		<official-title>To establish certain requirements relating to the
		  continuation of the Survey of Income and Program
		  Participation.</official-title>

	<legis-body id="H550E4719755F4EE1B5D7DFD1FF9EF37E" style="OLC">
		<section id="H991C8624BAE64E3CBE1DDF75E087F4AB" section-type="section-one"><enum>1.</enum><header>Restrictions</header><text display-inline="no-display-inline">The Secretary of Commerce may not—</text>
			<paragraph id="H0F745BAC067F4B288B30D6FC4DD88911"><enum>(1)</enum><text>discontinue the
			 Survey of Income and Program Participation,</text>
			</paragraph><paragraph id="H992BE2D43B84493FAE72C1A5E6DB91FF"><enum>(2)</enum><text>make any change in
			 the design or content of such Survey, or</text>
			</paragraph><paragraph id="H029D07FC1FDF4F189C2255795D4E8B07"><enum>(3)</enum><text>allow any of the
			 foregoing,</text>
			</paragraph></section><section id="LEXA-Repairid51DFC171B364471C9258A6DA1C7C1A31"><subsection id="LEXA-RepairidE69279D6381241E3A4209F1EB5151845"><enum></enum><continuation-text continuation-text-level="subsection">unless the
			 discontinuation or change involved has first been approved in accordance with
			 section 2.</continuation-text></subsection></section><section id="HB11A4A52B6234D058980ADDAA9D154E"><enum>2.</enum><header>Proposed
			 actions</header>
			<subsection id="HCC6BE365536545679896E83FCE4F9D73"><enum>(a)</enum><header>In
			 general</header><text>Whenever in the judgment of the Secretary of Commerce it
			 becomes necessary to discontinue the Survey of Income and Program Participation
			 or to make any change in the design or content of the Survey of Income and
			 Program Participation, he shall prepare a written proposal under this
			 subsection. Such proposal—</text>
				<paragraph id="HCA71EBEA913F446D0000C4958B34FCDE"><enum>(1)</enum><text>shall
			 include—</text>
					<subparagraph id="H0296D5A0F3A141ED9C13B883999838E9"><enum>(A)</enum><text>a description of
			 the specific actions proposed to be taken;</text>
					</subparagraph><subparagraph id="HE33C5DA471504D5D8F9F14253CE933A5"><enum>(B)</enum><text>the date or
			 schedule for their proposed implementation; and</text>
					</subparagraph><subparagraph id="H6E34457F778F4E27AA5C6E31C0067BF3"><enum>(C)</enum><text>the reasons or
			 justification for each proposed action; and</text>
					</subparagraph></paragraph><paragraph id="H7BB508761F27431DAE9674FCE5E3FC65"><enum>(2)</enum><text>shall be submitted
			 by the Secretary of Commerce to the SIPP Commission (established by section 3)
			 in such time, form, and manner as the Commission may require.</text>
				</paragraph></subsection><subsection id="HB7C180FA513A423F9BE1C4DD9CBB24"><enum>(b)</enum><header>Consideration and
			 decision</header><text>The SIPP Commission shall promptly consider any proposal
			 received under subsection (a) and, after appropriate deliberation, shall
			 transmit its decision to approve or disapprove such proposal to the Secretary
			 of Commerce in timely fashion. Any such decision shall be in writing and shall
			 include a statement of reasons and justification.</text>
			</subsection></section><section id="H2D428AB1E11F4C8D9EDBA5CBA6320968"><enum>3.</enum><header>Establishment of
			 Commission</header>
			<subsection id="HB00165A2A0C8495C80658EA089FBE00"><enum>(a)</enum><header>In
			 general</header><text>There is established a commission to be known as the
			 <quote>Commission on the Survey of Income and Program Participation</quote> (in
			 this Act referred to as the <quote>SIPP Commission</quote> or the
			 <quote>Commission</quote>).</text>
			</subsection><subsection id="HF656943DA0134236008D0289E7FEA346"><enum>(b)</enum><header>Composition</header><text>The
			 Commission shall be composed of—</text>
				<paragraph id="H8E5E72BAC8F147AF92DAA5EABD64E56"><enum>(1)</enum><text>the Director of the
			 Office of Management and Budget, who shall serve ex officio;</text>
				</paragraph><paragraph id="HFF251BCE2F6F4016A5B739ACC3694F55"><enum>(2)</enum><text>1
			 member from the Department of Agriculture, who shall be appointed by the
			 Secretary of Agriculture;</text>
				</paragraph><paragraph id="H0161671B41864C6F82A1F2B83629D70"><enum>(3)</enum><text display-inline="yes-display-inline">1 member from the Department of Labor, who
			 shall be appointed by the Secretary of Labor;</text>
				</paragraph><paragraph id="H5FD46172D053468B9011BFC103BEEC4"><enum>(4)</enum><text display-inline="yes-display-inline">1 member from the Department of Energy, who
			 shall be appointed by the Secretary of Energy;</text>
				</paragraph><paragraph id="HE31D9E381B5A4B85BE00CB0043E24C67"><enum>(5)</enum><text display-inline="yes-display-inline">1 member from the Department of Health and
			 Human Services, who shall be appointed by the Secretary of Health and Human
			 Services;</text>
				</paragraph><paragraph id="H998F92041ED04CACA0BD339105BD78D7"><enum>(6)</enum><text display-inline="yes-display-inline">1 member from the Social Security
			 Administration, who shall be appointed by the Commissioner of Social
			 Security;</text>
				</paragraph><paragraph id="H6BADA0A6FDE24FF88C080900431C797E"><enum>(7)</enum><text display-inline="yes-display-inline">1 member from the Bureau of the Census, who
			 shall be appointed by the Secretary of Commerce in consultation with the
			 Director of the Census; and</text>
				</paragraph><paragraph id="HCC26A1F9A5F34438B652C050F9662F4B"><enum>(8)</enum><text>2
			 members from the National Academy of Sciences, who shall be appointed by the
			 Director of the Office of Management and Budget from among individuals
			 recommended by the Council of the National Academy of Sciences.</text>
				</paragraph><continuation-text continuation-text-level="subsection">All
			 appointments to the Commission shall be made from among social scientists and
			 statisticians who have experience analyzing longitudinal household data on
			 economic well-being and participation in government programs.</continuation-text></subsection><subsection id="HB883A09D51D5421CAAB8DDCF9F40B190"><enum>(c)</enum><header>Terms of
			 appointees</header>
				<paragraph id="HB0A99D0D577F43AAB149A63E363E1900"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Except as provided in
			 paragraph (2), each member who is appointed to the Commission shall be
			 appointed for a term of 2 years.</text>
				</paragraph><paragraph id="H14915282DBA6457BBED2E350A060F593"><enum>(2)</enum><header>Vacancies</header>
					<subparagraph id="H3FC61AF138A74894AA10B100386287BA"><enum>(A)</enum><header>In
			 general</header><text>Any member appointed to fill a vacancy occurring before
			 the expiration of the term for which the member’s predecessor was appointed
			 shall be appointed only for the remainder of that term.</text>
					</subparagraph><subparagraph id="HE7AC36B5401B4B21BA56CF63C56D1F00"><enum>(B)</enum><header>Service after
			 term ends</header><text>A member may serve after the expiration of that
			 member’s term until a successor has taken office.</text>
					</subparagraph><subparagraph id="H63CBF0AC0D834BD7B78E41A6DBDE41D0"><enum>(C)</enum><header>Manner of
			 appointment</header><text>A vacancy among any of the appointed members shall be
			 filled in the manner in which the original appointment was made.</text>
					</subparagraph></paragraph></subsection><subsection id="H4B1256FF43444F97901B47F5005C4BEA"><enum>(d)</enum><header>Chairman</header><text>The
			 Director of the Office of Management and Budget shall serve as Chairman of the
			 Commission.</text>
			</subsection><subsection id="HF6FC843025CA47A292EBDD82E1188613"><enum>(e)</enum><header>Functions</header>
				<paragraph id="H51A1A117BC8A4E7DAB0752176EFD8427"><enum>(1)</enum><header>In
			 general</header><text>It shall be the function of the Commission to consider
			 and act on any proposal relating to the Survey of Income and Program
			 Participation (described in section 2(a)) in accordance with section
			 2(b).</text>
				</paragraph><paragraph id="HFD9840C57D2D47F1A3E3EB0384CC9739"><enum>(2)</enum><header>Nondelegable
			 functions</header><text>The functions of the Director of the Office of
			 Management and Budget under this Act shall be nondelegable.</text>
				</paragraph></subsection><subsection id="HD966DAC93C234FB398BDE28BF7ACC84B"><enum>(f)</enum><header>Procedures</header><text display-inline="yes-display-inline">The Commission shall meet at the call of
			 the Chairman of the Commission. A majority of the members of the Commission who
			 are eligible to vote shall constitute a quorum. All members except those under
			 paragraphs (1) and (8), respectively, of subsection (b) shall be eligible to
			 vote.</text>
			</subsection><subsection id="HA8B0A03D157B46ABB431001B01631E39"><enum>(g)</enum><header>Compensation</header><text>Members
			 of the Commission shall serve as such without pay, but shall be allowed travel
			 expenses, including a per diem allowance in lieu of subsistence, in the same
			 manner as persons serving intermittently in Government service are allowed
			 travel expenses under <external-xref legal-doc="usc" parsable-cite="usc/5/5703">section 5703</external-xref> of title 5, United States Code.</text>
			</subsection></section><section id="HF6D2398C19A840179F7D48028D6C8500"><enum>4.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">This Act shall take
			 effect as of the date of the enactment of this Act or September 30, 2006,
			 whichever is earlier.</text>
