Title II—Educational Technology Funding
Sec. 201. Educational technology funding.
3.The Congress finds the following:
(1)The average public
school building was built in the early 1960’s.
(2)Of
the Nation’s public school buildings, at least one-third need extensive repair
or replacement and two-thirds have troublesome environmental conditions such as
the presence of asbestos or lead in water and paint.
(3)In its 2005 report
card on the Nation’s physical infrastructure, the American Society of Civil
Engineers gave our schools a D.
(4)The Nation’s
public schools need hundreds of billions of dollars in construction,
modernization, and repair to bring them up to modern structural, educational
(including educational technology and educational technology infrastructure),
and health standards.
(5)Improving the
quality of public elementary and secondary school facilities to make them safe,
healthy, high-performing, and up-to-date technologically will help students
improve their academic performance and will improve teacher retention.
(6)Improving the
quality of public elementary and secondary school facilities is a matter of
national importance, and the Federal government must do more to help States and
school districts fulfill their responsibilities in this area.
4.In this Act:
(1)The term
Bureau-funded school has the meaning given to such term in section
1141 of the Education Amendments of 1978 (25 U.S.C. 2021).
(2)The term
charter school has the meaning given such term in section 5210 of
the Elementary and Secondary Education Act of 1965 (20 U.S.C. 7221i).
(3)The term
local educational agency—
(A)has the meaning
given to that term in section 9101 of the Elementary and Secondary Education
Act of 1965 (20 U.S.C. 7801); and
(B)includes any public charter school that
constitutes a local educational agency under State law.
(4)The term outlying area—
(A)means the United
States Virgin Islands, Guam, American Samoa, and the Commonwealth of the
Northern Mariana Islands; and
(B)includes the
freely associated states of the Republic of the Marshall Islands, the Federated
States of Micronesia, and the Republic of Palau.
(5)The term
Secretary means the Secretary of Education.
(6)The term
State means each of the 50 States, the District of Columbia, and
the Commonwealth of Puerto Rico.
<enum>I</enum><header>21st
Century High-Performing Public School Facilities</header>
<subtitle id="H109D08D8CEE844BCBC6BA8008067DBF"><enum>A</enum><header>Grants for
construction, modernization, or repair of school facilities</header>
<section id="H93598EDB7F144337997461EC01A03810"><enum>101.</enum><header>Grants</header><text display-inline="no-display-inline">Each fiscal year, the Secretary of Education
shall make grants to local educational agencies in each State for the purpose
of constructing, modernizing, or repairing public kindergarten, elementary, and
secondary educational facilities that are safe, healthy, high-performing, and
up-to-date technologically.</text>
</section><section id="HECE3608394DA4730B1A5F2B573FDCFBA"><enum>102.</enum><header>Allocation of
funds</header>
<subsection id="H2E544EA3E57F4039B2DDC3F342771F"><enum>(a)</enum><header>Reservation</header><text>From
the amount appropriated to carry out this subtitle for each fiscal year
pursuant to section 127, the Secretary shall reserve 1 percent of such amount,
consistent with the purpose described in section 101—</text>
<paragraph id="H37DF69CB6DDF4B0900E59331A10058F2"><enum>(1)</enum><text>to provide
assistance to the outlying areas; and</text>
</paragraph><paragraph id="H8464C33809574691B50056CB7BCC969D"><enum>(2)</enum><text display-inline="yes-display-inline">for payments to the Secretary of the
Interior to provide assistance to Bureau-funded schools.</text>
</paragraph></subsection><subsection id="H6B4CE7D54AFA467C8E72555EE6E5EDE4"><enum>(b)</enum><header>Allocation of
grants</header>
<paragraph id="H0BAF9FC420C84E9EAA5F484E7E7DBC5"><enum>(1)</enum><header>State-by-State
allocation</header><text>From the amount appropriated to carry out this
subtitle for each fiscal year pursuant to section 127, and not reserved under
subsection (a), the Secretary shall reserve for grants to local educational
agencies in each State an aggregate amount in proportion to the aggregate
amount received by all local educational agencies in the State involved under
part A of title I of the Elementary and Secondary Education Act of 1965 (20
U.S.C. 6311 et seq.) for the previous fiscal year relative to the total amount
received by all local educational agencies in every State under such part for
such fiscal year.</text>
</paragraph><paragraph id="HD896A8E462EC4CC1BFF2007492EC5CBD"><enum>(2)</enum><header>Within-State
Allocation</header><text display-inline="yes-display-inline">From the amount
reserved for grants to local educational agencies in a State under paragraph
(1), the Secretary shall reserve for grants to local educational agencies in
the State that are receiving assistance under section 1124A of the Elementary
and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6334">20 U.S.C. 6334</external-xref>) an aggregate amount that
is at least in proportion to the aggregate amount received by such local
educational agencies under part A of title I of the Elementary and Secondary
Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311 et seq.</external-xref>) for the previous fiscal year
relative to the total amount received by all local educational agencies in the
State under such part for such fiscal year.</text>
</paragraph></subsection></section><section id="HA4F8C2FA3D8241DF845610763BED00C9"><enum>103.</enum><header>Priority;
criteria for awarding grants</header>
<subsection display-inline="no-display-inline" id="H17428AAB92D4403FA07B00E6B05D3252"><enum>(a)</enum><header>Priority</header><text>In
awarding grants to local educational agencies under this subtitle, the
Secretary shall give priority to local educational agencies with
greater—</text>
<paragraph id="H4CAD865E46394089AA629CFF97F0BA90"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H2D6985356BD74D8AAB90359C99BAD289"><enum>(A)</enum><text>numbers of children
counted under section 1124(c) of the Elementary and Secondary Education Act of
1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6333">20 U.S.C. 6333(c)</external-xref>); or</text>
</subparagraph><subparagraph id="H65A7C79689394D8493EE37244EF6BEC" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">percentages of children served who are
counted under section 1124(c) of the Elementary and Secondary Education Act of
1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6333">20 U.S.C. 6333(c)</external-xref>); and</text>
</subparagraph></paragraph><paragraph id="H40C9AFFA85794FA20000801F3D927F7E"><enum>(2)</enum><text>need for school
construction, modernization, or repair, as demonstrated by the condition of the
public school facilities.</text>
</paragraph></subsection><subsection id="H5F6189FD963B46E4A188E01412BBB86D"><enum>(b)</enum><header>Criteria</header><text display-inline="yes-display-inline">In awarding grants to local educational
agencies under this subtitle, the Secretary shall also consider the following
criteria:</text>
<paragraph id="H2635C0E458F046EFA94BDA3997A0349E"><enum>(1)</enum><text>The fiscal
capacity of a local educational agency to meet its needs for construction,
modernization, and repair of public school facilities without assistance under
this subtitle, including the ability of the local educational agency to raise
funds through the use of local bonding capacity and otherwise.</text>
</paragraph><paragraph id="HAD2AE789604540F1B66DB7C9C3150028"><enum>(2)</enum><text>In the case of a
local educational agency that proposes to fund a construction, modernization,
or repair project for one or more public charter schools, the extent to which
the schools have access to funding for the project through the financing
methods available to other public schools or local educational agencies in the
State.</text>
</paragraph><paragraph id="H46775D520AA4461597DF003FE2C13850"><enum>(3)</enum><text>The likelihood
that the local educational agency will maintain, in good condition, any
facility whose construction, modernization, or repair is assisted under this
subtitle.</text>
</paragraph><paragraph id="HEAF9EAC4DC9A4B77B2B524F3EF2EDDAC"><enum>(4)</enum><text>The local
educational agency’s plan to obtain private business contributions described in
<external-xref legal-doc="usc" parsable-cite="usc/26/1397E">section 1397E(d)(2)(B)</external-xref> of the Internal Revenue Code of 1986 (26 U.S.C.
1397E(d)(2)(B)), except that an otherwise qualified local educational agency
shall not be denied a grant as a result of its inability to obtain such
contributions despite its good faith efforts.</text>
</paragraph></subsection></section><section id="HE2992FB07E5E4655A9AEF7BF4F8B2EF0"><enum>104.</enum><header>Authorized
matching requirement</header>
<subsection id="H10E227ADE5BC40FAA23ECBB29312D79C"><enum>(a)</enum><header>In
general</header><text>The Secretary shall require a local educational agency to
contribute matching funds toward the costs of the program to be carried out
with a grant received by the agency under this subtitle.</text>
</subsection><subsection id="H3A370C7B86D947019FF66400B130389C"><enum>(b)</enum><header>Match
amount</header><text>The Secretary shall establish the amount of matching funds
to be provided by a local educational agency under this section by using a
sliding scale that takes into account the relative poverty of the population
served by the local educational agency.</text>
</subsection><subsection id="HB1C96D5A68614BE4A5445CB300D17F00"><enum>(c)</enum><header>Determination of
amount contributed</header><text>The Secretary shall allow a local educational
agency to satisfy the requirement of this section through in-kind
contributions.</text>
</subsection></section><section id="HD303BFFB549F4408B016ECC367353EEA"><enum>105.</enum><header>Allowable uses
of funds</header><text display-inline="no-display-inline">A local educational
agency receiving a grant under this subtitle may use the grant for the
following:</text>
<paragraph id="HE600CD1EB9594D53ABD0E454B9D0B6BE"><enum>(1)</enum><text>Repair or
modernization of public school facilities to ensure the health and safety of
students and staff, including—</text>
<subparagraph id="H1786D228AD0441E896D217FCE06B9B14"><enum>(A)</enum><text>repairing,
replacing, or installing roofs, electrical wiring, plumbing systems, sewage
systems, windows, or doors;</text>
</subparagraph><subparagraph id="HEA04CDB222F84399BD84E712184F0D4"><enum>(B)</enum><text>repairing,
replacing, or installing heating, ventilation, or air conditioning systems
(including insulation); and</text>
</subparagraph><subparagraph id="HA2FF34E37E204019BF227D35EE744FF1"><enum>(c)</enum><text>bringing public
schools into compliance with fire and safety codes.</text>
</subparagraph></paragraph><paragraph id="HA451C9FDA14D48F7A5F810A699589275"><enum>(2)</enum><text>Modifications
necessary to make public school facilities accessible to comply with the
Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12101">42 U.S.C. 12101 et seq.</external-xref>) and section
504 of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/794">29 U.S.C. 794</external-xref>), except that such
modifications shall not be the primary use of the grant.</text>
</paragraph><paragraph id="HA850F8C9C7D3487386ADA91FE288B2C7"><enum>(3)</enum><text>Asbestos abatement
or removal from public school facilities.</text>
</paragraph><paragraph id="HEDDA52BE3E41446CA1D91D13EB33F4F2"><enum>(4)</enum><text>Implementation of
measures designed to reduce or eliminate human exposure to lead-based paint
hazards though methods including interim controls, abatement, or a combination
of each.</text>
</paragraph><paragraph id="H86EDE52B92354DBFA0EC00113951B769"><enum>(5)</enum><text display-inline="yes-display-inline">Upgrading or installation of educational
technology and educational technology infrastructure to ensure that students
have access to up-to-date educational technology.</text>
</paragraph><paragraph id="HD3AE26A7EEDC4C028CE3099C90992017"><enum>(6)</enum><text>Upgrading school
facilities to make them energy-efficient.</text>
</paragraph><paragraph id="HDC87AB33DD3E49EDBBA4D1E5B6448424"><enum>(7)</enum><text>Construction of
new school facilities that ensure the health and safety of students and staff,
are energy-efficient, and include up-to-date educational technology and
educational technology infrastructure, including where such construction is
economically or otherwise more feasible than large scale modernization or
repair of existing facilities.</text>
</paragraph></section><section commented="no" id="H17982F12575D4BDDB6617E4FBB26565D"><enum>106.</enum><header>Application for
grant</header>
<subsection commented="no" id="HC3A542805D9E4BA183504567A369E4D7"><enum>(a)</enum><header>Applications
required</header><text>A local educational agency desiring to receive a grant
under this subtitle shall submit an application to the Secretary as such time,
in such manner, and containing such information as the Secretary may reasonably
require.</text>
</subsection><subsection commented="no" id="H38BA39C8AA8E40B882FFDB3D7C002DBE"><enum>(b)</enum><header>Application
contents</header><text>Each application described in subsection (a) shall
contain—</text>
<paragraph commented="no" id="HC30047FFD88740FAA0885B9826A681FE"><enum>(1)</enum><text>an assurance that
the application was developed in consultation with parents and classroom
teachers;</text>
</paragraph><paragraph commented="no" id="HBB6A13ADF06043139409CF7CDDBB94B1"><enum>(2)</enum><text>a description of
the overall condition of the local educational agency’s school facilities,
including health and safety problems;</text>
</paragraph><paragraph commented="no" id="H9FE96FA868134D0187FACD8CE0605F9B"><enum>(3)</enum><text>a description of
the capacity of the local educational agency’s schools to house current and
projected enrollments;</text>
</paragraph><paragraph commented="no" id="HB78A5A7F8F71486A8D88ED824411F06"><enum>(4)</enum><text>a description of
the extent to which the local educational agency’s schools offer the physical
infrastructure, including for educational technology, needed to provide all
students a high-quality education;</text>
</paragraph><paragraph commented="no" id="HFEFBD264479347239C24BAF06700C4CC"><enum>(5)</enum><text>a description of
the improvements to be supported with funds provided under this
subtitle;</text>
</paragraph><paragraph commented="no" id="H78775F581F7D477398B6444105FB6F3B"><enum>(6)</enum><text>a cost estimate of
the proposed improvements;</text>
</paragraph><paragraph commented="no" id="HB716425BFB8A4D5F81633D83F258F563"><enum>(7)</enum><text>an identification
of other resources that are available to carry out the activities for which
funds are requested under this subtitle; and</text>
</paragraph><paragraph commented="no" id="H5D6ACE20CACE4E5A005BA7159600F69"><enum>(8)</enum><text>such other
information and assurances as the Secretary may reasonably require.</text>
</paragraph></subsection></section></subtitle><subtitle id="HA0CED7F3E4F24614825D3FE6F6095D34"><enum>B</enum><header>Low-interest loans
for construction, modernization, or repair of school facilities </header>
<section id="HA5C59F06446349CF8F2DD39BCEBED6F"><enum>111.</enum><header>Low-interest
loans</header>
<subsection id="H77635363EB43430BB176A0C4C9DECFDB"><enum>(a)</enum><header>Authority and
conditions for loans</header><text display-inline="yes-display-inline">Each
fiscal year, the Secretary shall make low-interest loans to local educational
agencies for the construction, modernization, or repair of public kindergarten,
elementary, and secondary educational facilities that are safe, healthy,
high-performing, and up-to-date technologically.</text>
</subsection><subsection id="H00D68C72D6E94763AF29028DCDC61181"><enum>(b)</enum><header>Priority;
Criteria for approving loans</header>
<paragraph id="H92032BE81C5444A5A1A6799906DE6372"><enum>(1)</enum><header>Priority</header><text display-inline="yes-display-inline">In making loans under this subtitle, the
Secretary shall give priority to local educational agencies described in
section 103(a).</text>
</paragraph><paragraph id="HB5429FAF4DBC41EC008E99FC66EAB527"><enum>(2)</enum><header>Criteria</header><text>In
making loans under this subtitle, the Secretary shall also consider the
criteria specified in section 103(b).</text>
</paragraph></subsection><subsection id="H82E7258912CD46EABFB965E68B3FAD3B"><enum>(c)</enum><header>Allowable uses
of funds</header><text display-inline="yes-display-inline">A local educational
agency receiving a loan under this subtitle may use the loan for any of the
activities described in section 105.</text>
</subsection><subsection id="H1AD72A8216604C869806C60005BE2C1C"><enum>(d)</enum><header>Amount and
conditions of loans</header><text>In making loans under this subtitle, the
Secretary shall ensure that—</text>
<paragraph id="H1515163E83F9490B93E1C558D352DB9C"><enum>(1)</enum><text>the amount of a
loan does not exceed the total construction, modernization, or repair costs
involved, as determined by the Secretary; and</text>
</paragraph><paragraph id="HA2E1B9766BEB4788AE008FD74F80764B"><enum>(2)</enum><text>the loan is
secured in such manner and must be repaid within such period, not exceeding 30
years, as may be determined by the Secretary.</text>
</paragraph></subsection></section><section id="HE089443204AB4419AFF6A09D7C4426CB"><enum>112.</enum><header>Revolving
fund</header>
<subsection id="H0558B7B325004AAAA9AB0025C1517986"><enum>(a)</enum><header>Establishment</header><text>There
is established in the Treasury a revolving fund to be known as the School
Construction, Modernization, and Repair Revolving Fund (in this section
referred to as the <quote>revolving fund</quote>).</text>
</subsection><subsection id="HB79DB40E98934720A7DC536441299B00"><enum>(b)</enum><header>Contents of
fund</header><text>The revolving fund shall consist of—</text>
<paragraph id="HAB565D36768A4D34B44583BF7688BE7C"><enum>(1)</enum><text>any amounts
derived from the loan program carried out under this subtitle; and</text>
</paragraph><paragraph id="H6C966EF72CA140E0A894D618D2FFAAE"><enum>(2)</enum><text>any amounts
appropriated to carry out this subtitle pursuant to section 127.</text>
</paragraph></subsection><subsection id="H2D07A82F7D684526A5B30BBE740B114"><enum>(c)</enum><header>Availability</header><text>The
revolving fund shall be available to the Secretary, in amounts specified in
appropriations Acts and without fiscal year limitation, to carry out this
subtitle.</text>
</subsection></section></subtitle><subtitle id="H487601AFB5464C6CB03C63163C66BC64"><enum>C</enum><header>General
provisions</header>
<section id="H246A5762CDB949C09607812882833E57"><enum>121.</enum><header>Impermissible
uses of funds</header><text display-inline="no-display-inline">No funds
received under this title may be used for—</text>
<paragraph id="HF81849F3A82E48BC8EA1B4D56DE82937"><enum>(1)</enum><text>payment of
maintenance costs; or</text>
</paragraph><paragraph id="HA87617E2C35744CC8658AE228F05CB36"><enum>(2)</enum><text>stadiums or other
facilities primarily used for athletic contests or exhibitions or other events
for which admission is charged to the general public.</text>
</paragraph></section><section id="H9BB985D6D65C4A0D845E427DA5B2AB00"><enum>122.</enum><header>Supplement, not
supplant</header><text display-inline="no-display-inline">A local educational
agency receiving a grant under subtitle A or a loan under subtitle B shall use
such Federal funds only to supplement and not supplant the amount of funds that
would, in the absence of such Federal funds, be available for construction,
modernization, and repair of public kindergarten, elementary, and secondary
educational facilities.</text>
</section><section id="H7FBE13B785D34EA18F74245E5F82F291"><enum>123.</enum><header>Maintenance of
effort</header><text display-inline="no-display-inline">A local educational
agency may receive a grant under subtitle A or a loan under subtitle B for any
fiscal year only if the Secretary finds that either the combined fiscal effort
per student or the aggregate expenditures of the agency and the State involved
with respect to the provision of free public education by the agency for the
preceding fiscal year was not less than 90 percent of the combined fiscal
effort or aggregate expenditures for the second preceding fiscal year.</text>
</section><section id="H19A6E276065545B700C0DB009780E8C2"><enum>124.</enum><header>Special
rule</header><text display-inline="no-display-inline">Each local educational
agency receiving a grant under subtitle A or a loan under subtitle B shall
ensure that, if the agency carries out construction, modernization, or repair
through a contract, the process for any such contract ensures the maximum
number of qualified bidders, including small, minority, and women-owned
businesses, through full and open competition.</text>
</section><section id="H76A4DED096D34D43B9A9F6F9CBDD285F"><enum>125.</enum><header>Application of
GEPA</header><text display-inline="no-display-inline">The grant program under
subtitle A and the loan program under subtitle B are applicable programs (as
that term is defined in section 400 of the General Education Provisions Act (20
U.S.C. 1221)) subject to section 439 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1232b">20 U.S.C. 1232b</external-xref>).</text>
</section><section id="H947B3D825B5B48F8858CC0F4FD3A92D"><enum>126.</enum><header>Reporting</header>
<subsection id="HDD5873AA40D4474E9749902463885CEB"><enum>(a)</enum><header>Reports by local
educational agencies</header><text display-inline="yes-display-inline">Not
later than December 31 of each fiscal year, each local educational agency
receiving a grant under subtitle A or a loan under subtitle B shall submit to
the Secretary a report on the agency’s use of such grant or loan funds.</text>
</subsection><subsection id="H04CBA1E062B14C6B9D71E26A73331D"><enum>(b)</enum><header>Reports by
Secretary</header><text display-inline="yes-display-inline">Not later than
December 31 of each fiscal year, the Secretary shall submit to the Committee on
Education and the Workforce of the House of Representatives and the Committee
on Health, Education, Labor, and Pensions of the Senate a report on grants and
loans made under this title, including the Secretary’s efforts pursuant to
sections 103(a) and 111(b)(1), the types of construction, modernization, and
repair funded, and the number of students impacted, including the number of
students counted under section 1124(c) of the Elementary and Secondary
Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6333">20 U.S.C. 6333(c)</external-xref>).</text>
</subsection></section><section id="HF29E79484D1C49758000D39C74B1EEB"><enum>127.</enum><header>Authorization of
appropriations</header>
<subsection id="H99B5CCDF7A3543899C17008F7975EBBF"><enum>(a)</enum><header>In
general</header><text display-inline="yes-display-inline">To carry out
subtitles A, B, and C of this title, there are authorized to be appropriated
$6,400,000,000 for fiscal year 2007 and such sums as may be necessary for each
of fiscal years 2008 through 2011.</text>
</subsection><subsection id="H5FAC18AF70824155A37568607CAB53EE"><enum>(b)</enum><header>Allocation</header><text>Of
the amount appropriated pursuant to this section for each fiscal year—</text>
<paragraph id="H6D4491E0EC1747419BF4AFC5E68C96DB"><enum>(1)</enum><text>not less than 85
percent shall be reserved to carry out subtitle A; and</text>
</paragraph><paragraph id="HBCCE3BCBF14841B6B528A95286EFF1DB"><enum>(2)</enum><text>not more than 15
percent may be reserved to carry out subtitle B.</text>
</paragraph></subsection></section></subtitle><enum>II</enum><header>Educational
Technology Funding</header>
<section id="HE1E4F3B4B2E5405EBFF12118A5D9492F"><enum>201.</enum><header>Educational
technology funding</header><text display-inline="no-display-inline">Section
2404(a) of the Elementary and Secondary Education Act of 1965 (20 U.S.C.
6754(a)) is amended to read as follows:</text>
<quoted-block display-inline="no-display-inline" id="H877A7946766D46B89EB0DD00CD85D12" style="OLC">
