		<official-title>To amend the Help America Vote Act of 2002 to require an
		  individual to provide proof that the individual is a citizen of the United
		  States and to present a government-issued photo identification as a condition
		  of casting a ballot in an election for Federal office, and for other

		<section display-inline="no-display-inline" id="H63EDDCFEF23443239B1EA02620556127" section-type="section-one"><enum>1.</enum><header>Short Title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Voter
			 Integrity Protection Act of 2006</quote>.</text>
		</section><section id="H2EB7443E1DC242CCA9B520035FEFFCB"><enum>2.</enum><header>Proof of
			 Citizenship Required for Casting Ballot</header>
			<subsection id="HF2A061664EB84920B8C8059FF6130398"><enum>(a)</enum><header>In
			 General</header><text>Section 303 of the Help America Vote Act of 2002 (42
			 U.S.C. 15483) is amended—</text>
				<paragraph id="H53D835839413419100EC2667CEBE27F6"><enum>(1)</enum><text>by redesignating
			 subsections (c) and (d) as subsections (d) and (e); and</text>
				</paragraph><paragraph id="H596FDA4547804020B5F14ECD75B76800"><enum>(2)</enum><text>by inserting after
			 subsection (b) the following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="HB4455D1616034867A8B9FE94DF2FB34" style="OLC">
						<subsection id="HA04A745C41A64C6984FF8CD2EC04CC"><enum>(c)</enum><header>Requiring Proof of
				Citizenship at Polling Place</header>
							<paragraph id="H38914E856079471EB6F2503543662DAD"><enum>(1)</enum><header>Individuals
				voting in person</header><text>Notwithstanding any other provision of law, the
				appropriate State or local election official may not provide a ballot for an
				election for Federal office (including a provisional ballot under section
				302(a)) to an individual who desires to vote in person unless the individual
				presents to the official a photographic copy of any document which provides
				proof that the individual is a citizen of the United States.</text>
							</paragraph><paragraph id="HF0DEFA08EA104744B0006E29DC7FA4A8"><enum>(2)</enum><header>Individuals
				voting by mail</header><text>Notwithstanding any other provision of law, the
				appropriate State or local election official may not accept any ballot for an
				election for Federal office provided by an individual who votes by mail unless
				the individual submits with the ballot a photographic copy of any document
				which provides proof that the individual is a citizen of the United
				States.</text>
							</paragraph><paragraph id="H6398CD1C7A444F6787F1677703618705"><enum>(3)</enum><header>Exception for
				individuals with proof of citizenship on file with election
				official</header><text>Paragraphs (1) and (2) shall not apply in the case of an
				individual who, at the time the individual applied to register to vote in
				Federal elections in the State involved, provided the appropriate State
				election official with a photographic copy of a document which provided proof
				that the individual is a citizen of the United States.</text>
							</paragraph><paragraph id="HEFC8B362828A4F0987ADBDF05773A1A4"><enum>(4)</enum><header>Treatment of
				driver’s licenses</header><text>For purposes of this subsection, a motor
				vehicle driver’s license shall not be treated as a document which provides
				proof that the individual to whom the license is issued is a citizen of the
				United States unless the State issuing the license required the individual to
				provide proof of the individual’s United States citizenship as a condition of
				receiving the
				license.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H0E4EC280F69845848F5719A7B78152FE"><enum>(b)</enum><header>Conforming
			 Amendment</header><text>Section 303 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/15483">42 U.S.C. 15483</external-xref>) is amended in
			 the heading by striking <quote><header-in-text level="section">for voters who
			 register by mail</header-in-text></quote> and inserting <quote><header-in-text level="section">for preventing voting fraud</header-in-text></quote>.</text>
			</subsection><subsection id="H7DC7C6469AD8486384EB753378FAA74"><enum>(c)</enum><header>Clerical
			 Amendment</header><text>The table of contents of such Act is amended by
			 amending the item relating to section 303 to read as follows:</text>

						<toc-entry level="section">Sec. 303. Computerized statewide voter

			</subsection><subsection id="H4668CFEE35FA4EEA9732D8E8FDAB5C2"><enum>(d)</enum><header>Effective
			 Date</header><text>Section 303(e) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/15483">42 U.S.C. 15483(e)</external-xref>), as
			 redesignated by subsection (a)(1), is amended by adding at the end the
			 following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="H38DB3E09AB774668A600F08C9D1FC517" style="OLC">
					<paragraph id="H78132851D03341729E452583C333F558"><enum>(3)</enum><header>Proof of
				citizenship</header><text>Subsection (c) shall apply with respect to the
				regularly scheduled general election for Federal office held in November 2008
				and each succeeding election for Federal
				office.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section display-inline="no-display-inline" id="H7423122A354849DA87660068884C39D7" section-type="subsequent-section"><enum>3.</enum><header>Requiring Photo
			 Identification</header>
			<subsection id="H2884A8E10FC64ACCB693F053A4BFF8F0"><enum>(a)</enum><header>Requirement</header>
				<paragraph id="H2DA104A004C543589272D8FD908FF011"><enum>(1)</enum><header>In
			 general</header><text>Subtitle A of title III of the Help America Vote Act of
			 2002 (<external-xref legal-doc="usc" parsable-cite="usc/42/15481">42 U.S.C. 15481 et seq.</external-xref>) is amended—</text>
					<subparagraph id="HA7BEF07351DA423DAB0075FC007C52AB"><enum>(A)</enum><text>by redesignating
			 sections 304 and 305 as sections 305 and 306; and</text>
					</subparagraph><subparagraph id="HDD2DE2EF81304CD6B369402B1C18D64"><enum>(B)</enum><text>by inserting after
			 section 303 the following new section:</text>
						<quoted-block display-inline="no-display-inline" id="H8CA9BD22B7B342D4001D9783029663E3" style="OLC">
							<section id="HDD7A6828F31849E1BC5657C4DB277F8D"><enum>304.</enum><header>Requiring
				Voters to Present Photo Identification</header>
								<subsection id="H820F7A78E78749AB88B6C46302C06FCE"><enum>(a)</enum><header>In
				General</header><text display-inline="yes-display-inline">Notwithstanding
				section 303(b), each State shall require any individual who desires to cast a
				ballot in an election for Federal office—</text>
									<paragraph id="H276F36BAC8D844DEAC11584988A8C23C"><enum>(1)</enum><text>in the case of an
				individual voting in person, to present to the appropriate election official a
				current valid photo identification which is issued by a governmental entity;
				or</text>
									</paragraph><paragraph id="H006F25159C484D5EB2A89F8DFD40DA00"><enum>(2)</enum><text display-inline="yes-display-inline">in the case of an individual voting by
				mail, to submit with the ballot a copy of a current valid photo identification
				which is issued by a governmental entity.</text>
									</paragraph></subsection><subsection id="H23AE1870F42E4E0BAA4F6DBD3F60CBF"><enum>(b)</enum><header>Making photo
				identifications available at no cost for purposes of casting ballots in
				elections</header>
									<paragraph id="HDAA1FB4B96064CCAA9408D2903A364BD"><enum>(1)</enum><header>In
				general</header><text>Each State shall establish a program to provide photo
				identifications which may be used to meet the requirements of subsection (a) by
				individuals who desire to vote in elections held in the State but who do not
				otherwise possess a government-issued photo identification, at no cost to the
				individual.</text>
									</paragraph><paragraph id="HABE7C2A4881245BAA437A21CF9D4B579"><enum>(2)</enum><header>Identifications
				not to be used for other purposes</header><text>Any photo identification
				provided under the program established under paragraph (1) may not serve as a
				government-issued photo identification for purposes of any program or function
				of a State or local government other than the administration of
				elections.</text>
									</paragraph></subsection><subsection id="H6832E2A9978442F791A888FDCF08F5D1"><enum>(c)</enum><header>Effective
				Date</header><text display-inline="yes-display-inline">Each State shall be
				required to comply with the requirements of this section (a) with respect to
				the regularly scheduled general election for Federal office held in November
				2008 and each succeeding election for Federal
				office.</text>
								</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H030C3BB530154EB2B1021ECF003F1289"><enum>(2)</enum><header>Conforming
			 amendments</header>
					<subparagraph id="H20256F57397C4B65B16B46002F4C75AB"><enum>(A)</enum><header>Effect on
			 current requirements</header><text>Section 303(b)(1) of such Act (42 U.S.C.
			 15483(b)(1)) is amended by striking <quote>paragraph (3)</quote> and inserting
			 <quote>paragraph (3) and section 304</quote>.</text>
					</subparagraph><subparagraph id="H3E1A3CBFD36645659B0071AFC7FFD1D0"><enum>(B)</enum><header>Enforcement</header><text>Section
			 401 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/15511">42 U.S.C. 15511</external-xref>) is amended by striking <quote>and 303</quote>
			 and inserting <quote>303, and 304</quote>.</text>
					</subparagraph></paragraph><paragraph id="H897CA61B561B4DEAA8C102E13CB400C2"><enum>(3)</enum><header>Clerical
			 amendment</header><text>The table of contents of such Act is amended—</text>
					<subparagraph id="HFFA0A61ECF5647808D3F27A46568C27B"><enum>(A)</enum><text>by redesignating
			 the items relating to sections 304 and 305 as relating to sections 305 and 306;
			 and</text>
					</subparagraph><subparagraph id="HA2A0E85B361A4E70AF428BD7B2038809"><enum>(B)</enum><text>by inserting after
			 the item relating to section 303 the following:</text>

			 States To Cover Costs of Making Photo Identifications Available</header>
				<paragraph id="HB00D37C8543247318267814525B61E3E"><enum>(1)</enum><header>In
			 general</header><text>Subtitle D of title II of such Act (42 U.S.C. 15321 et
			 seq.) is amended by adding at the end the following new part:</text>
					<quoted-block display-inline="no-display-inline" id="H8A0AD6C1FD964FDFAEAA667F31D0B406" style="OLC">
						<part id="HDA16CA63FFB44C87BEBF695FE6EF3905"><enum>7</enum><header>Payments to Cover
				Costs of Providing Photo Identifications</header>
							<section id="HEDA794BE83174B818EB000E283F17EBA"><enum>297.</enum><header>Payments to
				Cover Costs to States of Providing Photo Identifications For Voting</header>
								<subsection id="H6BFE6A20A33C4F928B58E876C76B1D4"><enum>(a)</enum><header>Payments to
				States</header><text>The Commission shall make payments each year to reimburse
				the States for the costs incurred in providing photo identifications under the
				program established under section 304(b)(1).</text>
								</subsection><subsection display-inline="no-display-inline" id="H83B020BF922A4756B7FA86A4F1D5DA67"><enum>(b)</enum><header>Amount of
				Payment</header><text>The amount of the payment made to a State under this part
				for any year shall be equal to the amount expended by the State during the year
				in carrying out the program established under section 304(b)(1), as determined
				on the basis of information furnished to the Commission by the State at such
				time and in such form as the Commission may require.</text>
								</subsection></section><section id="HE9DDE36382994F17A7FC295D25F629DA"><enum>297A.</enum><header>Authorization
				of Appropriations</header><text display-inline="no-display-inline">There are
				authorized to be appropriated for payments under this part such sums as may be
				necessary for fiscal year 2008 and each succeeding fiscal
				year.</text>
							</section></part><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph display-inline="no-display-inline" id="H1A0642B518DF436DB9136722F27C60BC"><enum>(2)</enum><header>Clerical
			 amendment</header><text>The table of contents of such Act is amended by adding
			 at the end of the item relating to subtitle D of title II the following:</text>

			 highway funds</header>
			<subsection id="HF7F59817AA934B16BE2085FC59F5387B"><enum>(a)</enum><header>In
			 general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/1">Chapter 1</external-xref> of title 23, United States Code, is amended by
			 adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H5EAD0BE394FF41199F92C6758CEFDA38" style="USC">
					<section id="H7BB5E149C7B64792A67368761B003230"><enum>167.</enum><header>Requirements
				for preventing voting fraud</header>
						<subsection id="HB016616D44FF7D91CB5809B5B78DC7C"><enum>(a)</enum><header>Withholding of
				apportionments for noncompliance</header><text display-inline="yes-display-inline">On October 1, 2008, and October 1 of each
				fiscal year thereafter, if a State does not meet the requirement of subsection
				(b), the Secretary shall withhold from amounts apportioned to the State on that
				date under each of paragraphs (1), (3), and (4) of section 104(b) the following
				percentage of such amounts:</text>
							<paragraph id="H1BFC91DE4166A36CAD1008A73978C97"><enum>(1)</enum><text>For fiscal year
				2009, 10 percent.</text>
							</paragraph><paragraph id="H6E312F294D5995FBF7AB8FB766BDE2B"><enum>(2)</enum><text>For fiscal year
				2010, 20 percent.</text>
							</paragraph><paragraph id="H85DF13084C5CC8532251219570CD7B4"><enum>(3)</enum><text>For fiscal year
				2011, 30 percent.</text>
							</paragraph><paragraph id="H01E77594472584EFD99C1794F4025F7"><enum>(4)</enum><text>For fiscal year
				2012, and each fiscal year thereafter, 40 percent.</text>
							</paragraph></subsection><subsection id="H650593BC35074A56A8B15800C27005B1"><enum>(b)</enum><header>Requirement</header><text>A
				State meets the requirements of this subsection if the State has enacted and is
				enforcing, as determined by the Election Assistance Commission, a law that
				complies with the requirements of sections 303(c) and 304 of the Help America
				Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/42/15483">42 U.S.C. 15483(c)</external-xref> and <external-xref legal-doc="usc" parsable-cite="usc/42/15484">42 U.S.C. 15484</external-xref>).</text>
						</subsection><subsection id="H257E970A49683364796AD7BDFBB61D5"><enum>(c)</enum><header>Period of
				availability; effect of compliance and noncompliance</header><text>If, within 4
				years from the date that an apportionment for a State is withheld in accordance
				with this section, the State meets the requirements of subsection (b), the
				apportionment of the State shall be increased by an amount equal to the amount
				withheld. If, at the end of such 4-year period, the State does not meet the
				requirements of subsection (b), any amounts so withheld from the State shall
				lapse.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H79C629CF01D24939A0CFA5B57C5BF484"><enum>(b)</enum><header>Clerical
			 Amendment</header><text>The analysis for such chapter is amended by adding at
			 the end the following:</text>
