		<section id="HFAF702E755494AB6A1F11FF5EEB27DD4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Criminal Terrorism Improvements Act of
			 2006</short-title></quote>.</text>
		</section><section id="H03D6F7D657824B069EA637A158005381"><enum>2.</enum><header>Terrorist offense
			 resulting in death</header>
			<subsection id="HC17DD3C9EAEA4C37A43EAB837CC9E27"><enum>(a)</enum><header>New
			 offense</header><text display-inline="yes-display-inline">Chapter 113B of title
			 18, United States Code, is amended by adding at the end the following:</text>
				<quoted-block id="HDEAC352E34C74BF1B3E6ED102996CBF" style="USC">
					<section id="HC0C15B46CAF44FD4B35848971DD82C53"><enum>2339E.</enum><header>Terrorist
				offenses resulting in death</header>
						<subsection id="H4142758247874CA6AC13E0F1705299F5"><enum>(a)</enum><text>Whoever, in the
				course of committing a terrorist offense, engages in conduct that results in
				the death of a person, shall be punished by death or imprisoned for any term of
				years or for life.</text>
						</subsection><subsection id="H95D9DCBA2C4A46EEAB02B3004CD7E214"><enum>(b)</enum><text>As used in this
				section, the term <quote>terrorist offense</quote> means—</text>
							<paragraph id="H9402412186224FCAB0DEC9EC3B07E115"><enum>(1)</enum><text>a felony offense
				that is—</text>
								<subparagraph id="HEFE59BA41B614D18BD354D9D51DB603B"><enum>(A)</enum><text>a Federal crime of
				terrorism as defined in section 2332b(g), other than an offense under section
				1363; or</text>
								</subparagraph><subparagraph id="H939D787D3E9E45C89CF9B9C5EC00D300"><enum>(B)</enum><text>an offense under
				this chapter, section 175, 175b, 229, or 831, or section 236 of the Atomic
				Energy Act of 1954; or</text>
								</subparagraph></paragraph><paragraph id="HD2DA7D4A1DE94EFB91156EFD716EBFD"><enum>(2)</enum><text>a Federal offense
				that is an attempt or conspiracy to commit an offense described in paragraph
				(1).</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H1C593BE5FC824E61B5F32679F84AEDD"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of sections at the beginning of chapter 113B
			 of title 18, United States Code, is amended by adding at the end the following
			 new item:</text>

						<toc-entry level="section">2339E. Terrorist offenses resulting in

			</subsection></section><section id="HDCC3C6C2C3CD46678E00DE2CED7549C9"><enum>3.</enum><header>Death penalty for
			 certain terror related crimes</header>
			<subsection id="HBA334837495F4714AFCEF80078E3C860"><enum>(a)</enum><header>Participation in
			 nuclear and weapons of mass destruction threats to the United
			 States</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/832">Section 832(c)</external-xref> of title 18, United States Code, is amended
			 by inserting <quote>punished by death if death results to any person from the
			 offense, or</quote> after <quote>shall be</quote>.</text>
			</subsection><subsection id="H33594B37AF3B4C6F827EAD1F5FAA2CF6"><enum>(b)</enum><header>Missile systems
			 to destroy aircraft</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/2332g">Section 2332g(c)(3)</external-xref> of title 18, United
			 States Code, is amended by inserting <quote>punished by death or</quote> after
			 <quote>shall be</quote>.</text>
			</subsection><subsection id="HB6515B3CDB774D27B3DE519BD281AEFF"><enum>(c)</enum><header>Atomic
			 weapons</header><text>The last sentence of section 222 b. of the Atomic Energy
			 Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2272">42 U.S.C. 2272</external-xref>) is amended by inserting <quote>death or</quote>
			 before <quote>imprisonment for life</quote> the last place it appears.</text>
			</subsection><subsection id="HFB350CF004A5413C83FCDD597700B893"><enum>(d)</enum><header>Radiological
			 dispersal devices</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/2332h">Section 2332h(c)(3)</external-xref> of title 18, United States
			 Code, is amended by inserting <quote>death or</quote> before
			 <quote>imprisonment for life</quote>.</text>
			</subsection><subsection id="HC1CF62024DA64FD993A0EB28E0ACA903"><enum>(e)</enum><header>Variola
			 virus</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/175c">Section 175c(c)(3)</external-xref> of title 18, United States Code, is
			 amended by inserting <quote>death or</quote> before <quote>imprisonment for
			 life</quote>.</text>
			</subsection></section><section id="HA1351F2DD8DB4DD39B02951E938F3B7E"><enum>4.</enum><header>Increase in
			 certain penalties</header>
			<subsection id="HEB9ACA08AB754E37B200FDFACE3136F"><enum>(a)</enum><header>Section
			 2332<enum-in-header>(b)</enum-in-header>(1)</header><text>Section 2332(b)(1) of
			 title 18, United States Code, is amended by striking <quote>20 years</quote>
			 and inserting <quote>30 years</quote>.</text>
			</subsection><subsection id="HFF7FE5A2CDEE4E27AF60977E3EC7AC41"><enum>(b)</enum><header>Section
			 2332<enum-in-header>(c)</enum-in-header></header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/2332">Section 2332(c)</external-xref> of title 18, United States
			 Code, is amended by striking <quote>ten years</quote> and inserting <quote>20
			 years</quote>.</text>
			</subsection><subsection id="H15413B8F4FC94DBCB22B1388E35936E8"><enum>(c)</enum><header>Section
			 2339C<enum-in-header>(d)</enum-in-header></header><text>Section 2339C(d) of
			 title 18, United States Code, is amended—</text>
				<paragraph id="H1208E4174CC146A28C4D755B5303963B"><enum>(1)</enum><text>in paragraph (1),
			 by striking <quote>20 years</quote> and inserting <quote>30 years</quote>;
			 and</text>
				</paragraph><paragraph id="H3343838C61AE46B98699F1CC9DE6B94"><enum>(2)</enum><text>in
			 paragraph (2), by striking <quote>10 years</quote> and inserting <quote>20
			 years</quote>.</text>
				</paragraph></subsection></section><section id="HAF2C44BFF23142E28F9756946D8B8616"><enum>5.</enum><header>Modernization of
			 state of mind requirement for section 2339C offenses</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/2339C">Section 2339C</external-xref> of title 18, United States
			 Code, is amended by striking <quote>unlawfully and wilfully</quote> and
			 inserting <quote>knowingly</quote>.</text>
		</section><section display-inline="no-display-inline" id="HE4D089274D2F41D0B643ECE8FBDBD2BF" section-type="subsequent-section"><enum>6.</enum><header>Providing material
			 support to terrorist groups</header>
			<subsection id="HAB127ED2B87C486CAFAFF4F40200CDF5"><enum>(a)</enum><header>Providing
			 material support to terrorists</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/2339A">Section 2339A(a)</external-xref> of title 18,
			 United States Code, is amended by striking <quote>, imprisoned not more than 15
			 years,</quote> and all that follows through <quote>life.</quote> and inserting
			 <quote>and imprisoned for not less than 10 years or for life, and, if the death
			 of any person results, shall be imprisoned for not less than 30 years or for
			 life.</quote>.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H584A17F0C74F4C70BFCB94D3118BE342"><enum>(b)</enum><header>Receiving
			 Military-Type training from a foreign terrorist
			 organization</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/2339D">Section 2339D</external-xref> of title 18, United States Code, is
			 amended by striking <quote>or imprisoned for ten years, or both.</quote> and
			 inserting <quote>and imprisoned for not less than 3 years and not more than 15
			 years.</quote>.</text>
			</subsection></section><section display-inline="no-display-inline" id="H33C09347F51D4C1FA8647E0050785B58" section-type="subsequent-section"><enum>7.</enum><header>Denial of Federal
			 benefits to convicted terrorists</header>
			<subsection id="H4DE0A257C46D436D9B7B49A59254F823"><enum>(a)</enum><header>In
			 general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/113B">Chapter 113B</external-xref> of title 18, United States Code, is amended
			 by adding at the end the following:</text>
				<quoted-block id="H52E0F4D262164D41A5DA24F8711ED919" style="USC">
					<section id="H7E2CB795C7094205A5C7700B688E2E0"><enum>2339F.</enum><header>Denial of
				Federal benefits to terrorists</header>
						<subsection id="H7E15451D579E44D6B5CFD754C5678BDE"><enum>(a)</enum><header>In
				general</header><text>Any individual who is convicted of a Federal crime of
				terrorism (as defined in section 2332b(g)) shall, as provided by the court on
				motion of the Government, be ineligible for any or all Federal benefits for any
				term of years or for life.</text>
						</subsection><subsection id="H71D332A8A6A44CB2B361C4F279A94900"><enum>(b)</enum><header>Federal benefit
				defined</header><text>As used in this section, <quote>Federal benefit</quote>
				has the meaning given that term in section 421(d) of the
				<act-name parsable-cite="CSA">Controlled Substances Act</act-name> (21 U.S.C.
				862(d)).</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HEDFE63D5E2934EE4956486419F66A5B"><enum>(b)</enum><header>Table of sections
			 amendment</header><text>The table of sections of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/113B">chapter 113B</external-xref> of title 18,
			 United States Code, is amended by inserting at the end the following:</text>

			 predicate</header><text display-inline="no-display-inline">Section 2516(q) of
			 title 18, United States Code, is amended by striking <quote>section
			 2332</quote> and all that follows through <quote>2339C</quote> and inserting
			 <quote>chapter 113B</quote>.</text>
		</section><section id="H9F13F6BE22E941EA943C563F45E41587"><enum>9.</enum><header>Addition of
			 attempts and conspiracies to an offense relating to military
			 training</header><text display-inline="no-display-inline">Section 2339D of
			 title 18, United States Code, is amended by inserting <quote>, or attempts or
			 conspires to receive,</quote> after <quote>receives</quote>.</text>
