			 period to be subsequently determined by the Speaker, in each case for
			 consideration of such provisions as fall within the jurisdiction of the
			 committee concerned</action-desc>

		<official-title>To increase access to and consumption of fresh fruits,
		  vegetables, and healthy alternatives in low-income communities with high
		  incidences of obesity and obesity-related disease.</official-title>
	</form>
	<legis-body id="H0936F3F79F164DD300F338A6068430AD" style="OLC">
		<section id="H348E3CF6B3844CCF912DCBE84001FDE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Bodegas as Catalysts for Healthy
			 Living Act</short-title></quote>.</text>
		</section><section id="HC8385CD6F54D4471AFF515C668B5D94C"><enum>2.</enum><header>Grants for small
			 businesses and consumer education and outreach</header>
			<subsection id="HF2BCD08D69A8415CA69E1FE90223112F"><enum>(a)</enum><header>Program
			 required</header><text display-inline="yes-display-inline">The Administrator of
			 the Small Business Administration shall carry out a program under which the
			 Administrator makes grants to any of the following:</text>
				<paragraph id="H6FCFDD2CF8DE491D9D6E11343E26D115"><enum>(1)</enum><text>A
			 locally-based organization that represents small business concerns.</text>
				</paragraph><paragraph id="H8BDEA854A2144CABB6009C008D00447D"><enum>(2)</enum><text>A local redevelopment agency that is chartered, established, or otherwise
			 sanctioned by a State or local government.</text>
				</paragraph></subsection><subsection id="H74585C4A0B0F42FAAF00D3995286EB88"><enum>(b)</enum><header>Use of grant
			 amounts</header><text>The recipient of a grant under this section shall use the
			 grant amounts for one or more of the following activities:</text>
				<paragraph id="H99E784B1BA8942B8BA8B9E348C28B6E5"><enum>(1)</enum><text>To provide, to
			 independently owned and operated small business concerns, such as bodegas and
			 corner stores, assistance (such as assistance in purchasing appropriate
			 equipment, or assistance in hiring and training personnel) in expanding their
			 inventory to include one or more of the following products:</text>
					<subparagraph id="H768B7AEBC6F346A2BCB56447EFC2004E"><enum>(A)</enum><text>Fresh fruits and
			 vegetables.</text>
					</subparagraph><subparagraph id="H6DE92DC11087430E834525A889F31DB"><enum>(B)</enum><text>Healthy
			 alternatives (as defined by the Department of Agriculture) such as whole milk
			 alternatives, pure fruit juices, and products with 0 grams of transfat).</text>
					</subparagraph></paragraph><paragraph id="H34ED91FF7D3E4AF1AC465290E4436D00"><enum>(2)</enum><text>To provide, to
			 community-based organizations, such as community health centers, assistance in
			 carrying out consumer education and outreach activities to encourage the
			 purchase of such products, such as by informing communities about the health
			 risks associated with high-calorie, low-exercise lifestyles and the benefits of
			 healthy living.</text>
				</paragraph></subsection><subsection id="HBFFCAC702DC24837A66D185045013864"><enum>(c)</enum><header>Collaboration
			 required</header><text>A small business concern may receive assistance in
			 expanding inventory under subsection (b)(1) only if the small business concern
			 works in collaboration with one or more community-based organizations in
			 expanding that inventory. A community-based organization may receive assistance
			 in carrying out activities under subsection (b)(2) only if the community-based
			 organization works in collaboration with one or more small business concerns in
			 carrying out those activities.</text>
			</subsection><subsection id="H6C2669842ED14C82003394025B4D537D"><enum>(d)</enum><header>Maximum
			 grant</header><text>A grant under this section may not exceed $100,000.</text>
			</subsection><subsection id="H807921AB45964CCDA81461B4B67C766B"><enum>(e)</enum><header>Authorization of
			 appropriations</header><text>There are authorized to be appropriated to carry
			 out this section $5,000,000 for fiscal year 2007.</text>
			</subsection></section><section display-inline="no-display-inline" id="H89098F86CADF4027AA8D3F4EB2E1ECCB" section-type="subsequent-section"><enum>3.</enum><header>Coverage of additional
			 primary care and preventive services under the Medicare and Medicaid
			 programs</header>
			<subsection id="H6772A41C38034EC5B7C9C820239F1487"><enum>(a)</enum><header>Medicare
			 program</header>
				<paragraph id="H9B26626F09A2414100CC28C00004363"><enum>(1)</enum><header>In
			 general</header><text>Section 1861 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x</external-xref>)
			 is amended—</text>
					<subparagraph id="HF31BF7808EEA49B4B550517F789869ED"><enum>(A)</enum><text>in subsection
			 (s)(2), by adding at the end the following new subparagraph:</text>
						<quoted-block display-inline="no-display-inline" id="H2B5F43AEF5D546BF0000FC86D9BCB05F" style="traditional">
							<subparagraph id="HBC6CDACA62AE4FD188FAA7251CFF673F"><enum>(BB)</enum><text>additional
				primary and preventive services described in subsection
				(ccc);</text>
							</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="HC207EDC0916148CA8D3366BB1347A357"><enum>(B)</enum><text>by adding at the
			 end the following new subsection:</text>
						<quoted-block display-inline="no-display-inline" id="HF57AD0000A0548DEB56F0466B61438AE" other-style="archaic" style="other">
							<subsection id="HDB40F66DDA2741BE8B8520BE763EDEDD"><enum>(ccc)</enum><header>Additional primary and preventive
		  services</header><text>The term
				<quote>additional primary and preventive services</quote> means such primary
				and preventive services that are not otherwise covered under this title as the
				Secretary shall specify when provided by qualified providers, as specified by
				the Secretary. Such term includes the following:</text>
								<paragraph id="H6A1F2DF7FC3D470AA887EF7E34D626CD"><enum>(1)</enum><text>Services for the
				prevention and treatment of obesity and obesity-related disease.</text>
								</paragraph><paragraph id="H64A21284F6E847899FE27DD8BEE94E26"><enum>(2)</enum><text>Supervised
				exercise sessions.</text>
								</paragraph><paragraph id="HDC6C7208507549839051EA3C5BF8F405"><enum>(3)</enum><text>Exercise stress
				testing for the purpose of exercise prescriptions.</text>
								</paragraph><paragraph id="HBD4D54B8CED34931A5E47444005F0081"><enum>(4)</enum><text>Lifestyle
				modification education.</text>
								</paragraph><paragraph id="H3ACBD41E1C344BC29626C36BE9007E40"><enum>(5)</enum><text>Culinary arts
				education for the purpose of promoting proper
				nutrition.</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="HB9AD1ED58B314193AADD89EDE9847D79"><enum>(2)</enum><header>Conforming
			 amendments</header><subparagraph commented="no" display-inline="yes-display-inline" id="H6C0098C81D394287A9445872F890743"><enum>(A)</enum><text>Section 1862(a)(1) of
			 such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395y">42 U.S.C. 1395y(a)(1)</external-xref>) is amended—</text>
						<clause id="H43622A718F1141C593119102365E8247" indent="up1"><enum>(i)</enum><text>by striking <quote>and</quote> at
			 the end of subparagraph (M);</text>
						</clause><clause id="HDF3FB5C7F701496A89209E961485B16D" indent="up1"><enum>(ii)</enum><text>by adding <quote>and</quote> at
			 the end of subparagraph (N); and</text>
						</clause><clause id="HB6152830529C4FD796EEE004BF59BA61" indent="up1"><enum>(iii)</enum><text>by adding at the end the
			 following new subparagraph:</text>
							<quoted-block display-inline="no-display-inline" id="H76FC6626FBD446F6A9BE96B5030668E2" style="traditional">
								<subparagraph id="H9AEA2D20F1C44D01B04700ACE0085109"><enum>(O)</enum><text>in the case of
				additional primary care and preventive services, which are performed more
				frequently than the Secretary may
				specify;</text>
								</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</clause></subparagraph><subparagraph id="H84325DA6D8014B8F81384B77C4F238C1" indent="up1"><enum>(B)</enum><text>Section 1833(b)(5) of such Act (42
			 U.S.C. 1395l(b)(5)) is amended by inserting <quote>or additional primary care
			 or preventive services (as defined in section 1861(ccc))</quote> after
			 <quote>(jj))</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="H1189F9499D104ABE82F51C281277551B"><enum>(b)</enum><header>Medicaid
			 program</header><text>Section 1905(a) of the Social Security Act (42 U.S.C.
			 1396d(a)) is amended—</text>
				<paragraph id="H1A9D53EBF9C94E86A9A3D8FAA8CBD98D"><enum>(1)</enum><text>by striking
			 <quote>and</quote> at the end of paragraph (27);</text>
				</paragraph><paragraph id="HAF9B5CEB7C48481D96BD059B6412BE00"><enum>(2)</enum><text>by redesignating
			 paragraph (28) as paragraph (29); and</text>
				</paragraph><paragraph id="HA09EB89A66FE4E9B82EDCFF5159EDD88"><enum>(3)</enum><text>by inserting after
			 paragraph (27) the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="H58D39A91D9294F76A278EA041D63EB02" style="traditional">
						<paragraph id="H5C16D481D8404D368C376BF22467317"><enum>(28)</enum><text>additional primary
				care and preventive services (as defined in section 1861(ccc)) which are not
				otherwise covered under this subsection;
				and</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HD078986378CE46ADAEF3896415E2B199"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall take effect on the
			 first day of the first calendar quarter beginning after the date of the
			 enactment of this Act, with regard to whether regulations to implement such
			 amendments are in effect as of such date.</text>
