		<official-title>To direct the Federal Trade Commission to prescribe rules
		  to prohibit deceptive conduct in the rating of video and computer
		  games.</official-title>

		<section id="H9A75048077974879A98984FAE99E0035" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Truth in Video Game Rating
			 Act</short-title></quote>.</text>
		</section><section id="H8E2B1E4FE8E0489194B5ADBCBEF7555"><enum>2.</enum><header>Deceptive ratings
			 of video games</header><text display-inline="no-display-inline">Not later than
			 1 year after the date of enactment of this Act, the Federal Trade Commission
			 shall prescribe rules under <external-xref legal-doc="usc" parsable-cite="usc/5/553">section 553</external-xref> of title 5, United States Code, to
			 prohibit the following as an unfair and deceptive act or practice prescribed
			 pursuant to section 18(a)(1)(B) of the Federal Trade Commission Act (15 U.S.C.
			 57<italic>a</italic>(a)(1)(B)):</text>
			<paragraph id="H3A8A56A4034C42628E7147EEB2B2F907"><enum>(1)</enum><header>Rating game only
			 on partial content</header><text display-inline="yes-display-inline">Such rules
			 shall prohibit any person or entity from providing a content rating of any
			 video or computer game that is to bear a label containing such content rating
			 when sold or distributed in interstate commerce unless such person or entity
			 has reviewed the content of the video or computer game in its entirety.</text>
			</paragraph><paragraph id="H1F9DC11B61F943F7816C27E3D59EAB12"><enum>(2)</enum><header>Withholding
			 content for rating</header><text display-inline="yes-display-inline">Such rules
			 shall prohibit any person who produces, sells, or otherwise distributes video
			 or computer games in interstate commerce from withholding or hiding any content
			 of the video or computer game from, or in any other manner failing to disclose
			 any content of the video or computer game to, the person or entity to whom the
			 video or computer game is submitted for the purpose of obtaining a content
			 rating.</text>
			</paragraph><paragraph id="H8ECDFD852E6C48EE9E96C33B001896D1"><enum>(3)</enum><header>Gross
			 mischaracterization of content</header><text display-inline="yes-display-inline">Such rules shall prohibit any person or
			 entity that provides a content rating for a video or computer game that is to
			 bear a label containing such content rating when sold or distributed in
			 interstate commerce from providing a content rating that grossly
			 mischaracterizes (as defined by the Commission in such rules) the content of
			 the video or computer game.</text>
			</paragraph></section><section id="HA093B3C9B91A41518DAB29DD4F7BF56B"><enum>3.</enum><header>G.A.O.
			 Study</header>
			<subsection id="HB2A0643110BA46AAB42410D000007BF1"><enum>(a)</enum><header>Study</header><text display-inline="yes-display-inline">The Comptroller General shall conduct a
			 study to determine—</text>
				<paragraph id="HDC13330DC1E845988400C3CA65858C76"><enum>(1)</enum><text display-inline="yes-display-inline">the effectiveness of the ESRB video and
			 computer game content ratings system, including content ratings for on-line or
			 Internet-based games;</text>
				</paragraph><paragraph id="HA39C558CB0CD4F05BC0021689C8B47F4"><enum>(2)</enum><text>whether content
			 ratings systems, like that used by the ESRB, should be peered-reviewed;</text>
				</paragraph><paragraph id="HA807119B59AA41BE84393E8DAC98FB7F"><enum>(3)</enum><text>whether an
			 independent ratings system would offer better accuracy and effectiveness in
			 content ratings for video and computer games;</text>
				</paragraph><paragraph id="HEE1E9DBD935940CDAA4ED953BE58C65"><enum>(4)</enum><text>the prevalence of
			 marketing video and computer games to audiences that fall under the age-based
			 content ratings of those games; and</text>
				</paragraph><paragraph id="HBB11BFEA00DF476D9D00D1920084AA1D"><enum>(5)</enum><text>the efficacy of a
			 universal ratings system for visual content, including films, broadcast and
			 cable TV, and video and computer games.</text>
				</paragraph></subsection><subsection id="H857B03C0E10148FC8179D84117E025F8"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">The Comptroller General shall transmit a
			 report on the findings of the study conducted pursuant to subsection (a) to
			 Congress not later than 180 days after the date of enactment of this Act. The
			 report shall contain recommendations regarding effective approaches to video
			 and computer game content ratings that address the unique ratings challenges of
			 on-line and Internet-based video games.</text>
			</subsection></section><section id="HD603CC6A319E4D29AE6F03998959EA00"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">As used in this Act—</text>
			<paragraph id="H84EB2C5643F947958BD5F9398B99B091"><enum>(1)</enum><text>the term
			 <quote>content</quote>, with respect to video and computer games, means all of
			 the visual images and sounds that are included as part of the recorded data of
			 the video or computer game;</text>
			</paragraph><paragraph id="HEDFBE390633846AE8E1DBA3CC0C5F080"><enum>(2)</enum><text display-inline="yes-display-inline">the term <quote>content rating</quote>
			 means any rating of the content of a video or computer game provided to notify
			 consumers of any content which may be offensive to consumers or may not be
			 suitable to persons of varying ages, including such content as violence,
			 graphic sexual content, nudity, or strong language;</text>
			</paragraph><paragraph id="HDB319520942F4849B07642F600442182"><enum>(3)</enum><text>the term
			 <quote>ESRB</quote> means the Entertainment Software Ratings Board; and</text>
			</paragraph><paragraph id="HA6A38C183AD444B0BBFECCC0D0FEF350"><enum>(4)</enum><text display-inline="yes-display-inline">the term <quote>video or computer
			 game</quote> means any electronic object or device that creates an interactive
			 game capable of being played, viewed, or experienced on or through a computer,
			 gaming system, console, or other technology.</text>
