		<official-title>To direct the Secretary of Homeland Security to ensure
		  that an individual may file an orphan petition for at least 2 years after
		  approval of an advanced processing application.</official-title>

		<section id="H68887C91CCCD429BB8657E63A73186C1" section-type="section-one"><enum>1.</enum><header>Short Title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Helping
			 Families Adopt Orphans Act</quote>.</text>
		</section><section id="H22F5B8641FDF4E1DB459B1B177B40055"><enum>2.</enum><header>Extension of time
			 to file orphan petition</header>
			<subsection id="HEB0F95A53B644017B5443BE3467F1494"><enum>(a)</enum><header>In
			 general</header><text>The Secretary of Homeland Security shall ensure that any
			 covered individual may file an orphan petition for at least 2 years after the
			 approval of the individual's advanced processing application.</text>
			</subsection><subsection id="H2452DC821054411A81A79068DDEB300"><enum>(b)</enum><header>Fees and
			 requirements</header><text>The Secretary of Homeland Security shall not require
			 a covered individual who timely files an orphan petition to pay any fees or
			 complete any requirements that—</text>
				<paragraph id="H615DF808A4AA4795BA8921A4860033C4"><enum>(1)</enum><text>the individual has
			 already paid or completed in conjunction with the advanced processing
			 application; or</text>
				</paragraph><paragraph id="H49443F6B9BDF46C2B6772FC8C005D06"><enum>(2)</enum><text>are contingent on
			 the amount of time that elapses between the approval of the advanced processing
			 application and the filing of the orphan petition.</text>
				</paragraph></subsection><subsection id="HCA61399FDEAE43BFBD1F7856D1C9B2D9"><enum>(c)</enum><header>Additional
			 fees</header><text display-inline="yes-display-inline">The Secretary of
			 Homeland Security shall not require any person who was a covered individual on
			 the date of enactment of this Act to pay any fee for the timely filing of an
			 orphan petition, unless that fee was required at the time the advanced
			 processing application was approved.</text>
			</subsection><subsection id="H44ECB9E05B3842998EDA28D52CF16128"><enum>(d)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="H996869ABA64B43DEBF63B0AD6F8666A"><enum>(1)</enum><text>The term
			 <quote>covered individual</quote> means any individual whose advanced
			 processing application was approved on or after January 1, 2005.</text>
				</paragraph><paragraph id="HA5C924F36FAB4E1894F83FFDF22BE4F4"><enum>(2)</enum><text>The term
			 <quote>orphan petition</quote> means the Petition to Classify Orphan as an
			 Immediate Relative or such form that is a successor to that form.</text>
				</paragraph><paragraph id="H56068D962D444C3A9F0017387C375800"><enum>(3)</enum><text>The term
			 <quote>advanced processing application</quote> means the Application for
			 Advance Processing of Orphan Petition or such form that is a successor to that
			 form.</text>
