		  maximum age for the original appointment of a retired member of the Armed
		  Forces to a border patrol agent position, and for other

		<section id="HD791F335DC8343A789D5BA66A87D771C" section-type="section-one"><enum>1.</enum><header>Short Title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Border
			 Patrol Agent Recruitment Act of 2006</quote>.</text>
		</section><section id="HD3730822FFAA444FAF51F0689C1F2864"><enum>2.</enum><header>Maximum age for
			 original appointment of retired member of armed forces to border patrol agent
			 position</header>
			<subsection id="HF259A878127147E5971DC5894293D067"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 3307 of title
			 5, United States Code, is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H06BD3AB403B6400A944E66D2719F8BA8" style="OLC">
					<subsection id="H7D83A84FB2994DB4B5A77390F2333D19"><enum>(g)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H17008EA01D6E45BF9B06F1B8E0197E9B"><enum>(1)</enum><text>The Secretary of
				Homeland Security shall fix the maximum age limit for an original appointment
				to a border patrol agent position at 45 years of age for any individual who is
				a retired member of the armed forces at the time of appointment.</text>
						</paragraph><paragraph id="HDFA450153241428C98F9DE94193ED19" indent="up1"><enum>(2)</enum><text>For purposes of this subsection, the
				term <term>border patrol agent</term> has the meaning specified by the
				Secretary of Homeland
				Security.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HAA604726AD5C4D5397A49F48DBF0FB94"><enum>(b)</enum><header>Conforming
			 Amendment</header><text display-inline="yes-display-inline">Section 3307(a) of
			 title 5, United States Code, is amended by striking <quote>and (f)</quote> and
			 inserting <quote>(f), and (g)</quote>.</text>
			</subsection></section><section id="H0A41EAA0F74B4563AEE0002E1EC3299B"><enum>3.</enum><header>Provisions
			 relating to retirement</header>
			<subsection id="HD1E6589271054C47AB13ED53F657449D"><enum>(a)</enum><header>Amendments to
			 Civil Service Retirement System</header>
				<paragraph id="HC673200DA22442D880A1373617C984D5"><enum>(1)</enum><header>Immediate
			 retirement</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/8336">Section 8336(c)</external-xref> of title 5, United States Code, is
			 amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H4307202FB12A41A5A3DDE34EAED558F" style="OLC">
						<paragraph id="H3928F37DA22141F6B6FEA273A535008F" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H80C6C00EF1BE4AABA08CBBBC03004100"><enum>(A)</enum><text>Notwithstanding
				paragraph (1), an employee who is separated from the service after completing
				15 years of service as a border patrol agent described in subparagraph (B),
				including in a supervisory or administrative position to which such employee
				transfers directly from a border patrol agent position, is entitled to an
				annuity.</text>
							</subparagraph><subparagraph id="HB42FB36787724B72AC2B487547069CA0" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">A
				border patrol agent described in this subparagraph is any border patrol agent
				(as defined in section 3307(g)) who, at the time of original appointment to a
				position as such agent, is—</text>
								<clause id="HE96F028A74CB427FA85B6FAFA7581BB4" indent="up1"><enum>(i)</enum><text>a retired member of the armed forces;
				and</text>
								</clause><clause id="HCA40A32ABAE04B8BB4719D4F6D7ECA9E" indent="up1"><enum>(ii)</enum><text>at least 40 years of
				age.</text>
								</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H9D4876EA8FB742A58FBF64FCE0E933FC"><enum>(2)</enum><header>Mandatory
			 separation</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/8335">Section 8335(b)</external-xref> of title 5, United States Code, is
			 amended by redesignating the second paragraph (2) as paragraph (3) and by
			 adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H11C0EEB7AA654821A6B3D0CBC911305B" style="OLC">
						<paragraph id="HFD0DDA7D4635490BA8F2B274D59938CB" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">In the case of a law enforcement officer
				eligible for immediate retirement under section 8336(c)(3), the first sentence
				of paragraph (1) shall be applied by substituting <quote>15 years of
				service</quote> for <quote>20 years of
				service</quote>.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H0C873BED3299416FB483DEFCE9C6FFE"><enum>(b)</enum><header>Amendments to
			 Federal Employees’ Retirement System</header>
				<paragraph id="HB9F28C4890FD48B589BDDA699BF0D71F"><enum>(1)</enum><header>Immediate
			 retirement</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/8412">Section 8412(d)</external-xref> of title 5, United States Code, is
			 amended—</text>
					<subparagraph id="H1D349974F67F4816904C8445872CEBD6"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (1) and (2) as
			 subparagraphs (A) and (B), respectively;</text>
					</subparagraph><subparagraph id="HC99B45BD79494C48A7826ECE85F399BA"><enum>(B)</enum><text>by striking
			 <quote>(d)</quote> and inserting <quote>(d)(1)</quote>; and</text>
					</subparagraph><subparagraph id="H70A637A08AEB4151ACC0AA5BCC1D1356"><enum>(C)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H2A924325BEBD42B899006FD581EFCE79" style="OLC">
							<paragraph id="H4D8AEA124F024938B4397188EC26947C" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H8350ECA8C4ED4361B944D603BB538F12"><enum>(A)</enum><text>Notwithstanding
				paragraph (1), an employee who is separated from the service, except by removal
				for cause on charges of misconduct or delinquency, after completing 15 years of
				service as a border patrol agent described in subparagraph (B), including in a
				supervisory or administrative position to which such employee transfers
				directly from a border patrol agent position, is entitled to an annuity.</text>
								</subparagraph><subparagraph display-inline="no-display-inline" id="H84159B131C60452AB077DB747D67C474" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">A
				border patrol agent described in this subparagraph is any border patrol agent
				(as defined in section 3307(g)) who, at the time of original appointment to a
				position as such agent, is—</text>
									<clause id="H16EFD6451EFE4240B7340058E4D41DF7" indent="up1"><enum>(i)</enum><text>a retired member of the armed forces;
				and</text>
									</clause><clause id="H9A76038DEBAC4A82BE604600D5720018" indent="up1"><enum>(ii)</enum><text>at least 40 years of
				age.</text>
									</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H634B549D2B1C45A39EAB68772DC31C77"><enum>(2)</enum><header>Mandatory
			 separation</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/8425">Section 8425(b)</external-xref> of title 5, United States Code, is
			 amended by redesignating the second paragraph (2) as paragraph (3) and by
			 adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H3D715D80A4774A49AA556B5CE1F545E4" style="OLC">
						<paragraph id="HA0F1CFF8449C4102AF2EF9DCD3DCBB9" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">In the case of a law enforcement officer
				eligible for immediate retirement under section 8412(d)(2), the first sentence
				of paragraph (1) shall be applied by substituting <quote>15 years of
				service</quote> for <quote>20 years of
				service</quote>.</text>
