		<section id="HE21174E22DBB4913A3A41300E5EC092" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote>Prescription Privacy Protection Act of 2006</quote>.</text>
		</section><section id="HC9C0AACC1DF9416A82E906C51F84DFA0"><enum>2.</enum><header>Protection of
			 privacy of drug prescriber information</header>
			<subsection id="H5D1261EFAA0C4A8BB79596E0139416DE"><enum>(a)</enum><header>In
			 general</header><text>Title XI of the Social Security Act is amended by adding
			 at the end the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="HED5A673EC5B84277BE717B040256C8B1" style="traditional">
					<section id="H63B816AF11594461962F97094D164BE0"><enum>1180.</enum><header>Privacy of prescriber information</header><subsection commented="no" display-inline="yes-display-inline" id="H7A0B5B9EB17E4F2A89F7E967F4D95B1"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">A drug manufacturer
				(as defined for purposes of section 1927) may not, directly or indirectly, use
				prescriber identifiable health information for commercial purposes.</text>
						</subsection><subsection id="H731D9F1A4DA44CC38972A16BEA8CC789"><enum>(b)</enum><header>Penalty</header><text display-inline="yes-display-inline">Any manufacturer that violates subsection
				(a) shall be fined not more than $50,000, or imprisoned not more than one year,
				or both, for each such violation.</text>
						</subsection><subsection id="HEB9F9027305842C891B77CD8987F1E39"><enum>(c)</enum><header>Definitions</header><text>For
				purposes of this section:</text>
							<paragraph id="H4BAB3CB280B947C9A603FF935C50C439"><enum>(1)</enum><header>Commercial
				purposes</header>
								<subparagraph id="HA3B296F63AE94EA30028BBB1915B7CD0"><enum>(A)</enum><header>In
				general</header><text>The term <term>commercial purposes</term> includes
				advertising, marketing, promotion, or any activity that could be used to
				influence sales or market share of a pharmaceutical product or to influence or
				evaluate the prescribing behavior of a prescriber.</text>
								</subparagraph><subparagraph id="HDB27C9BC887C4AC39BE14FD76300F714"><enum>(B)</enum><header>Exclusion</header><text>Such
				term does not include—</text>
									<clause id="HA899FD56646C42E1A4E6078E5426CB9"><enum>(i)</enum><text>pharmacy
				reimbursement;</text>
									</clause><clause id="H49FC1985DD184D84A4CCA07757EBF5A0"><enum>(ii)</enum><text>formulary
				compliance;</text>
									</clause><clause id="H64096774B6984528B6D804702188A116"><enum>(iii)</enum><text>care
				management;</text>
									</clause><clause id="H0B6672C2330048EDA97184E3AAC13847"><enum>(iv)</enum><text>utilization
				review by a provider or supplier, an individual’s insurance provider, or the
				agent of either; or</text>
									</clause><clause id="H3D7430EBD0554A89ACC051A6FC903338"><enum>(v)</enum><text>health care
				research, including clinical research and health services research.</text>
									</clause></subparagraph></paragraph><paragraph id="H9FFA384A8433472D966259F7BCF6A6BB"><enum>(2)</enum><header>Prescriber</header><text>The
				term <term>prescriber</term> means a physician or other health care
				practitioner that is authorized under State law to prescribe a prescription
				drug or biological.</text>
							</paragraph><paragraph id="H70506A37011C4712BAAFB9E8B0E97516"><enum>(3)</enum><header>Prescriber
				identifiable health information</header><text>The term <term>prescriber
				identifiable health information</term> means health information relating to a
				prescription drug or biological which—</text>
								<subparagraph id="HC92E5684537F4E079E91B3B4F00929D"><enum>(A)</enum><text>identifies the
				prescriber of the drug or biological; or</text>
								</subparagraph><subparagraph id="H3F856D7B064C40A88C1FC2D0E1BC971C"><enum>(B)</enum><text>with respect to
				which there is a reasonable basis to believe that the information can be used
				to identify such prescriber.</text>
								</subparagraph></paragraph><paragraph id="HE5A61D7056D44E40B100975E92EF83FE"><enum>(4)</enum><header>Prescription
				drug or biological</header><text>The term <term>prescription drug or
				biological</term> means a drug or biological that may be dispensed only upon
				prescription.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HC6E6CBD6445C4FE698CCD5E2D45FF990"><enum>(b)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendment made by
			 subsection (a) shall take effect on a date, specified by the Secretary of
			 Health and Human Services, that is not later than one year after the date of
			 the enactment of this Act.</text>
