<official-title>To amend the Public Health Service Act to provide for arthritis research and public health, and for other purposes.</official-title>

<section section-type="section-one" id="H657F3952BAD142FFACCFF65B00CF6011" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Arthritis Prevention, Control, and Cure Act of 2005</short-title></quote>.</text></section> 
<section id="H13B1EF2A79BA4D8A91344E9CF8CF2B3"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following findings:</text> 
<paragraph id="H8C0C453E889B4B268DB772C3EE1E0014"><enum>(1)</enum><text>Arthritis and other rheumatic diseases are among the most common conditions in the United States. There are more than 100 different forms of arthritis, of which the 2 most common forms are osteoarthritis and rheumatoid arthritis.</text></paragraph> 
<paragraph id="H769D707777A44B2A96222179FA534056"><enum>(2)</enum><text>Arthritis and other rheumatic diseases cause severe and chronic pain, swollen tissue, ligament and joint destruction, deformities, permanent disability, and death. Arthritis and other rheumatic diseases erode patients’ quality of life and can diminish their mental health, impose significant limitations on their daily activities, and disrupt the lives of their family members and caregivers.</text></paragraph> 
<paragraph id="H86C85E7BB593407F94C6EB3C00B1BA2B"><enum>(3)</enum><text>One out of every 3, or nearly 70,000,000, adults in the United States suffer from arthritis or chronic joint symptoms. The number of individuals in the United States with arthritis will grow as the number of older Americans continues to increase dramatically in the next few decades.</text></paragraph> 
<paragraph id="H3CA7317C1BF945D395E49D00106F106E"><enum>(4)</enum><text>Arthritis and other rheumatic diseases affect all types of people of the United States, not just older individuals. Arthritis and other rheumatic diseases disproportionately affect women in the United States, and nearly 3 of every 5 individuals with arthritis are younger than 65 years of age. Today, 8,400,000 young adults ages 18 through 44 have arthritis and millions of others are at risk for developing the disease.</text></paragraph> 
<paragraph id="H795DBDF916B44668B9FDEF1FABF149D"><enum>(5)</enum><text>Arthritis and other rheumatic diseases are the leading cause of disability among adults in the United States. More than 8,000,000 people in the United States are disabled by arthritis and other rheumatic diseases. By 2020, arthritis will limit the daily activities of nearly 12,000,000 individuals.</text></paragraph> 
<paragraph id="HE5E7F824B6F042A5B4AB184900D5A102"><enum>(6)</enum><text>Nearly 60 percent of people of the United States with arthritis are of working age. In general, people with arthritis have a low rate of participation in the workforce. Arthritis is exceeded only by heart disease as a cause of work disability.</text></paragraph> 
<paragraph id="H8FA9518B76494DDFB6FCDE67B9BB8494"><enum>(7)</enum><text>Nearly 300,000 children in the United States, or 3 children out of every 1,000, have some form of arthritis or other rheumatic disease. It is the sense of Congress that the substantial morbidity associated with pediatric arthritis warrants a greater Federal investment in research to identify new and more effective treatments for these diseases.</text></paragraph> 
<paragraph id="HE8898770C1464E7299C3690593ECCE87"><enum>(8)</enum><text>Arthritis results in 750,000 hospitalizations, 44,000,000 outpatient visits, and 4,000,000 days of hospital care every year, according to the Centers for Disease Control and Prevention.</text></paragraph> 
<paragraph id="H865E89E3183048B783006E10B9AFDA47"><enum>(9)</enum><text>The Centers for Disease Control and Prevention estimate that the annual cost of medical care for arthritis is $51,000,000, and the estimated annual total cost of arthritis to the United States, including lost productivity, exceeds $86,000,000.</text></paragraph> 
<paragraph id="H5C9B51B2A05747138D8EAC60EA00A9D1"><enum>(10)</enum><text>In 1975, the National Arthritis Act of 1974 (<external-xref legal-doc="public-law" parsable-cite="pl/93/640">Public Law 93–640</external-xref>) was enacted to promote basic and clinical arthritis research, establish Multipurpose Arthritis Centers, and expand clinical knowledge in the field of arthritis. The Act was successfully implemented, and continued funding of arthritis-related research has led to important advances in arthritis control, treatment, and prevention.</text></paragraph> 
<paragraph id="H0647E27F936247C4ADFB354500277895"><enum>(11)</enum><text>Early diagnosis, treatment, and appropriate management of arthritis can control symptoms and improve quality of life. Weight control and exercise can demonstrably lower health risks from arthritis, as can other forms of patient education, training, and self-management. The genetics of arthritis are being actively investigated. New, innovative, and increasingly effective drug therapies, joint replacements, and other therapeutic options are being developed.</text></paragraph> 
<paragraph id="H03CCEBD94B3B497882844EECE77EE7B5"><enum>(12)</enum><text>While research has identified many effective interventions against arthritis, such interventions are broadly underutilized. That underutilization leads to unnecessary loss of life, health, and quality of life, as well as avoidable or unnecessarily high health care costs. Arthritis self-management can reduce both patient pain and health care costs, with some self-management programs reducing arthritis pain by 20 percent and physician visits by 40 percent. Yet less than 1 percent of the 49,000,000 people in the United States with arthritis participate in such programs, and self-management courses are not offered in all areas of the United States.</text></paragraph> 
<paragraph id="H2BDF258D798146B7BEA7B52D7F51842E"><enum>(13)</enum><text>Rheumatologists are internists or pediatric sub-specialists that are uniquely qualified by an additional 2 to 4 years of training and experience in the diagnosis and treatment of rheumatic conditions. Typically, rheumatologists act as consultants, but also often act as managers, relying on the help of many skilled professionals, including nurses, physical and occupational therapists, psychologists, and social workers. Many rheumatologists conduct research to determine the cause and effective treatment of disabling and sometimes fatal rheumatic diseases.</text></paragraph> 
<paragraph id="H7D7CBD697B304D139521008FB600C47C"><enum>(14)</enum><text>Recognizing that the Nation requires a public health approach to arthritis, the Department of Health and Human Services established important national goals related to arthritis in its Healthy People 2010 initiative. Moreover, various Federal and non-Federal stakeholders have worked cooperatively to develop a comprehensive National Arthritis Action Plan: A Public Health Strategy.</text></paragraph> 
<paragraph id="H8ED81905D80B48B500C671162266A687"><enum>(15)</enum><text>Greater efforts and commitments are needed from Congress, the States, providers, and patients to achieve the goals of Healthy People 2010, implement a national public health strategy consistent with the National Arthritis Action Plan, and lessen the burden of arthritis on citizens of the United States.</text></paragraph></section> 
<section id="H29F66623D5FD46EE8ED9371C46445075"><enum>3.</enum><header>Enhancing the public health activities related to arthritis of the Centers for Disease Control and Prevention through the National Arthritis Action Plan</header><text display-inline="no-display-inline">Part B of title III of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/243">42 U.S.C. 243 et seq.</external-xref>) is amended by inserting after section 314 the following:</text> 
<quoted-block act-name="Public Health Service Act" id="H48C712ADF66747609FC3A200C7CC005D"> 
<section id="HD676BD03BE614E940014AF1EEDF7F84"><enum>315.</enum><header>Implementation of the National Arthritis Action Plan</header><text display-inline="no-display-inline">The Secretary shall develop and implement a National Arthritis Action Plan that consists of—</text> 
<paragraph id="H8AF0FD52978D46A4934FF9CB5E07F382"><enum>(1)</enum><text>the Federal arthritis prevention and control activities, as described in section 315A;</text></paragraph> 
<paragraph id="HC4096B6A95BA4B4ABEE0E81872A7D8D2"><enum>(2)</enum><text>the State arthritis control and prevention programs, as described in section 315B;</text></paragraph> 
<paragraph id="HED5BE8F27A484302A71BEDA3A4EB4952"><enum>(3)</enum><text>the comprehensive arthritis action grant program, as described in section 315C; and</text></paragraph> 
<paragraph id="H262DA68F9AE242CBB01C008B87669900"><enum>(4)</enum><text>a national arthritis education and outreach program, as described in section 315D.</text></paragraph></section> 
<section id="H449D5ABADD7E4654BF273E0960355FBA"><enum>315A.</enum><header>Federal arthritis prevention and control activities</header> 
<subsection id="H2FB674D5BB6448F7A1C3E5FB8FFA40A9"><enum>(a)</enum><header>In general</header><text>The Secretary, acting through the Director of the Centers for Disease Control and Prevention, shall, directly, or through a grant to an eligible entity, conduct, support, and promote the coordination of research, investigations, demonstrations, training, and studies relating to the control, prevention, and surveillance of arthritis and other rheumatic diseases.</text></subsection> 
<subsection id="HE1985E054DB347D500DD04DDD9131BFE"><enum>(b)</enum><header>Duties of Secretary</header><text>The activities of the Secretary under subsection (a) shall include—</text> 
<paragraph id="HB616CD0E301B4658A4976FB7297D0013"><enum>(1)</enum><text>the collection, publication, and analysis of data on the prevalence and incidence of arthritis and other rheumatic diseases;</text></paragraph> 
<paragraph id="H2024CEA36422433F9976BBA9C01FECB9"><enum>(2)</enum><text>the development of uniform data sets for public health surveillance and clinical quality improvement activities;</text></paragraph> 
<paragraph id="H98D35A61C5224987BF804391AC0F544"><enum>(3)</enum><text>the identification of evidence-based and cost-effective best practices for the prevention, diagnosis, management, and care of arthritis and other rheumatic diseases;</text></paragraph> 
<paragraph id="H7DE6BEC821AD445EB8475374A514C5A7"><enum>(4)</enum><text>research, including research on behavioral interventions to prevent arthritis and on other evidence-based best practices relating to arthritis prevention, diagnosis, management, and care; and</text></paragraph> 
<paragraph id="H92C07A766FB741BE92BB8174E32B16B9"><enum>(5)</enum><text>demonstration projects, including community-based and patient self-management programs of arthritis control, prevention, and care, and similar collaborations with academic institutions, hospitals, health insurers, researchers, health professionals, and nonprofit organizations.</text></paragraph></subsection> 
<subsection id="H9A3F9C1E25194699A05D8CC8B3D24456"><enum>(c)</enum><header>Training and technical assistance</header><text>With respect to the planning, development, and operation of any activity carried out under subsection (a), the Secretary may provide training, technical assistance, supplies, equipment, or services, and may assign any officer or employee of the Department of Health and Human Services to a State or local health agency, or to any public or nonprofit entity designated by a State health agency, in lieu of providing grant funds under this section.</text></subsection> 
<subsection id="H0F14CD57A9B14A3DBBC05300C3E4965B"><enum>(d)</enum><header>Arthritis Prevention Research at the Centers for Disease Control and Prevention Centers</header><text>The Secretary shall provide additional grant support for research projects at the Centers for Prevention Research by the Centers for Disease Control and Prevention to encourage the expansion of research portfolios at the Centers for Prevention Research to include arthritis-specific research activities related to the prevention and management of arthritis.</text></subsection> 
<subsection id="HA4686D976D6748C2958B00D235F1F75B"><enum>(e)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section such sums as may be necessary for each of fiscal years 2006 through 2010.</text></subsection></section> 
<section id="H55EF8EE5893E44229B44745928CF787E"><enum>315B.</enum><header>State arthritis control and prevention programs</header> 
<subsection id="HD40C8B9576FF42DEB576DAE5A7AD962"><enum>(a)</enum><header>In general</header><text>The Secretary shall award grants to eligible entities to provide support for comprehensive arthritis control and prevention programs and to enable such entities to provide public health surveillance, prevention, and control activities related to arthritis and other rheumatic diseases.</text></subsection> 
<subsection id="HBF15107A39F0478F8CFF3173E7A151C5"><enum>(b)</enum><header>Eligibility</header><text>To be eligible to receive a grant under this section, an entity shall be a State or Indian tribe.</text></subsection> 
<subsection id="HA0B13F52E6C1497B87D3864F19021B83"><enum>(c)</enum><header>Application</header><text>To be eligible to receive a grant under this section, an entity shall submit to the Secretary an application at such time, in such manner, and containing such agreements, assurances, and information as the Secretary may require, including a comprehensive arthritis control and prevention plan that—</text> 
<paragraph id="H6B6DA42677AF4DA38FF3DB83440814F8"><enum>(1)</enum><text>is developed with the advice of stakeholders from the public, private, and nonprofit sectors that have expertise relating to arthritis control, prevention, and treatment that increase the quality of life and decrease the level of disability;</text></paragraph> 
<paragraph id="H68614D92881E4393B98200F98600F815"><enum>(2)</enum><text>is intended to reduce the morbidity of arthritis, with priority on preventing and controlling arthritis in at-risk populations and reducing disparities in arthritis prevention, diagnosis, management, and quality of care in underserved populations;</text></paragraph> 
<paragraph id="HF14ADD7D043746A39800EC724C685EBE"><enum>(3)</enum><text>describes the arthritis-related services and activities to be undertaken or supported by the entity; and</text></paragraph> 
<paragraph id="H8BB20F2AECFF41F9A9C08BD735BA5414"><enum>(4)</enum><text>is developed in a manner that is consistent with the National Arthritis Action Plan or a subsequent strategic plan designated by the Secretary.</text></paragraph></subsection> 
<subsection id="HEB76EDF51D984F90898D8878202300B5"><enum>(d)</enum><header>Use of funds</header><text>An eligible entity shall use amounts received under a grant awarded under subsection (a) to conduct, in a manner consistent with the comprehensive arthritis control and prevention plan submitted by the entity in the application under subsection (c)—</text> 
<paragraph id="H978A9CA6E9BF4F8B9C90EC029F3FFDE8"><enum>(1)</enum><text>public health surveillance and epidemiological activities relating to the prevalence of arthritis and assessment of disparities in arthritis prevention, diagnosis, management, and care;</text></paragraph> 
<paragraph id="H7B40816029754D45B6C38CEBB473A2D7"><enum>(2)</enum><text>public information and education programs; and</text></paragraph> 
<paragraph id="H151BEBCE0991412285D9C5D9375BE9D2"><enum>(3)</enum><text>education, training, and clinical skills improvement activities for health professionals, including allied health personnel.</text></paragraph></subsection> 
<subsection id="H2B2E8E189C514FF3B0006FA316880017"><enum>(e)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section such sums as may be necessary for each of fiscal years 2006 through 2010.</text></subsection></section> 
<section id="HB250A41C41E142C589681862BB51EEB"><enum>315C.</enum><header>Comprehensive arthritis action grants</header> 
<subsection id="HC2137825D4D14A509E4C003D00CD3406"><enum>(a)</enum><header>In general</header><text>The Secretary shall award grants on a competitive basis to eligible entities to enable such eligible entities to assist in the implementation of a national strategy for arthritis control and prevention.</text></subsection> 
<subsection id="H72D367CCD195498800B125142EAACF2E"><enum>(b)</enum><header>Eligibility</header><text>To be eligible to receive a grant under this section, an entity shall be a national public or private nonprofit entity.</text></subsection> 
<subsection id="H248E5D4FFA064FE6007300F43B892A9"><enum>(c)</enum><header>Application</header><text>To be eligible to receive a grant under this section, an entity shall submit to the Secretary an application at such time, in such manner, and containing such agreements, assurances, and information as the Secretary may require, including a description of how funds received under a grant awarded under this section will—</text> 
<paragraph id="HBFEF42F1981245A6AAC85910A8A09922"><enum>(1)</enum><text>supplement or fulfill unmet needs identified in the comprehensive arthritis control and prevention plan of a State or Indian tribe;</text></paragraph> 
<paragraph id="H1F841D229759401080875500742BFE62"><enum>(2)</enum><text>otherwise help achieve the goals of the National Arthritis Action Plan or a subsequent strategic plan designated by the Secretary.</text></paragraph></subsection> 
<subsection id="H9749F3583F6247CEA4B88B588F20AAC"><enum>(d)</enum><header>Priority</header><text>In awarding grants under this section, the Secretary shall give priority to eligible entities submitting applications proposing to carry out programs for controlling and preventing arthritis in at-risk populations or reducing disparities in underserved populations.</text></subsection> 
<subsection id="H392FE476C7E64A45BBEAE32FAD791523"><enum>(e)</enum><header>Use of funds</header><text>An eligible entity shall use amounts received under a grant awarded under subsection (a) for 1 or more of the following purposes:</text> 
<paragraph id="HD116ECBE2C354A38AEE493EA7EC1D799"><enum>(1)</enum><text>To expand the availability of physical activity programs designed specifically for people with arthritis.</text></paragraph> 
<paragraph id="H66B582BBF44841508ECF3B66E830321"><enum>(2)</enum><text>To provide awareness education to patients, family members, and health care providers, to help such individuals recognize the signs and symptoms of arthritis, and to address the control and prevention of arthritis.</text></paragraph> 
<paragraph id="HDDA9F2B737FA48F7A83CE425F90008A2"><enum>(3)</enum><text>To decrease long-term consequences of arthritis by making information available to individuals with regard to the self-management of arthritis.</text></paragraph> 
<paragraph id="H866C2814BDD44B25A46E4BF8F3F53B22"><enum>(4)</enum><text>To provide information on nutrition education programs with regard to preventing or mitigating the impact of arthritis.</text></paragraph></subsection> 
<subsection id="H34D89BBE4BDB464EA7B4A900F9A10667"><enum>(f)</enum><header>Evaluation</header><text>An eligible entity that receives a grant under this section shall submit to the Secretary an evaluation of the operations and activities carried out under such grant that includes an analysis of increased utilization and benefit of public health programs relevant to the activities described in the appropriate provisions of subsection (e).</text></subsection> 
<subsection id="H3E15A4D4BED74675AE00E094B5584914"><enum>(g)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section such sums as may be necessary for each of fiscal years 2006 through 2010.</text></subsection></section> 
<section id="H86279B5DCFAF4F8EA081A44B37F8BC2"><enum>315D.</enum><header>National arthritis education and outreach</header> 
<subsection id="H0A57045CDDA0487C9628B9E004D451B"><enum>(a)</enum><header>In general</header><text>The Secretary shall coordinate a national education and outreach program to support, develop, and implement education initiatives and outreach strategies appropriate for arthritis and other rheumatic diseases.</text></subsection> 
<subsection id="H544740D0419C47BE96CEBCCE352C31D6"><enum>(b)</enum><header>Initiatives and strategies</header><text>Initiatives and strategies implemented under the program described in paragraph (1) may include public awareness campaigns, public service announcements, and community partnership workshops, as well as programs targeted at businesses and employers, managed care organizations, and health care providers.</text></subsection> 
<subsection id="HD9FAEE11FF9248FFA324208FCE69A53E"><enum>(c)</enum><header>Priority</header><text>In carrying out subsection (a), the Secretary—</text> 
<paragraph id="H0A5E0291C8E6469AB6B29CCA87DE28F6"><enum>(1)</enum><text>may emphasize prevention, early diagnosis, and appropriate management of arthritis, and opportunities for effective patient self-management; and</text></paragraph> 
<paragraph id="H57BDD3EDB0D144E296484CDFBAA6D3E3"><enum>(2)</enum><text>shall give priority to reaching high-risk or underserved populations.</text></paragraph></subsection> 
<subsection id="HA6703AD2C14642888B5B9FDB74A4D730"><enum>(d)</enum><header>Collaboration</header><text>In carrying out this section, the Secretary shall consult and collaborate with stake-holders from the public, private, and nonprofit sectors with expertise relating to arthritis control, prevention, and treatment.</text></subsection> 
<subsection id="H9177A4F1019246779E68DF639889621B"><enum>(e)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section such sums as may be necessary for each of fiscal years 2006 through 2010.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HB364DAD7B99A4ECF007215ABC43E9067"><enum>4.</enum><header>Expansion and coordination of activities of the National Institutes of Health with respect to research on arthritis</header><text display-inline="no-display-inline">Title IV of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/281">42 U.S.C. 281 et seq.</external-xref>) is amended by inserting after section 439 the following:</text>

<section id="H4A9441348E634F1FAA68E3EA5BFCC325"><enum>439A.</enum><header>Arthritis and Rheumatic Diseases Interagency Coordinating Committee</header> 
<subsection id="H5292091E59134491ADC2C9EF2C46DBF3"><enum>(a)</enum><header>In general</header> 
<paragraph id="H65D7AB76655049D9B76B7BBB657775B7"><enum>(1)</enum><header>Establishment</header><text>The Secretary shall establish an Arthritis and Rheumatic Diseases Interagency Coordinating Committee (referred to in this section as the <quote>Coordinating Committee</quote>).</text></paragraph> 
<paragraph id="H88E4E73A192E45D6B2AFD4C600B253D0"><enum>(2)</enum><header>Duties</header><text>The coordinating committee established under paragraph (1) shall—</text> 
<subparagraph id="H5168E50D5A434324855DA3D2478F898E"><enum>(A)</enum><text>provide for the improved coordination of the research activities of all the national research institutes relating to arthritis and rheumatic diseases; and</text></subparagraph> 
<subparagraph id="H5990A75A19C64A95B98E5F440383FE00"><enum>(B)</enum><text>provide for full and regular communication and exchange of information necessary to maintain adequate coordination across all Federal health programs and activities related to arthritis and rheumatic diseases.</text></subparagraph></paragraph></subsection> 
<subsection id="H9EFCDBD435ED4596A2A14EC8C111EC86"><enum>(b)</enum><header>Arthritis and Rheumatic Diseases Interagency Coordinating Committee</header> 
<paragraph id="H07D66BA9BAAC41EBA0B3727F68664F9C"><enum>(1)</enum><header>Composition</header><text>The Coordinating Committee shall consist of members, appointed by the Secretary, of which—</text> 
<subparagraph id="H1C9882672A5043B4A2F900EACC002CC2"><enum>(A)</enum><text><fraction>2/3</fraction> of such members shall represent governmental agencies, including—</text> 
<clause id="H7B57D84F2CA04ED78D982CA39B53BF26"><enum>(i)</enum><text>the directors of each of the national research institutes and divisions involved in research regarding arthritis and rheumatic diseases (or the directors’ respective designees); and</text></clause> 
<clause id="H1A0856B7CE19453084A1AB95A9E411B3"><enum>(ii)</enum><text>representatives of other Federal departments and agencies (as determined appropriate by the Secretary) whose programs involve health functions or responsibilities relevant to arthritis and rheumatic diseases, including the Centers for Disease Control and Prevention, the Health Resources and Services Administration, and the Food and Drug Administration; and</text></clause></subparagraph> 
<subparagraph id="HCDB123F1089A4642B11C52D9EB622D59"><enum>(B)</enum><text><fraction>1/3</fraction> of such members shall be public members, including a broad cross section of persons affected by arthritis, researchers, clinicians, and representatives of voluntary health agencies, who—</text> 
<clause id="HD9F6F04FECDC4CAEB497EFEAB58FA2FD"><enum>(i)</enum><text>shall serve for a term of 3 years; and</text></clause> 
<clause id="HD1CF21D67E994AA2B45CBF008300FE6B"><enum>(ii)</enum><text>may serve for an unlimited number of terms if reappointed.</text></clause></subparagraph></paragraph> 
<paragraph id="HDEC4F1070CF9445ABF5FD82275876446"><enum>(2)</enum><header>Chairperson</header> 
<subparagraph id="H90B04CFEBC07402AB6D46BD1482C9198"><enum>(A)</enum><header>Appointment</header><text>The Chairperson of the Coordinating Committee (referred to in this subsection as the <quote>Chairperson</quote>) shall be appointed by and be directly responsible to the Secretary.</text></subparagraph> 
<subparagraph id="HE75C554127904B15985DF36787D993FD"><enum>(B)</enum><header>Duties</header><text>The Chairperson shall—</text> 
<clause id="HF3FEEFC8F68C4604B675DE48119D8EC6"><enum>(i)</enum><text>serve as the principal advisor to the Secretary, the Assistant Secretary for Health, and the Director of NIH on matters relating to arthritis and rheumatic diseases; and</text></clause> 
<clause id="H7559FA77FDDC401E8FEAA01CC8223D05"><enum>(ii)</enum><text>provide advice to the Director of the Centers for Disease Control and Prevention, the Commissioner of Food and Drugs, and the heads of other relevant Federal agencies, on matters relating to arthritis and rheumatic diseases.</text></clause></subparagraph></paragraph> 
<paragraph id="H2F8F2079A9AA4D6BB9A4E6AE64C767CA"><enum>(3)</enum><header>Administrative support; meetings</header> 
<subparagraph id="HB13E993088224ABC95186845D942F32F"><enum>(A)</enum><header>Administrative support</header><text>The Secretary shall provide necessary and appropriate administrative support to the Coordinating Committee.</text></subparagraph> 
<subparagraph id="H3CC08607FD2F4833AC5B45846356BBDA"><enum>(B)</enum><header>Meetings</header><text>The Coordinating Committee shall meet on a regular basis as determined by the Secretary, in consultation with the Chairperson.</text></subparagraph></paragraph></subsection> 
<subsection id="H46A124877E044CD0ADBDCD917D79C2B0"><enum>(c)</enum><header>Arthritis and Rheumatic Diseases Summit</header> 
<paragraph id="HE6913FF4108740B2AAE5866BE32831F4"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of the <short-title>Arthritis Prevention, Control, and Cure Act of 2005</short-title>, the Coordinating Committee shall convene a summit of researchers, public health professionals, representatives of voluntary health agencies, representatives of academic institutions, and Federal and State policymakers, to provide a detailed overview of current research activities at the National Institutes of Health, as well as to discuss and solicit input related to potential areas of collaboration between the National Institutes of Health and other Federal health agencies, including the Centers for Disease Control and Prevention, the Agency for Healthcare Research and Quality, and the Health Resources and Services Administration, related to research, prevention, and treatment of arthritis and rheumatic diseases.</text></paragraph> 
<paragraph id="HCA519CBF98DE4D1DA3D4EB55EBFED72"><enum>(2)</enum><header>Summit details</header><text>The summit developed under paragraph (1) shall focus on—</text> 
<subparagraph id="H6AAF61DDD98245FDB1E33BD9338024E6"><enum>(A)</enum><text>a broad range of research activities relating to biomedical, epidemiological, psychosocial, and rehabilitative issues, including studies of the impact of the diseases described in paragraph (1) in rural and underserved communities;</text></subparagraph> 
<subparagraph id="HFDCBEA06EAB14700AEE137BD218D4D42"><enum>(B)</enum><text>clinical research for the development and evaluation of new treatments, including new biological agents;</text></subparagraph> 
<subparagraph id="H62DC12917CF44439A5261D8840647110"><enum>(C)</enum><text>translational research on evidence-based and cost-effective best practices in the treatment, prevention, and management of the disease;</text></subparagraph> 
<subparagraph id="HDC2DF860776B4B078E38B196F622B33"><enum>(D)</enum><text>information and education programs for health care professionals and the public;</text></subparagraph> 
<subparagraph id="HCD9290CA2A4E4E87AF9F4FF474BC5544"><enum>(E)</enum><text>priorities among the programs and activities of the various Federal agencies regarding such diseases; and</text></subparagraph> 
<subparagraph id="H9743701F09E64B3791DE5ED9E9EC4C2"><enum>(F)</enum><text>challenges and opportunities for scientists, clinicians, patients, and voluntary organizations.</text></subparagraph></paragraph></subsection> 
<subsection id="H020111E9E008477EBA7BD914CFD320BF"><enum>(d)</enum><header>Report to Congress</header><text>Not later than 180 days after the convening of the Arthritis and Rheumatic Diseases Summit under subsection (c)(1), the Director of NIH shall prepare and submit a report to Congress that includes proceedings from the summit and a description of arthritis research, education, and other activities that are conducted or supported through the national research institutes.</text></subsection> 
<subsection id="H297DFDA82A2D4AA8907542031EC234BA"><enum>(e)</enum><header>Public information</header><text>The Coordinating Committee shall make readily available to the public information about the research, education, and other activities relating to arthritis and other rheumatic diseases, conducted or supported by the National Institutes of Health.</text></subsection> 
<subsection id="H92E7535D78544E61AE7B98937F8EE1C6"><enum>(f)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated such sums as may be necessary for each of fiscal years 2006 through 2010 to carry out this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H8EE875CE864746699B75C7C78E0672D1"><enum>5.</enum><header>Expansion, intensification, and innovation of research and public health activities related to juvenile arthritis</header> 
<subsection id="H1793ACD2FF534D5A82C394D7A46B5CD7"><enum>(a)</enum><header>Juvenile arthritis initiative through the director of the National Institutes of Health</header><text>Part A of title IV of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/281">42 U.S.C. 281 et seq.</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block act-name="Public Health Service Act" id="HA490AAD4FB964BD0A140F873ECC051E7"> 
<section id="H54BF81A5CEB644E8BEBC7490FD4DC2C0"><enum>404H.</enum><header>Juvenile arthritis initiative through the director of the National Institutes of Health</header> 
<subsection id="HEAA14CED6EC94F41A4660153E9AC2EB4"><enum>(a)</enum><header>Expansion and intensification of activities</header> 
<paragraph id="H99095DA896BC4B09BB64B5AF85954B9D"><enum>(1)</enum><header>In general</header><text>The Director of NIH, in coordination with the Director of the National Institute of Arthritis and Musculoskeletal and Skin Diseases, and the directors of the other national research institutes, as appropriate, shall expand and intensify programs of the National Institutes of Health with respect to research and related activities concerning various forms of juvenile arthritis.</text></paragraph> 
<paragraph id="HFD520E46220A42C683655B14829B2E46"><enum>(2)</enum><header>Coordination</header><text>The directors referred to in paragraph (1) shall jointly coordinate the programs referred to in such paragraph and consult with additional Federal officials, voluntary health associations, medical professional societies, and private entities as appropriate.</text></paragraph></subsection> 
<subsection id="HA526091875AA4F838EF2C90171A9E4D"><enum>(b)</enum><header>Planning grants and contracts for innovative research in juvenile arthritis</header> 
<paragraph id="H09C46F38C6D640D69D5B15DF99D024F5"><enum>(1)</enum><header>In general</header><text>In carrying out subsection (a)(1) the Director of NIH shall award planning grants or contracts for the establishment of new research programs, or enhancement of existing research programs, that focus on juvenile arthritis.</text></paragraph> 
<paragraph id="H0424DF494B1D41C7987DB9BCB57262C0"><enum>(2)</enum><header>Research</header> 
<subparagraph id="H13557A9C7C2A455B87CEB257A37BE9"><enum>(A)</enum><header>Types of research</header><text>In carrying out this subsection, the Secretary shall encourage research that focus on genetics, on the development of biomarkers, and on pharmacological and other therapies.</text></subparagraph> 
<subparagraph id="HBF87938D2F204574AA797199FBF0E29F"><enum>(B)</enum><header>Priority</header><text>In awarding planning grants or contracts under paragraph (1), the Director of NIH may give priority to collaborative partnerships, which may include academic health centers, private sector entities, and nonprofit organizations.</text></subparagraph></paragraph></subsection> 
<subsection id="H5C21C355185240B89581AD8700002C61"><enum>(c)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated such sums as may be necessary for each of fiscal years 2006 through 2010 to carry out this section. Such authorization shall be in addition to any authorization of appropriations under any other provision of law to carry out juvenile arthritis activities or other arthritis-related research.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H0D48C3B165BB4BFEBE67110001615379"><enum>(b)</enum><header>Public Health and surveillance activities related to juvenile arthritis at the Centers for Disease Control and Prevention</header><text>Part B of title III of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/243">42 U.S.C. 243 et seq.</external-xref>) is amended by inserting after section 320A the following:</text> 
<quoted-block act-name="Public Health Service Act" id="H589D38CC2D884ACC8975AE739264C200"> 
<section id="H690AF4FDAFA34A89BFAE23D8FAF003FB"><enum>320B.</enum><header>Surveillance and research regarding juvenile arthritis</header> 
<subsection id="HF284F01F746C47C4854E528DC899AC00"><enum>(a)</enum><header>In general</header><text>The Secretary, acting through the Director of the Centers for Disease Control and Prevention, may award grants to and enter into cooperative agreements with public or nonprofit private entities for the collection, analysis, and reporting of data on juvenile arthritis.</text></subsection> 
<subsection id="HAC3D0746BFA04D73AAADBE08FFCDEF6"><enum>(b)</enum><header>Technical assistance</header><text>In awarding grants and entering into agreements under subsection (a), the Secretary may provide direct technical assistance in lieu of cash.</text></subsection> 
<subsection id="HF728C9EE9EB247D0A9BEC79EF1656743"><enum>(c)</enum><header>Coordination with NIH</header><text>The Secretary shall ensure that epidemiological and other types of information obtained under subsection (a) is made available to the National Institutes of Health.</text></subsection> 
<subsection id="H61DB4FB151BC41ECA8BF0072B516F765"><enum>(d)</enum><header>Creation of a National Juvenile Arthritis Patient Registry</header><text>The Secretary, acting through the Director of the Centers for Disease Control and Prevention and in collaboration with a national voluntary health organization with experience serving the juvenile arthritis population as well as the full spectrum of arthritis-related conditions, shall support the development of a National Juvenile Arthritis Patient Registry to collect specific data for follow-up studies regarding the prevalence and incidence of juvenile arthritis, as well as capturing information on evidence-based health outcomes related to specific therapies and interventions.</text></subsection> 
<subsection id="H3F6C2360A5E94743B3B9FEBE978B58F1"><enum>(e)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated such sums as may be necessary to carry out this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>

<subsection id="HD2B5CC09D080482CB3C59D25D84D89B9"><enum>(a)</enum><header>In general</header><text>Part Q of title III of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/280h">42 U.S.C. 280h et seq.</external-xref>) is amended by adding at the end the following:</text>

<paragraph id="H218B9B162696408AA0457015E170DD01"><enum>(1)</enum><text>an increase in the number and size of institutional training grants awarded to institutions to support pediatric rheumatology training; and</text></paragraph> 
<paragraph id="H2FD0C6C826C34DB8A2E2C7D900367CDD"><enum>(2)</enum><text>an expansion of public-private partnerships to encourage academic institutions, private sector entities, and health agencies to promote educational training and fellowship opportunities for pediatric rheumatologists.</text></paragraph></subsection> 
<subsection id="H60AB3889EBEE48A680562B029EF8BD9C"><enum>(b)</enum><header>Authorization</header><text>There are authorized to be appropriated such sums as may be necessary for each of fiscal years 2006 through 2010 to carry out this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HA9976E2520E54F3D82EABADBB3C163ED"><enum>(b)</enum><header>Pediatric loan repayment program</header><text>Part Q of title III of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/280h">42 U.S.C. 280h et seq.</external-xref>), as amended by subsection (a), is further amended by adding at the end the following:</text>

<section id="H33AF5791E19A4617BF911C241E823C57"><enum>399BB.</enum><header>Pediatric rheumatology loan repayment program</header> 
<subsection id="H59B43003BCE64A48BC051D9710CAD589"><enum>(a)</enum><header>In general</header><text>The Secretary, in consultation with the Administrator of the Health Resources and Services Administration, may establish a pediatric rheumatology loan repayment program.</text></subsection> 
<subsection id="H8C31609C9AFA4001888DBD575FA58E00"><enum>(b)</enum><header>Program administration</header><text>Through the program established under subsection (a), the Secretary shall—</text> 
<paragraph id="H133B9CF4E963475E9934268EEF61EA4B"><enum>(1)</enum><text>enter into contracts with qualified health professionals who are pediatric rheumatologists under which—</text> 
<subparagraph id="H3CFF752465CD4522A6EB3CEC31C300D4"><enum>(A)</enum><text>such professionals agree to provide health care in an area with a shortage of pediatric rheumatologists; and</text></subparagraph> 
<subparagraph id="HF073770CA8CE47D196749CC2D0BEC4A1"><enum>(B)</enum><text>the Federal Government agrees to repay, for each year of such service, not more than $25,000 of the principal and interest of the educational loans of such professionals; and</text></subparagraph></paragraph> 
<paragraph id="HFE7808B361C04DDD9434D8482CA2D02D"><enum>(2)</enum><text>in addition to making payments under paragraph (1) on behalf of an individual, make payments to the individual for the purpose of providing reimbursement for tax liability resulting from the payments made under paragraph (1), in an amount equal to 39 percent of the total amount of the payments made for the taxable year involved.</text></paragraph></subsection> 
<subsection id="H6A83D392529B4B17B40017ADFB002C73"><enum>(c)</enum><header>Funding</header> 
<paragraph id="H1FFDDF2610F547AAB0636C20578456A1"><enum>(1)</enum><header>In general</header><text>For the purpose of carrying out this section, the Secretary may reserve, from amounts appropriated for the Health Resources and Services Administration for the fiscal year involved, such amounts as the Secretary determines to be appropriate.</text></paragraph> 
<paragraph id="H346812E03C97447AA6F9EABB0300D02C"><enum>(2)</enum><header>Availability of funds</header><text>Amounts made available to carry out this section shall remain available until the expiration of the second fiscal year beginning after the fiscal year for which such amounts were made available.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="HBE319B8E27344A9C9199CA3842420001"><enum>7.</enum><header>Career development awards in pediatric rheumatology</header><text display-inline="no-display-inline">Part G of title IV of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/288">42 U.S.C. 288 et seq.</external-xref>) is amended—</text> 
<paragraph id="H6D30A918A661451FA535BC928BAF7690"><enum>(1)</enum><text>by redesignating section 487F (as added by <external-xref legal-doc="public-law" parsable-cite="pl/106/310">Public Law 106–310</external-xref>) as section 487G;</text></paragraph> 
<paragraph id="H9D05D57C898F4E519EF2A34DD7B73DAA"><enum>(2)</enum><text>by inserting after section 487G (as so redesignated) the following:</text>

<subsection id="H655B1C3E7A8C4DE88F11EC00B3E3D314"><enum>(b)</enum><header>Authorization of appropriations</header><text>There are appropriated such sums as may be necessary to carry out this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HD2541AD2E6464DC881F47BCFD0EE8FAC"><enum>8.</enum><header>General accounting office study of arthritis and the workplace</header> 
<subsection id="H0735DCB761F04577B29795D5D8F53F1E"><enum>(a)</enum><header>Study and report</header><text>Not later than 3 years after the date of enactment of this Act, the Comptroller General of the United States shall conduct a study on the economic impact of arthritis in the workplace, and submit a report to the appropriate committees of Congress containing the results of the study.</text></subsection> 
<subsection id="H882997B54753476A8D57B34811C4CF18"><enum>(b)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated such sums as may be necessary to carry out this section.</text></subsection></section>
