		<section display-inline="no-display-inline" id="HCF9F67D80DA746108E4B8FDCC8FFB5C0" section-type="section-one"><enum>1.</enum><header>Private disaster
			 loans</header>
			<subsection id="H2C0FDE1508C949E6B98F668F9D5D3CC"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 7 of the
			 Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636</external-xref>) is amended—</text>
				<paragraph id="HACC892E9019C40B6BF01B6711CD9501"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsections (c) and (d) as
			 subsections (d) and (e), respectively; and</text>
				</paragraph><paragraph id="H3056A637AADC4266BB4C45BAA2650500"><enum>(2)</enum><text>by inserting after
			 subsection (b) the following:</text>
					<quoted-block display-inline="no-display-inline" id="HAFB572517D284B2991EDDACF00CFC62C" style="OLC">
						<subsection id="H0BCB144B8DCD4882A5BBDF43D5E34C5"><enum>(c)</enum><header>Private disaster
				loans</header>
							<paragraph id="H3A1945D851EC4AD5AE050037DBFD5D00"><enum>(1)</enum><header>Definitions</header><text>In
				this subsection—</text>
								<subparagraph id="H295328C79D564BE7BC30E8E99497CCFB"><enum>(A)</enum><text>the term
				<term>disaster area</term> means a county, parish, or similar unit of general
				local government in which a disaster was declared under subsection (b);</text>
								</subparagraph><subparagraph id="H11F7E4D4DB4243FAA23F333C0936F321"><enum>(B)</enum><text>the term
				<term>eligible small business concern</term> means a business concern that
				is—</text>
									<clause id="H7216AAB0E4934A3AB5E6F1B4FE646AF"><enum>(i)</enum><text>is
				a small business concern, as defined in this Act; or</text>
									</clause><clause id="H1C118B55E0F7463C802CD307455E991C"><enum>(ii)</enum><text>is a small
				business concern, as defined in section 103 of the Small Business Investment
				Act of 1958; and</text>
									</clause></subparagraph><subparagraph id="HE0DB89B7B42E49B2B0B4B56DEAF41563"><enum>(C)</enum><text>the term
				<term>qualified private lender</term> means any privately-owned bank or other
				lending institution that the Administrator determines meets the criteria
				established under paragraph (10).</text>
								</subparagraph></paragraph><paragraph id="H2159DD10BBCA4FAC86E64D3CB000022"><enum>(2)</enum><header>Authorization</header><text>The
				Administrator may guarantee timely payment of all principal and interest as
				scheduled on any loan issued—</text>
								<subparagraph id="HB7F4F4552001409DB2EEF56DB9009742"><enum>(A)</enum><text>by a qualified
				private lender to an eligible small business concern located in a disaster
				area; and</text>
								</subparagraph><subparagraph id="H736829D0635E4DF2ACAF06ED9D64C6B5"><enum>(B)</enum><text>during the
				24-month period beginning on the date on which the disaster area is
				designated.</text>
								</subparagraph></paragraph><paragraph id="H3E63DC8C17154494A734DE00AEE2AE23"><enum>(3)</enum><header>Use of
				loans</header><text>A loan guaranteed by the Administrator under this
				subsection may be used for—</text>
								<subparagraph id="H25C47F5E011A4E369BC34B852E6E3914"><enum>(A)</enum><text>any purpose
				authorized under subsection (a) or (b); and</text>
								</subparagraph><subparagraph id="H379218DDDF08482CA57068E1102502F9"><enum>(B)</enum><text>acquiring or
				developing real estate for the purpose of selling or renting such real
				estate.</text>
								</subparagraph></paragraph><paragraph id="H1350303F86E246DD8C12F2BE8D2919D"><enum>(4)</enum><header>Online
				applications</header>
								<subparagraph id="H8E8B76BA9BF74B46B211C800100357E5"><enum>(A)</enum><header>In
				general</header>
									<clause id="HFB551D76F7AA45D09CDCFCE25168839F"><enum>(i)</enum><header>Establishment</header><text>The
				Administrator may establish, directly or through an agreement with another
				entity, an online application process for loans guaranteed under this
				subsection.</text>
									</clause><clause id="HD6302CDFCED64FB29788026DB5A5BFC9"><enum>(ii)</enum><header>Other Federal
				assistance</header><text>The Administrator may coordinate with the head of any
				other appropriate Federal agency so that any application submitted through an
				online application process established under clause (i) may be considered for
				any other Federal assistance program for disaster relief.</text>
									</clause></subparagraph><subparagraph id="H9782D4A408EA42FDA7B8D6D92D4BECAA"><enum>(B)</enum><header>Contents</header>
									<clause id="HD245C32FDCDD49BDA0F967008039A216"><enum>(i)</enum><header>In
				general</header><text>An online application process established under
				subparagraph (A) shall allow an applicant for a guarantee under this subsection
				to specify the qualified private lender from which the applicant seeks to
				obtain a loan.</text>
									</clause><clause id="HD273D8641484418C00481DEDF2EC4B23"><enum>(ii)</enum><header>Offers for
				loans</header>
										<subclause id="H1825358758FD4DAABF610026D59FE6E2"><enum>(I)</enum><header>In
				general</header><text>If an applicant does not specify a qualified private
				lender under clause (i), any qualified private lender may be selected to or opt
				to consider the application.</text>
										</subclause><subclause id="H4BBC6B858D5043F084C100FCC55E2401"><enum>(II)</enum><header>Process</header><text>The
				Administrator may, via the online process or another predetermined and
				objective process, determine a means of distributing or otherwise making
				available for consideration applications where a qualified private lender has
				not been specified by the applicant.</text>
										</subclause></clause></subparagraph></paragraph><paragraph id="H8170E50286584A6C9B3D68EB777831B5"><enum>(5)</enum><header>Refinancing</header><text>A
				loan guaranteed under this subsection may be used to refinance any debt under
				this Act or the Small Business Investment Act of 1958.</text>
							</paragraph><paragraph id="HEBD63A241A8A41C7A0872CC1936C9FBF"><enum>(6)</enum><header>Maximum
				amounts</header>
								<subparagraph id="HFBD56868160B47B0AC00AACF575E3220"><enum>(A)</enum><header>Guarantee
				percentage</header><text>The Administrator may guarantee not more than 85
				percent of a loan under this subsection.</text>
								</subparagraph><subparagraph id="H12B21110E71B40898845184534A11865"><enum>(B)</enum><header>Loan
				amounts</header><text>The maximum amount of a loan guaranteed under this
				subsection shall be $3,000,000.</text>
								</subparagraph></paragraph><paragraph id="HB0DF89385C0847CFAE1C80532BB19108"><enum>(7)</enum><header>Loan
				term</header><text>The longest term of a loan for a loan guaranteed under this
				subsection shall be—</text>
								<subparagraph id="H7749C1E1E35B4C04B66CEC1C46C1D60"><enum>(A)</enum><text>15 years for any
				loan that is issued without collateral; and</text>
								</subparagraph><subparagraph id="H78AFA69C3B64426CA06665ACDBAD13B0"><enum>(B)</enum><text>25 years for any
				loan that is issued with collateral.</text>
								</subparagraph></paragraph><paragraph id="H5E87D6185DC140E489A98CDD4677E754"><enum>(8)</enum><header>Fees</header>
								<subparagraph id="H4319A905B11449D48FB67D8E24C6E0D3"><enum>(A)</enum><header>In
				general</header><text>The Administrator may not collect a guarantee fee under
				this subsection.</text>
								</subparagraph><subparagraph id="H15363A456B974BCBBAFEF87247B715A6"><enum>(B)</enum><header>Origination
				fee</header><text>The Administrator shall pay a qualified private lender an
				origination fee for a loan guaranteed under this subsection equal to
				<fraction>15/100</fraction> of 1 percent of the amount of the loan.</text>
								</subparagraph></paragraph><paragraph id="H63715C560AA545D09BCDFE79D2F20934"><enum>(9)</enum><header>Documentation</header><text>A
				qualified private lender may use its own loan documentation for a loan
				guaranteed by the Administrator, to the extent authorized by the Administrator,
				except that the Administrator may not require such use by regulation, or
				otherwise.</text>
							</paragraph><paragraph id="H396CC9ABC0ED493F8CC1D3E2395EA7C5"><enum>(10)</enum><header>Implementation</header>
								<subparagraph id="H836B0E382FC14DBEB7BF8C673D52AA13"><enum>(A)</enum><header>In
				general</header><text>Not later than 30 days after the date of enactment of
				this subsection, the Administrator shall—</text>
									<clause id="HB6BC1BEB893B4274A40088F7D61C43D4"><enum>(i)</enum><text>establish interim
				criteria for qualified private lenders; and</text>
									</clause><clause id="H3398D4E0AAB7454099115F6E177D949E"><enum>(ii)</enum><text>begin accepting
				applications from banks and lending institutions.</text>
									</clause></subparagraph><subparagraph id="HD18F0F321DA544799FBBE8CB1E85E142"><enum>(B)</enum><header>Regulations</header>
									<clause id="H6EB195A189434633A360F91DF894C05D"><enum>(i)</enum><header>In
				general</header><text>Not later than 90 days after the date of enactment of
				this subsection, the Administrator shall promulgate regulations establishing
				permanent criteria for qualified private lenders.</text>
									</clause><clause id="H7A773AA731004A9A8193EF7C347FA900"><enum>(ii)</enum><header>Existing
				qualified private lenders</header><text>A bank or lending institution that the
				Administrator determined met the criteria established under subparagraph (A)(i)
				may continue to operate as a qualified private lender if the Administrator
				determines that such bank or lending institution meets the criteria established
				under clause (i).</text>
									</clause></subparagraph></paragraph><paragraph id="H8E30626FA6774FC593D3FAC6447890B6"><enum>(11)</enum><header>Other
				assistance</header><text>The fact that a small business concern receives
				assistance under this subsection shall not preclude such business concern from
				receiving other assistance under this Act.</text>
							</paragraph><paragraph id="HC7F372682248429C91EE9EDC689E44A6"><enum>(12)</enum><header>Authorization
				of appropriations</header>
								<subparagraph id="H2438BDF1892449C3B080EF8D5CAA4B89"><enum>(A)</enum><header>In
				general</header><text>Amounts necessary to carry out this subsection shall be
				made available from amounts appropriated to the Administration under subsection
				(b).</text>
								</subparagraph><subparagraph id="H0CBE662B12F44A74BD3364978839FC1D"><enum>(B)</enum><header>Authority to
				reduce interest rates</header><text>Funds appropriated to the Administration to
				carry out this subsection, may be used by the Administrator, to the extent
				available, to reduce the applicable rate of interest for a loan guaranteed
				under this subsection by not more than 3 percentage
				points.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H7E4D46E3CDE74F188566BD8116F97E66"><enum>(b)</enum><header>Effective
			 date</header>
				<paragraph id="H1E0E7E42D3B4439A8EB68DD435E80750"><enum>(1)</enum><header>In
			 general</header><text>The amendments made by this section shall apply to
			 disasters declared under section 7(b)(2) of the Small Business Act (631 U.S.C.
			 636(b)(2)) before, on, or after the date of enactment of this Act.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE5F386B095384D40A29068C47514EFE9"><enum>(2)</enum><header>Construction</header><text>For
			 any disaster described in paragraph (1) that was declared before the date of
			 enactment of this Act, the 24-month period described in section 7(c)(2)(B) of
			 the Small Business Act, as amended by this Act, shall begin on the date on
			 which such disaster was declared.</text>
				</paragraph></subsection></section><section id="HE36701D810764130BE0855F78B01A956"><enum>2.</enum><header>Technical and
			 conforming amendments</header><text display-inline="no-display-inline">The
			 Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/631">15 U.S.C. 631 et seq.</external-xref>) is amended—</text>
			<paragraph id="H2094F5ED8EDB4BCCA191635961463445"><enum>(1)</enum><text>in section
			 4(c)—</text>
				<subparagraph id="HF873AC177B0E457EBE8541B15F362F01"><enum>(A)</enum><text>in paragraph (1),
			 by striking <quote>7(c)(2)</quote> and inserting <quote>7(d)(2)</quote>;
			 and</text>
				</subparagraph><subparagraph id="H5D418425390F432CB62600B4F3DC0669"><enum>(B)</enum><text>in paragraph
			 (2)—</text>
					<clause id="HFB1DBDC6E76A4352B80709649EC083DD"><enum>(i)</enum><text>by
			 striking <quote>7(c)(2)</quote> and inserting <quote>7(d)(2)</quote>;
			 and</text>
					</clause><clause id="H18D220B48CB44CB08C91A1A792EDE6AC"><enum>(ii)</enum><text>by
			 striking <quote>7(e),</quote>; and</text>
					</clause></subparagraph></paragraph><paragraph id="HEC39BE41C1944A4D99C43C4EF5BFB2E5"><enum>(2)</enum><text>in section 7(b),
			 in the undesignated matter following paragraph (3)—</text>
				<subparagraph id="HD9DC88FE7E6F4A488DE540741D26A220"><enum>(A)</enum><text>by striking
			 <quote>That the provisions of paragraph (1) of subsection (c)</quote> and
			 inserting <quote>That the provisions of paragraph (1) of subsection
			 (d)</quote>; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H8FBFE2A115DB4229AA6754A8B222ABF3"><enum>(B)</enum><text>by striking
			 <quote>Notwithstanding the provisions of any other law the interest rate on the
			 Administration's share of any loan made under subsection (b) except as provided
			 in subsection (c),</quote> and inserting <quote>Notwithstanding any other
			 provision of law, and except as provided in subsection (d), the interest rate
			 on the Administration's share of any loan made under subsection
			 (b)</quote>.</text>
				</subparagraph></paragraph></section></legis-body>
