<official-title>To amend the Impact Aid program under the Elementary and Secondary Education Act of 1965 to improve the distribution of school construction payments to better meet the needs of military and Indian land school districts.</official-title>

<section id="HF7D1E5FA4A2646DF81153765A55F3286" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Improved Distribution of Construction Payments</header> 
<subsection id="HB74722A1C92B433C95BCBD88187ED3C1"><enum></enum><text display-inline="no-display-inline">Section 8007(a) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7707">20 U.S.C. 7707(a)</external-xref>) is amended—</text> 
<paragraph id="H17B24C7FCED04E2DB1E6E4BF552ED178"><enum>(1)</enum><text> in paragraph (1), by striking <quote>40 percent</quote> and inserting <quote>80 percent</quote>; </text></paragraph> 
<paragraph id="H4AD766ED68874D36A6B37DD3D8422C34" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraphs (A) and (B) of paragraph (2), by striking <quote>50 percent</quote> each place it appears and inserting <quote>40 percent</quote>; </text></paragraph> 
<paragraph id="HDF43E107661A4B4C80F242132810D34D" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">in paragraph (2) by adding at the end the following new subparagraphs: </text>

<subparagraph id="H05029A0A38744C7EAC004DCA9E00C757"><enum>(C)</enum><text>The agency is eligible under section 8003(b)(2). </text></subparagraph> 
<subparagraph id="HFD938253DCB04226AB6FF7E48F17DF51" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">The agency is eligible under Section 8003(a)(2)(C). </text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HC586E33649084FDB9918771E60BD825F" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">by striking paragraph (3) and inserting the following: </text>

<paragraph id="HD834F4C8335D44AA95284DB75852A9F5"><enum>(3)</enum><header>Amount of Payments</header><text>The amount of a payment to each local educational agency described in this subsection for a fiscal year shall be—</text> 
<subparagraph id="H1F3EDD761F1946C580C4677D26AE561F"><enum>(A)</enum><text>not less than the greater of the amount appropriated as provided under paragraph (1) for such fiscal year; divided by—</text> 
<clause id="H119FF2F518AF4522B2DFAC6F8E2CD5FF"><enum>(i)</enum><text>the number of children determined under subparagraphs (B), (C), and (D)(i) of section 8003(a)(1) who were in average daily attendance for all local educational agencies described in paragraph (2), including the number of children attending a school facility described in section 8008(a) if the Secretary does not provide assistance for the school facility under that section for the fiscal year; multiplied by</text></clause> 
<clause id="HAEC24A0EFD724761876F8FC10086ED29" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">the number of children determined for such agency; or</text></clause></subparagraph> 
<subparagraph id="H291274EFE21646F0A7ED30D1DED0ED58"><enum>(B)</enum><text>$25,000.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> 
<section display-inline="no-display-inline" id="HB4C37A4F72A14B09801F8633BDCDB635"><enum>2.</enum><header>Competitive Emergency And Modernization Grants</header><text display-inline="no-display-inline">Section 8007(b) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7707">20 U.S.C. 7707(b)</external-xref>) is amended—</text> 
<paragraph id="HBB239A4A167B45E29E304D7D2EC58E81"><enum>(1)</enum><text>in paragraph (1) by striking <quote>60 percent</quote> and inserting <quote>20 percent</quote>; </text></paragraph> 
<paragraph display-inline="no-display-inline" id="H1B82448B8FAD48CCB1AF7B5CA481BB81"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (3)(C)(i)(I) by striking <quote>the agency meets at least one</quote> and all that follows, and inserting <quote>the number of children determined under section 8003(a)(1)(C) for the agency for the preceding school year constituted at least 40 percent of the total student enrollment in the schools of the agency during the preceding school year.</quote>; </text></paragraph> 
<paragraph display-inline="no-display-inline" id="H1501E21DAC9F40CDB72CC1953C2EE300"><enum>(3)</enum><text display-inline="yes-display-inline">by striking paragraph (3)(D)(ii)(II) and inserting the following:</text> 
<quoted-block style="OLC" id="H91AF8A0B837A4CFFA8A5CA235B858129" display-inline="no-display-inline"> 
<subclause id="H17DD48CB22264170945EB7B6168427E5"><enum>(II)</enum><text>The number of children determined under section 8003(a)(1)(C) for the school for the preceding school year constituted at least 40 percent of the total student enrollment in the school during the preceding school year.</text></subclause><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HA495402D61E44B8D000059D71738F4C4" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">in paragraph (4)(C) by striking <quote>(B), (C), and (D)</quote> and inserting <quote>and (C)</quote>. </text></paragraph></section>
