		<legis-type>A BILL</legis-type>
		<official-title>To amend title 49, United States Code, to permit certain
		  revenues of private vanpool contractors received from providing public
		  transportation to be used for the purpose of acquiring rolling stock that is
		  not funded, in part, by Federal, State, or local government assistance, and to
		  permit certain expenditures of private vanpool contractors to be credited
		  toward the local matching share of the costs of public transportation
		  projects.</official-title>

		<section display-inline="no-display-inline" id="HE58FDD9450EE406888FE2821BC272D29" section-type="section-one"><enum>1.</enum><header>Government’s share of costs
			 for public transportation projects</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/49/5323">Section 5323(i)</external-xref> of title 49, United States
			 Code, is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="H03E0149C79DC425AB018365557B64749" style="OLC">
				<paragraph id="H8870D472B9CC416AB151B98DF3F7BF4"><enum>(3)</enum><header>Costs incurred by
				private vanpool contractors</header>
					<subparagraph id="HDBA0C8D0EA3F4EB59DC761BEE306BD05"><enum>(A)</enum><header>Local matching
				share</header><text>The local matching share provided by a recipient of
				assistance for a capital project under this chapter may include amounts
				expended by a private vanpool contractor of the recipient, without Federal,
				State, or local governmental assistance, for the acquisition of rolling stock
				to be used by the contractor to provide turnkey public transportation on the
				recipient’s behalf.</text>
					</subparagraph><subparagraph id="HEB66EA33DACB4254B6D9BC2119A60718"><enum>(B)</enum><header>Use of
				revenues</header><text>A private vanpool contractor may use revenues that the
				contractor receives in providing public transportation that are in excess of
				the operating costs of the contractor for purposes of acquiring rolling
				stock.</text>
					</subparagraph><subparagraph id="H0506C8D134B7468082903013D4074C22"><enum>(C)</enum><header>Definitions</header><text>In
				this paragraph, the following definitions apply:</text>
						<clause id="H5274131A77FF4B4087BA00AADBD28091"><enum>(i)</enum><header>Private vanpool
				contractor</header><text display-inline="yes-display-inline">The term
				<quote>private vanpool contractor</quote> means a private entity providing
				public transportation pursuant to a contract with a recipient of assistance
				under this chapter using a commuter highway vehicle or vanpool.</text>
						</clause><clause id="H42932F76F6D0422792E34059B6B1583E"><enum>(ii)</enum><header>Commuter
				highway vehicle; vanpool</header><text>The term <quote>commuter highway
				vehicle</quote> or <quote>vanpool</quote> means any vehicle—</text>
							<subclause id="H51B038684E6E45238B53D9B515BEACC"><enum>(I)</enum><text>the seating
				capacity of which is at least 6 adults (not including the driver); and</text>
							</subclause><subclause id="H98EE714561E84A55963C2813AE3B32D7"><enum>(II)</enum><text>at least 80
				percent of the mileage use of which can be reasonably expected to be for the
				purposes of transporting commuters in connection with travel between their
				residences and their place of
				employment.</text>
