		<section id="HF151CE8404254F31AD96F358160848DB" section-type="section-one"><enum>1.</enum><header>Eligibility requirements
			 under the Arms Export Control Act</header>
			<subsection id="H6AF3B02A8FF040A9B5B3C1C9D1A6837D"><enum>(a)</enum><header>General
			 requirements relating to misuse of United States–origin defense articles or
			 services</header><text>Section 3(c) of the Arms Export Control Act (22 U.S.C.
			 2753(c)) is amended—</text>
				<paragraph id="H0D734496248D4A65B4539CE5E9DCA8B3"><enum>(1)</enum><text>in paragraph (1),
			 by striking <quote>(either in terms of quantities or in terms of the gravity of
			 the consequences regardless of the quantities involved)</quote> each place it
			 appears; and</text>
				</paragraph><paragraph id="H9A81F7E7A755400290ABFADC989EF1A5"><enum>(2)</enum><text>in paragraph
			 (2)—</text>
					<subparagraph id="H35D3EF11FF344CEDAFFCB410C839F906"><enum>(A)</enum><text>by striking
			 <quote>(2)</quote> and inserting <quote>(2)(A)</quote>; and</text>
					</subparagraph><subparagraph id="H0B6EC1A4AA5546C7805427E7B9BC95E"><enum>(B)</enum><text>by adding at the
			 end the following new subparagraph:</text>
						<quoted-block display-inline="no-display-inline" id="H81BBA24C014341949EA15F58EBB3CFE8" style="OLC">
							<subparagraph id="H277FD6AA59F549DFADDB90AA64B5ADE0" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">The Inspector General of the Department of
				State shall submit to Congress an annual report that contains—</text>
								<clause id="H1515FD26B48A43F39BAC38C69D443EA7"><enum>(i)</enum><text>a determination of the Inspector
				General as to whether or not the Department of State has complied fully and
				comprehensively with the requirements of this subsection and subsection (e)
				during the preceding year; and</text>
								</clause><clause id="H4ABEB333EA2E4AD19005086C954ED973"><enum>(ii)</enum><text>a detailed description of the
				basis of the determination under clause
				(i).</text>
								</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection id="H1B44848BEC484A239BC42FDB86F9D2DC"><enum>(b)</enum><header>Congressional
			 approval for sales to non-NATO countries that have misused United States–origin
			 defense articles or services</header>
				<paragraph id="HDCAC304F474B4432A913BD00037E2C8C"><enum>(1)</enum><header>Amendment</header><text>Section
			 3 of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2753">22 U.S.C. 2753</external-xref>) is amended by adding at the
			 end the following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="HD7CFC56EAA74477D88CF848EAC803BE4" style="OLC">
						<subsection id="H7A359EE929304BA2B208CC05DA7C00A4"><enum>(h)(1)</enum><text display-inline="yes-display-inline">A license permitting a proposed letter of
				offer to sell defense articles or defense services with respect to which a
				certification is required to be submitted pursuant to subsection (b) or (c) of
				section 36 to a country described in paragraph (2) may be issued only if
				Congress enacts a joint resolution approving the sale in accordance with the
				procedures described in paragraph (3).</text>
						</subsection><subsection id="H4AC00F1493DE4D00B0151E8FC5DB7D83"><enum>(2)</enum><text display-inline="yes-display-inline">A country referred to in paragraph (1) is a
				country, other than a country that is a member of the North Atlantic Treaty
				Organization, Australia, New Zealand, or Japan, that is the subject of a report
				issued under subsection (c) or (e) of this section at any time during the
				previous five years.</text>
						</subsection><subsection id="H1D459120361E400BA0E3AE3C91A65051"><enum>(3)</enum><text display-inline="yes-display-inline">A joint resolution referred to in paragraph
				(1)—</text>
							<paragraph id="H5A88F9828E644889A75EBD7566F000D0"><enum>(A)</enum><text>may only be
				introduced by either chair or ranking minority member of the appropriate
				congressional committees (as such term is defined in section 36(e)(1));
				and</text>
							</paragraph><paragraph id="H6EDF58B94217414F9CC82B2F69CC801B"><enum>(B)</enum><text>shall be
				considered in the House of Representatives and the Senate in accordance with
				the procedures applicable to the consideration of a joint resolution of
				disapproval under subsection (b) or (c) of section 36, as the case may
				be.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HD54DBB22E24F4994ACB0DA84515BF5A4"><enum>(2)</enum><header>Effective
			 date</header><text>The amendment made by paragraph (1) applies with respect to
			 a country described in paragraph (2) of section 3(h) of the Arms Export Control
			 Act (as added by paragraph (1)) that is the subject of a report issued under
			 subsection (c) or (e) of section 3 of such Act on or after October 1,
			 2006.</text>
				</paragraph></subsection></section><section id="H7AAE85228D0146CC8156529F03EBA137" section-type="subsequent-section"><enum>2.</enum><header>Estimate and
			 justification for sales program under the Arms Export Control Act</header>
			<subsection id="H578420A227F24B44838C80CC93D73548"><enum>(a)</enum><header>Quarterly
			 reports</header>
				<paragraph id="H8E1A3E7157E84A08BE5CA006E920ECA"><enum>(1)</enum><header>In
			 general</header><text>Section 25(a) of the Arms Export Control Act (22 U.S.C.
			 2765(a)) is amended by striking <quote>(a) Except as provided</quote> and all
			 that follows through <quote>are deemed most likely actually to result in the
			 issuance of a letter of offer or of an export license during such year;</quote>
			 and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="H6BC88503663A415E8CD97B7948B3A6DB" style="OLC">
						<paragraph id="HE2939D3C05FC428298023B2E6889D66B" indent="up1"><enum>(a)(1)</enum><text>Not later than the first day of
				each calendar quarter, the President shall transmit to the appropriate
				congressional committees a report that sets forth an Arms Sales Proposal
				covering all proposed sales and licensed commercial exports under this Act of
				major weapons or weapons-related defense equipment for $7,000,000 or more, or
				of any other weapons or weapons-related defense equipment for $25,000,000 or
				more, which are likely to result in a letter of offer or of an export license
				during such calendar quarter or the succeeding calendar
				quarter.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H1F95836DF1094A3BA154CD0451D7E42"><enum>(2)</enum><header>Additional
			 information</header><text>Section 25(a) of the Arms Export Control Act (22
			 U.S.C. 2765(a), as amended by paragraph (1), is further amended—</text>
					<subparagraph id="HFC16CD47138041B5AC07E1BD7DE1A5B5"><enum>(A)</enum><text>by striking
			 <quote>(2) an estimate</quote> and inserting the following:</text>
						<quoted-block display-inline="no-display-inline" id="HE8697110CDB2406FA453CFB505211B50" style="OLC">
							<paragraph id="H44CE904C500E4286A39F98D39CE00C4" indent="up1"><enum>(2)</enum><text>Except as provided in subsection
				(d)(1) of this section, the President shall include in the report required by
				paragraph (1) for the first calendar quarter of each calendar year—</text>
								<subparagraph id="HB34413BADB7148DC947FB071F8915781"><enum>(A)</enum><text>an
				estimate</text>
								</subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="HF312AA9196C14347A92310A55454933F"><enum>(B)</enum><text>by redesignating
			 paragraphs (3) through (14) as subparagraphs (B) through (M),
			 respectively;</text>
					</subparagraph><subparagraph id="H30D09381309F44A2AA8E5B715432C5D0"><enum>(C)</enum><text>in paragraph
			 (2)(C) (as redesignated), by striking <quote>paragraphs (1) and (2) of this
			 subsection</quote> and inserting <quote>subparagraph (A)</quote> ;</text>
					</subparagraph><subparagraph id="H2DD9269E45364116BBC1F000247CD2F"><enum>(D)</enum><text>in paragraph (2)(D)
			 (as redesignated)—</text>
						<clause id="H12436A37320A4C9EA0981B94969B5856"><enum>(i)</enum><text>by
			 redesignating subparagraphs (A) and (B) as clauses (i) and (ii), respectively;
			 and</text>

						</clause></subparagraph></paragraph><paragraph id="H196FB4D0CE094112A9EBF4753CBA93C"><enum>(3)</enum><header>Definition</header><text>Section
			 25(a) of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2765">22 U.S.C. 2765(a)</external-xref>, as amended by
			 paragraphs (1) and (2), is further amended by adding at the end the following
			 new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="HC2F9D503775440F89BE093CB211F7DD3" style="OLC">
						<paragraph id="HA92A24006C63440DBA08749D3D930014" indent="up1"><enum>(3)</enum><text>In this subsection, the term
				<quote>calendar quarter</quote> means any three-month period beginning on
				January 1, April 1, July 1, or October 1 of a calendar
				year.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H22E207FF2E5A40E89D01FA1132DC5348"><enum>(b)</enum><header>Additional
			 information</header><text>Section 25(b) of the Arms Export Control Act (22
			 U.S.C. 2765(b)) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H893E933F43B24FCDA400B31080EB06C4" style="OLC">
					<subsection id="HB5B28790FDD64FDDA37F72E1AE169FD8"><enum>(b)(1)(A)</enum><text display-inline="yes-display-inline">Not later than 15 days after the date on
				which the President transmits to the appropriate congressional committees a
				report under subsection (a), the President shall make available to the
				appropriate congressional committees all information, in the possession of the
				President as of the date on which such report is so transmitted, regarding each
				proposed sale and export listed in such report.</text>
					</subsection><subsection id="HE9F2302C789946F9A255DDF494F7DA7F"><enum>(B)</enum><text>Such information
				shall include, but not be limited to—</text>
						<paragraph id="HB61BD420F2B243A48E509EA1AC590055"><enum>(i)</enum><text>technical details
				of all equipment, technology, software and armament that may be included as
				part of the sale or export;</text>
						</paragraph><paragraph id="HCC08DC5AB99747E0AD86C9839B004600"><enum>(ii)</enum><text>communications
				between the United States and the purchasing country regarding the sale or
				export;</text>
						</paragraph><paragraph id="HDDC440256DFC4DB7A9A383B950CE6419"><enum>(iii)</enum><text>intelligence
				information relevant to the sale or export; and</text>
						</paragraph><paragraph id="HAEC9B6B8467742CD91AFF5243DC688AD"><enum>(iv)</enum><text>any other
				relevant information relating to the sale or export.</text>
						</paragraph></subsection><subsection id="HF5F5E3D9BBB24D7C875EDE0700323634"><enum>(2)</enum><text>Either chair of
				the appropriate congressional committees may waive the requirement of paragraph
				(1) with respect to a proposed sale or
				export.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H669D0F7EDC3542C9932E75A3DA67E78B"><enum>(c)</enum><header>Exception;
			 definition</header><text>Section 25 of the Arms Export Control Act (22 U.S.C.
			 2765) is amended—</text>
				<paragraph id="H75337F71410746A4A319EE042FE74FE"><enum>(1)</enum><text>in
			 the first subsection (d) (as added by section 113(2) of the International
			 Security and Development Cooperation Act of 1985 (<external-xref legal-doc="public-law" parsable-cite="pl/99/83">Public Law 99–83</external-xref>; 99 Stat.
			 198))—</text>
					<subparagraph id="H60EDA1535AF7402BBC9237FBBE30A8A"><enum>(A)</enum><text>by striking
			 <quote>(d)</quote> and inserting <quote>(d)(1)</quote>; and</text>
					</subparagraph><subparagraph id="H477EFD759F6645D095B1275285DA3771"><enum>(B)</enum><text>by striking

				<paragraph id="H1D8109808A8E4CA7B18DE2AB70119D1B"><enum>(1)</enum><text>by striking
			 <quote><header-in-text level="section" style="OLC">annual</header-in-text></quote> and inserting
			 <quote><header-in-text level="section" style="OLC">quarterly</header-in-text></quote>; and</text>
				</paragraph><paragraph id="HA299AABEEDFD4C36AEB05304D7F915D"><enum>(2)</enum><text>by
			 inserting <quote><header-in-text level="section" style="OLC">annual</header-in-text></quote>
			 before <quote><header-in-text level="section" style="OLC">justification</header-in-text></quote>.</text>
				</paragraph></subsection><subsection id="H91C8A73D3D534DF7B058AD585020CAE2"><enum>(e)</enum><header>Reports on
			 commercial and governmental military exports; congressional
			 actions</header><text>Section 36 of the Arms Export Control Act (22 U.S.C.
			 2776) is amended—</text>
				<paragraph id="H9258D15F642B41EA885894CD3BA6DBC9"><enum>(1)</enum><text>in subsection (b),
			 by adding at the end the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="H113F951CAF024558BA690109ED7B75B4" style="OLC">
						<paragraph id="HFDB18E491A004D99865D17C4B0F5B26C" indent="up1"><enum>(7)</enum><text display-inline="yes-display-inline">A
				certification for a proposed sale or export of defense articles or defense
				services may be transmitted pursuant to this subsection only if information
				with respect to the sale or export of such defense articles or defense services
				is included in the report transmitted to the appropriate congressional
				committees pursuant to section 25(a) of this Act for the most recent calendar
				quarter (as such term is defined in such section) or the preceding calendar
				quarter.</text>
						</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H026C414A4A93438CBF88ACC8328E9037"><enum>(2)</enum><text>in subsection (c),
			 by adding at the end the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="H1D054ADA492D48EEA7F989B8DB3FEC7E" style="OLC">
						<paragraph id="H5916049F201844280028A9E1E62ADBB" indent="up1"><enum>(6)</enum><text>A certification for a proposed sale
				or export of defense articles or defense services may be transmitted pursuant
				to this subsection only if information with respect to the sale or export of
				such defense articles or defense services is included in the report transmitted
				to the appropriate congressional committees pursuant to section 25(a) of this
				Act for the most recent calendar quarter (as such term is defined in such
				section) or the preceding calendar quarter.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H171F3F1756D147888774CD6ECEA363C"><enum>(f)</enum><header>Effective
			 date</header><text>The amendments made by this section apply with respect to
			 reports required to be transmitted under section 25 of the Arms Export Control
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2765">22 U.S.C. 2765</external-xref>) for 2007 and each subsequent calendar year.</text>
			</subsection></section><section id="H56C8DC92B597475196539E9F17D9007B" section-type="subsequent-section"><enum>3.</enum><header>Reports on commercial
			 and governmental military exports under the Arms Export Control Act;
			 congressional actions</header>
			<subsection id="HB1B75E6BA67C40F0B99DD7AE092EC1"><enum>(a)</enum><header>Expedited
			 procedures for congressional disapproval</header>
				<paragraph id="HA3B0110448BF434787B1B52EE5BCE050"><enum>(1)</enum><header>Government
			 sales</header><text>Section 36(b) of the Arms Export Control Act (22 U.S.C.
			 2776(b)) is amended—</text>
					<subparagraph id="H9E0589F7CE6A4ED0A0FC534B28FC6E75"><enum>(A)</enum><text>by striking
			 paragraphs (2) and (3);</text>
					</subparagraph><subparagraph id="H5EED906933364CE48BA1DFE0C4C065ED"><enum>(B)</enum><text>by inserting after
			 paragraph (1) the following new paragraph:</text>
						<quoted-block display-inline="no-display-inline" id="HB2EF8793B2B148AD8F9900AA5F734B88" style="OLC">
							<paragraph id="H4ABF65D827D34C59AF3E1C311FEE79D" indent="up1"><enum>(2)(A)</enum><text display-inline="yes-display-inline">Except as provided in subparagraph (B), the
				provisions of subsections (b), (c), (d), (e), and (f) of section 152 of the
				Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2192">19 U.S.C. 2192(b)</external-xref>, (c), (d), (e) and (f)) apply to a joint
				resolution described in paragraph (1) to the same extent as such provisions
				apply to a joint resolution described in section 152 of such Act.</text>
							</paragraph><paragraph id="H59A5381A49BD40B48F1BF8C6212EBEFE" indent="up1"><enum>(B)</enum><text>A joint resolution described in
				subparagraph (A) may only be introduced by either the chair or ranking minority
				member of the appropriate congressional
				committees.</text>
							</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="HBD40545287554AC4819585017FB2C00"><enum>(C)</enum><text>by redesignating
			 paragraphs (4) through (6) as paragraphs (3) through (5), respectively;</text>
					</subparagraph><subparagraph id="H69035A49B1394F0EA3FECC54A9DEA481"><enum>(D)</enum><text>in paragraph
			 (4)(C), by striking <quote>paragraph (6)</quote> and inserting <quote>paragraph
			 (5)</quote>; and</text>
					</subparagraph><subparagraph id="H059224C3C4604596A18429A8CB6FF9BA"><enum>(E)</enum><text>in paragraph (6),
			 by striking <quote>paragraph (5)(C)</quote> and inserting <quote>paragraph
			 (4)(C)</quote>.</text>
					</subparagraph></paragraph><paragraph id="H429040BE4BA040678B3EF523BF62A6AC"><enum>(2)</enum><header>Commercial
			 sales</header><text display-inline="yes-display-inline">Section 36(c)(3) of the
			 Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2776">22 U.S.C. 2776(c)(3)</external-xref>) is amended to read as
			 follows:</text>
					<quoted-block display-inline="no-display-inline" id="H884AFCD7D7BF453DAB7CDEF691E14FB5" style="OLC">
						<paragraph id="HCADD8EA8037A43150066F0B66F5E552B" indent="up1"><enum>(3)(A)</enum><text>Except as provided in subparagraph
				(B), the provisions of subsections (b), (c), (d), (e), and (f) of section 152
				of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2192">19 U.S.C. 2192(b)</external-xref>, (c), (d), (e) and (f)) apply to a
				joint resolution described in paragraph (2) to the same extent as such
				provisions apply to a joint resolution described in section 152 of such
				Act.</text>
						</paragraph><paragraph id="H550AB492C2EF42629600B80022917192" indent="up1"><enum>(B)</enum><text>A joint resolution described in
				subparagraph (A) may only be introduced by either the chair or ranking minority
				member of the appropriate congressional
				committees.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H25E69348E9AC45B5AED6432CD63BF076"><enum>(b)</enum><header>Requirement to
			 provide advance notification and consultation on certain sales and
			 exports</header><text>Section 36 of the Arms Export Control Act (22 U.S.C.
			 2776) is amended by adding at the end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H5FCF360BC9FB4C99BF4D2BDBA1F7EF0" style="OLC">
					<subsection id="H546AF24E7FEF4BFCAF4B52DB93D0137E"><enum>(h)(1)(A)</enum><text display-inline="yes-display-inline">Not later than 20 calendar days prior to
				the submission of a certification under subsection (b), (c), or (d) of this
				section, the President shall provide advance notification in writing to, and
				consult with, the chairs and ranking minority members of the appropriate
				congressional committees of the offer to sell or export the defense articles or
				defense services with respect to which such a certification is required to be
				submitted pursuant to any such subsection.</text>
					</subsection><subsection id="H684702A00D5A40749718F6412007382"><enum>(B)(i)</enum><text display-inline="yes-display-inline">The requirement of subparagraph (A) to
				provide 20 calendar days advance notification in writing to the chairs and
				ranking minority members of the appropriate congressional committees shall not
				apply if the chairs and ranking minority members of the appropriate
				congressional committees have agreed, at their discretion, to waive such
				requirement.</text>
						<paragraph commented="no" id="HA7172ED001D343E692F4FFE6E3F2ECD" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">The requirements of subparagraph (A) shall
				not apply if the President states in the certification that an emergency exists
				that requires the sale or export of defense articles or defense services to be
				in the national security interests of the United States in accordance with
				subsection (b), (c), or (d) of this section.</text>
						</paragraph></subsection><subsection id="H990E3CD0D2444C15B341FAACEF5FA59C"><enum>(2)(A)</enum><text display-inline="yes-display-inline">The President shall not submit a
				certification under subsection (b), (c), or (d) of this section if either chair
				or ranking minority member of the appropriate congressional committees requests
				a deferral of the submission of the certification based on the impact of the
				proposed sale or export of defense articles or defense services described in
				paragraph (1) on the security or foreign policy interests of the United
				States.</text>
					</subsection><subsection id="H85E16D7A1C4948B0A0135E26C73EF98"><enum>(B)(i)</enum><text>The requirement
				of subparagraph (A) shall not apply if the President transmits to the chairs
				and ranking minority members of the appropriate congressional committees a
				report in writing that contains a determination of the President that
				extraordinary circumstances exist which necessitates the obviation of such
				requirement and a detailed description of such circumstances.</text>
					</subsection><subsection id="HBB0FA3C5F92E43D6BF93B25EBD2865F"><enum>(ii)</enum><text>The authority of
				clause (i) may not be delegated to any official who holds a position that is
				lower in rank or status than the Secretary of
				State.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HD5DD5F23FDF24F13AC2FAC1CA01B00F9"><enum>(c)</enum><header>Requirement to
			 provide information relating to certain sales and exports</header><text>Section
			 36 of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2776">22 U.S.C. 2776</external-xref>), as amended by subsection
			 (a), is further amended by adding at the end the following new
			 subsection:</text>
				<quoted-block display-inline="no-display-inline" id="HA22A72A238974A6DA89E7D5FED93F482" style="OLC">
					<subsection id="H6C7F37AD16A742AB87FA004C17008183"><enum>(i)(1)</enum><text display-inline="yes-display-inline">In the case of a certification for the
				offer to sell or export defense articles or defense services to a country other
				than a country that is a member of the North Atlantic Treaty Organization,
				Australia, New Zealand, or Japan, unless the President states in the
				certification that there has not been a violation of any agreement with the
				United States under section 3 of this Act or section 505 of the Foreign
				Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2314">22 U.S.C. 2314</external-xref>) involving such country which would
				necessitate the transmission to Congress of a report under subsection (c) or
				(e) of section 3 of this Act, the President shall, upon the written request of
				either chair or ranking minority member of the appropriate congressional
				committees, transmit to the appropriate congressional committees a report in
				writing that contains an explanation of the facts and circumstances prompting
				the omission of such statement in the certification.</text>
					</subsection><subsection id="HCA35D88188CE44D8AFF2EB58F6ADBE36"><enum>(2)(A)</enum><text>A written
				request to the President under paragraph (1) shall toll the 30-day period
				described in subsection (b), (c), or (d) of this section with respect to the
				enactment of a joint resolution to prohibit the sale or export of the defense
				articles or defense services from the date on which the request is received by
				the President until the date on which the President’s report is received by the
				appropriate congressional committees.</text>
					</subsection><subsection id="HFBF7FBDAEF994FA8AE35234333A7A75D"><enum>(B)(i)</enum><text display-inline="yes-display-inline">The requirement of subparagraph (A) shall
				not apply if the President transmits to the appropriate congressional
				committees a report in writing that contains a determination of the President
				that the national security interests of the United States would be adversely
				affected by the application of such requirement to the proposed sale or export
				of the defense articles or defense services.</text>
					</subsection><subsection id="H1113E1DFF0D5476187829E91A3EFCC4"><enum>(ii)</enum><text>The authority of
				clause (i) may not be delegated by the President to any other official of the
				Government of the United
				States.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H41FD1A26BC2A400BA5C09BB3B578E8A4"><enum>(d)</enum><header>Definition</header><text display-inline="yes-display-inline">Section 36(e) of the Arms Export Control
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2776">22 U.S.C. 2776(e)</external-xref>) is amended—</text>
				<paragraph id="HBBC1A1FB639E4F1EA72E5739B71F2717"><enum>(1)</enum><text>by redesignating
			 paragraphs (1) and (2) as paragraphs (2) and (3), respectively; and</text>
				</paragraph><paragraph id="H6CB6A45BAAFB4C50B7EF623E111532F2"><enum>(2)</enum><text>by inserting
			 before paragraph (2) (as redesignated) the following new paragraph:</text>

					</subparagraph></paragraph></subsection></section><section id="HE30723990C5E4AF6895755EA8D789B24"><enum>4.</enum><header>Notification and
			 consultation requirements relating to certain initiatives and
			 negotiations</header>
			<subsection id="HB0EF8BBC6E69400592F124E815CA3423"><enum>(a)</enum><header>Initiatives and
			 negotiations relating to nuclear cooperation</header><text display-inline="yes-display-inline">The President shall keep the appropriate
			 congressional committees fully and completely informed of any initiative or
			 negotiations relating to a new or amended agreement for peaceful nuclear
			 cooperation pursuant to section 123 of the Atomic Energy Act of 1954 prior to
			 the President’s announcement of such initiative or negotiations. The President
			 shall consult with the appropriate congressional committees concerning such
			 initiative or negotiations beginning not less than 15 calendar days before such
			 announcement.</text>
			</subsection><subsection id="HC45EEF18287B4812A7344F1000356816"><enum>(b)</enum><header>Initiatives and
			 negotiations with state sponsors of terrorism</header><text display-inline="yes-display-inline">The President shall keep the appropriate
			 congressional committees fully and completely informed of any initiative
			 relating to or negotiations with any country the government of which the
			 Secretary of State has determined, for purposes of section 6(j) of the Export
			 Administration Act of 1979, section 620A of the Foreign Assistance Act of 1961,
			 section 40 of the Arms Export Control Act, or any other provision of law, is a
			 government that has repeatedly provided support for acts of international
			 terrorism, either directly with such country or as part of a multilateral
			 initiative. The President shall consult with the appropriate congressional
			 committees concerning such initiative or negotiations not less than 15 calendar
			 days before the announcement or inception of such initiative or
			 negotiations.</text>
			</subsection><subsection id="HD1C37905574846C8BED681940385F3E3"><enum>(c)</enum><header>Definition</header><text>In
			 this section, the term <quote>appropriate congressional committees</quote>
			 means the Committee on International Relations of the House of Representatives
			 and the Committee on Foreign Relations of the Senate.</text>
