H5AE9AB214203402C9C75982D32F063AE"><enum>(B)</enum><text>After such date,
				the patent became subject to the requirement under such subsection to file
				information on the patent as a result of the approval by the Secretary of a use
				of the drug in the pediatric population, which use—</text>
								<clause commented="no" id="HFC0B3C5F73D94D1692D7B1F1478D4FC5"><enum>(i)</enum><text>is described in
				the approved labeling referred to in paragraph (1)(D); and</text>
								</clause><clause commented="no" id="H121C321B5B96408D9F2401C8F04D4800"><enum>(ii)</enum><text>is claimed by the
				patent.</text>
								</clause></subparagraph></paragraph></subsection><subsection id="H24B50B08436542D9979200B2D480B156"><enum>(c)</enum><header>Market
				exclusivity for already-marketed drugs</header>
						<paragraph id="H782138B22A7F41059FE2BEC1E102A422"><enum>(1)</enum><header>In
				general</header><text>With respect to an approved application under section
				505(b)(1), each of the periods of time under this chapter specified in
				paragraph (2) that is applicable with respect to the drug involved is deemed to
				be extended by the period of time determined under subsection (d) if—</text>
							<subparagraph id="H984EEA0E86C64549AD1479E66187EAF6"><enum>(A)</enum><text>the Secretary
				determines that information relating to the use in the pediatric population of
				the drug may produce health benefits in that population;</text>
							</subparagraph><subparagraph id="H8210F03B749D44DB80A278BF75FA3E78"><enum>(B)</enum><text display-inline="yes-display-inline">the Secretary makes a written request to
				the holder of such application for one or more pediatric studies, which request
				shall include a timeframe for completing such studies;</text>
							</subparagraph><subparagraph id="HE16BDC28C1354F6CAAFABA009D68BA72"><enum>(C)</enum><text>the holder agrees
				to the request;</text>
							</subparagraph><subparagraph id="H5EBD69B4760D40A38636BAE666B599EE"><enum>(D)</enum><text>such studies are
				completed within any such timeframe and the reports thereof submitted in
				accordance with subsection (e)(2) or accepted in accordance with subsection
				(e)(3); and</text>
							</subparagraph><subparagraph id="H398726CF9E6F4937AA999CB6CF4D869"><enum>(E)</enum><text display-inline="yes-display-inline">based on the results of such studies, the
				Secretary approves labeling for the drug that provides specific,
				therapeutically meaningful information about the use of the drug in pediatric
				patients.</text>
							</subparagraph></paragraph><paragraph id="H8ACF3101B4B14CF2A6953470DC9BFE1E"><enum>(2)</enum><header>Period of time
				to be extended</header><text>For purposes of paragraph (1), the periods of time
				under this chapter that are specified in this paragraph are the periods of time
				referred to in subsection (b)(2), as applied to the drug referred to in
				paragraph (1). With respect to periods of time referred to in subsection
				(b)(2)(C) as applied to such drug, the extension of time that applies under
				this subsection begins on the day after the date of the expiration of the
				patent involved (including any patent extension).</text>
						</paragraph><paragraph id="H1028498BBA6341A2A45DCE1B645BB3D7"><enum>(3)</enum><header>Qualifying
				listed patent</header><text display-inline="yes-display-inline">With respect to
				a study submitted pursuant to paragraph (1), a patent concerning a drug is a
				qualifying listed patent for purposes of this subsection if the patent meets
				one of the conditions described in subparagraph (A) or (B) of subsection
				(b)(3), as applied to the drug referred to in paragraph
				(1).</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H1837F040C60B4A3BB5C4A53864583A9"><enum>(b)</enum><header>Determination of
			 extension period</header><text display-inline="yes-display-inline">Section 505A
			 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/355a">21 U.S.C. 355a</external-xref>) is amended—</text>
				<paragraph id="HCAA7B33E7B8441F09EAA04CC96B3A61E"><enum>(1)</enum><text>by redesignating
			 subsections (d) through (n) as subsections (e) through (o), respectively;
			 and</text>
				</paragraph><paragraph id="HC2F14F8DD37B46A988FB7100367D2094"><enum>(2)</enum><text>by inserting after
			 subsection (c) the following:</text>
					<quoted-block display-inline="no-display-inline" id="HA334D82919554A95AC89A106F9AF2C80" style="OLC">
						<subsection id="HF04D647240AC4075B0B4600091436460"><enum>(d)</enum><header>Determination of
				extension period</header>
							<paragraph id="H12AABED2C55740BA9F4E35F93B071C60"><enum>(1)</enum><header>In
				general</header><text>For purposes of subsections (b) and (c), the extension
				period determined under this subsection with respect to a drug is the
				following, as applicable:</text>
								<subparagraph id="H44615B08D9124102B41DDDFF2679E3FC"><enum>(A)</enum><text>One month, if the
				sales revenue for the drug that is projected under paragraph (3) for the base
				year is $1,000,000,000 or more.</text>
								</subparagraph><subparagraph id="H33CC75032A354CE6B2CE8D32A23D24E"><enum>(B)</enum><text>Two months, if the
				sales revenue for the drug that is so projected is $500,000,000 or more but
				less than $1,000,000,000.</text>
								</subparagraph><subparagraph id="H6A703F28B226492DB9C8437155EA52A0"><enum>(C)</enum><text display-inline="yes-display-inline">Three months, if the sales revenue for the
				drug that is so projected is less than $500,000,000.</text>
								</subparagraph></paragraph><paragraph id="HAE808F01E15941F887CE8F3244D8CC38"><enum>(2)</enum><header>Base
				year</header><text>For purposes of this subsection, the base year for a drug is
				the calendar year during which market exclusivity under Federal law for the
				drug would expire in the absence of an extension under subsection (b) or
				(c).</text>
							</paragraph><paragraph id="H9C308C165B174FDCA1AC5DF93183DDB2"><enum>(3)</enum><header>Projection of
				sales revenue</header>
								<subparagraph id="HD20A756C6D364F519DE6BF0086EAA600"><enum>(A)</enum><header>In
				general</header><text>For purposes of paragraph (1), the Secretary shall make
				an estimate of the sales revenue for a drug for a base year on the basis of the
				sales histories of an appropriate sample of drugs over the 20-year period
				preceding the date of the enactment of the <short-title>Lower PRICED Drugs Act</short-title>, including data on
				the sales revenue of the drug that has been included in reports by IMS
				Health.</text>
								</subparagraph><subparagraph id="HC44D126DF3824CADB3C974DCE1ED7069"><enum>(B)</enum><header>Timing of
				projection</header><text display-inline="yes-display-inline">An estimate under
				subparagraph (A) for a drug shall be a projection made in advance of the base
				year for the drug. In the case of an extension period under subsection (b), the
				projection may not be made earlier than the expiration of the two-year period
				beginning on the date on which the drug is approved by the Secretary under
				section 505, unless all market exclusivity under Federal law for the drug will,
				in the absence of an extension under subsection (b), expire before the
				expiration of such period, in which case the projection shall be determined not
				later than three months before the beginning of the base year.</text>
								</subparagraph><subparagraph id="H6C71E723AE06491AA37E362C1EEECC04"><enum>(C)</enum><header>IMS
				health</header><text display-inline="yes-display-inline">The reference in
				subparagraph (A)(ii) to IMS Health is a reference to the corporation
				Intercontinental Marketing Services, first established in 1954, whose
				activities include the conduct of syndicated market research studies of the
				pharmaceutical industry and the international monitoring of prescription drug
				sales.</text>
								</subparagraph></paragraph><paragraph id="HD38A56B8A9CF4EE984C1CDF21D8EECF1"><enum>(4)</enum><header>Criteria</header><text>The
				Secretary shall by regulation establish criteria for making projections under
				paragraph
				(1).</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H5A4A0E4649194E648FCCF39F34FCD347"><enum>(c)</enum><header>Final rule for
			 criteria for projection of sales revenue; effective date</header>
				<paragraph id="H6017FF2A507D44539924C5AB38896FB2"><enum>(1)</enum><header>Final
			 rule</header><text>With respect to criteria under subsection (d)(4) of section
			 505A of the Federal Food, Drug, and Cosmetic Act, as added by subsection (b) of
			 this section, the Secretary of Health and Human Services shall promulgate the
			 final rule not later than 180 days after the date of the enactment of this
			 Act.</text>
				</paragraph><paragraph id="H4B57E745047A4832A1C700DCF265AC26"><enum>(2)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 this subsection take effect 180 days after the date of the enactment of this
			 Act, without regard to whether the final rule under paragraph (1) has been
			 promulgated, subject to subsection (e). The preceding sentence does not affect
			 the requirement under paragraph (1) for the Secretary to promulgate a final
			 rule, notwithstanding circumstances under the preceding sentence in which such
			 amendments have taken effect in the absence of a final rule.</text>
				</paragraph></subsection><subsection id="H3D6440326A5E46748BE5ACD4CDAA8570"><enum>(d)</enum><header>Conforming
			 amendments; technical corrections</header><text display-inline="yes-display-inline">Section 505A of the Federal Food, Drug, and
			 Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/355a">21 U.S.C. 355a</external-xref>), as amended by subsection (b)(1) of this section,
			 is amended—</text>
				<paragraph id="HF363B695A7CC4045A831C17C00612770"><enum>(1)</enum><text>in subsection
			 (e)(4)(C), by inserting <quote>of the Public Health Service Act</quote> after
			 <quote>499(j)(9)(B)(i)</quote>; and</text>
				</paragraph><paragraph id="H36DE11AAE1944692BCD1C078ED0697A8"><enum>(2)</enum><text>in each of
			 subsections (f) and (g), by striking <quote>subsection (d)</quote> each place
			 such term appears and inserting <quote>subsection (e)</quote>; and</text>
				</paragraph><paragraph id="H1B93C9967D244675891EC326C3425D62"><enum>(3)</enum><text>in subsection (n),
			 by striking <quote>under subsection (a) or (c)</quote> and inserting
			 <quote>under subsection (b) or (c)</quote>.</text>
				</paragraph></subsection><subsection id="HEC88FB19C7114265AFFA276D62CA0002"><enum>(e)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 this section apply to requests by the Secretary of Health and Human Services
			 for pediatric studies under section 505A of the Federal Food, Drug, and
			 Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/355a">21 U.S.C. 355a</external-xref>) after the date of the enactment of this
			 Act.</text>
			</subsection></section><section id="H3384FE2D7E114454978B6FAF0040B97D"><enum>5.</enum><header>Citizen petitions
			 and petitions for stay of agency action</header><text display-inline="no-display-inline">Section 505 of the Federal Food, Drug, and
			 Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/355">21 U.S.C. 355</external-xref>) is amended by adding at the end the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="H1140C28DFCB44EBD9D17E2FE8C235071" style="OLC">
				<subsection id="H2F685181E3C84367938CB2A43B3977BD"><enum>(o)</enum><header>Petitions and
				civil actions regarding approval of certain applications</header>
					<paragraph id="H4E60BF55F80A4552876DB77F7511996"><enum>(1)</enum><header>In
				general</header><text>With respect to a pending application under subsection
				(b)(2) or (j), if a petition is submitted to the Secretary that seeks to have
				the Secretary take, or refrain from taking, any form of action relating to the
				approval of the application, including a delay in the effective date of the
				application, the following applies, subject to paragraph (5):</text>
						<subparagraph display-inline="no-display-inline" id="HCF39517E084E44299EDFED797A400C5"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="H1D8811717B174A28B73F2FB124ACD586"><enum>(i)</enum><text display-inline="yes-display-inline">In the case of an application under
				subsection (b)(2), the Secretary may not, subject to clause (iii), consider the
				petition if it is submitted later than 210 days prior to the date on which the
				approval of the application may first be made effective under subsection
				(c)(3), including subparagraphs (C) and (E) (as applicable), or 210 days prior
				to the expiration of any 30-month stay under such subparagraph (C) with respect
				to the application, whichever is later.</text>
							</clause><clause id="HCE2C1E3C50314F95950067D441A6ACC3" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">In the case of an application under
				subsection (j), the Secretary may not, subject to clause (iii), consider the
				petition if it is submitted later than 210 days prior to the date on which the
				approval of the application may first be made effective under paragraph (5) of
				such subsection, including subparagraphs (B)(iii) and (F) (as applicable), or
				210 days prior to the expiration of any 30-month stay under such subparagraph
				(B)(iii) with respect to the application, whichever is later.</text>
							</clause><clause id="H5BA3FB717ED5418FB501428072993804" indent="up1"><enum>(iii)</enum><text display-inline="yes-display-inline">The restriction established in clause (i)
				or (ii) (as the case may be) does not apply to the petition if the Secretary
				determines that the petitioner has shown good cause for the failure to submit
				the petition by the applicable date under such clause.</text>
							</clause></subparagraph><subparagraph id="HDEDBDDD5D2ED46A6AF7224A8AE6BF0F5"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="HD12C1D329DDD40BD8C3280AE05479514"><enum>(i)</enum><text>The Secretary may not,
				on the basis of the petition, delay approval of the application unless the
				Secretary determines that a delay is necessary to protect the public health.
				Consideration of a petition shall be separate and apart from the review and
				approval of the application.</text>
							</clause><clause id="HF1F205A61E494190B485D2608B9958BA" indent="up1"><enum>(ii)</enum><text>With respect to a determination by
				the Secretary under clause (i) that a delay is necessary to protect the public
				health:</text>
								<subclause commented="no" id="HFC475AA4A61F4CD39BB9EAFB87B215B0"><enum>(I)</enum><text display-inline="yes-display-inline">The Secretary shall publish on the Internet
				site of the Food and Drug Administration a statement providing the reasons
				underlying the determination.</text>
								</subclause><subclause commented="no" id="HAD3D161911604F8D86DE63ECCB4E8E39"><enum>(II)</enum><text>Not later than 10 days after making the
				determination, the Secretary shall provide notice to the sponsor of the
				application and an opportunity for a meeting with the Commissioner to discuss
				the determination.</text>
								</subclause></clause></subparagraph><subparagraph id="H2F433503329942C5A400D64102DF216E"><enum>(C)</enum><text display-inline="yes-display-inline">The Secretary shall take final agency
				action on the petition not later than 180 days after the date on which the
				petition is submitted. The Secretary shall not extend such period, even with
				the consent of the petitioner, for any reason, including based upon the
				submission of comments relating to the petition or supplemental information
				supplied by the petitioner.</text>
						</subparagraph><subparagraph display-inline="no-display-inline" id="HEB1ECC2F63A54CA191FEE4CB6400CC07"><enum>(D)</enum><text>If the filing of
				the application resulted in first-applicant status under subsection
				(j)(5)(D)(i)(IV), the 30-month period under such subsection is deemed to be
				extended by a period of time equal to the period beginning on the date on which
				the Secretary received the petition and ending on the date of final agency
				action on the petition (inclusive of such beginning and ending dates), without
				regard to whether the Secretary grants, in whole or in part, or denies, in
				whole or in part, the petition.</text>
						</subparagraph><subparagraph id="H4724D63B719B417DBA4EC9AA53005750"><enum>(E)</enum><text>The Secretary may
				not consider the petition for review unless it is signed and contains the
				following verification: <quote>I certify that, to my best knowledge and belief:
				(a) this petition includes all information and views upon which the petition
				relies; (b) this petition includes representative data and/or information known
				to the petitioner which are unfavorable to the petition; and (c) I have taken
				reasonable steps to ensure that any representative data and/or information
				which are unfavorable to the petition were disclosed to me. I further certify
				that the information upon which I have based the action requested herein first
				became known to the party on whose behalf this petition is submitted on or
				about the following date: __________. I received or expect to receive payments,
				including cash and other forms of consideration, from the following persons or
				organizations to file this petition: _____________. I verify under penalty of
				perjury that the foregoing is true and correct.</quote>.</text>
						</subparagraph></paragraph><paragraph id="H79A22A9AFC634683940075B3C7BA2ED5"><enum>(2)</enum><header>Exhaustion of
				administrative remedies</header>
						<subparagraph id="H26C87B31FAF34116A60043451FF622FC"><enum>(A)</enum><header>Final agency
				action within 180 days </header><text>The Secretary shall be considered to have
				taken final agency action on a petition referred to in paragraph (1) if—</text>
							<clause id="HCFADE200F82E4D7B83C880277F3C8839"><enum>(i)</enum><text>during the 180-day
				period referred to in subparagraph (C) of such paragraph, the Secretary makes a
				final decision within the meaning of <external-xref legal-doc="usc" parsable-cite="usc/21/10">section 10.45(d)</external-xref> of title 21, Code of
				Federal Regulations; or</text>
							</clause><clause id="H62875DD8AB0546CF85DB081E08189662"><enum>(ii)</enum><text>such period
				expires without the Secretary having made such a final decision.</text>
							</clause></subparagraph><subparagraph id="H9BA4F69483B7461EB9D6C797A086351F"><enum>(B)</enum><header>Dismissal of
				certain civil actions</header><text display-inline="yes-display-inline">If a
				civil action is filed with respect to a petition referred to in paragraph (1)
				before final agency action within the meaning of subparagraph (A) has occurred,
				the court shall dismiss the action for failure to exhaust administrative
				remedies.</text>
						</subparagraph></paragraph><paragraph id="HCDEE5B7C40F04DFFBD748DD97B13E0F"><enum>(3)</enum><header>Applicability of
				certain regulations</header><text>The provisions of this section are in
				addition to the requirements for the submission of a petition to the Secretary
				that apply under section <external-xref legal-doc="usc" parsable-cite="usc/21/10">10.30</external-xref> or <external-xref legal-doc="usc" parsable-cite="usc/21/10">10.35</external-xref> of title 21, Code of Federal
				Regulations.</text>
					</paragraph><paragraph id="HB6A91EB4F59742F899C48F2C84856245"><enum>(4)</enum><header>Annual report on
				delays in approvals per petitions</header><text>The Secretary shall annually
				submit to the Congress a report that specifies—</text>
						<subparagraph id="HC726F4AB3F0E49C9BCE7387087A1E4AC"><enum>(A)</enum><text>the number of
				applications under subsections (b)(2) and (j) that were approved during the
				preceding 12-month period;</text>
						</subparagraph><subparagraph id="HF0279DEC39DB4A43973B1E9EDD0064C8"><enum>(B)</enum><text>the number of such
				applications whose effective dates were delayed by petitions referred to in
				paragraph (1) during such period; and</text>
						</subparagraph><subparagraph id="H57637BF9D0F64B99AD350010B4B9801"><enum>(C)</enum><text>the number of days
				by which the applications were so delayed.</text>
						</subparagraph></paragraph><paragraph id="HC49B3D71E7C84211BEDC79BA451275CA"><enum>(5)</enum><header>Exceptions</header><text>This
				subsection does not apply to—</text>
						<subparagraph id="HA12A48FE4470436B8515AD45396FABAC"><enum>(A)</enum><text>a petition that
				relates solely to the timing of the approval of an application pursuant to
				subsection (j)(5)(B)(iv); or</text>
						</subparagraph><subparagraph id="H4218A3AAD33D47E6841180210004CC54"><enum>(B)</enum><text>a petition that is
				made by the sponsor of an application under subsection (b)(2) or (j) and that
				seeks only to have the Secretary take or refrain from taking any form of action
				with respect to that application.</text>
						</subparagraph></paragraph><paragraph id="H6174F0543C814600A50099FBC5B1B480"><enum>(6)</enum><header>Definition</header><text display-inline="yes-display-inline">For purposes of this subsection, the term
				<quote>petition</quote> includes any request to the Secretary, without regard
				to whether the request is characterized as a
				petition.</text>
