<official-title display="yes">To restore, protect, and preserve the natural, chemical, physical and biological integrity, and the economic potentialities, of the New York/New Jersey Bight through designation and establishment of the New Jersey/New York Clean Ocean Zone and the regulation of various activities therein, and for other purposes.</official-title> 
</form>

<section id="H1C24B5523B5D473F96B39CF76757A4F8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>New Jersey/New York Clean Ocean Zone Act of 2006</short-title></quote>.</text> </section> 
<section id="H53C4E8495CA5415D00B490118FADA266"><enum>2.</enum><header>Congressional findings, policy, and declaration of purpose</header> 
<subsection id="HCC735A900F914A4EB7E55253E18B3E00"><enum>(a)</enum><header>Findings</header><text>The Congress finds the following:</text> 
<paragraph id="H1E116E2B734F46F3887744D1D12418C"><enum>(1)</enum><text>The New York/New Jersey Bight is an essential natural and scenic resource of the United States, providing innumerable recreational, commercial, economic and aesthetic benefits and extraordinary ecological, biological, and environmental benefits.</text> </paragraph> 
<paragraph id="HBB278385FE4C418C83A1E91C341E205F"><enum>(2)</enum><text>Various harmful activities within the New York/New Jersey Bight, including the dumping of contaminated dredged material, the dumping of various wastes, point source and nonpoint source pollution, the extraction of nonrenewable natural resources, and the potential development of deepwater oil and gas facilities, have caused or may cause serious adverse impacts to human health, welfare, and amenities, or threaten the marine environment, ecological systems, and economic potentialities of the New York/New Jersey Bight.</text> </paragraph> 
<paragraph id="HB6E4FEF57C214FF9A2E1B02CD2679CA"><enum>(3)</enum><text>Ecologically unique areas at risk from degradation caused by pollution, such as the New York/New Jersey Bight, are worthy of special protections to reduce such threats. Pollution-preventing protections have been established for and awarded to the Great Lakes and the Everglades, for example.</text> </paragraph></subsection> 
<subsection id="H10432F9BA4DE4D6F8341E1D4D7C7143B"><enum>(b)</enum><header>Purpose</header> 
<paragraph id="HA661990093F744A2A3A6967DD334667"><enum>(1)</enum><header>In general</header><text>The purpose of this Act is to restore, protect and preserve, the natural, chemical, physical, and biological integrity, and the economic potentialities, of the New York/New Jersey Bight.</text> </paragraph> 
<paragraph id="H5B9CC576A12A41B4929467E6B643E600"><enum>(2)</enum><header>Limitation</header><text>This Act is not intended—</text> 
<subparagraph id="H5EE56A8C613F4CFFB43047BB65CACA34"><enum>(A)</enum><text>to authorize or require any fisheries management actions within the New Jersey/New York Clean Ocean Zone, including fisheries management allocation and techniques or any similar fisheries management related activity; or</text> </subparagraph> 
<subparagraph id="H9FE23D79B5044CF5B1492374D6B7D7D8"><enum>(B)</enum><text>to prohibit or limit beach replenishment activities, flood control activities, erosion control activities, or habitat restoration projects on or along the shoreline adjoining the New Jersey/New York Clean Ocean Zone.</text> </subparagraph></paragraph></subsection></section> 
<section id="HDD2A7883AAFD4040A700116C8CB48100"><enum>3.</enum><header>Designation of New Jersey/New York Clean Ocean Zone</header> 
<subsection id="H17DD0E9B59CC474CB89C10F89F651C2D"><enum>(a)</enum><header>Designation</header><text display-inline="yes-display-inline">The New York/New Jersey Bight shall be known and designated as the <quote>New Jersey/New York Clean Ocean Zone</quote>.</text> </subsection> 
<subsection id="HB8B72FD9D0EC4CCF8C78F37176242E80"><enum>(b)</enum><header>References</header><text>Any reference in a law, map, regulation, document, paper, or other record of the United States to the area referred to in subsection (a) shall be deemed to be a reference to the <quote>New Jersey/New York Clean Ocean Zone</quote>.</text> </subsection></section> 
<section id="HA8A4EB8B4E75479085A142A120BEF422"><enum>4.</enum><header>Regulation of the New Jersey/New York Clean Ocean Zone</header> 
<subsection id="HFA4303C3A47144E3B37457A700C80028"><enum>(a)</enum><header>Ocean dumpsites</header> 
<paragraph id="H4D8D5412F135481CBA608495CD7E94C"><enum>(1)</enum><header>Prohibition of designation or establishment of new sites</header><text>Neither the Administrator, the Secretary, nor any State may issue a permit for ocean dumping, nor designate or establish any new disposal site, within the New Jersey/New York Clean Ocean Zone, including pursuant to section 102, 103, 104A, or 104B of the Marine Protection, Research, and Sanctuaries Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/33/1412">33 U.S.C. 1412</external-xref>, 1413, 1414a, 1414b) or section 4 of <external-xref legal-doc="public-law" parsable-cite="pl/95/153">Public Law 95–153</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/33/1412a">33 U.S.C. 1412a</external-xref>).</text> </paragraph> 
<paragraph id="H5939CFC7BC1B4A88B2B63C0014D3C9FB"><enum>(2)</enum><header>Termination of existing designations</header><text>Except as provided by paragraph (3), all existing designations of disposal sites within the New Jersey/New York Clean Ocean Zone are hereby terminated, and such sites shall not be used as disposal sites.</text> </paragraph> 
<paragraph id="H435C865BDFE54859A44FC173841358BB"><enum>(3)</enum><header>Use of HARS</header><text display-inline="yes-display-inline">Notwithstanding paragraphs (1) and (2), and consistent with the terms, conditions, and limitations of <external-xref legal-doc="regulation" parsable-cite="cfr/40/228.15">section 228.15(d)(6)</external-xref> of title 40, Code of Federal Regulations, dredged material may be placed in the Primary Remediation Area of the HARS for the purposes of ecological remediation and protection of sensitive species at sensitive life stages, if the Administrator determines, following testing and analytical measures established by regulation for materials proposed for ocean dumping, that the dredged material qualifies as material for remediation.</text> </paragraph></subsection> 
<subsection id="HBA935CFEBA2E44B89384A6A4A210CF00"><enum>(b)</enum><header>Regulation of point sources</header> 
<paragraph id="H9694566462E244B388BC51A1004C36D3"><enum>(1)</enum><header>Prohibition on discharges from new point sources</header><text display-inline="yes-display-inline">The discharge of a pollutant into the New Jersey/New York Clean Ocean Zone from a point source constructed or put into use after the date of enactment of this Act is prohibited under section 301 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1311">33 U.S.C. 1311</external-xref>). Neither the Administrator, nor any State, may issue a permit, pursuant to section 402 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1342">33 U.S.C. 1342</external-xref>) or comparable State law, for the discharge of a pollutant into the New Jersey/New York Clean Ocean Zone from a point source constructed or put into use after such date of enactment.</text> </paragraph> 
<paragraph id="H703B5E2E091C4F818836AEDB4F4617B8"><enum>(2)</enum><header>Limitations on existing permits</header><text>A State or Federal permit issued pursuant to section 402 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1342">33 U.S.C. 1342</external-xref>) for the discharge of a pollutant into the New Jersey/New York Clean Ocean Zone may not be renewed, reissued, or modified after the date of enactment of this Act to allow for any increase of discharge capacity of any point source or sources. The renewed, reissued, or modified permit may not contain any effluent limitation that is less stringent than comparable effluent limitations in such permit and shall otherwise require compliance with all other applicable laws and regulations under the Federal Water Pollution Control Act, including applicable water quality standards.</text> </paragraph></subsection> 
<subsection id="HE3E4020B9A534DE400F3EFF9ADB35596"><enum>(c)</enum><header>Extraction of nonrenewable natural resources</header> 
<paragraph id="HEDD2706D4FB547F995EA5583C0862651"><enum>(1)</enum><header>Prohibition</header><text>The permanent extraction of any nonrenewable natural resource from the New Jersey/New York Clean Ocean Zone for commercial or industrial use is prohibited, unless such removal is undertaken for the primary purpose of maintaining or establishing navigation channels.</text> </paragraph> 
<paragraph id="H8479EDCFE82C4671A205A62CC7FCF100"><enum>(2)</enum><header>Limitation</header><text>This Act shall not be used to restrict or otherwise limit beach replenishment activities, flood control activities, erosion control activities, or habitat restoration projects on or along the shores of the New Jersey/New York Clean Ocean Zone.</text> </paragraph></subsection> 
<subsection id="HDA9D4FBE7A5B40158BD332B001262AB"><enum>(d)</enum><header>Nonrenewable energy facilities</header><text>Except as set forth in subsection (e)—</text> 
<paragraph id="H7A15377049FE425D9BC28F24E029D394"><enum>(1)</enum><text>the creation of any type of nonrenewable energy facility or pipeline within the New Jersey/New York Clean Ocean Zone is prohibited;</text> </paragraph> 
<paragraph id="H7AD2A999FB80420FB5D264EA74B85D"><enum>(2)</enum><text>the Secretary of Transportation shall not issue any license pursuant to section 4 of the Deepwater Port Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1503">33 U.S.C. 1503</external-xref>) or section 106 of the Maritime Transportation Security Act of 2002 (116 Stat. 2086) for the ownership, construction, or operation of a deepwater port used for the production, storage, transport, or transfer of nonrenewable energy in the New Jersey/New York Clean Ocean Zone;</text> </paragraph> 
<paragraph id="H0352D799F9A04FD2A6A042839F7720BE"><enum>(3)</enum><text>there shall be no conveyance of any interest in any federally owned, submerged or subterranean land within the New Jersey/New York Clean Ocean Zone for the purpose of establishing or operating a nonrenewable energy facility, including—</text> 
<subparagraph id="HDEFD599070C445FE8CB6369651596BE5"><enum>(A)</enum><text>the conveyance of such an interest for any pipeline that transports any nonrenewable natural resource or any refined product produced therefrom, within or through the New Jersey/New York Clean Ocean Zone; and</text> </subparagraph> 
<subparagraph id="HDD3601D2CC384FBEAEB604B4AB163C24"><enum>(B)</enum><text>the grant or lease of such right-of-ways by the Secretary of the Interior pursuant to section 28 of the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/185">30 U.S.C. 185</external-xref>), or the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1301">43 U.S.C. 1301 et seq.</external-xref>).</text> </subparagraph></paragraph></subsection> 
<subsection id="HD1E2DB3F54CD48AF85D1FE71244DCDF0"><enum>(e)</enum><header>Renewable energy facilities</header> 
<paragraph id="H274D57E73F784D22AF3861876B03F284"><enum>(1)</enum><header>Limitation on granting leases, etc</header><text>No lease, easement, or right-of-way for a renewable energy facility may be granted for any federally owned, submerged, or subterranean land in the New Jersey/New York Clean Ocean Zone except in accordance with this subsection, section 8(p) of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1337">43 U.S.C. 1337(p)</external-xref>), and section 388 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/43/1337">43 U.S.C. 1337</external-xref> note).</text> </paragraph> 
<paragraph id="HB1CD70BBDCAE493800242800890027A6"><enum>(2)</enum><header>Compliance with applicable laws</header><text>The granting of any lease, easement, or right-of-way referred to in paragraph (1) shall comply with all applicable laws and regulations and shall not be exempt nor categorically excluded from the requirements of section 102 of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332</external-xref>). Section 102 of such Act shall be applied to each such lease, easement, and right-of-way on a project-by-project basis.</text> </paragraph> 
<paragraph id="H3F6D1F7AE2AD4B89BB0011D427B833CA"><enum>(3)</enum><header>Determination required</header><text>No lease, easement, or right-of-way referred to in paragraph (1) may be granted unless—</text> 
<subparagraph id="H91AE0055BF6F4F518C28D3DA0A32109"><enum>(A)</enum><text>the Secretary of the Interior, after completion of any review required by paragraph (2), determines that such action—</text> 
<clause id="H018D20A40AEC4CA4B7CB3E2383A4B3C"><enum>(i)</enum><text>complies with all environmental criteria, conditions, and restrictions established by or pursuant to section 8(p) of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1337">43 U.S.C. 1337(p)</external-xref>) or section 388 of the Energy Policy Act of 2005; and</text> </clause> 
<clause id="H4C42877775604BE6B54722BE2D98808D"><enum>(ii)</enum><text>will not unreasonably degrade or endanger human health, welfare, or amenities, the marine environment, or ecological systems or economic potentialities thereof; and</text> </clause></subparagraph> 
<subparagraph id="H97DA2BEE55B843549C073DDBC3E6D18D"><enum>(B)</enum><text>the Secretary of Commerce, acting through the Administrator of the National Oceanic and Atmospheric Administration, concurs in writing with the determination of the Secretary of the Interior under subparagraph (A).</text> </subparagraph></paragraph> 
<paragraph id="H31915B3151234312B835002DB4E25763"><enum>(4)</enum><header>Standard of review</header><text>For purposes of paragraph (3), an action is deemed to unreasonably degrade or endanger human health, welfare, or amenities, the marine environment, or ecological systems or economic potentialities thereof, only if the action is likely to cause, on an individual or cumulative basis—</text> 
<subparagraph id="H656B0B321DE3423792007583EE9BE8C"><enum>(A)</enum><text>significant adverse impacts to marine habitat, ecosystem diversity, productivity, and stability of the biological community within the area of the renewable energy facility concerned and surrounding biological communities;</text> </subparagraph> 
<subparagraph id="H3684D60402C64E049870BF129E00B3CB"><enum>(B)</enum><text>a threat to human life, health, or existing or potential amenities through—</text> 
<clause id="H40D61BC1B3A64C7A00F163DD308F2BE"><enum>(i)</enum><text>the creation of a hazard to navigation, fishing, or recreation;</text> </clause> 
<clause id="H9FB9755454F0424480576267D43231D"><enum>(ii)</enum><text>direct exposure to pollutants; or</text> </clause> 
<clause id="H75497F09615E43469C328B2C854C1C00"><enum>(iii)</enum><text>consumption of exposed aquatic organisms; or</text> </clause></subparagraph> 
<subparagraph id="H6385F0C7EEBF4017A59CB64BF09C1199"><enum>(C)</enum><text>significant impairment of recreational, scientific, or economic benefits currently or potentially derived from or within the area of the renewable energy facility and surrounding waters.</text> </subparagraph></paragraph></subsection> 
<subsection id="HD1FFD6C9E8064CC7A1C10300F4CAE551"><enum>(f)</enum><header>Underwater research and exploration</header> 
<paragraph id="H292A540244454EE3A7325817040166AC"><enum>(1)</enum><header>In general</header><text>Nothing in this Act restricts or otherwise limits underwater research or exploration of the aquatic environment within the New Jersey/New York Clean Ocean Zone, if such research or exploration—</text> 
<subparagraph id="H9DC64F7EEF9D46F8BE34BDD72120A7EF"><enum>(A)</enum><text>will not adversely affect, or will be performed for the sole purpose of furthering, the restoration, protection and preservation of, the natural, chemical, physical and biological integrity of the New Jersey/New York Clean Ocean Zone; and</text> </subparagraph> 
<subparagraph id="H3458512CD1034B7D82546EDA001EEB8E"><enum>(B)</enum><text>is conducted in accordance with all other applicable laws and regulations.</text> </subparagraph></paragraph> 
<paragraph id="HFB5DE9CACC634F3FA18D8E19FD225B4"><enum>(2)</enum><header>Prohibition</header><text>The conduct of any underwater research or exploration of the aquatic environment within the New Jersey/New York Clean Ocean Zone that does not comply with paragraph (1) is prohibited.</text> </paragraph></subsection></section> 
<section id="HF2E787A31AC04F9CA54DF857B61FF7A1"><enum>5.</enum><header>Support for marine activities</header> 
<subsection id="HB5284F31F6064EC49CB515C079DB4EA0"><enum>(a)</enum><header>Marine activities</header> 
<paragraph id="H9F86602A1B7B4F54BA8175E9868BE7E3"><enum>(1)</enum><header>Activities not limited</header><text>Nothing in this Act shall be considered to restrict or otherwise limit the conduct of any of the maritime activities described in paragraph (2) in the New Jersey/New York Clean Ocean Zone, to the extent that such activity does not violate any other applicable law or regulation.</text> </paragraph> 
<paragraph id="H89AD625DF4AC48F7991801796D18FF08"><enum>(2)</enum><header>Marine activities described</header><text>The maritime activities referred to in paragraph (1) are the following:</text> 
<subparagraph id="H9311BF4772F54BAE8DE9CFD3AB9D3F4F"><enum>(A)</enum><text>Boating.</text> </subparagraph> 
<subparagraph id="H49D8B3D388E3461FA392DD685D5D2FAC"><enum>(B)</enum><text>Underwater diving.</text> </subparagraph> 
<subparagraph id="H842C8C6A38444C6095B5908DC98D1584"><enum>(C)</enum><text>Surfing, swimming, and other similar recreational activities.</text> </subparagraph> 
<subparagraph id="H69BB0372F14E4E5C903502AEE4BB696E"><enum>(D)</enum><text>Recreational fishing and commercial fishing.</text> </subparagraph> 
<subparagraph id="H717D7D3E015D40B49D5C109502458367"><enum>(E)</enum><text>The creation of artificial reefs.</text> </subparagraph></paragraph></subsection> 
<subsection id="HDDFEE5FE7317445B00260025571F8149"><enum>(b)</enum><header>Fisheries management actions not authorized</header><text>This Act shall not be used to adopt or enact fisheries management actions within the New Jersey/New York Clean Ocean Zone, including fisheries management allocation and techniques or any similar fisheries management related activity.</text> </subsection></section> 
<section id="HF1712F44495F47A79276F4B54C6EF6A"><enum>6.</enum><header>Enforcement</header><text display-inline="no-display-inline">This Act may be enforced under sections 105 and 107 of the Marine Protection, Research, and Sanctuaries Act of 1972 (33 U.S.C. 1415 and 1417), except that section 4(b) of this Act may be enforced under sections 309 and 505 of the Federal Water Pollution Control Act (33 U.S.C. 1319 and 1365).</text> </section> 
<section id="HBA593B83A6124B3898818000EEBF762D"><enum>7.</enum><header>Definitions</header><text display-inline="no-display-inline">Except as otherwise specifically provided, in this Act:</text> 
<paragraph id="H34D29CD2158B41BEBAEB477E53AC003F"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text> </paragraph> 
<paragraph id="HC5C66C162F5148F4BDD470BD6FEBCAB6"><enum>(2) </enum><header>Artificial reef</header><text>The term <term>artificial reef</term> means a federally or State approved structure that is constructed or placed in the waters of the New York/New Jersey Bight for the purpose of enhancing one or more of benthic relief, fishery resources, commercial diving, recreational diving, surfing, commercial fishing opportunities, and recreational fishing opportunities.</text> </paragraph> 
<paragraph id="H7EEB0DAE8ABE46B0AA0658745FC0DEE5"><enum>(3)</enum><header>Continental Shelf</header><text>The term <term>Continental Shelf</term> means the seabed and subsoil of the submarine areas adjacent to the coast of the United States, and all submerged lands lying seaward and outside of the area of lands beneath navigable waters (as that term is defined in section 2 of the Submerged Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1301">43 U.S.C. 1301</external-xref>)), extending to a depth of 1000 fathoms.</text> </paragraph> 
<paragraph id="H272CF889AE8C4DA99472A54D558DA27"><enum>(4)</enum><header>Discharge of a pollutant</header><text>The term <term>discharge of a pollutant</term> means any addition of any pollutant to the waters of the New York/New Jersey Bight from any point source.</text> </paragraph> 
<paragraph id="HB4CE9842A2A5496A837B6E7498D9E174"><enum>(5)</enum><header>Disposal site</header><text>The term <term>disposal site</term> means a precise geographical area designated under Federal law for the dumping of any material into the waters of the New York/New Jersey Bight, including, but not limited to, any site at which dumping is authorized under a permit issued under section 102 or 103 of the Marine Protection, Research, and Sanctuaries Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/33/1412">33 U.S.C. 1412</external-xref>, 1413).</text> </paragraph> 
<paragraph id="H06B451FF829E460CBD074808B634F446"><enum>(6)</enum><header>Dredged material</header><text>The term <term>dredged material</term> means any material excavated or dredged from the navigable waters of the United States.</text> </paragraph> 
<paragraph id="HA81E041A1F8C4D4386F929387842E20"><enum>(7)</enum><header>Dumping</header><text display-inline="yes-display-inline">The term <term>dumping</term> has the meaning that term has under section 3(f) of the Marine Protection, Research, and Sanctuaries Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/33/1402">33 U.S.C. 1402(f)</external-xref>).</text> </paragraph>

<paragraph id="HA8385ABC66DB4DA0A6D7CE6829B9069E"><enum>(10)</enum><header>Material</header><text display-inline="yes-display-inline">The term <term>material</term> has the meaning that term has in section 3(c) of the Marine Protection, Research, and Sanctuaries Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/33/1402">33 U.S.C. 1402(c)</external-xref>).</text> </paragraph> 
<paragraph id="HDCCC145EA1F34979A2DA3FCF3E4292D7"><enum>(11)</enum><header>Material for remediation</header><text></text> 
<subparagraph id="H5059ADD3A9A74201B4253B96241EE122"><enum>(A)</enum><header>In general</header><text>The term <quote>material for remediation</quote> means dredged material that, through testing and analysis, is determined by the Administrator to—</text> 
<clause id="HA74B60D53E26493D8BB958EA486754BB"><enum>(i)</enum><text>contain, or to cause through bioaccumulation, chemical concentrations of any Contaminant of Concern that are less than those concentrations present in, or caused through bioaccumulation by, the surficial sediment collected at a depth of no more than 6 inches from the proposed placement site within the HARS;</text> </clause> 
<clause id="H36DD1867DA4A4D9BA4BC59A62EE99FF0"><enum>(ii)</enum><text>have fewer screening level exceedances for Contaminants of Concern than the surficial sediment collected at a depth of no more than 6 inches from the proposed placement site within the HARS, except material for remediation shall have no Screening Level exceedances if such surface sediment have no such exceedance; and</text> </clause> 
<clause id="HF7637B89DF2044909C80050059001DE1"><enum>(iii)</enum><text>otherwise complies with applicable Federal and State laws and regulations established for materials proposed for ocean dumping, including, without limitation, <external-xref legal-doc="regulation" parsable-cite="cfr/40/227.6">section 227.6</external-xref> of title 40, Code of Federal Regulations.</text> </clause></subparagraph> 
<subparagraph id="H1659AA5AF34B42939B08BAA1CBABB642"><enum>(B)</enum><header>Contaminant of Concern defined</header><text>In this paragraph, the term <quote>Contaminant of Concern</quote> means—</text> 
<clause id="H3415DA26BBF44DF59D306895B7FFF96F"><enum>(i)</enum><text>any of the pollutants specified in the chart in subparagraph (C) and having the corresponding Screening Level value (in parts per billion dry weight); and</text> </clause> 
<clause id="H4B222C616E444204A3D0FBFBFE8BCC"><enum>(ii)</enum><text>any additional pollutant designated under subparagraph (D).</text> </clause></subparagraph>

<paragraph id="H06B0E165C5BD47959E36D07EAC643BD"><enum>(15)</enum><header>Nonrenewable energy facility</header><text display-inline="yes-display-inline">The term <term>nonrenewable energy facility</term> means any equipment, pipeline, or facility, other than an electrical transmission cable, a communication cable, or a vessel in transit, that is or will be used primarily—</text> 
<subparagraph id="H74AEC0C3FC634770B29F1EDD4E27964C"><enum>(A)</enum><text display-inline="yes-display-inline">in the development, production, conversion, storage, transfer, processing, or transportation of any non-renewable natural resource; or</text> </subparagraph> 
<subparagraph id="HE188B5FD04AB4EFBA8B60079BBC8031"><enum>(B)</enum><text>for the manufacture, production, or assembly of any equipment, machinery, product, or device that is involved in any activity described in subparagraph (A).</text> </subparagraph></paragraph> 
<paragraph id="HC3CD45ADA13A42CF8900C15FEF0187C8"><enum>(16)</enum><header>Nonrenewable natural resource</header><text display-inline="yes-display-inline">The term <term>nonrenewable natural resource</term>—</text> 
<subparagraph id="HBC010C481B8843A099A83320824CE0C4"><enum>(A)</enum><text display-inline="yes-display-inline">except as provided in subparagraph (B), means any naturally occurring, inanimate object, mineral, or nonliving resource that cannot be replenished by natural means at the same rate that it is consumed; and</text> </subparagraph>
