		<section display-inline="no-display-inline" id="H826664A24EAB409EA253F75652C57EA" section-type="section-one"><enum>1.</enum><header>No-fly zone near nuclear
			 facilities under certain circumstances</header>
			<subsection id="H256A603C515A42C4B8AB7B89E1293813"><enum>(a)</enum><header>National
			 alert</header><text>If the threat alert level determined by the Homeland
			 Security Advisory System is elevated to code orange or code red for the Nation,
			 the Secretary of Transportation shall prohibit any commercial or private
			 aircraft from flying below 18,000 feet within a 10-mile radius of any nuclear
			 facility.</text>
			</subsection><subsection id="H21FEA040F2834E28B9FC454B31476137"><enum>(b)</enum><header>Local
			 alert</header><text display-inline="yes-display-inline">If the threat alert
			 determined by the Homeland Security Advisory System is elevated to code orange
			 or code red for a specific area, the Secretary of Transportation shall prohibit
			 any commercial or private aircraft from flying below 18,000 feet within a
			 10-mile radius of any nuclear facility located within a 50-mile radius of such
			 area.</text>
			</subsection><subsection id="HC3E645A7121C4788B518AE4ED44C7115"><enum>(c)</enum><header>Definition</header><text>For
			 this section, the term <quote>nuclear facility</quote> means a commercial
			 nuclear power reactor licensed by the Nuclear Regulatory Commission under the
			 Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2011">42 U.S.C. 2011 et seq.</external-xref>).</text>
