		<official-title>To amend title 10, United States Code, to clarify the
		  authority of the Secretary of a military department, or the Secretary of
		  Homeland Security in the case of the Coast Guard, to sell untreated water
		  located on military installations.</official-title>

		<section id="H786992020266426BAC45EEB052AEAB42" section-type="section-one"><enum>1.</enum><header>Sale of certain utilities and
			 services</header><text display-inline="no-display-inline">Section 2686 of title
			 10, United States Code, is amended by adding at the end the following new
			 subsection:</text>
			<quoted-block display-inline="no-display-inline" id="H24DD3D14B420477C8EFEEF816C527BAE" style="OLC">
				<subsection id="H16C2734325C443B5B7462D5ECE9F2CD7"><enum>(d)</enum><text display-inline="yes-display-inline">If a proposed sale under this section
				consists solely of untreated water, the Secretary concerned, in making the
				determination required by subsection (a) regarding whether the utility or
				related service to be sold is available from other local sources, shall not
				consider—</text>
					<paragraph id="HB7DB3192F4BE49469E09AE462822D19"><enum>(1)</enum><text>the availability of
				treated water from any local source; or</text>
					</paragraph><paragraph id="HE1F3BBDE312B44A600F2F55F58E15894"><enum>(2)</enum><text display-inline="yes-display-inline">the availability of untreated water from
				another local source that is situated outside of the political subdivision in
				which the military facility that will supply the untreated water is
				located.</text>
